THE PRESIDENT MUST NOT 'BE ABOVE THE L AW'

Hilbert Morales EL OBSERVADOR America has to thank Donald J. Trump for exposing a serious governance flaw which needs to be immediately addressed by the U.S. Congress and all political parties.

That flaw is that currently, certain legal interpretations are essentially, “whatever the President does is legal.” This interpretation of current law and the U.S. Constitution was first stated during the Nixon Administration in 1973. Former President Richard M. Nixon said, “WHEN THE PRESIDENT DOES IT, IT IS NOT ILLEGAL.” This statement is attributed to former President Nixon just after that Watergate incident. (Source: NPR, 05.14.17).

The Watergate burglary ordered

by President Nixon was that he ended up resigning to avoid certain impeachment by the U.S. Congress.

The Founding Fathers of America's U.S. Constitution were very concerned about the concentration of 'governing power' which led to the creation of a system of checks and balances between the U.S. Congress, the Judiciary (U.S. Supreme Court), and the Executive Branch of the U.S. Government, headed by the 'Office of the President'.

Presently, there are no effective measures which amount to checks and balances on the President

of the United States. Up to now, all has relied on the level of conformance to morality and ethics practiced by the individual elected to the Presidency. Donald J. Trump knows that whatever the President does is not illegal, because this loophole has never been 'plugged' by appropriately enacted laws and their standards or regulations.

HE KNEW HE WAS NOT VIOLATING ANY LAW WHEN HE REFUSED TO REVEAL HIS FINANCIAL AFFAIRS; WHEN HE APPOINTED FAMILY MEMBERS TO WHITE HOUSE POSITIONS (THIS IS NEPOTISM); WHEN HE RECEIVED AND ENTERTAINED FOREIGN DIGNITARIES AT HIS HOTELS OR GOLF RESORT FACILITIES. Allegedly foreign dignitaries are staying at Trump hotel and resort properties in order to curry favor.

Trump has allegedly profited from all these personal practices which are not prohibited by existing law and regulatory standards. 'We, The People', will end up paying for all of these actions which end up putting money, business permits and licenses, and 'prior privileged access to information' when his family members or loyal cronies are invited by this President to be present at meetings, state dinners, and other state events where public policy decisions are being discussed. Having this advanced knowledge and information often provides an opportunity to reduce business risks and to realize profitable business sequelae.

Today the Democratic Party is in the minority in both the Senate and the House of Representatives.

The U.S. Supreme Court currently has five justices who are proconservative and this judiciary check & balance only works when a legal case works its way through the federal court systems all the way up to the U.S. Supreme Court for adjudication. Simply stated, the conservative Republican Party controls and influences all three arms of the present U.S. federal government: the White House, the U.S. Congress, and the Judiciary. Furthermore, the U.S. Congress allegedly has been gridlocked by special interest DARK MONEY. And every commercial enterprise exercises its right to be a corporate individual which speaks through its special interest lobbyists coupled with election campaign contributions.

As I wrote this opinion piece, the Anderson-Cooper 360 CNN program (05.15.17) reported 'breaking news' in the form of a Washington Post report alleging that President Trump, during his meeting with Russia's Ambassador last week, revealed highly classified information which was not to be shared with anyone at any time nor any place.

May I suggest that Mr. Trump be oriented regarding the meaning of EMBARGOED? This journalism term conveys information which is not to be released to the public at all unless very specific criteria are met (date, time, 'need to know').

Maybe American intelligence agencies need to use 'embargoed' rather than 'classified' when divulging sensitive information to Mr. Trump. (My brother Guadalupe Morales served as a cryptologist during the Korean Conflict...He still will not divulge anything about his experiences as a cryptologist...even 65 years later!).

Reliable information is essential to anticipation and planning of national policy and the implementation of actions or responses.

Expert professionals can reverse engineer any statement to learn sources and methods used. Wall Street knows all about this and prohibits insider trading for the same reasons.

WHAT CAN BE DONE ABOUT THIS DIRE SITUATION? 'We, The People' must be willing to pay attention and be committed to having laws enacted which prevent these sorts of 'self-serving' outcomes from ever again endangering this unique democracy.

Each political party (especially Democratic and Republican) must establish enforceable standards which, if not complied to, result in the disqualification of an individual of ever becoming President of the United States.

These qualification criteria do not exist at this time. The approach taken today is whether or not this individual can get the votes needed to be elected.

Mainstream media executives must be held responsible for providing Trump with excessive publicity. Think of all those corporate TV executives who decided to focus on Trump so as to have high viewership numbers. The other 16 Republican presidential aspirants never received equal exposure time per FCC regulations.

