Our Tallahassee REALTORS® Party (RPAC) delegation Every winter REALTORS® from the entire state of Florida go to the Capitol building in Tallahassee during the statehouse legislative session to inform our state legislators what is important to Florida homeowners. In 2019, we had over 40 members from GTR attend. Florida Realtors - 36 directors from GTR, plus many Florida REALTORS® committee chairs and vice-chairs. JULY/AUGUST 2019 BOARD OF DIRECTORS ACTION ITEMS The following items were acted upon at the July 2019 Meeting: ✓ Move forward with the retirement plan with AXA as presented at the Board of Directors meeting. ✓ Table the election change discussion and refer it to the Greater Tampa REALTORS® attorney. ✓ Change dues billing date from 11/30/19 to 12/7/19 and change 1/1/20 deadline to 1/15/20.

The following items were acted upon at the August 2019 Meeting: ✓ Remove the Video Services library from the 2020 budget. ✓ Adjust the REALTOR® Image budget to $100,000 in addition to move Charity of the Year from this line and put into President's Discretionary. ✓ Remove the Convention event from the 2020 budget. ✓ Change the bus tour CAP sponsor to two tours with two buses each and $200 for four sponsors total. ✓ Change from six sponsors to four sponsors at $500 each ( from $3,000 to $2,000) and adjust the venue from $3,000 to $2,000 for the 2020 Real Estate Summit. ✓ Ratify the proposed budget as adjusted by Finance. ✓ Move forward with the $5,000 investment in the Tampa Hillsborough EDC starting in 2019. ✓ Move forward with the Maxey Fisher bid to trademark the GTR brand logo not to exceed $2,500 in legal and filing fees. ✓ Create a contract extension for the CEO contract for an additional four months with all existing terms and conditions to remain the same. ✓ Move forward with the Go Bolts banner installation from September – October 2019 as presented by Tampa Bay Lightning. ✓ Accept and implement the reciprocal lockbox agreement with Gainseville-Alachua county. ✓ As of 8/28/19, cease providing new GTR members a complimentary one-year membership to Global Council. 8

Intentional Misrepresentation of a Competitor’s Business Practices

F

ollowing a round of golf early one morning, Homeowner A approached REALTOR® X. “We’ve outgrown our home and I want to list it with you,” said Homeowner A. “I’m sorry,” said REALTOR® X, “but I represent buyers exclusively.” “Then how about REALTOR® Z?,” asked Homeowner A, “I’ve heard good things about him.” “I don’t know if I would do that,” said REALTOR® X, “while he does represent sellers, he doesn’t cooperate with other brokers and, as a result, sellers don’t get strong offers for their properties.” Later that day, Homeowner A repeated REALTOR® X’s remarks to his wife who happened to be a close friend of REALTOR® Z’s wife. Within hours, REALTOR® Z had been made aware of REALTOR® X’s remarks to Homeowner A earlier in the day. REALTOR® Z filed a complaint against REALTOR® X charging him with making false and misleading statements. REALTOR® Z’s complaint was considered by the Grievance Committee which determined that an ethics hearing should be held.

At the hearing REALTOR® Z stated, “I have no idea what REALTOR® X was thinking about when he made his comments to Homeowner A. I always cooperate with other REALTORS®.” REALTOR® X replied, “That’s not so. Last year you had a listing in the MLS and I spent months working with the buyers that submitted a purchase offer. You didn’t pay me the offer of compensation, though; you paid another broker who stole my clients from me at the last minute, and all he did was submit the purchase offer.” REALTOR® Z countered REALTOR® X’s statements, indicating he had made

a blanket offer of compensation in the MLS, and that his refusal to pay REALTOR® X had nothing to do with him not cooperating with other brokers, but the fact that there was a procuring cause dispute at the end of the transaction. Upon questioning by panel members, REALTOR® X admitted he had no personal knowledge of any instance in which REALTOR® Z had refused to cooperate with any other broker, but assumed that his failure to pay the compensation REALTOR® X felt he had earned was likely how REALTOR® Z treated other brokers. The Hearing Panel, in its deliberations, noted that cooperation and compensation are not synonymous. In fact, Standard of Practice 3-10 provided that the duty to cooperate established in Article 3 relates to the obligation to share information on listed property, and to make property available to other brokers for showing to prospective purchasers/tenants when it is in the best interests of sellers/landlords. In that respect, the Hearing Panel felt REALTOR® Z had, in fact, cooperated with REALTOR® X. However, to characterize REALTOR® Z’s refusal to pay requested compensation because of a genuine commission dispute as a “refusal to cooperate”, and to make the assumption and subsequent statement that REALTOR® Z “did not cooperate with other brokers”, was false, misleading, and not based on factual information. Consequently, REALTOR® X was found in violation of Article 15.

Q: Does the federal do-not-call legislation apply to door-to-door solicitations? A: No. However, you may still be prohibited from making door-to-door solicitations if there is a community, municipal or county restriction on door-to-door solicitations or if there is a posted No Trespassing sign on the property or the community.

Q: I’m a broker who specializes in the sale of businesses and business opportunities. I want to call businesses in my area to see if they’re interested in selling. Do the federal Do Not Call laws or regulations apply to businesses? A: No. The Do Not Call Registry is only for residential telephone numbers.

