BY ANITA MILLER It was a long time in the making, but the new deal between the city of Kyle and Texas Disposal Systems (TDS) is a “win” for both, a city official says. The Kyle City Council approved the new, 15-year contract on Jan. 21 and it contains good news for both residences and businesses, said Kyle’s Chief of Staff Jerry Hendrix. “On the residential side it’s kind of huge,”

he said. Instead of the four percent annual increase under the existing contract, residential customers will now see a yearly increase of only two and a half percent with the 2020 rate set at $22.14 per household. Hendrix said com-

mercial customers will also benefit by having a “lower multiplier” than in years past. In addition to lower rates, he said residential customers will see a lot of new and expanded benefits, including twice-yearly brush

Tense times for some residents in the Plum Creek neighborhood of Kyle came to an end on Saturday afternoon with the arrest of a 34-yearDUTSON old Round Rock man. Kyle Police charged Trevor Gordon Dutson with burglary of a habitation and tampering with evidence. At the time of his arrest he also had two outstanding warrants for fraud, both outside of Hays County. Kyle police responded to a burglary in progress in the 700 block of Fairway minutes after 2 p.m. Saturday. City staff later said the homeowner was not home at the time but summoned police after seeing an intruder on a security camera. “Our officers were able to determine the identity of the suspect and make contact with him by telephone,” Kyle Police Chief Jeff Barnett said. “They determined the subject knew the homeowner and that they were not dealing with a random illegal entry.” Police surrounded the residence and repeatedly urged the suspect to exit and surrender. However, he did not. Police also closed nearby neighborhood streets and urged residents, as a precautionary measure, to stay indoors until the situation was resolved. Three hours passed before Dutson was taken into custody without incident. “Once the individual

TOBIAS The election was to fill the unexpired term of District 6 council member Daphne Tenorio, who resigned last month in order to pursue the Democratic nomination for Hays County Treasurer. Tobias will serve until November 2021, at which point he will be eligible for re-election. Tobias won 69.78 percent of the total with 97 votes cast compared to his opponent, Brandy Heindl, who received 42 votes (30.22 percent). Only 139 votes were cast in the election, representing a scant 2.02 percent of the 6,882 voters who were eligible to participate. Tobias’ lead was consistent through absentee voting (7 votes, 71.43 percent compared to Heindl’s 2 votes, 28.57 percent), early voting (46 votes, 63.89 percent compared to Heindl’s 26 votes, 36.11 percent) and election day voting (46 votes, 76.67 percent compared to Heindl’s 14 votes, 23.33 percent.

HISTORY

Founded April 10, 1903, by Thomas Fletcher Harwell as The Kyle News, with offices on the corner of Burleson and Miller streets in the town’s oldest remaining building. It merged into The Hays County Citizen in 1956. The paper consolidated with The Free Press in October, 1978. During its more than 100-year history the newspaper has maintained offices at more than a dozen locations in Kyle and Buda.

Relief for commuters waiting for the end of work on Burleson Street is but a few months away. According to Leon Barba, engineer for the city of Kyle, the project is still on track to be completed in June. As of Jan. 21, Barba reported the project is an estimated 73 percent complete with the section from Center to Rodriguez streets open for local traffic only

as workers are still present. The roadway north of Rodriguez to south of the roundabout is still closed. While utility crews have been working from Rodriguez Street to south of James Adkins Drive since Jan. 23, that work has expanded to north of Rodriguez. Replanking the UPRR crossing is pending, while the detention pond is nearing completion and only minimal work is still needed on a retaining wall by the church.

• Lehman Road, now open from Primrose to FM 150 for local traffic, is expected to be done in August. As of Jan. 21 the total project was estimated to be 46 percent complete, with bridge work at Plum Creek to start soon. • The Kyle Crossing project, meanwhile, is 99 percent complete. The road is open and the final walk-through has been done. The city council, on second reading, repealed the ordinance that authorized “No Through Truck Signs” from Kohler’s Crossing to Vista Ridge. • Work on the Bunton Creek Interceptor is estimated 98 percent complete and 40 percent grant funded. The Texas Department of Agriculture has requested a two-month extension. • Council postponed an item dealing with the wastewater treatment plant expansion. Three bids were received ranging from $28,898,400 to $30,921,000.

