The National Association of REALTORS® and Greater Tampa REALTORS® have worked hard to keep REALTOR® Safety first and foremost in everyone’s minds. But what about your clients? They, too, can face danger when allowing strangers into their homes or visiting other properties.

Share this valuable advice with everyone, and you’ll help them learn to protect themselves against crime:

• Remind your clients that strangers will be walking through their home during showings or open houses. Advise them to hide any valuables in a safe place. For security, remember to remove keys, credit cards, jewelry, crystal, furs and other valuables from the home or lock them away during showings. Also remove prescription drugs.

• Don't leave personal information like mail or bills out in the open where anyone can see it. Be sure to lock down your computer and lock up your laptop and any other expensive, easy-to-pocket electronics, like iPads, before your showing.

• Tell your clients not to show their home by themselves. Inform them that not all agents, buyers and sellers are who they say they are. Predators come in all shapes and sizes. We tell our children not to talk to strangers. Tell your sellers not to talk to other agents or buyers, and to refer all inquiries to you.

• Instruct your clients that they are responsible for their pets. If possible, animals should be removed during showings. Make clients aware that buyers and agents are sometimes attacked, and the owner will be held liable.

• At an open house, be alert to the pattern of visitors’ arrivals, especially near the end of showing hours. In some areas, a group of thieves will show up together near the end of the open house and, while a string of

“potential buyers” distracts the agent, the rest of the group walks through the house, stealing any valuables they come across.

• Finally, when you leave a client’s property, whether after an open house or a standard showing, make sure that all doors and windows are locked. Thieves commonly use open houses to scout for valuables and possible points of entry, then return after the agent leaves.

• Let your clients know that you will take all of the above safety precautions, but that when they return home, they should immediately verify that all doors are locked and all valuables accounted for.

Taking steps to protect you and your client's safety is worth the cost of a little extra time and effort.

Fidelity to Client’s Interests

During a Board of REALTORS®

luncheon, REALTOR® A described to those at the table an old house in a commercial area which was open listed with him and invited the others to cooperate with him in selling the property. REALTORS® X and Y said they also had the property open listed but had found very little interest in it. REALTOR® B made no comment, but feeling he could find a buyer for it, went to the owner and discussed the advantages of an exclusive listing. The owner was persuaded and signed an exclusive listing agreement with REALTOR® B, telling him at the time that he had listed the property on an “open” basis for 30 more days with REALTORS® A, X, and Y. REALTOR® B’s comment was, “Just don’t renew those open listings when they expire.”

A few days later, REALTOR® A brought the owner a signed offer to purchase the property at the asking price. The owner told REALTOR® A that he now had the property exclusively listed with REALTOR® B, and asked him to submit the offer through REALTOR® B. Before REALTOR® A could contact REALTOR® B, REALTOR® B had taken another offer to purchase the property at the asking price to the owner. Confronted with two identical offers, the owner found both REALTOR® A and REALTOR® B expected full commissions for performance under their respective existing listing agreements. The owner filed an ethics complaint with the Board of REALTORS® alleging violations of Article 1 of the Code

of Ethics because of the difficult position he had been placed in by REALTOR® A and REALTOR® B. The owner alleged neither of them had warned him that he might be liable for payment of more than one commission.

A hearing before a panel of the Board’s Professional Standards Committee established the facts to be as outlined above. In reviewing the actions of REALTOR® A, the Hearing Panel found that he was not at fault; that he had performed as requested under his listing agreement. On the other hand, it was the conclusion of the Hearing Panel that REALTOR® B had violated Article 1 by failing to advise the owner of his potential commission obligation to the other listing brokers when the client told him other listing agreements were in force.

The Hearing Panel pointed out that because of REALTOR® B’s omission his client, through no fault of his own, may have incurred legal liability to pay two commissions; that REALTOR® B should have advised the owner of his potential liability for multiple commissions; and that by not doing so REALTOR® B had failed to protect his client’s interests as required by Article 1.

Q: I represent an investor who is selling a home. He tells me that since he’s never lived in the property, he isn’t required to provide the buyer with a seller property disclosure statement. Is this true?

A: Yes and no. A seller isn’t required to fill out a seller’s disclosure statement regardless of whether the seller occupied the property or not. However, pursuant to the Florida Supreme Court case Johnson vs. Davis, a seller is required to disclose known facts that materially affect the value of the property that are not known and readily observable to the buyer. That disclosure requirement exists whether the seller occupied the property or not.

Q: Is it possible to run my brokerage from my home?

A: Under Section 61J2-10.022, Florida Administrative Code, the required office can be in a residential location if it doesn’t violate local zoning ordinances. However, minimum office requirements and brokers’ signage requirements must still be met. If this type of office interests you, be certain to check with the homeowners’ association or condominium association.

