FACEBOOK, INTERNET PERSONAL PROFILES, & NET NEUTRALITY ISSUES this will be a bipartisan effort.

Hilbert Morales EL OBSERVADOR An article entitled, “Tech Chiefs Get a Bit Older and Wiser,” (author: Kevin Roose, New York Times Large Print Weekly, March 26, 2018, p 18) presents a perspective which may not be addressed at all by those members of the U.S. Congress who will have questioned Facebook's founder & CEO Mark Zuckerberg this past week. The issue being faced is that 87 million personal profiles were allegedly accessed by Cambridge Analytica who mined that personal profile information without the prior approval of individuals (who were not asked to opt in or opt out). But do recall that a credit firm recently 'lost' 125 million personal credit history profiles. I am certain there are other such incidents. These are humongous numbers of personal profile information. Personal privacy expectations have been breached. Why are they of such great interest? The reason is not often discussed by the general public whose members think mainly in terms of their own personal experiences. But to those who want to make profits using that information, this unapproved access to that humongous data base of personal information represents an opportunity to ‘strike gold'!

Cybernetic technology and its algorithms makes it possible to 'mine' that humongous pile of personal profile data to identify the traits and characteristics of consumers and how they choose to spend their money. A certain number of these personal profiles becomes 'a high potential consumer unit' which may be sold to a purveyor of particular goods or services. These individuals may be directly targeted. I am certain that during the past 2016 presidential campaign, Russian oligarchists allegedly financed operatives whose base was located in St. Petersburg, Florida. They were able to gain illicit access to the data bases of the DNC as well as several registered voter data bases in counties throughout America. Thus, these operatives had the capability to specifically target, with their well-crafted FAKE NEWS or ALTERNATIVE INFORMATION ad placements with specific targeting to communities and their registered voters, thus influencing to an unknown scale, the outcome of that 2016 presidential election. The FBI and others, responsible for monitoring these unlawful interferences directed at the American Democratic voting process, did call attention to what was going on, but were ignored. SO NOW, THE U.S. CONGRESS 'IS VERY INTERESTED' IN MITIGATING ANY INTERFERENCE WITH THE COMING MIDTERM ELECTIONS BY ANYONE. Hopefully

Five years ago, there was no talk about sympathy, empathy, ethics, or moral responsibility. This industry's largest firms have become mature, bureaucratic businesses whose daily decisions about issues such as 'global information wars', privacy, diversity, corporate altruism, and sexual harassment are extensively scrutinized.” “The idea that a product could make your life worse was not

We acknowledge that now and are determined to find holistic and fair solutions.” “Maureen Taylor, a leadership communications expert, says, “This kind of earnest selfexamination was becoming more frequent among founders. As you get older, you realize your responsibilities are bigger. People are

becoming very thoughtful about the ramifications of technology and remembering that the whole point was to make the whole world a better place.” “You become more responsible when you have more to lose,” said Mr. Malik. The Federal Communications Commission (FCC) needs to sustain Net Neutrality if social media networks such as Facebook, Twitter, YouTube, etc. are to continue to develop as a means of connecting people with each other. Equal access and level of speedy service are essential to 'letting the world's people connect with each other as a matter of their choice rather than that of oligarchists or dictators. I viewed the initial two hours of CNN's broadcast of Mark Zuckerberg's interactions with several U.S. Senators who posed questions. I was impressed by his candor; by his admissions that social media networks needed reasonable, workable, and acceptable monitoring and regulations. His responses parried those questions posed in a confrontational manner by those elected officials who were trained adversarial interrogators. His calm confident leadership displayed well. His willingness to have Facebook's expert teams available and accessible communicated that solutions would be devised and would minimize the ability of anyone to influence the coming 2018 Midterm elections.

