President’s Letter

Hafa Adai GCA Members: On May 10, 2020, the Governor declared Pandemic Condition of Readiness 2 (PCOR2) which means some restrictions have been lifted and some businesses can open, like retail stores, real estate and automotive sales, malls and shopping centers, nail, and beauty salons etc. Others are under review and need to submit a plan on how they will meet the requirements on social distancing and other requirements such as PPE’s. These businesses include dine-in restaurants, gyms, spas, outdoor recreational and sport activities like golf, tennis, swimming etc. Group and tour events are also subject to review in PCOR2. As the island slowly begins to open for business, bear in mind that things will be a little different than normal. I like to call this the “new normal”. Face masks will most likely be required if you’re entering an establishment, retail and office spaces will be marked to remind us of six feet social distancing and some businesses will only allow a certain number of people at a time to enter their stores or offices. Just before some businesses got the green light to open, GCA had published and distributed a Checklist in Preparation of Re-Opening Your Office/Business, you can download a copy from our website at www.guamcontractors.org. This is a great resource to help prepare your office or business for opening. The GCA office is now back to regular operating business hours, but like most businesses, we have established a new normal by requiring that face masks be worn before coming into the office. We have also marked areas outside and inside the office to remind our members and visitors of social distancing requirement. We are constantly wiping down and disinfecting high use areas like doorknobs and chairs to ensure the health and safety of our employees and visitors. We have also made it more convenient to make your membership dues payment without visiting our office. We have created an online payment option through PayPal on our website. Now members can make payments online through PayPal which accepts Visa, Mastercard, Discovery, American Express and other credit, and debit cards. We will be incorporating using this online payment option for other products and services like CQM and EM385 training, registrations for luncheons and GCA events in the near future. Another “new normal” for GCA is how we hold our board and committee meetings. Because we cannot hold functions and meetings of more than ten people in a room, we are now using Zoom conference platform to conduct our meetings. Technology amazes me sometimes! We can hold meetings without having to be in conference room and the participants can attend these meeting from the comfort of their own offices or at home. We have held a couple board meetings and committee meetings already using Zoom and we are still experimenting with this platform. Again, a new normal on how we conduct our meetings. We are investigating ways to hold some of our training via this platform, but as in the CQM and EM385 courses, it requires a written test that needs to be proctored. We are exploring ways to deliver this product electronically and still keep the integrity of the tests. The new normal is allowing us to try different things and it seems that this trend is not going to end anytime soon. Of that amount, about $126.9M was awarded to SB concerns to provide a variety of products and services on Guam. RUNNING A SUCCESSFUL VIRTUAL MEETING Many companies have employees working from home because of the COVID-19 pandemic. Business leaders find themselves participating in and leading virtual meetings. Virtual meetings are not only inexpensive ways to get people together, but they are great opportunities to build teamwork and trust among teams. Here are some tips to run a great virtual meeting: Plan ahead: Virtual meetings require more preparation than in-person meetings because the facilitator can’t just walk into a conference room and provide handouts. Send out the agenda and read-ahead materials early so participants have a chance to review what will be discussed. Share information with the participants such as technology requirements, links, call-in numbers, passcodes, and other instructions. Encourage participants to submit ideas for the agenda or any questions on the topic before the meeting. Plan to give each person time to provide their thoughts/suggestions about the discussion. Know the technology and application: Understand the mechanics of your company’s conferencing system as well as the application you will be using, (Skype, Zoom, MS Teams, etc.). Understanding what your system can and cannot do will give you flexibility to present material in a way that best fits the purpose of the meeting.

