GENERAL MEMBERSHIP MEETING June 23, 2016 Our congratulations to Captain Naseem Ghandour, who was presented with the SAME Guam Post Service Award for significant and faithful service to the SAME Guam Post. Capt Ghandour contacted the SAME Guam Post expressing his interest in the Post prior to his assignment to the 554th Red Horse Squadron at Andersen Air Force Base in 2013. True to his word, he has been an active member since. With the exception of temporary duty assignments off-island, Capt Ghandour was a regular participant (often as a volunteer) in SAME Guam Post’s many activities/events such as ACI Concrete Testing certification training and the annual Charlie Corn Golf Tournament. Capt Ghandour also organized group tours at Andersen Air Force Base and was actively involved in Guam Post PE Study Group Meetings.

This month’s military office brief was given by ENS Marc Simm, CEC, USN, ROICC Finegayan, who shared his background and a snapshot of current projects, including Bulge Forming Aircraft Ducting and AUV. The sustaining member brief was presented by Mr. Wayne Cornell, CDR USN (Ret.), President and CEO of DZSP21 LLC, who spoke about some of the challenges to be faced of Government Contracting. The main speaker was BG Roderick Leon Guerrero, the Adjutant General for the Guam National Guard.

GUAM NATIONAL GUARD BG Roderick Leon Guerrero, Adjutant General of the Guam National Guard, provided an overview of the organization and it’s role within our community. The Guam National Guard was established in 1981, Governor Paul M. Calvo served as the first Commander-In-Chief. Today, the organization has grown to over 1500 professional Soldiers & Airmen. The key responsibilities are as follows: • The Federal mission is to provide combat ready units to mobilize, deploy, fight, and sustain combat operations anywhere in the world to support National Command Authorities. • The state mission is to provide trained and equipped forces to support civil authorities in the event of civil disturbances, natural disasters, or as otherwise directed. • The community mission is to support programs that provide value and enrich the cultural lifestyle of the island community of Guam.

Future projects which form part of the NG Readiness Center Transformation Master Plan (RCTMP) include an Infantry Regiment RC and Engineering RC, however there are hurdles, such as ongoing MEC issues and Guam’s high construction costs. Act of Nature Funding was used to fix and upgrade damaged facilities on Fort Juan Muna and Barrigada Readiness Complex. SRM funding was used to Restore or Modernize our buildings that the NG has used since the inception to meet current regulatory requirements. Power consumption has reduced by 35% to save approximately $500K in costs. This is in large part due to installation of approximately 238 Solar Panels on the USPFO BLDG (100). BG Leon Guerrero concluded the presentation with tribute to the six fallen heroes from the 1st Battalion 294th Infantry Regiment. The construction of the memorial located at the main entrance of the Joint Force Headquarters, was completely funded by individual contributions from the Soldiers, Airmen, and Civilian employees of the Guam National Guard. A private ceremony is held there annually on the eve of the Memorial Day weekend with their families. Yet that was to be the last great attempt to extend the Caliphate across Europe. The global balance of power was shifting, and nearly a millennium of Muslim preponderance was drawing to a close.
The age of Muhammad and his successors, which had seen Islam emerge from desert obscurity to global empire, was enshrined as the model to follow. Over recent decades, resentment at continued Western interventions in Muslim countries such as Afghanistan and Iraq have only burnished the appeal of the glorious past.
No one should doubt the dangerous nature of the memories that ISIS is playing with.
Today, according to a poll, some two-thirds of Muslims worldwide want to see the restoration of a Caliphate.
It was Christians who colonized America, established trading empires that spanned the globe and started the process of industrialization. By the 19th century, with India ruled by the British Raj, and the Islamic Ottoman Empire scorned in Western capitals as 'the sick man of Europe', Muslims could no longer close their eyes to the sheer scale of their decline. It was they who were now the imperial subjects, and Islam the civilization looked down on by its adversaries as backward, as Christendom had once been. Ever since the first days of their faith, Muslims had tended to take for granted that its truth was manifest in its worldly success. As a result, subordinated to the infidel British or French, there were many in the Muslim world who looked to the golden age of the Caliphate for their inspiration.