Safety should come as the highest priority in our day-to-day operations as REALTORS® and independent business owners. Many times in our everyday business practices, we find ourselves meeting new clients (strangers) from online requests, showing vacant homes and driving to remote areas. Our personal information and our everyday activities are shared through social media. Although all of these may be common standards, it’s important to consider how to keep ourselves, customer, and families safe.

Here are some practices that I incorporate into my business:

• Collecting driver’s licenses from prospective customers that I have no prior relationship with nor have met in person before. If I request this and a person refuses, I believe it’s a red flag and I will not meet them.

• Providing the property and contact information for the people I am showing to a family member or colleague and letting them know once I safely depart my appointment. This means I am out of the property and within my car.

• Knocking loudly and announcing myself before entering any properties.

• Remaining near an exit at an open house to not trap myself in a room with parties visiting the open house.

• Sharing my cell phone location continuously with family, friends or colleagues.

• Strategically parking at a property to ensure my vehicle cannot easily be blocked in.

• Being mindful of posting my location on social media, especially when somewhere by myself. Lastly, always trust your “gut”. Instincts are everything. If something doesn’t feel right, listen to that. Bring someone with you or cancel the appointment.

I also want to take the time to thank everyone who came out to the 2022 GTR Young Professionals Network Blue Party. REALTOR® of the Year

This award is Greater Tampa REALTORS® highest honor and goes a member with at least 10 years of service to GTR and who exemplifies what it means to be a REALTOR®. They are active in the Association, the community and contribute generously of their time and talent. They volunteer because they know one person can make a difference. They are committed to excellence in their profession and service in their clubs, churches and communities. They are ongoing examples of the professionalism exemplified by the Code of Ethics to which they subscribe. This person is known to be honorable and respected throughout the real estate community.

The winner also will have a demonstrated commitment in the following:

• REALTOR® Spirit: Commitment to laws and regulations of the Association and the National Association of REALTORS® Code of Ethics and is dedicated to furthering principles of good real estate practice among other real estate brokers, the media and the general public.

• Civic Affairs Activity: Examples include local and national level participation in civic and service clubs, charitable activities, political commissions or committees, fraternal or religious groups, etc.

REALTOR® Community Service Award (C. Ed Owings Award)

Established in 1964 and named in honor of the late C. Ed Owings, 1961 President of the Association, this award is given to a REALTOR® who has performed outstanding service to the community for a minimum of three years.

Outstanding Leadership Award (Edward T. Starr Award)

Established in 1961 and named in honor of the late Edward T. Starr, 1959 President of the Association, this award is given to the Committee or Task Force Chair who exhibits outstanding leadership to the committee or task force for the current year. It defines the Chair’s leadership style to include time spent, efforts made, who benefited and why and any other specific details.

Distinguished Service Award (Vernon E. Taylor Award)

Established in 2018 and named in honor of the late Vernon E. Taylor, 2010 President of the Association, this award goes to the member with a sterling reputation among his or her peers and who has a minimum of 15 years of exemplary service to Greater Tampa REALTORS®. This REALTOR® has been a mentor to others, invests passionately and continually in RPAC, steps up when asked and has ethics above reproach. This person has served on or chaired committees and has dedicated their time, talent and energies for the betterment of our Association and its members. This award is someone all REALTORS® are proud to point out and say yes, that

person deserves The Distinguished Service award. (Former recipients of Meritorious Service are not eligible.)

Newcomer of the Year Award

This award honors a deserving REALTOR® with two years or less tenure in the real estate profession. You must indicate whether your nominated candidate practices real estate as a full- time profession (to the best of your knowledge) and the number of hours per week (on average) your nominated candidate works in the real estate profession. Criteria should include but is not limited to:

• Tenure as a REALTOR® (two years or less)

• Ethical practices

• Participation in Association activities (Examples include service on task forces, attending Great American REALTOR® Days and/or state conventions, investing in RPAC, writing an article for GTR’s magazine, attending GTR functions, working toward NAR designations, etc.)

• Active in community affairs (For example: service on committees and any volunteer work)

Humanitarian of the Year

This award goes to a member who exemplifies the spirit and actions of making a difference for others in such activity as:

• Saving of human lives or alleviating of suffering

• Seeking to promote human welfare

• Performing charitable and philanthropic acts of kindness

Affiliate of the Year Award

This award is given to an Affiliate who has been a member of the Greater Tampa REALTORS® a minimum of three years (including year nominated). This company or person has been involved in events and activities in the Association (for example: New Member Orientation, educational sponsor, event sponsor, etc.).