Set up ground rules: Respect and civility should be standard. Call in and set up early. Remind participants to avoid multitasking during the meeting (checking emails, messages, etc). Make sure everyone’s video is switched on to make the team feel more connected. Stay focused: Avoid trying to cram in too many topics into a single meeting. If you have a long agenda, give everyone a break (restroom, stretch, get a drink). Keep each segment of the meeting short — no longer than 30-45 minutes. Foster cooperative problem-solving: Bring up key issues/problems related to business challenges and encourage team members to work together to find new solutions and ideas. Wrap it up with a virtual “water cooler” talk: Encourage team members to share their thoughts, positive or negative, about the meeting. Summarize key points of the meeting for all participants. Virtual meetings may not completely replace the need for team members to gather in person, but if conducted in a professional manner, virtual meetings can achieve great benefits.

Our island community cannot equate the damage of COVID-19 to that of any typhoon or other natural disaster. It is a time in our lifetime where uncertainty is at an all-time high; obviously making it difficult to determine any kind of return to what once was. Earlier this month, Governor Lourdes Leon Guerrero released her Recovery Plan - Chålan Para Hinemlo. In it were details of how the island would progress out of different levels of Pandemic Condition of Readiness. However, throughout the United States, we’re seeing record numbers of unemployment, and some have alluded to that of greater numbers as that of the Great Depression. According to an economic news release from the U.S. Bureau of Labor Statistics, the US saw 20.5 million unemployed; raising the unemployment rate to 14.7-percent, a 10.3-percent increase. This includes temporary lay-offs (18.1 million) and permanent lay-offs (2.0 million). According to the report, 975,000 people lost their jobs in construction alone - and that’s just state-side. So, in the midst of all of these numbers, and the need to put food on the table, and reopening the economy, and divvying out stimulus checks, and getting people back to work, what does this mean? In essence, it could mean the need to rebuild yet again and finding work. The construction industry promotes foundational growth, resilience, and resourcefulness. It takes this industrial attitude to move forward in recovery. Landscape Management Systems, Inc. (LMS) continues on their award winning track record in their innovation and working with federal and local partners. According to their website, LMS “is one of Guam’s most highly recognized landscaping companies providing full-scale services, including landscape design, installation, grounds maintenance, and tree trimming services, for various governmental, commercial, and residential customers.” Their basic services include, ground maintenance, design and construction of irrigation systems, landscape installation, maintenance, and renovation, Ground maintenance, and installation of drainage systems. “LMS developed a sound long-term strategy and invested in additional resources to meet and exceed the standards set forthinthe (sic) Guam’s leading contracting industry. LMS strives to continuously innovate across multiple lines of business.”

In early April - almost a month into quarantine - it was announced LMS was awarded an up-to $25 million dollar federal indefinite delivery, indefinite quantity contract. According to an article on Naval-technology.com, the task order is up in April 2021, and the contract is not to exceed beyond April 2025. LMS’ responsibilities include, “collecting, consolidating, characterizing, minimizing and in some cases, disposing of Hazardous Material and Hazardous Waste within both Naval Base Guam and Andersen Air Force Base.” Further, LMS will be on-call “24/7 to assist with emergency spill response and clean up.” For Bob Salas, Owner, Director, and General Manager of LMS, this project gives “another opportunity for growth for LMS.” If you visit their website, and as we’ve written before, their portfolio is expansive and spans both local and federal contracts alike; further promoting their growth as a small business in the industry. “Through the expertise, partnerships and growth attained through this contract, [we are] poised to explore innovative avenues of Hazardous Material and Hazardous Waste abatement and remediation.” Additionally, Salas pointed to LMS’ desire to promote sustainability and environmental issues through this project as well. “Our involvement in this project gives us the opportunity to make a positive environmental impact here Guam in multiple ways; including the reduction of transporting of Hazardous Waste and Hazardous Material on island,” stated Salas. He added, “We are actively investing in minimizing Hazardous Waste generation and Hazardous Material use.” Part of growth is learning how to adapt to changes and test flexibility of operations. Salas stated how their regular routines with regard to normal operations is switched up considering part of the contract requires LMS to perform emergency response spill cleanup, which is completely dependent on the customer’s waste output. As they’re currently planning how to address these incidences, Salas stated how excited they are to meet the challenge. Working in the time of COVID-19 sounds like an epic novel waiting to be written or a TV show waiting to be piloted, but truly it is real life for a lot of businesses and industries. For many entities, it’s a time to reevaluate and figure out how to take care of employees, maintain productivity, and sustain themselves, all while remaining as safe and healthy as possible. LMS is no different.

