Cyber Crime What You Need to Know It's a great day, it's a little cooler and the holidays are around the corner! All is going well until you get a phone call from your client. They followed the instructions and have wired $37,000 to the title company for the closing. They called the title company to confirm receipt, but the title company did not send out the instructions yet because they do not have the final numbers! What do you do next? Three steps to reporting and investigating suspicious activity 1. Report to IC3.gov, the local FBI field office, and the local Sheriff's department. Immediately report details and follow all instructions. Chances of recovery drop off significantly after the first hour and become very difficult or impossible after 72 hours. 2. Notify both the sending bank and receiving bank of the possibility of fraudulent activity. 3. Follow instructions from the local bank and secure the local bank account. Recently, I attended the National Association of REALTORS®' board of directors meeting in San Francisco and I had the opportunity to listen to Frank Abagnale a former check conman, turned FBI agent for over 40 years. See the movie “Catch Me If You Can” for more background on Mr. Abagnale. In the seminar, I learned how you can protect yourself, your data and your clients personal information. We have all been aware of this for some time, but the threat continues to grow! According to IC3.gov, total complaints received have now exceeded 1,509,679 and $7.45 billion in total loses. In 2018 alone, Florida ranked third in the number of victims at 23,984 and a total of $178,141,470.

Steps to increase your security 1. Have a conversation with your buyer or seller about the crime and inform them about ways to detect suspicious activity. Florida REALTORS® provides a notice and disclosure about wire fraud, I have every buyer sign this disclosure making them aware of the concern. 2. Immediately before wiring funds, call the intended recipient to verbally verify the instructions are accurate, using a phone number you know is correct. Never trust a phone number included in an email with instructions. Be suspicious, it is very unusual for wiring instructions to be changed. Hearing about a change in wiring instructions is a red alert! This type of activity usually confirms someone’s email has been compromised. 3. Never send financial information over via email. It is not secure. Protect your personal email by using strong passwords, never clicking on suspicious links, using email services that offer better security. Many email services have been compromised. 4. After sending the transfer of funds, verify the funds have been received by the title company. 5. Turn on two-factor authorization or multi-factor authorization on your accounts. There are several options. Some send a text code to a trusted device (your phone) other methods use a FIDO2 and U2F physical key (Yubico key, Google key). 6. Consider using a Virtual Private Network (VPN). A VPN extends a private network across a public network and enables users to send and receive data across shared or public networks as if their computing devices were directly connected to the private network. Never send sensitive information across a public/open network. All

information sent in the open is free and open for anyone to view. 7. Consider using a password manager. Password managers help you generate secure passwords, help you remember them across all devices and remove the option to continue using the same password again and again, in some cases, they will alert you to a weak or compromised password so you can change it ASAP. Some offer free versions that will help you get started until you feel the need to move up to more robust version. 8. Limit the information you provide on social media. With just a little time investigating, crooks can obtain amazing amounts of “personal information” easily assuming a person's identity. Greater Tampa REALTORS® will be offering classes in 2020 to help you understand the extent of these crimes as well as how you can avoid putting yourself and your clients at risk. SEPTEMBER/OCTOBER 2019 BOARD OF DIRECTORS ACTION ITEMS The following items were acted upon at the September 2019 Meeting: ✓ Change the name of the Tampa Bay International Real Estate Council to either Greater Tampa Global Business Council or Tampa Bay Global Business Council. ✓ Use local funds at a cost not to exceed $130 to pay for breakfast at Ross Spano’s check presentation on Friday, August 30. ✓ Allow staff to request up to $500 of local funds to be used for RPAC fundraising expenses without board approval. ✓ Contribute $500 to the Gopher Tortoise race booth for sponsorship. ✓ Contribute $15,000 of the 2019 profit from the REALTOR® Builder Expo to REALTOR® Care Foundation. ✓ Move forward with contract negotiations on renewing Dennis MacDonald's contract as CEO. ✓ Adjust the REALTOR® Image budget to $100,000 in addition to move. ✓ Approve announcing intent to merge with Orlando Regional REALTOR® Association and proceed with due diligence. ✓ Greater Tampa REALTORS® submit the name Greater Orlando Tampa REALTORS® to the National Association REALTORS® for approval.

