by Shira Golding Nazi Theft of Art and the Holocaust Every year Holocaust Memorial Day is marked on 27 January as an occasion for Jews to remind the world how their families were terrorized and butchered by the Nazis during the World War II. The brutality of the Nazis was not confined to the persecution of Jews but as a part of bigger conspiracy they also wanted to spoil the art of European countries. They took possession of the artworks from prominent Jewish collectors and confiscated the galleries of the dealers. The common man too lost their art treasures while fleeing from home in a bid to save their life. Those who were left were sent to concentration camp by the Nazis. This went on from 1933 till the end of World War II. However most of the art works were recovered by the Allies right after they won the war by defeating Nazis of Germany but they are still unable to trace several priceless Jewish works of art. Moreover while the war was still going on, several confiscated art works, by prominent artists were gladly taken by museums, no questions asked and others fell into dealers’ hands and were sold around the world. At present there are several authors and journalists who are trying to identify the missing Jewish art works with the sole aim of returning the priceless possessions to the families of their rightful owners. Thanks to persistent efforts of the authors who revealed the unscrupulous activities carried out by some of the museums and galleries in France, Switzerland, Netherlands, Belgium and Africa. These museums held works that had been seized from Jewish victims during the war by the Germans and never tried to find the rightful owners for thousands of unclaimed art works. And nowadays, families whose art collections were confiscated by the
Nazis are regaining the priceless art that have been found hanging in museums all over the world. Auction houses too do not want to deal in art with unclear titles because their postwar sellers may have been thieves. There are several books available in the market that provides comprehensive overviews of the Nazi theft of art and holocaust victims. New York State Urban Development Corp.>, The New York Court of Appeals (the state’s highest court) has upheld the condemnation of property in the Manhattanville area of New York City for transfer to Columbia University. This outcome is not surprising. In fact, I predicted it back in December. In the recent Atlantic Yards case, the Court of Appeals had already held that state and local officials could declare virtually any area “blighted” and thereby make it eligible for condemnation and transfer to favored private interest groups. Nonetheless, there are several extremely troubling aspects of this case. As in Atlantic Yards, The court upheld an extremely dubious “blight” condemnation by applying a rule holding that any area could be
declared blighted so long as it might be “underdeveloped.” Indeed, even the presence of “underdevelopment” (a phenomenon that occurs in almost every neighborhood at one time or another) need not actually be proven. Instead, the government need only show that there is “room for reasonable difference of opinion as to whether an area is blighted.” As the lower court opinion in Kaur pointed out, this kind of lax standard would allow the city to declare “[v]irtually every neighborhood in the five boroughs” blighted. And, as I pointed out in this post, the court’s position makes a mockery of the New York state constitution, which allows blight condemnations only in ““substandard and insanitary areas.” Even worse, the Court of Appeals in Kaur brushed aside or completely ignored extensive evidence showing that the blight study justifying the condemnations had been rigged in Columbia’s favor and that Columbia itself was likely responsible for most of the “blighted” conditions. The key “blight” study was conducted by
AKRF, a consulting firm hired by Columbia. As the lower court decision pointed out: It is critical to recognize that [the state Economic Development Corporation’s] 2002 West Harlem Master Plan which was created prior to the scheme to balkanize Manhattanville for Columbia’s benefit found no blight, nor did it describe any blighted condition or area in Manhattanville. Instead… the Plan noted that West Harlem had great potential for development that could be jump-started with rezoning. It was only after the Plan was published in August 2002 that the rezoning of the “upland” area was essentially given over to the unbridled discretion of Columbia. In little more than a year from publication of the Plan, EDC joined with Columbia in proposing the use of eminent domain to allow Columbia to develop Manhattanville for Columbia’s sole benefit. This ultimately became the defining moment for the end game of blight. Having committed to allow Columbia
