avoid Real estate cyber scams RE Transactions are the Ideal Target for Hackers Phishing, hacking, wire fraud - these are all ways people attempt to steal from others online. As real estate continues to enhance online opportunities to complete business transactions, the chances of being caught up in a cyber scam have become even greater. Cybercrimes have become increasingly sophisticated over the years and the people perpetrating them focus on situations where a lot of money is changing hands, making real estate transactions an ideal target. We have all been warned about a wiring scam during the closing stage of the home buying and selling process. Hackers will break into the email accounts of consumers and real estate professionals to get details about a real estate transaction. The hacker will then send an email pretending to be the buyer, seller, real estate agent or someone else involved in the closing process and say there has been a last minute change and provide new wiring instructions; the instructions send the closing costs funds directly into the hacker’s bank account. I witnessed a client go through this very situation and we notified our clients about wire fraud upfront. Unknown to my buyer, his email was hacked, the hackers had picked up email correspondence between my client and his lender that included his disclosure. Next, they emailed my client with urgent messages including the instructions to wire his funds. My client was traveling for business and rushing to meet the demand prior to the close of the business day and reacted quickly to the demand. Once the wire was completed, he called me to say he realized he had not heard from me, his lender or anyone he was familiar with in the deal to send the money. It was at 6 p.m. in the evening, I immediately said it was a scam as it was a week prior to closing and I knew we did not have all in order for funds to be wired at this early stage. I went into action immediately with title, FBI and anyone else we could call and by the next morning, we had identified through the FBI where the funds were sitting. The timing was crucial as the account the funds were sitting in had an automatic transfer in place that would have sent the money out of the country that day, very little recourse once it is out of the country. This was a few hundred thousand dollars!

are a few tips to help home buyers and sellers recognize and avoid real estate scams: Do not send sensitive information via email. Do not send banking information, your social security number or anything else that could be used to comprise your identity over email. If you absolutely must send personal or sensitive information via email, only use encrypted email. Do not click on unverified email. If you do not recognize the name or email address of the sender, do not open the email and beware of any attachments or downloadable files from unknown email addresses; they can contain viruses or provide a way for a hacker to access your computer. Do not use unsecured Wi-Fi. It may seem harmless to check banking information using the free Wi-Fi at your local coffee shop but using an open connection can leave you vulnerable to hackers and scammers. Only access sensitive information on your home computer or on a secured network. If you suspect fraud, tell someone. If you suspect that fraud has or is in the process of occurring, contact all parties contacted to the transaction immediately. Unfortunately, often there is nothing that can be done to retrieve money stolen in the scam, however, you should still report the incident to the FBI’s Internet Crime Complaint Center or the Federal Trade Commission. The following items were acted upon at the July 2020 Meeting: ✓ The executive committee meet with our investment advisor and make any adjustments to our portfolio as they deem appropriate. ✓ Move forward with striking the legal defense language in our policy as written. ✓ GTR move forward with the DBPR sync project at a set up cost of $6,000 and an annual cost of $2,000. ✓ Add a 30-day cancellation with written notice without clause by either party to the Strategic Plan Consultant contract. ✓ Suspend the rules and accept the screening panel’s recommendation for Tax Collector, Clerk of Circuit Court, Judges for groups 9, 30 and 39. ✓ Provide a one-time storm damage donation of $1,000 to our sister organization in El Salvador. ✓ Support Tim Wiser for FR secretary. *The August BOD meeting was canceled due to a the Florida REALTORS® Convention.

CODE OF ETHICS Deceptive Information in the MLS Database

R

EALTOR® R searched the MLS database of current listings on behalf of his client, Dr. Z, who had recently completed his residency and was returning home to take a position on the staff of the community hospital. REALTOR® R’s search returned several listings that satisfied Dr. Z’s requirements, including a two-story residence listed with REALTOR® B that showed, in the “Remarks” section, “Pay your mortgage with rent from the apartment upstairs.” REALTOR® R sent the listings he’d identified in an an e-mail to Dr. Z. A day later, REALTOR® R received a call from Dr. Z who told him there was something about REALTOR® B’s listing that struck him as odd. “That house is in the neighborhood I grew up in,” said Dr. Z, “I also remember our neighbors having a problem with the Building Department when they added a kitchen on the second floor so their grandmother could have her own apartment.” REALTOR® R assured Dr. Z that he would make the necessary inquiries and get back to him promptly. His call to the Building Department confirmed Dr. Z’s suspicion that the home was zoned single family. Feeling embarrassed and misled by REALTOR® B’s apparent misrepresentation, REALTOR® R filed a complaint with the local association of REALTORS® alleging misrepresentation on the part of REALTOR® B for publishing inaccurate information in the MLS.

