I want to thank you for allowing me to serve as your Greater Tampa REALTORS® 2017 president.

W

alking through the halls of Florida’s Capitol building, swarming with eager REALTORS®, it’s hard to contain your excitement. March 2017 was my first trip to Great American REALTOR® Days (GARD) and the beginning of my love for political action. Every year, REALTORS® from across the state get the opportunity to visit Tallahassee to meet with legislators one-on-one and talk about pending real estate legislation.

Soon after my installation, I went to work with leadership and GTR staff to deliver improved services to our members. GTR became my second home because I was here every day.

In 2018, GARD will occur at the beginning of the regular legislative session. At this time, local legislators will head to Tallahassee for 60 days to discuss and vote on legislative proposals. A big issue that surfaced during the 2017 session was the proposed cap on fees charged by community association management companies for estoppel certificates (SB 398/HB 483). By attending GARD, we were able to talk to our local legislators and tell them why this mattered for REALTORS® and Florida homeowners. Because of our influence, the Florida Legislature passed the bill, gaining us yet another win in the fight for homeowner and private property rights.

Our building renovation is almost complete. REALTORS® without offices are able to use our new closing room, free of charge, to finish client transactions. There are also computer stations in the lobby available for members to use.

But, GARD is not all business. It’s also a fun time and great networking experience. On the first night, the Florida REALTORS® Office of Public Policy will host an open house reception. All GARD attendees are welcome — just be sure to indicate your attendance when you register. On the second night, after a day of working hard at the Capitol, REALTORS® from across Florida will take over Adams Street in downtown Tallahassee for the annual block party. Your registration name badge is your pass for admission and two drink tickets are provided. In 2018, GARD will be held Jan. 9 – 11. I have already marked my calendar and I really hope to see you there!

Now at the year’s end, I’m proud to say our hard work has paid off. We accomplished many of our objectives in the strategic plan.

We worked together to successfully cap estoppel fees. We have reached and exceeded our RPAC investment goals. GTR also enjoys a relationship with several local media outlets. And these are just a few highlights of our 2017 success. We gained a lot of new people in leadership positions who will continue to push our organization forward. As GTR’s 2018 past president, I look forward to supporting you all as we venture into new territories. It has truly been an honor and pleasure to serve you all. As I sign off for the year, I look forward to a fruitful future. Sincerely,

ACKNOWLEDGEMENTS Ashley Christie (NextHome Discovery) obtained her broker’s license in October and is a recent graduate of the Florida REALTORS® Leadership Academy. Kristy Perez was recently promoted to Programs Coordinator at Greater Tampa REALTORS®. In her new position, she will serve as a staff liaison to the Affiliate members and will assist the Programs Director. Her favorite part of the job is presenting Affiliates with tons of opportunities to network with REALTORS®. Kristy has been employed with GTR for nine months. She previously served on the First Impressions team. Grace Smith earned the e-PRO® certification which teaches cutting edge technologies and digital initiatives to link up with today’s savvy real estate consumer. GTR welcomes Jasmine Britt, our new Member Services Specialist. Jasmine was born in Panama City Beach, Florida and moved to the Tampa/Brandon area when she was around 13 years old. Having past experience in the hospitality industry, Jasmine plans to learn, grow and exceed expectations in her new position. Fun fact: Jasmine loves watching HGTV’s House Hunters even though she knows it’s fake. Kathryn Velez was recently promoted to Member Services Team Lead at Greater Tampa REALTORS®. Her new role is to provide the best services for GTR members and assist them with any issues they are having. What she loves about her job is the opportunity to make sure that every member leaves with a smile. Kathryn has been with GTR for eight months. Javin Nededog is a new addition to our member services team. Born in Washington state, he has lived in Germany and Arizona before making a home in Tampa. The Hillsborough Community College student is currently pursuing a pharmacy degree. Fun fact: Javin can play the ukulele.

