President’s Letter

Hafa Adai! GCA Members! This July 21st, Guam celebrates it’s 75th Liberation Day and GCA is proud to participate in this historic event this year. This will be the first time in the history of the association that we will be participating in the annual parade to commemorate the 75th Liberation Day and to our own 60th Anniversary of the Guam Contractors Association. Our GCA float will showcase the playhouse that was constructed and painted by the students of the GCA Trades Academy and will be donated by the GCA Trades Academy to Island Girl Power after the parade. We will showcase young adults and children on the float doing construction activities to show our future craft professionals and the diversity of our future workforce. Following our lead in the parade are Dewitt Transportation, Matson Navigation, Mid Pac Far East and Barrett Plumbing who are also participating with GCA in the Liberation Day parade. When our first woman Governor and maga'håga Lou Leon Guerrero was elected to office in November 2018 and most senators who were also elected that same year were women, there was a lot of buzz about women leading our government. 2019 was dubbed the Year of the Woman! Well, this month’s feature article in CNB highlights OUR very own women in the construction industry who have held leadership roles in their respective companies for many years and have garnered distinguished accolades in their roles in business and community service. All the women featured in this article also played a vital role in GCA and the GCA Trades Academy (GCATA). Bernadette N. “Bernie” Valencia, vice president and general manager, Matson Navigation Co. Inc. and a member of the GCATA Board of Directors won the Guam Business Magazine Executive of the Year in 2018, Mary Grace Jacot, president and CEO of S.E.T. Pacific Inc. and a GCA Board of Director Member also won the Guam Business Magazine Businesswoman of the Year that same year. And lastly, our current GCA chairwoman and president of Barrett Enterprises Inc., Jessica Barrett took the honors of the Guam Business Magazine Businesswoman of the Year in 2019. We congratulate these women for all their accomplishments and accolades and to all the women in the construction industry who have chosen an exciting career to be in. Just a small fun fact about women in the construction industry. Women in the U.S. earn on average 81.1 percent of what men make. The gender pay gap is much narrower in the construction industry. In construction, women earn on average 95.7 percent of what men make. This is according to the April 2017 Bureau of Labor Statistics Report 1065. Ladies, isn’t it time to get skilled and join the industry? Ask any of the ladies featured in this month’s CNB about the exciting careers in construction for women. Have a safe Liberation Day and Biba Guam!

In order to meet Guam’s future needs with building, managing and maintaining its changing infrastructure and facilities, the island must produce more STEM professionals. SMALL BIZ NOTES NAVFAC Marianas awarded about $153.3M in contracts from October 2018 through June 2019 on which Small Business (SB) concerns may participate as prime or subcontractors. Of that amount, about $91M was awarded to SB concerns to provide a variety of products and services on Guam. ARE YOU A MICROMANAGER? Detail-oriented,” “hands-on,” and “having high standards of performance” are a few traits often used to describe leaders. However; too much of a good thing can turn a successful leader into a micromanager. Micromanagement does nothing but increase stress, lower morale, and reduce productivity in an organization. We may not realize we are micromanaging, but we can get an idea by considering the following questions: • Do you see most of your staff as an underperformers? • Do you insist on being copied on every email your employees send? • Do you get frustrated and complain when an employee completes a task differently from how you would? • Do you delegate tasks only to those who can perform them as well as you? • Do you not let employees make decisions on their own? • Do you go to or supervise meetings your subordinates hold and make decisions? If you answered “yes” or even a “maybe” to most or all of these questions, you may be a micromanager.

Some tips on how you can change that: • Face your fears. Micromanagement often stems from a fear of failure. You want the job done correctly and sometimes employees believe can’t perform unless they’re micromanaged. Allow employees to perform on their own. They may make mistakes, but there are valuable lessons to learn and grow from failing. • Delegate small tasks. Focus your efforts on high-priority items where you can add the most value. • Keep it simple. Micromanagers often give very detailed instructions. Limit directions to essential information and allow employees to use their discretion on how to accomplish the task. • Say “what,” not “how.” Tell your employees “what” you want to accomplish, but don’t tell them “how” to get it done. • Open lines of communication. Welcome and encourage ideas from your employees. Incorporate those ideas to show you appreciate and trust their input and to develop a strong sense of teamwork.

