SETTING BOUNDARIES EARLY ON IS VERY IMPORTANT
Hilbert Morales EL OBSERVADOR Recently American society at all levels has been exposed to the fall-out of its own inability to openly and comfortably discuss its accepted sexual behavior standards necessary to deal with sexual harassments and abuses. Deep rooted cultural, philosophical, religious and social taboos must become known to prevent their being defined by those who have fetishes or are deviant. Today, human reproductive biology may be prudently managed using condoms and/or birth control (contraceptives which are steroids). Nevertheless, a taboo is practiced by many individuals who consider their personal sex life to be very private and personal. It is this taboo which hinders the ability of parents, clergy and workforce managers to do the counseling required as well as take administrative actions necessary. Society's ability to openly talk about sexuality issues has not kept up with developments and challenges. Parents, supervisors, and employees simply are not comfortable yet to openly discuss human sexual behavior in society or the workplace when it is appropriate and timely. What does become known in a fragmentary manner are the 'do not; shall not' social rules. The age of consent is generally accepted as 18 year-old but could be 16 years. A younger teenager is not considered to be responsibly capable of giving legal consent. Incest is criminal.
Prostitution, sexual slave trafficking, predatory rape; practice of fetishes, sadism and masochism are all subjects of applicable laws and regulations. One issue is: ‘WHO KNOWS THEM ALL?' For decades, promoters and advertisers have used very attractive women and sexual innuendos to sell products and services. A few years ago, the Boston Globe exposed the inability of local Catholic Diocese administrators to effectively deal with pedofilia. Pope Francis is allegedly dealing with such issues in a Chilean Diocese. During the last presidential campaign, then candidate Donald J. Trump boasted that his VIP status enabled him to grope women and get away with those disrespectful physical abusive actions. Recently, entertainment mogul Harvey Weinstein was exposed and deposed when several women publicly shared their anecdotes during which this executive used his power position, authority and influence to demand sexual favors. Women in government public service careers revealed their personal experiences being sexually abused by highly esteemed elected officials. Both Sacramento and Washington, D.C. governance officials quickly updated the personnel policies and procedures which had not been reviewed during the prior 25 years. Then, 160+ female gymnasts testified in court that one prestigious physician had violated each one of them over a 20 year period. That case resulted in the accused being found guilty, given a prison sentence of 175 years, with the court's judge (a woman) stating, “I have just signed your death warrant.” Heads are rolling at Michigan State University and U.S. Olympic Athletes management organizations. Recall the sexual harassment of young boys
at Penn State University when Joe Paterno was Head Coach. The “Me, Too” and “Times Up” movement plus two Women's Marches have created the 'crisis ambiance' wherein many women now feel enabled to openly share and talk about their personal experiences dealing with unwanted sexual harrassments. In addition, an adult woman friend recently confided in me that she and all her sisters had been 'sexually abused and violated' by their father during their teenage years. Now that he is elderly needing assisted living care, all daughters were unable to “fully trust him in anyway,” and were very leery of being alone with him when providing needed care. “What should we do?” she asked. My thoughtful suggestion: Have a joint meeting with him during which you tell him what your behavior expectations are today. Can you verbally communicate the boundaries which all of you agree upon? There is no taboo here. Finally, tell him you still care for him as your father who you want to respect, love and honor. You just do not want to be verbally or physically abused by anyone, especially a parent or relative. Afterwards, you will all experience a 'mental release' from that psychic burden you have been carrying since first abused. Being constantly on 'full alert' requires a lot of energy and prevents one from paying full attention to other activities such as learning (education) or focus on tasks at hand. The “Me, Too” and “Times Up” Movements are encouraging all women to stop being silent about inappropriate, improper and unwelcome incidences which
have been experienced. And let's include the LGBTQ cohort and men to share; to no longer suffer in silence. When all individuals who have been abused reveal their experiences, then these issues can be properly resolved while taking into consideration cultural, religious/philosophical, social, and legal perspectives. Dealing with certain individual human behaviors will be possible especially the perpetrators stand out as abusive and predatory because all have done unwelcome touching, groping, and been verbally abusive. Society's leaders must be careful not to facilitate character assassinations or make due process difficult to achieve. One deficiency which stands out is vocabulary. At different stages in a person's development there is a precise vocabulary which enables communication in a manner that permits identifying the violator while not burdening the victim with guilt feelings. It begins with parents who responsibly try to protect their children with the outcome that children do not learn essential and appropriate words for personal body parts or areas. Knowing anatomical terms is not enough because when sudden sexual groping happens, the girl (or woman) is often forced to 'react defensively'. She may later review her own behavior, including examination of clothing being worn at the time of an incident. On occasion, a girl may feel so alone, meaningless, insecure and defenseless that suicide is considered. As parents my wife and I had occasional discussions about the various stages the kids grew through. We decided to teach appropriate words for every secondary sex trait each child developed
as that trait appeared. But we did more than just that...each child was instructed to feel free to talk to us about any and all things plus the words necessary to describe the acceptable boundaries and even practiced the defensive arm, leg and body positions needed to reject unwanted physical contact. Each daughter was taught how to throw an effective punch and how to kick an abuser in the shins (causing a reflex action enabling escape). Most important was the instruction regarding being aware of one's surroundings at all times. Girls should never be alone with any male not known beforehand. Young women, especially when dating, need to be explicitly direct about her acceptable boundaries. One basic principle is to teach your kids that there is safety in numbers so always have a friend closeby. Sexuality is always present. In fact, it develops as one lives through puberty, transitional teenages, young adulthood, adulthood and finally become a senior citizen. The main purpose of setting boundaries early is to ensure that individuals know and behave as expected. With the introduction of women into the workplace interacting with men, flirting, courting, and development of serious relationships is all a very natural process not appropriate there. Being on the job requires being attentive to work being done which is why management needs to learn how to counsel and guide employees who need to defer romantic interests. But, sexual harassment issues are not addressed because of taboos and lack of vocabulary to effectively counsel. This is a deficiency which needs attention especially if we are to “define new social behavior boundaries.”