Salas emphasized his company’s work in putting in place the proper safety protocols to ensure safety and health of his staff. “We are fortunate to have dedicated employees that are eager to continue working to provide our clients the products and services they expect,” he stated. Admittedly, some of the necessary extra safety measures could cause some delays, but Salas stated that LMS is ensuring that essential work remains unaffected. As with almost all other businesses, safety is paramount. Now, more than ever, businesses are taking the time and energy to make sure the virus does not spread in the wake of slowly opening up the economy. “At no point in time during COVID-19 did we shut down or even slow operations,” stated Salas. Safety remained one of the highest priorities in providing employees with masks, gloves, hand sanitizers, among others to keep a safe and sanitary work place. “ In fact, we added additional safety training and continued to ramp up operations in the safest manner for our employees.” He assured that the same goes for this upcoming project.

Salas expressed, “As always, we as a company are looking for growth.” He added, “Growth as a company, growth in our managers, growth in our field workers, growth in our admin, and growth in our relationships." Salas continued on about the doors this contract will open for - the opportunities - his employees to obtain more certifications and potential advancement in the industry. Looking at the effects of COVID-19 on the construction industry, it is imperative to look at the ways the industry conducts business. Safety is always a goal in this industry, but its definition has evolved and expanded in these unprecedented, uncertain times. Now we are seeing businesses work digitally - teleconferencing, consistent sanitation, limited person-to-person interaction; things we wrote about in the last issue. However, all of this demonstrates the adaptability and flexibility of the industry to get the job done and move forward; its growth.

NEWSLINE Additional Funding for PPP Loans Set to Pass in the U.S. House and Be Signed Into Law On April 21, the U.S. Senate passed a bipartisan agreement that will provide $321 billion in additional funding for the Paycheck Protection Program. House members have been advised to return to Washington, D.C., for an April 23 vote on the interim coronavirus relief package, and the president has stated he will sign the bill into law once passed. The $484 billion deal also includes $60 billion for the Economic Injury Disaster Loan program, $75 billion for the nation’s hospitals, $25 billion

for COVID-19 testing and $11 billion in PPP administrative costs. Of that testing money, $11 billion will go to states. Read the bill, a section-by-section explanation of the small business provisions and the hospital and testing provisions. The concern now is how long these new funds will last. With the original $349 billion expended in just 14 days, lawmakers and economic experts believe that these new funds could

expire even faster—as early as next week—due to implementation of a swifter approval process since the rollout, more approved lenders and thousands of applications at the ready. While not all small businesses are in need of assistance at this time, the country has approximately 30 million small businesses. The U.S. Small Business Administration has approved only 1.6 million PPP loans, and it is unclear how many businesses have applied.

Bipartisan Senators Urge the Inclusion of 501(c)(6) Organizations in the Paycheck Protection Program On April 27, a bipartisan group of 18 U.S. senators urged expanding eligibility for the Paycheck Protection Program to include 501(c)(6) organizations in the next coronavirus relief package. If your senator supported this effort, please take the time to thank them through ABC’s Action Alert. In a letter to Senate leaders and the Senate Committee on Small Business and Entrepreneurship, Sens. Bill Cassidy (R-La.) and Joe Manchin III (D-W. Va.) wrote, “Unfortunately, local trade and professional associations organized under § 501(c)(6) of

the Internal Revenue Code are ineligible for assistance through the lending programs included in this legislation. Given the crucial role these organizations play in sustaining the Main Street economy, and the severe financial difficulties they are confronting, we strongly support their inclusion in the next round of federal aid for coronavirus relief.” The letter was also signed by John Boozman (R-Ark.), Richard Burr (R-N.C.), John Cornyn (R-Texas), Steve Daines (R-Mont.), Doug Jones (D-Ala.), Angus King Jr. (I-Maine), James Lankford (R-Okla.), Martha