Before writing this and sipping my cold brew coffee, I was pulled into a short little snippet about the new Disney live-action remake of Mulan. If you haven’t already heard, the reboot moves in a slightly different direction - taking out the beloved musical aspect, as well as everyone’s favorite talking dragon, Mushu. Over the years, Disney has created landscapes beyond our 2D lenses. They have changed some of the narratives for characters - they have given a voice to others. They have helped change some of their most beloved characters from the stereotypical damsels into dynamic heroines and leaders. But, let the record reflect, it is not live-action if some of these visuals are created through CGI - am I right? In some respects, Disney is helping push a message of empowerment and leadership rather than “damsel in distress”. Though not a Disney princess, for the women in the construction industry, Rosie the Riveter comes to the forefront: the Norman Rockwell icon for females being called to work in industrial jobs at a time when the war called men away from factories and such. According to History.org, “Between 1940 and 1945, the female percentage of the U.S. workforce increased from 27 percent to nearly 37 percent. The National Association of Women in Construction’s (NAWIC) website says three years ago, there were just under one million women (939,000) working in various sectors of the construction industry. 31-percent were in professional or management positions and 21-percent were in construction and maintenance positions. However, that 939,000 was just a little under 9-percent of the total workers in the construction industry. Further, that number saw a decrease from 11 years prior, where in 2005, there were over a million women in the construction industry. NAWIC’s website also stated, “The gender pay gap is much narrower in the construction industry. In construction, women earn on average 95.7 percent of what men make.” Alas, there has been a stronger push to have more females in this industry. In an article on cnbc.com written by Courtney Connley, the construction industry in the United States is expected to grow some 12-percent within the next seven years, this according to the Bureau of Labor Statistics. In Guam, who knows what that will look like with continued industrialization, as well as the military buildup, and numerous projects to recruit within and build the local workforce. In Guam, we have ManMaga’håga: the female clan leaders of ancient CHamoru society according to Guampedia.com. Last year, islanders elected their first female governor - Maga’håga Lourdes Leon Guerrero. In Guam’s construction industry, we have our own Mulans and Rosie the Riveters - our ManMaga’håga of construction. These women - and more are leading the way, setting an example, taking on the projects, but more importantly building a community of support, grit, and perseverance for young women to follow in their footsteps. A few years ago we wrote a profile about Jessica Barrett, President of Barrett Plumbing and Guam’s first CHamoru female certified plumber. Recently named the 2019 Guam Businesswoman of the Year, Barrett described the climate for Like Us On Facebook

the industry for women as “dynamic”, with “lots of awareness of women and the vital contribution they can make to the industry.” She said that some progress has been made over the years, but that “[Women] are still a minority and it is not uncommon to be excluded…” She added that a common misconception of women in the construction industry is “we are not able to perform the duties as well as our male counterparts and that we are not able to add value.” But she does it indicate that it is empowering and encouraging to be a woman in the industry right now. Dr. Jayleen Kent, Ph.D., C.I.T., President of Isla Coatings and Roofing Supply, spoke about how inclusive the industry has become - resulting in a new culture for both men and women. She also commented about the normalization of a career in construction for women. “We have increasing numbers of women in leadership roles who are both spearheading movements to introduce girls and women to construction, and are themselves serving as inspiring role models to other females and males,” stated Kent. Kent, as well as Barrett, and Irene Hicks, President of America’s Best ElectricMart, talked about the community of women who continuously work together and support one another. Hicks commented, “We talk and share our challenges and our successes in both our personal and business life. We encourage and lean on each other. It’s good to know they have my back.” Dr. Kent continued to speak on how she also maintains networks with men in the industry - “We still need guidance from men to ‘socialize’ us in their ‘old boy’s club’ culture; then we can continue more effectively to change it.” Grace Jacot, President and CEO of S.E.T. Pacific, Inc. and last year’s Guam Businesswoman of the Year, stated she has never noticed the advantages or disadvantages of being a woman in construction. “If one focuses exclusively on delivering the best results possible, and succeeds, the gender dynamic all but evaporates.” As she described it, construction work is all about the creation of something that wasn’t there before - “Gender is irrelevant in this process.” For Jacot, work is all about delivery and the quality of the product. She added, “The climate for both women and men is one that rewards excellence...any professional (irrespective of gender) that can competently deliver quality with reliability, will gain the trust and confidence of their client base.” All of these women have a litany of accomplishments and accolades - degrees, awards, and certificates they can display and projects and contracts they can add to their portfolios. But, these women - like the women who came before them embody true grit and perseverance, especially in the face of adversity and hardship. Jacot stated, “‘Failure’ is inextricably linked to ‘success’ just as you can’t know what true happiness is without sadness, or day without night...I fail every day. It is part of the human condition.” Kent echoed, “ I do not believe in failures, only learning opportunities and challenges. Most often I move through challenges by seeking consultation and guidance from those wiser than me.” Bernie Valencia, Vice President and General Manager of Matson, Inc. echoed saying, “There is a leason [sic] learned and an improvement opportunity to take advantage of.”