The United States’ national graduation rate rose to record highs in 2017. The Problem Nevertheless, there are still approximately 34 million American adults who do not have a high school diploma. Why A Diploma Matters On average, individuals with a high school degree can expect to earn 30 percent more than adults without a diploma over their lifetime, a difference of nearly $10,000 per year, according to U.S. Census data. For many individuals, completing their high school education as an adult is just the beginning of their road to a college degree or new career. Where to Find Free Classes Studying while balancing work and family may seem difficult, but help, advice and inspiration are close at hand. Each adult education center will work with new students to place them in the right classes and create a custom learning plan. Teachers and tutors in each program help students learn the material and support them as they earn their diploma. If you or someone you know doesn’t have a high school diploma, visitwww. FinishYourDiploma.org to find a nearby center and get started with classes. New PSAs feature personal stories from recent graduates who earned their high school diplomas in their 20s, 30s and 40s. This semi-annual event is designed to promote civic education and foster an environment which encourages learning by encouraging voter registration and participation in all elections by all eligible Californians. The resolution, which is supported by Assembly Bill 1817, encourages Santa Clara County Schools to participate in California High School Voter Educations weeks which run the last two week of April and September. Research by the Public Policy Institute of California indicates that 30-percent of voters in California lack confidence in elections and politics. BEWARE OF SCAMS WHEN PURCHASING A PUPPY ONLINE

One of the first places prospective puppy owners turn for research is the Internet. However, a BBB International Investigations Initiative study, “Puppy Scams: How Fake Online Pet Sellers Steal from Unsuspecting Pet Buyers,” warns of the risks associated with purchasing a pet online. The study estimates that tens of thousands of consumers in the U.S. and around the world may have fallen victim to online pet purchase scams, with prospective buyers losing anywhere from $100 to thousands of dollars each to the thieves. Puppy scammers often build websites using stolen pictures and content from legitimate breeders or other online sources and advertise pets for a lower price than the breed usually costs. They promise to send the adorable puppy after they receive payment, often through wire transfer. The fraudsters often continue to ask for more and more money, potentially for “shipping crates”, “vaccinations”, or “insurance”. The puppy seldom arrives.

Did you celebrate National Puppy Day on March 23? The adorable pictures all over social media almost convinced me to adopt a furry friend of my own – but I decided that I didn’t want to risk upsetting my cat. Although puppies are wonderful, it’s unwise to adopt one on impulse.

Don’t be in a hurry when deciding to bring a dog in to the family. When you don’t take time to research and think it through, it can make you more vulnerable to scammers or regrettable purchases. Scammers exploit emotions tied to puppy adoption or purchase. You can avoid these heartbreaking scams and find a good fit for your home by carefully researching breed characteristics and adopting a dog from a trustworthy seller, breeder, or rescue shelter.

A Vallejo woman reported a similar account to BBB Scam Tracker this January. She purchased two toy poodle puppies from a website and paid using Western Union. She was then told by the “shipping company” that she had to pay extra because her “puppies needed special crate and pet insurance as dictated by animal control.” Her puppies never arrived, and she lost $3,800. Most scammers discovered in this study were found to be located in the West African country

of Cameroon and were using sponsored links on search engines to target potential victims. In fact, the study found that at least 80 percent of the sponsored advertising links in an Internet search for pets may be fraudulent. In all, there may be hundreds or even thousands of fake websites offering pets for sale and using fabricated or stolen imagery and wording. According to the BBB Scam Tracker Annual Risk Report, online purchase scams were the riskiest scam to consumers in 2017. Pet purchases were one of the most common online purchase scams. In 2017, consumers filed more than 200 complaints with BBB against dog breeders in the United States and Canada. Complaints sometimes involved purchasing sick dogs and then having difficulty in obtaining refunds or reimbursement for vet bills. Prospective dog owners should avoid impulse purchases or adoptions. STATE AUDIT REVEALS ALARMING PRACTICES BY COMMUNITY CHILD CARE COUNCIL OF SANTA CLARA COUNTY (4CS) Report Claims 4Cs “Disadvantaged Some Families and Misused State Funds” their child care services terminated. “I feel betrayed that Santa Clara families are suffering because of 4C’s disgusting misconduct,” said Valentina Renales, a 4Cs parent from San Jose. “Why should 4Cs be allowed to deny crucial care to young children and take advantage of vulnerable, hard-working families? As one of the people who initially pushed for this audit, I am hopeful that these results are the first step in finding a solution to 4C’s bad behavior.”

