My First Experience with the District 6 Leadership Institute W hen the 2017 D6 Leadership Institute kicked off on Feb. 9, I was among the group of new and seasoned real estate industry professionals eager to grow as leaders and bond with our peers. The daylong session, hosted by the West Pasco Board of Realtors®, focused on teaching us to discover our own leadership styles. The first session was awesome and the speaker was very engaging. Prior to the first day, we were given a homework assignment that included completing the DISC assessment, a type of personality test that revealed our leadership strengths and areas where we could improve. The DISC assessment was very insightful and taught us how to deal with other people and see things from the other person’s perspective. And, I believe that if you plan on being an influence in anyone’s life, you need to know more about yourself. I was first encouraged to apply for the Institute last year when Mari Colgan, our President-Elect, told me that to move up in the real estate industry, I would need to get more involved. Her encouragement also led to me being the vice-chair of

GTR’s Communications Committee this year. By the end of the program, I want to increase my opportunities to contribute to GTR and the real estate industry in different leadership roles. I want to help as many people as possible through my training from the District 6 leadership program. After just one class, D6 leadership training has taught me about my personality, and has already made me a better communicator, instructor and overall REALTOR®. GTR will host the next D6 Leadership session in April that focuses on the foundation of leadership.

GTR Welcomes New Staff Grace Smith is GTR’s new Member Engagement Director. Grace comes to GTR from the Chicago suburbs where she previously held the position of Director of Events and Member Education for the REALTOR® Association of the Fox Valley. Grace graduated from Aurora University in 2015 with a bachelor’s degree in communications and a minor in public relations and advertising. Upon graduation, she became a REALTOR® in Illinois. After a few months, she joined the association side of the industry. She is excited to bring her association knowledge as well as her enthusiasm and passion for the real estate industry to GTR!

GTR welcomes Brittany Jackson as the Director of Communications and PR. Having worked both in not-for-profit associations and the public sector, she plans to bring a creative approach to engaging members and sharing GTR’s story. Brittany, a Tampa native, earned a bachelor’s degree in broadcast journalism from Hampton University and master’s degrees in public relations and international relations from Syracuse University. She’s also active in the community, serving on the Paint Your Heart Out Tampa Steering Committee and on the board of the Tampa Bay Chapter of the Florida Public Relations Association. When she’s not working, Brittany enjoys traveling with her husband, spending time with family and working with her church youth group. tamparealtors.org

PRESIDENT’S CORNER LOCAL ISSUES

Protect the Interests of Your Clients A

s REALTORS®, our top priority is to protect our clients and promote their best interests as outlined in the NAR Code of Ethics. That’s why I sat down with ABC Action News consumer reporter Jackie Callaway in February to talk about a recent issue that some Bay area homebuyers are facing with their taxes. Jackie shared with me the story of one homebuyer that noticed a $400 a month difference between the estimated taxes she was given and the amount she really owes. For many people, that kind of increase can make or break them. So, when it comes to estimating the taxes on a property for a buyer, there are a couple things we should all remember:

By sharing information and staying educated on these hot-button issues, we can all assure that we’re doing our best to serve the interests of our clients.

1. Use the county property appraiser’s online tax estimator. This resource will save you a ton of headaches. This easy-touse tool is the most accurate indicator for a buyer. It also gives an unofficial estimate for buyers who intend to apply for Homestead Exemption. 2. When in doubt, call the source! You can always refer your buyers to the county property appraiser’s office and keep yourself out of hot water! In the coming months, GTR plans to offer classes on this topic through the Hillsborough County Property Appraiser. I encourage you to attend these courses and

share the information with your clients. Another hot topic that JOE PEREZ 2017 President continues to be an issue is wire fraud. Just last year, a Sarasota woman was swindled out of $50 thousand when a hacker sent phony wiring instructions from her real estate agent’s email address. Read tips on how to prevent internet thieves from stealing your clients’ money on page 16. By sharing information and staying educated on these hotbutton issues, we can all assure that we’re doing our best to serve the interests of our clients.

