We spoke, they listened! RPAC Update

I

n my last message to you, Greater Tampa REALTORS® and members of our Governmental Affairs committee along with other REALTORS® from across the state where we spoke Florida Legislators and they listened. Your investment in RPAC is working and the results speak for themselves - As you can see these issues are not political issues but real estate issues affecting all of us, our families, our neighbors and the communities we call home. I am proud to be a Major Investor, and I encourage you to become an RPAC investor for 2020. Your support makes a difference, and every dollar invested helps us reach our goals! Ask any of our staff how you can help and be an RPAC investor. Some of our victories include: Remedies to open and expired permits — HB 447 allows local governments to close a permit six years after its issuance as long as no apparent safety hazards exist. It also prevents local governments from penalizing property owners for an open permit that was applied for by a previous owner. Effective: October 1, 2019. Approval of online remote notaries — Florida now joins the many states allow the use of online remote notaries in real estate transactions to make closings easier, faster and more convenient for distant parties. Effective: January 1, 2020. Curbing Assignment of Benefits (AOB) abuse to keep insurance affordable — HB 7065 limits contractors’ ability to receive payment for their attorney fees if the claim is settled or won in court. Please note: All bill provisions become effective on July 1, 2019, except for provisions

relating to attorney fees, which become effective when the bill is signed into law.

Professional Regulation (DBPR) to combat unlicensed real estate activity. Effective: July 1, 2019.

$682 million for environmental projects — Proposed funding includes $322 million for both Everglades restoration and the early planning, design and construction of the Everglades Agricultural Area Reservoir, $40 million to complete the raising of Tamiami Trail, $100 million for springs restoration, $50 million for beach restoration projects, $10 million for a red tide/blue green algae task force and $25 million for a septic-to-sewer cost-share program. Effective: July 1, 2019.

Fighting red tide through research and technology — SB 1552 establishes the Florida Red Tide Mitigation and Technology Development Initiative, a partnership between the state and Mote Marine Laboratory to develop technologies that can control and mitigate red tide and its impact. Effective: July 1, 2019.

Further reduction to Business Rent Tax — Businesses throughout Florida will save more than $65 million each year due to a .2% reduction of the business rent tax. Effective: January 1, 2020. More than $200 million for affordable housing projects — Lawmakers allocated $200 million from the state and local government housing trust funds for affordable housing programs. This includes $115 million to assist Panhandle residents whose properties were devastated by Hurricane Michael. Effective: July 1, 2019. Continued funding for LIDAR mapping — The budget includes language that allows the Division of Emergency Management to continue spending the $15 million currently being used for LIDAR (light detection and ranging) mapping. Effective: July 1, 2019. Preventing unlicensed real estate activity — The Legislature allocated up to $500,000 from the Professional Regulation Trust Fund to the Department of Business and

Flood insurance matters — HB 617 requires insurers that do not provide flood insurance to provide a disclosure at initial issuance and each renewal regarding the importance of flood insurance. Effective: July 1, 2019. Property owner bill of rights and tree trimming — SB 1400 requires county appraisers to publish a list of constitutionally protected property rights on their websites. The bill also allows property owners to trim or remove trees on their property without consequence if they have a letter from a certified arborist or landscape architect stating the tree is a danger. Effective: July 1, 2019. Providing more structure for beach restoration projects — HB 325 creates a five-year work plan for beach renourishment projects throughout Florida based on a specific set of criteria. The following items were acted upon at the March 2019 Meeting: ✓ Update policy to match the current Supra Rules and Regulations that members sign. ✓ Move forward with a three month lease of an executive suite located in the Crosstown Executive Suite , 1503 US. Hwy 301 South, Tampa FL 33619 at a rate of $575/month. ✓ Move forward with the City of Tampa recommended candidates. ✓ Support the new tree ordinance as proposed by staff from the City. ✓ Order 250 of the RPAC vintage shirts in assorted sizes in red and blue with the message “Defending the American Dream” and sold for $20 each fair share. This expense of approximately $1,500 would be paid using local RPAC funds.

