A bill seeking to outlaw boycotts of Israeli institutions and products – including in settlements – is diplomatically explosive A new “anti-boycott bill”, the third in a series of proposed laws that aim to curtail the ability of civil society to criticise Israeli government policy, will punish Israelis or foreign nationals who initiate or promote a boycott of Israel. The bill not only prohibits boycotts of legal Israeli institutions, but also of settlement activities and products. It seeks to impose fines on Israelis who “promote boycotts” and transfer the fines to boycotted organisations. It will impose a 10-year entry ban on foreign residents engaging in boycotts, and forbid them to carry out any economic activities in Israel. Heavy sanctions will also be imposed on “foreign political entities” engaging in boycotts. Any government promoting a boycott will be “prohibited from carrying out any action in Israeli bank accounts, in shares traded in Israel, in land or in any other property requiring registration of transfer”, and no money or property will be transferred from Israel to that government. Since the Palestinian Authority is defined by Israel as a “foreign political entity”, its recent decision to end its economic dependence on settlements for products, jobs and services will lead to punitive measures. According to the bill, even money or property due to Palestinians and to the PA by virtue of previous “laws, agreements or governmental

decisions” will not be transferred to them. The geographical application of the anti-boycott bill to the West Bank (“Judea and Samaria”) and the potential annulment of prior agreements will signal a de jure annexation of the West Bank to Israel and a final demise of the Oslo accords signed by the PA and Israel in the mid-1990s. This bill, like others recently tabled, comes against the backdrop of recent analysis by the current Israeli government and its advocates, who have sought to draw a distinction between “legitimate criticism of Israel” and criticism or campaigning that “delegitimises Israel” and is therefore beyond the pale. Alan Dershowitz has called this approach“the 80% case for Israel” – that is, the possibility of criticising specific Israeli policies, such as the settlement project, while emphatically supporting Israel as a Jewish state. Examples of“illegitimate” activities include universal jurisdiction (the prosecution of officials suspected of war crimes overseas), BDS (boycott, divestment and sanctions), and questioning the definition of Israel as a Jewish and democratic state. The recent series of proposed bills in Israel echoes each of these categories by seeking to prohibit them through law and to criminalise human rights activists who engage in such activities. This approach is deeply flawed. There is a difference between disagreeing with criticism and seeking to silence it through law. If Israel is a democracy, its activists must be allowed to voice criticism and engage in protest, however unpopular. By failing to distinguish between a

boycott of settlements and that of Israel itself, the initiators of the bill are demonstrating that they are not “protectors of Israel” but promoters of a “Greater Israel”. For them, a boycott of all Israeli products, as such, is no longer distinguishable from alternative, more limited options: the decision of Israeli or international activists to boycott settlement products in order to end the occupation, or the decision of the Palestinians themselves to stop supporting the very settlements that are denying them their sustenance. The settlers and their supporters thus expect Palestinians not only to accept the divestment of their land and resources, but also to support those who have robbed them by buying their produce and working (for subminimum wages) on the very building sites that are encroaching on their lands. The EU, also a “foreign political entity” under the Israeli definition, is likely to disagree strongly with this bill. The EU association agreements with Israel (1995) and with the PLO (1997) have a mutually exclusive territorial scope: the EC-Israel agreement applies to the territory of the state of Israel, whereas the ECPLO agreement applies to the territory of the West Bank and Gaza. When challenged on the issue of settlement products from the West Bank, the European court of justice recently ruled that only the Palestinian Authority can issue origin certificates for goods originating in the West Bank. In court, the EU advocate-general was even clearer. He said that as a matter of international law, the borders of Israel are defined by the 1947 partition plan for Palestine, and any territories outside the 1947

