Hilbert Morales EL OBSERVADOR According to Rachel Maddow's commentary (MSNBC 04.02.17, President Trump made a public statement favoring America's having a 'universal health care plan' with a single payor. The U.S. Congress needs to take advantage of this 'very reasonable statement' by acting like a non-partisan deliberative body which crafts the 'National Universal Health Care Legislation' which repairs the 2010 Affordable Care Act (keeping the several good features of the 2010 A.C.A...A child may be covered by parents policy until age 26; all individuals receive health care insurance coverage (no exclusion due to prior

Right now, all policy makers are trying to deal with 'universal health care using the 'competitive market model. This economic model must be replaced with a modified form of the 'public utility model' (such as that applied to utility services (electricity, natural gas, and potable water). The reality is that a sick patient (the customer) who has a medical condition (broken bone; appendicitis; impacted tooth etc) does not have time nor the inclination to 'shop around for the best price'. And one economist, Milton Friedman, points out that the 'provider knows more and is better educated than the client, who is at great disadvantage...probably desirous of therapy regardless of cost.

A modified 'public utility model' would provide for licensing and certification of the physicians, nurses, all allied para-medical and technical staff (and enc ou ra ge a c cre d it e d teaching institutions to train sufficient numbers of these staff personnel; plus monitor and certify 'durable medical equipment manufacturers, pharmaceutical drug industry and hospital/ clinic chains. The modif ied 'public utility model' could also ensure that rural areas had adequate primary care services accessible locally at reasonable costs. Its goal would be to be innovative and creative in designing a 'continuum of health care services from conception to birth to a life of wellbeing until 'passing on'. It in the best interests of any national society to have its population, especially its working force, in the best of health and wellness

President Trump is a 'business person' who deals with productivity and efficiency at lowest cost. The 'market model has many duplication which add to costs. In addition, a 'public utility model' could be designed to provide the individual patient-client preferences & choices. Finally, some eight nations have used 'a pubic utility model' for decades (Canada, Singapore, etc.). WHY? Simply because healthy individuals are essential to any human activity. Mr. Trump, if you establish America's national health care system, understand that you will 'stabilize' 20% of America's Gross National Product (GNP) created by the effort of educated, trained and informed personnel. And continue to support the basic research efforts of the National Institutes of Health and the National

Science Foundation. Understand that many of those who resist necessary change are fearful of losing what wealth they have today and wish to sustain their current position of power and inf luence. President Trump: Encourage the U.S. Congressional leaders to allocate the funding needed to make progress in implementation of your vision of the future health care service delivery system accessible to all residents of America. Those funds will provide the license to begin the performance, production and consumptions needed to implement that vision which will establish your future station in American history. Monitor fully the use of those allocated resources to ensure honesty and integrity of all health care developmental activities undertaken.

CALIFORNIA, A SAFE STATE FOR UNDOCUMENTED IMMIGRANTS Estephany Haro El Observador On Monday, the California senate passed bill SB 54 in response of President Trump’s anti-immigration policies. The bill, proposed by California State Senate President Kevin de León (D-Los Angeles) would apply a set of sanctuary policies statewide that would prevent law enforcement from working with Immigration and Customs Enforcement, also known as ICE; with an exception of people who committed serious crimes such as murder and rape. There is disagreement over this bill, both in the senate and in the streets, but I think California is going towards the right path. In the end, the senate did pass the bill with a vote of 27-12. By passing this sanctuary bill, undocumented immigrants will be less fearful in this moment of anxiety and fear. We currently live at a point where parents are being detained by ICE in front of

their children on their way to school. Where parents are scared of sending their children to school, and even of showing up to work themselves. They are afraid of reporting crimes because they don’t want any law enforcement agency to have their personal information.

they haven’t been to in years, they’re afraid that their U.S. citizen children will be taken away from them. However, undocumented immigrants are not the only ones afraid of this administration. The legally staying young people known as “Dreamers” are fearful too.

This is a sad reality for millions of undocumented immigrants who contribute billions of dollars to this economy and generally don’t commit crimes. In a statement from Kevin De Leon after the approval of the bill, he said, “Undocumented residents commit crimes and are incarcerated at a lower rate than native-born residents. Counties with sanctuary policies are safer and economically better off than comparable non-sanctuary counties. Our communities will become more – not less – dangerous if local police are enlisted to enforce immigration laws.”

