Prosecuting Ilana Hammerman for taking three Palestinian girls to Tel Aviv will foment discord and do little to protect Israelis Despite government claims to the contrary, Israel’s borders are far from impenetrable to residents of the occupied Palestinian territories. The separation wall is only 60% complete, numerous ways to circumnavigate checkpoints exist throughout the West Bank, and poorly patrolled perimeters provide any would-be terrorist with ample opportunity for security breaches. It is an open secret that thousands of Palestinian labourers illegally cross into Israel every day seeking casual work, yet if Israel’s hawkish right is to believed, the only thing preventing a new wave of suicide attacks is an iron-fist policy towards Palestinians’ freedom of movement. Such a wilful distortion of reality is behind the scandalous police investigation of Ilana Hammerman, an Israeli journalist facing prosecution for violating the “law of entry into Israel”. Hammerman’s crime was to take three Palestinian girls on a day-trip to Tel Aviv, in an act of civil disobedience intended to highlight the injustice of Israel’s military occupation of the West Bank. In a moving article for Haaretz, she wrote of their fraught experience avoiding detection at the hands of border guards and police as she ferried her quarry around the sights of Tel Aviv and Jaffa. Even though they lived a mere hour’s drive away from the coast, the girls had never once seen the sea nor walked the streets of Israel’s largest city, thanks to the heavy restrictions imposed by the IDF.

Hammerman openly acknowledges her awareness of breaking the law, seemingly prepared for the consequences of admitting to her deeds in public: “I did not do this in rash defiance, but rather after much thought. Out of a need, that has become ever more pressing in the last years, to raise certain essential issues for in-depth public discussion in Israeli society”. In her eyes, her own liberty is worth sacrificing if it assists in the struggle to bring freedom to the millions of Palestinians held captive in their West Bank cantons. Her bold actions have, inevitably, incurred the wrath of groups on the Israeli right, including the Legal Forum for the Land of Israel(LFLI) – an organisation founded to fight for settler rights during the 2005 disengagement. LFLI filed a formal complaint with Israel’s attorney general, calling for Hammerman to be prosecuted for her violation of the law, beginning a process which could result in her spending up to two years in jail. According to LFLI director general Nachi Eyal, a prominent figure in the settler movement, “she wanted everyone to know that you can take Palestinians in against the law and lie to police officers and the army. I want to send a message that no citizen in Israel can take the law into his hands and if he does they have to pay”. Hammerman is an easy and convenient target for the likes of Nachi, despite her crimes paling by comparison to the countless Israeli businesses employing Palestinians illegally on a daily basis, including employers within West Bank settlements. For others, Hammerman’s defiant gesture is a laudable stand against the Israeli government’s inequitable policies. One Israeli activist working with Palestinian youth in the south Hebron hills describes her as “one of the great Israelis of our time” for her

tireless campaigning, with others rallying support for her cause via NGO networks across the country. Should the Israeli police take the bait and haul Hammerman over the coals for her actions, she will become another martyr in the vein of Ezra Nawi, whose heavy-handed treatment by the courts galvanised activists on the Israeli left who were horrified at the political bias displayed by the domestic authorities. Prosecuting Hammerman for her tame and harmless violations will only reinforce such a view, and will do nothing to protect the security of Israeli citizens in the process. The likes of Hammerman and Nawi are vital in the fight to foster contact and communication between ordinary civilians on either side of the IsraelPalestine divide, and their work prevents even more hatred and mistrust being fostered towards Israelis than currently exists. However, portraying them as traitors and self-haters is the preferred tactic of the Israeli right, who believe that divisive, discriminatory policies are the one and only way to safeguard Jewish rights in Israel. That their tactics have failed for years is of scant importance to those at the helm of the Israeli government. Fomenting tension and discord has left Israelis in constant danger for decades, but to Netanyahu and his merry men, robbing Palestinians of their rights to give succor to ultranationalist Israelis can never be bettered as a modus operandi. Flies in the ointment like Hammerman are a minor inconvenience, but no match for the clout and conviction of the hardline elements backing Israeli irredentism at home and abroad. Whatever happens to Hammerman, there needs to be a serious reevaluation of Palestinian rights in both the West Bank and Gaza, as much for Israelis’ wellbeing as that of their Palestinian neighbours.