to annex Manhattanville, the EDC and [Empire State Development Corporation] were compelled to engineer a public purpose for a quintessentially private development: eradication of blight. From this point forward, Columbia proceeded to acquire by lease or purchase a vast amount of property in Manhattanville. It is apparent from the record that ESDC had no intention of determining if Manhattanville was blighted prior to, or apart from Columbia’s control of the area…. Throughout this time Columbia not only purchased or gained control over most of the properties in the area, but it also forced out tenant businesses, ultimately vacating, in 17 buildings, 50% or more of the tenants. The petitioners clearly demonstrate that Columbia also let water infiltration conditions in property it acquired go unaddressed, even when minor and economically rational repairs could arrest deterioration. Zvi commented on my last Amnesty post, and elaborated on it: Amnesty has created its own contorted definition of the term “occupation,” which it applies exclusively to Israel. Where Israel is concerned, Amnesty abandons the definition of occupation as defined under international law – which it applies to every other country and conflict – and uses its own contorted definition instead. Amnesty does not apply this contorted definition to any other country or conflict, anywhere in the world.For example, Amnesty does not apply the same definition to Azerbaijan, despite the fact that Azerbaijan completely surrounds the enclave of Nagorno-Karabakh. Amnesty does not claim that Azerbaijan is “occupying” NagornoKarabakh. Amnesty did not and does not apply this definition in the Balkans, or in Yemen (where the Saudis are blockading part of the country and cutting off land borders as well) or in Iraq. Most importantly, Amnesty has never applied this definition to Israel’s Arab neighbors. in 1967, the Arab powers (Egypt, Jordan, Syria, Lebanon) cut off Israel’s access to the Red Sea in a deliberate attempt to choke Israel to death. At this time,
nearly the entire Israeli border was controlled and absolutely closed by Arab armies. Nobody has ever been insane enough to claim that at this point, Israel was “occupied” by the Arabs. In addition, the definition is bizarrely illogical. As long as a power does not close all of a region’s borders, it has no control over what comes in or goes out. It might as well have no control over any border whatsoever. Israel cannot control Gaza’s border with Egypt at all, as is clearly demonstrated by the profusion of weapons-smuggling tunnels that run across this border and the occasional demolition of the Egyptian border fence. In other words, the closure of Gaza relies in equal parts on Israeli and Egyptian actions. Amnesty’s definition must therefore be applied equally to Israel and Egypt, since there can be no closure of a territory without a complete encirclement. Thus, either Amnesty must lay responsibility for Gaza at the feet of an international anti-Hamas coalition consisting of two equal partners – Israel and Egypt – or Amnesty’s bizarre definition of “occupation” is simply another example of arrogant hypocrisy. Elder, you are absolutely right. Israel cannot fulfill the responsibilities of an “occupying power” because Israel cannot control anything that happens in Gaza. Gaza is controlled exclusively and entirely by the
Hamas regime, a bloodthirsty jihadi regime that is at war with Israel and whose ambition is not freedom but rather the genocidal slaughter of the Jews. This regime has exclusive control over all activities in Gaza. It is categorically impossible for Israel to “ensuring the welfare of the inhabitants of Gaza” – people who live under the boot of Hamas and whom Hamas holds hostage to its war against Israel – without sending in the army, occupying Gaza, and crushing Hamas. Only by occupying Gaza could Israel fulfill Amnesty’s demands. But if Israel did that, Amnesty, and every other critic of Israel, would go absolutely berserk. Amnesty is putting Israel in a position in which Amnesty will attack Israel no matter what Israel does, short of allowing its citizens to be bombed and mortared and doing nothing about it. Amnesty is doing this by fabricating a special definition for a term that has a very different legal definition. Amnesty then uses its private definition in the context of international law, where only the real legal definition may be used. In doing so, Amnesty appears to me to be guilty not only of hypocrisy and malicious mischief, but of fraud. If Amnesty’s lawyers agreed to this fabrication, then perhaps they should be disbarred. Of course, it is not only Amnesty. The UN has also called Gaza “occupied”– and “proved” it by offering an obscure footnote that,
