Platte County Commissioner Jason Brown Addresses Missouri North Area Council Providing a candid and optimistic update about the state of Platte County, Presiding Commissioner Jason Brown addressed the Missouri North Area Council membership lunch in Dec. “As bad as the national economy has been, we (Platte County) are weathering the storm well,” said Brown. County sales tax growth has improved 5.5 percent over a flat previous year. When Brown came into office the county was basing budgets off sales tax revenues declining 13 percent. According to Brown, the County is in the process of adopting a budget that will once again be balanced.

“This is your government, this doesn’t belong to me or the other commissioners,” Brown told attendees. “We are managing the people’s money and we will be prudent with those dollars.” Brown touted efforts by the county to encourage building in Platte County. In 2010 the County Commission adopted an occupancy-based assessment practice, removing the “inventory tax” placed on unoccupied homes builders may have. In early 2011 the county approved a temporary moratorium on building permit fees. The county has seen a 30 percent increase in permits pulled over the previous year thanks in part to

the effort. The county is also preparing for future growth by expanding infrastructure, including roads and sewers. Meanwhile,

Bob Regnier Named 2011 Kansas Citian of the Year

Bob Regnier

Bob Regnier who leads HBA member company Bank of Blue Valley, earned the Greater Kansas City Chamber of Commerce’s highest honor, 2011 Kansas Citian of the Year. The chamber cited Regnier for his business and civic leadership at the Annual Dinner in November. Regnier founded the Bank of Blue Valley in 1989 at 119th Street and Metcalf Avenue as a locally-owned, locally managed community bank. Today it ranks No. 20 on the Kansas City Business Journal’s listing of area banks. Regnier has held numerous civic posts including chairman of the Greater Kansas City Chamber.

Home Show Teams Up with Harvesters Home Show attendees will have the opportunity to support Harvesters Community Food Network through a special offer, Sunday, March 25. Congress Restores Higher Limits for FHA-Backed Mortgages

Home builders and buyers won an important victory when Congress approved a much-debated deal to restore higher loan limits through 2013 for mortgages backed by the Federal Housing Administration. When Congress allowed conforming loan limits to revert to their lower levels and reapplied a more restrictive formula for determining loan ceilings in local markets in October, thousands of potential home sales were put in jeopardy. NAHB and industry allies fought vigorously for an extension of the higher limits, and achieved a preliminary victory when the Senate approved a measure aimed at accomplishing that goal. The measure did face opposition in the House of Representatives from those who refused to support any measure that could be perceived as increasing the federal government’s role in housing. NAHB lobbied aggressively and was able to

help push through an agreement among lawmakers on both sides of the aisle. Higher limits for mortgages insured by the Federal Housing Administration will be reinstated for the next two years. This measure was approved by the House late on Nov. 17 and immediately taken up and passed by the more willing Senate. Not only will it re-establish FHA’s national ceiling for mortgages to $729,750 from the $625,500 to which it had fallen, but it will restore the formula for determining local FHA loan ceilings to 125% of the area median home price from the 115% currently in place -- something that should help put a floor under falling home values in markets nationwide. This legislation does not restore the higher loan ceilings for Fannie Mae and Freddie Mac, which together provide funding for about half of all U.S. mortgages.

Now under construction in Winter Park, Fla., about 30 minutes from the site of the 2012 NAHB International Builders’ Show in Orlando on Feb. 8-11, TNAH 2012 is on schedule to be completed in December. “At 4,181 square feet, it is smaller than previous TNAHs,” said architect and builder Phil Kean of Phil Kean Designs in Winter Park. “It will be displayed as a two-bedroom floor plan that will appeal

