Hilbert Morales EL OBSERVADOR The past three-day weekend included Rev. Martin Luther King holiday in recognition of his focused advocacy for civil rights becoming universally available to all ethnic communities. An observation is that when American society thinks about Civil Rights issues, it does not include past and current efforts to allow all civil rights to be practiced and applied by all Americans: Whites (AngloSaxon), Negroes (Blacks); Mexican-Americans (Brown); Asian-Americans (Yellow); and Native Americans (Red). Whites are a definite minority when one considers the entire diverse human universe. Bring to mind that when the Founding Fathers, who all had experienced bias, bigotry, prejudice, exclusion, religious oppression, and economic hardships because of being marginalized by their Royalty and elites who made all governance decisions without really consulting the people being governed. History records the resistance of communities to the oppression of oligarchies self-interest. During the American Revolution one mantra of that era was “NO TA X ATION WITHOUT REPRESE N TAT ION ” (Boston Tea Party incident); another was “DON'T TREAD ON ME”. Over time the philosophy was developed that government, with the consent and involvement of We, The People was the best way for humanity to evolve. U.K.'s Prime Minister Margaret Thatcher said, “History developed Europe; a more humane philosophy which included all the peoples developed American Democracy.” America's Founding Fathers, were all of the Christian faith, and embedded into the Declaration of Independence and U.S. Constitution, especially its first ten amendments, collectively known as The Bill of

Rights” many Christian ideals. But, during the 1700's many Anglos believed that persons of color were less human and subjected them to slavery. Participation in governance was limited to white men who were property owners. Today, the ideal of ONE PERSON: ONE VOTE IS AN ACCEPTED NORM which is being undermined by requirements for Identity Cards coupled with gerrymandering and several suppression schemes to limit the vote of peoples of color. The Reverend Dr. Martin Luther King had a vision of a future community which was governed in a much more humane inclusive manner. His advocacy of universal civil rights is well publicized. That progress was made upon prior developments which other, less known individuals conceived and achieved. This American Democracy is still developing as a work in progress. The recent vulgar statement by Mr. Trump indicates that our society has much work to do if we are to share the wealth of this nation while living in a climate of mutual respect and inclusion which allows all of us to live enjoying peace and prosperity. From the beginning an education was highly prized and deemed an essential requirement for success. Today, the practice of religious freedom requires that all of us need to know that all major religions identify with ONE GOD who created all in this universe. And religions all have commandments. Compliance thereof is essential to having community civic order. Then, as now, certain white supremacists believed they were destined to be the leader of people of color who were thought to be less than they were. This sense of superiority is subtle, but exists while often derided. Each of us must learn to deal with its many varied practices. Segregation of school children was one such practice whereby people of color were marginalized systematically.

The historic records reveal many concerned individuals reacted to these oppressive practices with constructive action which changed things for the better. What follows are such anecdotes: “Sixteen-year-old Barbara Johns was in the belly of Jim Crow segregation, swallowed by white supremacy. God, please help me she prayed in her bedroom in Prince Edward County, Virginia. We are your children, too. Johns was distraught over the conditions she and her classmates faced at Robert Moton High School, where some classes took place in tar-paper structures. God answered her prayer with a plan. More than four years before the Montgomery Bus Boycott, JOHNS ORGANIZED A ( NON-DE S T RUC T I V E , NON-VIOLENT) STUDENT STRIKE. Arguably, the birth of the modern civil rights movement, this student strike was followed by legal actions to end school segregation, and her actions had set the stage for the landmark BROWN VS. BOARD OF EDUCATION (1954) U.S. Supreme Court decision. Barbara Johns and her classmates helped reshape the face of public (school) education in America. White and Black children would study the words “all (humans, men and women) are created equal in the same classroom. Why must God's children cry out so long before we hear them?” “For A frican-A merican children in Prince Edward County during the 1950's, there were not enough wise men and women. The few who spoke up were ignored (by the majority). FEAR is the enemy of FAITH. Rather than integrate following the 1954 BROWN VS. BOARD OF EDUCATION decision, school leaders adopted a policy called “MASSIVE RESISTANCE” which shut down public education for five years. Most whites found refuge in whites only private schools (unfairly) supported by local