Una propuesta tóxica que busca convertir a la justa lucha de los “dreamers” en un juego de ajedrez político e ideológico donde el precio de un futuro como miembros plenos de la sociedad de Estados Unidos,
pasa por disolver la gran tradición migratoria de Estados Unidos como el gran unificador de las familias divididas, perseguidas o vulnerables. De un brochazo quedó resquebrajado el mantra de los republicanos como el partido de los “valores familiares”. Por la ciudadanía para 1.8 millones de dreamers potenciales, el presidente Trump pide 25,000 millones de dólares para el muro y la seguridad, el fin de la “migración en cadena” y de la lotería de visas, así como ninguna esperanza de regularización para los padres de los soñadores. Es entendible que el “plan” de la Casa Blanca haya detonado expresiones de decepción y frustración entre los “dreamers”, toda vez que es altamente improbable que pueda pasar la prueba de fuego de un apoyo suficiente
ni en el Senado, donde requiere 60 votos, incluidos al menos 9 demócratas, ni el Cámara de Representantes donde no está claro si sería apoyado por la “mayoría de la mayoría” de los republicanos. El apoyo a la legalización de los “dreamers” no es un tema divisivo en los Estados Unidos. Encuestas muestran consistentemente que más del 80% de los estadounidenses favorecen una salida legal para los jóvenes, incluidos más de la mitad de la población que se considera conservadora. INTEGRATED STUDENT SUPPORT PROGRAMS ARE CLOSING EDUCATION GAPS
New study finds growing evidence for model that supports the whole child A new Child Trends report, Making the Grade: A Progress Report, finds growing evidence for a rapidly expanding approach to educational achievement known as integrated student supports (ISS). This school-based approach to promoting students’ academic success provides support for the whole child, addressing both academic and nonacademic barriers to achievement. “Although the high school graduation rate has risen over the past decade, the United States still lags other countries, and large disparities persist in academic outcomes,” said Kristin Anderson Moore, PhD, a senior scholar at
“For the first time since 2009, states have $400 million in formula dollars to support student health and safety under the Student Support and Academic Enrichment program,” said Kristen Harper, Ed.M., Child Trends’ senior policy specialist. “This report is an important resource for states as they decide how best to invest these dollars to advance education equity by building community schools, implementing wraparound supports, or embedding ISS in school accountability as a mechanism to better serve students in struggling schools.” Child Trends synthesized findings from relevant resources—including evaluations, child development research and theory, implementation reports, interviews with principals, benefit/cost analyses, and analyses using the Social Genome Microsimulation model. The report comes at a critical time for states and school districts as they begin the early stages of implementing the federal Every Student Succeeds Act, which explicitly encourages the use of ISS models. With ISS continuing to expand across the country, Making the Grade: A Progress Reportprovides educators, policymakers, and communities with access to the latest
Key Findings The report’s conclusions are optimistic about the effectiveness of ISS. • Evaluation studies find a mix of positive and null (nonsignificant) findings, but there are virtually no negative effects seen across any of the evaluations. • Several strong evaluations find support for