The following items were acted upon at the October 2019 Meeting: ✓ Have all discussion on the merger moving forward be discussed in the open with the exception of legal, which should be discussed in executive session of the board. ✓ Move merger proposal forward to the first item on todays agenda. ✓ Have a vote today to vote the merger agreement and not postpone further. ✓ Board approve the Plan of Merger document and proceed to inform members of the plans, finances, By-laws etc. with a membership vote to happen 12/5/19. ✓ Discontinue allocating 20% of the AMEX points to REALTORS® Care Foundation. ✓ Move forward with the closing of the Bungalow property and that we issue a 7-month lease starting at the end of the current lease. ✓ Adopt the new committee structure as presented. ✓ Move forward with the Events Committee recommendation for 2020 GTR event with a net loss not to exceed $15,000. ✓ The 109 S. Bungalow property be purchased with cash from our checking account.

CODE OF ETHICS Dispute Between REALTORS® in Different Boards

R

EALTOR® A cooperated in the sale of a commercial property with REALTOR® B, the listing broker. REALTOR® A is a member of the XYZ Board of REALTORS®, and his office is located in the XYZ Board. Both the property and REALTOR® B’s office are located within the jurisdiction of the ABC Board of REALTORS® where REALTOR® B is a member. A dispute arose between REALTORS® A and B over the division of the commission. REALTOR® A filed a request for arbitration with the Professional Standards Committee of his Board. The President of the Board, when advised of the contractual dispute, subsequent to the Grievance Committee finding the matter arbitrable and of a mandatory nature, notified the President of REALTOR® B’s Board and requested interboard arbitration in accordance with Article 17 of the Code of Ethics. The arbitration request was brought before the Grievance Committee of REALTOR® B’s Board which also determined that the dispute was arbitrable and of a mandatory nature. One week before being notified of his Grievance Committee’s decision, REALTOR® B filed suit against REALTOR® A. The Board of Directors of the ABC Board notified REALTOR® B to appear and answer to a charge of violation of Article 17 when REALTOR® B did not withdraw the suit subsequent to being informed that both Grievance Committees had found the issue arbitrable and mandatory. REALTOR® B described his contractual dispute to the Directors and stated that he knew REALTOR® A

had requested arbitration because he had received a copy of the request. REALTOR® B maintained that he had filed suit because REALTOR® A was in another Board’s jurisdiction and he did not think anything would come of the request since he, REALTOR® B, was not a member of the XYZ Board. REALTOR® B was advised that since both Grievance Committees had determined the matter was arbitrable and mandatory that interboard arbitration was being scheduled to hear the dispute. The Board of Directors concluded that his action in filing suit was not in itself in violation of Article 17 but advised REALTOR® B that if he failed to withdraw from the suit and participate in the interboard arbitration, he could be found in violation of Article 17.

Q: Do referral fees have to flow through a brokerage company, or can they be paid directly to an associate? A: Referral fees should flow through the brokerage company to the associate, in accordance with Section 475.42(1)(d),Florida Statutes. Although FREC says that an associate may be paid directly at closing if a broker instructs the closing agent (in a specific writing) to authorize direct payment, FREC has not expanded this to include other situations.

Q: May a sales associate be paid directly for conducting a broker price opinion?

A: No. Section 475.42(1)(d), Florida Statutes, does not allow sales associates to collect any money in connection with a real estate brokerage transaction, whether as commission or other payment, except in the name of their employer—the broker. BPOs fall within the definition of real estate brokerage activity— “appraising” property—as per Section 475.01, Florida Statutes.

The end of the 2019 is upon us and the holidays are fastly approaching. I imagine everyone is eagerly anticipating some down time from the rigorous year. Upon my appointment as the Young Professional Network Chair, following a successful term of my predecessor Mr. Corey Richardson, it became clear this role is one that requires consistent determination and humility. YPN has continued to build on the foundation laid over the past few years. Our focus this year was to ensure our YPN annual goals aligned with the strategic objectives of our association: with focus on professional development and evolving the association through innovative forward-thinking initiatives. Facebook’s Special Ads Category for Housing by Tracy Wisneski

