Hilbert Morales EL OBSERVADOR Introduced by Assembly Member Rob Bonta (CA District 18; Alameda) and supported by six assembly members and four Senators, AB 42 seeks to reform the current jail bail bond industry. A Blue Ribbon Commission recommendation was to reform the current law enforcementjudicial system which results in many individuals spending much time in jails simply because of their inability to afford a jail bail bond which would enable return to their family, community, and employment while waiting on their own recognizance for their court trial/hearing. “This act will amend Section 1270 of the CA Penal Code, relating to bail bonds. Existing law provides for the procedure of approving and accepting bail, and issuing an order for the appearance and release of an arrested person. Existing law requires that bail be set in a fixed amount by a judge who is guided by extensive rules and considerations. An arrested offender may be released on his or her own recognizance, unless the court makes a finding on the record that his or her release would compromise public safety

This bill, AB 42, would state the intent of the Legislature to enact legislation to safely reduce the number of people detained pretrial, while addressing racial and economic disparities in the pretrial system, to ensure that people are not held in pretrial detention simply because of their inability to afford money bail. The bill would also require the court to release a defendant being held for a misdemeanor offense on his or her own recognizance unless the court makes an additional finding on the record that there is no condition or combination of conditions that would reasonably ensure public safety and the appearance of the defendant if the defendant is released. A majority vote by the State Assembly and the Senate is required to pass AB 42. Following Governor Brown's signature, AB 42 would become law within the State of California. Modernization of CA's pretrial system is urgently needed because currently thousands of individuals held in county jails across the state have not been convicted of a crime and are detained while awaiting trial simply because they cannot afford to post money bail or pay a commercial bail bond company. During 2015,63 percent of people in California jails were either

awaiting trial or sentencing. As compared with the rest of the nation, CA has relied on pretrial detention at much higher rates than other states. California’s existing pretrial detention practices allow a person’s wealth rather than the person’s likelihood of (integrity) success on pretrial release to determine whether the person will remain in jail before the person’s case is resolved. Detaining people simply due to an inability to afford money bail violates the American principles of equal protection and fundamental fairness. Nationwide, the majority of people who are unable to meet money bail fall within the poorest one-third of society. The consequences of pretrial detention—which include greater likelihood of innocent people pleading guilty to a crime, longer sentences upon conviction, loss of employment, income, and housing, and traumatic family disruption—disproportionately affect people of color and lowincome. The commercial money bail system, which requires people to pay nonrefundable deposits to private companies in order to secure release from jail, often leaves people in debt and drives them and their families further into poverty. The commercial money bail system does not improve rates of appearance in court or enhance public safety. California should follow the lead

of the federal government and jurisdictions across the country that have stopped making wealth-based decisions on pretrial detention and instead have shifted to a system that evaluates whether an individual can be safely returned to the community as well as make required court appearances, and, if so, under what conditions. Other projected improvements are: a) Reduction of jail's operational expenses; b) Reduced recidivism; c) pretrial social services, mental health and behavioral health services have reduced social costs previously ignored. d) Increasing the use of evidence-based practices in pretrial decisions will provide judges, law enforcement agencies, and pretrial service providers with additional tools to both assist them in assessing a defendant’s likelihood of success on pretrial release and to identify and meet the needs of those defendants and the community to assure constitutional and statutory objectives. Modernizing pretrial (risk assessment) practices will support the goals of the Public Safety Realignment Act of 2011 by providing additional options to manage pretrial populations using best practices developed over many years across many jurisdictions. It is the intent of the Legislature to enact legislation to safely reduce the number of people detained pretrial, while addressing racial and economic disparities in the pretrial system, to ensure that people are not held in pretrial detention simply be-

