HAPPY NEW YEAR! With a blink of an eye, we’re already in the second decade of the millennium. We wish all our members a prosperous year ahead. We have exciting things happening at GCA in the coming months. We will be launching for the first time, a new program to educate and empower young girls and their mothers about the exciting opportunities in construction careers for women. While we struggle with a skills a gap in our industry, coupled with the challenges of importing foreign skilled labor, we must do our due diligence to hire and train a local workforce to support a sustainable volume of construction work when all the dust settles from this spike in construction we are seeing today. This is the best time to train our local people while we have skilled talent here to assist with the on-the-job training. We recognize, that as an industry, we need to do more to attract our younger generation to consider a career in the trades, not just for construction, but for other skilled trades that require formal technical skills training. It is the goal of GCA to do more outreach in our local schools, even as early as middle school, to have these students explore the opportunities of a career in construction. We are also concentrating on reaching out to more females in middle and high school as they are an untapped resource for our industry. The new program we are launching in March is called Power Up: It’s a Mother Daughter Thing and will help in this endeavor. Dr. Mittie D. Cannon, founder of this program, has been engaged in workforce development in the construction industry for over two decades. Over the years, she recognized that statistically the construction industry was consistently challenged to pull in a qualified and diverse workforce – specifically, the industries overwhelming deficit in female employees. Through recognizing this critical shortage, Dr. Cannon has developed a passion for exposing young women to careers in construction through innovative programing. Dr. Cannon initially ran summer camps for young women to expose them to careers in the construction industry. Those successful programs, lead Dr. Cannon to her brainchild, Power Up: It’s a Mother Daughter Thing! Now, she is bringing her program to Guam and will be here in Guam personally for the launching of this program in March. We’re all excited about this event. The one thing that attracted me to this program is that it includes the mothers who will act as a reinforcing entity in the program. Once the mothers are exposed to the different types of skilled trades, they will be assured that this is a viable option for their daughters to consider as a career. It’s probably every parent’s wish that their children attend college and get a 4-year degree, but the reality is, not every student has the resources nor the desire to attend college. They have other options like joining the military, going directly into the workforce without any formal training and earning minimum wage, or continuing their education and training at Guam Community College or a trade school like the GCA Trades Academy to get more formal skills trade training with industry recognized credentials like the U.S. Department of Labor Journeyman Certificate through a Registered Apprenticeship Program, or the National Center for Construction Education and Research (NCCER) certifications for the construction trades. As I have mentioned earlier, this is the best time to grow, train and develop our workforce. We are no longer competing with our competitors down the street or in another village for a skilled workforce, we are competing globally as more companies are eyeing Guam to recruit our residents for job opportunities elsewhere. Stuff of legend, right? Overgrown, often misunderstood, Keep cash or coins in your pockets. Eat noodles the day of. Make noise. Eat 12 grapes at midnight or something ‘ring-shaped’. These are traditions found throughout the world to ring in a new year. From prosperity, fertility, chasing away our demons, or long life in the coming year, these - and many more - are symbols of what we put out into the universe. Nowadays, there are vision boards, apps to keep track of goals, screenshots of faraway destinations to visit, and the motivation to use the gym membership until March. But, the new year also gives us a chance to reflect on the year prior and the coming year. The surprises, the obstacles, the accomplishments, etcetera. New Year can become this never-ending cycle of clean slates and resolutions; however, it has the opportunity to look at the idea there is always room for growth and improvement, room to be better than last year, last month, last week, yesterday - the last decade. Within the last ten years, the island has seen exponential growth in industry, infrastructure, and investment. She has seen a stagnant, dismal economy, but also periods where a few extra dollars have crept into our pocketbook. She has seen an architectural nod to the past with the futurism of the 21st century. She has seen an increase in hustle and bustle from one tip of the island to the other. She has seen her people begin to find their niche in the industry to build Guam with her best interests at heart. Challenges It can be easy to look back and think about challenges and obstacles; what was put before us and how we overcame it, or how we are working toward resolving the issue. A resounding concern that remains at the forefront for policymakers and officials alike is the limited skilled workforce on the island within the industry. For years, the concern has been about local workforce within the trades, and it became a bigger concern with the H-2B visas for Filipino workers being outright denied by the Department of Homeland Security and the State Department. The Guam Department of Labor has an ongoing anthology of local news articles that document the struggle to have H-2 workers work in Guam, which goes back as far as February 2017. Greg Massey of the Guam DOL said a growing concern for the island in 2020 is still workforce development. “The demand for skilled workers is greater than the number of individuals we can train,” he started. “Those we can train face social barriers that impact how well they retain their jobs or stay in a training program.” However, there has been a push throughout the island private and public agencies are working to create programs and apprenticeship opportunities for students Like Us On Facebook

