Safety remains a top priority Having a Safety Protocol in Place Will Protect You & Your Clients
E
very September is dedicated to REALTOR® safety efforts. Like countless other professions that require public interaction, the real estate industry involves some risk. Our goal is to help educate our members on the significance of safety procedures and the precautions that should be made. As a REALTOR®, it’s important to have a personal safety protocol in place that you use when meeting new clients, showing properties or sharing information online. Although the month of September has been designated as REALTOR® Safety Month, it’s important to practice these safety precautions and preparations year-round. By educating our REALTORS® about potential threats and providing you with resources to protect yourselves, GTR hopes to keep our REALTORS® safe. On page 10 you can discover ways to combat common real estate threats. Make sure you take our REALTOR® Safety Personality quiz on page 13 and see which superhero you are most like. This issue, we also want to highlight our foundation and the wonderful work they do. The REALTORS® Care Foundation of GTR is a charitable organization that provides educational housing programs and services. You can learn more about
the programs offered through this foundation on page 27. And, as a friendly reminder, your membership dues renewal deadline is November 30. GTR congratulates past president (1992) and REALTOR® of the Year (2014) Don Walden of Donco Realty, Inc., who recently celebrated his 90th birthday. Walden, a fifthgeneration Plant City native and graduate of Stetson University, retired from the United States Army as a lieutenant colonel after 22 years. Walden then launched a career in commercial real estate and continues to work. Aside from his service with GTR, he is very active in his community, having served as the president of the Plant City Kiwanis Club, Chairman of the Greater Plant City Chamber of Commerce and more. Walden is pictured above receiving a proclamation from Plant City Mayor Rick Lott. 2018 GTR President Mari Colgan was elected as the 2019 Florida REALTORS® District 6 Vice President. As DVP, she will represent Pasco, Hillsborough and Pinellas Counties. GTR welcomes new Education Director Jennifer Garula-Mers. Jennifer is originally from Cincinnati, Ohio, and has resided in Florida for a decade with her two children. She has her B.S. in Education from Xavier University, and is a 200 E-RYT trauma, PTSD, traumatic brain injury, and sensory-reintegration instructor. Jennifer has worked in the not-for-profit sports arena under Major League Baseball governance and for the University of Georgia as a subject matter expert for education assessment, technology and psychometrics. She also has extensive experience in the private/public sector in adult education, including developing curriculum, instructional design and assessment. In her spare time, she enjoys the Florida lifestyle with her family and friends as well as traveling. Tom Scaglione was named Associate REALTOR® of the Year on Aug. 9 by Florida REALTORS®. Tom, a past president of GTR, has been active with the local association for more than 25 years and is the recipient of numerous awards, including GTR’s REALTOR® of the year award in 2012. Throughout the years, Tom has served the community

Andy Joe Scaglione, 2016 president of GTR, received the Commercial REALTOR® Achievement Award from Florida REALTORS® on Aug. 9. The award honors lifetime contributions to commercial activities at the local, state and national levels. Andy Joe has been a member of GTR since 1986 and was named the local REALTOR® of the year in 2017. He is also a founding member of the Florida Gulf Coast Commercial Association of REALTORS® and has been a member of the Florida REALTORS® Commercial Alliance Committee among his service on a number of other boards and committees. Barbara S. Jordan was recently awarded the District 6 Leadership Institute Hall of Fame Award in honor of 2010 GTR President Vernon Taylor. Recipients are selected based on active participation on the local, state and national levels, professional development activities and advocacy efforts and participation in RPAC. Zarina “Rina” Champagne recently joined GTR as a member services specialist. Rina is a Florida native and graduate of the University of North Florida with her B.S. in Communications.Before joining GTR, Rina had over seven years of upper-level sales and retail management experience. When she’s not 100 ft. under water scuba diving, you can find Rina watching movies with her soon-to-be husband, Johnathon, or cruising with her wonderful family. GTR welcomes Jory Allen as the newest member services specialist. Jory moved to Tampa a year ago from West Palm Beach, Florida and has an extensive background in customer service, including working in the hospitality and restaurant industries and front office work. In her spare time, Jory loves to dance, travel and learn new things. She also spends her spare time playing with her puppy, Zora. Jory is currently a student at the University of South Florida, working on her bachelor’s degree in healthcare management and is looking forward to learning everything she can about real estate.

CODE OF ETHICS Advantage Gained Through Deception of Client
C
lient X listed his unique parcel of land on a lake exclusively with REALTOR® A, who worked diligently for months to sell Client X’s property. Finally, Realtor® A came up with the idea of selling the property to the county for a park, and made arrangements for its presentation at a special meeting.
Client X went before the County Commissioners with his attorney. REALTOR® A, the listing broker, was in the audience. REALTOR® A commented about the property and told the County Commissioners that if the County purchased the property he, REALTOR® A, would receive a real estate commission. The County Commissioners agreed to take the matter under advisement. REALTOR® B, a member of the County Commission, approached Client X and suggested that if the property were listed with REALTOR® B exclusively, and REALTOR® B then cooperated with REALTOR® A so that the real estate commission would be split between them, the County would probably purchase the property from Client X. Otherwise, REALTOR® B indicated, the County would not purchase it. Unknown to Client X, the County Commissioners had already voted to buy the land. Worried that he might not sell the land, Client X immediately signed a second written exclusive listing with REALTOR® B. Thereafter, a sales contract was executed which provided that the real estate commission was to be divided equally between REALTOR® A and REALTOR® B. Unknown to REALTOR® B, Client X had told REALTOR® A the entire story about REALTOR® B’s
approach to and conversation with Client X. REALTOR® A filed a complaint against REALTOR® B alleging violations of Article 1 and Article 16. The Grievance Committee found enough evidence of REALTOR® B’s alleged violations of the Code to warrant a hearing before a Hearing Panel of the Board’s Professional Standards Committee. At the hearing, REALTOR® B defended himself, indicating that he had been instrumental in influencing the County Commission to vote to buy Client X’s land, and had voted for it himself. Accordingly, REALTOR® B felt it was appropriate for him to receive a commission. It was the Hearing Panel’s conclusion that REALTOR® B had used his official position as County Commissioner to deceive Client X with respect to the prospects of the County purchasing his property, and had coerced Client X into executing an exclusive listing while the property was already listed exclusively with REALTOR® A. The Hearing Panel found REALTOR® B in violation of Article 1 for having advised Client X dishonestly and Article 16 for having acted inconsistently with the exclusive relationship that existed between Client X and REALTOR® A.