cause of their inability to afford money bail. EO's readers are encouraged to go to <California Penal Code, Section 1270> to read this proposed pretrial improvement legislation in its entirety. Much of what is presented above has be lifted from this proposed legislation (copy-editing) to ensure correct presentation and understanding. The general public, especially the low income person of color, needs to communicate to his/her CA Assembly member, that you support passage of this legislation. It take no imagination to realize that THE CURRENT BAIL BOND INDUSTRY WILL BE LOBBYING to ensure this AB 42 bill is not successfully passed. The successful passage of this AB 42 bill is essential to the modernization of the current law enforcement-judicial system which has favored punitive mass incarceration since 1975 when former President Clinton signed that federal 'three strikes' legislation which initiated the mass incarceration trend. SO COMMUNICATE WITH YOUR STATE ASSEMBLY MEMBER TO TELL HIM OR HER THAT YOU SUPPORT THE ENACTENT OF AB 42; TELL GOVERNORN JERRY BROWN TO SIGN IT...all legislators will be under lobbyist pressure to let it die. De acuerdo con cifras censales, más de 736,000 latinos laboran en el campo, la pesca y los bosques, comparado con 638,000 no-hispanos. La conexión entre los latinos y el campo trasciende empero la dimensión estrictamente laboral y alimentaria. Para muchos de nosotros, especialmente quienes crecimos en zonas rurales, los seres humanos y el agro somos parte de una unidad de vida, tradiciones e identidad. Por eso no sorprende que, durante casi una década, un hispano ha dedicado su tiempo y esfuerzo a promover el concepto de que mejorar la salud de la tierra es la clave para incrementar

la producción agropecuaria, uno de los pilares de la economía de Estados Unidos. Se trata de Rudy García, un especialista agrónomo regional del Servicio de Conservación de Recursos Naturales (NRCS, por sus siglas en inglés) para Nuevo México, Utah, Arizona y Colorado, quien ha dedicado una parte de su vida a plantar en los productores la semilla del concepto de la salud de las tierras. Sus talleres enseñan a los productores nuevos métodos de planeación, desarrollo y monitoreo de un sistema de cultivos integrados, que consiste en el manejo de irrigación, cobertura y rotación de cosechas, manejo de residuos y de nutrientes, así como control de pestes y labranza para la conservación. La premisa de los talleres es indis-

cutible: los suelos más saludables son aquellos con mayor diversidad y abundancia de vida, por lo tanto, aquellos productores que promueven la salud de sus tierras y la diversidad en la superficie de los campos de cultivo tienen más y mejores cosechas con un uso más razonable de pesticidas. “No hay duda que mejorar la salud del suelo es uno de los métodos más sencillos y efectivos para que los productores agrícolas incrementen no sólo la productividad, sino también la rentabilidad de sus cultivos y al mismo tiempo conserven el medio ambiente”, sostiene Rudy García. No se trata de un asunto menor. Para el año 2050 es necesario aumentar la producción agrícola por un 60% para satisfacer las necesidades alimentarias de la humanidad, de acuerdo con estimaciones de la Organización de Naciones Unidas para la Agricultura

(FAO). Más aún, cada año se pierde más de 24,000 millones de toneladas de suelo a nivel global, de las cuales más de 2,000 millones están ubicadas en los Estados Unidos. Por lo tanto, Rudy recomienda a los productores mantener el suelo cubierto lo más posible, limitar el movimiento y cultivo del suelo lo menos posible, conservar plantas creciendo todo el año para que alimenten el suelo y diversificarlo con rotación de cultivos. TEACH YOUR CHILDREN ABOUT MONEY THIS FINANCIAL LITERACY MONTH StatePoint April is Financial Literacy Month, an ideal time to think about the lessons your children are learning about money. Setting a good financial example is just the start. Parents should also actively engage children on the topic. These lessons can help put kids and teens on the right path towards a financially responsible adulthood. How Money Works Now that consumers use credit or debit cards, buy things online and even purchase movies on their televisions and mobile devices, children may not realize when you are actually spending money and that money is needed to buy things. Take time to explain to them that products and services have different prices. They also need to learn that money can be spent only once, and that after buying something, a person needs to earn more money in order to buy something else. Play “grocery store” or other games that involve buying and selling items. Take turns being the cashier and the customer. Saving for a Goal Teach your children that some things cost more money than they may have now, and that saving means putting some money aside a bit at a time until you have enough to buy what you want. Kids can learn to keep money in a safe place and practice their math skills by keeping track of the amount saved for future spending. To maximize the benefits your child receives for saving money, you may want to consider an In-Trust-For (ITF) or custodial bank account. Those offered by Ally Bank, for example, earn a competitive rate of interest with no monthly