According to Pew Research there are more than 700,000 young adults under Obama’s Deferred Action for Childhood Arrivals program known as DACA, which protects them from deportation and allows them to work legally in the U.S. However now even these Dreamers are on thin ice, because of the Trump administration which has detained at least two DACA recipients without any justification.

agencies will not put them at any risk. Even though the bill was passed in the senate with a majority vote, it now has to be passed by the Assembly. If approved, Gov. Jerry Brown would sing it into a law effective Jan. 1, 2018. This can have a tremendous impact, as nearly a quarter of all undocumented immigrants in the United States reside in California, according to the Public Policy Institute of California. In 2105 Gov. Brown passed bill SB60, which grants driver's licenses to undocumented immigrants. In the Bay Area alone, the number of sanctuary counties has increased after President Trump took office. These include San Francisco, Santa Cruz and Alameda, as well as cities such as Oakland and San Jose, according to the Mercury News. Our state is known to be an immigrant friendly state, and so it is good news that they continue to be on the forefront of providing a safe haven to our families, neighbors and friends.

Suzanne Potter California News Service SACRAMENTO, Calif. - Hundreds of educators are marched on Cesar Chavez Day - in Sacramento to show their solidarity with immigrants in California and to oppose the immigration and education policies of the Trump administration. The march and rally kick off the 75th annual convention of the California Federation of Teachers. CFT President Joshua Pechthalt said President Trump's stepped-up wave of deportations has created a climate of fear that is detrimental to education. "The threat of deportation is casting a blanket of fear over our schools," he said. "Kids are coming to school crying. If parents feel that they may be picked up by ICE coming to school, they're not going to come to school. We've seen that happen." Trump supporters have pointed out that ICE simply is enforcing the laws on the books. The march began at 11:30 a.m. at the Sheraton Grand Hotel, making stops at Immigration and Customs Enforcement offices and ending with a rally on the steps of the Capitol building.

CFT Vice President Francisco Rodriguez, a representative of the Pajaro Valley Federation of Teachers in rural Santa Cruz County, said some parents now are afraid to fill out even the most basic forms. "Any paper or information you request from parents is now suspect," he said. "People want to know, 'Why do you want to know where I work, where I live?' And it's part of this insecurity created by the changes in policy."

He said conference leaders also will call for new state laws to cap the number of charter schools and require them to disclose more information about their operations and management.

It’s important to be safe when purchasing tickets so that you don’t get turned away at the gate. In 2016, consumers nationwide filed around 3,000 complaints on ticket brokers and event ticket sellers with BBB. The leading cause for complaints was problems with refunds and exchanges. Consumers allege being unable to get refunds (even if shows were cancelled or postponed), being charged hidden fees and receiving fraudulent tickets. It can be fun to wear team gear to the game, but only if it’s authentic! Consumers nationwide reported nearly 500 counterfeit product scams to BBB Scam Tracker in 2016, and 53% involved a monetary loss. Buying gear online is especially tricky. In 2016, consumers reported around 2,800 online purchase scams to BBB Scam Tracker. These scams often involve purchasing an item from an unknown website and never receiving it. • Watch out for ticket fraud. Stick to trustworthy sources when buying tickets. The best way to buy is through the Major League Baseball (MLB) official website, mlb.com. If they’re sold out and you have to purchase from an online ticket exchange or broker, be careful. Unfortunately, ticket fraud can occur when you purchase tickets from the secondary market. Look up every business at bbb.org and check out their BBB Business Profile before making a purchase. For more tips on avoiding fraudulent tickets, visit bbb.org/tickets. • When buying gear, watch out for counterfeits. The best way to be sure the hats and jerseys you’re buying are authentic is by shopping at the MLB’s official store, mlbshop.com. You can also find MLB