to get training and certification necessary for the skills needed in increasing construction-skilled island workers. Vera Topasna, director of the Guam Buildup Office, stated that challenges that Guam faces that are buildupfocused include “Government of Guam’s capacity to meet the demands of the military buildup in the areas of staffing, infrastructure improvements and historic preservation and environmental stewardship.” She continued by saying that the GBO continues to be a liaison between the Offices of the Governor and Lieutenant Governor and the Department of Defense to address those critical issues and “find pathways to address the aforementioned priorities. Speaker of the 35th Guam Legislature, Tina Muña-Barnes pledges “to work with the administration and all stakeholders, so that we can make the permitting process easier for those who want to invest in our local economy.” More importantly, the Speaker is working toward stimulating economic development on island, promoting community involvement, and government accountability. She cited collaboration between the administration and the legislature to implement strategies for laws to help develop industry. “Many good laws meant to build new industries are left on the backburner yet to be implemented. The challenge we have is collaborating with the administration to develop strategies to implement these laws.” Speaker Muña-Barnes said, “Guam's construction industry will play the most integral role in job creation and new dollars stimulating our economy with the construction of a new power plant scheduled to be completed in 3 years and an estimated 5-10 years of preparation for the military's expansion.” She added this means a call for more skilled workers, which means more job opportunities for people and more money flowing into the economy. When it comes to the construction industry, Speaker Muña-Barnes said, “it is time to fill the void of skilled laborers on Guam by modifying the curriculum in our public high and middle schools to include these trades.” More, she stated, “we need to funnel more students into the apprenticable (sic) trades especially trades in the construction industry, have them build successful careers as journeymen... “As much as we want all of our high school graduates to attend college, that’s just not realistic,” stated the Speaker. “We should make it so that we are teaching these and other skills and disciplines that will help make our graduates more employable or give them something upon which they can build.” Massey pointed to focusing on the continued growth of the programs at GDOE and the Guam Community College

to give more students vocational opportunities, while also giving employers the support through the H-2B programs. According to the GDOL H-2B Denial Situation page, the last approval of workers was in the early part of the year for 355 workers from the Philippines, while there were blurbs about potentially getting H-2B workers from Mexico. I Maga’hågan Guåhan Lourdes Leon Guerrero stated, “Our three major challenges are the shortage of skilled labor, the increased cost of construction that shortage has passed on to our consumers, and the strain faced by permitting and regulatory agencies due to large federal contracts.” She added how they have worked to implement a plan to keep the island safe, “leveraged federal programs to build affordable housing”, and maintained a solid stance on a buildup done right for Guam. Gov. Leon Guerrero also pointed to ‘multi-million dollar investments into the Port Authority of Guam,” which would make cargo systems more efficient for goods and materials. “This investment coupled with an increased focus on expedited container screening and support for our bridges and roads gives me confidence in these priority areas.” Speaker Muña-Barnes said, “We have to always future-proof our infrastructure. Our island relies heavily on imports, safeguarding the flow of these goods is crucial. It’s also important to start looking at growing and creating goods on Guam locally.” She added, “That means we have raised our regulatory needs with the military directly and a joint working group has been established to help solve this problem.” Governor Leon Guerrero discussed the use of foreign labor is exclusively for buildup-related projects. Therefore she emphasized her administration’s “umbrella strategy has articulated that nearly all projects on Guam” are related to the buildup. Leon Guerrero spoke about how all projects that benefit our community benefit everyone. She stated, “From housing developments, to restaurants, and storefronts, our administration believes that military personnel can’t live behind the fence 100% of the time.” In addition to the community benefit of buildup-related projects, i Maga’håga spoke about a ‘Guam-only federal carveout for foreign labor”, which she said would shine a light on the unique challenges and the significant advantages the island brings to the nation. But, for the administration, what it comes down to is “good paying skilled labor jobs for Guam”. Which is why the Leon GuerreroTenorio administration has “worked with GCA and others to place 1,000 people in Aprenticeship (sic) and Pre-Apprenticeship programs.

Looking toward the future However Guam’s vision board for 2020 looks, it is cluttered with reminders that the island is still struggling to get people skilled in the trades and is still dependent on foreign labor, impeding its ability to grow; many came up with ideas of starting and bolstering programs for vocational training; some are looking at how this local shortage is affecting possibilities for Guam to benefit from the potential flood of federal dollars for the build up. However, what it may come down to is looking at the bigger picture for everybody. Looking deeper at education and its impact on the future of the island and its industries; creating stronger interworkings and synergy within government agencies and looking at regulatory reform for business opportunities throughout; but more or less, it could mean a closer look at what is really trying to be done - what is the goal? The whole thing with a new year is looking back at the past once more, seeing what worked and what didn’t, writing down what we want changed - in some cases, saying it, and seeing what to do to make things better. There also has to be a level of positivity, gumption, and determination to connect all the parts necessary for good things to happen. The road might not be paved, but it still must be travelled and fixed along the way. I Maga’hågan Guåhan Leon Guerrero said, “I have always been optimistic about Guam’s future.” She continued, “I believe that the things that divide us, are not nearly as great as the things that unite us.”