WHAT IS RPAC?
RPAC stands for REALTORS® Political Action Committee. RPAC is the lobbying/political arm of the National Association of REALTORS® and Florida REALTORS®.
WHY DO WE HAVE RPAC?
It is imperative that we have a mechanism to express our views throughout all levels of government. RPAC serves as this mechanism. RPAC uses its financial resources to support candidates who both understand and support REALTOR® issues. RPAC looks to build the future by putting dollars in places that will help advance the interests of real estate professionals. RPAC is the only political group in the country organized for REALTORS® and run by REALTORS®. RPAC exists solely to further issues important to REALTORS®. The money to accomplish this comes from voluntary contributions made by REALTORS®. These are not members’ dues; this is money given freely by REALTORS® in recognition of how important campaign fundraising is to the political process. RPAC doesn’t buy votes. RPAC enables REALTORS® to support candidates that support the issues that are important to their profession and livelihood.
WHAT ARE THE RESULTS?
RPAC is one of the largest and most effective political action committees in the country and has been instrumental in promoting favorable legislation that would benefit our communities and our careers. RPAC also plays a major role in the election of officials who stand with REALTORS®, regardless of party affiliation. Our legislative allies are members of the REALTOR® Party. The REALTOR® Party supports the issues that are important to your business as a REALTOR®, regardless of political party affiliation. During the 113th Congress, NAR’s legislative and regulatory agenda continued to focus on creating a fundamentally sound and robust U.S. real estate market while protecting the business interests of members, as well as consumers. Despite Congress’ lack of actions, NAR achieved several accomplishments and set the foundation for many important issues moving forward. RPAC was the largest contributor to candidates during the 2014 federal election cycle, disbursing roughly [$4.9 million] in direct contributions to federal candidates, Leadership Political Action Committees (PACs) and National Political Party Committees. Direct contributions made by RPAC were given to both Republican and Democratic candidates. Other successes include: • •
Businesses throughout Florida will save an additional $31 million each year due to the second reduction in the tax rate in as many years. $500,000 was allocated from the Professional Regulation Trust Fund to the Department of Business and Professional Regulation to combat unlicensed

real estate activity. Strengthened the current flood insurance notice included in homeowner’s property insurance policy Allowed businesses to receive tax credits for a portion of the Business Rent Tax they pay, which will go toward certain scholarship funds Will extend the Florida Office of Financial Regulation (OFR) requirement to lenders making residential mortgage loans for business purposes. Affordable housing programs received close to $110 million from the state and local government housing trust funds. Several REALTORS® and a former Florida REALTORS® staff member have officially been appointed to the Florida Real Estate Appraisal Board (FREAB) and the Florida Real Estate Commission (FREC).
Although the National Association of REALTORS® doesn’t lobby local governments, the national association does provide funding and other resources to local and state REALTOR® associations for their advocacy outreach. The REALTOR® Action Center gives all REALTORS® who have a current, valid e-mail address or access to the Internet a fast and easy way to contact their members of Congress and present NAR’s legislative positions. In responding to NAR Calls for Action, REALTORS® can send letters to members of Congress on issues that matter to them and their clients with the click of a mouse.
WHY SHOULD YOU INVEST IN RPAC?
REALTOR® Advocacy and RPAC impacts your bottom line. Through RPAC efforts, REALTORS® and/or homeowners either increased their commissions or saved cash. REALTORS® must be politically active. If not, who will take on the responsibility of protecting our values and rights? If REALTORS® do not speak out, get involved and help shape the discussion, someone else will. No one knows a community better than a REALTOR®. REALTORS® know the lay of the land, the families, the best schools, the neighborhoods and the leaders of any given area. REALTORS® work in every city, county and community in the nation. REALTORS® are on the frontline as defenders of real estate issues.

RPAC is an investment; your investment in your business. Join the group of REALTORS® and Affiliates who are committed to the preservation and improvement of our careers and livelihoods by investing in RPAC. HUMANITARIAN OF THE YEAR: This award is given to the member who meets the following criteria which should include but is not limited to: • Involvement in the saving of human lives or the alleviation of suffering • Concern with promoting human welfare • Performing charitable and philanthropic acts of kindness AFFILIATE OF THE YEAR AWARD: This award is given to an Affiliate who has been a member of the GTR a minimum of three years (including the year nominated). This company or person has been involved in events and activities in the Association (for example: orientation, educational sponsor, event sponsor, etc.) The Awards Committee will review all submissions to select the most deserving recipients. Four corners to a stronger community by Tom Scaglione Over the last 10 years, the REALTORS® Care Foundation of GTR has changed the lives of hunderds of families in the Tampa Bay area through its four key programs that develop stronger communities including: • The First-Time Homebuyer Grant Program, which assists qualified residents of Hillsborough, Pasco, Pinellas, Polk and Manatee Counties with up to $5,000 for downpayment or closing costs; • Scholarships for students pursuing a degree in real estate • Community development activities such as providing funds for affordable housing programs; and • Disaster relief efforts to support people in impacted areas.
