U

ntil you’re accused of a crime,

you may be blissfully ignorant of the fact that “innocent until proven guilty” may be a myth.

“It’s the opposite,” says Michelle Gesse, author of the book Bogus Allegations: The Injustice of Guilty Until Proven Innocent, whose husband Steven lived the nightmare of being falsely accused of a felony. The scary part of this story is how easily it could happen to any one of us. Of course, few people give much thought to what they should do (and not do) if they are falsely accused. But the truth is, there’s no way to know for sure what curveballs life might have in store — and it’s better to be safe than sorry. Here are some lessons that Michelle Gesse has learned: January - February 2013

Have an “arrest plan” in place Generally, people don’t assume that their homes will catch fire, but most people still take out insurance, just in case. In the same way, says Gesse, you should think through and be prepared for a possible arrest. “None of us think something like this could happen to us, but it is possible that at some point in your life you or someone you love may be arrested,” she says. “It could be your spouse, your child, or a relative. What would you do if this happened? Would

you be forearmed with any strategy or knowledge, or would you be floundering, completely at the mercy of ‘the system’? It’s a good idea to think about what you would do if you were confronted by the police at your own front door, or how you might respond if you received a phone call telling you that a loved one had been arrested.” Likewise, it is wise to have “the talk” with your kids beforehand. This particular “talk” should be about what they should do if they are ever arrested or interrogated by law enforcement officers, regardless of the reason. Be the first to call 911 The person to call 911 is going to be considered the victim, regardless of the circumstances. If you find yourself in any sort of threatening situation, don’t hesitate. Be the first to call 911. “Even though he was telling a blatant lie, Steven’s accuser was treated by law enforcement as the victim since they heard his version of the story first,” Gesse recalls. “As we learned, once you have been taken into custody, you have been classified as the perpetrator of the crime. The so-called victim will receive support from victims’ advocates, the press, law enforcement, the community, etc., while you and your family are on your own to clear your name. Being the first to pick up the phone can save you an unimaginable amount of stress, time, notoriety, and money.” Everyone involved has the right to remain silent Imagine the following scenario: Your spouse (or any loved one) has just been handcuffed and taken away from your home in a police car. You are out of your league with no idea what is going on, and you’re struggling with feelings of anxiety, panic, confusion, and fear. Meanwhile, other officers and detectives have remained at your residence. Your first instinct is to talk to them, to tell them the truth about what happened, and to prove to them that your spouse has done nothing wrong. Don’t. January - February 2013

“Even if you aren’t the person being accused of a crime, exercise your right to remain silent!” Gesse stresses. “Don’t talk to anyone without a lawyer present. In court you will be grilled by the prosecution about what you said and what you didn’t say and your answers could put doubt into the jury’s minds.” Insist on a search warrant, even if you have nothing to hide “Can we search the house?” If you know that you have not committed any wrongdoing and have nothing to hide, you may be tempted to answer this question with a “yes.” The more cooperative I am, the sooner this will be over, you reason. Maybe the officers will even see that I’m innocent, and my family will never be bothered again. “Squelch the impulse to be open and helpful, and don’t allow anyone to search your house without a warrant,” Gesse instructs. “It can tell your lawyer what the police were looking for. It’s always best to have physical documentation when you’re dealing with the criminal justice system.” Realize that the criminal justice system is not Perfect If you have ever watched one of the many television shows or movies that’s based around the legal system, you might take it for granted that the law officers, investigators, and prosecutors are going to search for the truth and examine the evidence before prosecuting. According to Gesse, — reality looks very different. “The criminal justice,” she explains, “wants to move cases as quickly as possible. They do this by negotiating plea bargains. A plea bargain is the quickest and least expensive way for them and for you to end the process. Accepting a plea bargain even to a lesser offense, however, may mean having a criminal record as well as having conditions imposed on you like alcohol testing, community service, or limits on travel. Would you be willing 26

Plan Before The Next Emergency Strikes Dwight Barnett

C

hances are that we will be affected by additional storms this winter or in the years to come. Heavy snowfalls, ice storms, floods, hurricanes and tornadoes can cause powersystem failures that leave us in the dark again. You need to be prepared for when — not if — the lights go out. What you should have on hand: • More than one flashlight and an ample supply of batteries. • A 12- to 120-volt inverter: This will come in handy to recharge batteries for the radio, cellphones and lighting. • Car chargers for your phones. • A week’s supply of wood for a fireplace or wood-burning stove. An auxiliary source of heat such as a propane camp heater can be used if there are no woodburning appliances. When the power goes off, a gas or electric furnace will not work. Close off outer rooms and concentrate the heat to one or two rooms. All gas- and wood-burning appliances produce carbon monoxide gas, a tasteless, colorless, odorless poison that can become January - February 2013

