Dear GCA Members:

President’s Letter

We just received notice the Chief Judge Frances Tydingco-Gatewood has overturned the Magistrate decision granting contempt. Our lead attorney in the case, Jeff Joseph of Joseph & Hall P.C. has issued the following statement about the decision. The Plaintiffs are, understandably, upset by the Chief Judge’s decision to overturn the decision of the Magistrate Judge granting contempt. More importantly, however, this decision is promising for the Plaintiffs as we head into the next stage of the case. First, the Chief Judge considers the government to have conceded that the government has simply has not been properly investigating or determining whether the temporary need requirement has been met for decades and on thousands of approvals. She states that the government has conceded that it has been “rubber-stamping,” these cases. Then, she chastises the government for “attempting to establish the rationality of its present actions by disclaiming the rationality of its past ones.” She states that “such a strategy raises serious jurisprudential concerns, as it involves an attempt to simultaneously invoke and rebut the presumption of regularity attendant to agency decision-making.” This is crucially important for the Plaintiff ’s case, because the government is essentially claiming that they have just been “making a mistake” for decades—a mistake on which the Plantiffs and class have relied. Plaintiffs absolutely reject the argument that the government has simply made thousands upon thousands of consistent mistakes for decades. Rather, as we have claimed in the complaint and have maintained throughout the litigation, this government has changed the law and changed the interpretation of temporary need without following the basic rules of the democratic process. If you are going to change the rules of the game, you have to provide notice and comment to the public. They did not do that in this case. We believe the statute and regulations are clear in this case and not subject to any new interpretation by USCIS (especially after years of consistent approvals). And, even if the government claims the statute and regulations are unclear, the pattern of consistent approvals over decades means that this new interpretation should not be persuasive to the court and is not entitled to deference. As we move into the final stages of this litigation, the Plaintiffs intend to prove that, despite the governments claims that they simply made thousands of mistakes, the facts will show that temporary need has been considered and analyzed by the USCIS in approving these petitions over the decades and that those decisions were not just “rubber-stamped.” Rather, the agency has simply changed its mind. The agency can certainly do that, but not without notifying the public and allowing for comment. As the Supreme Court recently said in Kisor v. Wilkie, “a court should decline to defer to a merely ‘convenient litigating position’ or ‘post hoc rationalization advanced’ to ‘defend past agency action against attack.’” And, “a court may not defer to a new interpretation, whether or not introduced in litigation, that creates ‘unfair surprise’ to regulated parties. . . That disruption of expectations may occur when an agency substitutes one view of a rule for another.”

Giants.

Stuff of legend, right? Overgrown, often misunderstood, humans with extensive powers with a knack for knocking things over. They usually come from faraway lands with the likes of wizards and witches, trolls, and princes and princesses. But, we also know giants to describe the amazing individuals and organizations within a community. Those whose hard work, contributions, determination, and vision for the people they live among are meant to make lasting, positive change and growth for everybody. The giants in our community do this with care and commitment for making our slice of paradise even better for everybody who calls Guam ‘home’. However, more than that, we see the dedication and gumption of companies and services every day that help our island and her people grow. These ‘giants’ go above and beyond - promoting excellence, enthusiasm, perseverance, and above all else, the laborious spirit to do extraordinary work for our community. The Guam Contractor Association celebrates and congratulates two giants who have continuously demonstrated all the positive attributes listed above. Congratulations to Hawaiian Rock Products Corp as the Guam Contractor Association’s Contractor of the Year 2019 and Black Construction Corporation for Excellence in Construction.

Unless you’ve been living under a rock, these names might go right over your head. However, we know these giants in construction on our island as movers, shakers, and builders; good ones at that. It isn’t enough to look at their accolades and accomplishments. Over the years, it really has been about how each individual organization has - and continues to - build up our community - literally and figuratively. Sure, in an industry propelled by friendly competition, it also moves forward with a synergy for the greater good of both the industry and the island. We look to moments when these giants worked together in the 1970s with the Guam Contractors Association to raise money for a court case against the United States Department of Labor. But, even more than that, we look to moments when they have set the example in their work ethic and finished product for the smaller giants. We usually write two different features for the Excellence in Construction and Contractor of the Year awards, but it is important for these organizations and their employees to share the limelight in their continued, exemplary work and professionalism that has spanned decades and innumerable accolades that may as well take up the entire article - believe me when I say the list could reach the word quota and then some.

Both giants have celebrated over six decades in Guam within the last two years, which demonstrates their longevity and commitment to the island. This goes beyond their projects and really looks at what they do for the community - whether it’s hiring and training the local workforce, an impeccable safety record, providing quality end-products, or their commitment to efficiency and sustainability for the environment.

That’s exactly what these two organizations have put together. It is what the industry and the community have come to know them for and expect from them as well. More than anything, it shows the dedication, skillset, and drive of their employees, who for decades have been working to move our island toward growth, development, and prosperity because they believe in the island, her people, and her future.

For as long as I’ve been writing the features for the Excellence in Construction and Contractor of the Year features, I’ve always struggled with how to write them. What do I write that hasn’t already been written before? Shoot. If I’m still in the job next year, I’ll probably be wracking my brain again. However, because of the frequency with which their narratives have been written, we see a common pattern - commitment, care, and - of course - excellence.

And, it’s true. When we celebrated the 60th anniversary of Black, Leonard Kaae, Senior Vice President and General Manager of BCC, said their longevity stems from how much their company believes in Guam. For HRP’s 60th, HRP’s President Jerrold Johnson spoke emphatically about investing in their employees and building relationships with their customers. That is excellence, according to Aristotle, isn’t it?

Aristotle is credited for saying “Excellence is never an accident. It is always the result of high intention, sincere effort, and intelligent execution; it represents the wise choice of many alternatives - choice, not chance, determines your destiny.” It makes a lot of sense.