licensed gear from authorized resellers. If you’re unfamiliar with the business or website, make sure to look it up at bbb. org first to avoid an online purchase scam. Know the signs that an item is counterfeit: it’s much less expensive than items from official shops, the website has spelling or grammatical errors, or logos and colors on the merchandise aren’t right. • Be smart when making a purchase. Whenever you’re making a purchase online, protect yourself. Verify that the website is secure by looking for the “https:”, where the “s” stands for “secure”, and other trust marks. Make sure your computer is running up-to-date anti-virus, anti-spyware and anti-malware software. Always try to use a credit card, as they offer more protection than debit and prepaid cards, and never pay by wire transfer or gift cards. Additionally, always read the purchase terms and conditions carefully! Understand the refund and guarantee policies before making a purchase, and be on the lookout for hidden fees. •Don’t show up empty handed. Don’t plan on buying tickets or gear outside the venue. Tickets sold by scalpers are often either overpriced or fake, and gear sold outside the gates is also likely to be overpriced or counterfeit. Avoid stress by showing up to the game with a ticket in hand! • Look up your seats beforehand. When purchasing a ticket, make sure you know the section, row and seat number. Look up the seat location before buying the ticket to ensure the seats exist, they’re in a location you like and the view isn’t obscured. Know what you’re buying to avoid possible disappointment when you arrive. If you encounter fraudulent tickets or counterfeit goods, let BBB know! También puede tener diversos efectos secundarios que varían de una persona a otra”, explica Hoffmann. “Los pacientes han estado en busca de tratamientos alternativos para la migraña. Como estos dispositivos no son ingeridos ni metabolizados como la terapias farmacológicas, no necesariamente tienen el mismo tipo de efectos secundarios”. Cuando no se atiende, una migraña puede durar entre 4 y 72 horas. Éste es el primer dispositivo médico cuya comercialización fue permitida por la FDA para aliviar el dolor de cabeza ocasionado por una migraña precedida de un aura. ¿Cómo funciona? Usando ambas manos para sujetar el dispositivo contra la nuca, el paciente presiona un botón que libera un pulso de energía magnética muy corto (de menos de un segundo) para estimular la corteza occipital (la parte posterior del cerebro que procesa la información visual). La tecnología del Estimulador Magnético Transcraneal (TMS) del dispositivo Cerena ha sido estudiada por bastante tiempo ya, pero no fue sino hasta hace poco que se autorizó para usos clínicos específicos. Cefaly es el primer dispositivo de neuroestimulación eléctrica percutánea (a través de la piel) o TENS, por sus siglas en inglés, al que la FDA concedió la comercialización para usarse antes de la aparición de una jaqueca, como un tratamiento preventivo para los dolores de cabeza de la migraña en pacientes de 18 años de edad en adelante. Los pacientes pueden usar Cefaly todos los días, y el tratamiento ha demostrado reducir el número de días en los que las personas experimentan migrañas. La tecnología TENS se ha usado como tratamiento para el dolor en general, pero ésta es la primera vez que se ha autorizado como una medida preventiva para la migraña. El dispositivo portátil de baterías Cefaly se asemeja a una diadema de plástico para la frente. El usuario se pone un electrodo (un parche) en la frente, conecta la diadema de plástico al electrodo y el dispositivo emite entonces una corriente eléctrica para estimular uno de los nervios largos de la cabeza (el nervio trigémino), el cual se ha relacionado con las migrañas. “Es una terapia de tiempo fijo: funciona por 20 minutos y se apaga automáticamente”, explica Hoffmann. Los efectos secundarios de ambos dispositivos incluyen irritaciones de la piel, malestar, somnolencia, mareos y dolor

en el lugar de uso. Se informó con poca frecuencia de estos problemas y fueron resueltos pronto, aclara Hoffmann. En una encuesta telefónica en la que participaron más de 2,000 usuarios europeos del Cefaly, 95 por ciento no tuvo queja alguna sobre el uso del dispositivo. No obstante, la seguridad y eficacia de estos dispositivos no ha sido establecida entre ciertos grupos, como los niños, las mujeres embarazadas y las personas con marcapasos. Limitaciones de los medicamentos para la migraña Hay muchos medicamentos para reducir el dolor y los síntomas de la migraña. “Aunque estos medicamentos para la migraña son bastante eficaces, no a todos les vienen bien. Algunos pueden causarte cansancio, somnolencia o mareos; otros pueden afectar tu proceso mental; y algunos medicamentos contra la migraña pueden ocasionar defectos de nacimiento, de modo que las mujeres embarazadas no pueden usarlos”, advierte el Dr. Eric Bastings, M.D., neurólogo de la FDA. “Es importante tener en cuenta que los dispositivos médicos también tienen algunas limitaciones, y que no se ha establecido la seguridad y eficacia del Cefaly y del Cerena entre ciertos subgrupos, incluyendo el de las mujeres embarazadas”. Estos betabloqueadores, que reducen la frecuencia cardiaca, se utilizan principalmente para tratar afecciones cardiacas. “Estos medicamentos no son para los pacientes de migraña que padecen asma, ciertos problemas pulmonares o una frecuencia cardíaca lenta”, advierte el Dr. Bastings. Consejos para los pacientes de migraña Las migrañas con frecuencia son subdiagnosticadas y subtratadas. El Dr. Bastings recomienda a los pacientes que le cuenten a su prestador de servicios de salud sobre sus dolores de cabeza, y que consulten con un médico especializado en migrañas si no consiguen el alivio adecuado. “Los médicos deben estar al tanto de los medicamentos aprobados para la migraña y de las opciones de tratamiento alternativas”, agrega. Estos dispositivos presentan otra alternativa de la que los pacientes pueden hablar con su médico, señala Hoffmann. “Ahora los pacientes tienen más opciones, y ojalá que puedan encontrar la que mejor les funcione”. What Is “Environmental Justice” and How Is It Under Assault in the New Administration?

