BUILDING COMMUNITY THROUGH HOME OWNERSHIP Comedian George Carlin joked that home was just a place to keep your stuff. While that gets a deserved laugh, as REALTORS® we know that home is much more. Home is a place to feel safe, to celebrate, to raise families, to build wealth and to build dreams. Through home ownership, we also build community.
Even answering seemingly simple questions such as “Is that neighborhood safe?” or “Can you help find a nice Christian family to buy our home?” can unintentionally open doors to discrimination. Consider the possible discrimination in phrases such as “walkable neighborhood,” “man-cave,” or “family room.”
Sadly, for many in America, a home as a place to thrive is elusive. While more Americans today are more likely to own a home than 10 years ago, that’s not the whole story. Homeownership rates for Black Americans are still lower than in 2010; while the reasons for that have deep socioeconomic reasons, including affordability, reports of discrimination are still far too common.
As it states in the preamble to our Code of Ethics, the term REALTOR® has come to “connote competency, fairness and high integrity.” At this time of year, we also are reminded of our obligations under the Fair Housing Act, which prohibits discrimination in the sale, rental and financing of housing based on race, religion, national origin or sex.
The National Association of REALTORS® reported in the “2022 Snapshot of Race and Home Buying in the U.S.” that 46 percent of Black/African American home buyers reported being steered toward or away from specific neighborhoods. Similar numbers were reported by Asian/Pacific Islander and Hispanic/Latino buyers. White/Caucasian buyers were at 35 percent. Other forms of reported discrimination included refusal of a homeowner or agent to show a particular property; purchase offer being denied for suspected discriminatory reasons, as well as stricter requirements and access to types of loans.
This month’s issue of Tampa REALTOR® is dedicated to understanding the Fair Housing law and how you can help ensure you are serving homebuyers and sellers in accordance with the law. Adherence to Fair Housing practices not only ensures a level playing field but it also makes the home buying and selling experience better and more enjoyable for everyone.

CODE OF ETHICS Mass Media Solicitation Not a Violation of the Code
R
EALTOR® A, a residential broker, worked in a market area that included an attractive suburb of a large city. At the time REALTOR® A launched a new advertising program, there were a number of houses for sale in the neighborhood listed exclusively with other REALTORS®, each having the respective listing broker’s sign on its front lawn. Working with his advertising agency, REALTOR® A developed a special e-mail solicitation describing the service of his offices. He employed a commercial e-mail distribution service to purchase the e-mails of every homeowner in REALTOR® A’s market area. The e-mail distribution service sent REALTOR® A’s e-mail solicitation to all the homeowners in his market area, including houses that had other REALTORS®’ signs in the front yard. Several of the REALTORS® whose clients received REALTOR® A’s e-mails filed complaints with the Association against REALTOR® A. The Grievance Committee considered the complaints and referred them to the Professional Standards Administrator to schedule a hearing by a Hearing Panel of the Professional Standards Committee at which time all of the complaints would be considered. The complaints charged REALTOR® A with unethical conduct in failing to respect the exclusive agency of other REALTORS®. At the hearing, REALTOR® A defended his action by saying that the distribution of his e-mail solicitation was widespread in nature; that it had
been carried out by a commercial distribution service; and that it was of the same nature as television or social media advertising that might come to the attention of some clients having exclusive listing contracts with other REALTORS®. The Hearing Panel’s decision noted that REALTOR® A, in designing his advertising campaign, did not direct his e-mail to property owners whose identity had come to REALTOR® A’s attention through information disclosed by other REALTORS® consistent with their ethical obligation to cooperate with other brokers under Article 3 of the Code of Ethics; e.g., through a “for sale” sign or through information disseminated through a Multiple Listing Service. Rather, REALTOR® A’s advertising campaign was directed in an indiscriminate manner to all property owners in a given geographical area. Furthermore, the medium REALTOR® A chose for his advertising campaign was an e-mail, which property owners could read or delete as they saw fit. The panel determined that this form of communication does not harass a property owner, as would telephone calls or direct personal contacts. The Hearing Panel, therefore, held that REALTOR® A’s advertising campaign did not violate Article 16 of the Code of Ethics.