In addition, neither party, Republican nor Democrat, set enforced standards of propriety. Trump was allowed to perform 'individualized character assassination' on each of his competitors, one at a time.

Where were those responsible for enforcement of violations? Trump

used profanities, confrontational language, bullying tactics, abusive language to women, ethnic and faith groups. The conduct of this election campaign reached a new low level in terms of decency and civility.

WHAT NEEDS TO BE DONE? First: The 'Emoluments' section of the U.S. Constitution must become fully defined. The U.S. Congress has the responsibility to achieve this by enacting appropriate laws defining standards which, if not met by a presidential candidate, result in disqualification. Candidates for the Presidency and VicePresidency must become totally transparent. Their IRS submittals must be subjected to scrutiny which exposes all potential conflicts of interest. A suggestion: Have a panel of Federal Judges having life time appointments become responsible for review in confidence of each candidates 'personal estate' and report their findings to 'We, The People'.

Laws which prohibit NEPOTISM in all its possible forms must apply to all elected officials, especially the President. The commission of a FELONY by a sitting President must result in impeachment. The commission of TREASON must result in IMPEACHMENT. IF AMERICA IS TO BE A NATION OF LAW AND ORDER, THEN NO ONE INDIVIDUAL CAN BE EXEMPT. THE PRESIDENT MUST BE SUBJECT TO ALL THE LAWS OF THE LAND. NO ELECTED OFFICIAL, ESPECIALLY THE PRESIDENT, CAN BE ABOVE THE LAW.

MUÉSTRAME TU HUMANIDAD Por José López Zamorano La Red Hispana La promulgación de la polémica legislación de SB4 de Texas, firmada por el gobernador Gregg Abbott a través de Facebook, donde no tuvo que responder preguntas de la prensa incómoda, detonó un tsunami de críticas no sólo de grupos de defensa de migrantes, sino también de organizaciones defensoras de las libertades civilices y hasta de autoridades de su propio estado.

Conocida como la ley “Muéstrame Tus Papeles” la ley que entrará en vigor el primero de septiembre faculta a los policías a actuar como agentes migratorios, prohíbe las ciudades santuario y obliga a las agencias estatales y locales del orden a acatar las órdenes federales de retención de migrantes.

“Esta es una medida draconiana, es un asalto a la Constitución de los Estados Unidos tratar de empoderar a todos los representantes no sólo de las agencias estatales sino locales… es una intrusión ilegal por parte del gobernador de Texas tratar de ser el agente migratorio”, afirma el abogado migratorio Silverio Coy. Su perspectiva parece ser compartida por la ciudad de El Cenizo que, acompañada de la Liga de Ciudadanos Latinoamericanos Unidos (LULAC), presentó la primera demanda en contra de ley. “La demanda es precisamente para detener la implementación de esta ley… que es discriminatoria.

Es importante reconocer que cualquier tipo de ley que ponga en riesgo la seguridad de nuestras comunidades debe de tomarse muy en serio”, declaró el alcalde de El Cenizo, Raúl Reyes.

A la primera demanda se sumará en los próximos días otra de la Fundación Mexicano Americana de Defensa Legal (MALDEF), uno de los grupos demandados preventivamente por el procurador de Texas, Ken Paxton, como antes lo intentó hacer infructuosamente hace más de 20 años Pete Wilson, con otra controversial iniciativa anti-inmigrante, la Proposición 187 de California.

Las organizaciones de defensa de los migrantes confían que los tribunales harán con la SB4 de Texas lo que antes hicieron en 2010 contra la no menos polémica legislación SB1070 de Arizona, que fue bloqueada casi en su totalidad, aún, cuando la Suprema Corte de Justicia preservó una cláusula que permite a policías de Arizona checar el estatus migratorio de personas detenidas.

Apenas la semana pasada, el gobernador de California Jerry Brown aprobó un presupuesto adicional de 15 millones de dólares para expandir la defensa legal de indocumentados que enfrentan casos de deportación, en momentos de un aumento en el número de inmigrantes que enfrentan procesos de remoción pese a no tener antecedentes criminales.

El contraste entre las acciones de los gobernadores de Texas y California no podría ser mayor. Para el primero, la SB 4 busca enviar el mensaje de que en su estado no son bienvenidos cierto tipo de migrantes. Para el segundo, sus acciones son un reconocimiento de que la tolerancia, la diversidad y la compasión siguen siendo valores que hacen más fuerte a este país.

