GTR goes to Tallahassee! Representing Our REALTOR® Members
T
his month our Governmental Affairs committee at Greater Tampa REALTORS® packed up and headed to Tallahassee for Great American REALTOR Days (GARD). GARD is an annual event that allows REALTORS® to speak with state senators and house representatives on legislation important to GTR members and homeowners. Below is a highlight of the issues discussed with state legislators during our trip to the Capitol building. Commitment to Water Quality and Clean Environment Greater Tampa REALTORS® and Florida REALTORS® continues to engage with future legislators to advocate for sound policies that will have a positive effect on environmental restoration efforts in the state. Water is the lifeblood of all Florida residents and visitors. We need safe drinking water as well as it serves to protect our environment. After all, who would want to visit or move to Florida if the beaches, springs, lakes and rivers were not as beautiful as they are? Affordable Housing The State and Local Government Housing Trust Funds were created in the early 1990s to help Floridians in good times and bad. For thousands of families, these funds are the only way to realize the American dream of homeownership. GTR and FR continues to advocate for full funding from the trust funds to be allocated for affordable housing projects. Private Property Rights The internet has made it easier for homeowners to rent their property by expanding housing options for
individuals who live in, or travel to, Florida. Many local governments have enacted new ordinances designed to discourage property owners from exercising their right to rent property. State and local REALTOR® associations, while respecting community concerns, are well positioned to monitor state and local regulatory activity and to take action to protect private property rights. Being able to rent your home is a fundamental right. Open and Expired Permits It is common for an open permit to interfere with the closing of a real estate transaction. GTR and FR support legislation that helps property owners close both open and expired permits when the original contractor is unable or unavailable to do so. Assignment of Benefits An Assignment of Benefits (AOB) provides insurance policyholders with the ability to assign their post-loss insurance benefits to a contractor. These contractors can then directly charge the insurance company for the cost of remediation or repairs. However, a growing number of contractors have been inflating the cost of repairs. GTR and FR support legislation that would reform the assignment of benefits process to help stop this abuse. Online Remote Notarization FR supports the adoption of tools and processes that improve the experience for consumers and the REALTORS® serving them. Remote online notarization is one of those tools, modernizing the sales transaction and allowing for increased flexibility when it comes to closings.
Business Rent Tax Lowering the business rent tax will provide Florida businesses with the capital to expand, hire more employees, improve benefits and raise salaries. GTR and FR continues to advocate for further reductions to this tax, giving businesses financial resources to grow their companies and enrich their communities. LIDAR Mapping Elevation mapping is one of the tools that the Federal Emergency Management Agency (FEMA) uses to determine flood insurance zones and rates. LIDAR (light detection and ranging) mapping is currently the most technologically advanced elevation mapping process that has been developed. GTR and FR support the most accurate elevation mapping process and the funding needed to pay for it. These are not just REALTOR® issues, these are concerns for all property owners, business owners, tenants and even visitors to Florida. As REALTORS®, we take it upon ourselves to protect property rights, keep our waterways clean and maintain a healthy environment. This is why I am a member of our Governmental Affairs committee and why I support RPAC.