REALTORS® Making a Difference GTR donated over $20,000 in furniture and cleaning services to the Nick Capitano Boys & Girls Club. The club, which received new laptops, a flat screen TV, and several pieces of furniture, was also repainted with the help of volunteers from the Association and our Young Professionals Network. Two local vendors donated their services to this project: Envision

Development, a family-owned company that offers construction and flooring installation services, and The Office Furniture Center of Tampa, which provides corporate, medical and home office furniture products. The True Value of the CIPS Designation Celebrating 20 years of the Certified International Property Specialist (CIPS) designation at GTR

M

ary Odum is GTR’s first CIPS designee and Patricia Riesenkampff received her CIPS in 2016. Both are members of GTR’s International Council. This interview celebrates the twenty-year span of the CIPS designation at GTR. Patricia Riesenkampff (PR): What was your initial impetus to get your Certified International Property Specialist designation? Mary Odom (MO): The Coldwell Banker manager at Siesta Key named Bill Furst. He really placed a lot of emphasis on our agents to attain this designation back in 1994. PR: Was anyone here at GTR in charge of a global initiative? MO: No, there was no one. I got my designation in 1995. When Bob Glaser was president of GTR, he asked if I would be willing to chair an international committee for the Association. PR: Mary, what was the process of education back then? I heard that it was difficult to complete

because the five mandated classes were not being offered in just one place as GTR now offers us today? MO: There was not very much in the state of Florida at all. I had two of my classes in Miami, one in Sarasota and one in Boca and in Orlando. All the instructors were very good. I can say that the mix of people in the classes was best. Most of the CIPS candidates were from overseas and outnumbered those from the United States. There were Canadians and also candidates from Hong Kong. There was a Japanese man and people from France, England, Spain, Germany and quite a few people from South American countries like Colombia and Brazil. It was very interesting. Most of the people with whom I spoke from overseas wanted to have working knowledge of how to work real estate in their own countries the way we work it in America and have connections in this country because they had clients that were coming here. We had small classes and never more than between 24 and 36 people in a class. That is why everyone got to know each other so well.

PR: As you know Mary, I achieved my CIPS in May 2016 and was very proud to have my instructor, Carlos Fuentes, present the CIPS pin to me at the welcoming “meet and greet” event before the trade mission to Germany. My CIPS goal is to assist Germans and internationals who wish to invest in Florida real estate. So, Mary, what relevance did you hope that your CIPS designation would bring to your business? MO: Well, because I am British-born and knew there were an awful lot of people from the United Kingdom coming to buy investment properties especially to the Orlando area, I thought that it would be a vehicle for me to solicit business there and to build a network. I thought that I would be a conduit for that business because of the fact that I understood how people from the UK expect to be treated. They expect things to be underplayed rather than overplayed.


How to Earn Your CIPS

The Certified International Property Specialist (CIPS) designation is the exclusive global designation of NAR. This premier designation is awarded by NAR’s Commercial and Global Services department to REALTORS® who complete the coursework and meet practical experience criteria that demonstrate knowledge and familiarity with international clients. How to earn the CIPS designation: • S uccessfully complete two core courses and three elective courses (options and requirements vary for U.S. and non-U.S. applicants)

PR: How long have you been in Florida? MO: I came to the United States in 1960 as a flight attendant working for TWA. I met and married my husband two-and-a-half years later. We moved around a lot and came to Florida in 1965 and lived in Sarasota. Two of my children were born there. So, when the children were getting older and my oldest daughter was getting ready for college, I decided that it was time for me to stop volunteering twice a week at the schools, hospitals and libraries and decided it was time for me to start earning money as a REALTOR®. I joined Coldwell Banker in Sarasota and worked until 1983 when my husband got transferred up here. So, I came here and joined GTR at the end of 1984 and continued working for Coldwell Banker. At that time, Coldwell Banker was very small and we had constant contact with all the

other offices and had lots of meetings together. During one of these company meetings, Bill Furst was promoting the new CIPS designation. He said that Coldwell Banker was sponsoring the CIPS classes and that if we took the classes, the company would reimburse us after the class completion and give us $200 to offset the cost of each of the five classes. PR: So that was a thousand dollars you could get in the end! MO: Yes, and the CIPS designation was a very big deal back then. We were invited to an International dinner at a posh restaurant in Orlando. All of the CIPS designees were invited and it was very formal and very nice. Many of the officials from the National Association of REALTORS® and GTR also attended. It was a huge nationwide group.

• D esignees must complete the designation application with at least 100 elective credits. Elective credits can be earned in 13 different categories such as: speaking other languages, possessing additional NAR® designations, attending international conferences and international transactions, experience abroad and others. • B e a member in good standing in NAR (or NAR cooperating international association) Is there a fee to become designated? There is a one-time application fee of $75. How much are the annual membership dues? Dues for the CIPS designation are $220 annually and new applicant dues are pro-rated quarterly based on the date of application. REALTOR® DESIGNATIONS PR: From all you have told me, I gather you have had a positive experience gaining your CIPS and having worked on many committees here at GTR? MO: Oh yes, it’s been excellent, no question about it. It is something I love to do and after thirty odd years, it is not just something you stop thinking about or stop caring about.