The following items were acted upon at the April 2019 Meeting: ✓ Accept 2018 Audit results as presented by Rivero Gordimer & Co P.A. ✓ Ratify the email vote to hang the GO Bolts Banner. ✓ Purchase a Florida flag and a REALTOR® flag and two 7’ poles for both the board room and auditorium at a cost of $329.97 each plus tax and S/H. ✓ Move forward with the alarm system provided by Utility Helpers at the Zephyrhills location. ✓ Use Agent Brand as the company for making the three websites ADA compliant at a quoted cost of $5,500. ✓ Staff be authorized to negotiate contract with Agent Brand and sign contract with the following three terms: Time frame for completion, Compliance testing/ ranks AA before final payment, and vendor liability stated within contract. ✓ Move forward with the CW44 ads as presented at a cost of $5,500. ✓ Move forward with the Outfront Media billboard plan to place billboards at the Dale Mabry & Waters intersection and Westshore & Spruce intersection for about five months at a cost of $22,482.50. ✓ Move forward with the Real Estate for all Tampa Bay Alliance as presented in the proposal. Knowing or Reckless False Statements About Competitors

R

EALTOR® A operated a residential brokerage firm in a highly competitive market area. He frequently used information from the MLS as the basis for comparative ads and to keep close track of his listing and sales activity as well as his competition. One day, while reviewing MLS data and comparing it to a competitor’s ad, REALTOR® A noticed that REALTOR® Z had used a diagram to demonstrate his market share, contrasting it with those of several other firms. The ad showed that REALTOR® A had listed 10% of the properties in the MLS over the past three months. REALTOR® A thought this was low. His analysis of MLS data showed his market share was 11%. REALTOR® A filed an ethics complaint against REALTOR® Z citing Article 15 of the Code of Ethics in that REALTOR® Z’s “obviously understated market share claim” was a “misleading statement about other real estate professionals.” REALTOR® A’s complaint was considered by the Grievance Committee which determined that an ethics hearing should be held. At the hearing, REALTOR® Z testified he had always been truthful in his advertising and that all claims were based in fact. He produced an affidavit from the MLS administrator which indicated that a programming error had resulted in miscalculations and, after careful recomputation, REALTOR® A’s market share over the past three months had been 10.9%. The administrator’s statement noted that this was the first time that information related to REALTOR®

A’s listings or sales had been misstated on the system. “I relied on information from the MLS. It’s always been accurate and I had no reason to even suspect it was wrong last month,” said REALTOR® Z in his defense. The Hearing Panel agreed with REALTOR® Z’s logic, noting that a REALTOR® should be able to rely on generally accurate information from reliable sources. They reasoned that if, on the other hand, the MLS had shown REALTOR® A having, for example, 1% of the market, then REALTOR® Z’s reliance on the information would have been “reckless” because REALTOR® A had generally had a 10 –15% market share and a reasonable conclusion would have been that the information from the MLS was seriously flawed. The Hearing Panel concluded that REALTOR® Z’s comparison with other real estate professionals, while slightly inaccurate, was based on usually accurate and reliable information and had been made in good faith and while technically “misleading,” had not been “knowing” or “reckless”. REALTOR® Z was found not to have violated Article 15.

Q: Is a cooperating broker who procures a buyer entitled as a matter of law to half of the commission that the listing broker receives? A: No. There is no law entitling a cooperating broker to half of the commission received by a listing broker.

Q: I represent a seller and can’t gain access to show the property due to an uncooperative tenant. What can I do? A: Section 83.53, Florida Statutes (Landlord and Tenant), provides that tenants shall not unreasonably withhold consent to the landlord to enter the dwelling for reasons including, but not limited to, making repairs as well as exhibiting the unit to prospective buyers. A landlord may notify tenants that they must remedy their noncompliance within seven days of receipt of the notice. If they don’t, the landlord has the right to terminate the lease and move for an eviction.

YPN Has Its Perks

Benefits of Being a Member Known as Greater Tampa REALTORS®’s Young Professional Network (YPN), this subcommittee offers the benefit of networking with peers and navigating many of the community events that help educate, inform and service Tampa residents and those looking to move to Tampa. We network with many of GTR’s other subcommittees and often partner with them on events within the community such as March’s ‘Port of Tampa Bay Tour’ with the Global subcommittee. YPN is not dictated by age but rather an open, creative and collaborative approach to serving the members of the association. We embrace the fresh ideas of our subcommittee members, which helps to develop them into leaders of the community. Our committee echoes a membership that is like a family while setting a high bar for leadership. This is demonstrated through the deliberate accountability to educate members about projects and new developments happening in the Tampa Bay area. Often this is accomplished by the subcommittees’ REALTour(s). YPN hosts the following networking and fundraising events: • • • • •

REALMix REALTour BLUEParty Appreciation Annual Event Tacky Sweater Party Charity of the Year Participation – Volunteerism benefiting Bay area youth