This is his fourth year working with the organization. Jacob Bruynell recently joined Greater Tampa REALTORS ® as the new Programs Manager. He is a fourth generation Tampa Floridian and attended Florida State University where he majored in Political Science/Economics. He has previous experience in large-scale event planning for a physicianbased association and most recently worked as a project manager for an asset management firm focusing on fixed and capital assets. JAN/FEB 2019 BOARD OF DIRECTORS ACTION ITEMS The following items were acted upon at the January 2019 Meeting: ✓ Hire the appropriate inspectors to report on all areas of building – roof, electric, ac, plumbing, not to exceed $750. ✓ Revise the Benevolence policy. ✓ Adopt the Member room rental fees and equipment fees as outlined in the rental contract prepared by the GTR Board Attorney. ✓ Charge a handling fee of $50 or 5% of the full value of the check, whichever is greater, each time a check is returned. ✓ Screen the mayoral candidates after the March 5, 2019 election. ✓ Recommend Charlie Miranda for Tampa City Council (District 2), Guido Maniscalco (District 6) and Luis Viera (District 7), with no screening and maximum funding. ✓ Submit request to roll over remaining 2018 local RPAC funds for use in 2019. ✓ Sponsor the Lincoln Day Dinner and the Kennedy King Dinner at the $5,000 level since 2019 is not an election year using local RPAC funds. ✓ Move forward with the Member Services Advisory board recommendation for IXACT CRM including the terms in the recommendation to include exclusivity from the contiguous associations and for up to a six year period. ✓ Request $1,000 to purchase auction items. ✓ Authorize CEO to sign Supra Amendment 4 to Master Agreement. ✓ Use Stephen Lytle for the HR outsourced ongoing support for the Open Door Policy. ✓ Accept the proposal from Bailey for Employment Compensation Survey at a cost not to exceed $4,000.
The following items were acted upon at the February 2019 Meeting: ✓ Move forward with the letter of intent as presented by Insured Title Agency, LLC. ✓ Procced with lining bid by blueworks and the power assist toilet replacement bid by IERNA. ✓ Add the downstairs toilet to the power assist. ✓ Rent the auditorium to members only and include all rooms listed on hourly rental sheet. ✓ Move forward with acquiring an executive office suite lease in the greater Brandon/ Riverview area to provide member service to our members. ✓ Support 20’ protective root zone and minimum mandatory reconfiguration standards while opposing increased neighborhood notice standards. ✓ Postpone our vote to approve the three tree ordinance measures until after the public tree representative provides us with clarification. ✓ Sponsor the annual Pasco County Republican and Democratic dinners not to exceed $3,000 each using local RPAC funds. ✓ Move the funds from the off-site Tech Expo to the on-site Tech expo budget to accommodate the fee to cover the key note speaker. ✓ Enter into a reciprocal Supra agreement with Ocala/Marion County Association of REALTORS®.

CODE OF ETHICS Obligation to Advise Client on Market Value
C
lient A went from his hotel to REALTOR® B’s office and advised that he formerly lived in the community, and had kept his home as an income property after he moved away. The house had been vacant for several months and he had decided to sell it. He asked if REALTOR® B could drive him to look at it. As they inspected it, Client A stated that he would be happy to get $80,000 for it. REALTOR® B listed it at that price and after a few days it was sold to Buyer C. Six months later, Client A was in town again. Hoping to recover a box of old photographs he had left in the attic, he called on Buyer C, whom he had met at settlement. When he arrived he found that Buyer D then lived in the house. He expressed some surprise that Buyer C had sold it so soon, and learned that Buyer D paid $140,000 for it. Astonished, Client A then made some inquiries as to market values and learned that he had grossly under priced his house when listing it with REALTOR® B. He went to the Board of REALTORS® office and filed a complaint against REALTOR® B charging him with unethical conduct in not having advised him as to the property’s fair market value. At the hearing, REALTOR® B’s defense was that he had not been asked to put a price on the house, but had accepted agency on the basis of a price set by the client; that the client had stated he “would be happy” to get $80,000 for it; that he was glad to get a listing that would move quickly in the market; that he had done nothing unethical since he had not bought it himself; and that while he had honestly pointed out to the
buyer that the house was a bargain, he had made no effort to induce relatives or business associates to buy it. On questioning, he conceded that after looking at the house with Client A, he realized the property was being listed at about half its fair market value, but insisted that was his client’s business; that different owners have different reasons for selling and pricing their property, but acknowledged that Client A had not indicated that he needed a quick sale or that he would make any price concession. The Hearing Panel pointed out that brokers have no hesitation in advising clients that properties are overpriced when this is the case, and they are obligated to be equally candid in providing their best judgment to clients when properties being offered for sale are obviously underpriced. The panel concluded that in view of the wide discrepancy between the owner’s asking price and the property’s market value, which REALTOR® B conceded was apparent to him, it was REALTOR® B’s obligation as an agent to advise his client that the house was worth considerably more, especially since it was apparent that Client A had been away from the community for years and was out of touch with local values. The Hearing Panel found REALTOR® B in violation of Article 1.

Q: A landlord has placed a newspaper advertisement stating that he will rent his residential property only to nonsmokers. I represent the applying tenant, a smoker who feels that he is being discriminated against. If the landlord decides not to lease the property to the tenant based solely on the fact that he is a smoker, would that be a violation of the Fair Housing Act? A: No. A smoker is not a member of a protected class as defined under the Fair Housing Act. Under the Fair Housing Act, the only protected classes are as follows: race, color, religion, sex, handicap, familial status and national origin. Thus, the landlord’s refusal to rent his residential property to the tenant based solely on the fact that he is a smoker is not a violation of the Fair Housing Act.