and state tax dollars. More than 2,000 Black children were left without any educational options. One of those Black children was in first grade when those public schools closed. Many years later, that man had a hard time writing his name. But, he had worked two jobs. He became a preacher who refused pay (because) the Bible says, “FREELY YOU HAVE RECEIVED; NOW FREELY GIVE.” What did Prince Edward County fear? What did King Herod fear?” (Source: FORWARD MOVEMENT, January 5 & 6, 2018) A prior case was initiated during 1941: Mendez et al. Vs. Westminster School Board, Orange County, CA. The Mexican-American Mendez family had moved into a home right across the street from a school which was segregated for ‘whites only’. The school for Mexican-American children was away across town. School officials refused to enroll Mendez's kids in that for whites-only school right across the street. Five families, led by Gustavo Mendez sued Westminster School District. This case went all the way to the U.S. Supreme Court and can be googled as “Mendez vs. Westminster” (Source: Wikipedia). In 1947, the U.S. Supreme Court ruled for the Mendez family with the result that all schools within CA were desegregated. Following this ruling, school districts within all 9 Southwestern States stopped having segregated schools for African; Asian, Mexican, and Native Americans, No longer were schools for whites only! This Mendez Case provided a learning platform for judicial luminaries such as Earl Warren, Governor of California, who became Chief Justice, U.S. Supreme Court. Thurgood Marshall and Robert L. Carter had filed a "Brief for the National Association for the Advancement of Colored People as amicus curiae (i.e., ‘friend of the court') in Westminster v Mendez". Thurgood Marshall became the first African American Associate Justice, U.S. Supreme Court.

In addition, these cases initiated the rejection of separate, but equal which is now established as unconstitutional. School districts in CA had established Mexican Only Schools without any CA state law authorization, therefore these schools were no longer allowed. These cases demonstrate the effectiveness of the rule of law which must be based upon access to and equity before this nation's courts & judicial system. Gustavo Mendez is a role model in that he refused to compromise; persevered on having this case adjudicated. The Mendez family believed in helping the entire Mexican community, instead of a handful of (their own) children. Gustavo Mendez covered most of the expenses for the various witnesses who made presentations. Today many need to push back to re-establish what is right, proper, moral, and ethical in defining our core values which create our standard of living in a very diverse national population. On 02.15.2011, President Barack Obama awarded the Presidential Medal of Freedom to Sylvia Mendez, daughter of Gonzalo Mendez, lead plaintiff in this lawsuit. She, and her two brothers, Gonzalo, Jr. and Jerome, were some of the MexicanAmerican students who were denied admission to their local Westminster school, which formed the basis for this suit. Sylvia was awarded this honor for her years of work encouraging students to stay in school and to ensure that the importance of Mendez v. Westminster in American history will not be forgotten. It is upon these prior developments that Dr. Martin Luther King stood when advocating for civil rights which We, The People enjoy today... especially the right to vote. NO ES DEMASIADO TARDE PARA VACUNARSE CONTRA LA GRIPE ¿Quién está en mayor riesgo de contraer la gripe?

FDA ¿Todavía no se ha vacunado contra la gripe? No es demasiado tarde. Y todavía hay buenas razones para vacunarse. La gripe, conocida más formalmente como influenza, es una enfermedad viral grave que puede ocasionar la hospitalización e incluso la muerte. Aunque cada temporada de gripe es diferente, la gripe ha ocasionado entre 9.2 millones a 35.6 millones de enfermedades; 140,000 a 710,000 hospitalizaciones; y de 12,000 a 56,000 muertes cada año desde 2010, según los Centros para el Control y la Prevención de Enfermedades (CDC, en inglés). Los virus de la gripe se diseminan a través de diminutas gotitas de personas infectadas con gripe que tosen, estornudan o hablan. La gripe también se transmite tocando una superficie u objeto que tiene virus de la gripe. Aunque los virus de la gripe circulan durante todo el año, la actividad de la gripe alcanza su punto máximo entre los meses de diciembre a febrero, pero la actividad puede durar hasta mayo en los EE. UU.

