UNPUNISHED VOLUNTARY DISCLOSURE Last chance As the Automatic Exchange of Information entered into force beginning 2017 in Switzerland, the time frame to disclose undeclared assets and income without being punished closes soon.

Individuals who are Swiss tax residents and need to file a tax declaration are under the obligation to report all worldwide income and assets. Sometimes, foreign assets remain undeclared for a reason, though often by mistake simply because taxpayers are unaware of the Swiss reporting obligation.

The “unpunished voluntary disclosure” When voluntarily declaring previously unreported assets for the first time in Switzerland, taxes (and interest) are charged, but there is no additional penalty. This should encourage individuals to rectify their situation, as they come back into compliance without being fined. It is important that the authorities have no knowledge of the undeclared assets. This is because as soon as the authorities start asking questions, it is no longer possible to benefit from the penalty waiver.

The impact of the automatic exchange of information With the Automatic Exchange of Information (AEOI) coming into force, Swiss authorities will receive information

from foreign financial institutions. The information that will be shared includes account and tax identification numbers, as well as the names, addresses and dates of birth of taxpayers abroad with an account in a country other than the country of origin, and all types of income and account balances. The AEOI is in force in all EU countries, plus an additional 50 countries and some “tax havens” like the Cayman Islands or Bermuda. When the Swiss authorities receive the first information from participating countries in the second half of 2018, they will likely crosscheck the declared positions. If accounts are reported that were never declared, this qualifies as tax evasion. In such a situation, arrear taxes (up to 10 years back), interest, and a penalty between one third and three times the evaded taxes, can all be levied. For Switzerland, the AEOI entered into force on 1 January 2017. As a consequence, it was debated if a “spontaneous” voluntary disclosure is still possible after January 2017. Data is being gathered at this moment and it is only a question of time until the Swiss tax authorities will receive the information. Although one could take the standpoint that the data is already collected (and only the reporting is outstanding) and hence a “spontaneous” declaration is no longer possible, most cantons apply a “generous” interpretation of the relevant

law. Several cantons, like Zurich, state that the AEOI will only give them access to this information the precise moment the exchange happens, i.e. in the year 2018. Therefore, they still accept unpunished voluntary disclosures in the year 2017.

Conclusion If taxpayers still have undeclared assets abroad, it is high time to report these and benefit from the unpunished voluntary disclosure rules. This disclosure should be done in the year 2017, as it is very likely that this will not be possible in the future.

As the planning and development phase will take some time, the empty factory building on the site is available for intermediate use: “We are open for creative suggestions, like pop-ups or similar projects, for the factory space of roughly 800 square meters”, explains Bastiaan Don, Group Head of Development & IT at VISIONAPARTMENTS.

Besides Zug, three more openings are planned for this year: In September, the first tenants will be welcomed in Frankfurt (130 units) and one month later in Vevey (100 units). In November,

DIGITALISING SWITZERLAND’S ECONOMIC FRAMEWORK By: Samantha Suarez-Maier, Editor at Hello Switzerland

How do you create an oasis for startups and SMEs in an ecosystem that isn’t highly conducive to creating businesses? The answer is clear – you change the framework. As a Private Public Partnership, digitalswitzerland works to create a political, social and economic framework that brings Switzerland into the 22nd century, in 2017. Initiated by Marc Walder, digitalswitzerland aims to make, create and innovate through five key objectives: reworking the Swiss political framework, developing talent and education, enabling a startup culture in Switzerland to thrive, fostering digital thought leadership and engaging the public. By working with key politicians in Berne, notably Federal Councilor Johann Schneider-Ammann (FDP/ PLR/PLD), digitalswitzerland wants to provide solutions to issues relating to the digitalization of industries, like the sharing economy, immigration and enabling students to engage with Science, Technology, Engineering and Mathematics (e.g. STEM) in the educational curriculum. Nicolas Bürer is optimistic about the future.

When you look at where Switzerland was 10 years ago, we have achieved so much. These topics are on the agenda now, and the politicians in Berne realise that we have to come with solutions to these real problems.

How can Switzerland attract top talent when the current immigration system is so restrictive? Immigration, Bürer notes, is one of the biggest obstacles facing Switzerland in the future. Attracting talent within Europe is a short-term goal of digitalswitzerland, while creating a framework that can attract talent and capital from the Americas and Asia-Pacific in their long-term vision.

What would be your top advice to those who want to create a startup in Switzerland? Look at the environment first, and try to connect with those that are in a similar position to yours. Switzerland is becoming well known for Basel in biotech, Geneva in cyber security, Zurich for fintech, Zug for blockchain and many others besides. Take advantage of the resources that are on offer here by relying on specialists, when you can, while you concentrate on core business.

The growing tendency of deploying employees abroad, as well as the global interconnectedness among firms, forces thousands of workers to travel abroad for brief or extended periods of time every single year. With any trip abroad, there are new customs, traditions, modes of behaviour and communication standards, all of which must be observed. If you interact with international business partners or head up an international team, it is important that you familiarize yourself with the various modes of behaviour.

Technical and linguistic proficiency alone do not suffice No matter where a professional assignment abroad takes you, being well prepared is essential to better understand the country, culture and its people. Between greeting someone and saying goodbye, there are a myriad of social pitfalls to contend with, as values and conduct standards can vary widely from country to country. Be it with time, quality, hierarchies, respect, communication or etiquette, your own expectations can differ greatly from the reality of country-specific conduct norms.

The right greeting unlocks many doors A cordial greeting is always essential. While your own greeting customs are familiar, you will encounter unfamiliar greeting rituals in many countries. Typically, it is normal to approach the host openly and amiably, no matter how complex a country-specific

greeting seems. Dealing with unfamiliar situations in a calm and relaxed manner aids you in establishing a solid contact. In contrast, intrusive and overbearing behaviour can cause misunderstandings. Openness, attentiveness and curiosity are helpful traits to unlock the proverbial door in any situation.