On March 20 and 27, we are pairing up with GTR’s Global Committee for The Port Tampa Bay Educational Harbor Tour, that you won’t want to miss! See their vision for 2030, the economic impact it has on Tampa Bay and the jobs that it will bring along with it. Our first REALtour of 2019 will be on April 25. We will be boarding the Pirate Water Taxi for two hours along the Hillsborough River. In 15 stops, you’ll see some of Tampa’s greatest riverfront attractions and hear about Tampa’s history. The Key to a Successful Relocation Department by Diane Howard

elocation departments within real estate companies provide important roles as suppliers of real estate services and advocates for relocation management companies (RMCs). As a single point of contact, they support thirdparty companies by providing valuable real estate information and services to transferring employees. To provide the highest level of service, a department must be well equipped to handle a variety of incoming assignments and be knowledgeable about local market changes and industry practices. Whether a brokerage has a large relocation department or a small team, coordinating incoming assignments with trained real estate associates takes knowledge and expertise of the referral process. In today’s market, it’s difficult to predict how much business will be provided by an RMC, but their requirements and expectations are the same; they expect a department to have a system in place for managing assignments, and to have the right talent in place to fulfill their service needs.

RELOCATION DEPARTMENTS THREE DISTINCT ROLES There are three distinct roles within a relocation department that help ensure a smooth operation and process flow; the role of the relocation director, the department coordinator and the sales associate in the field. Working together, they provide quality service to the customer and to the corporate client. To encourage strong relationships and form new partnerships, the broker relies on the performance of its relocation team to help lead them to success. The roles and responsibilities defined in a brokerage environment are: Relocation Director - Directs and oversees an organization's relocation accounts and activities. Performs a variety of tasks including leading and directing the work flow of coordinators and real estate associates to assure compliance with all relocation requirements. Relocation Coordinator - Accepts, processes and tracks all incoming assignments. Maintains communication with all parties (i.e. buyer, seller, agent and corporate counselor) involved in a sales transaction. Understands the profile of all real estate associates who are relocation-trained to be able to properly match the assigned lead to the most qualified agent. Real Estate Sales Associate - Has a clear understanding of the market conditions, economics, median prices and community information for local market areas. Has good communication skills, an overall understanding of the transferee needs, as well as the requirements of the third-party client. Real estate associates must seek to provide a 'wow' customer experience. Each role is clearly defined, but depending on the size of some brokerages, a staff member may have more or less responsibilities. For example, a relocation director may be responsible for accepting and placing assignments in addition to overseeing the department. Or they may only be responsible for business development, reviewing contracts and creating operational guidelines, and may have the assistance of a department manager to oversee daily assignments. In either case, providing the best internal system for success requires dedication, and buy in from the entire team. Relocation directors who meet with their department coordinators on a regular basis to address daily challenges have the opportunity to implement systems
that keep their staff engaged in the tasks at hand. At the same time establishing parameters for training and setting expectations for the real estate sales associate is a must. Supporting his or her efforts in providing exceptional service assures that everyone is working toward the same result. Relocation coordinators, who receive assignments directly from a corporate client, rather than from their relocation director, understand the importance in processing assignments within specific guidelines. All third party companies are not the same; knowing their individual requirements and timeframes is essential. However, there are enough similarities in guidelines to allow coordinators to implement general guidelines that can be followed with each assignment. This usually means that for each assignment, coordinators will conduct a customer needs assessment and provide this information along with specific client requirements to the assigned sales associate. The relocation coordinator’s role is to effectively communicate with those involved in a corporate move. Their responsibility is to make sure that the relocation counselor is informed and continuously updated regarding all details of the transfer. This communication is essential to help avoid any surprises that may arise, or to address any issues that start developing during the transaction process. Include coordinators in the training process for sales associates. Since they interact with sales associates during the assignment process, getting to know each sales associate supports proper placement. In addition, coordinators are responsible for reviewing service results; including, the number of assignments given, an associate’s conversion rate, survey results and overall presentation in their websites. Sales associates are the heart and pulse of a successful relocation department. Aside from the typical associate comments of wanting more referral business, or not wanting to complete multiple training programs, most sales associates who join relocation teams understand the mindset that is required to handle the needs of relocating families. In fact, some relocation-trained associates were once transferees or may have worked in the mobility industry. Associates that subscribe to this mindset pride themselves on providing exceptional service and most embrace additional training to hone their skills. tamparealtors.org