Highlighting the unfairness of three girls’ caged existences is a vital way to raise Israeli awareness, but unless it sparks a nationwide debate it will fail to come close to achieving its goals. Bibi dumps Dagan, top international spook (Nir Keidar) Newsweek has a fascinating article about the ongoing developments in the case of the Al-Mabouh assassination. Poland recently arrested an accused Mossad fixer when he attempted to enter the country. His arrest was requested by Germany because of the agent’s participation in a scheme to secure a passport for one of the Mossad agents who murdered Al-Mabouh. Israel has protested the arrest and asked Poland to return him to Israel and German to quash its extradition request. It will be a test of international resolve to see whether Germany and Poland have the courage of their convictions and go forward with this process. If they wish to honor the concept of accountability and national sovereignty which was violated by the Israeli “hit,” then they must not acceded to Israeli pressure. We’ll see if they do. Frankly, I’m a bit surprised that the Mossad would allow agents implicated in the Dubai assassination to return to their normal hunting grounds. Wouldn’t you think they’d keep those individuals under wraps for a time until the dust settled? To me, this is yet another mark of the Israeli intelligence apparatus’ disconnect from reality–at least reality outside Israel. The world doesn’t appreciate what the Mossad did in Dubai. England expelled the agency’s station chief. Ireland and Australia did as well. Yet Israel somehow thinks it got a wink and a nod and that the whole thing

will blow over. I don’t think that’s the case. I wonder whether the arrest of the agent in Poland may have something to do with Bibi Netanyahu’s decision, announced yesterday, that Meir Dagan, the Mossad’s director, will not be reappointed to his job. I was amused by the fact that one of the candidates being bruited about is none other than Yuval Diskin, the current Shin Bet director. It appears that beating up Israeli Palestinian citizens and criminalizing the legal political activity of Israeli Palestinian leaders stands one in good stead to become Israel’s top international spook. The passage from this article that really pricked my ears was this: Official and unofficial spy aficionados are still puzzled over why Israel would ruin its previously friendly relationship with authorities in a key Gulf emirate, and blow the identities of so many undercover operatives, just to eliminate an obscure Hamas operative. One theory gaining support among intelligence experts is that Mossad’s intent was to drug and kidnap Mabhouh, and then try to use him in a trade for Gilad

Shalit, an Israeli soldier held hostage in Gaza by Hamas. But the Israelis, according to this theory, may have overdosed their target on knockout drops. While a theory gaining support among anonymous intelligence experts doesn’t carry much journalistic weight, it is a suggestive one. It does seem especially stupid for Israel to expose half its covert ops personnel and render them unusable in future in their former capacity. Not to mention the international opprobrium that has attached to Israel for the murder, the loss of all those stations chiefs, and harm done to its relations with all the countries whose passports and citizens were abused. Not to mention the exposure of how the agency handles financing of its international ops. While Israel has a long and honored tradition of knocking off Hamas operatives, it also has a long tradition of kidnapping Palestinians and Lebanese to use as poker chips in negotiations for the release of Israeli prisoners. A statement from UNRWA said the summer camp’s guards were “physically assaulted and handcuffed,” but not injured Eyewitnesses accounts confirmed the UNRWA report, with locals saying

vandals broke into the camp and tied up security guards, then setting fire to equipment inside the facility. “It looks like serious damage,” one resident said. The UNRWA statement did not comment on the extent of the damages caused by the fire, but the agency’s Director of Operations in Gaza, John Ging noted that “the overwhelming success of UNRWA’s Summer Games has once again obviously frustrated those that are intolerant of children’s happiness.” Hamas considers UNRWA summer camps to be way too liberal, as they do not explicitly incite campers to

hate nor are they paramilitary training for a future terrorist career. That’s why they set up their own alternative camps based on the Quran and paramilitary training. we suggested a number of times that we visit Shalit. We also suggested that he be allowed to communicate with his family via letters. They refused. Hamas is a non-state party to the conflict. As such, it is not obligated to allow family visits or visits by the Red Cross, but it is obligated to make family ties possible.” If Pierre Dorbes is right, then neither Israel has to treat non-Israeli Arab prisoners as POWs. But is Pierre Dorbes correct when stating that Shalit cannot be entitled to the status of POW? BtSelem states: “Regardless of the question of the legality of the seizure or status of the person who is seized, international humanitarian law states that every person is entitled to be treated humanely and in a dignified manner by the opposing side, whatever the circumstances. Prisoners of war are entitled to a variety of other rights, among them to right to receive visits by the ICRC. Given that Shalit is entitled to the status of POW, denial of his right to these visits also constitutes a flagrant breach of international law. Moreover, the

