Ban Ki-moon suggests panel made up of many states to discover what happened, according to Netanyahu aide The UN secretary general has called for a multinational investigation of Israel’s raid on the Gaza-bound aid flotilla that left nine dead, an Israeli official said today. Ban Ki-moon has proposed the inquiry could be headed by the former New Zealand prime minister Geoffrey Palmer and include representatives from Turkey – under whose flag many of the ships in the aid convoy sailed – Israel and the US, an official from Israeli prime minister Binyamin Netanyahu’s office said. Ban’s proposal came after Israel risked a fresh wave of international condemnation yesterday by detaining a boat carrying humanitarian aid attempting to break the blockade of Gaza and forcibly diverting it to the port of Ashdod. Israel has said that most of those aboard the MV Rachel Corrie will be deported today. Ban discussed his proposal for an investigation into the first raid with Netanyahu yesterday, the Israeli official, who spoke on condition of anonymity, told Reuters. Netanyahu plans to convene senior cabinet ministers today to decide whether Israel should take part. Israeli leaders have spoken publicly about setting up an internal inquiry with foreign observers into the interception of the Turkish-flagged Mavi Marmara last week. A statement on the UN’s website said Ban held telephone discussions with the prime ministers of Turkey

and Israel on “options for moving forward with the investigation called for by the United Nations security council”. Last week, the council called for a “prompt, impartial, credible and transparent investigation”. Five days after the botched assault on a six-boat flotilla ended with Israeli troops shooting dead eight Turkish activists and one US citizen, naval commandos boarded the MV Rachel Corrie in international waters about 20 miles from the coast of Gaza. Yesterday’s operation was mounted despite growing calls for Israel to ease significantly its siege of Gaza. The US, Israel’s staunchest ally, pointedly repeated that the blockade was “unsustainable and must be changed” – a call Netanyahu again rejected. Israel said it had met no resistance in stopping the 1,200-tonne Rachel Corrie. However, Greta Berlin of the Free Gaza Movement, an organisation behind the flotilla, said passengers and crew had four times refused to accede to Israeli demands to voluntarily divert to Ashdod, resulting in the raid. “There’s no way that 20 people are going to resist a fully-armed force,” she said. “The fact that Israel boarded a civilian boat in international waters is a violent act.” She expected that the 11 passengers – including the Nobel peace laureate Máiread Corrigan – and nine crew would be treated “with kid gloves. The world is watching”. There had been no contact with the boat since early yesterday, she added. Tomorrow, Britain will say £19m in aid will be given to refugees in Gaza. The money, to be spent on healthcare, education and other services, will be

announced by the international development secretary, Andrew Mitchell. It will go to the UN Relief and Works Agency (UNRWA), on which about 70% of Gazans rely to meet their basic needs. The support comes amid heightened international concern about Israel’s blockade. The latest detention of a ship bound for Gaza came as the last of the Turkish citizens wounded in last week’s assault on the Mavi Marmara was repatriated. It coincided with a warning from the UN’s commissioner for human rights, Navi Pillay, that Israel’s embargo was illegal. “International humanitarian law prohibits starvation of civilians as a method of warfare and it is also prohibited to impose collective punishment on civilians,” Pillay said. According to Israeli military accounts, commandos boarded the Rachel Corrie – named after an activist crushed to death by an Israeli bulldozer in Gaza in 2003 – from naval vessels alongside rather than winching troops from helicopters as happened in Monday’s operation. The boat, carrying medical supplies and construction materials, was towed into Ashdod. Israel said it would unload the aid and transfer it to Gaza. The passengers – from Ireland and Malaysia – would be immediately deported, Ygal Palmor, spokesman for the Israeli foreign ministry, said. Israel has spent the past five days struggling to contain a diplomatic crisis. Relations with its regional ally Turkey have sunk to an unprecendented low. Autopsy reports on the dead activists yesterday revealed that five had gunshot wounds to the head. The US joined the growing international chorus for the siege to be eased.

