GUAM INDUSTRY FORUM 2018 By John M. Robertson
There is no longer the need for speculation about the Guam Military Buildup because it is underway. First word of the buildup came in 2004 when diplomat Richard Lawless stopped off in Guam on his return to Washington from Tokyo. There have been many false projections and obstacles along the way since then and there will be more ahead but now, with certainty, the US “Pivot to the Pacific” is real. There have been three previous industry forums related to buildup in the past but this one will be different and hopefully more interesting and beneficial for local Guam engineering and contracting firms as well as those from the mainland United States, Japan, and elsewhere. This March 2018 event will be different from previous industry forums primarily because it is being organized by the Guam Post of the Society of American Military Engineers with support from the Guam Contractors Association and the Guam Chamber of Commerce. The effort is being led by persons with broad experience in the engineering and construction contracting industry with the intent of keeping focus on what people in the industry want and need to know. The forum organizers are receiving no financial support from the government. Seed money was borrowed from the SAME Guam Post engineering scholarship account, putting the Guam Post at risk. Any surplus of monies, if any, remaining after all registration fees are collected and bills paid will benefit the scholarship fund. Members of the organizing committee are volunteering their time. That includes Noel Enriquez, Wayne Cornell, LT Timothy Dahms, Ilana Almquist and John Robertson of the Guam Post and Catherine Castro of the Chamber of Commerce and Bill Beery of Contractors Association. The committee has contracted with RiMS – Ruder Integrated Marketing Strategies for expert assistance. Attendance is expected to be in the range of 800 persons.

Rey Llaneta, in much the same Tom Cruise (Knight and Day) tongue and cheek tenor, declares matter-of-factly... “I’m the guy” on the ground. I’m trying to make things happen, especially, for Guam. I’d really like to see my vision come to fruition—that U.S. quality standards, excellence, will be coveted by countries within our Pacific region. He says simply, “I really believe that our people can make a name for themselves in the Pacific.” Llaneta has been “working on this” vision around 8 years. And, in that time he has been injecting the idea initially of doing business via the Asian Development Bank (ADB). Over the past few months that position has taken on a new iteration —multiple opportunities have surfaced.. Essentially, Llaneta, each year, invited Guam businesses and other individuals, over the past 7 to 8 years, to explore the opportunities available, primarily, via the annual Asian Development Bank(ADB) Business Opportunities Fair, held in Manila. Toward the latter part of 2017, that model morphed a bit, from the resource-side and the opportunities-side into a consortium of 8 companies which are expressing their collective and individual interest(s).
On the opportunity-side, the US Commercial Service's Liaison Office to the ADB visited Guam. Gregory Harris, American Director/Senior Commercial Officer, to the ADB. Harris was encouraged by Llaneta to channel the Guam-American businesses to take the action step to engage themselves abroad, namely, the Asia-Pacific, via the ADB project needs. Such a meeting, per Llaneta’s Guam Consortium’s drive, UOG’s SBDC and Endowment, and the Governor’s Office, took place at the University of Guam, Small Business Development Center(UOG SBDC) at an event called “Commercial Opportunities in the Asia Pacific Region” on September 28, 2017.