refusal to allow visits and cutting Shalit off totally from the outside world raise the grave suspicion that he is being treated improperly, in particular regarding the medical treatment he has, or has not, received for his injury. For these reasons, the Hamas leadership, as the persons holding actual control of the security apparatuses in the Gaza Strip, has the duty to act order to bring about Shalit’s unconditional release immediately. Until his release, the persons holding him must treat him humanely and enable representatives of the ICRC to visit him.” Although it is still unclear to me on which grounds Gilad Shalit is entitled to a POW-status (as Hamas is a nonstate party), for sure the way he is being treated now is a war crime: “seizing a person (civilian or combatant) and holding him forcibly with the objective of pressuring the other side to meet certain demands is absolutely prohibited, and is considered hostage taking. This act is much more grievous when it is accompanied by a threat to kill or injure the hostage if the hostagetakers’ demands are not met.

Furthermore, breach of the prohibition is deemed a war crime, for which everyone involved in the act bears criminal responsibility. It was the second such attack in just over a month. There was no immediate claim of responsibility for the attack, but Islamic extremists have accused the main U.N. aid agency here of corrupting Gaza’s youth with its summer program of games, sports and human rights lessons for 250,000 children. The U.N.’s main competitor in running summer camps is the ruling Islamic militant Hamas movement,

rebuilt quickly. Hamas police condemned the attack and said it was investigating. Ging said the attack was the latest sign of growing levels of extremism in Gaza. He said it provides further evidence “of the urgency to change the circumstances on the ground that are generating such extremism.”… U.N. camps have been targeted by suspected Islamic extremists since their launch in 2007…. In recent months, Hamas has become increasingly assertive in trying to impose its strict version of Islam on everyday life in Gaza. However, the Islamists have also avoided open confrontation with the U.N. Relief and Works Agency, which provides services for twothirds of Gaza’s 1.5 million people. El Al Israel Airlines today inaugurated a domestic route to Eilat, with tickets starting at NIS 99 one way. Flights will be made with 136seat Boeing 737s that will depart from Ben Gurion Airport’s Terminal 1. El Al CEO Eliezer Shkedi said, “This is a breakthrough and good news for tourists entering and leaving Israel. El Al’s scheduled flight, inaugurated today for the first time, will boost the number of number of tourists, improve service, and bring the periphery closer to the center of the country to everyone’s benefit. We believe that El Al’s regular service between Tel Aviv and Eilat will substantially boost both domestic and international tourism to Eilat.” To serve Israelis and tourists making follow-on flights to El Al’s international destinations, the airline will provide shuttles between Terminal 1 and the international terminal, Terminal 3, at Ben Gurion Airport. Check-in for the follow-on flights will be carried out at Eilat Airport. To mark the first month of the

launch, El Al is offering special single-segment fares of NIS 189 based on a booklet of 14 midweek flights for residents of central Israel, and NIS 149 per segment for residents of Eilat who buy the 14midweek flights booklet El Al is not yet offering marketbreaking fares to Eilat. Although both Arkia Airlines Ltd. and Israir Airlines and Tourism Ltd. charge up to NIS 400 one-way fares to Eilat, they both make dozens of flights every day between Ben Gurion Airport and Eilat, compared with three daily flights by El Al. Yesterday, Hamas police forcibly took money from the Islamic Bank in Gaza City, claiming that they were enforcing a court order. All Gaza banks are closed today in protest. Meanwhile, Hamas had arrested Dr. Juma Al Sakka, director of public relations at the Ministry of Health in Gaza, five days ago without charge. Dr. al-Sakka’s wife and children protested, with his wife – a lawyer named Hanan – going on a hunger strike in front of Hamas’ headquarters. So Hamas beat her and arrested Hanan and the rest of the family. Good luck finding any outrage among the Western intelligentsia about these stories, the types of which happen pretty much every day.