Tips To Help You Get On Track With Your Retirement Savings: • Try to increase your contributions to your retirement savings plan every year, even if by only 1 percent. • If your employer offers matching funds for your retirement savings plan, contribute at least enough to get the full employer match. Don’t turn down free money! • Brainstorm ideas for earning money in retirement, such as turning a hobby into a source of income, or taking on seasonal parttime work. • Wait as long as you can—up to age 70 if possible—to begin collecting Social Security. access to the internet. “ The FCC ’s decision to repeal the net neutralit y r ules harms star tups, small companies and other businesses that rely on a level play ing f ield to compete,” said Super v isor Joe Simitian, President of the Santa Clara Count y Board of Super v isors. “It also hampers development of cut ting-edge Internet technolog ies, and threatens the public’s abilit y to engage in the dig ital tow n square. The Count y is commit ted to protecting this impor tant r ight.” Net neutralit y r ules prohibit broadband internet ser v ice prov iders f rom discr iminating against law f ul internet traf f ic— generally by block ing it or slow ing it dow n—for f inancial or other rea sons. In 2015, the Federal Communications Commission (FCC) issued formal r ules protecting net neutralit y. These r ules of fered cr itical protections for Count y residents, star t-ups, small and large business, and Count y government. The Count y ha s made substantial investments in systems that prov ide cr itical health, welfare and safet y ser v ices

over the Internet, and a reversal of the FCC ’s net neutralit y r ules threatens the abilit y of Count y residents to access those and other cr itical web-ba sed ser v ices. On December 14, 2017, the FCC (now chaired by Tr ump appointee Ajit Pai), announced its decision to reverse course and eliminate its net neutralit y r ules. That same day, the Count y declared its intent to f ile a lawsuit challeng ing the decision. La st Thursday, the FCC relea sed its f inal order abandoning the r ules. Today, the Count y f iled a “protective” petition for rev iew a s a precautionar y move to preser ve the Count y’s procedural r ights in the litigation. “ The FCC ’s repeal of the net neutralit y r ules is unlaw f ul and threatens the continued existence of the free and open Internet,” said Santa Clara Count y Counsel James R . Williams. “ The Count y prov ides many cr itical ser v ices to its residents through the Internet, and we w ill f ight to ensure that the FCC ’s unlaw f ul actions do not undermine access to these and other v ital online resources.”

CHILDREN’S ADVOCATES PRAISE BROWN’S PROPOSED BUDGET Suzanne Potter California News Service SACRAMENTO, Calif. -- Gov. Jerry Brown's new $131.7 billion budget is earning praise from children's advocates because of the investments it makes in supporting health and combating poverty. The budget includes $26.7 million for a voluntary pilot program to send community health workers to visit struggling families. Kelly Hardy, senior managing director of health policy at Children Now, said this program will benefit low income kids and their parents. "It really helps young families reach self-sufficiency by supporting healthy development of the kids and connecting parents to services like CalFresh and employment services," Hardy said. Gov. She said she's also glad to see that the state is committed to keeping

kids enrolled in the Children's Health Insurance Program, known as CHIP - at least in the short term - even if Congress fails to fund the federal government's share. Today is the 101st day since the authorization for CHIP expired. Congress has simply extended funding on a short-term basis while they work on a deal. Hardy said some groups are particularly vulnerable, waiting for Congress to act. "Coverage for 32,000 pregnant women and kids is at risk if CHIP funding is not extended soon," she said. "So it's just more reason for the federal government to take care of what should have been a slam-dunk reauthorization. " California enjoys a $19 billion surplus this year. Hardy said she'd like to see a larger investment in early-childhood care.