maintenance fee. Plus, there’s no minimum balance to open the account. When opening such an account, use this as an opportunity to discuss interest and other basic banking concepts. The Importance of Self-Control Help your children learn the difference between needs and wants or wishes. Explain that although everyone really wants things like toys and electronics, you have to pay for needs - things like food, shelter and heat before you can buy items that are wants. Help your children come up with a plan to save and spend their own money that takes into account their wants and needs. Making Spending Decisions The next time you need to make a big purchase, talk it through with your child. Explain how you weigh the pros and cons. Show how taking time to ask questions, learn about different choices, and compare what’s good and bad about each choice helps you reach good decisions. “Financial literacy ideally begins in childhood. Even young children should learn about basic concepts like saving for a goal and spending only what you can afford,” says Jacqueline Howard, director of Corporate Citizenship at Ally Financial. There are many resources to help you talk to your kids about money and finances. This April, take the time to boost your children’s financial literacy and enforce the concept of smart money management.

The so-called war on drugs vastly expanded the U.S. prison population. But while African Americans are no more likely to sell or use drugs, they are three times more likely to be arrested, more likely to be convicted and will serve more time in prison than whites. According to Leila Morsy, co-author of the report and senior lecturer at the University of New South Wales, when parents are sent to prison, their children become more susceptible to depression, behavioral problems and ADHD. "Their grade point average drops, they're also more likely to drop out of school,” Morsy said. "Boys are more likely to drop out because they themselves have been incarcerated." The report, published by the Economic Policy Institute, urged educators to join with criminal justice reformers to advocate for policies that would end mass incarceration. In Connecticut, African Americans are about 10 percent of the population, but make up 40 percent of inmates in prisons

and jails. Ames Grawert, counsel at the Brennan Center for Justice, said the effects of mass incarceration are serious and pervasive. "It can't possibly be just a criminal justice issue, just a racial justice issue - although it is both of those things,” Grawert said. "It's an economic justice issue. It's an education issue. It's an issue that affects all of us in a myriad amount of ways." This year, Gov. Dannel Malloy again is pushing to reform the bail system and keep young people out of jail by extending the juvenile justice system to the age of 21. Morsy stressed that sentencing reform and increased educational and employment opportunities for released offenders also would benefit those left behind when a parent goes to jail. "Improvements in our criminal justice policies will lead to improved outcomes for children and are very likely to contribute to narrowing the achievement gap,” she said. In 2014, more than 600,000 inmates nationally were serving sentences of a year or more in state prisons for nonviolent crimes. NEW BBB RISK INDEX IDENTIFIES RISKIEST SCAMS

Better Business Bureau There is no doubt that scams have gone high tech, but the riskiest scam is the face-to-face home improvement scam, with fake check scams running a close second, according to the new BBB Risk Index, a sophisticated analysis that goes beyond volume to look at the risk each scam type poses. The BBB Institute for Marketplace Trust (BBB Institute) recently released its inaugural BBB Scam Tracker Annual Risk Report, which provides comprehensive insight into scams based on the more than 32,000 reports made to BBB Scam Tracker in 2016. There were some real surprises within the data: men were more vulnerable than women in seven of the top ten scam categories; and consumers 18-24 were the most likely to lose money to a scam. This analysis uncovered that younger consumers have a lower median loss than people in their top earning years, partly because the types of scams aimed at older consumers tend to have higher median losses. While seniors also tend to lose more money than Millennials when they are scammed, they fall for scams far less often. And the biggest takeaway is that no one is immune from the risk posed by scams. The BBB Risk Index measures risk along three dimensions: exposure (how likely are you to be exposed to the con?), susceptibility (if you are exposed, how likely are you to lose money?) and monetary loss (if you do lose money, how much is it likely to be?). Exposure X Susceptibility X Monetary Loss = Risk Index Based on the BBB Risk Index, the riskiest top five scams overall (U.S. and Canada combined) are: 1. Home improvement scams (bbb.org/homescam) 2. Fake checks and money orders (bbb.org/fakecheckscam)

