President’s Letter
Hafa Adai GCA Members! As I had mentioned in the January issue of the CNB, GCA will be celebrating its 60th Anniversary on November 5, 2019. Guam is also celebrating its 75th Liberation Day and to commemorate both milestones, GCA and its members along with the GCA Trades Academy, will be participating in this year’s Liberation Day parade. The theme for this year’s Liberation Day festivities is “Legacy of Peace and Friendship”. Our float will showcase what the industry has done in the past 60 years of building Guam to what it is today. We envision a more modern and sophisticated float to incorporate modern building materials, supplies and design. We’re open to ideas on what our float should look and feel like. If you’re interested in participating in the float building project, please contact the GCA office for updates on the planning meetings. Along the same line of celebrating our 60th Anniversary, this year’s premier event, the 2019 GCA Excellence in Construction Awards and Contractor of the Year Award will be held on November 16, 2019. It was delayed by about a couple weeks this year to accommodate a special guest who is an advocate of the construction trades and a motivational speaker that we had invited from off-island to participate in the many events planned for that week in celebration of our industry and our 60th Anniversary including the EIC/COY Awards Gala. This year’s EIC/COY Awards Gala is looking to be “off the chart” this year. More on that later as we come closer to the events. However, the deadlines for the EIC/COY will remain the same as we have to meet the deadline to submit our entries for the 2019 Associated Builders and Contractors (ABC) National EIC Competition which is on October 30 , 2019. Finally, at last month’s GCA Board of Directors meeting, the GCA Marketing and PR Committee presented a marketing plan to the board for their consideration and approval. This program is called C.O.R.E (Contacts, Opportunities, Resources and Education) and was adopted from the ABC Keystone Chapter. ABC Keystone Chapter won ABC’s Best Practice Award for this marketing program. The C.O.R.E. Sponsorship Program is a convenient, value-added, marketing, events and training package that allows member companies to increase their exposure in the association while saving money and making sponsorship decisions once for the entire year. The program features “FLEX spending credits” and a wide range of sponsorship levels for every company’s size, giving the freedom to meet individual needs and participation goals. The marketing team will be presenting this program to our members sometime this summer with plans to launch in January 2020.

UNIVERSITY OF GUAM - SCHOOL OF ENGINEERING Background 1989: UOG established a Pre-Engineering (2-yr) Program 2009: UOG began a movement to create a new School of Engineering (SENG) 2016: UOG established a SENG 2017: An Advisory Council was established to provide guidance and feedback in the development of a 4-year engineering degree program 2018: UOG Board of Regents approved a Civil Engineering Bachelor of Science degree program 2019: Construction of a new SENG building began on March 2019; Courses in Civil Engineering program to be offered starting August 2019. 2020: Anticipate construction of SENG building to be completed in 2020. Challenges Much progress has been made in the last 10 years to bring a dream of a fully accredited 4-year Engineering Degree Program to reality, however there are still challenges to be overcome. Hiring Faculty – Currently have 5 full-time faculty (1 Civil, 2 Struc, 1 Env, and 1 Geotech) – Will be hiring 2 additional faculty (Env and Hydrology) Developing Curricula – Developed with an Advisory Council consisting of representatives in the engineering field from private, public, and military organizations Attracting Students – Summer Internship Program (GPA, GWA, NAVFAC Marianas, Firms) – Student Scholarships and SAME Guam Post Student Chapter – Student Research/Teaching Assistantship SENG Building/Facilities – 7 faculty and admin. Offices; 4 labs; 3 classrooms – Funding to equip labs (Hydraulics, Structure, Soil and Computer) is still needed; SENG seeking support. ABET (Accreditation Board for Engineering and Rendering of the UOG School of Engineering Technology) Accreditation – Evaluation is an 18-Month, five-step process. – Request must be accompanied by one official transcript from a recent program graduate.