when researched, proved the exact opposite! The commission apparently felt that no one would bother looking up the footnoted case. What we see is that even respected international agencies will subsume logic to their own bias. They “know” that Gaza is occupied, and they therefore must find – or make up – reasons after they already made that determination in their minds. Columbia may well have created much of the “blight” that justified the condemnation transferring property to the university. On the issue of the objectivity of the AKRF study, the Court of Appeals opinion claimed that the mere fact that AKRF was employed by Columbia does not disprove the validity of its conclusions, and also notes that those conclusions were validated by a later study conducted by another firm. It does not consider the evidence cited by the lower court showing that the methdologies of both studies were deliberately biased in Columbia’s favor. It is perhaps worth noting that AKRF was also the firm that conducted an equally dubious blight study justifying the Atlantic Yards takings. In that case, the blight study and takings were heavily influenced by politically influential developer Bruce Ratner, the originator of the development project in question. The Court of Appeals also makes much of claims that the Columbia project will produce important public benefits by creating jobs and other economic payoffs. However, there is little if any proof that the condemnation of these particular properties (which are only a small part of the total area where Columbia
wants to build) is actually needed to produce those benefits. Moreover, as I point out in this article, private interest groups and local governments routinely inflate such estimates because once the property is condemned, they are not legally required to actually produce the economic gains that supposedly justified the condemnation in the first place. Based on past experience, it would not be at all surprising if Columbia ultimately fails to produce more than a small fraction of the benefits it now predicts. The problem of over-broad definitions of blight is hardly limited to New York. It is present in numerous other states too, including many that have enacted post– Kelo eminent domain reform laws. Nonetheless, the Atlantic Yards and Kaur cases set a new low in this field. Not only has the New York Court of Appeals applied an extraordinarily broad definition of blight, it has also endorsed blight designations based on studies that are probably rigged in favor of private interests who benefit from condemning the areas in question. Moreover, it has opened the door to condemnations based on the presence of “blight” created by the very people who will get to own the property after it is taken. via

ESDC delayed making any inquiry into the conditions in Manhattanville until long after Columbia gained control over the very properties that would form the basis for a subsequent blight study. This conduct continued when ESDC authorized AKRF to use a methodology biased in Columbia’s favor. Specifically, AKRF was to “highlight” such blight conditions as it found, and it was to prepare individual building reports “focusing on characteristics that demonstrate blight conditions.” This search for distinct “blight conditions” led to the preposterous summary of building and sidewalk defects compiled by AKRF, which was then accepted as a valid methodology and amplified by Earth Tech. Even a cursory examination of the study reveals the idiocy of considering things like unpainted block walls or loose awning supports as evidence of a blighted neighborhood. by Whistling in the Dark Rosh Hashanah- the Prayer for Spiritual Rebirth You must be waiting for the judgment day. It’s time for the review of the last year deeds. But, we know God is kind and all our misdeeds will be forgiven. This is the essence of Rosh Hashanah. It is the Jewish New Year for people, animals and legal contracts. This is the only Jewish festival that runs for two days so that people can understand the seriousness of the occasion. It is believed that God evaluates the past deeds of his men from his golden throne. But the final judgment is not given out on Rosh Hashanah. Yom Kippur is the actual time for the same and that comes ten days after Rosh Hashana. The time span between these two festivals is popularly called “Shabbat Shuva”. This festival is not a purely merry making one. Rosh Hashana is a solemn occasion and Jewish people go for lengthy devotions on that day. It is interesting to note that men and women are assigned with different greetings. Men greet with the words ” Leshana tova tikateiv v’ technateim” whereas women greetings is “Leshana t ova tikateiv vetichatemi”. Tishri is the chosen month for the festival which is either September or October on Gregorian calendar. But this is a month of restricted rejoicing