Roddy Scheer & Doug Moss EathTalk Environmental justice is defined by the U.S. Environmental Protection Agency (EPA) as “the fair treatment and meaningful involvement of all people regardless of race, color, national origin or income, with respect to the development, implementation and enforcement of environmental laws, regulations and policies.” In layperson’s terms, it means making sure specific groups of people don’t bear a disproportionate burden from potential and existing environmental threats. Traditionally, we think of situations like the siting and construction of a pollutionspewing factory in or near a low-income minority community as an example of an environmental injustice. Some recent examples ripped from the headlines include the lead contamination of the water supply of predominantly African-American Flint, Michigan, and the siting of the potentially hazardous Dakota Access Pipeline adjacent to sacred and ecologically sensitive Standing Rock Sioux tribal land. “The federal government has recognized for decades that air and water quality are especially poor in low-income areas and communities of color, and some of that imbalance stems directly from government permitting decisions, such as where to allow the dumping of toxic materials,” reports the Natural Resources Defense Council (NRDC), a leading environmental advocacy non-profit. Environmental justice has been a hot topic lately as it relates to who bears the brunt of climate change impacts. According to EPA research, city dwellers and the poor are among the Americans most likely to suffer from climate change. NRDC points

out that 24 to 27 percent of urban AfricanAmericans, Latinos and indigenous people in the U.S. are now living below the poverty line, compared with only 13 percent of urban whites—meaning that minority groups are at the greatest risk from the heat waves, bad air, stronger storms and other negative consequences of a warming climate. The federal government has been working on environmental justice issues since at least 1992 when then-President George H.W. Bush created a White House office dedicated to “environmental equity.” Bill Clinton took up the mantle when he assumed the presidency in 1994 and issued Executive Order #12898 calling for the federal government to identify and address “disproportionately high and adverse human health or environmental effects of its programs, policies and activities on minority populations and low-income populations.” Clinton’s order created the Interagency Working Group on Environmental Justice to coordinate and oversee implementation of the rule across different federal agencies, and spawned the Environmental Justice Small Grants Program, which has awarded upwards of $24 million since then in funding to more than 1,400 community-based and tribal organizations working in communities facing environmental justice problems. But that all is likely to change now that Donald Trump has proposed slashing the EPA’s overall budget by $2 billion and cutting funding for environmental justice programs specifically by 78 percent, from $6.7 million to just $1.5 million. “These cuts are a direct attack on lowincome communities and communities of color everywhere who are on the front lines of toxic pollution,” says NRDC’s environmental justice head Al Huang.

A NIGHT FOR SELENA, A NIGHT FOR GOOD TIMES Sonido Clash brings back its celebration of Selena for a third time

or another their historical experiences are shared. In the case of Selena Tribute Night 2016, Fernando remarks, “well, we weren’t expecting to have a line all the way down the street. And then to see that, people were even asking if there were any extra tickets or any opportunities to get in and that was something we wouldn’t of expected to have for the second one but it shows the need for events that are representing our icons and I think the things that we learn too, naturally. People pass the word on but we also have to find spaces where there aren’t.” Another one of the differences that caught the group by surprise was just how much all walks of life love Selena. “There was a different generation that we saw, not the young 21 crowd, but people who were probably alive when Selena was, they showed up. That was a surprise and maybe this year because we have a different selection of artists maybe we’ll have other groups in San José that will come out”, says Perez. The Selena Effect

If you weren’t able to make it to last year’s Selena Tribute Night thrown by Sonido Clash (SC), This is what you missed: Eclectic music, an energetic Selena impersonator, Selena look-a-like contest, great vendors and of course, the photo booth. “People love to get their photos taken,” says SC's Fernando Julian Perez, and it's so true.