TURKEY continued from page 1 antagonised 72m Turks, perhaps irreparably, over a billion of Muslims, and millions of others around the world. Israel’s use of brutal force against the aid flotilla is a clear violation of international law. The attack on Mavi Marmara took place 77 miles off the cost of Gaza in international waters over which the state of Israel has no legal entitlement. By brutally attacking and killing unarmed people, the Netenyahu-Lieberman government has committed a crime that must and will be investigated by an international court. People in the aid flotilla came from 32 different countries and included aid workers, peace activists, writers, journalists, reporters, lawyers, members of parliaments and ordinary citizens. Contrary to the claims of the Israeli propaganda machine, these people are not terrorists but aid workers and peace activists from around the world who believe that the blockade of Gaza by Israel must end to restart the peace process in the Middle East. This was a chance for Israel to show that it is genuinely interested in peace. By defending the attack and the killing of civilians, the Netenhayu-Lieberman government has shown that they have no interest in peace in the region. The aid flotilla was bringing humanitarian aid to the people of Gaza who have been suffering under a suffocating siege since the Gaza war at the end of 2008. Let’s remember that Ehud Olmert, the prime minister of Israel at the time,

had given orders for the destruction of Gaza only four days after he met the Turkish prime minister, Recep Tayyip Erdogan, in Ankara to finalise the Syrian-Israeli talks. Having lied to Turks, Syrians, Europeans and Americans all of whom were involved in the talks, the Olmert government started a war which resulted in the killing of more than 1,400 civilians with thousands injured. In the three-week war, Gaza was completely destroyed and no civilian buildings, schools, hospitals, houses of worship or even a UN building were spared. Since then, Gaza and its 1.5 million people have been living under Israeli blockade. Israel has turned a deaf ear to calls by the Obama administration and the European Union to lift the blockade in Gaza, stop settlement activities in the Palestinian territories and restart the peace talks. By defying the international community and violating international law, Israel has cornered itself both morally and politically. The international reaction to the murdering of unarmed civilians in the aid flotilla shows the extent to which the world is becoming ever more impatient with the arrogant and irresponsible policies of successive Israeli governments. While the rage over what happened in Mavi Marmara has not died down, other ships like Rachel Corrie – in remembrance of the young American student so cruelly bulldozed by the Israeli Defence Forces in Gaza 2003 while trying to stop the demolishing of a Palestinian home – were already

making attempts to challenge the blockade. The United Nations security council and the UN human rights commission condemned Israel for its action. So did scores of other states and international organizations including Nato and the Elders Group, which includes Nelson Mandela, Jimmy Carter and Desmond Tutu. Heads of states from the UK and Russia to the Arab world have called for the investigation of events and the immediate lifting of the blockade of Gaza. Israel faces a dilemma here: the siege of Gaza has not localised the reality of occupation but internationalised it. By acting in defiance and hoping that it can get away with illegal use of force against unarmed civilians, the Netenyahu-Lieberman government is turning against the whole world. I personally do not know if the Turkish-Israeli relations will ever go back to normal after what happened in Mavi Marmara. But it is clear that Israel must formally apologise to the Turkish people for its brutal killing of Turkish aid workers. An international fact-finding mission, as called for by the UN, must be immediately established to investigate the events and those responsible for the raid must be brought to justice. Finally, the blockade of Gaza must be lifted to normalise the lives of 1.5 millions Palestinians. Furthermore, Egypt must keep the Rafah gate open to let international aid into Gaza. These measures will not make us forget what happened in the early

hours of 31 May. But the mayor already has chosen sides, before plans for this mosque became public. SIOA has called on Bloomberg many times to remove Omar Mohammedi, a lawyer tied to the Hamas-linked

Council on American-Islamic Relations (CAIR), from New York City’s Human Rights Commission. Bloomberg keeps him on. And before Times Square jihad bomber Faisal Shahzad was caught, Bloomberg offered his opinion: that the would-be car bomber was probably a rightwinger who was upset about Obamacare. This is why I believe petitions to the mayor are a waste of time. But the June 6 rally will show him that he is on the wrong side of the will of the people because the people of New York know that the mayor is wrong. This mosque is not about freedom of religion. It’s about insulting America and the victims of 9/11 and establishing an international symbol for Islamic supremacism in New York. Where we are and where we need to go Caroline Glick does a brilliant job of taking stock of where Israel finds itself today and what strategies it ought to adopt to cope with the next two and a half years (at least) of dealing with a hostile government in Washington. For decades two things limited the salience of Jew hatred as a political force in the Muslim world. First, Israel’s reputation as a regional power deterred Arab states from attacking it. And second, the US’s Middle East policy of rewarding states that lived at peace with Israel and spurning those that did not made attacking Israel a less attractive option for most Muslim states. The likes of Iran and Syria were punished for their support for terrorism and their refusal to make peace with Israel. Then too, Turkey’s rise in prominence in the US in the 1990s owed a great deal to its close strategic ties with Israel. Israel’s reputation as a regional power was diminished by its 2000 withdrawal from south Lebanon and its less than stellar performances in the 2006 war. As for the US, in the year and a half since Obama took office he has fundamentally restructured US foreign policy in a manner that rewards US enemies at the expense of US allies. From Honduras and Colombia to Britain, Poland, and the Czech Republic, to Japan and India to Israel, Iraq and Afghanistan, Obama has treated US allies with contempt and hostility. At the same time, his repeated bids to woo US adversaries have rewarded the leaders of Iran, Venezuela, Russia and others for their aggression. … THIS BRINGS US to Israel’s current quandary about how to respond to the international campaign against it. Israel of course can do nothing to