Howle released a report on April 5, 2018, detailing questionable and unfair practices by the Community Child Care Council of Santa Clara County (4Cs). 4Cs is the largest non-profit agency that serves as a link between families and child care providers in the County of Santa Clara. For thousands of working families, all roads to affordable child care lead through 4Cs. The results of the audit reinforce what 4Cs employees, Child Care Providers, and parents have been saying for years, including how 4Cs: • Unfairly disrupted and terminated services to some families; • Terminated a preschool program to seemingly avoid further scrutiny; • Misused state funds; • Paid providers late, creating unnecessary financial hardship for them; • Engaged in questionable management of its employee retirement plans. The state audit outlines 4Cs’ pattern of inaccurately backdating their Notice of Action forms to families, which allowed them to avoid paying potential penalties for giving parents inadequate time to respond. This practice of backdating Notice of Action forms also created deadlines that the State Auditor called “unreasonable,” and which led to “to certain families having their childcare services terminated unjustly.” “The findings of the state audit are very troubling. I am highly concerned that the audit determined families had their child care services unjustly terminated by the 4Cs, an action that impedes the continuity of care and education of their children,” said Senator Jim Beall, who requested the audit at the Joint Legislative Audit Committee (JLAC) hearing on June 28, 2017. In one example, the State Auditor explained how 4Cs created a notice of possible termination on March 7, 2017 that contained a deadline of February 20, 2017 for the family to respond by. This deadline, which occurred over two weeks before the notice was even created, resulted in two children having

Employees at 4Cs have also suffered from the organization’s mismanagement of state funds and suspect administration of their retirement plans. There is currently a lawsuit pending against 4Cs by a group of current and former employees which alleges that 4Cs failed in its responsibility to exercise prudent judgment of how assets would be invested. “We’d like to thank Senator Jim Beall and Assemblymember Ash Kalra for bringing forward the request for this audit, as the audit report clearly shows that the families in Santa Clara are not being served and that our concerns are valid,” said Virgilio Gonzalez, a Family Fee Specialist at 4Cs and SEIU 521 member. “By working together as a union, 4Cs employees are the ones who first flagged these problems. Along with providers and parents, we must have a voice in finding solution to the problems unearthed by this audit.” The state audit also identified a pattern of 4Cs not paying their Child Care Providers on time for the services they’ve provided. In some instances, delivery of late payments extended as far as 16 days. These late payments jeopardize the ability of providers to continue offering care to Santa Clara families.

LOS ANGELES - Thousands of people were improperly removed from California voting rolls in 2017, possibly due to an administrative error, says a California coalition for people who are or have been in prison. On Wednesday, the "All of Us or None" coalition sent letters demanding restoration of voting rights to agencies in ten counties, including Butte, Contra Costa, Kings, Los Angeles, Orange, San Diego, Santa Clara, Solano, Tulare and Ventura. Staff attorney Brittany Stonesifer with the group Legal Services for Prisoners with Children - part of the coalition - says the counties are failing to comply with a law that took effect in January 2017. It clarified that people sentenced to county jail or parole retain their voting rights - and only those currently in state prison or on state parole for felonies lose the franchise. "And the primary demand was to restore improperly removed people from voter registration, to fix their systems to make sure that that doesn't happen again, and to send notice to people who were improperly removed," says Stonesifer, "so that they have an opportunity to re-register and to turn out to vote in time for

A 2011 prison realignment law decreed that people with non-serious, nonviolent, nonsexual felonies be sentenced to county jail, not state prison. Confusion over that group's right to vote led to lawsuits, and then the law clarifying their voting rights. The coalition cross-referenced public records and found in L.A. County alone, more than 3,000 eligible voters were dropped in 2017. The L.A. County Registrar of Voters' issued a statement saying it has a longstanding partnership with the re-entry community, is committed to upholding voting rights, will look into the claim and resolve any concerns. Stonesifer calls this a civil-rights issue that must be addressed to maintain a functioning democracy. "This is a historical problem," says Stonesifer. "You know, people who have convictions are disproportionately lower income, and people of color have been historically disenfranchised in the United States. So, this just feeds into that long history of disenfranchisement." She notes that multiple studies have shown that people who retain their right to vote after incarceration have a stronger sense of civic responsibility and are much less likely to end up behind bars again.