Cost-benefit studies and a microsimulation model that forecasts long-term outcomes both find that students’ participation in effective ISS interventions will have long-term benefits. • High-quality program implementation is important but requires the provision of adequate resources. Top Recommendations for Policymakers, Funders, and Practitioners • Invest in implementation science as the next critical frontier for research and practice. The concrete elements that comprise successful ISS implementation is evolving slowly among researchers and educators. • Encourage studies that measure nonacademic outcomes to grow the evidence base for ISS.Nonacademic outcomes are rarely measured as part of evaluations, which limits field researchers’ understanding of the mechanisms that drive ISS success. • Provide technical assistance products and services to help practitioners align ISS implementation with other popular student support frameworks and programs, such as multi-tiered systems of support and social and emotional learning.

Netflix scammers are back—and now ‘Se habla español’
Netflix website where consumers are asked for credit card numbers, passwords and other personal information. The stolen information can potentially be used to access a consumer's financial and other accounts, particularly if they reuse passwords for different accounts, and it can be used to commit identity theft. And that's on top of the likely damper the scam will place on family movie night. As far as we can tell, the fake Spanish Netflix messages have not been widely covered, if at all, in the news or other reports about the scam. The Spanish message we received was clever in that it listed a legitimate Netflix email address in the "Reply-To" field. However, careful scrutiny revealed that it was not sent from a Netflix email address. Also, when we contacted Netflix customer service, a representative confirmed that our editor's email address was not in their system and that they would not have emailed us. Consumer Action urges consumers, including Spanish-speakers, to be aware of the latest wave of fraudulent Netflix emails and to know how to safeguard their information.

Consumer Action Organization The Netflix phishing scam is back. It was first spotted as early as a year ago, picked up steam last fall, and, as reported by cybersecurity firms MailGuard and Panda Security this month, is now back again to ring in the New Year. Consumer Action's editors were treated
to our very own copy of the phony message—in Spanish—in mid-January. As before, the phishing message tells recipients that due to problems with their payment, they must click on a link to verify or update payment information. Clicking on the link redirects consumers to a fake, but realistic,

La estafa tipo "phishing" de correos electrónicos falsos dirigidos a usuarios de Netflix está de regreso. Whether they get your password through a phishing scam or even a data breach, don't make your passwords even more valuable to crooks by using them for multiple accounts. • Use security software. Protect your computer from phishing and other online threats by installing and keeping your security software up-to-date. • Contact financial institutions. If you inadvertently give out personal and financial information to scammers, contact your financial institution to prevent or dispute fraudulent charges. • Report phishing scams. State Awards Innovative Grant to Tackle Food Waste and Hunger in Santa Clara County Silicon Valley Food Rescue to Close Gap On 125 Million Needed Meals
The Cal Recycle Grant was crafted by representatives from Joint Venture Silicon Valley, and the County of Santa Clara’s Recycle and Waste Reduction Commission. The Commission, which provides leadership for county-wide planning, works to assure the success of cooperative programs to reduce, reuse and recycle materials that otherwise would be disposed of in landfills. Joint Venture Silicon Valley will be responsible for administering the grant. “We are committed to finding innovative ways to end waste and, more importantly, end hunger within Santa Clara County,” said Supervisor Mike Wasserman, who represents the County of Santa Clara at the Recycle and Waste Reduction Commission. “We look forward to having Joint Venture Silicon Valley administer this program.” Nationally, the U.S. spends $218 billion a year growing, processing, transporting and disposing of food that is never eaten, while too many people (especially children and the elderly) go to bed hungry each night. In Santa Clara County alone, more than 200,000 people are living below the official poverty line, with one in six Bay Area residents facing food insecurity. SANTA CLARA COUNTY, CALIF.— The County of Santa Clara announced last Thursday January 25th that Joint Venture Silicon Valley (a local organization funded by the County of Santa Clara to find solutions to waste and hunger in the county) has been awarded a prestigious State of California grant for $313,000 as part of Cal Recycle's Food Waste Prevention & Rescue Grant Program.