3. Employment scams (bbb.org/employmentscam) 4. Online purchase scams (bbb.org/webpurchasescam) 5. Advance fee loan scams (bbb.org/loanscam) The scam most reported to BBB Scam Tracker in 2016 – by far – was the tax scam. However, consumers are savvy to this con and rarely fall for it, so it did not even make the BBB Risk Index’s top ten. Employment scams were three times as risky for consumers as tax scams, and ranked #3 on the BBB Risk Index. Home improvement scams, ranked #1 on the BBB Risk Index, was the only category in the top ten to rely on in-person contact. Because of the highly personal nature of this scam – someone literally at your doorstep – the exposure rate was low but the susceptibility rate and the median loss were both very high, making it the riskiest scam of all. Fake check scams take on a variety of approaches, but all rely on the fact that consumers assume that when a check “clears” their account and funds are made available, they are in the clear to spend those funds. In fact, it may take several weeks for a fake check to be detected and returned, and that includes cashier’s checks and money orders. The BBB Institute also notes that fake checks are used in about 30-40% of employment scams, and appear frequently in other scams, as well. Whenever a consumer is asked to deposit a check and then send funds back out for any reason, that’s a big red flag. The full report is available at bbb.org/ RiskReport. Mi nombre es Rosa. Cuido a mi mamá con la ayuda de mis 2 hermanas. Mi mamá fué diagnosticada con Alzheimer hace 3 años. A pesar de que somos 3 personas tomando turnos para cuidarla, es la tarea más difícil que he hecho en toda mi vida. Mi mamá tiene 83 años. Todavía puede bañarse con supervisión, pero para todo lo demás necesita mucha ayuda. Su comportamiento cambió mucho. Pasa el día repitiendo lo mismo una y otra vez. Se pone muy anxiosa. Es muy desgastante física y psycológicamente cuidar a un enfermo con Alzhiemer o Demencia. Es un trabajo de 24 horas los 7 dias de la semana. Me llamaron de un centro de cuidados para personas de la tercera edad, yo había puesto el nombre de mi mamá en la lista de espera, me dijeron que había una cama disponible para ella, pero mis hermanas y yo no estábamos preparadas para moverla

Even though it’s 3 of us taking turns caring for her, it is one of the most difficult experiences of my life. My mom is 83 years old. She can still bathe with supervision, but for everything else she needs a lot of assistance. Her behavior changed a lot. She spends the day repeating the same thing over and over again. She gets very anxious. It is physically and psychologically very exhausting to care for someone with Alzheimer's or Dementia. It is a 24 hour/7 days a week job. I was called from a Nursing Home, I had put my mom's name on the waiting list, they told me that there was a bed available for her, but my sisters and I

FOUNDATION FOR HISPANIC EDUCATION HOLDS FIRST SCHOLARSHIP FUNDRAISER The Semillas Project Raises Money for Students Who Are the First in Their Families to Attend College San Jose, CA – The Foundation for Hispanic Education held the first-annual scholarship fundraiser in support of its three charter high schools on Saturday, March 11th at the Mexican Heritage Plaza in San Jose, CA. THE SEMILLAS PROJECT – an After School Digital Media course that engages underserved learners at Luis Valdez Leadership Academy (LVLA), Roberto Cruz Leadership Academy (RCLA), and the Latino College Preparatory Academy (LCPA). Each year the Semillas Scholars choose a health topic that is prevalent in the Latino community. This year, the focus was on Diabetes in the Latino Community. To that end, The Semillas Project students collaborated with the Silicon Valley American Diabetes Association, Dr. Peter H. Hwang of Stanford University Medical Center and instructors to research and develop impactful storylines with health education as a primary program objective. The final project was a short film, “Mis Manos” which will be part of a multi-year health awareness program for TFHE students to become a new generation of medical professionals, storytellers, and agents of change for the Latino community. The Semillas Project Students premiered their “Mis Manos” film at the scholarship fundraiser event and were featured onstage with Semillas Project Director Emiliano Valdez in a conversation with event emcee Rick Najera (writer, author, comedian). TV and Film Actor Antonio Jaramillo (NBCTV Shades of Blue) was Keynote Speaker at the event. Veteran actor Luis Guzman (TVs Code Black) was presented with the Semillas Humanitarian Award by Ed Alvarez, President of the Foundation for Hispanic Education. The evening culminated in a $20,000 Scholarship Presentation by Dr. Hernan Bucheli, Vice-Provost of Saint Mary’s College.