It also reveals that 4Cs improperly spent $6,859 in state grant funds to fight the efforts of their employees to form a union and speak out against the organization’s many improprieties. As usual, the main Mexican presidential candidates do not look like the 90 percent of Mexicans who are either full-blooded Indian (30%) or the mixed Mestizo (60%); they look like the Spaniards that arrived in Mexico 499 years ago. Andres Manuel Lopez Obrador (AMLO) – leftist former mayor of Mexico City is the candidate of the MORENA party he founded so he could run for President again, he leans to authoritarianism, offers the possibility of full amnesty for drug cartel members and formation of national armed force “creating a federal public security department and a national guard incorporating both police and military forces…(but)There will be no torture in our country…Lopez Obrador also criticized Trump administration plans for what he called an ‘unnecessary’ wall along the U.S.-Mexico border.”

Raoul Lowery Contreras Special to El Observador On a sunny February day in 2007 in Tijuana, Mexico, I was standing on world-famous Revolution Avenue among countless stores and stands selling tourist merchandise the street had sold to millions of Americans over the years, smoking a Cuban cigar that was illegal two miles north in the U.S.A. Suddenly, a mass police presence descended on the avenue blocking off crossing streets with squad cars and motorcycles. Rumbling from east of downtown Tijuana came a Mexican Army convoy led by U.S. made Humvees followed by twoand-a-half-ton Army trucks carrying a regiment of Mexican soldiers in their desert camouflage uniforms carrying American-made M-16 assault rifles. They had been ordered into Tijuana by newly-elected President Felipe Calderon to disarm and replace the notoriously corrupt Tijuana police force that had engaged in a noontime gun fight on the main street with state judicial police protecting a rival drug cartel. It was brazenly attempting to poach Tijuana from the then infamous Felix Arrellano

drug cartel that supplied illegal narcotics to California, Las Vegas and the West Coast. Since that day in 2007, 80,000 people have died in the Mexican war on drugs that started that day I smoked a Cuban cigar on Revolution Avenue. That is more than all the Americans killed in a similar 12 years in Southeast Asia, in Vietnam. Like the ineffective U.S. war in Vietnam, the Mexican government has little to show for its campaign against the drug cartels. It has been unable to end the massive corruption fueled by drug cartels. Why? Because they have voluminous cash resources derived from the $20 to $30 billion Americans spend on cartel produced and distributed narcotics. The massive body count has deeply affected Mexican politics and is part of the coming Mexican political campaign that will elect a new president and congress (500 deputies, 128 senators) and over 2,800 local and state officials on July 1. National crime and corruption join petroleum, the economy and poverty as issues. Added in: young Mexicans are concerned with “impunity” of criminal office-holders.

Ricardo Anaya is the candidate of the Center Right P.A.N (National Action Party) party that broke the 70 year-long one-party dictatorship of ruling PRI party in 2000 when Vicente Fox won the Presidency which Felipe Calderon repeated in 2006. Actually Anaya is a coalition candidate of the PAN and the leftist PRD (Democratic Revolutionary Party) party that twice nominated AMLO for president in 2006 and 2012. Anaya is a free enterpriser campaigning on economics and economic growth that is projected to make Mexico the 5th largest economy in the world in 2050. “To combat poverty, (Anaya proposes) to grow the economy by boosting competition and investment, and progressively increasing the minimum wage…The best social policy is economic policy, and well-paid jobs...At the right time I will say personally to the president of the United States, and I will say it in his language so there will be absolutely no confusion ... Mexico will not pay a single cent for that wall…" Interesting to Mexophiles is the fact that