Buda initiates free, limited time microchipping pets BY ANITA MILLER

Stray and lost animals aren’t a problem unique to any city or region, yet it’s one many municipalities struggle to deal with. Late last year the city of Buda decided on a course of action to help displaced animals to be reunited with their owners. On Jan. 16, the Buda Police Department rolled out an ambitious ninemonth program of microchipping pets for free – and just as importantly, requiring pet owners to fill out paperwork ensuring that the chips are properly registered. According to the ordinance passed in 2019, all animals over the age of four months must be chipped and registered with the city of Buda. The microchipping will be done for free at Buda police headquarters through September, and registration is good for the life of the pet. In order to qualify for free microchipping, pets

Buda council passes on new A.I.driven tool, for now BY ANITA MILLER A better way of gauging public opinion or the intrusion of Big Brother? Members of the Buda City Council are grappling with that question in the wake of a presentation last week on Zencity, an Artificial Intelligence-driven platform that cities can use to gather and analyze data across social media, web and news platforms. No action was taken, and the city’s Public Information Officer David Marino said he wasn’t too surprised. “My job is to bring things forward to council that are possibly helpful in the future,” he said, adding that more and more people are commenting in online public forums. While people still attend public meetings, he noted, it’s on social media where they are more likely to share their opinions. Based in Tel Aviv, Israel, Zencity is a pioneer in its field and specializes in municipal governments. Its clients in Texas include Houston and Seguin. Houston used data that Zencity gathered to assess concerns about trains blocking vital intersections, while in Seguin, people weighed in on a new mural dedicated to the Texas Rangers. Zencity tracks city-managed social media sites as well as others like neighborhood groups, other web sources and

Trump’s middle-finger defense Young At-Large by John Young

“Son, this is a Washington, D.C., kind of lie. It’s when the other person knows you’re lying, and also knows you know he knows.” This from Allen Drury’s novel “Advise and Consent.” The 1959 account of conniving and blood sport in a high-profile Senate confirmation won the Pulitzer in fiction. For a modern-day masterwork about deceit in the Senate, however, turn to Donald Trump’s “defense” in his impeachment trial. Call it “Obstruct and Conflate.” “No evidence to convict,” says that defense. Disregard the evidence presented to the House by the most credible raft of witnesses any inquiry could assemble. Well, then, “Not impeachable.” Let’s just say that “no evidence” and “not impeachable” are not compatible in any way. Either Trump did exactly what testimony and the transcript of a certain phone call clearly demonstrate, or he didn’t. Which is it, Republicans? Apologists less inclined to lie outright say, “OK, he did it. It’s not that big a deal.” That depends. Is it a big deal that that the Government Accountability Office found the freeze on military aid to Ukraine violated the law? Ah, but he freed up the aid eventually, they say. Yes – freed it up the moment a story in Politico revealed the troubling matter and Congress pressed for answers. In the light of those two incompatible arguments, the Republicans have nothing. The most amusing defense comes from Sen. Lindsey Graham, who when defending Trump appears to channel Tom Cruise in “Rain Man” defending his socially impaired sibling. Addressing the phone call that got this whole thing started Trump, Graham said, “If he thought he was doing something wrong, he would probably shut up about it.” The Rain Man defense, by the way, is built around another lie the Republicans have trotted out, that this is just about one phone call. Such a claim is an insult to the good name and hard work of one Rudolph Giuliani, who at this very moment continues his years-long labors to make rain out of “a favor” his boss requested from Ukraine’s president to help Trump cheat on the 2020 election. No, no defense whatsoever. As Colorado Sen. Michael Bennet said, the case against Trump “hasn’t been rebutted at all, except by the president’s middle finger.” We are going to hear from the president that he’s been fully exonerated by his Senate partisans. It must be nice to be on trial when you have supped with, campaigned for and in many cases donated campaign funds to jurists. We hurt for the Republicans who had to sit, cell phones idle, for three days to hear the hard facts about the corruption of The Chosen One. They complained about repetition. So boring. “So be it,” said a scathing Washington Post editorial. “GOP senators intent on exonerating the president without bothering to fairly consider the case against him should at least be forced to face the reality of his abuses.” A telling, and unique aspect of “Advise and Consent” is that Drury’s novel doesn’t identify any character by political party — that parties bleed and blend across lines depending on what senators believe to be right. This is what happened to end Richard Nixon’s presidency, when Republicans like Sens. Barry Goldwater, Howard Baker and more acted pursuant to the facts. Trump’s “acquittal” will be remembered forever as pure partisanship, a “Washington, D.C., kind of lie.” No matter what Trump apologists say, it will be Rep. Adam Schiff’s intonations which are jackhammered into history’s eardrums. “Sometimes I think how unforgiving history can be of our conduct,” he said, “if we do a lifetime’s work with the most wonderful legislation and then (are) remembered for none of that.” Today’s Senate Republicans long will be remembered for giving cover to one conniving man at the expense of what the founders constructed with a document written of, by and for people. Too many social media users enthusiastically share unvetted “facts” with likeminded friends at the expense of truth and clarity. The solution to our increasing lack of clarity? STAFF REPORT Guided by two players in double figures Friday, the Lehman Lobo boys basketball team scored a key upset win that kept it in playoff contention. By virtue of a 50-46 win over the Lake Travis Cavaliers, Lehman (1314, 3-7) is now only two games behind fourth place with three weeks to go in the season. Lehman led 11-10 after a quarter before Lake Travis rallied to take a 24-23 halfime advantage. A 16-point third quarter made the difference for the Lobos as they took a 39-35 lead into the fourth frame. Lake Travis drew no closer as the Lobos held off the Cavaliers late to score the win. Lobo senior Jarek Salinas finished with 16 points and senior Marcos Cantu finished with 11 points. Lehman senior Nijah Collier tallied eight points in the contest. Heading into the final stretch of the season, Lehman squares off against all six of the programs currently ahead of them in the 25-6A standings. With only three games separating