Recycling and Waste Reduction Commission revealed that more than 34 million pounds of edible food are discarded in local landfills. With the grant, A La Carte is expected to begin serving the County of Santa Clara later in 2018, and help close the gap on the 125 million meals still needed each year. Silicon Valley Food Rescue will work with local universities, leading Silicon Valley corporations and other early partners on a desperately needed endeavor that will break down distribution barriers and increase the nutrition levels for people living with food insecurity daily.
Suzanne Potter California News Service SACRAMENTO, Calif. - Almost twothirds of babies in the Golden State are born to low-income families, according to a new report, which makes them less likely to have access to high-quality education and health care. The nonprofit group Children Now just released its 2018 California Children's Report Card, and said the state's future depends on all kids reaching their full potential. Children Now president Ted Lempert said the state still struggles with poverty, but the long-term trend is looking up. "All our grades stayed the same or went up from two years ago," Lempert said. "So the bad news is the grades are low, the outcomes aren't there. The good news is, we are making some improvement." The state got its highest grade, an A, for the levels of health insurance -
97 percent of California children are insured, including undocumented kids. One of the lowest grades, a D-plus, came in prevention of child abuse and neglect. Lempert said he's optimistic, however, that recent reforms meant to streamline the process by which a young person is removed from an abusive situation will improve outcomes going forward. The report also gave California a D-minus for access to quality child care. Lempert said that's because day care can cost more than college. "On average, full-time child care in a center is over $16,000," he said. "And very few eligible families are getting the subsidy to pay for that." The study found only 14 percent of low-income infants and toddlers are enrolled in child care. Lempert said if the state offered more child-care subsidies, more parents could return to the workforce, which would put a big dent in poverty levels.

Washington, D.C. - San Jose Mayor Sam Liccardo announced on Thursday January 25th that he had submitted his resignation from the Federal Communications Commission (FCC) Broadband Deployment Advisory Committee (BDAC), citing the pervasive and overwhelming influence of big telecom and industry interests over the body, and the predetermined, industryfavoring outcome. “When I joined this committee, I hoped that I could contribute to developing balanced, common-sense recommendations that will advance our goal of expanding broadband access for all Americans, which FCC Chairman Ajit Pai identified as his ‘top priority’ at yesterday’s meeting,” said Mayor Sam Liccardo. “It has become abundantly clear, however, that Chairman Pai and the FCC merely pay lip service to the goal of digital equity, and this body will simply serve to further the interests of the telecommunications industry over the public interest. As a result, I have submitted my resignation to the FCC Broadband Deployment Advisory Board effective immediately.” As the mayor of San Jose, Sam Liccardo joined the BDAC to propose model legislation that would help bridge the digital divide for the 34 million Americans in low-income and rural communities that lack broadband access. From the beginning, however, it appeared that the Trump Administration stacked the makeup of the committee in favor of the industry, with Mayor Liccardo as the only original city representative on the committee. Mayor Liccardo highlighted the issue, leading to pressure from the press, letters signed by 230 municipal leaders across the country,
and 14 Members of Congress, resulting in the appointment of two more city representatives. Even with that progress, three out of four seats on the BDAC are filled by industry-friendly representatives from the biggest wireless and cable companies, and their allies. “Stacking the deck” has dealt the industry a favorable hand. Over the holiday break, despite nine months of deliberations, a single industry representative completely rewrote a draft municipal code at the 11th hour, leaving municipal representatives scrambling with insufficient time to vet the hundreds of changes. That rewritten version closely resembled legislation that the industry pushed in 20 states across the country. Although BDAC participants were instructed to keep draft documents confidential, industry associations have shared drafts with over 70 of their member companies prior to providing access to members of the general public. Much of the battle focuses on fees, and whether the industry or the taxpayers must foot the bill for the industry’s infrastructure investments. While Mayor Liccardo wholeheartedly shares the goal of deploying 5G, the next generation of wireless internet, the telecom industry has used the issue to maneuver for taxpayer-subsidized pricing for access to public infrastructure in high-demand, more affluent service areas. Despite the BDAC’s stated purpose of identifying resources to improve broadband access to underserved poor and rural populations, the body did not craft a single measure that identified a new or substantial source of new funding for that purpose. Instead, the BDAC has focused on
reducing municipal fees, and eliminating local control and discretion over where and how broadband infrastructure is deployed in the public right-of-way. The industry’s claim that reducing municipal lease rates on public infrastructure will help it better serve the 34 million Americans without broadband access bears little resemblance to patterns of industry investment in low-income neighborhoods and rural areas. In his resignation letter, Liccardo observed that the industry “has sought to create a set of rules that will provide it with easy access to publicly-funded infrastructure at taxpayer-subsidized rates, without any obligation to provide broadband access to underserved residents. “ Below market rates and by-right access to public infrastructure also strip cities of the ability to hold companies accountable for building out networks to serve all areas of a city. In San Jose, telecom companies have historically underserved our Latino and low-income populations. “We must keep fighting to ensure that the growing benefits brought by broadband access reach all of our communities,” Liccardo added, “and with little hope of supportive policy emanating from the FCC, we are looking to Congress to come up with a solution and will do everything to support sensible legislation that puts the best interests of Americans first. With 20 bills introduced this year we feel confident that Congress can take this opportunity to lead. “We should all embrace the opportunity of greater broadband deployment, at better speeds, with the latest technology,” concluded Mayor Liccardo. “Yet, we have to do it in a way that puts the public’s interest first.”