In 2012 and 2006 Mexicans in the U.S. had to return physically to Mexico to vote at border voting stations. This time they can do it by mail. Los Angeles, of course, has the largest number of eligible Mexican absentee voters, Dallas is second followed by Houston, Chicago and New York City. So much has changed in Mexico since General Manuel Avila Camacho “received” 93.9 percent of the 1940 Mexican vote for President and his opponent, General Juan Andreu Almazan (who probably received close to 50% of the vote) officially received 5.7%. Caramba! Absentee votes from Mexicans living in the U.S. can decide the Mexican Presidency. And, some of these voters can be American citizens. SACRAMENTO, Calif. - Labor unions and consumer advocates are throwing their support behind a bold new bill in California to control health-care costs by creating a commission to set limits on what providers can charge. Supporters held a rally Monday April 9 in Sacramento to push Assembly Bill 3087, citing skyrocketing health-care costs. The bill, written by Assembly Member Ash Kalra, D-San Jose, would create an independent Cost, Quality and Equity Commission made up of many stakeholders, including providers, insurers and patient groups who would aim to stop price gouging while ensuring a reasonable markup for doctors and hospitals. "It takes into account a wide range of factors to ensure that the number set is appropriate, in order to actually pay for the services and allow our system to be sustainable," Kalra said. The system would be modeled on the way Medicare sets reimbursement rates, and on a similar system established in Maryland in

1971 that has given that state the lowest rate of hospital markups in the country. Opponents argue that government-mandated lower prices would drive doctors out of the state, exacerbating the current physician shortage and reducing access for patients. A recent report from the University of CaliforniaBerkeley showed that consolidation among health-care systems led to higher prices, even though it was supposed to make the system more efficient and thus, lower costs and improve care. But Kalra said now, more people are going to the doctor less frequently, to save money. "The data showed that consolidation has not led to a drop in prices - rather, what we've seen is an increase in prices and a drop in utilization," Kalra explained. "Consolidation is leading to higher prices, because they have more of a percentage of the market, so it's actually having a reverse effect." The bill also creates a system of appeals, giving providers a forum to argue for just compensation; and it introduces what is known as "global budgeting" for hospitals, a system intended to discourage unnecessary procedures and incentivize preventive care.

DOWNTOWN STREETS TEAM RECOGNIZED AS “BEST PRACTICE” MODEL FOR ENDING HOMELESSNESS IN CALIFORNIA League of California Cities and California State Association of Counties Report encourages communities to replicate innovative model locally SAN JOSE, CALIF. — Bay Area homeless services provider Downtown Streets Team (DST) has been recognized by the League of California Cities and the California State Association of Counties (CSAC) Joint Homelessness Task Force as one of the top five “best practices” organizations for providing innovative services and effective support to individuals in California experiencing homelessness. The announcement comes during a period of sustained growth for the organization, which just expanded into the California capital, Sacramento, its ninth Bay Area location. To determine which programs operated most effectively and efficiently, the joint city-county task force – which includes elected officials, municipal housing and homeless leaders, and city and county attorneys – spent 18 months examining how counties and cities in California have responded to the homelessness crisis. “Our homelessness task force spent more than a year looking at some of the best local programs that are helping people transition into supportive housing,” said Darby Kernan, Deputy Executive Director for Legislative Affairs at the California State Association of Counties. “Downtown Streets Team is one of those programs that is helping

people get off the streets and address the root cause of their homelessness, too. There are more examples highlighted in the task force report.” Downtown Streets Team members, all of whom are homeless or at risk of homelessness, each volunteer an average of 20 hours per week, removing debris and garbage, cigarette butts and used needles from streets, parks and public spaces. In exchange for their labor, Team Members receive stipends to assist with food, housing, phone service and transportation, among other basic needs. The key goal of the program is to provide work experience, job-readiness skills, employment opportunities and housing partnerships to ensure that people who are currently homeless or at risk of homelessness have the means to achieve self-sufficiency. “Homelessness is a complex, multi-faceted issue that we continually strive to address in a holistic manner,” said Downtown Streets Team CEO, Eileen Richardson. “Rather than design a program that targets one particular root cause of homelessness, our grassroots approach focuses on the many factors that can lead our neighbors into homelessness. We’re immensely honored to be recognized and look forward to partnering with more communities in the future.”

