Hays County COVID-19 Update as of August 9 STAFF REPORT

Hays County Courthouse, San Marcos, TX – Hays County Local Health Department (HCLHD) reports two (2) COVID-related fatalities, a Dripping Springs woman in her 80s, and a San Marcos woman in her 40s. This report covers August 7-9, 2021. HCLHD also reports 317 new lab-confirmed cases along with 35 new hospitalizations and 21 new hospital discharges. There are 258 addition-

al persons considered recovered. The total number of persons considered recovered is 19,765. The current total of lab-confirmed cases for Hays County since the beginning of the pandemic is 21,864. Hays County has 1,820 active cases. In the past 21 days there have been 2,333 active cases. Hays County has had 1,060 total COVID-related hospitalizations and 58 Hays County residents are currently hospitalized.

City of Kyle attempts world record with ‘Kyle’ gathering The city of Kyle is gearing up for its annual Pie in the Sky Festival Labor Day weekend, Sept. 3-5. Among the festivities, Kyle officials are trying to gather as many patrons as possible with the name “Kyle.” “We are so excited to host Kyle Pie in the Sky Hot Air Balloon Festival once again and bring back the Guinness World record attempt for the most Kyles in one place,” Special Events Coordinator Sarah Watson said. “We have high hopes that 2021 will be the record-breaking year for the Gathering of the Kyles.” The gathering will occur on Saturday, Sept. 4 at 10 a.m., during the morning session. There will be a group photo and official sign in. The current Guinness World Record for the largest same name gathering (first name only) belongs to Kupreski Kosci in Bosnia and Herzegovina with a total of 2,325 participants named Ivan. Some of Hays County’s youngest athletes had the unique opportunity of experiencing teamwork, sportsmanship and the importance of community during the baseball world series.

The 6U Shetland All-Stars team, a tee-ball team part of the Hays Youth Baseball and Softball Association (HYBSA), competed at the Pony World Series in Youngsville, Louisiana from July 21 to July 24. The Hays Shetland team consists of local

Hays County kids aged 4 to 6. After the regular baseball season, which ran from February to May, 13 players were selected for the all-stars team in late May after tryouts. The all-stars team was led by head coach Philip Daigle and assistant

coaches Kris Beasley, Chelsea Romanowski and Andrew Rodriguez. After competing in three tournaments, the team secured a spot to compete in the Pony World Series and had a month to prepare for

Kyle PD investigates deadly hit and run BY SAHAR CHMAIS A Hays County Sheriff’s Deputy found a man struck by a vehicle in the 100 block of Windy Hill Road, on Thursday, Aug. 5 at 2:29 a.m. The 22-year-old victim, Jose Emilio Berberena, died from his injuries. Officers began life saving efforts on Berberena while waiting for Buda Fire and EMS to arrive. The Kyle resident was transported to Ascension Seton Hays Hospital, but died from the injuries. An investigation of the accident was initiated by the Kyle Police Department Crash Investigation Unit immediately

For the upcoming Tax Year 2021 (Fiscal Year 2022), the valuations have been set by the Hays County Central Appraisal District at $25,073,854,064. Other items in the new budget will also include funds for a Hays County

mental health facility, which will have VA wing, to serve military veterans. Funds for the facility will come from the $44 million federal American Rescue Plan Fund. The budget also includes upgrades in technology for the Public Defenders Office across the county. The budget includes more county positions

for FY 2021-22. It includes 18 new correction officers jobs, 22 positions for the expansion of jail operations, one animal control officer and 31 patrol vehicles. A new deputy constable position will be considered after redistricting is complete. A new district court has also been created for Hays County, so funding has been provided to support it. Social service agencies are not expected to receive any increases from the previous year’s budget. Becerra created a new budget office, adding that he expects the population

of Hays County to be set at or above 225,000 by the recent U.S. Census. According to the Texas Government Code, once a county reaches a population of 225,000, the county either appoints the county auditor as budget officer or creates the position of budget officer. During the workshops, commissioners will get a chance to question and delve into the details of the budget for the next fiscal year. On Aug. 24, Commissioners Court will vote on the proposed budget and will adopt the final budget on Sept. 21. The fiscal year begins Oct. 1, 2021.