Fernando Julian Perez and Quynh-Mai Nguyen were around to be the voice of the collective this time around, reminiscing about their last few months, as well as the now and future.

As it stands, the San José based collective of musicians, videographers, artists and community collaborators throw some of the South Bay’s most infectiously fun parties, and although they continue to grow and are starting to branch into community activism and providing curriculum for community members, they still like seeing people just plain have fun. In its third year, the annual Selena Tribute Night has gone through various tweaks in its two initial outings. Now, SC feels they’ve figured out a good recipe for this DIY festival celebrating the Latina Tejano Music Queen, Selena Quintanilla, whose

Perez, and Nguyen both wear a ton of hats as is the SC do it yourself way of life. Nguyen is the resident artist, Perez the videographer, producer, and both are organizers, just to name a few of their duties. Both are committed as is the rest of the group, to bringing the unique Selena night to fans and putting on the best show they possibly can.

The initial draw to the tribute night is the idea of being able to centralize one's admiration for the music of the singer all night long. And it happens through artists playing their own interesting takes on her songs, as well as the aura of what she encapsulates through the night. Being there is what a 'Selena vibe' feels like. Perez says, “basically, that’s why we selected these folks (artists) too, to give another representation of sounds, so it wouldn’t be just catered to the Latino community it also exposes people to the hip hop sounds, or electronic music future world sounds.” Nguyen also feels that the connection through generations to Selena adds a hook to the party line. “I had my friend who teaches middle school, she has one student who loves Selena and when she heard that there was a Selena tribute, she was like ‘oh, I wish I could go!’ and my friend said ‘oh yeah, but it’s in a bar’. Just the fact that being able to tap into different generations with someone whose iconic like Selena, that speaks volumes. And knowing in the beginning with the first event, that was really any other Selena tributes but after the second, now third, we heard of so many popping up, which is really cool.” Perez adds, “like recently there was a Selena cruise? People on a boat!”

When asked about their experiences from year to year, there's a lot of back and forth about how amazing it is to expand and the people that discover them through word of mouth. At the core of these to and fro's is the idea of art and culture that unites many generations, and that in some way

Perez says, “we had to turn people away and that sucked, but we have a fire code we have to obey. We want people to have it as another memory, definitely

people that have never been to a Sonido Clash event. So hopefully they become supporters of Sonido Clash, because we will continue to bring artists.” Nguyen says, that the opportunity for these events to help artists collaborate and show their talents is one of the greatest achievements in building these parties and networks and creating fans. “It’s not just strictly music, it’s like art incorporated in a venue where most people just come to dance to the music. But when you have vendors there, it’s showing that there’s that community support behind it. Sonido Clash, it’s a community, not just music but art. For me I hope that this just keeps going. It’s like a tradition.” On the social media side, the fans are ready and the optimism is high. “Every year I see on the comments, “oh, we can’t miss out on this year, we gotta go” and tagging saying, “are we gonna go?”. It’s nice to see that, it’s nice to see the excitement. Because when the night actually like happens and you see everybody dressed up, dressed in Selena costumes, it’s just fun”, says Nguyen. The Future Recently SC was invited to CSU Monterey Bay to speak to students about the merits and work behind being entrepreneurs. “What we were able to do is take our passions, and maintain our work, but give these young people the idea that they can also go forward and change the communities you live in, and go back to the communities you live in”, says Perez. He also states that that experience in Monterey helped highlight the idea that they are moving forward, and beyond just he music scene. “We’re not just some party crew, not just some event, we’re doing presentations and innovating stuff, we’re working with nonprofits to present payday lending campaigns and beyond the music as well we’re trying to become leaders in the community to support other campaigns. So you might see us someday, not just in the club, but presenting to young high school students about the opportunities that they have.” And until their next endeavor, this next SC event will be in a club. Nonetheless it will be a knowledgeable and good time focusing on the many elements that made Selena so loved; like her music, her fashion, and her effortless sense of self. There will be dancing, there will be laughter and probably some tears when the right song hits. But it's all good, anything for Selena(s). More info at sonidoclash.com. Advocates for Calif. Immigrants Warn: Be Prepared Suzanne Potter California News Service