According to EnergySage, a solar information clearinghouse and matchmaker for 500-plus pre-screened solar installers, replacing a roof on a 3,000 square foot home in Southern California with another regular roof and then adding photovoltaic panels on top would run around $34,000 in gross costs all told

($8,000 for a new asphalt or slate roof and $26,000 for the photovoltaic equipment and installation). Of course, some solar installers will lease the panels to you, so you would just pay a smaller monthly fee akin to your old electricity bill. Meanwhile, gross costs for putting in a full Tesla Solar Roof top out over $50,000, a 33 percent price premium for the sleeker look and added cool factor. But given all the turbulence in the solar industry in recent years, Tesla customers are also happy to pay a premium for the peace of mind of knowing they are dealing with a company that won’t be going out of business anytime soon. But Tesla is far from the only game in town when it comes to so-called “building integrated” photovoltaics (BIPV). Forward Labs, a venture capital backed Silicon Valley start-up, has started installing its own integrated solar roofing systems around the San Francisco Bay Area and plans to expand beyond California in 2019. Unlike Tesla’s tiled roof design, Forward Labs’ “single-surface” look—more akin in style to a metal roof—features layers of solar cells and tempered glass that can take on any color the customer chooses. The start-up claims its solar roofing technology can produce almost double the energy output of Tesla’s tiles while costing 33 percent less. Mario Jiménez Castillo El Observador Él es un santo muy aclamado dentro del catolicismo, se le considera muy milagroso, algo así como una especie de 911 celestial. Muchos creyentes dan fe y testimonio de haber recibido milagros urgentes a través de la fe y devoción a San Expedito. Los fieles suelen rezarle novenas y le ofrendan velas y veladoras de color rojo o blanco, se considera estos colores como los predilectos del santo. Su fecha de celebración es el día 19 de abril, sin embargo, los fieles creyentes le celebran durante todo el mes. En varios países es reverenciado con procesiones y romerías que inician el primer día de la primavera. San Expedito, vivió a principios del siglo IV bajo el dominio del emperador Diocleciano, quien años más tarde le mandaría a asesinar. Era el comandante de una legión de soldados romanos. Por orden del emperador, fue sacrificado en Melitene, sede de una de las provincias romanas en Armenia. Su martirio ocurrió el 19 de Abril del año 303. A pesar de ser un soldado romano, encargado de defender el Imperio

de Roma, cierto día, la gracia de Dios tocó su corazón y se convirtió al cristianismo. A los tres días de haber iniciado la novena, ocurrieron cambios que le favorecieron, un milagro ocurrió, fue todo muy rápido, recalcó. Desde ese entonces se convirtió en una fiel creyente y les comenta a otras