A guest among strangers No matter what your position abroad, you are always a guest. When speaking with foreign partners, it is always appropriate to conduct yourself in a collegial, direct, yet friendly manner. This helps you discuss your position, the tasks and goals required to ensure the success of any project. It is of little help and indeed often counter-productive to comment on or judge the politics, religion and society of the country you are in.

Characteristics from East to West Russia - If you have been to Russia, for example, you have surely encountered the warm and enthusiastic joie de vivre. Mirroring the intensity of a typical Russian greeting and its firm handshake is the intensity found on the job itself. Russians can be a loud bunch at work, so it is no surprise that they often speak openly and directly about the job itself. In Russia, on-the- job performance is what counts.

USA - Americans like to speak about success. If they can, they’ll flaunt it, too. In the job world, specialists are highly sought after. A friendly exchange with a difference of opinion is commonplace.

Asia - In Asia, rules and customs differ

to China. It is especially important to not only familiarize yourself with the customs of your host country, but to accept them as well. Not talking about your feelings at work is as essential as it is to be diligent on the job.

France - Customs in Europe are also not the same everywhere. The French, for example, place a great deal of importance on friendly and open interaction, but are very casual when it comes to work and free time. Punctuality is not as important as it is in Austria or Switzerland. For the French, external appearances are more important — from fashion and fine food to classy social interaction. Greetings and goodbyes are typically warmer and a peck on the check is standard for close colleagues — which also applies to most Mediterranean countries in Europe, and many regions in southeast Europe.

Mandatory basic health insurance The mandatory basic health insurance provided by all health insurers covers exactly the same benefits. Some insurance companies also offer attractive models on a pick-and-mix basis, such as telemedicine or the choice of a family physician. Such

a choice is usually rewarded with a lower premium. Basic health insurance can be changed every year with one month’s notice. And your new insurer is obliged to provide its basic health insurance to you. The premium is determined solely based on the insurer selected, your place of residence and the amount of the deductible selected.

Supplementary health insurance In Switzerland, basic health insurance already covers the vast majority of treatments. Nonetheless, supplementary insurance may make sense if you

have any additional wishes or needs that are not covered by basic health insurance. There are numerous options that are combinable in different ways from insurance provider to insurance provider. The Swiss health care insurance system is very extensive, which is why we strongly recommend that you get personally advised. Klöntalersee There’s a lot to like on this easy stroll along the Klöntal Lake near Glarus south of Zurich. It’s a short but winding drive from the valley to this gorgeous alpine lake surrounded by mountain peaks. There’s a walking path along the west side of the lake, where we enjoyed shuffling through the fallen leaves in the forest. The kids loved gathering wood to build a fire on the lake shore.

Bachalpsee This spectacular view of the Bernese Alps over the lovely Bachalp Lake is one of the most photographed locations in Switzerland. The beautiful contrast of harvest colours and light dusting of fresh snow above us was so charming.

Before heading on the trail, don’t miss the thrilling cliff walk at the top of the chair lift. Then it’s an easy hour on the obstacle free path to the lake, a perfect place for a picnic while the kids skip rocks.

Gorges de l’Areuse This walk through the Areuse gorge in north-western Switzerland is a good choice when higher elevations are covered in clouds or early snow storms. The path takes you through forests and meadows along a river, with several narrow sections bordered by dramatic cliff walls. It’s a bit long at 11 km but mostly downhill and easy walking; we saw many families with little kids happily skipping along this one.

Tips Hiking in fall has a few considerations. This is a time to pack extra layers, check the weather carefully, and have a Plan B. Better safe and warm, than sorry and shivering. Always check resort websites and trail conditions before heading out. Many mountain resorts and alpine towns have special fall festivals, particularly the Alpinabzug, where they bring the cows down the mountains to the valleys for winter. So check the event calendars to coordinate your hike with one of these events.

WATER, WHAT ELSE? Drink water and unsweetened tea to quench your thirst. Water is by far the healthiest thing you can get in liquid form. It is not so important whether it is the flawless Swiss tap water or natural mineral water and moderate amounts of coffee cannot hurt either. What about coffee? Drinking moderate amounts of unsweetened, black coffee will not lead to health issues if you have the tolerance for it. Coffee is a natural product with healthy qualities. Smoothies, best made only from fresh fruits or vegetables, can be an alternative. Freshly squeezed fruit juice, however, I recommend only as a treat and not as a real alternative, since the most valuable ingredients of the fruit is lost during squeezing. Most of the finished product juices, often wrongly advertised as healthy, are made from fruit concentrate and are, in principle, nothing else than sugar water with fruit flavor. Some orange juices, for example, contain even more sugar than soda! Alcoholic beverages are ultimately true calorie bombs and stop the fatburning process. For these and other health related reasons, you should only moderately enjoy alcoholic drinks.

ABOUT STEEVE PARTOUCHE In the case of cohabitation or patchwork families, Steeve Partouche recommends analysing your pension situation and clarifying your actual needs in detail. Although Switzerland has a good social system, the regular social security insurances don’t usually provide sufficient protection for survivors in such cases.

Essential points to consider The unmarried partner in Switzerland who has very little or no income of their own is not sufficiently protected if something were to happen to him/her or to the main earner.

I f the main earner should die 1st pillar: no benefits for the partner, but a pension is paid for their own children.

2nd pillar: the benefits must be clarified (minimum period of cohabitation 5 years, actively protect the partner, etc.).

If something happens to the partner s a homemaker, the partner A is performing an unpaid job. If incapacitated due to illness or in case of death, new arrangements for childcare would be necessary, which usually involve considerable costs.