The president Tuesday night bragged about appointing conservative Neil Gorsuch to the Supreme Court and filling many lower court vacancies. But Todd Cox, policy director at the NAACP Legal Defense Fund, says Trump's nominees could chip away at minority rights for decades to come. "President Trump's nominees demonstrate a breathtaking hostility toward civil rights and equal justice, and their records are rife with animus towards minority communities who depend on the courts to vindicate and protect their rights," Cox states. "President Trump is reshaping the federal courts to enable and lock in his retrograde, discriminatory policy agenda." The president also lauded the passage of the Republican tax reform bill, saying it lowers taxes on the middle class and will encourage companies to create more jobs on American soil. However, Nicole Berner, general counsel at the Service Employees International Union, says Trump's tax bill is a huge giveaway to the upper 1 percent of taxpayers, and she maintains his administration has worked hard to
repeal the Affordable Care Act even though that would cause tens of millions to lose access to health care. "Wages are stagnant and job growth has slowed to a six-year low," she stresses. "Millions of Americans work second and third jobs but continue to struggle to support their families. "And despite his cynical campaign promises, Trump has focused on helping corporations and the wealthy at the expense of working people."

In addition, the president also brought up his efforts to promote religious freedom - something Sharon McGowan, director of strategy at Lambda Legal, says is a code word for discrimination against LGBT people. "We have an attorney general who has weaponized the Department of Justice against LGBT people, a secretary of education who has tried to pull the rug of legal protection out from under transgender children and officials at the Department of Health and Human Services who have created a whole new enforcement unit to shield those who wish to discriminate against LGBT people in the name of religion," McGowan points out. Trump also proposed a deal on DACA that has been criticized by conservatives for giving Dreamers a path to citizenship, while drawing fire from Latino leaders concerned about the proposed border wall and an end to the visa lottery system.