B acknowledged the seller had told him that the conversion had been made to code but without the necessary permits, and the apartment had never been rented. “I assumed the new owners could get a variance from the Building Department,” he said. The Hearing Panel did not agree with REALTOR® B’s defense or rationale and concluded that showing a single family home as having incomeproducing potential from an upstairs apartment which had never been rented was a misrepresentation that violated Article 2.

Q: What if my listing isn’t ready to show and I want to preadvertise? cc A: Not a problem. Check with your MLS to find out which status is the appropriate one to use: Coming Soon, No Showings, Delayed Showings or Temporarily of the Market, etc. Understand the terminology because the criteria that accompany each status varies from MLS to MLS. As we embark into the fall of 2020, this year has looked different from what it has in the past and YPN is no different. Luckily, we have shifted and adapted to provide top notch events for our members such as YPN Goes Virtual, Masked Marketing and our Virtual REALtour.

First, we’ll start off with a twist on one of our most popular events, our YPN REALtour. This time around it looked a little different, instead of our members coming together to tour Tampa Bays latest and greatest in person, we conducted this event at three different communities simultaneously through Zoom. The REALtour featured prominent communities in the Tampa Bay area ranging from Southshore Bay to Medley at Miranda. We had committee members present at each so our members were able to learn about the communities and all they have to offer from the comfort of their own homes in an hour.

Next was our Masked Marketing & Branding event featuring experts in this field including our very own Amina Stevens. This event was a tell all on how a diverse panel was able to adapt their personal marketing strategies to this shifting environment. Including how a REALTOR® shifted their focus on having more conversations through social media because people were quarantined, essentially leading to more consultations and ultimately more business. Unfortunately, due to the pandemic we can’t celebrate our members by hosting our signature annual inperson YPN Blue Party. However, we have found a different way to give back. YPN hosted a new type of event that helps propel young professionals forward in their career called YPN Goes Virtual: Get Involved and Evolve. This event featured current leaders both in YPN and those who have been in the business for years such as current board members and board presidents. They shared their experiences in becoming a leader not only in their respected business but also at Greater Tampa REALTORS®. This event was meant to share

For honorably serving the membership and the community… and then some. We need your help to identify individuals worthy of these prestigious honors. The time is now to nominate members who are involved at GTR, in addition to involvement with civic projects, service clubs, charitable activities and/or political groups. These award recipients will be recognized at our Awards Banquet. Of course, there are a couple of rules. No member of the Awards Subcommittee is eligible for an award and current officers are not eligible for REALTOR® of the Year. You may email Grace Smith at grace@tamparealtors.org if you have any questions on a member's eligibility. Please submit the name(s) of members you feel may deserve one of our yearly awards to by the October 14 deadline. We have made it easy for you to recommend names online at TampaRealtors.org/awards. Distinguished Service Award (Vernon E. Taylor Award): Established in 2018 and named in honor of the late Vernon E. Taylor, 2010 President of the Association, this award is presented to the member with a sterling reputation among his or her peers and who has a minimum of 15 years of exemplary service to Greater Tampa REALTORS®. This REALTOR® has been a mentor to others, invests passionately and continually in RPAC, always steps up when asked and whose ethics are above reproach. This person has served on or chaired committees and has dedicated their time, talent and energies for the betterment of our Association and its members. This award is someone all REALTORS® are proud to point out and say yes, that person deserves The Distinguished Service award. Former recipients of Meritorious Service are not eligible.

Humanitarian of the Year: This award is given to the member who meets the following criteria, which should include but is not limited to: 1. Involved in the saving of human lives or to the alleviation of suffering 2. Concerned with or seeking to promote human welfare 3. Performs charitable and philanthropic acts of kindness

Committee Chair – Outstanding Leadership Award (Edward T. Starr Award): Established in 1961 and named in honor of the late Edward T. Starr, 1959 President of the Association, this award is given to the Committee Chair who exhibits outstanding leadership to the committee for the current year. It defines the Chair’s leadership style to include time spent, efforts made, who benefited and why and any other specific details.