Michael Gappa was recently promoted to Member Services Team Lead at Greater Tampa REALTORS®. In this new role, Michael will provide services for members, resolve member issues and maintain the flow of communication with management. What Michael likes most about his job is the positive work environment each and every staff member provides. Michael also enjoys teaching new skills to his fellow team members and providing new ideas to improve the Association. Brittany Stalker is the newest addition to the GTR team. She previously worked at the Pinellas REALTOR® Organization as a member liaison. At GTR, she will serve as the Professional Development Assistant. Originally from Virginia, Brittany is a Navy veteran who worked on aviation structural mechanic safety equipment (ejection seats and air conditioning systems in F-18s). She is a mom to three kids ages 6, 7 and 13. In her off time, you can find Brittany coaching her daughter’s cheerleading team or in the stands cheering on her 6-year-old daughter who plays tackle football. Tampa Bay International Real Estate Council (TBIREC) has been named a Gold Council in the 2017 Global Achievement Program. Only a select few of the 125 global business councils nationally were awarded this prestigious award. TBIREC achieved its golden status through a commitment to providing education, events, networking and resources to Council members. IN LOVING MEMORY... John T. Sanders, Jr. passed away Friday, October 6. John was an active member at First Baptist Church Temple Terrace. His faith, kindness, and joy impacted the lives of many people through his service in church, in business, and in the community.

He owned Sanders Realty & Appraisal in South Tampa and was active in real estate for 30 years. He was a graduate of Robinson High School and was a loyal supporter of the school throughout his life. John was a devoted fan of his Florida Gators from his first day on campus.

Case #12-12: Advertising in the Guise of News

S

hortly after mailing his “Homeowners Neighborhood Newsletter” to local residents, several complaints were filed against REALTOR® B claiming that he had engaged in deceptive advertising in violation of Article 12’s “true picture” directive. These complaints were reviewed by the Grievance Committee which determined that a hearing should be held and that all of the related complaints would be consolidated in a single hearing. The appropriate notices were sent and the hearing was convened. REALTOR® A, one of the complainants, introduced REALTOR® B’s “Homeowners Neighborhood Newsletter” into evidence pointing out that, on the first page, REALTOR® B had prominently shown pictures of, and addresses for, ten homes in an exclusive area of town labeling each as “Recently Sold.” REALTOR® A, the listing broker for several of these properties, stated that, in his opinion, the average reader would readily conclude that REALTOR® B, by advertising this way, was claiming to have listed and sold the properties and that his claims violated Article 12, as interpreted by Standard of Practice 12-7. In response, REALTOR® B indicated that Article 12 was limited in scope to “. . . advertising and representations to the public” and that his “Homeowners Neighborhood Newsletter” was not, in fact, advertising but rather a well-intentioned effort to make homeowners aware of current market values. “Sale prices in our county become a matter of public record once a deed of sale is recorded,” REALTOR® B argued, “and anyone who wants to find out about recent sales can get that information from the

recorder’s office.” “All I am doing,” he continued, “is reporting news—and saving residents the time and effort of retrieving this information on their own. If someone appreciates my efforts and later buys or sells through me, so much the better, but that is not the reason for my newsletter.” After hearing from the complainants and the respondent, and after reviewing the content of the newsletter, the Hearing Panel concluded that it did, in fact, violate Article 12 since, while the information regarding the properties themselves was accurate, its cumulative effect was to convey the impression that REALTOR® B had listed and/or sold the properties when he had not. The fact that he had been the cooperating broker in one of the transactions did not give him the right to claim, directly or indirectly, that he had “sold” any of the other properties because in no instance had he been the listing broker. The Hearing Panel did not accept REALTOR® B’s claim that his newsletter was exempt from scrutiny under Article 12 in that he was disseminating news and not engaging in advertising. They noted that the name, address, and phone number of REALTOR® B’s firm appeared prominently in several places; that a considerable portion of the newsletter was devoted to services available from REALTOR® B’s firm and the advantages of doing business with REALTOR® B; and concluded that while the newsletter might, in fact, include an element of “news” a primary purpose of it was to advertise REALTOR® B and his firm and, consequently, that it was subject to scrutiny under Article 12.