REPORT: TIPPING RULE CHANGE WOULD COST WOMEN $4.6 BILLION

SACRAMENTO, Calif. - As women's marches take place across the country this Saturday, time is running out to put in your two cents about a rule proposed by the Trump administration that a new report says could cost female workers $4.6 billion in tips a year. The Department of Labor wants to rescind Obama-era rules that barred employers from seizing their workers' tips. Researchers at the Economic Policy Institute found that the change could cost tipped workers overall $5.8 billion a year. Study co-author Heidi Shierholz says women would take 80 percent of the hit. "Tipped workers are going to see a huge hit to their take home pay, and employers will be enriched because the vast majority of tipped workers are women," she states. "Because women earn lower wages, they are far more disproportionately harmed by this rule."

"They're already paying those workers what they need to get workers in those jobs, and so if they do share any tips with workers at the back of the house, it will very likely be offset with declines in their base pay," she points out. That could become the basis of a law to stop the change - if the administration finalizes the rule.

IS THERE TRUTH TO THE NOTION THAT E-BIKES RECHARGED OFF THE FOSSIL-FUEL GRID ACTUALLY GENERATE FEWER CARBON EMISSIONS OVERALL THAN CONVENTIONAL HUMAN-POWERED BIKES? that a bicycle commute of 15 miles each way would require the rider to consume an extra 800 calories which in turn would produce almost four pounds of carbon dioxide per day (or 1,444 pounds per year). And if you charge up your bike’s battery with renewable energ y (say, from the solar panels on your roof ), fuhgeddaboudit! The e-bike wins every time.

Roddy Scheer & Dough Moss EarthTalk Well, actually, there could be… E-bike pioneer Justin Lemire-Elmore argues that e-bikes are better for the environment, at least if you compare the carbon emissions associated with producing enough extra food to fuel the rider of a standard bicycle against the emissions from coalderived electricity used to charge an e-bike. “Although counterintuitive that a vehicle fueled by something as dirty as coal can be considered clean and green, the fact is that food production is much dirtier,” reports Lemire-Elmore. “All things being equal, an electric bicycle produces 8.5 times less greenhouse gases than

a standard bicycle.” Lemire-Elmore goes on to argue that considerations of the carbon impact of the food we eat should take into account every step “ from fork to farm” including greenhouse gas emissions from creating fertilizers, operating farm machinery, delivering raw foodstuffs to factories for processing and then transporting processed goods to a f inal production and packaging facility before being once again shipped to the grocery store shelf and f inally to your pantry via the way-back of your car. In fact, the average American diet produces .005 pounds of carbon dioxide per calorie of food produced, according to researchers from the University of Chicago. LemireElmore uses this formula to assert

Of course, there’s no question that a bicycle, however it’s powered, is a far better mode of transport when it comes to environmental impact compared to any of the other choices as well—even walking. According to research by Mirjan Bouwman of the University of Groningen in the Netherlands, travelling one kilometer by bike (electric or conventional) requires approximately f ive to 15 watt-hours (w-h) of energ y, while travelling the same distance by foot requires some 15 to 20 w-h. (Meanwhile, covering that kilometer

in a train requires 30 to 40 w-h and over 400 w-h in a car with just the driver.) An e-bike needs only about 10 percent of the energ y required to power a car, and is 13 times more energ y eff icient than a typical four-door sedan and six times more eff icient than rail transit. The fact that it might be even better than riding a conventional bike when it comes to your carbon footprint might be just the impetus you need to justif y spending the extra dollars for a new-fangled “ battery-assist” bike. If everyone knew that you were being even more environmentally friendly by NOT pedaling up that steep hill, who wouldn’t go for an electric bike? And with municipalities pouring millions of dollars into improving infrastructure for bikes and new routing apps making biking safer and more fun, now is a great time to embrace the idea of a two-wheeled commute. Maybe it’ ll even convince you to get rid of that car altogether...