I married Respondent (Carlos) on June 23, 1986. We separated on or about midJune 2007. There were no children of the marriage. (Los Banos) and adjudicate the parties respective interest in Los Banos as a missed asset under Family Code § 2556. Both Carlos and I were born in Mexico. To make ends meet we both worked and tried to be careful with money. But despite our efforts at the time of separation we were in debt to the IRS for about $4,000 in addition to about $3,000 in consumer debt. Other than odd pieces of furniture and an old car there were NO community assets. Carlos was convicted of child molestation in 2006 and spent about six months at the Elmwood Correctional Facility in Milpitas. Upon his release, Carlos deported back to Mexico. In our culture child molestation is the most detested of behaviors, so it is no surprise that I have had NO contact from Carlos since he was deported 10 years ago. I would not be surprised if he left Mexico and/or changed his name, as his association with

child molestation puts not only himself but his family members at some risk. In 2011, I purchased Los Banos. As I was still legally married my status was noted on the title. To purchase No. Santa Ana I needed a $10,000 down payment. I had accumulated $3,000 in savings over the prior 5 years and a cousin lent/gave me the $7,000 balance. I initially filed for dissolution on March 3, 2011. I was then unaware of service by publication and attempted to locate Carlos in order to serve him. I contacted the Mexican immigration authorities to see if they could provide some assistance. That proved most unproductive. I became discouraged. When I tried to restart the matter in 2012. I was informed I had waited too long and would have to refile. I did so March 23, 2012. I then employed a paralegal service to help me. I informed the service I owned Los Banos, but was told since Carlos and I were separated when I purchased it, I didn’t have to and didn’t reference the property on any of the documents. The Judgment of Dissolution was entered on June 7, 2013. It stated there were no assets. I am now interested in selling Los Banos, but I am informed the buyer will not be able to obtain title insurance so the property is essentially unsaleable until title issues are addressed. I respectfully request the court exercise its jurisdiction over 536 North Santa Ana Street, Los Banos as a missed asset pursuant to Family Code §2556 and adjudicate the nature and extent of our respective interests in said property. EarthTalk Like most good questions, it depends... The main variables are how long the shower takes and the flow rate of the shower head. A typical bathtub holds 36 gallons of water, but most of us only fill it up partially. For baseline purposes, let’s assume a typical bath uses 25 gallons. Meanwhile, a typical shower head doles out 2.5 gallons per minute (GPM). (In 1992 the federal government mandated that all new shower heads sold in the U.S. had to be 2.5 GPM, although California, Colorado and New York have since instituted even lower limits for their own states.) According to this scenario, a 10-minute shower would use as much water as 25-gallon bath. If you can spend less than 10 minutes in the shower, all the better for the environment. Likewise, if you install a low-flow shower head—some models go as low as 1.5 GPM now—you can save even more water and money on your water bill. The U.S. Environmental Protection Agency’s (EPA’s) “WaterSense” label marks shower heads that are particularly miserly when it comes to water usage. But just because a new shower head is low-flow doesn’t mean it has to feel like it, given the genius of engineering going

Delta may be leading the pack with its “H₂Okinetic” design that uses physically larger water droplets to provide what it describes as “the feeling of more water without using more water.” Its budgetoriented 75152 model (~$30 online) can be toggled between 2.5 GPM and a stingy 1.8 GPM, and is a top pick on leading review site Wirecutter. “On its 2.5 GPM setting...the Delta 75152 delivers a powerful, soaking spray through its four nozzles, which create a much denser spray pattern than the ring
of spray holes found on most budget showerheads,” reports Wirecutter. Yet another way to cut down on water waste in the shower is by using a socalled “shower timer” that lets you know how long you’ve been scrubbing. Waterproof timers go from anywhere between $6 and $20 online; it might be the best investment in water conservation you could make. A more elaborate version is the $149 Shower Manager, a battery-powered device that you install between an existing shower
For those of us who just can’t give up our baths, there are some things we can do to keep the water waste to a minimum. For starters, plug the drain before you start running the water and adjust the temperature as it fills up. Also, only fill up the tub to the minimal level you’ll need to get your body wet and washed. And truly committed environmentalists can find a way to reuse the “graywater” from the bathtub to irrigate your garden or water your houseplants, either by rigging up some kind of hose system or just with a plain old bucket.