as Jewish people have to meet their great judgment. The dusk before Rosh Hashana marks the beginning of the celebration of the festival. Jews get ready for the prayers in a very unusual way. A bath is a must in order to purify the body. Jews also get their hair cuts for Rosh Hashana. Wearing special clothes and giving out treats to the children form the basis of the customs which they follow. The aim is to caste away the sins of the last year. The traditional way to do so is to throw crumbs of breads into water after Torah verse to cast off the sins into the depth of the sea. Jews also shake their garments to get rid of their sins. Repentance goes with the sound of Shofar. The horn is made out of ram’s horn and it is blown hundred times every day of Rosh Hashana upon the command of Ha Shem. Each blow carries a different significance with it. The purpose is to remind Jews that their souls are about to enter into repentance. But this would be wrong to assume that Jews get so much tensed with the outcome of the judgment that they fail to enjoy the festival Rosh Hashana. They believe God is merciful and will definitely forgive the bad deeds. Jews carry the spirit of Rosh Hashana with a ray of hope of forgiveness. Jews take honey, apples, rice, spinach, Tzimmes and even fish for the feast. Honey was used as a sweetener in the past. It is taken on Rosh Hashana just to get a sweet new year. Honey also signifies good living
and wealth. Jews go for a mixture of apples and honey . Eating up the head of fish signifies the beginning of a year. It is also symbolic of fertility and abundance. Each year a new fruit is tasted to appreciate the fruits of the earth. Jews also thank Ha Shem for keeping them alive to enjoy the fruits. Rice stands for abundance and spinach for a new productive green year. Tzimmes is an Eastern European recipe of honey baked carrots. Jews take it as a symbol of increasing good deeds. Rosh Hashana invites all for spiritual regeneration. It is not known whether you will be punished or rewarded for your deeds but once a year we can at least try to be a good human and pray for the well being of all. Landau: We will use force to defend gas fields Last week, I noted that Hezbullah is trying to lay claim to natural gas that has been discovered off Israel’s coast, now that Israel has undertaken all of the expensive and financially risky exploration costs. This week, the Lebanese government got into the act as well, which prompted Infrastructure Minister Uzi Landau (Yisrael Beiteinu) to announce that Israel will defend its natural gas fields militarily if necessary. “We will not hesitate to use our force and strength to protect not only the rule of law but the international maritime law,” Landau was quoted as saying. Landau made his comments in reaction to the declaration of
Lebanon’s Speaker of Parliament, Nabih Berri, that the part of the gas field lies within Lebanon’s territorial waters. He continued, “Whatever we find, they will have something to say. That’s because they’re not challenging our findings and socalled occupation of the sea. Our very existence here is a matter of occupation for them. These areas are within the economic waters of Israel.” A consortium led by billionaire Yitzhak Tshuva announced June 3 that it had struck natural gas in a field called ‘Leviathan’ off the coast of Israel. The field is estimated to contain 15 trillion cubic feet of gas and is the second large scale gas find in a month. MK’s thwart international probe into flotilla of fools The Council of Europe is an interparliamentary group consisting of over 500 delegates representing 50 European countries. Israel has observer status at the council, which usually focuses on issues concerning the advancement of democracy, human rights, and the rule of law. The Council met this week in Strasbourg and was chaired for the first time by Turkey. Turkey wanted to open an investigation into the flotilla of fools incident. But the Israeli delegation managed to thwart the investigation (this may sound like a minor item, but it was the second headline on the television news magazine which I heard on the radio as I was driving back to Jerusalem from an out-of-town wedding Thursday night). Although the Turkish parliamentarian who currently holds the council’s rotating preseidency had initally hoped to establish an international probe into Israel’s acitons, the resolution ulitmately stopped short of condemning Israel, and while it criticized the continued limited blockade against Gaza, complimented Israel’s efforts to reduce the blockade and to establish an internal investigative committee of foreign observers. The parliamentary delegation was led by Kadima MK Yohanan Plesner, who