Q: Is it possible to run my brokerage from my home? A: Under Section 61J2-10.022, Florida Administrative Code, the required office can be in a residential location as long as it doesn’t violate local zoning ordinances. However, minimum office requirements and brokers’ signage requirements must still be met. If this type of office interests you, be certain to check with any homeowners’ association or condominium association. It’s possible that these associations prohibit such businesses.

Q: In the event a sale doesn’t close, am I still out the money I paid for an HOA to prepare the required estoppel certificate? A: No. In accordance with Chapter 720.30851(3), Florida Statutes, if a sale doesn’t close, you should give written notice to the preparer of the estoppel certificate no later than 30 days after the closing date, along with reasonable documentation that the sale did not occur, and the seller is obligated to refund the money within 30 days after receipt of the request.

One REALTOR®’s Journey from Blindness to Sight

I

am always amazed by the diverse community of professional REALTORS® in Tampa Bay. This edition, I would like to place the spotlight on one agent in particular who is truly inspiring. Robert Perez with Keller Williams Suburban Tampa/Plant City has a resilient energy that is authentic and contagious. He possesses a life view you only get once you have faced true adversity. What Robert calmly refers to as “curve balls” most people would describe as catastrophic, lifechanging events. Robert’s first curve ball was losing his eyesight. His vision started to

12

rapidly deteriorate in 2008 from a rare disease that attacks the cornea called Keratoconus. The cornea is like a dome shaped window and is held in place by tiny fibers called collagen. Keratoconus thins the cornea and weakens the collagen causing the cornea to bulge out like a cone. As a result, vision becomes increasingly blurry and distorted. By 2010, everything looked black. As his vision deteriorated, the disease’s impact on his professional and personal life increased. Robert lost his driver’s license, which he described as one of his personal low points because it cost his

independence. Eventually he was not able to work. But that didn’t compare to the heartache in his personal life. He could not read to his three small children. He could not take them to the movies or amusement parks. For a committed father like Robert, that was the hardest thing to deal with. After two long years on the cornea transplant list, thanks to Dr. Ben Perez with the Lions Eye Institute, things were about to change. On July 20, 2010 at 3:21 a.m., Robert received a call — a cornea was available. Two hours later, Robert was prepping for surgery. He woke up from the operation with stitches and feeling


THE GIFT OF VISION like his eyes were full of sand. He described it as utter agony. And it was all worth it. A couple of days after the surgery he started to see light. As time passed, his vision continued to improve. I asked him to tell me about the first thing he did when he could see again. He told me that he ate vanilla bean ice cream. Vanilla bean ice cream? I thought it was somewhat odd to pick something to do that did not require eyesight. Never skipping a beat, Robert explained that being able to eat ice cream is good but being able to see ice cream while you eat it takes the experience to a completely different level. Of course, his fondest memory following the surgery was taking his three children to Disney World. Unfortunately, life sent Robert yet another curve ball when his marriage came to a sudden and painful end. He found himself unemployed and homeless. It would be easy to imagine throwing in the towel. Not Robert. Through his church’s support, Nativity Catholic, he was given the opportunity to begin a career in real estate. He decided to take the leap now that he was given the gift of sight. He didn’t pass the test the first two times but he remembers vividly scheduling his third attempt to take the test on his birthday. As luck would have it, he passed on the third time. The day Robert received his passing score he quickly called his acting broker at Keller Williams, Julie Swain, and hung his license within

the next six days. With his recentlyreturned sight, Robert found himself as a newly-licensed REALTOR® determined to make a difference for his family and his community. In truth, describing Robert as determined simply does not do it justice. Robert is one of those people with a special something you notice right away. His desire to give back is so clearly sincere, it’s impossible not to be motivated. He uses his job as a REALTOR® to give back to the Tampa Bay community. In addition to serving his community through real estate, he is an ambassador for Lions Eye Institute and an enthusiastic and compelling advocate of the Eye Bank Association of America, Donate Life America and LifeLink Tampa. During my conversation with Robert, it was apparent that he does not take life or sight for granted. He is one of those rare people who strive to make a difference every day. In spite of his curve balls, he is an optimistic and energetic role model for his children and our community. It’s hard not to be humbled by his amazing story. a look ahead: What’s New in Education in 2018