The Awards Subcommittee will review all submissions to select the most deserving recipients. The more submissions the committee has, the better. Home Showings During the Pandemic Guidelines to Keep You and Others Safe by Tamiracle Williams, GTR Communications Specialist The COVID-19 pandemic has changed the way REALTORS® conduct open houses and private showings. During the stay-at-home order, many turned to live/ video streaming services like Zoom and Facebook to conduct showings. Now that Florida is in Phase 2 of the reopening plan, REALTORS® can return to in-person activities. If you are considering hosting an in-person open house or private showing, here are a few tips to follow: 1. Before planning an in-person event, talk with the homeowner and your broker about disinfecting procedures before and after a showing. 2. Consider setting up an appointment calendar for the open house to control the number of guests inside the property. REMEMBER that gathering should be capped at 10 people. 3. Before the showing, open all interior doors, cabinets and closets. 4. Instruct guest to remain 6 feet apart and wear a mask throughout the showing. Remember that mask should cover the nose, mouth and chin to work effectively.

5. Set up a COVID-19 station at the entrance of the property with extra disposable personal protection equipment (PPE), hand sanitizer, a trash can and relevant COVID-19 signage (i.e. mask mandate, touch-free zone, etc.). 6. Strategically place hand sanitizers throughout the home. If a home has multiple stories, be sure to place hand sanitizer at the bottom of the staircase. 7. Eliminate sign-in sheets and paper marketing materials. Instead opt for something digital such as a QR Code or vanity link that will direct attendees to the property’s marketing material or landing page. 8. After every visit sanitize high-touch surfaces (doorknobs, light switches, handles, stair railing etc.), throw away your PPE and wash your hands with soap and warm water for 20 seconds. How to Avoid ADA Litigation by Tamiracle Williams, GTR Communications Specialist The Americans With Disabilities Act (ADA), signed into law on July 26, 1990, makes it unlawful to discriminate against people with disabilities. ADA requires that public accommodations have websites, tools and technology that are accessible to people with temporary and permanent disabilities. Web accessibilities should encompass all disabilities that affect web access: auditory, cognitive, neurological, physical, speech and visual.


In 2012, 56.7 million Americans had some form of a disability, according to data from the Census Bureau. Dictionary.com defines disability as " a physical or mental handicap, that prevents a person from living a full, normal life." There has been an increase in web accessibility lawsuits in the United States, in the past few years. Major corporations like Dunkin Donuts and Winn-Dixie have both faced lawsuits in the State of Florida for inaccessible websites. More recently, several real estate associations and REALTORS® have received demand letters regarding website accessibility. In a Greater Tampa REALTORS® exclusive webinar, Juana Watkins, General Counsel and Vice President of Law and Policy at Florida REALTORS® provided members with a few technical things to keep in mind about ADA Compliance. 1. Alternative (ALT) Text for Images. If someone is visually impaired and uses a screen reader that reads aloud the information on the page, you need ALT text for all visual images including logos and icons. 2. Transcripts for Audio. Providing text transcripts is crucial for people who are hearing impaired. It makes the information accessible and allows for better search engine performance as platforms such as Google and Bing can index the information discussed in the audio/video files. A transcription service can help you create transcripts and closed caption files. 3. Social Media. Social media platforms are increasing efforts to make their platforms more accessible. Facebook, YouTube and Instagram all have ALT text and /or captioning tools available on their native platforms to help make content ADA compliant. *Please Note: Some of these features may not be available on third-party social media management platforms. 4. RSS and Embedded Content. If you have IDX or RSS coming to your website, you may be responsible for the accessibility of that content. Currently, there is no case law, but it's recommended that you use widgets for this type of content on your website. It's also important to have a conversation with your web administrator about the Website Content Accessibilities Guidelines (WCAG). WCAG is a single shared standard for web content accessibility that meets the needs of individuals, organizations and governments internationally. It explains how to make web content more accessible to people with disabilities and provided a checklist.

No matter what challenges COVID-19 has given us Affiliates and REALTORS® combined, the market is still on FIRE. As schools begin, whether online or in-person, people are still looking for their future home. As we enter the 4th quarter, let's dominate the goals we set before the pandemic and help our REALTOR® partners thrive!

Please make sure to always thank our Affiliate and Events Coordinator, Marisa Knight. She has been amazing to work with throughout these past months. Also, make sure to keep an eye out on our Facebook page and emails for Zoom events, classes, sponsorship opportunities and community outreach awareness. The GTR Board of Directors and staff have been working hard for their members and affiliates. We will continue to have our Affiliate Coffee Hours, so I look forward to seeing you there virtually.