City of Kyle, Texas Notice of City Council Budget Meetings and Public Hearings for Proposed Operating and Capital Budget Fiscal Year 2021-2022 The Kyle City Council is scheduled to conduct the remaining budget meetings and public hearings on the City Manager's proposed budget for fiscal year 2021-2022 to review revenues, expenditures, and fund balances for all City Funds. This review and discussion will cover property tax rates, water and wastewater service rates, storm drainage fee, other fees and charges for various City programs and services, capital improvement projects, requests for additional personnel, requests for new equipment and vehicles, and other budgetary items. The City Manager presented the City’s proposed budget for fiscal year 2021-2022 to the City Council at Budget Worksession No. 3 held at Kyle City Hall on Saturday, July 31, 2021. It is important to note that the City Manager’s proposed budget as presented to City Council on July 31, 2021, is subject to changes and amendments by the City Council during the budget deliberation process. The proposed budget for fiscal year 2021-2022 is a complete financial plan for all City funds, programs, services, operations, and capital improvement program (CIP) activities for the period covering October 1, 2021, through September 30, 2022. Pets are good at teaching empathy My Lab puppy, Thurber, makes me laugh out loud every day. The writing life requires you to sit still for long periods of time, but those days are long gone. As I write this column – attempt to write it, that is – my sevenand-a-half-month-old buddy keeps dropping his ball at my feet, hoping to get me to play with him. Which makes me laugh out loud. He usually doesn’t give up until I take him outside for a good run – or we go to the park, so he can greet strangers with enthusiastic joy. I knew getting a dog would change my daily routine, but I had no idea how much he would change and brighten up my life. I didn’t realize until after he arrived five and one-half months ago, but I used to go for days without laughing – certainly without laughing out loud. Now Thurber’s antics make me laugh so hard and so often, I can only imagine how much public civility would be improved if everyone in our country could experience the daily joy he brings me. Civility is “the foundational virtue of citizenship,” developmental psychologist Marilyn Price-Mitchell wrote a decade ago in Psychology Today. It’s behavior “that recognizes the humanity of others, allowing us to live peacefully together in neighborhoods and communities.” She explained that the psychological elements of civility include awareness, respect, self-control and empathy – the very characteristics a professional dog trainer is currently helping me develop in Thurber. Empathy – the ability to understand and share the feelings of another – is certainly a skill we Americans are losing in our increasingly isolated, angry, social-media-driven world. But pets like my best buddy Thurber can help bring us together and help us restore our argumentative nation to a civil, well-functioning republic. Child development specialist Denise Daniels explains in

The Washington Post that “emotional intelligence,” or EQ, is a measure of empathy. She points to the findings of the Yale Center for Emotional Intelligence, which researches EQ and teaches people how to improve it, and notes that a high EQ score is the best indicator of a child’s success – as well as an adult’s. Which brings us back to the value of pets. Daniels writes that a variety of research in the U.S. and U.K. has shown a correlation between attachment to a pet and higher empathy scores. I know my buddy Thurber has certainly improved my empathy and EQ score. I didn’t realize that my emotions for the little guy would run so deep, or that I would work so hard and do so many things to give him the happiest, healthiest life he can experience. Plus, everywhere we go – and he loves few things more than jumping into the backseat of my truck – he makes total strangers smile, laugh and converse with me. His simple presence can bring human strangers together. He not only makes us forget the petty human world – for a little while, at least – but he reminds us that a simple but magnificent creature like him can turn the most hardened souls back into an empathic, laughing, happy children. As I work hard to train Thurber to be a great dog who exhibits compassion, self-discipline, courtesy and empathy, he is training me right back to improve all of those very same skills. I can no longer imagine what my world would be like without my lovable Labrador enriching it for me – and everyone else who meets him every day.

COVID widow tells deniers to get real Kudos to grieving widow Julia Letlow, a Louisiana Republican congresswoman, for setting the record straight. Better late than never. Last November – you may dimly recall, if at all – her husband Luke won a House seat but never made it to Washington. In mid-December he announced that he had COVID. Twelve days later, he died at age 41. Prior to the illness, according to his doctor, he’d been healthy as a horse. He left behind Julia and two small children. This tragedy was bad enough. Arguably worse were the numerous dolts who insisted on social media with high confidence that COVID hadn’t killed Luke, that surely he had succumbed for some other reason – because in their authoritative view COVID wasn’t real, it was a hoax, or whatever. When I wrote about Luke’s sudden death on Dec. 30, I was peppered with all kinds of creative emails. The big theme was that COVID was not a scientific truth, it was merely a “narrative.” So it’s nice that Julia, having won