A

d targeting abuses on Facebook were brought to light in 2016 and ended in a payout of nearly $5 million to settle several lawsuits alleging ad discrimination in housing, credit and employment on Facebook. In response, Facebook has now rolled out its Special Ads Category that applies to all ads for the three targeted industries. What does this mean for REALTORS®? The Special Ads Category is now part of Ads Manager that requires agents to designate housing ads by using the Special Ads Category, which restricts their access to targeting data. If it is not yet connected to your Facebook Ads Manager, you’ll be getting it very soon. The restrictions are severe and it is questionable if they are all required in order to uphold Fair Housing protections, but that discussion will likely evolve over time. Let’s examine the important aspects of the Special Ads Category and how to make the best use of the tools currently available. At the top of the campaign creation in Ads Manager, there is a box that must be checked when creating an ad that is categorized as housing, credit and employment. Toggle to housing for real estate ads and several settings will then become part of your audience creation. Zip codes, age, gender, behaviors and demographic targeting are not available in the Special Ads Category. Age is set to 18-65+ and gender is set to “all”. Behavior and demographic targeting are completely unavailable. Demographic restrictions can be questionable for various valid objectives, such as targeting homeowners for homeowner ads, and renters for rental and firsttime home buyer ads. Another example would be the objective of targeting people 55 and over for listings in designated 55+ communities. There are several other valid, nondiscriminatory objectives for these categories, but as of now, they are currently unavailable.

Redlining is a very serious issue that it is important to prevent. In response to accusations that zip codes were being used for redlining, zip codes are now a restricted target in all housing ads. The minimum area that can be used for targeting is now an address or map pin plus 15 miles. This is to ensure that everyone within at least a 15-mile radius from a listing has access to the ad. At this time, this larger radius applies to all real estate ads, not just ads advertising specific listings, thus making it more expensive for agents to reach homeowners in their smaller farming areas. For example, if your farm area is Carrollwood, your homeowner ads would still be served to homes as far as Seffner (15 miles in a straight line from your pin could potentially translate to as much as 25 miles for the actual drive). Farming is among the oldest and most widely used farming methods allowing REALTORS® to specialize in smaller areas, so I wonder if there may eventually be an approved method for farming ads on Facebook that is in line with Fair Housing laws. Language is still an allowable target Language is open to targeting allowing agents to include the language(s) of their choice. Language can be used as just one setting if you only use one language, and users are also able to create ads in more than one language if desired. Some interests are allowable targeting methods, and others are restricted. Some interest targeting that is still available include such helpful interests as Zillow, Realtor.com, renting, rent.com, homeowner association, home improvement and others. Several interests are not allowable targeting methods, because it is alleged that such targeting may unfairly discriminate against certain audiences. Among the restricted interests are golf and equestrian that could create a


FACEBOOK ADS challenge when listing in golf or equestrian communities, for example. A potential workaround for this would be to include imagery and language to appeal to buyers specifically looking for those communities. Some suggested methods for reaching targeted audiences in light of these restrictions. Using strong images/videos and text to appeal to your targeted audience is helpful. You can even go a step further and employ Facebook’s Split Testing feature to test which ads perform best. The Split Testing feature is available on the campaign page of ad creation and includes the option to use campaign budget optimization that will feed more campaign funds to the higher performing ads. Keep in mind that the most effective split testing is achieved by only changing one variable between the ads. Split testing can also be pricier than some agents’ usual ad budgets, but if done effectively, the results should eventually improve your results and ROI.

Using Your Facebook Audiences Facebook audiences are a strong marketing tool that agents should employ in their Facebook ad strategies. Facebook allows you to create a pixel (a bit of code) that you embed into your website and landing pages. This code is helpful in analytics, but it is also helpful in empowering you to retarget your ads so that your audiences see ads from you repeatedly. Facebook audiences can also be created from the Facebook users who’ve interacted with your Facebook page, Facebook videos and Facebook ads. Another source of audience is your database that can be uploaded within Facebook Business Manager to help you reach your current contacts. Audiences help us to achieve the repeated marketing touches required to earn more leads and also enables us to keep in touch with our current contacts. Audiences are still an allowable resource and more than one audience can be combined when targeting ads. Look-alike Audiences Restricted; Special Ad Audience Used Instead Look-alike audiences were an excellent method for building upon data from our audiences, allowing us to expand audiences over a million or more in our quest to reach more people who may be interested in our listings or services. However, those Look-alike Audiences also used targeting information that is now restricted, so Look-alike Audiences can no longer be used for housing ads. In their place, Facebook now offers Special Ad Audiences that use much less data to create a larger audience. Test your Special Ad Audience results against other approved targeting methods to see what brings the best results. Back to the Drawing Board For agents who’ve been employing Facebook ads in their marketing campaigns, such drastic changes have undoubtedly changed the nature of our work. Our earlier testing and measurements are no longer valid, requiring us to regroup, retest and repeat. If you’re wondering if it’s worth the effort, consider for a moment that Facebook Ads Manager runs ads across both Facebook and Instagram. Facebook boasts 2.45 billion MAU (monthly active users), 1.62 billion are daily active users. Instagram has over 1 billion monthly active users, with over 500 million using it every day. Features Buyers Seek in condos New HUD Rule Makes Condominium Purchasing Easier by Tamiracle Williams