personas acerca de los milagros de los que ha sido beneficiaria. Peticiones: se le pide por causas justas y cuando se necesita un milagro urgentemente. Muchos también le piden para tener suerte en los juegos de azar y la lotería. PHOENIX – Estamos en el Mes de Concientización sobre el Autismo y una organización sin fines de lucro busca que la ciudad de Phoenix sea líder en festejar a las personas con autismo. El complejo de apartamentos de First Place AZ próximo a inaugurarse en Phoenix central, es una iniciativa de la organización y su diseño fue concebido específicamente para adultos con autismo. Si bien en el centro de Phoenix es común el paisaje formado por condominios y apartamentos en construcción, el nuevo proyecto First Place AZ es único en su tipo. Consiste en un edificio de apartamentos con un costo de 15.3 millones de dólares que abrirá este verano, con un diseño especial para albergar adultos con autismo. El proyecto incluye numerosos elementos de seguridad y detalles novedosos de diseño como aparatos electrodomésticos silenciosos cuya función es minimizar la sobrecarga sensorial. Denise Resnik, fundadora y presidenta de First Place AZ, lo ve así: "First Place representa un enfoque innovador de la vivienda para la población especial. To round out FANG (Facebook, Amazon, Netflix, and Google), Netflix would own the largest data set reflecting user passions, and Amazon would own the largest data set reflecting user consumption. Tight regulation restricting the sharing of data outside these companies would create government-granted data monopolies on the four biggest data-driven currencies: aspiration, intention, passion, and consumption. Advertisers, sponsors, and content providers would have zero bargaining power against these data sets. Shelly Palmer Apple CEO Tim Cook and Facebook CEO Mark Zuckerberg have been all over the news this week. Mr. Cook has admonished Mr. Zuckerberg for Facebook’s current predicament and has been exceptionally self-serving proclaiming Apple’s data privacy policies as moral high ground. Before your eyes glaze over and you decide you are already a world-class expert in this subject, or worse, you think data is someone else’s issue, or much worse, you don’t think there’s anything you can do about your data, let’s review: Apple vs. Facebook Apple is a hardware company. It sells the most expensive computers and consumer electronics hardware you can buy. Because of its extreme pricing, Apple enjoys extreme profit margins. This is how it has amassed over $235 billion of cash on its balance sheet. Apple uses data to its benefit, and it has absolutely no need to make its data available to anyone for any reason. Apple makes more than enough money selling hardware. Apple also sells software and content. Both are profitable businesses. Apple doesn’t need to share any of that data with anyone either. On the other hand, Facebook does not sell hardware or software or content. It sells you. In order to do this, it provides you with all kinds of services you find valuable. When you agree to use Facebook, you are exchanging data that describes how you use Facebook’s platform and the related services (sometimes provided by third parties) for the right to use the services. Facebook has privacy policies. You may or may not like them, but they are articulated in the privacy section of Facebook’s interface and you can set them as you see fit. Could Facebook do a better job? Absolutely. I did my best to explain

some of Facebook’s issues in an essay titled “What Facebook Data Did They Get and What Did They Do?” Does Apple have a better business model than Facebook? That’s for shareholders to decide. But there is no way to make an “oranges to oranges” comparison between the two companies. What if Facebook Agreed Not to Share My Data with Anyone? How different would your experience be if Facebook decided that it would not share any data with anyone? The company would simply use the data it collects to support its business model, which is, selling you to advertisers, sponsors, and content producers. For all practical purposes, your experience on Facebook would not change. The algorithms the company uses to keep you engaged with the platform would still be continuously tuned to achieve better outcomes for Facebook’s shareholders. The content you see would still be valuable. The entire reason you use Facebook would not change at all. What Would Change? Everything! If the government regulates Facebook, the regulations will apply to every data-collecting entity that does business in the United States. With over 2 billion registered users, Facebook would own the largest data set reflecting user aspiration. Aspiration is a valuable currency that can be transformed into cash. Advertisers want to know what you aspire to, and you give that information to Facebook with every item (bit of data) you post, what you click on, read and consume on the platform. Google would own the largest data set reflecting user intention. You don’t intend to go to Google; you go to Google and tell it what you intend to do. Google has transformed the currency of intention into

Without the ability to leverage the data collected by large platforms, start-ups would need funding to purchase access. Maybe that’s a good thing. There’s lots of capital sitting on the sidelines, and perhaps the venture capitalists would enjoy a U-turn back to the days when start-ups actually needed money to start up. No matter how you look at this, the consequence of overzealous regulation will be the creation of a handful of de facto dataopolies. It would be wrong to call this an unintended consequence. It’s hard to

APRIL 13 - 19, 2018 imagine how government regulation could result in anything else. What to Do First, poke some holes in my theory. Beat me up over this and tell me where I’m wrong. But please, don’t get political here. Be an American, not a partisan. My thesis is that tight regulation of data and data privacy will result in de facto dataopolies – specifically, Facebook, Amazon, Netflix, Google, Apple, Microsoft, Salesforce, AT&T, and Verizon. And that while supertight regulation might protect some version of individual data privacy, the legislation would also be egregiously anticompetitive.
