The Texas Public Information Act sets down a very clear and precise legal process the people must use to make a request for public information valid. The same law also sets down just as clear and precise a process for a government body to follow if seeking an attorney general opinion to keep that requested information secret. In the case of five formal Freedom of Information requests presented by the BRAND to SJWA on Jan. 7, the district has apparently failed to abide by law in either adhering to mandated timelines on responding to the request, filing an appeal or appeals on the requests, or providing legally required notification and copies of that appeal to requestors. As of Friday, no appeals from SJWA had been filed with the Texas Attorney General’s Office, according to officials with the AG’s Public Information Division (PID). Section 552.301 of the Texas Public Information Act is clear on the process a government must undertake to make “Request for Attorney General Decision,” as the section is titled, pertaining to written request for records. Section 552.301(e) specifically sets down what a government must submit to the AG no later than the 15th business day of receipt of a written request, which in SJWA’s case with the BRAND will be Monday, Jan. 28. According to law, “written comments” stating why the records should be kept secret, copies of the written request(s) for information, evidence to establish date of receipt of requests, and copies of the information requested must all be submitted by the governmental body in its appeal. submitted to the Attorney General as part of the appeals process – with the exception of the requested material, which can be redacted – must be forwarded to the requestor. With those criteria met, according to AG PID officials, an appeal is deemed valid and formally filed. Once an appeal to an FOI request is filed, the Attorney General has a maximum of 45 days to render a decision. However, caveats in the Public Information Act could shorten that timeline considerably. “If a governmental body does not request an attorney general decision as provided by Section 552.301 and provide the requestor with the information required by Section 552.301(d) and (e-1), the information requested in writing is presumed to be subject to required public disclosure and must be released unless there is a compelling reason to withhold the information,” Section 552.302 of the Public Information Act reads. Based on how law reads, SJWA has apparently violated the conditions of Section 552.301 by not providing an appeal “as provided” by law and not

when we get it. Unfortunately now all we can do is wait. Section 552.302 of the law provides that if Section 552.301 is not followed, then the requested information is presumed public and must be disclosed. If SJWA’s appeal is valid, the Attorney General has a maximum of 45 days to render a decision. While law appears to read that if the appeal is invalid the requested information must be immediately disclosed, opinion on that is still pending from the Texas Attorney General’s Office. SJWA has used a similar tactic in the past to delay the disclosure of public information. Last year, Hernandez refused to release meeting agendas upon request under the invalid excuse she had to receive permission from the AG to release public information. Involved in the identical FOI process, SJWA

providing copy of that to the requestor. Such violations would presumably trigger Section 552.302, where the only “compelling reason” to withhold information listed in law is in Subchapter C of the PIA, which provides legal exceptions to public information laws. Within that subchapter, 56 specific exceptions are listed – none of which are among the public records the BRAND requested from SJWA. If SJWA intends for its Jan. 17 letter to the BRAND – which said the FOI “request” had been turned over the Texas Attorney General for decision – to serve as its appeal, then it violates all requirements to be deemed a legal appeal and should therefore be invalid. An invalid appeal and no other correspondence should trigger Section 552.302, which deems the requested information public and released “in a timely manner.” Opinion from the Attorney General’s PID on a timeframe for disclosure of the information under Section 552.302 was pending as of press time Friday. PID officials have confirmed that should SJWA appeal the FOI requests, then an appeal – as prescribed by law – must be filed on each of the BRAND’s five requests.

Municipal Court amnesty being offered Hereford Municipal Court will be conducting an amnesty program from Feb. 18-March 18. During this time, police officers will not be actively serving warrants, but opportunity will be given for individuals to pay off any active warrants. Plans are for the names

received opinion from Texas Assistant Attorney General Erin Groff that not only were the requested documents public record, but the AG had no choice except to find in favor of the requestor because SJWA had not complied with the proper appeals process. In that case, agendas that are among those requested by the BRAND were ruled to be disclosed. According to the Public Information Act, that ruling provides precedent that BRAND requests for, at least, meeting agendas is valid and SJWA appeal of the request is not permitted.