T

he Professional Development Committee has been busy planning for next year! In keeping with the association’s strategic goals, the education department will increase course offerings, provide a wide variety of classes and events with top-notch instructors and expand the education benefit to allow for additional opportunities for all members of GTR. In 2018, the Professional Development Committee (PDC) will highlight the prestigious Graduate REALTOR® Institute (GRI). Offering the GRI at a lower cost to the member is important to the committee. In 2018, members of GTR will be able to obtain the GRI for under $400! For our newest members, the 100 series of GRI also fulfills the 45-hour post license requirement and can be completed for only $99. We will offer the 100 series four times in 2018 and the 200 and 300 series will be offered twice. This means that every GRI student can complete the designation within six months. Continuing education is paramount to the success of our members. Not only will you be able to purchase the 14-hour package during renewal times, but you can also complete individual CE classes throughout the year at no cost to you. GTR has expanded and increased our free CE and non-CE classes and will provide close to 400 classes and trainings in the next year! Certifications and designations are one of our key educational components and we will ramp up the offerings in 2018. Next year, you will be able to earn the following certifications/designations right here at GTR: At Home with Diversity (AHWD), Pricing Strategy Advisor (PSA), Military Relocation Professional (MRP), Resort and Second-Home Property Specialist (RSPS), Graduate REALTOR® Institute (GRI), Seller Representative Specialist (SRS) and NAR’s GREEN designation.

GTR will also increase its offsite courses in 2018. Quarterly, we will host classes in each of the three high REALTOR® concentration areas to provide educational opportunities to our members who live throughout Hillsborough County. This will allow our members to attend some of our classes without having to fight traffic. The PDC is also ramping up our partnership with our online vendor, the CE Shop. We have purchased hundreds of classes to be used as giveaways, prizes and rewards for our members. This initiative promotes the CE Shop and helps GTR reach our members who are unable to attend our in-person classes. We will also promote the CE Shop monthly flash sales in our e-Connections e-blasts. GTR will begin building a video library in 2018 with quarterly webinars hosted by Craig Grant, CEO of the Real Estate Technology Institute. These 45-minute to hour-long webinars will feature hot topics in the world of real estate technology. For our newest members, we will have a quarterly series of classes that you can attend to learn more about working with buyers, sellers, contracts and more. HOLIDAY SALES TIPS DON’T Overprice the Home From Thanksgiving to New Year’s Day, buyers are busy spending money. An overpriced home can deter a potential customer who is already feeling overwhelmed by the holiday hysteria. Keep the price reasonable and a serious buyer will be motivated to close the sale quickly.

DO Invest in a Camera During those chilly winter months, buyers may not want to brave the elements to view your client’s home. Highresolution photos of the home for sale along with a virtual video tour goes well with a cup of hot chocolate from the comfort of a buyer’s home. After viewing your photos/ video, serious buyers will show up to your home with an offer!

DON’T Leave Presents Out in the Open

DON’T Overdecorate If your client’s holiday decorations rival Santa’s Wonderland, then it may be time to scale it back a bit. Decorations should accent the home rather than clutter it. Clients should choose seasonalthemed decor over religious or cultural decorations. There’s nothing wrong with a little personalization but just don’t overdo it!

DO Keep in Mind International Buyers There are international buyers who don’t observe the American calendar. REALTORS® and clients motivated to sell should make themselves wholly available for showings throughout the holiday season.

DON’T Neglect Curb Appeal Florida winters are often filled with falling leaves and broken tree limbs in the yard, not to mention clogged gutters. It’s important to advise your clients that preparing the outside of the home is just as important as preparing the inside when making a sale. Remember, buyers want to envision themselves living in their future home.