In our culture child molestation is the most detested of behaviors, so it is no surprise that I have had NO contact from Carlos since he was deported 10 years ago. I would not be surprised if he left Mexico and/or changed his name, as his association with child molestation puts not only himself but his family members at some risk. In 2011, I purchased Los Banos. As I was still legally married my status was noted on the title. To purchase No. Santa Ana I needed a $10,000 down payment. I had accumulated $3,000 in savings over the prior 5 years and a cousin lent/gave me the $7,000 balance. I initially filed for dissolution on March 3, 2011. I was then unaware of service by publication and attempted to locate Carlos in order to serve him. I contacted the Mexican immigration authorities to see if they could provide some assistance. That proved most unproductive. I became discouraged. When I tried to restart the matter in 2012. I was informed I had waited too long and would have to refile. I did so March 23, 2012. I then employed a paralegal service to help me. I informed the service I owned Los Banos, but was told since Carlos and I were separated when I purchased it, I didn’t have to and didn’t reference the property on any of the documents. The Judgment of Dissolution was entered on June 7, 2013. It stated there were no assets. I am now interested in selling Los Banos, but I am informed the buyer will not be able to obtain title insurance so the property is essentially unsaleable until title issues are addressed. DE PUERTO RICO A RENT: PAOLA HERNÁNDEZ Actriz de Broadway nos da detalles de su experiencia en el escenario

70’s. Y también ahora el momento del tema del transgénero y la aceptación de la persona como es. Yo digo lo que carga el show es la aceptación. No hay problema en ser lo que eres. Para ti Paola ¿qué es algo importante para ti, que te afecta a ti, o que te gusta de la obra?

Arturo Hilario El Observador Las luces brillantes, la música, y la emoción. Estos son las indicaciones de una producción Broadway, y actriz de la escena Paola Hernández lo conoce muy bien. Originalmente de Puerto Rico, Hernández ha tenido una ascensión al escenario a diferencia de otros artistas en el circuito de teatro. Tuvimos la oportunidad de hablar con ella sobre su trabajo más reciente, en la producción de la gira reciente de RENT. Ahora celebrando su vigésimo año, la producción de rock revolucionaria de los 90’s se dirige al Center for the Performing Arts de San José empezando el martes 23 de enero, hasta el domingo 28 de enero de 2018. En la siguiente entrevista, Hernández nos habla sobre cómo comenzó su carrera, y sobre cómo RENT toca a todos los que lo ven. Cómo llegaste a trabajar en Broadway y empezare en el teatro Yo soy de san juan puerto rico yo estudié mis cuatro años de universidad en la universidad de puerto rico y lo hice en relaciones públicas y publicidades, ni si quera era teatro, una vez que yo empecé a trabajar en la industria de publicidad, como que no me estaba llenando y yo siempre hacía teatro por

lo lado en puerto rico. Pero el teatro en puerto rico no es lo que se llama un “full time” es algo que todas las noches lo ensayamos, teníamos funciones cada fin de semana, no es como Broadway que un tour que estas toda la semana trabajando. Después de esos dos años de estar trabajando en publicidad yo creo que en momento de catarsis [decidí] tomar esta oportunidad. Y bueno, me fui para Nueva York y estudié dos años en conservatorio que se llama Circle in the Square Theatre y alli después de graduarme empecé a audicionar y gracias a dios en una de las primeras audiciones salí del conservatorio y inmediatamente conseguí trabajo con el musical de RENT. ¿Entonces que fue la primera obra en que trabajaste en tu vida? Si supieras que fue RENT, pero en Puerto Rico, a mis 19 años. Fue dirigida por el director Miguel Rosa. Quien diría que años después, yo diría que 7 8 años después, estoy haciendo el musical nuevamente en mi carrera profesional en los estados unidos. Pero, si fue RENT, mi primera apariencia. Qué bueno, entonces ya sabias como iba entonces la historia. Hablando de eso, ¿cómo ha cambiado la obra de RENT, que ya cumple 20 años, desde que inicio?