DID you know? Spring cleaning is a ritual in many homes, though some might be forgetting to address an area of their homes that can be especially vulnerable to insect infestations. According to PestWorld.org, kitchen cabinets and pantries used to store spices and baking items, such as flour, can make for inviting hideouts for various types of pests. These unwelcome guests include beetles, Indian meal moths and ants. To remedy this issue or prevent insects from becoming an issue, discard stale spices or dated baking items. Once such items have been removed from the cabinets and pantry and discarded, wipe down the interior of the spaces before installing fresh shelf paper. DPS stop in Vega leads to cash seizure AMARILLO – The Texas Department of Public Safety (DPS) seized more than $289,000 in cash Jan. 15, after a Texas Highway Patrol trooper stopped a vehicle in Oldham County. At approximately 5:55 p.m., a DPS trooper stopped a 2005 Lexus GS300 traveling west on I-40 near Vega, for a traffic violation. The luncheon will take place from noon-1 p.m., at HISD Administration Building. Hereford Health Clinic medical director Dr. Trevor Rohm highlights the luncheon with a program on women’s heart health and the issues they face. Heart disease is the leading cause of death among women worldwide that many do not consider a health risk. Subsequently, risk factors are addressed. Rohm’s address will concern heart disease in women, the risk factors, and how they are different in women. Tickets for the luncheon, which will feature combination fajitas, are $15 each and must be purchased no later than Thursday, Jan. 24. Answering a rally with a fourth-quarter comeback of their own, the Hereford Lady Whitefaces were able to get past the visiting Goddard Lady Rockets from Roswell, N.M., 58-47, in non-district hardwood play Tuesday. In snapping a two-game skid, the Lady Herd won for the fifth time in the last seven games to improve to 13-14 overall on the season. “There were mistakes made and good things we did,” Hereford coach Bryan Lintner said. “Just forget about it. This game meant nothing. The most important game is [Friday’s district game] at Estacado. “The next four games need to be our best of the season. We some potential to make noise in the playoffs.” In what Lintner dubbed a “trap game” for his team against an out-of-state opponent on a bye night of the district schedule, the Lady Whitefaces flexed their muscle in the post to avoid a tumble. After Lori Arias put the Lady Herd up 32-24 with 5:09 to play in the third, the Lady Rockets flipped the switch on a half-court trap. A flurry of Lady Whiteface turnovers fueled a 16-6 Lady Rocket spurt that turned the deficit into a 4036 lead with 7:12 to play when Bailey Beene hit pair of free throws. Cooper Marsh exhibited the Grand Champion steer, a Class Two Exotic weighing 1,195 pounds, that also took Breed Champion honors. The calf was tops in a field of 26 entries. Reserve Grand Champion steer honors went to Addison Kahlich, who showed a 1,140-pound Class 1 Exotic that was Reserve Breed Champion. In the nine-entry heifer show, Cutter Pohlman walked away with both the Grand and Reserve Grand Champion ribbons and banners. The lamb show encompassed 30 entries. Johan Grotegut won Grand Champion with his 151-pound Medium Wool that was Breed Champion. Rachael Detten’s 113-pound Class 1 Southdown was Reserve Grand Champion and Breed Champion. Brad Turpen showed a Class 4 Fancy Senior rabbit that was named Grand Champion after earlier being named Breed Champion. Turpen doubled down, also taking Reserve Grand Champion honors with his Class 1 commercial junior rabbit that was also Breed Champion. Junior Showmanship honors in the steer show went to Cooper Marsh, with Caitlyn Skiles named the Intermediate Showmanship winner. Cutter Pohlman was the Senior Showmanship winner. Isaiah Alejandre won the First Year Cattle Showman award. Johan Grotegut won the Junior Showmanship award in the lamb show with Avery Detten taking Intermediate Showmanship honors. Samantha Lookingbill was the Senior Lamb Showmanship winner. The First Year Sheep/ Goat Showman award went to Harmonie Vanderwig.