Q: Can an agent share a referral fee with someone who doesn't hold a real estate license? A: Section 475.25(1)(h), Florida Statutes, prohibits a Florida licensee from paying a fee or compensating someone who doesn't hold a real estate license in Florida or another state. However, there's a very limited finder's fee exception in Section 475.011(13), Florida Statutes, that permits a property management firm or the landlord personally to pay up to $50 per transaction to an apartment tenant who refers another tenant to live in the same complex.
Q: I’m a landlord, and I don’t want to rent to college students. May a landlord refuse to rent to single college students without violating the Fair Housing Act? A: Yes. College students don’t constitute a protected class under the Fair Housing Act, which prohibits discrimination based on race, color, religion, handicap, familial status or national origin. Familial status has been defined as a person with one or more children under the age of 18, a woman who is pregnant or a person who has custody or is gaining custody of a child under the age of 18. tamparealtors.org

Avoid Fair Housing Violations in Property Descriptions
2021 was the best year for the real estate market in the last 15 years, according to the National Association of REALTORS®. In addition to financial benefits, owing a home brings substantial social benefits for families, communities and the U.S. Home ownership is associated with better educational performance of children, higher participation in civic and volunteering activity, better health care outcomes and lower crime rates in the communities. Yet, not all families have the same opportunities to homeownership, with many of them facing more constraints in their effort to achieve the American Dream. You create the circumstances for housing to be truly fair and for the homebuying experience to be more enjoyable and more meaningful for everyone when property descriptions more appealing to a wider variety of potential buyers. Reconsider these phrases when you create property descriptions.
People-related phrase
- specifically allude to either the current owner, a potential buyer or make a reference to someone's identity.

Perfect for… The property is perfect for anyone who wants it and who has the money or ability to finance it. That is fair housing.
FAIR HOUSING Property-related phrases - appear frequently in property descriptions regarding the layout or contents of the home itself. the neighborhood and home’s location.
Master Suite/ Bedroom/Bathroom
Great Family Home/Room
Implies the owner is or should be a man. Consider owner’s or primary suite/ bedroom/bathroom instead.
Potential buyers include those who are single, unmarried couples, childless and/or retirees.
Playroom for Kids
A bonus space should not be promoted for its family or kid-friendliness. It may make an ideal entertainment room, home office, gym or hobby space.
Neighborhood-related phrases - common phrases that
paint the picture of the neighborhood and home’s location.
Private backyard for playtime with the kids
A fenced backyard can just as easily be enjoyed by those without children.
Great Schools Avoid making assertions about schools. Instead, include the distance to schools in the area.
Safe/Quiet Neighborhood Your judgement of safe or quiet may not be the same as someone else’s.
Walking Distance Nice Neighbors You don’t know how neighbors will treat a newcomer to the neighborhood. This can be misleading and inaccurate.
Walking distances may be a misleading for those who are older or struggle with mobility. Consider providing fractional mileage by using Google Maps. For example, “This neighborhood is conveniently located near Trader Joe’s (0.2 mi), Midtown Tampa (0.4 mi) and Amalie Arena (0.6 mi).”
Near a Church A prospective buyer may not be church-going. This also suggests they should be from a specific denomination.

Ignorance is bliss, they say. Home inspectors don’t get involved with demographics or appraising houses but I still observe the craziness going on in today’s housing market. Prices have skyrocketed and many families are struggling to find options they can afford.
generally start at a lower salary than some other college graduates. How far do we take it? How much involvement do we need from the government and what impact does that have to investors and available housing? I see no easy solutions.
I travel into different neighborhoods every day to do home inspections. I am pleased to see great diversity in Tampa communities, and I see the positive results of 50+ years of Fair Housing laws. I know that discrimination still exists in pockets, and I am thankful that I have never witnessed it. We all need to embrace our founding fathers’ belief that all men are created equal.
Houses are in short supply in our area. More and more people are moving to Florida each day. This is not predicted to slow down any time soon. And there lies the dilemma. If we hinder a free market, it could have an adverse effect Investors may pull out and sell because it’s less attractive. Fewer rental homes mean higher rents as a result of demand. More policies, more regulation, less attractiveness, fewer rental homes, increased rates, less affordable housing … it’s a vicious cycle.
But amid rising home purchase costs and increasing rental costs, discussion surrounds the subject of “affordable housing.” My first thought was that the market sets itself and the government shouldn’t get involved. I have one son who worked hard to get a college degree and a nice job. I have another son who dropped out of college in his first year and works in the labor pool. I don’t think taxpayers should help the one who didn’t put in the work and effort.
Is there a solution? California and New York, which are grappling with the same issues, don’t have good answers yet. I’m worried for my children who are just starting out on their own and looking for their first homes and I worry for those for whom “affordable housing,” is just a hope. Awareness is a good start, but there is work to be done.
Then I searched “Affordable Housing in Florida.” I had no clue that the government subsidized that many developments. I don’t think I’ve heard the terms “extremely low income” or “very low income” in relationship to median income in the area. I can see the value in helping teachers, nurses, and others who