change the potency of Jew hatred in the Islamic world. It can also do nothing to change American behavior. For as long as Obama is president, US foreign policy can be expected to remain on its current trajectory. That is, for at least the next two and a half years, the US will continue to play a destabilizing and hostile role in the region. What this means is that Israel should adopt a strategy that minimizes the international lynch mob’s ability to get close to it and maximizes Israel’s ability to knock the mob off balance. Take for instance the UN Security Council call for an independent investigation of the Mavi Marmara incident. Israel rightly rejected such a UN inquiry understanding that its aim is to diminish Israel’s sovereign right to self defense. On the other hand, on Thursday morning Foreign Minister Avigdor Lieberman offered that Israel could establish its own judicial inquiry and that there was no reason for international investigators not to be members of the Israeli committee. This idea is ill-advised for two reasons. First by its very nature, a judicial inquiry would place Israel in

the role of criminal defendant. And second, given the nature of the international assault on Israel, no international observers or investigators can be given any role in investigating the Mavi Marmara episode. In contrast, Israel could benefit from a domestic investigation of the operational and diplomatic aspects of its handling of the Turkish-Hamas flotilla. It is in these areas – rather than the legal areas – that Israel has failed and must learn the lessons of those failures. Moreover, appointing a committee would buy Israel time in the face of the anti-Israel campaign now sweeping the globe. And as to that campaign, it is time for Israel to launch a counteroffensive. Its representatives at the UN should demand an investigation into Turkey’s illegal sponsorship of the pro-Hamas flotilla. They should raise such protests at every UN forum and continue to protest until they are thrown out of the meetings and then return, the next day to relaunch their protests. The Justice Ministry should issue international arrest warrants against

the flotilla’s organizers and participants and prepare indictments against them for trial in Israeli courts. Israel’s embassies throughout the world should call for their host governments to outlaw organizations involved in the Gaza flotilla movement. No, these Israeli efforts will not change anyone’s vote in any UN forum. But they will place these wholly corrupt institutions on the defensive. For decades Israel has taken for granted that the UN is hopelessly hostile and left things at that. Israel’s willingness to declare defeat has emboldened UN officials. By putting them on the defensive, Israel will force them to devote time to staving off Israeli attacks and so have less time available for initiating new assaults against Israel. The pope said the death of Msgr Luigi Padovese, stabbed by his Turkish driver Thursday, “must not in any way overshadow the dialogue with Islam”. “One thing is sure, it was not a political or religious assassination”. The driver, 26-year-old Murat Altun, was being treated for psychiatric problems and reportedly told police he had a “Divine revelation” telling him to kill the bishop, according to Turkish media. Padovese, 63, Apostolic Vicar of Anatolia, was the

second Catholic priest to be murdered in Turkey in recent years after Father Andrea Santoro in 2006. “Naturally I am deeply pained by the death of Msgr Padovese, who also contributed a great deal to the preparation of the synod and would have been a precious element (in the talks in Cyprus),” said the pope, who earlier Friday received a message of condolence from Turkish President Abdullah Gul. “But we do not want this tragedy to interfere with dialogue with Islam, which will be the theme of my trip”. Referring to the synod in the Vatican on October 10-24, the pope voiced the hope it would boost both dialogue among Christians and “our common capacity for dialogue with Islam”. A Turkish prosecutor has open a case against the Israeli officials who approved the attack on the Gaza flotilla and the Turkish ship, Mavi Marmara, which left 9 Turkish nationals dead: Israel’s prime minister, defense minister and chief of General Staff are among the prime suspects in an investigation initiated by the ?stanbul Bak?rköy Prosecutor’s Office into Monday’s military operation against a Gaza-bound civilian aid flotilla that left nine peace activists, all of whom were Turkish citizens, dead. …If the prosecutor’s office can compile enough evidence against Israel at the end of its probe, it will charge Israeli officials with various crimes, including murder, injury, taking hostages, attacking Turkish citizens on the open seas and piracy. It will be yet another method by which to bring to the world’s attention the nature of the crime that Israel committed against Turkey and its citizens. This is how one builds a broader case too to appeal to the international community for accountability for Israel’s actions, insisting on the applicability of international law and the laws of war. No one issue will break the dam, but when all are pressed together then the dam may be breached. Today, brings news that a single Israeli commando killed six of the 9 who died that night. The soldier is being considered for a medal for bravery. What I hope is that my IDF veteran friends with Breaking the