worked from Tuesday to try and soften the resolution the European organization planned to pass. … “The Turks are opening another front against Israel – this time in Strasbourg, at the Council of Europe,” complained Plesner. “On Monday, they revealed – by surprise – that they wanted to hold a chain of emergency hearings on the flotilla and Gaza. Israel’s News1 site reveals that some years back Israeli intelligence apprehended an Israeli who was an agent of the former Soviet Union (which would imply that he was unmasked sometime on or before 1989). They made a deal. Instead of prosecuting him, they “turned” him and he became a double agent and fed false or misleading information to the Soviets. The article continues: The identity of the double agent, which was revealed to us, is forbidden to publish. We speak of someone well-connected and respected who travels in the highest circles and does business among them. The exposure of his identity, if and when such restriction are lifted, would almost certainly surprise many. …The decision not to arrest him or bring him to justice was made, due to the nature of the case, at the very highest level in Israel. The name of the double agent is familiar and known to be among the highest echelon. When confronted with the charge, the individual said the story was foolishness and not worth taking seriously. A non-denial denial. With stories like this it’s important to gauge who might leak the information and why. Of course, the Mossad and Shin Bet have had more than their share of bad PR over the
past few months and a story like this burnishes their image. The reporter who wrote the story, Yoav Yitzhak, has a fairly reliable reputation and uncovered the financial scandal that caused Ezer Weitzman to resign the presidency. So this story certainly deserves some credibility. News1 has provided a possible clue to unmasking the identity of the spy. It features a photo with his face removed by Globes photographer, Tamar Matsafi. The fact that Globes is a business publication and the reporter notes that the spy engaged in business deals would tend to exclude some of the most likely suspects like Avigdor Lieberman and Natan Sharansky. But it might include prominent Israeli businessmen from the former Soviet Union like Lev Leviev, Arcady Gaydamak or Leonid Nevzlin. I encourage anyone with access to Israeli photo archives to comb through them and let me know if you find prior publication of this image with the face intact. Here’s Jennifer Rubin to explain why (she calls them delegitimizers, but we’re talking about the same people): Israel’s enemies have been at this for some time. But the efforts to use international organizations to delegitimize and constrain Israel have accelerated under Obama for at least three reasons. First, he’s raised the profile of international organizations, conferred on them new prestige, elevated gangs of thugs like the UN Human Rights Council, and made clear that international consensus is near and dear to him, a priority above many other foreign policy goals. This has emboldened Israel’s foes, who now enjoy more respect and more visibility. Because Obama has put such a high price on consensus in
these bodies and on internationalizing decisions, he is handing a veto to the more aggressively anti-Israel members. Second, the U.S. has done nothing to discourage or rebut the delegitimizing. We’ve sat mutely when the UN Human Rights Council has condemned Israel. We haven’t denounced or even chastised the Israel-bashers. When Jeane Kirkpatrick or John Bolton held their
posts, you would at least see the Israel-haters’ arguments demolished and their representatives put in their place. No such defense is offered these days by Susan Rice. Tax freedom day The Jerusalem Market Research Center has announced that June 22 was Tax Freedom Day (or as this article calls it, Tax Independence Day) in Israel. If correct (and honestly, I find it hard to believe), this is a great improvement – I can recall it being in August. “Tax Independence Day” – the date Israelis stop working for the government and start working for themselves – was on June 22 this year, 25 days earlier than in 2009, and the earliest since 1990. The figure indicates that, thanks to changes in the the tax structure, salaried employees are on average paying a lower percentage of their salaries to taxes than anytime in the last 20 years. The figure was published Thursday by the Jerusalem Market Research Center. Despite the changes, Israel’s taxes are still on the high side; Tax Independence Day in the U.S. is on April 9, in Canada on May 2, and in Britain on May 30. However, Israel “beat out” several countries this year, with a lower tax burden than paid by residents of Germany (July 8). France (July 16), and Sweden (July 16).