Safety Tips for GTR Young Professionals

Every day, REALTORS® put themselves in potentially dangerous situations that we may not think twice about. Most of the time, we are alone. There are several ways to protect ourselves in our day to day activities. Below are simple tips that young professionals can add to their daily routine to keep themselves safe. •

The simplest form that does not require an app or for you to be a “techie” is having a safety buddy that can be reached by phone. Call to inform him or her where you will be and for how long. Ensure that they will check in with you at the end of the set time period if they haven’t heard from you. The best part of the buddy system is that it allows you to reciprocate the favor when one of your colleagues is in the field. Step up from the buddy system by adding another layer of safety. There are apps available that aren’t real estate specific but can be as easily applied. The iPhone has a “Find My Friends” app (Android has a similar app) that allows you to share your location with anyone that has an iPhone. You may choose to share your location for one hour, until the end of the day or indefinitely. This feature can be activated or deactivated with the push of a button. When you are showing a home or holding an open house, avoid parking in the driveway. This not only gives potential home buyers the opportunity to experience what pulling up to their brand-new home feels like, but doubles as a safety measure to prevent your vehicle from being blocked in. During the home showing, always announce your presence when entering the home. A simple, “Hello, REALTOR® coming in”, can go a long way. Allow your clients to walk in front of you when entering rooms and never have your back to them.

Be prepared for the unexpected. Always keep your phone charged, have gas in the tank and try to conduct your business during daylight hours.

Always be aware of your surroundings.

Always trust your gut feeling about situations.

How Safe Are you passwords? Avoid Bad Password Habits

by Tamiracle Williams According to Florida Association of REALTORSÂŽ Tech Helpline, 1 in 5 Americans have experienced a compromised online account. Between Association member portals and social media passwords, real estate professionals have several passwords to remember daily. Some opt for the old fashion method of writing them down on paper. Others use password savers like Apple Keychain and Google Password. However, there is a better option that works across Android and Apple devices. It's called a password manager. What's a password manager? Consumer Reports describes password managers as a service that "can help defend against criminals by generating and storing passwords for each of your online accounts."

Real estate professionals should continue to take the following safety precautions regardless if they decide to purchase a password manager: 1. Always opt for multifactor authentication such as getting a verification code sent to your phone. 2. Regularly change your password, most websites including your Greater Tampa REALTORSÂŽ member portal will prompt you to change your password every 6-8 months. 3. Only use trusted computers and devices. 4. Don't use the same passwords across platforms. It's important to remember that password managers are just an extra level of security for protecting your data.

Password managers are like a digital vault. Similar to Apple Keychain, most managers will auto-complete forms and have a copy-and-paste feature on mobile and tablet devices. Passphrase and authentication codes help secure password managers. Some of the top password managers include Last Pass, 1Password, Dashlane and Sticky Password. Each offer individual and team/ business accounts. Some password managers start at a low price of $2.99 per month for an individual account.

The time is now to nominate members who are involved at GTR, in addition to involvement with civic projects, service clubs, charitable activities and/or political groups. These award recipients will be recognized at our Annual Installation and Awards Banquet. Of course, there are a couple of rules. This REALTOR® has been a mentor to others, invests passionately and continually in RPAC, always steps up when asked and whose ethics are above reproach. This person has served on or chaired committees and has dedicated their time, talent and energies for the betterment of our Association and its members. This award is someone all REALTORS® are proud to point out and say yes, that person deserves The Distinguished Service award. Former recipients of Meritorious Service are not eligible. Committee Chair – Outstanding Leadership Award (Edward T. Starr Award): Established in 1961 and named in honor of the late Edward T. Starr, 1959 President of the Association, this award is given to the Committee Chair who exhibits outstanding leadership to the committee for the current year. It defines the Chair’s leadership style to include time spent, efforts made, who benefited and why and any other specific details. Newcomer of the Year Award: This award honors a deserving REALTOR® with two years or less tenure in the real estate profession. You must indicate whether your nominated candidate practices real estate as a fulltime profession (to the best of your knowledge) and the number of hours per week (on average) your nominated candidate works in the real estate profession. Criteria

should include but is not limited to: •Tenure as a REALTOR® (two years or less) •Ethical practices •Participation in Association activities (Examples include: service on committees, attending GARD and/or state conventions, investing in RPAC, writing an article for GTR’s magazine, attending GTR functions, working toward NAR designations etc.) •Active in community affairs (For example: service on committees and any volunteer work in in the community) REALTOR® Community Service Award (C. Humanitarian of the Year: This award is given to the member who meets the following criteria, which should include but is not limited to: 1. Involved in the saving of human lives or to the alleviation of suffering 2. Concerned with or seeking to promote human welfare 3. Performs charitable and philanthropic acts of kindness Affiliate of the Year Award: This award is given to an Affiliate who has been a member of the Greater Tampa REALTORS® a minimum of three years (including year nominated). This company or person has been involved in events and activities in the Association. Ex: Orientation, educational sponsor, event sponsor etc. The Awards Committee will review all submissions to select the most deserving recipients. The more submissions the committee has, the better. I hope you will think of at least one qualified member. There are plenty of members deserving of recognition, but the committee may not know who they are unless you submit a name for consideration.