a special election to fill Luke’s House seat, has now come forward to enlighten the fools who continue to live in denial – starting with her fellow Louisianans, only 37 percent of whom have opted to get vaccinated. And not a moment too soon, because Louisiana continues to break COVID-19 hospitalization records. One Louisiana doctor said that his facility is “admitting one Covid patient (every) 45 minutes,” and, in many places, elective surgeries are being canceled as a lower priority. On CBS News this week, Julia Letlow said: “People don’t want to feel forced into anything or be lectured to. We are a very prideful, strong people in Louisiana. I just said, ‘What can I do? Is there anything I can do to help with the misinformation out there? With all of the confusion and fear?’ And

someone asked, ‘Well, what would you tell somebody who’s on the fence about possibly receiving a vaccine?’ And I said I’d tell them about Luke. I would tell them my story.” It’s heart-breaking, of course. He isolated himself in their house, well aware that vaccines were being rapidly developed. Julia said, “He and I prayed about the possibility of the vaccine, and we were so excited that it was coming out and that it was going to be widely available. And he missed it by two weeks.” He was admitted to a hospital shortly before Christmas, “he cried on the way,” and after that “it all happened very quickly…Where I saw the color drain, and that’s when it hit me that he might not come home.” She prayed over him, “and that’s when I left him, and I kissed him goodbye.” Understandably, perhaps, the CBS News folks didn’t want to impinge on her moving story by asking any inconvenient questions. Such as: “Do you regret that your husband, during his House campaign, staged multiple maskless rallies

and meetups?” Such as: “Looking back, was your husband wrong when he campaigned against lockdowns and told voters that ‘we have to learn to live in a Covid world’?” Such as: “Would you be as bullish about vaccines if your family had not suffered this personal tragedy?” But setting all that aside, we should welcome Julia to the fight. She said in the Wall Street Journal: “When Luke was in the hospital, he told me numerous times that he wanted to help people understand the seriousness of the virus.” If she can goad any deniers into getting the jab, it’s a plus. When her husband passed, I wrote: “After 330,000 deaths, how many more cautionary tales do people need to hear?” That was nearly 300,000 deaths ago, so I’ll repeat the question. STATE NEWS Delta variant spurs huge increase in COVID-19 hospitalizations The number of Texans hospitalized with lab-confirmed COVID-19 cases is increasing faster than at any other point since the pandemic began in early 2020, due to the highly contagious delta variant. As of Sunday, the Texas Department of State Health Services reported 8,892 people were in Texas hospitals. That is up more than four-fold from a month ago. The Coronavirus Resource Center at Johns Hopkins University reported 96,807 cases in the past week and 384 deaths. That is nearly eight times the number of new cases reported a month ago and more than double the deaths. In Austin, health authorities warned the public that a surge in cases has swamped hospitals, according to a New York Times report. Intensive-care units are near capacity, with only a handful of ICU beds available. Gov. Greg Abbott has barred local governments and public schools from reinstituting mask mandates but is urging people to get vaccinated against COVID-19. The vast majority of those hospitalized have not been vaccinated. A total of 12.84 million Texans are fully vaccinated, about 44% of the state’s total population, according to DSHS.

SECOND SPECIAL SESSION UNDERWAY; DEMS STILL AWOL Abbott convened a second special session just hours after the first session expired but there still wasn’t a quorum present to pass bills. Many Texas House Democratic legislators remained in Washington, D.C. in an effort to both block a quorum and lobby members of Congress to pass a federal voting rights bill. Abbott has put forth a 17-item agenda that includes the election reform bill, bail reform, border security and other issues that were presented but not passed during the regular session. “I will continue to call special session after special session to reform our broken bail system, uphold election integrity, and pass other important items that Texans demand and deserve,” Abbott said when announcing the new session. “Passing these special session agenda items will chart a course towards a stronger and brighter future for the Lone Star State.” Texas House Democrats predictably were critical. State Rep. Ina Minjarez said Abbott is “wasting” taxpayers’ money, chiding the governor in a tweet with the hashtag #StopGaslightingTexans.

Texas Capitol employees won’t have to go without a paycheck in September after all. Abbott vetoed a portion of the state budget that funds the Legislature and its staff after House Democrats walked out during the regular session. But Abbott, Lt. Gov. Dan Patrick, House Speaker Dade Phelan and others announced an additional month of funding for the Legislature before the second special session that began Saturday. “Texans should not have to pay for Legislators who quit their jobs and leave unfinished business,” Abbott said. “…Funding is being temporarily restored for legislative staff that will be necessary to pass critical legislation…” At least $12.6 million will be transferred from the Texas Department of Criminal Justice to both chambers and the legislative agencies that support them, the Texas Tribune reported. The biennial budget, which is already funded, ends Aug. 31. Without the additional funding, more than 2,000 state workers might not have been paid after that date. The special session by law lasts no more than 30 days.