Say Goodbye to DUNS Numbers; Hello to SAMMI The General Services Administration (GSA) recently awarded a $41.8 million contract to Ernst and Young LLP to provide a new government-wide entity validation services system. The system will replace the Data Universal Numbering System (DUNS) provided by Dun and Bradstreet (D&B) since 1998. The new vendor verification process will be a government-owned unique entity identifier called the System for Award Management Managed Identifier (SAMMI) within SAM.gov system. GSA plans to reengineer the system so the DUNS number will be phased out over the coming months and replaced with a SAMMI, number. D&B will continue to work with GSA during the transition.
Common Mistakes in Proposal Writing 1. Compliance with the RFP or RFQ - Not providing key documents (safety record, legally binding teaming agreement, etc.) or addressing an evaluation element (technical or safety approach) may render your proposal non-responsive or technically unacceptable. 2. Last Minute Submissions - There are many reasons why proposals are turned in at the last minute. A lot has to do with running the business first. It’s a matter of priorities. Business operations tend to detract from focusing and preparing a sound proposal. Adding to that is a natural tendency to procrastinate. That 30-day period to respond to a solicitation quickly becomes a 2-3 day rush to “finalize” and package the proposal.

Unfortunately, “last minute” preparations often lead to: 3. Boilerplate Proposals – Taking a similar proposal and tweaking it to fit current solicitation requirements might be a faster way to develop a proposal. But, sometimes “cut and paste” jobs are very obvious to Evaluation Teams and can impact the overall evaluation. 4. Mathematical, Grammar and Punctuation Mistakes Can make the difference between winning and losing a contract. These mistakes happen easily in the rush to complete a proposal in time or insert last-minute changes to the proposal. Proofreading your work is essential.

It is kind of difficult to write about the Internet...on the Internet. It is not hard in the sense of coming up with information; heck, isn’t that part of the reason the thing was invented? No. It seems almost surreal. We live in a world where information is instantaneous and can be shared just as quickly. The click of a button signals another light bulb, a connection to the world beyond our immediate present. For decades, it has been a place where we do not just retrieve information, we put it out there, as well. A digital corkboard at the neighborhood coffeeshop. But, beyond the selfies, cat videos, community events, and otherwise regular fodder, the Internet has transformed the way we learn about the community, industries, and the world around us. It has allowed us to interact with people whom we might never meet; constructing a trail of information that leads us to the Ginger Bread house for us to consume. Don’t worry though, this story has a happy ending. It can be easy to agree the Internet has made our lives a whole lot easier in the last twenty years. First, let’s be glad we don’t have to dial-up anymore. But, more importantly, information - though scattered and sometimes misleading - helps us develop our perspective on issues, but it also potentially educates us about what might not be available.

As we look toward the future of the construction industry in Guam, and the continued growth of our island, it is imperative to link up with government agencies - regulatory or otherwise so we have an idea of the potential implications of our projects and the ever-changing political and legal landscape; the inner workings of our government. “Comprehensive planning is an important tool to avoid conflicts,” stated Edwin Reyes of the Bureau of Statistics and Planning. “...By having people know the guidelines, policies, goal, and objectives that regulate land use on Guam are important so that actions are consistent with what the area zoned for and to ensure the project is compatable (sic) with surrounding uses,” added Reyes. Though the site could use some tweaking - Reyes stated, the site is very user-friendly, and provides a nice electronic platform for what the the agency does best: provide detailed data for natural resource planning in Guam and outreach. According to the website’s ‘About Us’ section, “[BSP’s] mission is to ensure Guam’s resources are effectively used for the benefit of present and future generations by ensuring consistency among various plans, policies and programs.” Further, the site provides a litany of ways of fulfilling its mission, like providing invaluable information for the growth and development of the island, and encouraging partnerships between private and public sectors.

Though the website is still technically under construction, according to Reyes, visitors can still access the Business and Economic Statistics Program, Socio-Economic Planning Program, Planning Information Program, Land Use and Planning Program, as well as the Guam Coastal Management Program and the Coral Reef Initiative. Even as April is Earth Month, it is important - now more than ever - to look at the possible impacts our industry and its develop will have on Guam’s natural resources. The Guam Coastal Management Program was created in 1979. It was an agreement between the National Oceanic and Atmospheric Administration (NOAA) and the Bureau of Planning Office of the Governor. It works in tandem with the Department of Land Management, Department of PublicWorks, Department of Parks and Recreation, Department of Agriculture, and the Guam Environmental Protection Agency. In this intricate web, the agencies work toward development and resource protection. Reyes stated, “Guam is a unique place and because we are only 212 square miles in size, there is not much room for mistakes in terms of how we treat our environment.” He continued by talking about reducing the stress toward our ecosystem, about controlling erosion and sediment in the process of construction, and ensuring healthy coral and sea life. “Meeting or surpassing the erosion and sediment control standards will help the project maintain compliance with the Guam Water Quality Standards and Guam Soil Erosion and Sediment Control Regulation which are in place to protect our precious resources,” he added finally.