SACRAMENTO, Calif. - Advocates for California immigrants are speaking out, educating people on their options in light of the Trump administration's increased enforcement actions. On the campaign trail, Trump had threatened to revoke Deferred Action for Childhood Arrivals (DACA), the program that allowed temporary work permits for about 750,000 people brought to the United States as children, but it remains in place so far. However, enforcement officers now can detain undocumented people with no criminal history aside from immigration-related offenses. Mariam Kelly, senior immigration attorney and DACA program supervisor for Community Legal Services in East Palo Alto, said the best way people can protect themselves is to explore all their legal options. "I cannot stress enough, they can get a legal screening from a qualified immigration attorney," she said. "I'm going to say that maybe 10 percent of my clients are eligible for some other form of relief, other than DACA." Some people may qualify for special immigrant juvenile status, for a "U-Visa" as a victim of a

crime, or can petition to stay with relatives who are U.S. citizens. However, Kelly warned that it is unwise for anyone with a prior criminal or immigration-related offense to apply for DACA or to try to renew it. Attorney Martha Ruch, an Equal Justice Works Emerson Fellow and staff attorney for the group Asian-Americans Advancing Justice-Los Angeles, said everyone on U.S. soil has rights, even those who are undocumented - including protections against unreasonable searches and self-incrimination. "So, it's crucial that everyone know that if they're being questioned, they should not reveal their immigration status to immigration officials and - to a large extent - to police," she said, "and to say that they are asserting their right to silence and will not sign anything until they consult with an attorney." Ruch said once a person is detained, having an attorney familiar with his or her case can make a big difference. She also advised people at risk of being detained to make an emergency plan, designating someone to care for children or elderly parents. Other tips: Insist on seeing a warrant before allowing officers to search a home, car or business. Also, a person should never carry foreign identification papers.

Carlos Aylagas is a young Salvadorean actor who has started to venture in the world of international cinema and acting. Carlos was born in San Salvador, El Salvador, and from a very young age had dreams of being an actor, which he has accomplished. He began his acting training in Los Angeles, and with the passing of time doors have opened for him, commented the actor. During the month of May, we can watch him act on HBO in a short film titled “2500 Kilometers”. This short was filmed in Guatemala, where he was chosen as one of the main characters. This miniseries explores current issues such as domestic violence and how this pushes many Central American women to try to emigrate to the United States and other countries, fleeing from the violence that is currently happening in several countries there. Carlos also told us that he is a co-author of a book titled “El país que viene”, which was published in El Salvador, and that he will participate in the movie “La Palabra de Pablo”, which is currently in the process of production. IMDB ADDS 'F-RATING' TO RECOGNIZE WOMEN IN FILM “Below Her Mouth” Is One Of The First to Receive Rating

IMDb (Internet Movie Database), the world’s largest movie website, has adopted a new 'F-rating' to highlight films that are directed by women, written by women, and/or pass the Bechdel test – meaning they feature a conversation between women that isn't about men. The accreditation, which aims to support and promote women and redress the imbalance in the film industry, has so far been added to over 21,000 titles on the website, making it easier for users to search for films and TV programs which feature women in a significant role. Among the films credited are “Girl on the Train", which was directed by Erin Cressida Wilson, "Gentlemen Prefer Blondes," which was written by Anita Loos, and 2016's "Ghostbusters," which has 36 scenes which pass the Bechdel test. A film, TV program or book is said to pass the Bechdel test if it features scenes in which two or more women or girls talk to each other about something other than a man or boy. April Mullen’s "Below Her Mouth", which will be released on April 28th by Gunpowder and Sky Distribution, is among those to receive a triple-rating for featuring a female director,