That Constantinople has been a Muslim city for almost 600 years, that the Crusades are done and dusted, and that Europe no longer defines itself as Christendom, barely intrudes on the consciousness of many jihadis. They inhabit a mental landscape in which the Middle Ages never went away. The menace of this way of thinking is brutally evident — a world in which young people murdered at a rock concert can be cursed as 'Crusaders' is a world on the verge of going mad. It is

not just non-Muslims who are threatened by this imperialist nostalgia. 'Either you are with the Crusade,' ISIS has warned European Muslims, 'or you are with Islam.' Its ambition is to terrorize the West into turning against its own Muslim citizens, and render it impossible for them to live here as equals: 'For then Muslims in the Crusader countries will find themselves driven to abandon their homes, and will go to live in the Caliphate.' History could hardly be more brutally exploited. No one should doubt the dangerous nature of the memories that ISIS is playing with. And the jihadi dream of a return to a world split into two violently divided rivals — into a 'House of Islam' and a 'House of War' — no longer seems such a fantasy as once it did. When I was doing my daily search of the news making headlines around the world, a story on www.cnn.com last week caught my attention and forced me to look closer at the whole issue of Light-Emitting Diode (LED) and impacts on healthcare. It all started with "community guidance" by the American Medical Association (AMA) earlier this month to reduce the harmful human and environmental effects of high intensity street lighting. While many American communities, including Guam, are taking significant efforts to modernize roadway lighting systems, it appears that converting to "improper" LED technology can have great impacts on health and the ecosystem near these lighting fixtures. The AMA cites the Blue Lighting, or the white light of an LED to the naked eye, can decrease visual acuity which can create a road hazard for drivers. The AMA guidance also cites the impacts of LED lighting on species of animals that need a dark environment in which the related systems can disorient some birds and sea-life in and around the modern streetlight. The AMA guidance would imply that all Guam drivers and

much of our mangrove ecosystems, in and around our main roadways, are at risk. There were recommendations to utility companies to use among other things lower correlated color temperature fixtures, LED lighting shields to minimize glare and utilize dimming technologies in the street lighting during peak time periods as a way to reduce such risks. "The guidance adopted today by grassroots physicians who comprise the AMA's policy-making body strengthens the AMA's policy stand against light pollution and public awareness of the adverse health and environmental effects of pervasive nighttime lighting, " said the AMA in a news release. The AMA did recognize LED street lighting does have energy efficiency benefits. Nearly 10 percent of the Nation's roadways feature LED lighting today. More of Guam's roads can expect to see more of this technology installed during these times of rising costs to manage this important public program as directed by the Guam Consolidated Commission on Utilities.

Unless you already had a startup and entrepreneurial instincts kicked in early, most remember their first jobs. Some summer jobs or out-of-high-school jobs helped some people make a little extra cash and gain some experience while doing so. Not to say that only teenagers and college students are taking these kinds of jobs that pay enough just for gas and meals.

The same release also reported an increase in average hourly earnings from $12.95 to $13.56 an hour within a year.
On the contrary – according to the United States Department of Labor website, the “typical minimum wage worker is not a high school student earning weekend pocket money…89-percent of those who would benefit from a federal minimum wage increase to $12 per hour are age 20 or older...”
In the hypothetical – possibly scary - world where growth slows or ceases, ”if we can only look at history to learn from, we saw from the last (increase), you look at the stats, see how things have improved over the last two years…what academic studies are you showing that this might take it over the edge?” said Cruz.
The United States Department of Labor also points out “since 1938, the federal minimum wage has been increased 22 times.” It’s related to a major topic that has gained some traction in recent months – the last several years, really. It’s a push to incrementally raise the minimum wage.
The same year that Cruz presented his data to the Guam Women’s Chamber of Commerce, over 600 economists sent a loud roar to President Barack Obama, then Speaker of the United States House of Representatives John Boehner, and several other government officials in their support of a minimum wage increase to $10.10 an hour. The last part of the letter states, “Research suggests that a minimum-wage increase could have a small stimulative effect on the economy as low-wage workers spend their additional earnings, raising demand and job growth, and providing some help on the jobs front.”
In the last twenty years, the minimum wage in Guam has raised half a dozen times. In 1997, it stood at $5.15 an hour. Ten years later, it jumped 60 cents. Then on January 1, 2015, it reached $8.25 an hour. This was part of Vice Speaker Cruz’s plan to steadily raise the minimum wage.
“Every employer shall pay each person employed by him wages at a rate no less than Nine Dollars and Twenty Cents ($9.20) per hour, effective January 1, 2017, and Ten Dollars and Ten Cents ($10.10) per hour, effective January 1, 2018.”
It’s important to note that this list of signatures has come under fire because of some of the economists listed, their research focus, and affiliations with unions. However, it begs the question of the amount of extensive, hard-hitting evidence policy makers are using to prove a point that their constituency needs a minimum wage befitting the times and economic climate.
As it stands, Guam, Washington D.C., and over two-dozen states have a minimum wage higher than the federal minimum wage of $7.25, according to the National Conference of State Legislatures. This isn’t a new conversation for many states and territories.
Vice Speaker Cruz spoke about how a wage increase would mean that employees would “be able to buy stuff that (businesses) are selling them.” He says that he has tried to figure out how some people working minimum wage positions can afford things like gas, “how can they even go to McDonald’s.”
Following the Vice Speaker’s Bill in 2014, it allows businesses a one-year period to adjust accordingly between raises. Cruz organized a presentation for the Guam Women’s Chamber of Commerce in 2014 when he began talks to raise the minimum wage to $10.10. It included a multitude of statistics and demonstrated the rising costs of living between 2007 and 2014. It shows that there was a 32-percent increase in food costs, 24-percent in housing costs, and 26-percent in fuel, among others.
“I see [the construction industry] as the least impacted…except for the laborers,” said Cruz. He goes on to say almost all the industry is doing a prevailing wage because of the industry’s contractual work.
His current Bill - 312-33 - simply says:

At the time of the presentation, Cruz claimed that a $10.10 hourly minimum wage would help over 17,500 workers from various households. According to Cruz’s presentation, the last minimum wage prior to 2015 did not negatively affect jobs, wages, or hours. In fact, there was an increase of 2,477 jobs, and an extra 1.2 hours a week. However, with the idea of a wage increase comes the notion that prices will rise overall. “Everything has already been going up,” said Vice Speaker Cruz. “When has it happened? Since 1932, it has never happened…it’s worked out.” His presentation also provided information on average hourly rates and employment trends in the construction industry between June 2005 and June 2009, which showed an increase from $13.08 to $14.13 and hour and employment from 5,456 to 6,508 in the industry.

In a press release sent out from the Governor’s office dated June 13, 2016, it states that a $45,000 contract was awarded to a research group to organize and conduct an economic impact statement. The release states that the impact statement should be prepared within 90 days. As that plays out, a public hearing in May was held where the community voiced their opinions – fervently opposing voices resounding from the business community. Talk of rising costs for goods and even cost of living rang throughout the halls of the Guam Legislature where community leaders told their side of the possible impacts of a minimum wage increase. The CATO Institute presented four reasons why the minimum wage should not be raised. CATO is a think tank organization - a public policy research group - whose analysts do research on a plethora of public policy issues. According to their policy analysis of raising the minimum wage, “If the government requires that certain workers be paid higher wages, then businesses make adjustments to pay for the added costs, such as reducing hiring, cutting employee work hours, reducing benefits, and charging higher prices.” In its Executive Summary, the analysis states that policymakers think that businesses simply ‘absorb’ the costs in their business by

profits. However, to be completely fair, businesses need to keep up with their earnings. What ends up happening is finding ways to ensure they’re not losing out, including cutting employment and other expenses, which poses a possible threat to the workforce. Earlier it was quoted from the USDOL that a raise in the minimum wage would help those 20 years and older. According to the CATO analysis published on June 21, 2012, roughly 49-percent are teenagers or young adults under 24 years old. The other 51-percent are 25-years-and-older. “The popular belief that minimum wage workers are poor adults (25-years-or-older), working full-time and trying to raise a family is largely untrue,” CATO states. Additionally, the CATO analysis, written by Mark Wilson, says that a raise in the minimum wage would be detrimental to workers with little to no skillset, namely entry-level positions. A raise would essentially hurt those employees because businesses would be putting a greater emphasis in to looking toward hiring skilled employees. “A rise in the minimum wage increases the demand for workers with greater skills because it reduces competition from low-skilled workers,” Wilson continues. It goes without saying that the thought of putting extra money in people’s pockets can help mitigate poverty. However, according to the CATO analysis, they wrote that 63.5-percent of poor Americans do not work or earn a wage, it contradicts those low-skilled workers who might lose their jobs, reduce their income, and end up in poverty, and it can hurt the poor especially when cost of business is passed on to consumers. “Since 1995, eight studies have examined the income and poverty effects of minimum wage increases, and all but one have found that past minimum wage hikes had no effect on poverty,’ states the analysis. Joe Roberto of East Island Tinting and the Guam Contractors Associations Small Business Committee said, “At this time I am not in favor of increasing the minimum wage.” He continued, “Please know I have always been in favor of increasing wages, but not a ‘minimum’ wage.” He explained that wages are deserved by the work that is put in by employees. In defense of businesses and construction, he added the construction industry “relies heavily on personnel” and raising the minimum wage affects prices for consumers. Roberto explained that regarding any business the number one cost is labor. Increasing wages for minimum wage employees causes a ripple effect in other costs associated with projects, like materials.