On February 2nd the film “Winchester” will attempt to create a world that is made up of folklore and the historical reality that inhabits the characteristically creepy Victorian known to some as one of the most haunted houses in the world. The Winchester Mystery House was is a spectacular, decadent home built by guns, in more ways than one. Sarah Winchester was the widow of the heir and treasurer to the Winchester Repeating Arms Company, William Wirt Winchester, who died at age 43 of tuberculosis. Following the death of her husband, and the sudden 50 percent ownership of the arms company, Sarah was left with grief, and with an approximate present-day value of 25 thousand dollars a day to spend. Sarah Winchester’s creation has an array of theories surrounding its curious architecture and fascinating construction, but one thing is certain when touring its dark hallways and sometimes claustrophobic array of staircases, the story of Sarah and her build is a truly unique story of the Bay Area. It’s been nearly 140 years from
when the widow Sarah Winchester purchased an unfinished home in Santa Clara County and gave it a new existence, one that would capture Sarah’s fears, hopes, ideas, and most of all, the fascination she had with the spirit world. Sarah had a mostly blank canvas to work with at the property and home she purchased. What accelerated her imaginative and perplexing build project was the haunting fears of the victims of Winchester rifles coming to get her This house and its 162 rooms, some unavailable to the public for safety reasons or because they are used as office space, contain captivating stories. From a séance room, to a bright conservatory containing an array of plants, to a lone, state-ofthe-art (in the 1800’s) shower in the 13-bathroom house. The film “Winchester” will follow some of the beats of the true story of Sarah and her unending, 24-hour a day construction, but will also inject themes of a thriller and horror story to the very real house that now sits on Winchester Boulevard and across from Santana Row. Among the actors in the film are Helen Mirren (Eye In The Sky, The Queen) in the title role of Sarah Winchester, her niece, played by Sarah Snook (Steve Jobs, Jessabelle), and a doctor, played by Jason Clarke (Mudbound, Dawn Of The Planet Of The Apes. The plot of this “gothic thriller” involves Sarah Winchester’s unending, manic construction of the
The film version of this story will more so focus on the scary and thrilling aspects of the house and its many stories. Judging by the trailers and footage it will be a creepy, jump scare type of affair. If there is a chance to visit the home before the film is watched, I would recommend it as it does offer a chance to take in the actual feel of the wood, and the different types of spaces offered in the home, or should I say mansion. Although most of the furniture are replicas of what the house might have been furnished in, (after Sarah’s death in 1922 the house was purchased at auction, and most of the furniture was sold off by Sarah’s niece Marian Marriott), the original Tiffany stained glass is still on display today. Five months after Sarah Winchester’s death the house was reopened and held its first tours. Although the story may follow a folkloric account of the events inside the house, there is no doubt there is a presence to the home. A characteristic to the grand and sometimes confusing structure that cost a lot of money, a lot of effort, and truly is unlike anything else in this world. If you are reading this and are close enough, it is a worthy cause stepping into the hauntingly beautiful home, with a very much true and sad story behind its existence. But since the big question still remains, what was Sarah’s real answer for building the house, there is room for interpretation, whether supernatural or not. ‘Winchester’ is in theaters February 2nd, and the Winchester Mystery House is right where it has always been.

FAKE NEWS: A CASE STUDY

In the above examples, the titles are slightly different, and the article has been slightly rewritten. In all of the above examples, the writing credit goes to AFP, the news agency, not to Rob Lever. The Journey This story has gone from one writer’s opinion (mine) to another writer’s subjective interpretation of that opinion (Rob Lever’s) to fake news (AFP). Was Mr. Lever’s writing an innocent manipulation of published work? Is he just a poor journalist, or is he an awesome journalist being paid to propagate the idea that somehow Facebook and social media are bad for democracy? I don’t want to pick on Mr. Lever. I don’t know him or what his motivations might be. I just wanted to share with you that my words, which accurately communicated my opinions, were twisted to support a thesis I do not agree with. Then that misrepresentation was widely propagated. Most Quotes Are Out of Context