writer and lead. The film, whose writer, director, producer, and cinematographer are women, was shot with an all female crew and stars two female leads. In "Below Her Mouth", Jasmine (Natalie Krill) is a successful fashion editor living with her fiancé, Rile (Sebastian Pigott). On a night out in the city with her best friend, she meets Dallas (Erika Linder), a roofer recently out of a relationship. Surprised by the confidence with which Dallas pursues her, Jasmine turns Dallas down – but can’t get her out of her head. When Jasmine finally succumbs, the two women embark on a steamy affair that forces them both to reevaluate their lives. IMDb becomes the latest film organization to feature the rating, which was created in 2014 by Holly Tarquini, director of the U.K.'s Bath Film Festival. Should We Have Internet Privacy Laws? Should we have Internet privacy laws? What should we protect? Are privacy laws antithetical to a free and open Internet? Or would a well-reasoned set of privacy rules provide a level playing field and fertile ground for commerce and communication? Under this administration, it looks like whatever laws are in place will remain in place. Whatever proposals can be nullified seem to be fair game. For those who supported the previous administration’s worldview, it’s time for a new strategy.

I do not endorse any of the following products, but I pay for and use some of them. They all work as well as consumer-grade systems can work. If you feel like you will be safer using a VPN or encrypted email, here’s a short list of options:

Regardless of what you may have recently heard about joint resolutions or nullifications, nothing has changed. Internet Service Providers (ISPs) have always had the right to use your data as they see fit, within a few Federal Trade Commission (FTC) and Federal Communications Commission (FCC) parameters. This has not changed. And you have given FANG (Facebook, Amazon, Netflix, and Google) the right to use your data as they see fit (with a few privacy policy exceptions and within the few aforementioned FTC and FCC parameters). So regarding online privacy, for all practical purposes, absolutely nothing has changed. What About S.J.Res.34? Update: On April 3, 2017, the president signed S.J.Res.34, a joint resolution that nullified the FCC’s “Protecting the Privacy of Customers of Broadband and Other Telecommunications Services” rule. But the FCC rule never went into effect. So net/net, nothing has changed.

On the other hand, you pay for Facebook and Google with your data, so as the cliché goes, “YOU are the product,” and you should not have any expectation of privacy (other than what’s written in the user license agreement or Privacy Policy of the respective sites). As for Amazon and Netflix, you pay with both cash and data. But you can rest easy. Both Amazon and Netflix only use your data internally. While they offer insights to certain vendors, sponsors, and suppliers, the amount of actual data they make available to 2nd or 3rd parties is negligible. Short Term In the short term, all of this is meaningless. ISPs don’t make money selling your data (although they could), and most of them do not yet have an effective way to sell advertising. They make money by charging you for Internet access. FANG literally lives on your data. Without it, FANG would be severely disabled. But you already grant them the rights, so nothing has changed.

There’s more at stake than online privacy. The concepts of Net Neutrality and a free and open Internet and a set of reasonable rules that promote investments and reward investors are not mutually exclusive. We should strive for consensus. Regardless of your personal preferences, you should contact your elected officials and let them know your thoughts. When discussing online privacy, remember the Internet not only transports your smartphone and web browser data, it also transports your banking data (from bank to bank), your health records (from doctor to hospital), autonomous vehicle data, Internet of Things data, municipal sensor data (such as water meters and weather data), and every other type of data that we create by interacting in a completely digital world. VPNs & Encrypted Email Since the joint resolution passed, I’ve had a remarkable number of questions about Virtual Private Networks (VPNs) and email encryption, as if suddenly there’s a new need for these services. (BTW: We’ll discuss online privacy vs. online security in another article. They are not the same thing.) If you didn’t need a VPN or encrypted email

Long Term What Does This Mean? One side will tell you that the FCC rule was overly burdensome for ISPs because they would have had to obtain opt-in permission from each customer to use the customers’ data. The other side will tell you that the FCC rule was absolutely necessary because ISPs have access to 100 percent of your online activity while FANG can only see what you do on their respective sites. Most of the explanations from elected leaders failed to mention that you pay hard currency to your ISP for access to the Internet. Therefore, you would expect some privacy options (even if those options were offered at a premium price).

Long term, things will change. There are many probable futures. One of them is not the passage of the previously proposed privacy rules by the FCC. What has changed is the method we will use to draft and legislate privacy policy. It is a non-trivial matter and is, and will continue to be, a topic which inspires vigorous debate. In a data-deregulated environment, ISPs are free to develop all kinds of new capabilities as the technologies become practical. We might see “intelligence layers” between us and the networks. Hypothetically, this type of AI would know where you are, where you are likely to be, what you like to do, when you like to do it, etc. In practice, it would be used to sell you stuff. It could also be useful for autonomous vehicles