borders do not form part of the territory of Israel for purposes of the association agreement. If the bill passes into law, the EU would qualify as a “promoter of boycott”, whereas Israel could be seen to be breaking the terms of the association agreement. Tom Terrific and Salam, the Real Deal This is another installment in the amazing adventures of Tom Terrific(aka Friedman) in Palestine, wherein our hero goes slumming through the West Bank seeking economic miracles to which he can attribute the magical touch of “Prime Minister” Salam Fayyad. Here’s one particular howler from today’s column: …If the Palestinians can build a real economy, a professional security force and an effective, transparent government bureaucracy it will eventually become impossible for Israel to deny the Palestinians a state in the West Bank and Arab neighborhoods of East Jerusalem. Can anyone tell me why in God’s name Israel will find it impossible to deny the Palestinians a state merely because they have built a working economy and political apparatus? I also find it humorous when Tom describes Fayyad as if he’s a Chicago ward-heeler: The economist-turned-politician seems more comfortable mixing with his constituents in the West Bank… Constituents? Forgive me, but in my high school civics course I was taught you had to be elected to have “constituents.” Am I missing something here or is Tom perhaps missing something? What was Fayyad ever elected to? I swear, Tom’s tooting of Fayyad’s horn makes me swear the former’s palm is getting greased by someone. You couldn’t pay a PR flack enough to produce such unrelenting upbeat propaganda. And he hasn’t just done this once, he does it several times a year. In truth, I half-wonder whether the PA is paying Tom a consulting fee of some sort. Here’s some more Tom delusion. He claims conditions in the West Bank are so excellent that “even some Gazans are moving there.” Excuse me Tom, do you realize there’s a siege underway on Gaza and that no one gets in or out without Israeli

approval, which is practically nonexistent? So the only people “moving” from Gaza to the West Bank are those Israel has permitted to do so. Tom has a truly ambitious agenda for Pres. Obama’s July 6th meeting with Bibi: The most important thing President Obama can do when he meets Israel’s prime minister, Bibi Netanyahu, on July 6 is to nudge him to begin gradually ceding control of major West Bank Palestinian cities to the Palestinian Authority… Ever the gradualist even in the face of mounting disaster, Tom goes for the lowest common denominator. I can think of many important things Obama should ‘nudge’ Bibi to do: end the siege, end the Occupation, enter final status talks. But switching from Israeli to Palestinian uniforms in a few West Bank cities is not one of them. And all of you out there who like to “dump on” Fayyad and call him “inauthentic,” Shame on You says Tom: I am struck, though, at how much Fayyadism makes some

Arabs…uncomfortable. For those Arabs who have fallen in love with the idea of Palestinians as permanent victims, forever engaged in a heroic “armed struggle” to recover Palestine and Arab dignity, Fayyad’s methodical state-building is inauthentic. Some Arabs — shamefully — dump on it… Imagine that, Arabs actually think a guy who came to power through an aborted armed coup and was never elected by anyone to anything is inauthentic! What will they think of next? I swear Tom and Bibi are in cahoots on this. The only thing Bibi is willing to concede to Palestinians is that Israel can nibble around the edges of Occupation and improve the Palestinians economy. So what tune does Tom sing? It’s the economy stupid. No, in this case it’s not the economy. It’s political power and control of land and resources. You can’t build a state or an economy without having absolute control over such things. And all Tom is doing is dealing in half measures. Oh Tom, poor Tom. You’re too little, too late. UNIFIL has been doing a capacity testing operation across southern Lebanon, to see how well it could deploy troops if needed. Some southern Lebanese protested, throwing rocks and injuring one UNIFIL peacekeeper.

Interestingly, Hezbollah protested the operation itself, saying it was a violation of UN resolution 1701 – the resolution that expanded UNIFIL responsibilities. Hezbollah is apparently considering itself to be the only army with a right to work in southern Lebanon. UNIFIL responded, saying that this was coordinated with the Lebanese army and is quite legal. Spencer: The Honor Killing of Aqsa Parvez In Human Events yesterday I discussed the recent life sentences given to the father and brother of Aqsa Parvez. They murdered her for Islamic honor: Muhammad Parvez and his son Waqas murdered Aqsa Parvez, Muhammad’s daughter and Waqas’s sister, on December 10, 2007, because she wasn’t behaving the way a good Muslim girl should. Last Wednesday, a Canadian court gave them both life sentences for this honor killing. But what is being done to stop the next Islamic honor killing in North America? Next to nothing. The Koran commands women to “draw their veils over their bosoms” (24:31). While there are varying interpretations of this among Islamic authorities, Islamic traditions attributed to Muhammad amplify this to require that a woman should cover her head in public. Muhammad Parvez was determined to force Aqsa to do so, and to make sure she conformed to other Islamic norms as well. That she didn’t, enraged him:

“This is my insult. My community will say you have not been able to control your daughter. This is my insult. She is making me naked.” Aqsa ran away from home, telling friends that Muhammad Parvez had sworn on the Koran to murder her if she did so. But on that December day, Waqas brought Aqsa home from her school bus stop. Less than an hour later she was dead. Muhammad Parvez clearly believed that by murdering his daughter he was doing the right thing from an Islamic standpoint. And he had abundant reason for getting that idea. A manual of Islamic law certified as a reliable guide to Sunni orthodoxy by Al-Azhar University, the most respected authority in Sunni Islam, says that someone who kills his child incurs no legal penalty under Islamic law. Syria in July 2009 scrapped a law limiting the length of sentences for honor killings, but “the new law says a man can still benefit from extenuating circumstances in crimes of passion or honour ‘provided he serves a prison term of no less than two years in the case of killing.’” In Jordan in 2003, the Parliament voted down, specifically on Islamic grounds, a provision designed to stiffen penalties for honor killings. Al

-Jazeera reported that “Islamists and conservatives said the laws violated religious traditions and would destroy families and values.” This is why honor killings keep happening — because they are broadly tolerated, even encouraged, by Islamic teachings and attitudes. Yet no authorities are calling Islamic leaders to account for this. The life sentences given to Muhammad and Waqas Parvez give Muslim spokesmen in Canada and the United States a new opportunity to speak out. They have a new chance to acknowledge that Islam’s shame/ honor culture and devaluation of women has created communities in which abuse of women is accepted as normal. They could call for a searching reevaluation of the meaning and continued relevance of material from the Koran and Sunnah that devalues and dehumanizes women, and call in no uncertain terms for Muslims to reject explicitly and definitively the literal meaning of such texts. They could call for sweeping reform and reexamination of the status of women in Islam. They could call upon every mosque in the West to institute classes teaching against honor killing and directly challenging the teachings and

assumptions that give it justification…. But they won’t. Read it all. by nklajn The Mitzvah of the Mezuzah – Part 2: Which Rooms Need a Mezuzah? Before setting out to buy mezuzahs you first need to calculate the quantitiy needed. In most cases, any doorframe that leads to a room requires a mezuzah. A room for this matter is a space not smaller than 2 by 2 meters, bordered by four walls. It can be a corridor, hallway, or even a storage room. Doorframes without a door (like passages between rooms, or a staircase also need mezuzahs. Toilets, bathrooms, and temporary rooms (like a sukkah) do not need a mezuzah. A storage room which is located outside the house and is not smaller than two by two meters needs a mezuzah. If the objects stored in the room are useful and people frequently enter to take them out and use them the mezuzah should be installed with a blessing. But if the storage room is very rarely opened the mezuzah should be installed without a blessing. Gates of gardens and entrances to cities and countries need a mezuzah.

The doorframe of a guard’s hut at the entrance of a house does not need a mezuzah because it is not intended for residence. Nor do an exterior staircase or an animal pen. A public bathhouse doesn’t need a mezuza but a dairy barn, a chicken coop, a granary and a wine cellar do need. But some claim they don’t. A house or a garden where a non Jew is also living does not need a mezuzah. Horizontal doors set into the floor leading to a cellar do not need a mezuzah, only vertical, standing doors. A house rented overseas, during a period of less than 30 days, does not need a mezuzah. ‘Thousands’ protest for ‘Palestinian’ rights in Lebanon The true tragedy of the ‘Palestinians’ is not that they left their homes in Israel 62 years ago, whether voluntarily or involuntarily. The true tragedy is that 62 years later they are largely still in refugee camps because the Arab countries are holding them hostage in the hope of sending them back to what is now Israel. Compare that to Israel, which absorbed more than 800,000 Jewish refugees who were expelled from Arab countries in the 1950’s and 1960’s. Each Arab country has its own way of making sure that the ‘Palestinians’ who live in that country never feel at home. In Lebanon, that is done by excluding them from work in nearly every profession. On Sunday, there was a protest in Beirut to demand basic rights for the ‘Palestinians’ who live in Lebanon. After 62 years, could they be waking up? “As Palestinians in Lebanon we have no rights. We just want to live with dignity,” said Palestinian Imtithal Abu Samra, 29, who lives in the Beddawi refugee camp in northern Lebanon. Some 425,000 Palestinians are registered as refugees in Lebanon by UNRWA, the U.N. agency responsible for Palestinian refugees. Many live in 12 camps across Lebanon in conditions the U.N. has described as deplorable and appalling. Palestinians in Lebanon are barred from working in dozens of professions and are generally paid lower wages than their Lebanese counterparts when they do find jobs. The Palestinian Authority Court of First Instance on Tuesday sentenced a Palestinian man to 10 years imprisonment on charges of selling land to Israel. The accused, identified only by the