The U.S. Commercial Service's Liaison Office To The ADB Who We Are The U.S. Commercial Service's Liaison Office to the Asian Development Bank (CS ADB), based in U.S. Embassy in Manila, is part of the U.S. Department of Commerce’s global network of export development offices. CS ADB works directly with U.S. firms to target major project, consulting and procurement opportunities generated from the Asian Development Bank’s direct lending and grant activities. CS ADB captures these opportunities and sends them out as monthly reports entitled "Foreign Government Tenders". CS ADB also works with U.S. sponsors/developers of private projects who can benefit from the lending and risk mitigation activities of the ADB’s Private Sector Department, and the ADB’s Office of Co-financing Operations. Our Mission The CS ADB office was created by the U.S. Congress to provide assistance and advocacy for U.S. firms pursuing business opportunities generated by the ADB's lending and grant activities. The office’s staff of five is led currently by an American Director/Senior Commercial Officer, Mr. Gregory Harris, and works closely with the U.S. Executive Director to the ADB, Ambassador Swati A. Dandekar, and his staff. We began operations in 1992. The point: it appears that Guam/U.S. businesses (resources) have been matched with the real project needs (opportunities). And, that picture gets even brighter with some other revelations Llaneta conveyed beyond the ADB umbrella—NAVFAC and US AID. ADB—pushes out $30 Billion annual, to rid poverty in their respective 20- member countries NAVFAC Philippines—estimated $150 Million(from $50 Million), Civil Military Affairs, Enhanced Defense Cooperative Agreement (EDCA) will require U.S. construction standards for projects approved and locally awarded and administered via NAVFAC Philippines. And now, for the first time, NAVFAC Philippines (will be a stand-alone entity as a Regional Officer in Charge of Construction (ROICC)), whereas previously, they received their authority via NAFAC Thailand. CRANES AND DERRICKS OPERATOR CERTIFICATION COMPLIANCE DATE EXTENSION - FREQUENTLY ASKED QUESTIONS
A monthly crane and rigging informative column for all personnel directly or indirectly involved with crane safety. Each month we will attempt to explain a different technical issue pertaining to crane operations here on Guam, addressing the sometimes over-looked or misunderstood topics by management and operators alike. By Dave Barnhouse OSHA announced that it has changed the the Subpart CC—Cranes and Derricks deadline for crane operator certification by one year, to November 10, 2018. The following is a set of questions and answers that discuss this proposal and its effects on the construction industry. Question #1: Why has OSHA extended the compliance date for crane operator certification? Answer: OSHA extended the compliance date for crane operator certification to ensure it has enough time to complete a rule making addressing two issues raised after publication of Subpart CC – Cranes and Derricks. First, Subpart CC—Cranes and Derricks requires that operator certification be by “type and capacity.” The two largest testing organizations have issued certifications by “type” but not “capacity.” These certifications are not currently valid under Subpart CC. The Agency is concerned that this will disrupt the construction industry severely, both for employers and crane operators who thought their certification would be valid. Second, many crane industry representatives requested that OSHA revise the crane standard to preserve a requirement that employers assess the ability of their operators to run the cranes to which they are assigned. In order to address these issues, OSHA extended the compliance date for crane operator certification by three years, until 20 | JANUARY2018
November 10, 2017. OSHA now needs one additional year to propose and finalize the rule making addressing these issues. Question #2: OSHA extended the compliance date in 2014 by three years to November 10, 2017. What steps has OSHA taken during this period of time to address the stakeholders’ issues? Answer: After extending the compliance date, OSHA considered options for addressing stakeholders’ concerns. The Agency decided that rule making would be necessary for consideration of any revisions of the requirements in the final rule for Subpart CC. To gather more information, OSHA spoke with over 40 industry representatives about how they currently ensure crane operator competency. Based on this information, OSHA revised crane operator requirements and presented the draft to the Advisory Committee for Construction Safety and Health at a meeting on March 31 and April 1, 2015. Considering feedback from this meeting, OSHA revised the crane operator requirements and preamble www.guamcontractors.org

Several other OSHA standards required significant time and resources from both OSHA and the Solicitor’s office, which delayed proposing revised crane operator requirements as early as intended. OSHA now needs the additional year to ensure that the public is permitted adequate opportunity to evaluate and respond to the proposal.

Question #3: What crane operator requirements are in place right now? Answer: Currently, OSHA requires employers to: • ensure that operators of cranes covered by the standard are competent to operate the equipment safely; • train their employee prior to operating the equipment when that employee is assigned to operate machinery and does not have the required knowledge or ability to operate the equipment safely; and • ensure that each operator is evaluated to confirm that he/she understands the information provided in the training. These are the same requirements that have been implemented since publication of Subpart CC in 2010. If the proposed rule is finalized, these requirements will remain in place until November 10, 2018. Question #4: If a crane operator’s certification now only specifies type, but not capacity, will the operator have to get another certification by November 10, 2017, now that OSHA’s proposed extension has taken effect? Answer: No. Certification is not currently required because of the previous extension, and OSHA has extended the compliance date for the operator certification requirements again to November 10, 2018. Since this extension is finalized, November 10, 2018, would be the earliest date on which certification would be required.

Iridium To Grow Service With The Launch Of New Satellites By: Shawn Gumataotao A little while ago, SpaceX launched 10 communications satellites into low-Earth orbit for the Virginia-based company Iridium. In the lead up of a week filled with heavy rain and strong winds, just a few clouds dotted the skies in Southern California when the rocket climbed skyward. The first batch in a $3 billion 72-satellite network that will replace the company’s current fleet of aging low-Earth-orbit mobile voice and data relay stations. The stakes are high for both companies. For SpaceX, which has now lost two of 29 Falcon 9 rockets -- one in flight and one on the ground -- a successful mission will help restore confidence in the low-cost boosters and clear the way for a resumption of commercial and government launches that have been on hold since a September mishap. For Iridium, the launch was the first step in a complex satellite-by-satellite swap out, part of a long-range effort to retire satellites that have operated long past their design life, replace them with upgraded, more capable spacecraft and expand the company’s capabilities in an increasingly competitive commercial space operations environment. 22 | JANUARY2018
“Frankly, it means our future, because we have to replace this network anyway,” Iridium CEO Matthew Desch said in an interview with CBS News.
Daniels is excited about the short term prospects in which there will be due to couple of satellites that are not working at 100%.
Going into the long replacement operation, Desch said the first order of business is “to do no harm to our 800-and-some-thousand current subscribers. So the new satellites do everything the old satellites did, but they do a whole lot more. It really gets us seriously into sort of broadband connections.”
Down the road, the software upgrades implemented after launch, the first-generation satellites can relay voice and data at ISDN-class speeds, but the Iridium NEXT spacecraft will work at up to 1.4 megabits per second or "a whole lot more performance".

"In the big picture, the new constellation which will take about two years to get launched and fully operational - will offer higher speed data solutions," wrote Daniels in an email. " Of course, higher data speeds come at a higher price. All pricing is still yet to be determined, and higher speed service won't be available until late this year."