PANDEMIC HELP FOR TIMBER HARVESTERS, HAULERS Texans who make a living cutting or hauling timber, or processing wood by chipping or grinding, are eligible for grants from a fund of up to $200 million provided by the U.S. Department of Agriculture under a pandemic assistance program. The new program, Pandemic Assistance for Timber Harvesters and Haulers (PATHH), encourages timber harvesters and haulers to apply. The deadline is Oct. 15. “We Texans pride ourselves on our rugged individualism and self-reliance. Texans out for revenge in New Mexico

On Aug. 14, 1842, the secretary of war and marine gave a mysterious Missourian everything he wanted: a colonel’s commission, the money and authority to raise a mercenary force and his sealed orders. Now it was all up to Charles A. Warfield to take Texas’ revenge on New Mexico. The unprovoked imprisonment the previous year of the 300-plus members of the Santa Fe Expedition had deeply wounded Lone Star pride. The tales of cruel mistreatment the pitiful Pioneers told following their mass release in March 1842 made retaliation a national priority. Even more important than saving face and appeasing public opinion was the political necessity to protect the international reputation of the young Republic. European confidence in the future of an independent Texas was badly shaken by the embarrassing failure to make the claim to New Mexico stick. As a result, bankers from London to Brussels no longer regarded the regime as a good credit risk. To organize and lead the clandestine campaign, war secretary George W. Hockley chose a frontiersman with many years experience in New Mexico and the Rocky Mountains. Charles Warfield’s grand though unrealistic goal was the conquest of New Mexico capped by the occupation of Santa Fe. Figuring 800 fighters could handle the job, Warfield counted on Texas and Arkansas to contribute 300 each. The additional 200 he was confident of signing up himself in his native Missouri and at trading posts in the southern Rockies. Hays CISD COVID protocols for new season With the upsurge in COVID-19 cases due to the Delta variant, the Hays CISD COVID Response Team put together requirements and suggestions for this school year. These protocols will begin on Monday, Aug. 16. While the Texas Education Agency (TEA) does not require contact tracing, Hays CISD will do it anyway. The district is not required to report positive cases, but the district will provide notification anyway. If a staff member or student tests positive, regardless if he or she has been vaccinated, that person is required to quarantine (currently 10 days). Anyone who has not tested positive, but has been in close contact with a person who tested positive, will be required to quarantine if they have not been vaccinated. Students can attend remote conferencing during their required quarantine, per TEA. Teachers on remote learning will not be students’ regular teachers, but will focus on remote conferencing.

While the governor has decreed that school districts cannot require masks, Hays CISD strongly recommends them and is urging people to wear them at school. While some school districts across the state are defying the governor’s order, Hays CISD said it does not have the enforcement power to require masks. The district is declaring a moratorium on non-essential large gatherings, including the district’s annual convocation. The district will keep this order in effect until this wave of COVID has safely subsided. A 50% fan capacity at athletic venues, including Shelton Stadium will be set. Current ticket sales will be honored, but fans will be spread out for social distancing safety. If more than 50% of tickets have not been sold for a particular venue, the venus will cap sales at 50% capacity. Campuses will be closed to regular visitors and all non-essential personnel. HCISD Superintendent Dr. Eric Wright put out a release this week for all

parents, saying, “The best advice is to get vaccinated if you qualify. We can speed up our return to normalcy by encouraging everyone to get shots. Looking at the graphs of new cases for the state and for Hays County, we are seeing numbers that are not as high as the peak last winter, but they are higher than what we saw at the start of last school year. This is not the way we wanted to start the 2021 -2022 school year, but we will make the best of it.”