a silent killer. Open a door or window for a few minutes every hour to add fresh combustion air to the heated rooms. You should have a battery-operated carbon monoxide detector in the room with you. Also, bundling together with blankets to share body heat will reduce the energy needs of the room. • A means to protect pipes and plumbing in freezing weather. If the power has been off more than two days, you will need to provide heat to the bathrooms and kitchen to protect the sinks, bowls and pipes from freezing. If you can’t provide a heat source, shut the water off at the main supply pipe and drain the pipes by open-

ing the lowest faucet and the highest faucets in the home. Use a sponge to remove as much water as possible from the toilet tank and bowl. Drain traps may be damaged by a prolonged freeze, but they can easily be replaced. If you plan ahead, you can purchase antifreeze from an RV dealer to add to the drains’ traps to prevent freeze damage. • Enough food stored to last four to five days for each person in your home. Canned foods, including soups, can be heated on a wood burner or camp stove, but you will need that old reliable manual can opener. MREs (meals ready to eat) designed for the military can be purchased online or at military resell stores. • Plenty of fresh drinking water. According to the Mayo Clinic and the Water Encyclopedia, the minimum requirement for an adult male is 13 cups (3 liters) of water daily; a female will need an average of 9 cups (2.2 liters) daily. To be safe, you should have on hand enough drinking water for each person to have a minimum of 8 ounces of water at least eight times a day. Without water, the body will not function properly and you could succumb to the environment. Store as much water as possible in case your water is supplied by a well or if the municipal supply is not working. Fill bathtubs and sinks with water for personal use. The average bathtub holds between 40 and 60 gallons of water. The average person in the U.S. uses approximately 100 gallons of water per day. However, you can reduce water use by limiting flushing of the toilet to four times per day, which will consume a total of 6 gallons of water. Use hand sanitizers and reuse wash water in the sink. • If you have a generator or plan to purchase one, there are a few safety rules you will need to observe: A generator cannot be connected to a plug in the home or garage. Any generator for emergency backup can only be connected to the electric panel by a “transfer switch.” A transfer switch automatically January - February 2013

disconnects the home’s electric panel from the meter when the generator is in operation and then re-connects the panel to the meter and disconnects the generator when the power is restored. Never operate a gas-powered generator indoors, near a window or door or under the roof’s overhang. Exhaust fumes contain potentially poisonous carbon monoxide. The generator should be protected from rain or snow. Do not refill the gas tank while the unit is running. Consider using earplugs when working near a running generator. Use heavy-duty extension cords rated for 20 amps or more for all 120-volt equipment. Do not use more than one appliance for each outlet on the generator. When connecting the furnace to the generator, disconnect the wiring from the home’s electric panel to the furnace. When the power to the home is restored, the current could feed back through the generator and injure anyone working on the outside wiring to the home. An unsuspecting lineman could be electrocuted by your generator. When the generator is not in use, add a gasoline stabilizer, following the stabilizer’s labeled directions, and then drain the gas from the tank before storage. Use approved storage containers for the fuel and never store gasoline indoors. If you don’t want to deal with a portable generator, get a standby one, that runs on natural or propane gas. The professionally installed standby generator is part of your home systems. If power is lost at the street, a transfer switch automatically starts the generator and safely switches the electrical needs of the house to the standby system. Since this process is automatic, the only thing you’ll experience before electrical power is restored is a brief down period, usually around 10 seconds. With that in mind, while a standby generator can be a high-end item, all it takes is just a few seconds to see what a “bright” investment it can be! And don’t forget to gas up your cars! ∆

All you have to do is fire up your browser and start searching. Here are three tips on using social media to help you achieve your goal(s) . • Focus: Bigger is not always better. Often there is an inverse relationship between the size of a community and the strength of the community. Start looking within a tightly defined niche first, and then, if you need to, widen your definition until you find a group that is big enough to adequately support you. • Fit: As the saying goes, differ- 34

It sounds like a small thing, but when you head to bed after a long day, and you see those lovely linens waiting for you, you feel like a princess. Isn’t it wonderful to be at an upscale hotel or quaint bed-and-breakfast where they serve your morning coffee from a silver carafe? You can do the same thing at home! Instead of heading to the coffee pot and filling up that same old stained and chipped coffee mug you’ve used for years, make your morning caffeine ritual special. Pour the pot of coffee into a stylish urn. Purge your cupboard of every ugly mug you own, and, instead, sip from a darling china cup. Instead of pulling packs of sugar or sweetener straight from the box or pouring your creamer from the carton in the fridge, dig out that wonderful cream and sugar set you have buried back in your cupboard and put it to use every day.