The Semillas Project Scholarship Fundraiser benefits 1st Generation college students and will provide scholarships so that students of LVLA, LCPA, and RCLA can be the first in their families to attend college. This year’s Semillas Project students are 10th Graders Tania Romero, Cynthia Toro, Chris Gomez, Giselle Vasquez, and Osiel Rodriguez. 11th graders include Andrea Rodriguez, Lizeth Yebra, and Abisaid Esquivel. The Semillas Project supports the Mission of the Foundation for Hispanic Education by providing engaging and relevant service learning experiences. These authentic experiences meet real community needs, and provide experiences for students to learn about their education and career options through professional job shadowing, career development activities through digital media project based learning, and integrated career activities with their peers and professionals in the field.

different communities should stand up and start meeting.” Barajas hopes that the march on Sunday will have an impact in promoting the ideas of the UFW. In the way the words “Sí Se Puede” command a sense of duty to uphold dignity and courage against adversity, there can be a push for organizing and speaking out against what these communities see as injustices. “I think we’re going to have a historic march and that’s because the organizations, the community know they have to come out and speak, and speak loud. So my messages for the different communities is to stand up, come together, get organized. NEIL GORSUCH AND THE ENVIRONMENT What will be the implications for environmental and climate policy if Neil Gorsuch is confirmed to fill the vacant seat on the Supreme Court?

Roddy Scheer & Doug Moss EarthTalk Environmental leaders aren’t particularly jazzed about Neil Gorsuch as Donald Trump’s nominee to fill the vacancy left on the U.S. Supreme Court following the death of Antonin Scalia in February 2016. For starters, the name Gorsuch brings back bad memories of the 1980s when Anne Gorsuch (Neil’s mother) slashed federal environmental

funding by 22 percent as head of the U.S. Environmental Protection Agency (EPA) under Ronald Reagan. Greens at the time accused her of placating polluters and trying to dismantle the very agency she was hired to run. (And it’s deja vu all over again at the EPA with Scott Pruitt now at the helm.) But it would be unfair to judge a son based on his mother’s doings some four decades ago. Nevertheless, environmentalists aren’t

According to Billy Corriher of the Center for American Progress, Judge Gorsuch made his way onto candidate Trump’s radar as a potential Supreme Court nominee in August 2016 after writing a “controversial manifesto arguing that it should be easier for corporations and individuals suing federal agencies to have courts strike down regulations and overrule decisions by experts at agencies like the Environmental Protection Agency.” Gorsuch contends that the judiciary should be able to overrule how federal agency experts interpret how a given law should be implemented. In the case of global warming, the Obama EPA interpreted carbon dioxide as a harmful pollutant worth regulating under the Clean Air Act based on the recommendations of the very agency experts Gorsuch would potentially seek to overrule. Like Trump’s cabinet picks, Gorsuch favors the shrinking of federal bureaucracy and an increased reliance on the states to handle their own problems. This antipathy toward federal regulations is another reason Gorsuch could be a disaster for the climate in the case he casts the deciding vote on the Supreme Court against implementing the Clean Power Plan, an Obama-era effort to ratchet down