For basic safety reasons, your clients should always be sure to remove any presents from sight. Place them in a closet or other enclosed space until a showing is over.

his festive time of year offers no shortage of opportunities to network, celebrate with colleagues, and show your appreciation to clients with holiday cards and gifts. Yet with all of these cheery occasions comes the potential for etiquette mishaps. Here, manners experts and real estate pros answer some common questions and provide tips that will help you make a great impression this holiday season.

Sending Cards: Is E-mail Acceptable?

It seems everyone in the real estate business is connected to their computers. So it would certainly be convenient — and affordable — to send electronic holiday cards to clients and colleagues. But is that acceptable? “E-mail cards are being done a lot,” says Beverly Langford, author of “The Etiquette Edge: The Unspoken Rules for Business Success” and a principal of LMA Communication in Atlanta. “But there are people who would think that’s the easy way out, so it depends on your audience. I wouldn’t send e-cards to everybody. But something is better than nothing, and sooner is better than later.”

Gift-Giving Dilemmas: What to Buy?

Shopping for your valued clients and most trusted colleagues can be tough. You know them on a professional level, but do you really know what they’d enjoy as a gift? Luckily, there are plenty of options that will please just about anyone. (Check out REALTOR® Magazine’s holiday gift guide for ideas.) Edible gifts are always a safe bet, Price says. “Food or wine — if the client drinks — make appropriate gifts during the holidays because there’s a lot of entertaining going on,” he says. But any thoughtful present will do. “A doctor and his wife recently closed on a house, coming here from Southern California in the middle of our rainy season. So I gave them two automatic umbrellas from Nordstrom, and a $50 bottle of wine to the doctor who referred them to me. It’s good to show your gratitude.”

price of the listing as a guide, Langford suggests. “If you’ve just sold a $3 million house, you might want to do something like a lavish gift basket from Godiva.” When it comes to your broker, what gift is best? Peggy Post of the Emily Post Institute Inc. in Burlington, Vt., says it’s not necessary to give gifts to bosses, in general. “You don’t want to look like you’re currying favor,” she says. “But if you feel like you really want to do something, you can bake something or buy something very simple. Another way to handle it is to get several people to pitch in for something.” If a colleague buys you a gift, but you didn’t buy him one, don’t fret. Just graciously thank him for it, Langford says. It’s not necessary to reciprocate, but you may want to make a note to yourself to get something for that person next year.

Going to the Party: What to Wear, Bring?

So, you’ve received an invitation to a holiday party. Now comes the tough decision — what to wear. Don’t make assumptions, especially if you’ve never been to that party before. “If the invitation doesn’t state the attire, call and ask,” Langford says. You don’t want to show up underdressed to a blacktie event. Likewise, “If it’s strictly a professional party, don’t go in sparkling like a Christmas tree.”


To arrive to a party at someone’s home in style, there’s one accessory you can’t forget: a gift for the host. Post recommends a small box of high-quality chocolates. “Or, you could bring something you’ve made, like muffins for the hostess’ breakfast the next morning, a decoration for the tree, or bulbs if they’re gardeners,” she says. “Just something simple to denote your gratefulness for the invitation.” One thing to avoid bringing: cut flowers, Langford says. The flowers may be pretty and smell great, but the host will have to abandon her guests in order to arrange the flowers into a vase. After the party, a thank you note to the host will be well appreciated.

Conversation Starters: What’s Off Limits?

As a real estate practitioner, you probably have no problem striking up conversation in social situations. However, at a work-related party, you should make an effort to veer away from “shop talk” and include spouses in the conversation. “Talk about noncontroversial current events, holiday plans, or people’s families,” Langford suggests. “Ask open-door questions that let the other person talk.” To be on the safe side, avoid talking about issues that may lead to heated debates or get too personal. If you plan to broach more touchy topics, such as politics or religion, “know who you’re talking to and whether they’ll enjoy a spirited conversation,” Price says. “You need to be careful not to get into an argument that leads to hurt feelings.” Price also adds that you should keep the conversation positive, and never gossipy. “You should never say anything negative about other colleagues in a public situation,” Price says.

Making a Toast: What Should I Say?