Fíjate que las diferencias no son muchas, cada director tiene su preferencia en lo que quieran enseñar, pero una de las cosas bonitas fue que ambos directores consiguieron fue que el mensaje es lo primordial. Nunca pensé que estuviera trabajando con el director original, con la música original, la coreografía original. Y hace 20 años atrás nunca me veía trabajando con los originales, que estuviéramos haciendo la pieza en su totalidad original. Lo bueno es que se van a lo que está pasando en hoy día y adaptamos una que otra cosa, pero aun así, la pieza como esta, los temas siempre se sienten [contemporáneos]. No importa que sean 20 anos atrás, o como lo estamos viendo en este momento. ¿Me puedes hablar sobre tu opinión de que es el contenido de la historia de RENT? Pues mira, la historia es un documental de una vida de artistas y bohemios, un grupo de amigos que se conocen. Pero también está tratando de el tema de lo que es el SIDA y eso fue algo bien dominante entre los 80’s y 90’s, y fue una enfermedad que arroto mucho en esa época específicamente. Pero además de tratar de ese tema se trata de temas de amor, pasión, de poder estar tu sabes, hoy día estamos hablando de la homosexualidad como si fuera un tabú todavía, y eso lleva desde los años 2000’s y antes de eso en los 80’s y

No sé por qué, cada número tiene su magia y cada número tiene su fanaticada. Pero en este momento me esta como que llamando mucho la atención el tema emblemático de RENT que se llama “Seasons of Love”, precisamente porque estaba empezando nuevo año. [Trata de] Como mediste el año que acaba de acabar. Pero obviamente como estamos empezando un año nuevo es esa pregunta de ¿qué vas hacer ahora? ¿Cómo vas a vivir bien tú en este momento? Porque mañana no sabes si vamos a estar. Por ahora es mi numero favorito porque son unas preguntas que indican al comienzo o indican el terminar de algo. Finalmente, muchas gracias por el tiempo que nos distes Paola. Ya cuando lleguen con RENT a San José, para los que nunca han visto, o no han visto en muchos años, ¿porque se será una buena idea salir a ver a esta obra? Yo siempre soy portavoz de ir a ver arte, y al teatro y ver la música. [RENT] es un musical completamente cantado, desde el momento que te sientas hasta que te paras, todo es música. Tiene momentos alegres y momentos tristes, es un ‘rollercoaster’, una montaña rusa de emociones. Hay momentos que uno pasa por esos momentos, o uno se identifica con este momento, o conoce a alguien que ha pasado por ese momento. Lo bueno de RENT y es algo que yo admiro del creador, Jonathan Larson, es que es basado en su vida, en las personas que lo rodeaban. Son cosas que fueron parte de la vida de él. Y el hecho que pueda transmitir ese mensaje en una manera que utiliza pequeños detalles, lo hace más personal. Y eso es lo que me gusta mucho. Es muy personal y la gente se puede identificar con RENT bien rápido. Pueden tener la experiencia de RENT en San Jose empezando el martes 23 de enero. En fechas recientes tuve la agradable oportunidad de charlar con Verónica Meza, actriz, directora y fundadora del Teatro Nahual, grupo de teatro latino del Área de la Bahía y con tres de los actores que darán vida al fabuloso melodrama “La casada imperfecta”, obra del reconocido dramaturgo mexicano, Miguel Ángel Tenorio.

Verónica, nos comentó que se siente muy entusiasmada con la puesta en escena de esta obra, que trata la vida en pareja de un matrimonio aparentemente muy feliz, pero debido a las circunstancias de la vida y a la falta de comunicación, el amor comienza a diluirse en la rutina diaria. ¿Qué sucede tras bambalinas de una relación aparentemente perfecta ante la sociedad? La obra aborda de manera sutil el tema de la violencia doméstica y la violencia psicológica,