This week, resolve to print your favorite photos of loved ones and display them in your home in lovely frames. Tuck one on your bedside table, another on a shelf in your kitchen and another on your desk at work. No one likes to do the dishes. But it’s more fun when you keep your dish soap in a pretty decanter. A friend used this idea to turn her laundry room, of all places, into a showplace. She put her liquid fabric softener in a crystal decanter and her powdered soap in an apothecary jar, using a silver scoop to measure it out. She placed both containers on top of her washer on a lovely silver tray. In addition, if you like to keep functional things like boxes of tissues out where they are in view, make them more attractive by finding a nice tissue-box cover. Instead of lining up unattractive bottles of cooking oil or vinegars, put them in a fun galvanized tin container so they look nicer. And take that pile of mail on your kitchen desk or table and stow it in a pretty bowl until you have time to deal with it. ∆

It seems incredibly unfair that an innocent person would have to spend thousands of dollars to prove that he has done nothing illegal,” says Gesse.

Getting a lawyer doesn’t imply guilt In fact, innocent people need the most help! But if you’re ever falsely accused of a crime in real life, you’ve never needed a lawyer more. “In my opinion, the innocent need legal help even more than the guilty,” Gesse says. “As an innocent person, you have no idea what’s going on, what to expect, or how to handle the obstacles that will be thrown in your path. You aren’t equipped to represent yourself in court. You’ll definitely need the help of an experienced professional if you don’t want to end up serving time for a crime you didn’t commit.” Don’t skimp on a lawyer If you are falsely accused of a crime and decide to proceed to trial, don’t skimp on a lawyer. This is not the time to save money. “If you go to trial, you want the best lawyer you can afford,” Gesse asserts. You’re not as alone as you think you are If you ever find yourself or a loved one falsely accused of a crime, you’ll probably feel alone and totally adrift. But keep in mind that other people have found themselves in this situation. Unfortunately, an unwarranted sense of shame keeps most falsely accused individuals from sharing their stories. Do your own research on the subject of “false accusations” and reach out to others who have been there. You will need to establish your own safety net of a very small number of individuals with whom you can confide. Be prepared for an emotional roller coaster Going to trial is financially costly and it’s brutal on your emotional reserves. Expect for everyone in the family to feel stress, fear, anger, and exhaustion on a regular basis. So cut yourself and your loved ones some slack, and be easy on yourselves. This is not the time to go on a diet or start a new job. 34

GET TO KNOW EACH OTHER FINANCIALLY You and your fiancé probably feel you know each other pretty well. But if you haven’t discussed your attitudes about money, you may still have a few things to learn. For instance, is one of you a saver and the other a spender? How do you each handle credit and debt? What about financial independence and control? These are underlying concerns that can rear up later if you don’t address them now. It may seem hard to bring these things up at first, but think of it this way: You’re not just talking about money. You’re talking about your dreams for your future together and how you can make them a reality. Do you want to buy a house? Raise a family? Travel? These all take money. January - February 2013

So, start by making a date to talk about what you each want, how you’ll prioritize your goals — and finally how you’ll work together to finance them. The rest should follow quite naturally. For instance, if you already have assets, you could decide to keep those assets separate to maintain some financial independence. If you both work and one of you makes more money than the other, agree on what percentage of your individual incomes you’ll contribute to the household that’s fair to each of you. orget the plain black dress, the simple sheath and the bare, bare leg. It’s time to take our cues from the elegant decades of the earlier part of the 20th century, just like the aristocratic Crawley ladies of the hit TV series, Downton Abbey.

The Emmy-nominated period drama has revived the Edwardian age of opulence. Watch for the third season which airs in January to be even more fashion forward as the costumes become more “art-deco” inspired. Baz Luhrmann’s “The Great Gatsby” also inspires apparel trends. The elegance of that period and the opulent formal gowns worn at dinner are a wonderful fantasy from a sophisticated time that designers want to bring this season and carry through to Spring 2013. To help you ward off tech temptations that lower productivity, here are 10 tech mistakes and some useful organizational tips. Checking social media sites at the wrong time and places You get a squirt of dopamine every time you check a social media site and have a fun exchange with a friend or colleague. However, that very thing makes you more likely to interrupt productive work to constantly check in. In short, it’s addictive. Protect yourself from the addictive side of social media and outline clear guidelines for using it. Limit yourself to five or 10 minutes tops. If you find you are having a difficult time doing this, install blocking software like Concentrate or Freedom that locks you out of social media while you are working on important tasks. Checking email compulsively Studies show that every time you interrupt a task by doing something like switching to email each time you hear the inbox alert it takes you at least 20 minutes to get re-focused on the task you abandoned. The average worker spends 1 hour 47 minutes every day on email. But the constant switching means you’ll waste an additional 96 minutes as you try to get back on task. Turning on all app notifications There’s no easier way to get distracted than setting up notifications for all of your online activities in each of your gadgets. Limit the notifications you set up to those that are truly essential, like calendar meeting reminders.