PR: How do you think the next generation of CIPS designees will benefit from achieving this education? MO: It teaches how to deal with different people from other cultures. PR: Do you think it boils down to that? MO: Oh definitely! In our industry, you need to know where to put your foot so you don’t put it into your mouth! PR: Though all the academia regarding the coursework of the five classes and other electives is important, it’s basically more important to have the understanding of the different mentalities, rituals and cultures so we can better facilitate international business? MO: I would say that is true. And then the relationships you build are so important. PR: How important were your mentors for you? MO: They always kept me moving forward and the people at Florida REALTORS® were very helpful and encouraging back in those early days. And, I was lucky to have Lisa Couture as my GTR staff liaison who was just as helpful then as she is today. Because a lot of real estate agents could not see themselves dealing with people from overseas, I thought that might become part of my portfolio.

PR: Mary, I find you are the poster child for the CIPS because it is all the more relevant in today’s world as it was twenty years ago. You epitomize the kind of REALTOR® who builds the bridge more than halfway in order to make people coming here to invest in Florida real estate feel more comfortable. You have served on many committees at GTR and have always been one to give back! Working as an aspiring global, German speaking agent with CENTURY 21 Beggins Enterprises, the world of academia and what relevance we bring to our business is very important to me and that we continue to inform ourselves. Also that we can readily put a trusted service team together for our clients such as the FIRPTA tax advisers, immigration lawyers, currency and financial advisors and commercial appraisers. The people who now wish to achieve this designation are fortunate as it is far more feasible now than it was back then. GTR also offers these CIPS classes right here taught by such excellent instructors. MO: Yes, and there is also a big liability involved where you always need to be informed and to offer people only that information which is going to help and positively facilitate their business transactions.

PR: Any advice for new CIPS designees? MO: It would be better to focus on one market area you can learn all about to become a true resource. Also, try not to spread yourself too thin. Internationals are coming in great numbers to our area. We have the direct flights now to Frankfurt and to other European destinations, cruise ships are coming directly into the Tampa Bay Port, we have international cultural attractions and Disney and the beaches are all very close. PR: There’s also the security benefit of having a major military presence here at MacDill Air Force Base. And, one in four of all purchase transactions is from a foreign buyer. PR: Thank you very much, Mary, for spanning these last twenty years of our CIPS designations together with me. It has been an honor and a delight. One last question? Would you be open to offering your wisdom to new CIPS designees should they have questions or need advice? MO: Of course! Patricia Riesenkampff, a German-speaking CIPS designee and 2016 graduate of the Commercial Ambassadors Program at GTR, is a global REALTOR® at CENTURY 21 Beggins Enterprises who lived in Frankfurt, Germany over thirty years and moved back to the United States in 2015.


LICENSE RENEWAL EDUCATION UPDATE

FREC changes CE requirements

Florida’s real estate licensees will soon need to take an ethics course when renewing their license. The change, effective after Oct. 1, 2017, won’t add hours to the current CE requirement, however, and the new ethics course may also be accepted by your local association/ board of REALTORS® as required Code of Ethics training. After Oct. 1, three of the 14 continuing education (CE) required hours must include an Ethics and Business Practices course approved by the Florida Real Estate Commission (FREC), which is addressed in FREC rule 3.009(2)(b). After Oct. 1, you must complete the following continuing education hours for license renewal: • 3-hour Core Law course • 3-hour Ethics and Business Practices course • 8-hours of Specialty courses (which may include a 2nd Core Law course) The change does not impact post-education requirements, which apply to first-time renewal of an initial license. The change could make it easier for members to obtain NAR’s mandatory biennial Code of Ethics training. Since FREC and NAR will require an ethics class after Oct. 1, a single class, if approved by both your local association and FREC, may also suffice as Code of Ethics training. n February, My Florida Regional MLS (MFRMLS) launched State27Homes.com, a new and enhanced property search site for buyers looking to call central and southwest Florida home. MFRMLS has operated a consumer home-search site since 2009. They’ve rebranded and redesigned the consumer site to compete with modern search standards, meet the needs of home buyers and optimize the agent-lead capture. WHY DOES MFRMLS HAVE A CONSUMER HOME-SEARCH WEBSITE? Because 44 percent of buyers look online for a home before contacting an agent, the goal is to get buyers to start the process on State27Homes. com with confidence that the information is updated since it’s coming directly from the MLS. Beware of Wire Fraud Scams Use these three tips to protect your clients from fraudsters