GPA’s top 3 major challenges for 2020 relative to Guam’s construction industry include:

Nearly two decades ago, GPA General Manager, John M. Benavente, P.E., forecasted the Guam Power Authority to be a critical economic catalyst for Guam. Over the next five years, GPA will complete the following large projects, including:

The new Ukudu base load power plant, the Phase II Renewable Energy Acquisition projects and the Phase III Renewable Energy Acquisition projects. These three projects total over $1.1 billion in construction opportunities and challenges for GPA and the Guam construction industry.

GPA’s top 3 major challenges for 2020 here on Guam include: • Managing the large construction projects; • Reducing GPA costs while improving power quality and reliability, especially with the renewable energy integration challenges; and, • GPA’s labor force right-sizing GPA strategy for dealing with labor shortages. GPA’s operations are dependent upon skilled labor. GPA has announced that it anticipates that within the next five years over 50 percent of GPA’s technical and skilled labor workforce will retire. journeyman, IT professionals, and engineers is a testament that GPA trains and employs skilled people that are valuable human resources who are competitive throughout the nation. GPA is also tackling forecasted labor shortages by increasing productivity. GPA is instituting and refining its use of productivity tools such as Mobile Work Force Management systems, Outage Management System, Drone Systems, Command Center, Customer Information System, Enterprise Resource Planning, and Advanced Grid Analytics. These systems provide more accurate and timely information for better planning and decision making. They also provide more automated processes, which are a technology-assisted means to execute work quicker and with less errors. With the retirement of GPA’s aged power plants, a cadre of individuals with enormously useful and valuable skills will become available to government and private industry on Guam. GPA is committed to helping these people via cross-training and outplacement, so that their skills are realized to be put to excellent use in other industries. On the question of whether Guam’s current infrastructure regarding the ability to import products and goods can meet forecasted Guam growth, a) GPA will be able to meet load growth for Guam, most especially with the approval and construction of the new 198 megawatt Ukudu Power Plant. This new plant increases system reliability and reduces costs because of its excellent efficiency; and b) GPA believes that the availability of natural gas on island via GPA, will open the opportunity for Guam to become a hub for regional natural gas supply and natural gas bunkering for maritime transportation. Major investments in port capabilities are needed to support these opportunities. The increase in the number of larger ships porting on Guam, may help with any importation issues.

The top 3 issues in the past 5 years affecting our island include the landing of international fiber optic cables, cyber and physical security, and renewable energy. Guam is being transformed into a global telecommunications hub. Guam has the opportunity to encourage the development of a technology industry supporting the global communications and Internet based economy including large datacenters. It will take vision and superb execution to get this done. And, GPA will play an enormous role in getting this opportunity landed. Guam Power Authority is working on cyber and physical security projects with the United States Department of Energy (USDOE), the U.S. and Guam Department of Homeland Security, the United States Department of the Navy, the American Public Power Association (APPA), and the Guam Waterworks Authority. GPA sees daily attempts by North Korea, China, Russia, and others to hack into GPA systems. GPA’s strategy of diversifying its energy production to ultralow sulfur diesel (ULSD), liquefied natural gas (LNG), and renewable energy will put GPA in control of its fuel costs. GPA customers will soon be largely insulated from oil market volatility, thus reap the benefits of lower power bills. In 2018, GPA and the U.S. Navy worked together and completed a Guam Renewable Integration Study. This study recommended several projects to enable GPA’s grid to reliably increase the amount of intermittent renewable energy into its power system, without the power quality issues experienced in other island grids. GPA continuously looks ahead in its planning and forecasting, to uncover new ideas and resources that are sustainable, and can be used to meet the growing demand power on Guam. GPA’s Integrated Resource Plan (IRP) is currently under review with an updated plan expected by June 2020. GPA’s efforts are to not only support a prosperous economy and improved quality of life on Guam, but to also preserve the natural resources and support a clean environment for our island.