YPN has had great success with these events. In fact, many participants still mention the REALTour, at Tampa International Airport in Oct. 2017, as more than 50 participants toured pre-construction expansion of the airport and attended a presentation of the airport’s goals for expansion and impact of the new direct international routes. In addition to tourism, REALTORS® also learned how to best service some of the niche

12

communities. Our most recent REALTour took members on a two-hour ride along the Hillsborough River to see Tampa's riverfront views and learn about downtown Tampa. The REALTour at Epperson’s Crystal Lagoon in Wesley Chapel last June was another one of YPN’s successful tours. We had the opportunity to meet with the community’s builders for in-depth discussions on how to serve clients as well as the many people relocating to Tampa. In fact, there are at least 150 people relocating to the Tampa area daily, according to WFLA News Channel 8 Daytime TV. Each member has their own outlook based on the different niches they represent. Many serve on other committees, so they can richly contribute to discussions that complement the mission of YPN’s members and how we may impact the many aspects of real estate such as millennials, tech, relocation, bilingual sellers and buyers, vacation homes, commercial, global real estate, property management and investment clients. YPN has been around since 2012. Understanding the Telephone Consumer Protection Act How TCPA Applies to Telemarketing Practices by Tamiracle Williams

M

any homeowners receive dozens of calls and text messages when they list a home without an agent or when they remove a property from the multiple listing service, according to Inman. Many REALTORS® use various customer-relationship management tools and automated phone marketing technology to generate a list of potential homebuyers or sellers to contact. With this list, agents can automate texts, phone calls and leave ringless voicemails. However, many agents fail to realize that these automated marketing tools could be a violation of the Telephone Consumer Protection Act (TCPA). The Telephone Consumer Protection Act signed by President Bush in 1991 was implemented to protect consumers from harassing calls, spam texts, junk faxes and solicitation voicemails. In conjunction with the TCPA, the Federal Communications Commission (FCC) released rules and regulations for telemarketers to follow. Here are the current rules and regulations under the Act: • Solicitors can not call before 8 a.m. or after 9 p.m. • Solicitors can not contact people with an auto dialer or prerecorded message who have not explicitly consented to be contacted • Companies must keep an up-to-date list of people who have requested to be removed from their telemarketing list • Solicitors must include their full name, company name and contact information in messages • Solicitors must provide an opt out feature for calls and text messages.

In addition, the Federal Trade Commission created the National Do No Call Registry for consumers who do not want to receive telemarketing calls. The FTC prohibits contacting people on this and provides consumers with a way to report soliciting messages. The minimum penalty for violating the TCPA or contacting someone on the Do Not Call Registry is $500.

Real estate professionals who choose to use lead generation or phone marketing technology should use caution when using autodialing or auto texting services. Here are some ways to avoid violating the TCPA: • Make sure that the marketing software you are using has obtained written consent from the parties you wish to contact. • Check telemarketing.donotcall.gov to avoid sending automated communications to a registrant on the Do Not Call Registry. • Review in-house do not call list to remove any additional prospective homebuyers or sellers who do not want to be contacted by your brokerage.

As videos become the new norm for digital marketing, real estate professionals should begin to incorporate this strategy into their content marketing plan. Creating a high-quality video that can be crosslisted on social media, MFRMLS and your website takes planning. Answering the following questions can help you develp a video creation plan:

Who will be producing the video? Video production can be a time consuming and stressful task on top of the day to day responsibilities of a real estate professional. If this is a project you wish to take on, it’s important to block schedule time to plan and execute the video. If you don’t have flexibility in your schedule, consider visiting the GTR Affiliate Directory to find a videographer for the project. An alternative would be to utilize live-streaming video features found on social media platforms such as Instagram, Facebook and LinkedIn. What is the purpose of the video to inform, persuade or entertain? Determining this can help you decide what type of video you want to produce. REALTORS® can use videos to:

• establish a brokerage or personal brand • showcase a new listing • highlight your local community's features • provide first-time homebuyers with tips and tricks to navigating the homebuying process What action would you like your audience to complete after watching the video? This action can vary depending on the type of video you create. Not sure what call of action you should use? Here are a few examples: • Listing Video: The idea action would be for a prospective buyer to schedule a showing or ask for additional information on the property. • Personal Brand Video: The goal would be for the viewer to visit your website or reach out for a consultation. What branding will you include in the video? Branding is your personal or brokerage identity. It can be as simple as including a logo in the corner of the video or as detailed as creating an intro and outro with your contact information. It’s important to make sure that the branding featured in the video corresponds with other marketing material to create consistency.