Whether you’re moved to make a toast at a friend’s party or you’re hosting a gala and would like to say a few words, keep a few pointers in mind. For example, the host or hostess offers the first toast at a formal occasion such as a dinner party. Around a dinner table with friends, a guest can propose the first toast and often does so to thank the host for bringing everyone together, according to the Emily Post Institute. Keep it short and to the point, focusing your remarks on the event being celebrated. A joke or short story is OK, as long as it’s clean. For a boost of confidence, write out what you wish to say and then practice it ahead of time, the Institute recommends.

Too Many Places to Be: How to Decide?

As party invitations start rolling in, you realize just how popular you are. Unfortunately, the season is short and parties inevitably will conflict with one another. If invited to several occasions on the same day, what should you do? “Go to all three,” Langford says. “People understand during the holidays that you’ll have many commitments. I’d much rather guests come by for 30 minutes and leave than say you can’t come because you’ve got to go to another party.” Post, on the other hand, says you may decline two of the invitations by simply saying, “Sorry, I can’t make it.” No explanation is

necessary. What’s key, she says, is that if you say yes to one person, you honor that commitment even if a more desirable invitation arrives later. “You could try to attend two of the parties,” Post adds. “But if the invitation is to a sit-down dinner, you need to sit and stay.” Regardless of whether you go or not, you absolutely must RSVP. If you’ve ever planned a party before, you know how frustrating it is to be in the dark about who is coming.

Stating the Obvious: Watch What You Drink

Among all holiday etiquette faux pas, having too much alcohol to drink always tops the list, experts say. Your professional reputation and your friendships are at stake. “I had a cocktail party one afternoon, and somebody broke a Waterford flute and didn’t bother to tell me,” Langford recalls. “I found it stuck in a corner afterwards. I was really surprised, given the people who were invited.” To avoid embarrassing situations, either don’t drink alcohol or limit your intake. The days of work parties where coworkers let down their hair, got drunk, and ended up wearing lampshades on their heads are out of style, the Emily Post Institute says. GTR donates $30K to ® realtors care foundation REALTOR® Builder Expo Proceeds will Benefit Tampa Families

reater Tampa REALTORS® donated nearly $30 thousand in proceeds from the 2017 REALTOR®-Builder Expo to the REALTORS® Care Foundation (RCF), which will benefit up to six first-time homeowners in Hillsborough County. The REALTOR®-Builder Expo is a trade show hosted by the Tampa Bay Builders Association (TBBA) and GTR. The expo allows builders to preview their new or soon-to-be constructed communities to REALTORS®. The beneficiary, RCF, offers up to $5,000 for down payment and/ or closing costs assistance to families who need a little help to achieve their dream of home ownership.

Protect your property Hillsborough County Clerk Offers Free Tool to Detect Fraud By: Tom Scherberger REALTOR® Rod Banks’ assistant made a startling discovery last year at a vacant Valrico home he had listed. Someone had moved in. Xenia McBroom was on a routine inspection at the Diamond Hill home when she made the discovery. “She called me and I was just shocked,” Banks recalls. The $300,000 house in the gated community had sheets in the windows for curtains. Once he determined that someone really was living there, Banks called the Hillsborough County Sheriff’s Office. The ensuing investigation would uncover an alleged scheme involving two so-called sovereign citizens who believe the laws of Florida do not apply to them. Both were charged with property fraud but the mess they left behind has occupied Banks for more than 18 months. The buyer backed out, the bank that owned the property spent six months clearing the title, ultimately selling the home to another buyer for a lesser price. And Banks is still waiting to be repaid for the expenses he incurred. “It’s really annoying and no one wins in the end,” Banks said. As this case shows, property fraud is expensive and all too common. If it can happen to a bank, it can happen to anyone. It happened to Banks not once, but twice. A second home he had listed also was targeted by a scammer in a similar scheme. But there is help to avoid falling

victim to such scams. A free service offered by Hillsborough County Clerk of Court & Comptroller Pat Frank can protect property owners by alerting them to any official document recorded in their name. Once you subscribe, you will be alerted whenever a property-related document is recorded in your name. You can be alerted by email, text message or by phone.