A

s the technology boom has made closing the deal a much easier process, it’s also paved the way for hackers to defraud unsuspecting buyers out of hundreds of thousands of dollars in recent years. Wire fraud is on the rise but REALTORS® can help protect their clients through education. Here are a few tips to safeguard your clients from digital crooks: NOTICE THE SIGNS “These fraudsters will hack a REALTOR®’s email account and pretend to be a party in the transaction in order to redirect wiring instructions to their own account. They will usually say that there’s a problem KIMBERLY MARTIN with the account they were given North American initially and the funds need to be Title Company sent to a different account number. The emails look legitimate and could even have the REALTOR®’s signature or picture on them. People should know that there will never be a change to the wiring instructions, and if there is, they should always make a phone call to verify the change.” LIMIT THE USE OF EMAIL “Always transmit wiring instructions securely. At Reltco we only request wiring instructions in person from the seller on the day of closing. Never transmit your wiring instructions via email, STEVE BARKER even if it’s secure, because you Reltco, Inc. don’t know if the receiving party may forward them to an unsecured third party email. If you’re not providing them in person, then fax or mail is the safest alternative.”

FAIR HOUSING I represent an out-of-state buyer who is looking for property in a 55-and-older community. She is here on vacation and has a limited amount of time to look for property. How can I find out where all the 55-and-older communities are in my area? The Florida Commission on Human Relations has a registry of “55 and older” communities available on its Web site. Go to http://fchr.state.fl.us, select the “Directory of 55+ Housing Communities” link, then select “55+ Directory.” You can then search the directory by county, unit, name address, city. COMMERCIAL LIEN LAW I have a brokerage agreement with an owner of commercial property, dated October 15, 2005. I provided the owner and the closing agent a written commission notice before the closing date; however, the owner’s attorney says I’m not entitled to a lien on the owner’s proceeds because I didn’t have a disclosure in the brokerage agreement regarding the commercial lien law. Is this true? Yes. Section 475.703(5), Florida Statutes, states that a broker must disclose to the owner at or before the time the owner executes the brokerage agreement that this law creates lien rights for a commission earned by the broker. The statute also states “a broker may not enforce a lien under this part for a commission earned under a brokerage agreement for which the disclosure required by this subsection was not made.”

Case #​12-2: Exaggeration in Advertising

P

rospect A noted REALTOR® B’s classified advertisement describing a home with five acres “about 20 miles from the city” giving directions to the “modern 3-bedroom home, well maintained, and set in a charmingly landscaped site.” After visiting the property, Prospect A clipped out the ad and pasted it to a letter to the Board of REALTORS® complaining of the gross exaggeration it contained, which had induced him to waste time and money in inspecting the property. The property, he said, was actually 36 miles from the city limits. Its wood-lath support for plaster, which was visible in many large breaks in the walls, indicated it to be 40 years old or more. There was no evidence of painting in recent years. Several windows were broken, half of the back steps were missing. The house was located at the end of a crude dirt road in a small cleared area that had become densely overgrown in weeds—a picture of extreme neglect. REALTOR® B was asked to respond to the charge of misleading advertising, and a hearing was called on the complaint by the Professional Standards Committee. REALTOR® B criticized the complainant for bringing the matter to the Board, pointing out that Prospect A had failed to mention that the property was priced at only $30,000; that at such a price it was an exceptionally good buy to anyone looking for a small place with a few acres; that to get attention to such properties it was necessary to do a bit of “puffing” to attract attention in advertising; that as a matter of fact the general lines of the house were similar to many of modern design; that the house had been well enough maintained to be salvageable by anyone who would do a reasonable amount of work on it; and that, in his opinion, the site was truly “charming” in its rugged simplicity. The Hearing Panel concluded that REALTOR® B had used gross exaggeration in his advertisement and was found in violation of Article 12 of the Code of Ethics. tamparealtors.org

T

his past January, the Florida REALTORS® Mid-Winter Meetings were held at the Renaissance SeaWorld hotel in Orlando, Fla. These meetings are attended by passionate REALTORS® from around the state, particularly those that get involved in state-level committees for the benefit of ALL 165,000+ REALTOR® members throughout Florida. Some topics discussed included: • Public Policy Issues: flood insurance, non-homestead real estate tax cap expiration, sales tax on commercial leases • Contract Forms: What revisions need to be made to our Florida REALTOR® provided contract forms and addenda to meet the ever evolving demands and issues surrounding each of our transactions? • Industry Data: How can we best utilize our MLS data to provide each of us better tools to serve our clients such as infographics and monthly market reports? • Strategic Planning: How can we anticipate now the needs of our REALTORS® in the future? • Global Awareness: We all know Florida is an international destination. How can we tap into foreign buyers of Florida real estate and further promote our beautiful Sunshine State?