It also is being built on an infill site in an older neighborhood close to downtown Winter Park within walking distance of shops, restaurants and a public library. The New American Home is produced and presented by the NAHB leading Suppliers Council and Builder magazine and it showcases the NAHB Leading Suppliers products. IBS Panel Discussion to Look at Advantages of Green Building for Multifamily Projects A panel discussion on the cost savings, flexibility and other advantages of using the National Green Building Standard to rate and certify multifamily projects will take place during the 2012 NAHB International Builders’ Show in Orlando. An experienced green multifamily developer will join Michelle Desiderio, director of green building programs at the NAHB Research Center, which administers the National Green Building Certification program and trains and Building Business News

Building Codes: The HBAM supports enabling legislation to allow third class counties the ability to adopt their own building codes. The HBAM opposes any legislation creating a uniform statewide building or energy code. Licensing Issues: The HBAM opposes license and/or registration legislation for home builders. HBAM has also opposed mandatory statewide licensing of home inspectors. The HBAM believes licensure is best addressed at the local level. Workers Compensation Reform: The HBAM supports the requirement that everyone in the construction industry carry workers’ compensation insurance. The HBAM also supports legislation that requires co-employees to be released from liability for negligence in performing the non-delegable duty of an employer to provide a safe workplace when the negligence contributes to injury or death. Homeowner Warranty & Recovery Fund: HBAM opposes statutory home warranties and any fees to cover the potential litigated damages of homeowners. Instead, HBAM encourages homeowner association boards and builders to work cooperatively to identify legitimate problems and to develop reasonable and cost-effective solutions without the need for costly and timeconsuming litigation. Mechanics Lien Law: The HBAM continues to monitor/gather data regarding additional costs and logistical challenges of industry compliance with mechanic’s lien legislation passed in 2010. Power of Fire Protection Districts: The HBAM supports legislation which would curb the powers of fire protection districts, especially as those powers overlap with city or county controlled issues. HBAM does not support multiple municipalities of government entities charging service fees for the same inspections.

State Wide Building Codes: The HBA opposes any legislation creating a uniform statewide building code. Licensing Issues: The HBA opposes license and/or registration legislation on a statewide basis. The HBA believes licensure is best addressed at the local level. Recording Fees: The HBA opposes any additional fees on recording instruments. Green Building: The HBA supports initiatives to promote the use of green building technology in residential construction, but does not support government mandated use of specific guidelines, such as the LEED Program. Tax Credits: The HBA supports any tax credit or grant from the state level for new home buyers. Tax Policy: The HBA strongly supports maintaining enacted tax reductions and opposes removing exemptions key to economic growth, including the exemptions for construction and professional services. The HBA is opposed to any changes in state tax policy adversely impacting homeownership. Unemployment Compensation Fund: The HBA supports the refunding of the Unemployment Compensation Trust Fund by means that are fair, reasonable, and balanced. Workers Compensation: The HBA supports protecting the affordability of the workers compensation system and maintaining the requirement that all in the construction industry carry the insurance.

Recording Fees: The HBAM generally opposes any additional fees proposed on recording instruments.

Education Funding: While recognizing the connection between economic development and quality education, the HBA supports revising the current education funding formula. These measures should include funding based on actual costs, administrative consolidation, and further expansion of local funding options.

Land Disturbance Fees: HBAM opposes any significant or unwarranted increases in land disturbance fees imposed by the Missouri Department of Natural Resources that do not have a direct nexus to timeliness or effectiveness of the program.

Fire Sprinklers in Residential Structures: Fire sprinklers in one and two family residences should remain a consumer option. Currently no political jurisdiction is allowed to adopt mandatory fire sprinklers in their residential building code.

Green Building: HBAM supports non-mandatory initiatives to promote the use of green building technology in residential construction. HBA supports flexibility in guidelines and certification programs which include standards such as the ICC 700-2008 National Green Building Standard™ and its related National Green Building Certification.

Repeal Platting and Taxation Requirements – The HBA supports repealing the provisions of KSA 19-1207 implemented with Senate Bill 193 (2011). The HBA opposes paying a tax before it is levied and the burdensome efforts associated with estimating, collecting and refunding the projected tax bill.