“Compassion is necessary to transform every negative emotion, but it’s particularly central to anger,” writes Dr. O. “Even though anger is loud and imposing, the quiet, calm energy of compassion, when focused, can override it.” Here are a few of Orloff’s heart-healthy strategies for defusing your anger and nurturing your compassion: WHEN YOU’RE UPSET, PAUSE AND SLOWLY COUNT TO 10 “No matter how vile someone is being,” Dr. O advises, “wait before you speak.” This is really the pause that refreshes because it offsets the adrenaline surge that comes from lashing back impulsively. Take a few deep breaths, and slowly, silently, count to 10 or more. During the lull, to relax and regroup, repeat inwardly: “Calm is beautiful.” This “mindful constraint” gives you command of the interaction so you can be pro-active instead of reactive. It also keeps you from yanking up your blood pressure and constricting your blood vessels, which can bring on a killer heart attack. TAKE A COOLING OFF PERIOD When you’re angry and upset, retreat to a calm setting to quiet your neurotransmitters and reduce your stress levels. While

Testosterone Or A Panacea T

here has been increased awareness among men of the condition of testosterone deficiency, or “Low T.” Men can now blame their chronic fatigue, insomnia, poor work performance, depression and an evaporation of libido on low testosterone levels.

This new syndrome was not developed through the effort of brilliant scientists, but by the Eli Lilly and Co. as an attempt to let everyone know how widespread testosterone deficiency is among men from age 30 on. To make the problem easier to understand and by using a nationwide campaign blitz, “Low T” is now a familiar phrase. If you have it, you are part of the in crowd who hopes to be forever young. Numerous scholarly studies have shown that in men over 45, an average of 37 percent will have testosterone levels in the low normal, but not deficient, range. Low testosterone does interfere with some critically important functions. The hormone is essential for the production of viable and healthy sperm — it plays a role in libido but not in becoming aroused or having an erection. It is not surprising then that a research study just published in the Annals of Internal Medicine showed that adding testosterone to the erectile January - February 2013

dysfunction drug Viagra in men with low testosterone did not improve the quality of the erection in any way. Testosterone also is essential for strong, healthy muscles and bones, and when deficient, can lead to osteoporosis and weakness. These symptoms generally occur in men well beyond 75 and are much rarer in men in their 60s. The nonspecific symptoms that have been ascribed, in part, to low testosterone include fatigue, reduced muscle mass and weakness, decreased sports performance, depression, increased body fat, decreased bone strength, loss of body hair, a need to shave less frequently and temporal crown baldness. Whether in a doctor’s office or at a Low T clinic, patients are begging for a testosterone shot, preferably combined with a vitamin B-12 injection, to boost vim and vigor. Because so many of the symptoms of low testosterone are nonspecific and could be caused by stress, depression, sleep disor-

ders and many other conditions, rushing to treat a younger patient with a testosterone injection or cream should be done with caution. Testosterone should not used as a panacea for more energy, better sleep habits or greater prowess on the tennis court or golf course. It should be used for the far more serious problems, such as infertility, muscle mass loss, osteoporosis and improving libido. And testosterone is not without side effects. It can lead to prostate cancer and cause the prostate to enlarge, leading to symptoms of benign prostatic hypertrophy (BPH), which causes difficulty with voiding and emptying the bladder completely. Prior to initiating treatment with testosterone, the prostate-specific antigen (PSA) test should be measured and the patient examined to define the severity of BPH. Therapy can be given as self-administered injections every two weeks. This is

the safest approach, as the materials can easily be discarded to avoid contamination of others. There are testosterone creams available that are effective and easy to use but very expensive. And if a woman, child or pet comes in contact with cream, virilization can occur. The most important positive results of treatment are improved libido, more muscle strength, less fatigue and less osteoporosis. And remember, there are significant side effects that include acne, hirsutism, male pattern baldness, seborrhea and breast soreness, priapism (a painful enlarged penis), bladder irritability, headache, virilization, liver damage and bleeding tendencies. Sadly, hormone replacement, with testosterone for men and estrogen and progesterone for women, is not the fountain of youth. In the long term, side effects are more serious than any short-term benefit. ∆