initials AF, 44, from Qalqiliya in the occupied West Bank, was convicted in accordance with the 1960 article 144 of the penal code number 6. AF’s original sentence was reduced from 15 years to 10 years with manual labor. Selling land to Israeli settlers is considered collaboration with an enemy state under the law and in Palestinian society, which deems such transactions detrimental to Palestinian national aspirations. And they call Israel an apartheid state? I suppose that the guy should be

thankful that for now he’s not being executed. National Review gets it right: In 2007, he came to the U.S. and applied for asylum. Common sense indicates that our material-support rules don’t apply to support that’s provided — at the behest of a U.S. ally — within a broader attempt to bring down a terrorist organization.

If Yousef returns to the West Bank, he risks execution. Obviously, DHS doesn’t believe he’s a threat, or it would detain him; in fact, the FBI has advised DHS that Yousef is not a threat. He has converted to Christianity and has become vocal critic of Islam. Yousef has a hearing tomorrow at which a judge will decide on his appeal for asylum. This shouldn’t be a complicated call for the judge or anyone else — Yousef deserves asylum. If our immigration system can’t distinguish between him and a true terrorist, it’s more witless and perverse than even we imagined. Someone on Twitter actually asked me why Israel doesn’t give Yousef asylum. I said it was Yousef’s choice to live in the US. If you had the choice between living 9 miles or 9,000 miles away from people who really, really want to kill you (as opposed to all other people they’d like to kill at random), which would you choose? Monday, some 65 years after their grandfather risked his life to save Jews in Bulgaria, Jasmin and Vladimir Kurtev came to Israel from Bulgaria to accept the honor of Righteous Among the Nations on behalf of their late grandfather, Vladimir Kurtev. “My grandfather fully deserves this honor,” said Jasmin Kurtev. “He is the perfect example of how each one of us has the duty to stand up against destructive political government’s wrongdoings and that we must remain human and fight for our fellow citizens.” Vladimir Kurtev was a teacher in Kyustendil who maintained strong ties with the leaders of the city’s Jewish community. Kurtev was one of four delegates who set out for Sofia to stop the deportation. The four delegates met with the Minister of Interior, Gabrovski, who denied all deportation plans. However, refusing to give up, Kurtev insisted that the edict be revoked. On telling Kurtev’s story, Chairman of Yad Vashem, Avner Shalev, described Kurtev as “a Bulgarian patriot, courageous fighter and loyal friend to the Bulgarian Jewish community”. With the help of the other three delegates, Kurtev’s courageous and determined actions succeeded in releasing all arrested Jews from old Bulgaria. “Kurtev understood that he is a part of a civic society and, therefore, it was his civic duty to put a stop to what the Germans wanted,” said Shalev. “Kurtev was a unique man who changed the course of history.”

However, shortly after World War II ended Kurtev disappeared and was killed by the Bulgarian communist authorities. PA prime minister Salam Fayyad, in his weekly radio address, spoke about the growing movement to give more rights to Arabs of Palestinian descent who are stuck in Lebanese “refugee” camps with few rights. While he said that he supported giving them more civil rights, he stopped well short of asking that they should have the rights of other refugees worldwide – the right of citizenship in the country in which one is born. Instead, he called for UNRWA to continue to perpetuate the issue of being a caretaker for them, insisting that people who have been stateless for decades remain so until a complete solution is found for these “refugees,” which he called “the core of the Palestinian issue.” He pointed out that the PLO is responsible for the political life and security in the camps, which helps explain why no Palestinian Arab leader is keen on actually helping these people/pawns and why no one is even beginning to talk about what would happen to millions of these people if a Palestinian Arab state is declared – for they certainly cannot all fit in the West Bank and Gaza. Inevitably, they would have to become citizens of Arab countries, and there is no reason why those who choose to do so today cannot start the process. Well, there is one reason: because the Arab leaders and the PA all agree that it is better to leave them as pawns rather than give them the basic right to choose what to do with their own lives. A lot of the loud complaints about Israel is a smokescreen to hide this 60 year Arab conspiracy to deny millions of people their basic rights.