Builder Confidence Rises for the Third Consecutive Month Builder confidence in the market for newly built, single-family homes edged up two points from a downwardly revised number to 21 on the National Association of Home Builders/Wells Fargo Housing Market Index (HMI) for December, released today. This marks a third consecutive month in which builder confidence has improved, and brings the index to its highest point since May of 2010. “While builder confidence remains low, the consistent gains registered over the past several months are an indication that pockets of recovery are slowly starting to emerge in scattered housing markets,” said Bob Nielsen, chairman of the National Association of Home Builders (NAHB) and a home builder from Reno, Nev. “However, the difficulties that both builders and buyers continue to experience in accessing credit for new homes are holding back potential sales even in areas where economic conditions are improving.” “This is the first time that builder confidence has improved for three

consecutive months since mid-2009, which signifies a legitimate though slowly emerging upward trend,” said NAHB Chief Economist David Crowe. “While large inventories of foreclosed properties continue to plague the most distressed markets and consumer worries about job security and the challenges of selling an existing home remain significant factors, builders are reporting more inquiries and more interest among potential buyers than they have seen in previous months.” Derived from a monthly survey that NAHB has been conducting for more than 20 years, the NAHB/Wells Fargo Housing Market Index gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores from each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view

conditions as good than poor. Each of the HMI’s three component indexes registered a third consecutive month of improvement in December. The component gauging current sales conditions rose two points in the latest month to 22, while the component gauging sales expectations in the next six months edged up one point to 26. The component gauging traffic of prospective

buyers gained three points to 18, which is its highest level since May of 2008. Builder confidence primarily gained strength in the South in December, where a four-point gain to 25 brought that region’s HMI score to its highest level since March of 2008. A one-point gain to 16 was registered in the West, while the Midwest held unchanged at 24 and the Northeast slipped one point to 15.

BUILDING LENDING RELATIONSHIPS FOR OVER 115 YEARS

Employee Collective Bargaining Rights Must Be Posted as of Jan. 31, 2012 Beginning on Jan. 31, 2012, all employers with more than $500,000 in annual gross business volume including home builders and remodelers will be required to post an official notice advising employees of their collective bargaining rights under the National Labor Relations Act. The law applies to all companies that meet the gross business volume threshold, including those who have nonunion shops or whose business is located in a right-to-work state. According to the National Labor Relations Board (NLRB), the notice must be 11 inches by Building Business News

17 inches and displayed in a conspicuous location where other workplace notices are regularly posted. Companies can download instructions and notification posters, available in more than 20 languages, free of charge from the NLRB website. A company that does not display the required poster as of Jan. 31, 2012 may be subject to an unfair labor practices complaint. Home Permits Relatively Thanks to Area November Strong in Jackson and Johnson Counties Councils Sponsors

Jackson County in Missouri and Johnson County in Kansas continue to lead building permit activity and carry positive numbers for the year to date 2011over 2010, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. Blue Springs, Independence, Greenwood, Oak Grove, and Lee’s Summit are having a better year than 2010, but other cities have not fared as well. Jackson County and the cities included in the county show a collective 12 percent increase year to date with a total of 427 units in 2011 versus 382 in 2010. Johnson County is on track for a slight increase with 4 percent growth in building permit activity through November. Most of the growth has occurred in Lenexa and Overland Park with no measurable increases in other Johnson County cities in 2011.

An economics report from the National Association of Home Builders based on census data indicates that Kansas City is the only growing market in Missouri or Kansas through the first ten months of the year with the exception of Columbia, Missouri. The same report indicates that Missouri statewide building permit activity was down 7 percent through October and Kansas activity was down 13 percent. “With interest rates now available below 4 percent for qualified buyers, those on the sidelines should be considering a new home for spring,” said HBA Executive Vice President Sara Corless. “Many custom builders are beginning to sign contracts that will keep them busy into early 2012 and some builders report that they are adding new home inventory in time for the 50th anniversary of the Spring Parade of Homes in April 2012.”