• C ommunications: You’ve all probably read our beautiful, content-rich Florida REALTOR® magazine. How can we further provide value and tools to our membership? (Speaking of tools, are you aware of the FREE tech hotline and legal hotline we all have access to as Florida REALTORS®?) How do we promote these and many other resources to our members state-wide? What topics are of interest to our growing membership? This is just a snapshot of the many topics and issues that REALTORS® from around the state come together to discuss and solve. These members volunteer their time away from their businesses and families for the betterment of our industry. In addition to the benefits of being involved in committees that discuss some of the hot topics mentioned above, just being present at these meetings, surrounded by top agents, brokers and executives, fuels you to be better when you get back home. As they say, “iron sharpens iron.” In the hallways, in the hotel lobby, at the bar, over dinner—this is where the real learning and growing takes place. This is where you get to share best practices with your peers from different markets. This is where you learn the pitfalls others

experienced and how you can avoid them. Where should you spend your marketing dollars? Should you open that branch office? How is that CRM working for you? These are just some of the questions and topics discussed after hours. Serving on committees puts you on a level playing field with some of the best professionals from around the state, many of whom are on the top of their game in their careers. Outside of meetings, you solidify these relationships with your peers, eventually forging lifelong friendships. This is invaluable and something you can’t attribute a dollar amount towards. The opportunities for personal and professional development by getting involved are endless if you are open to them. So, why should you get involved? The real question is how can you afford not to?

Working With A Builder’s Inventory W

ith low resale inventory levels, what can a real estate agent do to help clients find homes? At the peak of the market in early 2005, inventory levels were low at a six-month supply. That low level of available homes on the market contributed to the rising prices of homes at that time. According to statistics provided by GTR, we are currently experiencing an extremely-low three-and-a-half month supply. Not only is that causing prices to rise and bidding competition for buyers, it is also leaving our buyers frustrated in the process. One potential solution to the problem is to turn to builders in the market. Many of the builders understand the shortage of available homes here and, in a small way, attempt to capitalize on it by building homes in inventory. They accomplish this by selecting specific lots and floor plans to permit and build. The builder takes on the expense of building the homes in the hopes of selling them before they are completed. Most of the options (flooring, cabinetry, paint color, appliances, etc.) are picked by a builder representative in advance so that the building process can proceed uninterrupted. However, if the home is purchased early enough in that process, there may be opportunities to make some minor changes. Additionally, the builder may offer incentives for either the buyer or their real estate agent, or both. There are some drawbacks to buyers purchasing inventory homes, though. One of the greatest benefits to building a home is the fact that

buyers can personalize their home by selecting options that suit their wants, needs, and decorating style. When purchasing a builder’s inventory home, the buyer is not typically provided with that ability to make any changes to the selections that were predetermined by the builder. The builder makes every attempt to utilize commonly-chosen options for their inventory homes. Doing so makes the home more desirable to a greater number of prospective buyers thereby reducing the amount of incentives that need to be offered as an enticement. Another drawback is that the timing may not be just right for the buyer, but it is dictated by the seller. They’ve spent the money to build the home, so when it goes under contract, they want to close as soon as possible. Without the ability to control the timing, it leaves too much up in the air. At the very least, they would be unable to reasonably predict their profit margin. Most often, one advantage to buying with a builder is that the goals of the builder, mortgage company, and buyer are all in line: a closing as quickly as possible. We do not always see that in a traditional resale transaction. Because the builder wants to keep everything on track, it is common for the builder to contribute toward buyer closing costs. Be aware that, in a new home purchase, the owner’s title insurance and stamps on the deed are paid by the buyer. That is not the case in a resale transaction. Perhaps the builders had good lobbyists. In any case, make sure you consider those fees when

the builder tells you they are going to put money toward the buyer’s closing costs. That contribution should exceed the costs for owner’s title and stamps on the deed. One other item about the closing cost contributionit is an incentive that is offered only if you use the mortgage (and perhaps title) company of the builder. Finding builder inventory homes is not difficult, if you know where to look. Visit builder models in various areas and you can be placed on an email list to receive updated lists of inventory homes. Some builders have very many while others have only a few. The key is to get on everyone’s list so that you can see it all. Then, the trick is to make sure you are connecting your buyer with a “good” builder. You need one with a solid reputation for customer service. If customer service is their focus, that is a good thing. But beware, some builders use phrases like that together with their logo, but they can sometimes be just words. Ask other real estate agents or talk to the on-site sales person to ask how they handle customer issues. Builders can help alleviate the inventory shortage. tamparealtors.org