The future of the industry is definitely about growth and development, but more importantly to be part of projects that will have a lasting impact on the island. Valencia, the Guam Business Magazine’s 2018 Executive of the Year, stated, “There are so many opportunities for women, especially in federal contracting.” She said to get those opportunities, women need to search for them and “be aggressive”. She stated emphatically, “The only way is up!” Dr. Kent stated, “It is and will continue to be a growth industry…[and] can always be a source of pride for children and grandchildren as they look at their cities grow.” She added, “Their mom’s [sic] and grammy’s [sic] in the industry can say ‘I helped build that!’” But, first, it takes getting people to be part of the industry. “Looking forward we have much work to do on developing our local workforce to create a skillset that they can use to make a good living, and this is not enough to supplement the needed workforce in the coming years, [but] it is a good start,” said Barrett. Additionally, she hopes the H2B visa issue gets squared away to prevent any issues in the future. Jacot stated, “I am very optimistic about [the future of ] the construction sector.” She added, “All of the mega-trends, favor growth and productivity for the construction industry in Guam, America’s front porch to Asia.” She continued by talking about Asia’s push in the global economy, advancement in technology, and the U.S.’s push to safeguard regional security, and how these will propel the construction industry in Guam for the future. “Many countries in Asia and Europe have institutionalized the pathway for high school students to enter construction, advanced manufacturing and other sectors of the labor market,” asserted Jacot. “The U.S. has a long way to go to break down the misconceptions and unhelpful barriers for young people to enter these fields,” she expressed.

When the industry and community talk about breaking down barriers and misconceptions, it goes hand-in-hand with outreach. The Guam Contractors Association has organized outreach programs, like Pizza, Pop, and Powertools, focusing on increasing the opportunities for young girls to consider careers in the construction industry with training and activities. In fact, a former DIY Network TV host and “women in construction” advocate, Kayleen McCabe, was invited by GCA as a keynote speaker at this year’s Pizza, Pop & Power Tools event in November. In March 2020, GCA will also launch a new program, Power Up; It’s A Mother Daughter Thing, that would introduce young women and their mothers to exciting careers in construction. The concept of women in construction is not complex, but it is different for whomever you ask. Here in Guam, it requires one to look at what is available - education and certification opportunities - then taking what is available and searching for the opportunities. That in and of itself is a barrier, which is surely being blasted away, but definitely a reboot many more people could get behind. The strength of our island – her people – comes from the hands of women - i ManMaga’håga - who didn’t just break barriers, but constructed networks with one another; the women who supported one another and paved - literally and figuratively - the way for others to build and fortify our community. It’s their ingenuity, perseverance, and inherent desire to do extraordinary work in our island home that continuously inspires the next generation of young women. I don’t know about you, but I am still waiting for a Disney adaptation of the Women Who Saved Guam.

NEWSLINE EEOC Releases Additional Guidance on EEO-1 Component 2 Collection On July 2, the Equal Employment Opportunity Commission updated the Component 2 EEO-1 Online Filing System website to include additional resources for employers. The website now includes a More Info section and a Frequently Asked Questions page. Under the More Info section, the EEOC offers resources to assist employers with filing their Component 2 EEO-1 data, including a sample form, an instruction booklet, a fact sheet and reference documents. According to a notification letter sent to impacted employers, the EEOC has contracted with NORC at the University of Chicago, a non-partisan research institution, to collect the Component 2 data for 2017 and 2018. The web-based portal for the submission of the Component 2 EEO-1 reports for 2017 and 2018 will be active by July 15, 2019 via the Component 2 EEO-1 Online Filing System. Employers will be notified when this filing system is available. The website also lists help desk information to offer filers additional support. Interested parties can contact the help desk by phone at 877-324-6214 or by emailing eeoccompdata@norc.org.