McSally (R-Ariz.), Robert Menendez (D-N.J.), Gary Peters (D-Mich.), Jacky Rosen (D-Nev.), Tim Scott (R-S.C.), Kyrsten Sinema (D-Ariz.), Debbie Stabenow (D-Mich.), Jon Tester (D-Mont.) and Thom Tillis (R-N.C.). ABC has continued to advocate for expansion of the PPP, as the CARES Act allows for some nonprofits to apply for the PPP, but excludes 501(c)(6) organizations, such as national, state and local associations, from accessing these loans. The inclusion of 501(c)(6) organizations in the program means ABC chapters can benefit from PPP loans.

DOL Issues COVID-19 Relief and Guidance for Employee Benefit Plans On April 30, the U.S. Department of Labor’s Employee Benefits Security Administration published a rule extending deadlines under Title I of the Employee Retirement Income Security Act and the Internal Revenue Code for group health plans, disability and other welfare plans, pension plans and participants and beneficiaries of these plans during the COVID-19 national emergency. According to a DOL news release, the rule, jointly issued with the U.S. Department of the Treasury’s Internal Revenue Service, extends certain time frames to ensure plan participants, beneficiaries and employers have additional time to make critical health coverage and

other decisions affecting benefits from March 1, 2020 until 60 days after the COVID-19 national emergency ends. Additionally, the rule states laid-off plan participants and their beneficiaries will have until 60 days after the national emergency ends to secure alternative coverage through special enrollment in another group health plan, such as COBRA, the Health Insurance Marketplace, Medicaid or CHIP. This rule provides additional time for participants and beneficiaries to make claims for benefits and appeal denied claims. Along with the joint rule, the DOL issued EBSA Disaster Relief Notice

2020-01, which announced an extension of deadlines for furnishing other required notices or disclosures to plan participants, beneficiaries and other people, so plan fiduciaries and plan sponsors have additional time to meet their obligations under Title I of ERISA during the COVID-19 outbreak. For more information, the DOL released a set of frequently asked questions on the rule and other health benefit and retirement benefit issues. OFCCP Publishes Directives on Contractor Compliance Evaluations On April 17, the U.S. Department of Labor’s Office of Federal Contract Compliance Programs issued guidance to increase accountability and efficiency in its enforcement and to maximize the effectiveness of compliance assistance resources to assist contractors in meeting their responsibilities. According to a DOL news release, the agency released the following directives: • Efficiency in Compliance Evaluations: Directive 2020-02 outlines the steps OFCCP will take to expeditiously resolve compliance evaluations and quickly remedy violations to benefit the workers OFCCP protects and the regulated community. Efficient compliance evaluations help ensure the collection of relevant evidence in a timely manner. Like Us On Facebook

• Pre-referral Mediation Program: Directive 2020-03 establishes a mediation program to resolve matters before spending significant time and resources in the enforcement process. OFCCP will offer this program to federal contractors and subcontractors to resolve findings of discrimination after the Show Cause Notice has been issued but prior to referrals to the Office of the Solicitor for enforcement. This mediation is not a substitute for the conciliation period between a Notice of Violation and Show Cause Notice. • Ombuds Service Supplement and Protocol: Directive 2020-04 supplements Directive 2018-09 with additional details outlined in an Ombuds Service Protocol, which explains the principles of the Ombuds Service. While some stakeholders appear reluctant to contact OFCCP directly, the www.guamcontractors.org

agency is committed to engaging in transparent communications, and created the Ombuds Service as an independent mechanism to allow stakeholders to share their concerns with OFCCP or provide general feedback and recommendations to improve agency administration. More information on these directives can be found on the DOL website and in an analysis published by ABC general counsel Littler Mendelson P.C. Additionally, in response to the COVID-19 pandemic, OFCCP issued a temporary exemption from certain federal contracting requirements through June 17, 2020.