Silence and Combatants for Peace will identity this individual and send him pictures of the men he killed along with their families and perhaps pictures of their dead bodies. These will include the noted Turkish photographer Cevdet K?l?çlar, whose images will break your heart, knowing he will no longer be among the us to capture, with such incredible delicacy and dignity, the faces of his subjects. They also include Furkan Dogan, the 19 year old TurkishAmerican who hoped to attend medical school. By the way, I’d like to know why the IDF found it necessary to murder a photographer shooting pictures of the scene on board, putting a bullet right between his eyes. Undoubtedly, they preferred having no documentary record of the massacre. Will we ever see the images Cevdet K?l?çlar shot that night? Perhaps we’ll even see an image of his executioner the moment before death. Or perhaps has already destroyed the evidence. Israel’s seizure of the flotilla of fools was legal under International Law For those looking for a clear and concise explanation of why Israel’s seizure of the flotilla of fools was legal under international law, I suggest reading this article by Eric Posner in the Wall Street Journal (for those without access to the site, the full article is here). The catch here is the meaning of “armed conflict.” Traditionally, armed conflict can take place only between sovereign states. If Gaza were clearly a sovereign state, then Israel would be at war with Gaza and the blockade would be lawful. If, however, Gaza were just a part of Israel, Israel would have the right to control its borders— but not by intercepting foreign ships outside its 12-mile territorial sea or contiguous zone. Gaza is not a sovereign state (although it has its own government, controlled by Hamas) and is not a part of Israel or of any other state. Its status is ambiguous, and so too is the nature of the armed conflict between Israel and Hamas. Thus there is no clear answer to the question whether the blockade is lawful. However, the traditional idea of armed conflict involving only sovereign states has long given way to a looser definition that includes some conflicts between states and nonstate actors. The international rules governing blockades attempt to balance belligerents’ interest in security and other countries’ economic interests in shipping. During war, security interests prevail. There are three narratives of the first minutes of the raid on the Mavi Marmara: one by Israel, one by the leaders of the flotilla when speaking in English, and a third one – by the people who support the flotilla when speaking in non-Western languages. The Turkish newspaper that published the pictures of the IDF soldiers today does not use the meme of ruthless IDF soldiers shooting from the helicopter and murdering civilians within seconds of landing on deck – nor do the pictures support that narrative in the least. Rather, they prove Israel’s version of events completely. Yet the Turkish press, as we had seen Friday from some of the

Arabic press, instead say how weak and ineffectual the IDF soldiers were, all but mocking them for not using lethal force initially. The newspaper notes, with glee, the fear in the soldiers’ faces captured in the photos. It discusses how the brave “humanitarians” fought the mighty IDF with sacks of onions. The article calls the soldiers “ amateurish” and “ incompetent.” To the supporters of the IHH and its partners, the IDF’s reticence in using lethal force is a clear sign of weakness, not a sign of caring about human life. This also indicates that the version of events that much of the world believes, in which the Free Gaza folks make outlandish claims like Under darkness of night, Israeli commandoes dropped from a

Interestingly, the Turkish article claims that the IDF erased these photos from the camera memory cards before returning them to their owners, and that the Turks recovered them with simple unerase software, in an attempt to hide the facts of the IDF failure. It seems equally possible that the photographers quickly deleted the photos before the IDF confiscated the cameras. In fact, as YNet notes, the IDF “ expressed its satisfaction with the Turkish newspapers’ decision to publish the photos.‘This is clear proof of Israel’s repeated claims, that the boat was carrying mercenaries, whose