When will you shoot? This is extremely important for REALTORSÂŽ that have buyers currently living in a listing. Find a date and time that works for all parties involved and try to be flexible for your client. If you are not working with a professional company, consider shooting during golden hour. Golden hour refers to the time frame right after sunrise and right before sunset. This provide soft natural lighting in video. Where will the video be posted? Most websites and social media platforms are capable of hosting videos, however, they each have their own restrictions and guidelines. Wanted: nominees for the 2020 board of directors Guide the Future of Your Association with a Seat on Greater Tampa REALTOR® ’s Board The search now begins for ready, willing and able REALTORS® to not only serve your association as the leaders and decision makers, but to help lay the groundwork for its future. As a GTR officer or director, you could help guide the direction of our profession on the local level and in your business communities. The GTR Nominating Committee consists of two appointees from the Board of Directors and three general members elected annually at a General Membership Meeting (held on April 30 this year). The Nominating Committee will interview qualified candidates to serve on the 2020 board in the positions of officers or directors. Following personal interviews, the committee will submit a recommended slate of candidates. DO YOU QUALIFY AS A CANDIDATE? General Qualifications: According to the GTR’s bylaws, all candidates must be active REALTORS® in good standing with the local association at the time of application and at the time they take office. Director: Candidates must have served at the time that they take office as a chairman of a committee of the association for one year, or served on a committee for two years within the last five years. Corporate Secretary and Vice-President: Candidates must have served at the time that they

take office as a director of the association for a completed twoyear term within the last five years. Treasurer: Candidates must have served as an officer or director for a complete term and have served as a member of the Finance Committee for at least one full year within the past five years prior to being nominated. President-Elect: Candidates must have served as an officer or director for a complete term and have served as a member of the Finance Committee for at least one full year within the past five years prior to being nominated. Limits: No elected or appointed director or officer shall have served in the same capacity for more than two consecutive terms. The same person may not serve consecutive terms as President, nor may the same person serve consecutive terms as President-Elect. Facebook Advertising Changes New Targeting Exclusions for REALTORS® by Tracy Wisneski Facebook is a data giant, collecting details about users and their online practices that can be used to target ads with far more precision than traditional ads ever could before. While that presents a fantastic opportunity to market to well-tailored audiences, it has also opened that opportunity to those who would abuse it. Those abuses became public in 2016 when Pro-publica investigated the ability to create Facebook housing ads that excluded users by ethnic affinity, which is most often race-based. Such ads are a direct violation of both The Civil Rights Act of 1964, as well as The Fair Housing Act of 1968. In response, Facebook no longer allows advertisers of housing, credit or employment to use ethnic affinity as a targeting tool as of November 2016. It also updated its policy details and education on discriminatory practices and required advertisers in certain industries to certify compliance with Facebook’s non-discriminatory policy that includes more protected classes than current federal legislation. However, discriminatory ads persisted excluding people based on gender, age and location. The exclusion of certain zip codes was potentially being used to discriminate against certain populations, enabling redlining. Several lawsuits followed, culminating in a settlement in March removing further targeting from advertisers of housing, credit and employment. The three biggest new targeting exclusions for REALTORS® are age, gender and zip code. Zip code is an integral part of our effective advertising, especially in its ability to help us target potential home sellers in our specialty areas. Additionally, it allows us to create ads specific to an area

that have a higher engagement rate. The exact zip code restriction has not quite been rolled out yet, so it remains to be seen exactly how it will work. I have seen promises that we’ll at least be able to pinpoint a radius of as small as 15 miles, which will be important, but still limiting fair advertising that does not discriminate against protected groups. We’ll learn more about those restrictions in coming months. How can you be sure that you will not mistakenly break these new restrictions? Facebook is ramping up its educational component and will continue to require housing advertisers to certify compliance, and in doing so, alert you of the changes. They are also improving their digital monitoring tools, which will alert advertisers to ads or targeting that look like they may be breaking policy (or the law). Those alerts will include further information, as well as an option for a manual review if there may be a mistake. An upcoming change that looks like it will be an asset for REALTOR® marketing endeavors is the creation of a new searchable portal listing all housing offered, regardless of ads or newsfeed content. I look forward to learning more about how that will work and how we can best utilize it to serve our clients and find more prospects.