3rd through 7th place in the standings, Lehman must win out and obtain some help to take the final playoff spot.

Rebs crush Austin, still 4th in district BY MOSES LEOS III

Sensing a chance to thin the crowd battling for 25-6A playoff spots Tuesday, the Hays Rebel boys basketball team wasn’t coy in slamming the door on the Austin Maroons. Backed by 17 points from guard Durand Hill, Hays (17-9, 6-5) utilized a red-hot offense to cruise to a 62-38 win over Austin. With the win, Hays now holds sole possession of the final playoff spot out of 25-6A with five games left, while also placing Austin High, which is one of seven teams fighting for the final three district playoff slots, on the brink of elimination. Even with several key tests still to come, Hill felt confident things were starting to turn in the Rebels’ favor. “We’re getting the sense we got this and we’re motivated to keep it going and keep fighting,” Hill said. Led by Hill, Hays’ offense found its groove from the get-go, building a commanding 9-0 lead within the first three minutes of play. Hays’ lead grew to 17-6 after a quarter which then swelled to 32-13 at intermission. Hill scored 12 of his 17 points in the first half with six of those points coming by way of an old-fashioned three-point play. Rebel head coach Matt Sandoval lauded Hill, who he said had his best game of the season. The open shot at the back post came from a deflection off Hays goalkeeper Kate Foate on a Lehman corner kick, which then landed right in front of Alexander, who nailed the strike. “Yeah she (Alexander) kind of snuck in there on the back post and she put it in,” said Dickson. “That goalkeeper was just solid in the back, and she found that seam on the backside. But it was good to get that in, you could see the excitement in her for Delaney getting

The victory gives the Lady Lobos a 4-2 record in District 25-6A, while the loss drops the Lady Rebels to a 1-3-2 record. Buda Automotive’s doors are closed but memories remain A good auto mechanic gets all kinds of referrals, but for most, “my grandfather told me to call you” isn’t high on the list. The exception to that rule was Buda Automotive, a family-owned business that closed its doors for good Jan. 23 after 32 years in business. Actually, Jan. 28 would have marked 33 years, recalled Ellie Warmington, who with husband Tim has reported for work every day at the little shop down an unpaved driveway off Loop 4 in Buda. Behind the service bays is a small office area where Ellie mans the phone and computer amid a jumble of photos, trophies, games, toys and other paraphernalia from the years of visits by their children and then grandchildren. They hadn’t intended to close but, they say, the decision was forced on them when their landlord died and his son-inlaw took over and more than tripled the rent. “He made ridiculous demands and took all our