Background In light of a recent court decision, certain employers will be required for the first time to submit detailed data on employee compensation and hours worked (or Component 2 data) for calendar years 2017 and 2018 to the EEOC as part of their annual EEO-1 form submission by Sept. 30, 2019. According to the EEOC’s FAQs, certain employers, including federal contractors, are required to submit EEO-1 2017 and 2018 Component 2 compensation data: • Employers, including federal contractors, are required to submit Component 2 compensation data for 2017 if they had 100 or more employees during the 2017 workforce snapshot period. Employers, including federal contractors, are required to submit Component 2 compensation data for 2018 if they had 100 or more employees during the 2018 workforce snapshot period. • Federal contractors with 50-99 employees are not required to report Component 2 compensation data.

• Federal contractors with 1-49 employees, and other private employers with 1-99 employees, are not required to file either EEO-1 Component 1 data or Component 2 data. The submission of Component 2 data was initiated during the Obama administration. However, under the Trump administration, the Office of Management and Budget blocked the EEOC from requiring employers to submit any compensation data. In March 2019, the D.C. District Court ordered the OMB stay to be vacated. ABC has been active in efforts to reverse the court’s decision or, at minimum, extend the time period for employers to comply with any new Component 2 pay data requirement. On May 3, the U.S. Department of Justice filed a notice of appeal of the court’s decision, but the outcome of the litigation is unclear at this time. The EEOC has since clarified that the appeal does not stay the district court orders or alter EEO-1 filers' obligations to submit Component 2 data, and EEO-1 filers should begin preparing to submit Component 2 data.

EPA Finalizes the Affordable Clean Energy Rule On June 19, the U.S. Environmental Protection Agency issued the Affordable Clean Energy final rule, which replaces the Obama administration’s overreaching Clean Power Plan with a rule that restores rule of law, empowers states and supports energy diversity. In the notice, the EPA finalizes three separate and distinct rulemakings: • Repeal of the CPP; • The ACE rule, which establishes emission guidelines for states to use when developing plans to limit carbon dioxide at their coal-fired electric generating units; and • New regulations for EPA and state implementation of ACE and any future emission guidelines issued under the Clean Air Act section 111(d).

On Oct. 31, 2018, ABC submitted comments in support of the EPA’s ACE proposed rule, stating that the EPA has taken a more reasonable approach to addressing carbon emissions while supporting businesses and jobs and ensuring necessary and essential environmental protections in our communities.

On March 28, 2017, President Trump signed Executive Order 13783, Promoting Energy Independence and Economic Growth, which directed the EPA administrator to review the CPP. Following the review, the EPA published the proposal to repeal the CPP on Oct. 16, 2017 and the new ACE proposed rule on Aug. 31, 2018.

Additionally, ABC submitted comments in support of the EPA’s proposal to the repeal the CPP in January 2018. Had it gone into effect, the Obama administration’s CPP would have imposed strict regulations on coal-fired power plants, increasing compliance and transaction costs and creating uncertainty for America’s small businesses.

OSHA Publishes Webpage on Suicide Prevention The U.S. Department of Labor’s Occupational Safety and Health Administration published a new webpage that provides various resources for workers on suicide prevention. Resources on the OSHA webpage include contact information for the National Suicide Prevention Lifeline, as well as information from the Center for Construction Research and Training, the Construction Industry Alliance for Suicide Prevention, the U.S. Department of Veterans Affairs and more.

According to the OSHA website, suicide is a serious public health concern that can have lasting harmful effects on individuals, families, workplaces and communities. Additionally, men in the construction and extraction industry had the highest rate of suicide among all occupational groups in the United States in 2015, according to the U.S. Center of Disease Control and Prevention. From 2012 to 2015, the rate of suicide among male construction workers increased more than 20%, based on deaths per 100,000 males.

ABC was one of 17 member organizations of the CIASP that met in October 2018 to collaborate on how to equip companies to better address mental health issues and reduce the risk of suicide in the construction industry.