Lumbar Spine Stretch Takes Patience and Practice The moves: A lumbar spine stretch using a squat position. Works on: Spine mobility, lumbar flexibility, lowerextremity flexibility and strength. Precautions: This stretch is not for everyone! If you have a history of back injury, check with your physician before attempting this. Do not hold your breath during this activity. Setup: Stand with the feet hip-width apart. Perform a full squat with the torso coming down between the knees and the abdomen resting on the thighs. Attempt to keep the heels on the ground. Allow the arms to wrap around the outside of the knees. Allow your head to relax down toward the ground. It may take months, but the end goal of this stretch is to get the buttocks touching the heels, with the shoulders between the knees and in front of the shins. Repetitions: Starting out, perform each stretch for 30 seconds to one minute. As your tolerance builds, progress to one to two minutes. Let go and allow your body to relax into the position. Options: You can perform this stretch by holding onto something very sturdy that is about waist-high. This will assist you in coming back out of the squat if strength or balance is a problem.

Stretch Helps Ease, Curb Tennis Elbow Simple stretching can ease the pain of tennis elbow. The moves: Stretch for tennis elbow. Works on: Stretches the back of the forearm. Setup: Extend your right arm in front of you with the elbow fully extended. Turn your right hand down so your fingers are pointing down. Hold your right hand with your left hand. The stretch: Slowly pull your right hand toward you so the wrist flexes. Pull until you feel gentle stretching on top of your right forearm. Repetitions: Repeat on each side five times daily, more if you feel you need it. Hold each stretch 15 to 30 seconds. Precautions: Maintain a relaxed neck and keep your shoulders down. Options: As long as the elbow remains straight, the wrist and forearm can be rotated into many different positions to find the best stretch for you. January - February 2013

Bring one knee to the chest, loop the rope around the foot and hold a tail of the rope in each hand. Lower the foot back to the ground. Step 1: Tighten the abs and flatten the lower back to the floor. Use the rope to lift the leg until a hamstring stretch is felt. Keep the knee completely straight. Repetitions: Hold each stretch 30 seconds. Repeat five times. Precautions: Avoid this stretch if it causes pain in the lower back or knees. Do not bounce to reach further. Breathe evenly.

To Stretch a Rule Performing a sitting spine rotation can put you back in circulation. The moves: Sitting spine rotation. Works on: Stretches the lower and middle back and shoulders, and opens the chest. Improves blood flow to muscles that have been static. Setup: Sit sideways on a chair with your knees a hip-width apart. Turn your chest toward the backrest. Place the hand nearest to the chair on the backrest as far behind you as possible. Bring the other hand across your chest and hold on to the other end of the backrest. The stretch: Sit up straight and lift your chest. The chin stays aligned with the chest and level with the floor. Maintain the position of your knees so they are even with each other. Take a deep breath and, when you exhale, push with the hand and arm closest to the chair and pull with the opposite arm to rotate your chest toward the backrest. Hold for three breaths. Repetitions: Perform one repetition per side, each hour. Precautions: Do this on a chair that is high enough to allow your knees to be at or below hip height. Keep your chin aligned with your chest. Sit up straight, do not allow your lower back to slump. Options: You may vary the hand or arm position if unable to place them accordingly.

Stretch Strengthens Legs, but Start Slowly The moves: Side lunge. Works on: Strengthening the lower extremities and dynamic stretching of the groin. Setup: Start in a standing position with hands on your hips. Step: Initiate the move by taking your hips back slightly as if you were going to sit in a chair. Take a large step to the right with the leg turned slightly to the outside. Squat down over the right leg until the thigh is parallel to the floor. Ensure that the right knee is in line and directly over the ankle, not in front of it. Tighten the thigh muscles of the left leg and keep it fully straight 69 January - February 2013

odernists love cacti. These living

The gravel has a practical purpose: Cactus and succulent potting soil contains lightweight wood bits and perlite, which is white and tends to float to the surface when you fill the pot with water. The gravel’s weight keeps the perlite and woody bits securely in place. Beware of placing your cactus sculpture near direct hot air from the furnace vents. This can cause premature drying, and rehydrating by watering is risky. Don’t expose cacti to frigid air, which might damage these sensitive, heat-loving plants. A bright location with plenty of indirect sun from a south facing window is ideal. Avoid buying short-lived seasonal houseplants. Consider a cactus as a decorating accent that just gets better with time. ∆