SMALL BIZ NOTES Contract awards were limited in the first quarter of the fiscal year as a result of the Continuing Resolution placed on the Federal Government. NAVFAC Marianas awarded about $22M in contracts from October 2019 through December 2019 on which Small Business (SB) concerns may participate as prime or subcontractors. Of that amount, about $11.1M was awarded to SB concerns to provide a variety of products and services on Guam. Socio-economic breakdown of the SB awards are: - $9.4M - Small Disadvantaged Business (SDB) - $7.2M - HUBZone Small Business (HZSB) - $1.5M - Women-Owned Small Business (WOSB) - $489K - Service-Disabled Veteran-Owned Small Business (SDVOSB) The sum of the figures above exceed the overall SB awards of $11.1M because some SB concerns qualify for multiple socio-economic categories. Significant SB awards in December: • Global Food Services, LLC was awarded about $1.4M to provide galley services at Naval Hospital Guam.

• Fargo Pacific, Inc. was awarded about $694K for facility repairs on Naval Base Guam.

HOW TO INCREASE CONTRACT OPPORTUNITIES Oftentimes, contracting officers/specialists tend to pick and choose who they are able to meet with. Finding (or making) time to meet with them can be very difficult due to heavy workloads especially during the last quarter of the fiscal year. It is not realistic to meet every contracting officer and contract specialist in a contracting activity. Contracting covers various sectors (construction, facilities support, environmental, commodities, transportation, etc.) so contracting representatives may not be interested in meeting with contractors/vendors who really cannot provide/perform requirements in their departments. For example, construction contracting reps probably would not meet with vendors who provide equipment or janitorial services. Or those in commodities and services may not have a desire to meet with construction contractors. So, what would contracting officers/specialists like to see from a SB concern seeking work with the federal government? A well-prepar d capabilities statement is probably all that is needed for the initial meeting. Additional info may be obtained through SAM, DSBS (SBA Profile), websites, etc. Things to consider before meeting with contracting representatives: 1. Update/maintain your SBA profile (DSBS). - When conducting market research, contracting personnel typically go to the DSBS site first. - Your SBA profile is a great marketing tool and can make a big impression on contracting representatives (or prime contractors looking for potential subs). 2. Subcontracting is a great way to build experience and past performance. - The Performance History section in your SBA Profile is not just

for federal contracts as a prime contractor. - List your work as a subcontractor as that counts towards experience. - Suppliers/vendors should list their larger or regular customers as they can provide references. 3. Develop a website if you don't have one. - A simple site is all that is necessary. - Insert the link in your SBA Profile and ensure it works. - Contracting reps will certainly look at your website to learn more about your company. - Insert a Capabilities Statement that can be downloaded/printed out. 4. Attend PTAC workshops and become a client. - PTAC workshops are geared towards getting a better shot at government contracts; e.g. where to find federal opportunities, how to respond to RFPs/RFQs/sources sought notices, marketing to the federal government, how to create a capabilities statement, etc. 5. Network, network, network. - Unfortunate but true; some SBs will work to get 8(a) or HUBZone certified then sit back and wait for opportunities/contracts to come rolling in. You still have to get out and market your capabilities. - Join the Guam Contractors Association and/or Chamber of Commerce. - Attend membership meetings and networking events, mixers, etc. 6. Sending emails. - Proof-read requests for meetings before sending. - A poorly written email has a good chance of being ignored or deleted.

Reminder: DOL Overtime Rule Effective Jan. 1, 2020 On Sept. 27, the DOL issued a final rule on overtime, officially named Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees, which updates and revises the “white-collar” overtime exemption regulations under the Fair Labor Standards Act. The final rule goes into effect on Jan. 1, 2020. Overall, the final overtime rule addresses many of the concerns expressed by ABC in its May 21 comment letter in response to the department’s March 22 proposed rule. The final rule increases the minimum salary level for exemption from $455 per week ($23,660 annualized) to $684 per week ($35,568 annualized). This level is lower than the threshold of $47,476 in the Obama-era 2016 overtime final rule. In Nov. 2016, a federal court blocked

the Obama rule from taking effect nationwide. In addition, the final rule increases from $100,000 to $107,432 the total annual compensation required for employees to qualify under the shorter highly compensated test. The 2019 proposed rule raised the highly compensated salary threshold to $147,414 per year, which ABC opposed. ABC’s comment letter argued that the DOL should retain the highly compensated salary threshold at the 2004 level of $100,000. The final rule also allows employers to use commissions, bonuses, and other nondiscretionary incentives that are paid at least annually to satisfy up to 10% of the standard salary level, in recognition of evolving pay practices. According to a Littler Mendelson P.C. analysis, “If incentive payments fall short by even $1,

however, employers will owe overtime pay to shorted employees for the entire prior year. Under the final rule, employers will have only a single pay period for a final make-up payment to ensure exempt employees receive the full $35,568 for the year.” ABC’s comment letter argued that the 10% cap should be lifted, or at a minimum raised to 25%.