As I was reflecting on what we have accomplished in 2020 as Affiliates, it brings a smile on my face on how resilient we are. We stepped up to the plate and mastered Zoom, webinars, social media marketing and best of all virtual networking. We continued to build relationships and grow with our REALTOR® partners and work together to get the deals done. To help us continue to grow, our next Affiliate Forum topic will be about Conflict Resolution on September 29 from 9:30 a.m. to Noon. It’s harvest time in Plant City, and the smell of fresh strawberries hangs in the air thick as jam, sweet enough to taste. Just flick your tongue in the breeze and see. The plump red berries are what most people imagine when they think of Plant City, and while strawberries are indeed king in the World’s Strawberry Capital, there’s something else in the air these days: the scent of success wafting through the rural community. After years of just “being there” east of Tampa and mostly unnoticed, save for the week of the Strawberry Festival, it seems homebuyers have all suddenly taken notice of Plant City, which appears to be enjoying its moment. Seems these days, just as the plump, red berries are picked in the Plant City fields, homebuyers more and more are picking Plant City. Wayne Wiggins, owner-broker of Plant City Realty, Inc., understands. He’s generation number five in Plant City, and he’s been wondering when people would finally get it—when they would figure out there’s a lot more to Plant City than just its famous fruit. “Builders have finally discovered us,” said Wiggins, who concentrates his real estate business there. He notes that new housing is booming, more is coming and the supply of pre-owned homes is low due to high demand— something driven by more working families choosing the town ideally situated midway between Tampa and Orlando

work centers. Add the ease of commuting in either direction to value pricing, an abundance of country charm, and an old-fashioned, small-town feel, and the rush to Plant City is more than understandable, said Wiggins. “As I like to say, we’re having our 15 minutes,” he said. Wiggins’ Plant City ancestors go way back (some slung muskets in the Civil War). A town street bears his family name. It’s changed over the years, but Wiggins said despite the surge in growth, no one need worry that development will spoil Plant City. Its leagues of guardian residents and founding families are smart, the city’s leadership and planners are just as sharp, and wise enough to control growth using good ol’ “common sense.” New people coming sometimes may have a tendency to try and make their new hometown into the one they came from, Wiggins lamented, but Plant City leaders—its movers and shakers—have a “way of tempering that,” and they jealously protect Plant City’s wholesome, country character, Wiggins said. The new chapter in Plant City began when improving the city’s parks, streets and revitalization efforts downtown began to “get traction,” he said. When

the nation’s largest builders began to show up, things began to really roll. Companies like DR Horton and Pulte Homes are building in the city, and Plant City has annexed parts of Hillsborough County to accommodate some of that building. Seems the builders like Plant City as much as the families buying their new homes, something Wiggins attributes to the fact that the city works so well with developers. Plant City officials are “friendly,” is the best way Wiggins said he can put it, at least compared to Hillsborough County. By friendly he doesn’t mean easy and willing to give away the store. He means easyreasonable—easy, practical and realistic. The planning and building process is “less cumbersome; they use common sense and decisions are made based on what is a good idea,” said Wiggins. Plant City’s new homes are now known as some of the best values going. Young families can get into new 3/2 Plant City homes for around $200,000, Wiggins said. If you’ve got $300,000 to spend, count on that home being a “really nice one.” At the low end of the pre-owned market, an older family home that needs some fixing might come in below

$150,0000. A large mobile home on enough land for livestock can be had for $150,000 to $200,000. The problem is demand exceeds supply, Wiggins said. Still, prices remain stable and comparatively attractive. He does advise having financing in order, as considering a deal too long could mean watching it get scooped up by a better prepared buyer. The pre-owned market is a diverse mix of historic woodframe farmhouses and small bungalows, to large, two-story executive and manor homes on acreage that push $1 million. For those who imagine Plant City is poor farm country, think again, Wiggins said. “Plant City is not a poor town,” he said. “There’s a lot of old money and new money” and many homes are valued between $500,000 and $1 million. Be it a mobile home or a mini mansion, what one can’t put a price on is the smalltown feeling Plant City exudes, said Melissa Poage, an agent with Signature Realty who grew up there. It’s grown over the years, but retains its smalltown charm, she said, something rare these days. “It’s still America’s small town,” she said of Plant City. “It’s community-minded, family oriented; it’s just that it’s grown.” Many who grew up in Plant City leave for careers only to return years later, she said, adding it’s the kind of place with the power to call one back. home“It’s comforting, towny, yet it’s close to everything,” she noted, referring to the easy drive into neighboring Tampa. Many who live there commute to work in Tampa, St. Petersburg or Orlando, she said. It’s a safe place, kid friendly, the schools are good and it has the wide-open country spaces that are a sure cure for urban claustrophobia. People know each other, and it’s