carbon emissions from the utility sector by moving away from coal. Without the Clean Power Plan—currently cooling its heels in judicial review and likely headed for the Supreme Court later this year—there’s little hope of the U.S. meeting its Paris climate accord emissions reduction commitments. Another concern is Gorsuch’s historically dismissive posture toward the standing of public interest groups as plaintiffs (defined as their right to file suit given direct injury or harm). According to EnviroNews, Gorsuch dismissed a 2015 case brought by a hunters and anglers group against the Forest Service for allowing motorcycles to access trails in Colorado’s San Juan National Forest due to lack of direct harm. Likewise, he barred three leading environmental groups from joining a 2013 suit regarding where off-road vehicles could travel in New Mexico’s Santa Fe National Forest. Greens, still hopeful that the judiciary can be the last check on the conservative-dominated legislative and executive branches, are crossing their fingers that Democrats can block Gorsuch and send the Trump administration back to the drawing board for someone more to their liking.

CAN ALEXA LIE? Shelly Palmer There was a recent tabloid piece featuring a video of a woman asking Alexa if it was connected to the CIA. At the time, the Echo Dot she was speaking to did not respond to the question. She asked a few times, and each time the Echo was silent. Conspiracy theorists weighed in. It was an amusing video, but the Daily Mail’s clickbait headline raises a legitimate question: Can Alexa lie?

What you really want to ask is, “Can Alexa Voice Services’ underlying natural language understanding algorithm be trained to interpret a question and purposely respond with a false answer?” Again, the answer is no because the system does not work that way. After doing its best to figure out what you said, it passes that information on to a related database, waits for a response and then speaks the answer back to you. But … What About Other AI Systems?

How Alexa Works According to Amazon, you can “use the Alexa Voice Service (AVS) to add intelligent voice control to any connected product that has a microphone and speaker.” Alexa uses machine learning to help it recognize what you say (Automatic Speech Recognition) and understand the question (Natural Language Understanding) and then routes your information as requested. You can think of Alexa as voice control for any app. Instead of tapping a button on your phone, you just talk. But Alexa is not “thinking” about what you said; the system is passing the request on to an algorithm that does its best to return the correct results. It’s just like typing a request into the Amazon or Spotify or Google search bar. Whatever product or song or search result is available is what Alexa speaks or plays back to you. Pre-Programmed Responses There’s not a lot of AI in Alexa’s pre-programmed responses. It’s really a parlor trick. For example, ask Alexa to tell you a “knock, knock” joke or a “back to school” joke, and it will randomly pull from a short list. Ask, “Which came first, the chicken or the egg?” or how much Alexa weighs or where Alexa was born or the answer to “life, the universe and everything.” It will quickly answer with a cute response. Alexa features thousands of pre-programmed responses. Could any of those answers be lies? Of course. The system will return whatever it is programmed to return. Asking if Alexa can lie is the wrong question. Could someone build a “lie” into the third-party database? Sure. But what’s the point? What You’re Really Asking

This is where life gets interesting! From January 11 to 31, 2017, Libratus (an AI system designed at Carnegie Mellon to play heads-up, no-limit Texas Hold’em) decimated four of the world’s top human poker players in a match of 120,000 hands. The humans didn’t just lose, they were a couple of million down by the end of the match. This Is a Very Big Deal In March 2016 when AlphaGo beat 9th Dan Devine Go Master Lee Sedol in Google’s DeepMind Challenge, people were stunned that an AI system could beat a human in a game that required both strategy and intuition. But as amazing as this accomplishment was (move 37 in game 2 changed my life, and I wrote about it in an article titled “AlphaGo vs. You: Not a Fair Fight”), Go is a game where both players have what game theorists call “perfect information.” In other words, both players can see the entire board and know the rules. Poker Is Different In a game of heads-up, no-limit Texas Hold’em, you’re trying to make a winning five-card hand out of seven possible cards, and so is your opponent. You do not know the identity of your opponent’s two “hole cards,” so you have to guess which of 169 possible hands your opponent may have. Game theorists call this an “imperfect knowledge” or “imperfect information” game. It’s a lot like life. Tuomas Sandholm, professor of computer science and co-creator of Libratus, acknowledged the power of the system he helped create, saying, “The best AI’s ability to do strategic reasoning with imperfect information has now surpassed that of the best humans.” In other words, computers can now out-bluff humans.