NOTICE OF RULES ADOPTED BY REUNION RANCH WATER CONTROL AND IMPROVEMENT DISTRICT Reunion Ranch Water Control and Improvement District, a political subdivision of the State of Texas (the “District”) has adopted Rules the Regulations Governing Water and Sanitary Sewer Facilities, Service Lines, Connections, Erosion Control, Drainage Facilities and District Property (the “Rules”) governing the design, installation and inspection of all connections and taps made to the District’s water distribution system and sanitary sewer collection system, the limitations of the flow of waste into the sanitary sewer system and drainage system, protection of all facilities which are part of the District’s waterworks, sanitary sewer system and drainage system, and the enforcement of these Rules. The foregoing Rules of the District provide for penalties for violations. The Rules, pursuant to Texas Water Code §49.004, impose the following civil penalties for breach of any rule or regulation of the District: The violator shall pay the District twice the costs the District has sustained due to the violation up to $10,000.00. A penalty is in addition to any other penalty provided by the laws of this State and may be enforced by complaints filed in the appropriate court of jurisdiction in the county in which the District’s principal office or meeting place is located. Under Section 51.128 of the Texas Water Code, rules adopted by the District are recognized by the courts in the same manner as penal ordinances of a city, which may be enforced under Texas Local Government Code §54.012. If the District prevails in any suit to enforce the Rules, it may, in the same action, recover any reasonable fees for attorneys, expert witnesses and other costs incurred by the District before the court. The amount of the attorneys’ fees shall be fixed by the court. Such civil penalties shall be in addition to any other remedy or penalty provided by state law, including a civil action for injunctive or other relief. A customer found in violation of the Rules shall be liable to the District for all expenses borne by the District including laboratory fees, legal fees, engineering fees and other costs incurred by the District in establishing the violation and resolving the cause of the violation. A customer found in violation of these Rules who causes or contributes to a violation by the District’s Sanitary Sewer Collection System of effluent parameters shall be liable to the District for all expenses or penalties borne by the District, including legal and engineering fees related to any lawsuit filed by federal, state or local authorities regarding violations by the District of effluent parameters applicable to the District’s Sanitary Sewer Collection System. In connection with violations of Erosion Control (Article X of the Rules), failure to adhere to such Erosion Control requirements will subject the violator to a fine of five hundred dollars ($500.00) for the first violation and seven hundred fifty dollars ($750.00) for the second and subsequent violations per lot per day to be paid by the builder, developer, corporation or other entity or individual who violates such Rules, to be paid to the District. In addition, the District may also impose the cost of replacement of District property or the cost associated with trash removal plus a 15% administrative fee for violations of the Erosion Control requirements. Pursuant to Texas Water Code §51.241, a person who violates the Rules commits a criminal offense classified by statute as a Class C Misdemeanor and is subject to criminal prosecution. Any violations of the Rules may be reported to local authorities and/or prosecutors. Persons prosecuted for violation of the Rules shall also be subject to any additional federal, state and local criminal and penal provisions. Each method of enforcing the Rules is cumulative of the others, and the exercise of any rights hereunder shall not divest the District of any other rights of enforcement or remedies. Nothing in the Rules shall be construed as a waiver of the District’s right to bring a civil action to enforce the provisions of the Rules, and to seek all remedies and damages as allowed by law. Other violations of the Rules may result in termination of services. The Hope 4 Hays County Veterans program will begin to offer assistance for car insurance, cell phone bills and medical assistance devices not obtained through the Veterans Administration. Funds will be managed by Hays County through a $100,000 grant from the

Texas Veterans Commission Fund for Veterans Assistance. These funds will help find a solution to financial problems veterans and their families experience through improving their quality of life, said Hays County Case Manager Cheryl Robinson.

“Money-related issues are a source of anxiety for many veterans’ families,” Robinson explained. “The threat of being evicted, losing their home or not being able to have needed medical assistance devices is a daily source of stress.” Veterans and their

families also have access to other services if the grant is not an option. Robinson’s group can put them in touch with local and state service agencies for further assistance ranging from job training, technical skill building to counseling for addiction, she added.

Beasley said the kids were very excited about the prospect of going to Louisiana. “They thought it was the coolest thing,” Beasley said. “Every practice, it’s all they could talk about. We showed them that we were traveling outside of Texas and competing against kids from other states. To be able to do that is something they’re going to always remember.” To raise money for the series, the team held a BBQ benefit on July 10 and a fundraiser through MOD Pizza in Kyle where a percentage of sales went to the team if customers said they were supporting HYBSA. Along with donations from numerous parents, friends, local sponsors and other community members, HYBSA’s Mustang team, consisting of 9- and 10-year-old players, and Bronco team, consisting of

caught the attention of an umpire during the team’s regular season, who gave Lydia a signed game ball and said that despite rarely seeing girls out on the field with the boys, players like her with great attitudes tend to go far in the sport. Lopez also praised the entire team’s efforts, saying they all kept a great attitude throughout the journey. “All of the kids were so great,” Lopez said. “They didn’t complain; they loved it. Even in the heat. They all really impressed us.” Beasley, who grew up playing baseball for Hays, said it was an honor to coach the kids at the same fields he grew up playing
