Our industry is constantly changing and what works yesterday may not work tomorrow. Customers are always looking for the best value and if we do not offer value, they will seek a solution from other sources. As REALTORS®, we must communicate our value to the consumer or risk the consumers not seeing the whole value picture. I highly recommend this book for your summer or fall reading. Congratulations to our member Nate Kilton, he was reappointed to his position as Vice Mayor of Plant City. Kilton became Vice Mayor of Plant City in 2018 after successfully serving as a City Commissioner from 2016 to 2018. Congratulations to member services team member Brittany Stalker, who received her At Home with Diversity certification in April. This course gave her a better understanding of how to work with people from different backgrounds, religions and ethnicities. In May, Past President Jack Rodriguez was inducted into the RPAC Hall of Fame. The Hall of Fame recognizes dedicated members who have made a significant commitment to RPAC over the years by investing an aggregate lifetime amount of at least $25,000. Congratulations to our Global and Commercial Coordinator, Javin Nededog. He received his CIPS designation in May. This designation will allow him to better assist members with any questions they may have regarding other cultures. Jack Crutchfield, a REALTORÂŽ with Hohman Homes, was recently awarded the 20182019 Rotarian of the Year by the Tampa Carrollwood Rotary Club in recognition of his outstanding dedication and service to the mission of the club.

MAY/JUNE 2019 BOARD OF DIRECTORS ACTION ITEMS The following items were acted upon at the May 2019 Meeting: ✓ Replace RPAC/RCF auditorium wall piece artwork and installation. Painter to remove existing artwork and paint wall to match. Work not to exceed $2,000. ✓ Use Carlyle Electric to upgrade the electrical at the Zephyrhills office as presented at a cost of the quoted price of $8,475. ✓ Accept the Speedy Tree Care bid for the tree work proposal dated 2/5/19 as long as it includes stump removal and pallet removal. ✓ Accept the bid from OFC dated 4/24/19 for new furniture for Kennedy location at a cost of $8,272. ✓ Update our investment policy to reflect the newly proposed minimums and maximums to invest per asset class as proposed by the Investment Policy Task force. ✓ Read “we amend the motion to reflect that our investment policy reflects only the funds managed by our financial investment institution.” ✓ Greater Tampa REALTORS® enter into an agreement with New Smyrna Board of Realtors to have a reciprocal lockbox agreement. ✓ Greater Tampa REALTORS® prorate the LSC fee on a monthly basis for the MLS dues at the time of application. ✓ Use local funds at a cost not to exceed $500 to order acrylic plates for the RPAC wall.

The following items were acted upon at the June 2019 Meeting: ✓ Proceed with renting the auditorium to members only in accordance with the rental agreement dated 6/15/19. ✓ Use Aurora for our parking lot construction at a cost of $23,500. ✓ Fund up to four BOD members at Stellar in the amount of $1,000/ea for airfare, food and incidentals to attend the CMLS conference in 2019. ✓ Amend the budget and update the Great Plains system in 2019 not to exceed $6,500. ✓ GTR provide SavvyCard® to all members as a member benefit. The cost would be offset by a $10 increase in the Stellar MLS local service fee beginning in 2020. ✓ Apply for a $1,500 grant to purchase items for Florida REALTORS® RPAC Auction. ✓ Purchase two American flags, one for the computer room and one to be used as needed.

CODE OF ETHICS Request for Arbitration Expenses

R

EALTOR® A, the listing broker, and REALTOR® B, a cooperating broker, engaged in a heated dispute as to which REALTOR® was the procuring cause of a sale and, therefore, entitled to the commission. Finding that they could not resolve the matter themselves, they agreed to arbitrate in accordance with Article 17 of the Code of Ethics. REALTOR® A initiated the request for arbitration with a letter to the Board; the letter was received and reviewed by the Grievance Committee which agreed that it was an arbitrable matter. The case was sent on to the Professional Standards Committee for a hearing. The President of the Board, consistent with the Board’s Code of Ethics and Arbitration Manual, appointed a five-member Hearing Panel to hear the case. The proper forms agreeing to the arbitration were sent to both REALTORS®, each signed his agreement and returned it to the Professional Standards Administrator. Prior to the date set for the hearing, REALTOR® A learned that REALTOR® B had practiced law before he entered the real estate business. REALTOR® A then decided that he would be at a disadvantage in presenting his case to the Hearing Panel without an attorney due to the legal background of REALTOR® B. REALTOR® A sent in an amended arbitration request in which he asked that he be awarded the commission and attorney’s fees and any other administrative expenses that he might incur in the presentation of his case before the Hearing Panel. The Chairperson accepted the amended complaint as part of the case and mailed REALTOR® B a copy.