Real fake news articles feature fabricated stories crafted to push a particular agenda. In most cases, the thesis of the article is supported by alternative facts (lies). But there are more subtle, more insidious types of fake news. Specifically, articles that might pass a cursory fact check, but have been written to espouse a point of view unintended by the original author. Here’s a quick case study that demonstrates the technique and clearly illustrates why it will be nearly impossible to stop. Last week I wrote a relatively popular article entitled “Facebook: Ministry of Truth?” It was published on my own website, as an opinion piece on LinkedIn, and in the digital opinion section of AdAge, where I am a weekly contributor. The thesis of the article is that in my opinion, Facebook’s idea to survey its users about the trustworthiness of any particular news source is misguided. I stated the problem, cited examples of what might go wrong, and offered a solution. A few days later, a pull quote from my article appeared on Yahoo News in an article entitled “Facebook admits social media threat to democracy” by Rob Lever for AFP (Agence FrancePresse, a French news site). Mr. Lever’s name is not linked to anything, and if you use the search box on afp.com, his name does not yield any recent results. That said, he’s easy to find on Google, and he looks like a pretty busy writer. He’s verified on Twitter, and he has a solid profile on LinkedIn. By all accounts, he’s a professional writer. But is he a trustworthy journalist? Importantly, I am not a journalist. I am a business advisor, a commentator, and a professional purveyor of my own opinions. I do my best to research my work, and I take great care to link to sources I cite (many editors, though, remove links they believe to be extraneous – which is both annoying and unfair). In any case, I always make it clear that my writing is opinion and commentary, not “news.” My conclusions are my own, and I encourage Socratic discussion about the topics I cover. Most of my posts end with an author’s note: “This is not a sponsored post. I am the author of this article and it expresses my own opinions. I am not, nor is my company, receiving compensation for it.”
Mr. Lever chose to paraphrase what I wrote and to quote directly from my article: But technology columnist Shelly Palmer warned that Facebook appeared to be equating trust and truth with what the public believes — what some call “wikiality.” “Wikiality is Facebook’s answer to fake news, alternative facts, and truthiness,” Palmer wrote. “Facebook, the social media giant, is going to let you rank the news you think is most valuable. What could possibly go wrong?” Mr. Lever uses what I wrote to support his idea in his article that “Facebook admits that social media is threat to democracy.” I do not agree with Mr. Lever’s statement. I believe his sentiment is misguided in the extreme. Is Mr. Lever’s article fake news? He never spoke to me, did not cite or link back to my original work, did not even mention my article, and did not use the quote in its correct context, that is, the thesis that I wrote my article to support. In Mr. Lever’s article, the quote from my article is just words attributed to me. He has used my words without proper citation to further his own ideas. This manipulation of my writing is at least disingenuous and at worst nefarious. But is it fake news? Mr. Lever’s article has propagated and promoted a point of view I do not share. So that part is fake. And thanks to Yahoo News and Mr. Lever’s excellent click bait headline, it has gone very, very wide. Thousands of people have tweeted, retweeted, posted and shared several versions of the article. Critically, each share adds editorial credence for members of the respective social networks. If you learn about something from inside your echo chamber, and it feels true, you are very likely to accept it as such. Along with the original version of Mr. Lever’s article, a quick search yielded the following: Phys.org – Facebook admits social media threat to democracy (Update) France24 – Facebook vows to tackle social media threat to democracy Daily Sabah – Facebook admits social media could
Most quotes are out of context; that’s not new. But when a professional journalist quotes you in an article, usually you are clearly identified and the thesis of the article is in line with your thoughts. When professional journalists use pull quotes, the quotes are – or they should be – linked back to the original article, so even if the quotes are used out of context, it’s easy to find the original article and to quickly ascertain the original author’s true meaning.

What makes Mr. Lever’s use of my writing different is that I was not contacted, the pull quotes work for an alternative point of view, and the writing mistakenly suggests that I share that point of view. The damage is done, and only a fraction of the people who read the Yahoo News piece and its offspring will see this article calling out Mr. Lever’s misrepresentations. So Easy You Can Do It By Mistake If it is this easy to create fake news with a pull quote from an opinion piece, imagine how easy it is when the writer has malicious intent. It doesn’t take long to see how this kind of manipulation of published works can be used to push conspiracy theories or populist views. Will It Ever Be Worth The Resources To Police? There is one more thing to learn from this particular case study. Unless you are specifically looking to fact check the quotes, there is no way to flag any of Mr. Lever’s writing as fake news. If an algorithm could be written to do the fact checking, it would not call Mr. Lever’s misrepresentation as an error. Even if an AI system were trained to fact check, it would look at my original article, find the quote, and assume Mr. Lever’s writing was correctly pulling the quote. No matter what tools are used, determining that such erroneous reporting is fake news requires more resources than most people would be willing to commit. Some food for thought as Facebook and other social media sites face existential questions about their value to society. Author’s note: This is not a sponsored post.