East Texas voters threw out the Sharpstown rascals n Feb. 1, 1971, the Securities and Exchange Commission (SEC) released a 47-page follow-up to the bombshell lawsuit filed two weeks earlier that exposed a stock fraud scheme involving a Houston banker and real estate developer and politicians in the highest offices in the State of Texas. Frank W. Sharp was one of those familiar Bayou City success stories but with a novel twist. He made his fortune not in oil but by building homes. Sharp left the small East Texas town of his birth in the mid-1930s looking for work. Even in the Great Depression, there were jobs to be had in the Bayou City, and he found one as a carpenter’s helper. When the ambitious young man felt he had learned enough about the construction of single-family residences, he borrowed $150 and began his home-building career. By the end of World War II, he had progressed to building several dwellings at a time in Texas City and Jacinto City. Sharp anticipated the unprecedented demand for housing created by Houston’s post-war boom. In 1948 the magazine Better Homes and Gardens had this to say about his latest project: With the proposed investment of $32 million and projected population of 25,000, “Oak Forest (is) one of the largest privately financed, single-family home developments in the United States or world history.” With the completion of Oak Forest in 1955, Sharp set his sights on an even bigger prize – the Sharpstown subdivision on the southwestern outskirts of the city. between the filing of the SEC lawsuit and the Democratic primary. With other papers following the Big D daily’s example, the story just would not die. Democrats went to the polls in the spring of 1972 determined to throw the rascals out. Preston Smith, named an unindicted co-conspirator in the bribery trial, finished a pitiful fourth behind Ben Barnes, the LBJ protégé, Frances “Sissy” Farenthold, the only female member of the Texas House, and eventual governor Dolph Briscoe, a Uvalde rancher whose chief qualification was that he was the biggest landowner in Texas. The race for governor was no fluke as incumbents with little or no connection to Sharpstown were given the boot. Texas’ government had to start over almost from scratch. The couple returned to Texas to raise their family and eventually retire in Wimberley. Many who knew him called him “Jerry.” He was a man of very few words. When he spoke, we listened! There were words of wisdom to be heard and then there were some one-liners that would make you laugh so hard! Paisley enjoyed watching sports, especially football, and cheering on his Arkansas Razorbacks and Dallas Cowboys. A memorial service was held on Jan. 19 at the Harrell Funeral Home in Kyle.

SIDES Bobby Neil Sides, 88, of Buda, Texas, died at his home on January 9, 2020. Bobby was born Dec. 19, 1931 to Victor and Lucy Sides and was the 6th of 10 siblings. Sides graduated from Dora High School in Alabama where he loved playing football. Joining the Air Force took him to Austin, where he met the love of his life, Alice. They were married on July 1, 1952. After various jobs Sides found his passion working for the Austin Police Department. Working on patrol, working lake patrol, and then working in narcotics as a part of a DEA task force was a source of pride for Sides and his family. His final career was as an investigator for the Dept. of Human Services. Sides and Alice were members of the Driftwood Methodist Church and an active part of the Driftwood community center. Sides loved to fish, hunt, shoot guns, and go out to eat with his policeman buddies like Gerald Raines, Bill Ligon, Bull Billberry, Phil Suitt, Lawrence Luker, Jay Spencer and Jerry Brinkoeter. Many a night was spent with Jim Fletcher selling raffle tickets at Salt Lick for the Driftwood community center. An open door policy with his friends like the Gremillions, the Halls, the Eckhols, the Garrisons and many other Driftwood friends to visit, plus share a cup of coffee and one of Alice’s chocolate chip cookies was a source of joy for many years. In his later years he looked forward to his visits from his greatgrandchildren who called him Bob. Sides is survived by his three children and their spouses: Robert (Diane) Sides of Dublin, TX; Janice (Roger) Barker of Locust Grove, VA; Michael (Susan) Sides of Buda. They gave up a lot and really showed how much they wanted to be not only a service provider for the community but a true partner.” As part of the deal, TDS will give the city $1,500,000 towards a Heroes Memorial Park to be constructed

It was good hearing that feedback.” Even though they didn’t immediately bite, the council left the door open for the issue to come back and Marino said opinions could change. “Maybe in the future, as more of these organi-

zations come into play – where there’s more competition – those sentiments will change.” For example, more cities might begin using Zencity or a similar progra. “I think you’re going to see more of this in the future,” he said. Although he makes a point to track social media far beyond the city’s 16 official channels, new social media sites are always popping up and it’s increasingly difficult for Marino to keep up. “Social media has really changed the communications world in a way you wouldn’t have seen even 10 years go,” he said. “It does come down to how do you sit there and monitor that all the time.” Marino said he became aware of Zencity when the company was a vendor at a recent municipal convention. “They are really one of the only ones that are doing it in that way – city government. They are the only one in the game doing it the way they’re doing it.”

Ellie remembers being in the hospital with their firstborn, watching her husband field questions. Helping people out is why he got into the auto repair business and why he has stayed, said Tim, who turns 62 next month. “I don’t know if I can deal with not having a shop to play in,” he said. “It’s always been a struggle for a small business. We’ve been kind of off the grid – never a part of Buda downtown, the Chamber of Commerce and all that – just kind of on the fringe.” He remembered 1983 when they were first married and living in

Sequoyah, and phone service wasn’t even available yet. “We had to wait three months to get a phone – there weren’t enough phone lines.” Ellie would go to the Buda grocery store every Sunday to call her mother. “Her mother’s like, ‘where did you move my daughter where you can’t even get a telephone?’” Regardless of the continuing growth and change the area is experiencing “now you have traffic jams in downtown Buda. It’s crazy.” Some of their customers have been with them from day one. And