Although several third-party companies require their network brokers to complete specific training programs through their certification process, most relocation departments maintain their own training program to set forth standards and expectations for their sales associates. Fair Housing: Advertisements
The Fair Housing Act (FHA) was signed into law in 1968 by then-President Lyndon Johnson. FHA prevents discrimination concerning the sale, rental or financing of a property based on race, religion, sex, disabilities and family status. This law also applies to housing-related advertisements. In late-2018, the Department of Housing and Urban Development (HUD) filed a complaint against social media giant Facebook for violating FHA. Facebook was allowing real estate Brokers to exclude specific demographics from seeing their Marketplace listing. Some of the demographics excluded from advertisements included African Americans, Jews, Spanish speakers and people interested in wheelchair ramps. Following the complaint, Facebook updated its policies to align with the Fair Housing Act. Now real estate professionals are wondering if their advertisements are compliant with FHA. Here are tips to ensure your online advertisements are compliant with FHA. 1. Don't narrow your audience for targeted marketing campaigns. Many social media sites such as Instagram and Twitter allow you to select a target demographic based on several features. When it comes to sponsored social media post broader is better. 2. Diversify your advertisements by utilizing inclusive representation in images. Stock photo sites such as iStock, Adobe Stock and Pexels are a great tool for finding inclusive photos. 3. Focus on the property, not the targeted buyer. Always include price, location, features and amenities in advertisements. Phrases such as "consigners allowed" or "monthly income must be 3x the rent" are acceptable. It's important to avoid phrases such as "English speaker preferred" or "assistance programs not accepted."

WHY MEDIATE? Taking Control by Susanna Madden
The National Association of REALTORS® Code of Ethics was adopted in 1913 years ago to ensure consumers are properly served by requiring REALTORS® to cooperate with each other in furthering their clients' best interests. Why? Let’s just say there were some unsavory types selling real estate to unsuspecting buyers. The creation Code of Ethics and the invention of the word REALTOR® differentiates us from real estate agents who do not promise to abide by the code. Its purpose is to show our professionalism to the public and promote the benefits the word offers. There are 17 Articles in our Code of Ethics and when we take the oath to become a REALTOR®, we swear to abide by them. 16 of the Articles have to do with our duties to our clients and customers, to the public and to each other. The 17th Article has to do with arbitration, which is how we handle the situation when there’s a dispute over who is entitled to the professional fee. There are several important things to remember here: • The property must close before it can be arbitrated or there is no commission to arbitrate. • Arbitration is actually between brokers, not agents, as the brokers own the listings. Only brokers can offer and accept offers of compensation. • The preponderance (greater weight) of clear, concise evidence showing no break in the chain of a series of events connecting to the buyer helps to determine the prevailing party. • The panel’s decision is not based on: • Who wrote the contract first • Who showed the property first But remember this: arbitration is binding and in the end one party will prevail. Except on very rare occasions, one party will walk out with all the marbles.
When you joined this Association, you agreed to arbitrate commission disputes in accordance to the regulations of the Association and be bound by the decision. ENTER: MEDIATION Greater Tampa REALTORS® offers mediation to members who are in an arbitration dispute, whereby they can sit with a mediator to discuss the situation and see if they can come up with their own compromise. The purpose of the mediator is not to offer solutions, but rather to be certain each party respects the other’s right to speak. The parties may talk about what services they provided for the client, how they met them, what they discussed with them and then in many cases, information is gleaned that the other party had not been aware of. There is no predetermined entitlement of commission. The two parties can work it out however they wish. For example, splitting the professional fee however they agree and the broker will allow. Or they may choose to come back for more mediation discussion. Or, they may choose to go ahead and take their chances and arbitrate, letting the chips fall where they may. This is why mediation is NAR’s preferred method of dispute resolution. Mediation can salvage reputations, friendships and feelings. So, to mediate or not to mediate? That is the question that perhaps you should consider, if the time comes when you are faced with an arbitration situation and you want to take control of the outcome of a commission dispute.