tell what might occur when it’s published. Roberto said, “I hope it says the truth…” He goes on to observe, “the economy as it stands cannot afford [to raise the minimum wage].” He went on to say that any middle ground that could’ve been found between businesses and those seeking the wage increase is gone. He believes that the economy cannot afford extra cost to businesses. Data provided by President James Martinez shows workers in the construction industry make a little more than the current Guam minimum wage through the Davis-Bacon Wage Rate. The highest is $16.26 an hour for plumbers and the lowest being $9.25 an hour for a laborer: common or general. In an industry driven by productivity, safety, and performance, skills and training are paramount. And all these things should drive wages. Martinez said “in terms of the trades” there aren’t many employees in the construction industry who make minimum wage, but there are entry-level employees who serve in administrative positions who may be making the minimum wage. Martinez says there is no research that could tell how a rise in the minimum wage can negatively impact the construction on Guam. However, ‘artificially increasing the minimum wage annually will eventually catch up to the achievement levels acquired through training and hard work,” said Martinez. He continues by echoing the same sentiments of Roberto, how a rise in the minimum wage could also potentially hurt the morale of seasoned employees. Ultimately, what most information points to is a sunset duel between higher prices all around and helping minimum wage workers away from the poverty line with more training and essentially more skills. But, with conflicting information, how can we truly navigate the public discussion and real implications of this issue? Are we simply left to knit pick at each other’s arguments? That’s not going to get us anywhere. Whether you are for or against the raising of the minimum wage, what it comes down to is looking at both sides of the issue. It calls for the voices of each side to discuss compromise and to look out for the best interest of a workforce that is already seeing rising prices throughout and the need for available training to instill and promote competitiveness in the labor market. There still remains a lot of uncertainty in some aspects of this issue, especially with conflicting data. But, what might get us through this is a willing attitude to discuss options and gather more information to make a better decision that can help everyone.
An indirect impact also has to do with supply costs where “wholesalers and retailers of supply will have labor increases and will eventually have to increase their prices as well” providing a “double whammy” to the industry. A minimum wage is something to “work toward” to create value for the company, employee, and economy as a whole. Roberto spoke about how the morale of seasoned employees might take a hit. Where someone who has built their reputation and portfolios, attended specialized and extensive training, obtained special certifications, and demonstrate their work over a long period of time, it can create unnecessary tension in a work environment when someone fresh out of school is entitled to a slightly similar wage. “This is a very sensitive topic and must be carefully weighed.” In the absence of an economic impact statement, it’s difficult to

Coming off of the gargantuan regional event of FESTPAC, a dynamo on and for the Guam environmental scene whirls into the house. There’s a true energy emanating from this demure, yet vitality-packed persona. Enter, Peggy Denney—environmentalist, recycler extraordinaire. As we began our discussion, covering first this mammoth event experience for Peggy, it was ultimately, a rousing success for her volunteers and i*recycle Guam. They had separated out over 50,000 aluminum beverage containers from that event. On a practical level it was not an easy feat, with a host of challenges, but it got done—well. By the way, this effort was a genuine “volunteer” mission. You do what you got to do. It is not unlike her personal Guam story; which began some 37 years ago. She quips, “I’ve been here 37 years”. It’s a loaded declaration, like those of us with some time on the ground know. That’s a few times around the proverbial block, and on our island that means you’ve got some battlefield duty to show for it. Her parents were here from ’73 to ’88, taught at UOG. Their stint on Guam came as a relationship formed with then, Senator George Bamba and his wife, Cecilia—late ’60’s, early ’70’s. “Mom had worked as a secretary for the Arizona State Legislature.” As such, Peggy’s parents and the Bamba’s had occasion to meet up periodically at national state legislative events. That contact led to an eventual job prospect and employment, for her dad, at the University of Guam as a professor of finance. As time went on, Peggy ultimately located to Guam herself. Originally, trained and worked as court reporter, doing depositions for attorneys, for 16 years; she then, went back to college at the University of Guam—graduated with an Agricultural degree, then, worked for Guam Environmental Protection Agency (GEPA), as the Education Outreach Coordinator. It was here, at GEPA, where she began her history with i*recycle Guam. “As part of my job at GEPA, my duties included responsibilities with the i*recycle Program, serving as liaison to the schools.” Asked about the beginnings of i*recycle, Peggy reports: ”Frank Shimizu, with AMBROS, initially came up with the idea for Guam Business Partners for Recycling Guam, with August Busch III, as I recollect around 2003 in Palau—to create a program that would focus on the collection and recycling of aluminum beverage cans.