In August, the U.S. Department of Housing and Urban Development (HUD) released the long-awaited final rule on project approval for single-family condominiums insured by the Federal Housing Administration (FHA). The new condominium policy will "reduce regulatory barriers that currently restrict affordable homeownership opportunities,” according to HUD's website. The new rule: • Introduces a new single-unit approval process to make it easier for individual condominium units to be eligible for FHA-insured financing • Extends the recertification requirement for approved condominium projects from two to three years • Allows more mixed-use projects to be eligible for FHA insurance This rule makes it easier for first-time homebuyers to purchase condos, especially for those in urban markets. When looking for a condo, homebuyers are looking for everyday convenience with features related to health and safety.

Here are some of the top features buyers look for in a condo: 1. Hi-Tech Security - Features such as gated parking and 24-hour cameras give buyers peace of mind when it comes to safety. Newer condominium developments include locked access to community facilities and exterior doors. 2. Energystar Appliances - Appliances such as low flow toilets and LED lights bulbs can help a homebuyer save money on utility bills. 3. Fitness and Recreation Center - Buyers enjoy the convenience of not having to pay an additional fee or drive to an alternative location to workout. 4. Better, Faster, Stronger! Florida REALTORS® 2019 Legislative Town Hall by Joey Henderson, Director of Public Affairs The Legislative Strategy Townhall for Districts 5, 6, and 13 on November 1, 2019, was an excellent opportunity to network with leaders from other associations and gain insight on the multi-faceted legislative issues that our state association addresses on behalf of members. An audience of more than 50 registered board executives, association members and employees converged at the REALTOR® Association of Sarasota and Manatee to participate in the town hall led by Barry Grooms, 2019 Florida REALTORS® president-elect and coowner of Sarabay Suncoast Realty Inc. in Bradenton. Along with Florida REALTORS® (FR) staff, Grooms has been traveling the state hosting town hall meetings to engage and hear the concerns from membership directly. Promoting the 2020 theme of Bigger, Stronger, Faster, Grooms seeks to use the town halls as a launching pad to gather areas of interest, points of view and recommendations that impact the real estate industry and focus on solutions. Furthermore, he seeks to be pro-active as FR explores solutions to protect the industry, build upon technology and provide member organizations with more exceptional service to ultimately deliver the highest quality professional service to homebuyers and business communities. Grooms welcomed everyone and introduced each senior FR staff who gave a brief synopsis of their role as it relates to the vision for FR. Trey Goldman, legislative counsel and staff liaison to the Insurances and Top Brokers Committees, discussed judicial and regulatory realty business issues and informed everyone that the remote online notary becomes effective January 1, 2020. Andrew Rutledge, commercial legislation, gave highlights

on Land Use / Property Rights, Commercial Legislation and Property Management Committees. Andy Gonzales provided an overview of the Appraisal and Resort / Second Homes Committees that he serves. Tom Butler, Communications Director, summarized the mission and goals of the Legislative Research Committee, and Danielle Scoggins, vice president of Public Policy, shared information about the Attainable/Workforce Housing group, state and local taxation and public policy. Other topics of discussion included: embracing technology, serving on county affordable housing advisory boards and committees, working with affordable housing nonprofit organizations, reviewing statutes on condos and homeowners associations (HOAs), understanding transportation development decisions impact on the real estate industry, coalition building with groups of interest (e.g., Florida Housing Coalition) and increasing global activity (incidentally, it was also noted that Greater Tampa REALTORS® was awarded the Global Award for the third year in a row). GTR member Teresa Morning’s question about flood insurance also generated a healthy conversation as far as disclosure to prospective clients and forth-coming legislation. In addition to Teresa, attending the townhall were Mari Colgan, Connie Johnson, Marie Gregorio, Barbara Jordan, Ellie Lambert, Gipsy Perry, and staff members Dennis MacDonald, Joey Henderson and Jacob Bruynell. The take away for the townhall is that Florida REALTORS® leadership and staff are engaging multiple issues in support of the industry, enhancing professionalism and delivering top service. Barry Grooms stated as far as the beginning of professionalism, “If you have a good heart, that’s where it starts.”