The case was set and a hearing was held at which REALTOR® A appeared with his attorney and a court reporter. REALTOR® B acted as his own attorney. The Hearing Panel had the Board’s attorney and a Professional Standards Administrator with a tape recorder present. After giving both parties the opportunity to present their case, the Hearing Panel adjourned the hearing and went into executive session to reach a decision. It was the opinion of the Hearing Panel that the arbitration process is provided to all REALTORS® and REALTOR-Associates® by the Board to avoid any unnecessary expenses. The hiring of an attorney was REALTOR® A’s own decision, not required by Article 17 of the Code of Ethics, the Hearing Panel, the Code of Ethics and Arbitration Manual, or the Board of REALTORS®. The Hearing Panel decided the commission dispute based strictly on the merits of the case presented. The Hearing Panel disallowed the request by REALTOR® A that he be awarded attorney’s fees or other administrative expenses.

Q: My buyer made an offer, and the seller made a counteroffer. My buyer countered the seller’s counteroffer, and the seller rejected it. Now, my buyer wants to go ahead and accept the seller’s original counteroffer. May he? A: No. The buyer’s counteroffer served as a rejection of the seller’s counteroffer. Since the seller’s counteroffer was rejected it may no longer be accepted.

Q: I’m representing a customer with an executed contract. The contract has inconsistencies between the preprinted provisions and the handwritten addendum. The handwritten addendum is in direct conflict with some of the preprinted terms on the contract. Which terms will govern? A: Handwritten and typed terms will generally prevail over preprinted terms that are in direct conflict

Prior to moving here in 2001, I lived in Southeastern Pennsylvania with my wife of now 50 years and our 2 children. I spent much of my career in engineering positions in the medical industry and the water, wastewater and toxic gas analysis areas. I eventually moved into Manufacturing Management, Inventory Control and IT Management for a startup company. I was with that company for 15 years. In 2000, my wife was offered an opportunity at her Company’s new Corporate HQ in Tampa. The Tampa Bay area is now our home and we are very happy here. Today, along with working with Sellers and Buyers, I enjoy a little golf, a little treasure hunting on the beach and a bunch of volunteering at GTR and my Community. It reminds me often why folks here say “it’s just another day in Paradise”.

GIPSY PERRY Gipsy Perry works for BHG Real Estate Ellie & Associates. She is passionate about her career, family and God. Mother of 3 boys and married for the past 15 years. ore and more United States citizens are moving to foreign countries after retirement. *A recent U.S. Social Security Administration report found that 700,000 retirees live in foreign countries. Many of these retirees are baby boomers, who are currently between the ages of 55-75. Baby boomers are moving overseas for three main reasons: 1) They want to save money. 2) They are on a pilgrimage to return to their native roots. 3) They are seeking a new, exciting adventure. Argentina, Australia, Belize, Chile and Columbia are some of the best places to retire according to a Forbes article published in November of 2018. Many Americans believe that they can just up and move to another country whenever, but there is more to it than just getting a passport. Here are a few things to discuss with your client if he or she is considering overseas retirement. • Affordability, cost of living and tax • Safety and ability to travel back to the United States • Prevalence of the English language • The political and cultural climate • Healthcare and Insurance Resources such as irs.gov and travel.state.gov can be a great tool to learn about some of these topics. They even include details on travel advisory and restrictions for U.S. citizens. After your client has decided on a retirement destination have them visit the usembassy.gov to learn about the specific requirements needed to obtain temporary residency in a particular country. What to expect from the Certified International Property Specialist Designation

As an experienced REALTOR®, I work largely with foreign investors. I have taken a number of classes and achieved certifications and designations all of which I found helpful. But somehow I felt something was missing. Following a desire to take my business to the next level, I decided I would take a closer look at the Certified International Property Specialist (CIPS) designation. I read the description of the class and saw there was a bundle being offered, so I decided I was going to take the plunge. I was not ready for what followed. There was a tidal wave of resources, generous firsthand experiences from leaders in this arena and perhaps, best of all, a bond with a circle of other Global REALTORS® that has changed the way I look at the world and my career. What could be so profound you ask? Genuine, highly qualified instructors sharing first-hand knowledge and I mean no holding back. The room was full of other REALTORS®, many of whom are

from all over the world, who each brought their own unique perspective and reactions. The class focused on resources that we already have access to, which are paid for by our dues to NAR, Florida REALTORS® and Greater Tampa REALTORS®. That's right, not only did I get a box full of tools but instructions on how to use them for maximum affect. If you're in the global arena or think you might want to get started, then I highly recommend the CIPS Designation. Also, don't miss the opportunity to join our local chapter of Tampa Bay International Real Estate Council. I have found my place in the sun and hope you will as well.