As we look toward the future of the military buildup, most in the industry have taken steps to ensure little is done to detrimentally affect our island. However, more than that, we need only make a few mouse clicks, and possibly a few phone calls, to get some information that can help move our projects forward without any delays and with the most efficiency. Reyes stated, “Knowing the regulation will help the project be successful because it allows the owners and those involved in construction to understand what the expectations of the government are upfront so that compliance can be achieved and it will help the project avoid any potential fines, stop orders, and other cost accumulating delays that comes from mitigating problems ‘after the fact’.” Additionally, Reyes summed it up by stating, “Ultimately we all have to work together to ensure Guam's natural charm is protected. Protecting this beauty doesn't mean we don't develop, but rather we hope to create a paradigm where development can incorporate natural and beneficial features into its design so we can achieve economic prosperity and environmental stewardship.” This is why we pull together our collective resources to promote success for all. I remember my senior literature teacher telling me, “no man is an island.” I’m sure John Donne had some deeper meaning to it all, but I also know that we can’t do everything on our own. EEOC Alert: Employers Should Monitor EEO-1 Developments ABC members should continue to monitor developments after a recent court order dealing with the EEO-1 form enforced by the Equal Employment Opportunity Commission. The form has long required employers with more than 100 employees and government contractors with more than 50 employees to list the number of their employees in job categories by race, ethnicity and gender. This data, known as “Component 1 data” is due this year by May 31, 2019. However, there is controversy over a new set of data on the EEO-1 form called
“Component 2 data,” which the Obama administration asked employers to start collecting for the first time this year. The new data would report employee compensation in “pay bands” by race, ethnicity and gender. During the Trump administration, the Office of Management and Budget blocked the EEOC from forcing employers to submit any compensation data until recently, when a court ordered the OMB stay to be vacated. The impact of the court order is to suddenly revive the burdensome pay data requirement with very little time for
employers to respond. The EEOC has also told the court it is not ready to receive compensation data. At this time, the issue remains unsettled, and ABC is involved in efforts to reverse the court’s decision or at a minimum extend the time period for employers to comply with any new Component 2 pay data requirement. The Component 1 data is still due by May 31. We will keep members apprised of updates in the court case as they occur.

OFCCP Announces 2019 Updates for Federal Contractors Last week, the Office of Federal Contract Compliance Programs issued the latest Corporate Scheduling Announcement List and an updated hiring benchmark for veterans protected under the Vietnam Era Veterans’ Readjustment Assistance Act. FY19 Corporate Scheduling Announcement List On March 25, the OFCCP released its fiscal year 2019 CSAL, a courtesy notification that lists 3,500 selected contractor establishments for an upcoming compliance review of their affirmative action goals, outreach activities and recruitment efforts for protected groups, according to the OFCCP website. The CSAL provides at least a 45-day notice before these establishments undergo a Corporate Management Compliance 22 | APRIL2019
Evaluation, Functional Affirmative Action Program review or Section 503 Focused Review. More information on the FY19 CSAL can be found on the OFCCP website and in an analysis published by ABC’s general counsel, Littler Mendelson P.C. VEVRAA Hiring Benchmark On March 27, the OFCCP announced it has lowered its hiring benchmark for veterans protected under VEVRAA to 5.9 percent from 6.4 percent, effective for affirmative action plan years starting on or after March 31, 2019. Under VEVRAA regulations, the OFCCP’s hiring benchmark reflects the percentage of total hires in the civilian labor force who are protected veterans, and
contractors who are required by VEVRAA to develop a written affirmative action program must also reach the benchmark provided by the OFCCP each year. While the OFCCP offers a national benchmark determined through data from
the U.S. Bureau of Labor Statistics, contractors can also develop individualized hiring benchmarks using five factors found on the OFCCP website. More information on VEVRAA and the updated hiring benchmark can also be found in an analysis published by Littler Mendelson P.C.

ALL CONSTRUCTION WORK INVOLVING EARTHMOVING ACTIVITIES REQUIRES A PERMIT • Guam EPA will cite all contractors who perform earthmoving without a permit • Fines up to $10,000 per violation, per day may be assessed for failure to obtain a permit, starting at the date the earthmoving began • Guam EPA shares all construction-related NOVs with the Guam Contractor's Licensing Board • Projects larger than 1 acre also require coverage under the USEPA's Construction General Permit requires preparation of stormwater pollution prevention plan (SWPPP)