Best Safety Practices Every REALTOR® Should Know Information REALTORS® Need to Stay Safe on the Job

Each year, September recognizes REALTOR® Safety Month by observing ways to improve the day-to-day risks agents face and allowing them to return safely to their own homes, each night. In 2021, there were over 11,000 reported victims of real estate cybercrime, according to the FBI’S Crime Compliant Center. These victims include agents, buyers, escrow firms, insurance agents, inspectors, title companies and more.

Here are tips you should always consider:

• Use the CITO rule (Come Into The Office). If the CITO rule cannot happen, choose to meet clients at a public area such as a coffee shop.

• In this day and age, finding details about a person is more accessible with social media. Do your due diligence and research all prospects prior to meeting them.

• Do not overshare on personal things such as exact location of residence, details about family/children, etc.

• Remain in communication with associates/ colleagues, friends and family.

• Defend your right to put safety first, there is nothing worth jeopardizing your safety.

• Consider self-defense courses to be prepared if ever placed in a situation where you need to defend yourself

• With the use of email phishing schemes, there is an illusion that they are from a reputable company, many unknowingly reveal details about their personal banking information including passwords and account numbers.

• Train agents on the importance of cybersecurity teaching red flags to look for. Make it a policy.

• Back information up daily or even hourly.

• Avoid using any unsecured, free Wi-Fi networks when reviewing private data or performing a transaction.

• Consider using a Virtual Private Network (VPN) that can help keep important data/ information private.

• Be aware of adware and malware and how to report issues.

Top Five Safety issues we find during Home Inspections in the Tampa area

Many Florida homes are sold “as-is,” making a home inspection vital to determine the age, condition and life expectancy of your home’s features. During the inspection process, we look for anything that could compromise the safety of the occupants, which also includes pets. Homeowners should always be aware and look for ongoing issues while living in their homes. Here are the top five safety issues we find in Florida homes.

Dryer vents. Most of the homes we inspect in Florida have a dryer vent that goes up through the roof. Lint builds up inside the vent and clogs the system. This is highly flammable. This buildup forces the dryer to work harder with each cycle and the lint can work its way into the heating element, causing major issues. It is very important to keep your dryer vent cleaned on a routine basis. This not only prevents fires but will reduce your energy bill.

Electrical issues. Equipment and appliances need to be grounded for your safety. We find a lot of pool equipment not properly bonded and grounded, which can lead to shocks or worse. Some older homes have circuit breaker panels that have a bad history with known issues. These include Sylvania, Federal Pacific, Zinsco and Challenger brands. Some insurance companies will not insure houses with these panels.

Also, all homes run a risk of faulty wiring. If you have lights that constantly flicker or dim, it could be an indicator of poor connection that leads to sparking, overheating and fire. If your lights are constantly burning out, it could be due to a loose connection or insulation causing overheating. Dead outlets are a potential safety issue indicating possible heat building up and melted wires. Outlets and switches that are hot or even warm to the touch are an indication of safety concerns and should be addressed by an electrician. Breakers that trip frequently indicate an overloaded circuit that could result in issues. Look for these signs and consult an electrician immediately if you find them.

Mold and allergens. We all want to breathe healthy air in our homes. New homes must pass a Blower Door Test to ensure enough fresh air is able to pass through the home. Excess moisture in a home can lead to microbial growth including mold. Home inspectors are trained to look for any signs or leaks or moisture intrusion that could lead to mold. The most common causes are shower pans improperly installed, windows that are not set correctly allowing rain to enter the wall, roof leaks or plumbing leaks. If you see moisture stains or feel soft spots in drywall, these are good indicators to call an inspector to investigate.

Pest issues. Common pests include rodents, bats, bedbugs, roaches and fleas. These pests can cause health issues that include allergic reactions, asthma and respiratory disease. Low areas outside the home holding stagnant water can breed mosquitoes, which can carry many virus-borne diseases.

We joke that there are only two types of homes in Florida. The ones that have had termites and the ones that will have termites. If left untreated, termites can cause lots of structural damage to a home. It is important to have routine pest service in Florida to prevent these issues.

Flooring issues. We live in a state with a lot of senior citizens. One in four senior citizens will fall each year, according to the CDC. We can reduce the risk by identifying trip hazards during the inspection. This includes properly installed handrails, ensuring that hallways and stairs are properly lit and carpeting is properly stretched and tacked to the floor. Ensure bathtubs and showers have a non-slip feature as well. You should also identify slick flooring such as vinyl plank and laminate where shoes should be worn. Make sure there are no raised tiles/planks making a trip hazard and avoid using throw rugs that slide easily.