Remembering the starting i*recycle Guam timeframe, “We started placing the collection bins in the Fall of 2007 at the public schools. And then, the collected aluminum beverage cans were shipped off to the U.S. in the Spring (April) of 2008.” So, that completed the first cycle of the iRecycle Program for Guam schools. Noting the consistency of their commitment toward recycling, it is mentioned as one of three key environmental issues for their company. My mission and purpose in joining this organization is to promote recycling and waste diversion at construction sites.” She saw that particular opportunity at the GWA/GPA construction site in Mangilao, and was able to accomplish significant waste diversion for wood, tile, etc. “This my life,” she says. And it is aptly demonstrated as she speaks of ideas regarding the reuse of all sorts of things. A Guam Animals In Need (GAIN) volunteer conveys an idea to use wooden pallets as a pet station. She brings up Pinterest, a social network site for fashion and craft sharing; and that she is such a fan because it gives tons of inspiration about using a variety of materials.

All I could say was, “Amen.” i*recycle is in the process of replacing the 8cy metal bins that are located at the 40 participating schools with 6cy plastic bins. The cost of each bin is approximately $1000, and we should be receiving our first shipment in August. Two Programmatic Agreement Memos for Marine Corps Realignment Projects Available for Public Comments PITI, Guam – Naval Facilities Engineering Command (NAVFAC) Marianas announced today the start of a 45-day public comment phase for two Programatic Agreement (PA) Memos associated with Marine Corps Realignment projects on Guam. PA Memos provide an opportunity for interested members of the public to participate in the Section 106 consultation process required under the National Historic Preservation Act. Public comments will be accepted through Aug. 2, 2016 (Chamorro Standard Time) for PA Memo #1: Salvage and Transplantation of Federally Listed Plant Species for Utilities and Site Improvements Phase I at Naval Base Guam Telecommunications Site (NBGTS),
and PA Memo #2: Water Phase 2 (Water Well Development Studies) at Andersen Air Force Base (AAFB).

NAVFAC Marianas Presents Modified Requirements on Handling Munitions and Explosives of Concern PITI, Guam - Naval Facilities Engineering Command (NAVFAC) Marianas officers met with the Guam Society of Professional Engineers (GSPE) in April to explain modified requirements for handling Munitions and Explosives of Concern (MEC) that apply to construction contractors on Guam and the Commonwealth of the Northern Mariana Islands (CNMI). NAVFAC Marianas Operations Officer Commander Warren LeBeau and Public Works Officer Lt. Cmdr. Adam Perrins discussed a new exemption to Explosive Safety Policy that has been approved by the Office of the Chief of Naval Operations (CNO). “The CNO-approved exemption establishes a modified procedure which lessens the impact to base operations and the public when construction excavation is required deeper than 3 feet,” said NAVFAC Marianas Operations Officer Cmdr. Warren LeBeau. “If an item of MEC is not discovered within the initial 3 feet, then reasonable risk will be assumed and the construction, maintenance or repair project can proceed with lesser 24 | JULY2016
protections in place.” LeBeau said this is an exceptional step to acknowledging the uniqueness of the island’s construction landscape due to World War II MEC. He said this assumes reasonable risk while accomplishing mission critical construction. “As the Navy on Guam executes the historic construction program in support of the realignment to the Pacific, this new procedure will help to reduce construction costs and significantly mitigate potential delays in construction schedules,” LeBeau said. The updated protocols will be incorporated in future solicitations and the fiscal impact will be better defined over the next year as competitive, fixed priced contracts begin to be awarded. A cross command on-site team will be formed to improve techniques tactics and procedures said LeBeau. The team will also be in place to request additional policy modifications, recommend new technologies and modify solicitation as experience from construction is gained.
“We have a process in place that we’ll continue to improve over time with the input of industry professionals,” said LeBeau. “We continue to ask contractors for their input to enable improvements to the process and to how we do business that is safe, cost-effective and timely.” This outreach was the first in a series of on-going presentations that NAVFAC Marianas is committed to hosting on a regular basis to ensure open lines of communication. GSPE member and All Hazard Management Professionals (AMPRO) President John Scott acknowledged his support for collaboration and continuous dialogue between industry and the Navy. “We can make this work through a collaborative process between contractors and the Navy,” said Scott. The collaboration will be mutually beneficial as the private sector and the Navy executes construction projects in support of the enduring military mission in the Pacific and future requirements for the relocation of Marines from Okinawa to Guam. www.guamcontractors.org