HOW TWO LOCAL TEENS BECAME COLLEGE-READY

Three tips for choosing the right high school

to attend a school that looks and operates so differently from what one’s parents experienced. It requires a transition for the whole family, especially for parents eager to be supportive. That takes time and collaboration.

Seize opportunities Putting in extra work to drive your own learning and create meaningful relationships within a small community can also come with big opportunities.

Both Verdusco and Morales pursued programs that allowed them to continue learning elsewhere.

Verdusco, for example, took part in a four-week community-building trip to Nicaragua. Aside from getting a taste of independence, the trip opened Verdusco up to the world outside of his city. He taught local students English—a lifechanging opportunity for Verdusco as well

MAY 19 - 25, 2017 as the students with whom he worked.

At the encouragement of his Spanish teacher, Morales applied for and was accepted to the Chicano Latino Leadership Project—a three-day overnight program in the summer. Not only did it give Morales a taste of the college application process as well as college life, he learned about his culture and how to be a leader based on that rich history.

In the end, it was finding the right community and support that made a difference for both students.

“Summit has a strong community with a mentor who is constantly checking in.

It showed me that there are people who care,” Verdusco said, reflecting on his time at Rainier. “Summit pushes us to do our best—mentally and physically, in and out of school. Summit is always there for us.”

Special to El Observador When choosing a high school, there are many factors to consider.

Among the biggest consideration for many is whether a school will help prepare each student for college. Looking at the class of 2016, about 55 percent of high school graduates in Santa Clara County met the UC requirements for college preparedness.

That number slipped locally to 31.8 percent when looking at just Hispanic students—below the statewide success rate of 37.2 percent for this same group of students who make up a large percentage of those enrolled in local schools. By contrast, every single graduate at Summit Rainier, a San Jose high school which serves over 60 percent Hispanic students, meets the college readiness requirements.

Among the success stories in those statistics are two students: 17-year-old Jorge Araiza Verdusco and Luis Morales, 18 who will be majoring in business when they begin college in the fall. Both were born and raised in San Jose and will be the first in their families to attend college.

While preparing for success after high school is never easy, the college-bound seniors recently shared tips for the many families currently choosing a high school for the fall.

Be realistic about your needs Morales looks at schools that offered smaller classroom environments as well as a focus on college preparation—support he knew he needed. Morales found that support at a school that also had a strong community that encouraged him. For example, Morales has worked closely with a Summit mentor for multiple years—a

teacher who not only supported his academics but also was a critical partner in planning for college.

“The opportunities given at Summit—to start thinking about and guiding yourself to have a better future—I didn’t realize it until I had communication with those who went to other high schools. It was eye-opening,” he said.

Verdusco also considered basic logistics in his decision, like access to technology.

At Rainier, he was given a laptop. At the time, he didn’t have a smart phone or a laptop. Having access to the technology needed to research, write and complete any project freed Verdusco from trying to answer the simple question of access.

Without the laptop, he would have spent lots of time on logistics like how to get to the library, or which family member had a computer available, rather than working on his studies.

Embrace change and challenges Technology was an attractive feature in the school choice process for both Verdusco and Morales, but it also came with responsibility. Students take control of the pace of learning at Rainier, and that was a transition for both students.

For Morales, the college-like structure made him realize the importance of time management. It also highlighted how he would create undue stress on himself at times. These mistakes became lessons.

He began to take responsibility for the outcomes of his decisions. He also began to see the connection between the choices he made every day to accomplishing the goals he’d set for himself.

YOUR GUIDE TO HAPPY SUMMER CAMPING

Rebecca Harpster Golden Gate Better Business Bureau Summer is almost here! As a kid, I loved having three months off of school, but I know it was stressful for my parents, especially because they worked full time.

Summer camps are a great way to reduce parental stress because they ensure that children are occupied and supervised while caretakers are at work. I remember having a great time crafting, singing and making s’mores at various summer camps throughout my childhood.

Choosing a camp, however, can be overwhelming. There are many types of summer camps. Some last the whole summer, while others last only a few days.

There are day camps, which take place during normal working hours, as well as overnight camps. Which type of camp you choose depends on you and your child’s needs.

The specific camp you choose is important as well. In 2016, Better Business Bureau (BBB) received around 100 complaints about camps nationwide. Common complaints involved issues with registration, problems receiving refunds and poor service.

The following BBB tips will help you choose a camp with a proven track record for ensuring the safety, health and satisfaction of its attendees: • Do your research. Start your search at bbb. org. BBB Business Profiles include contact

information, a BBB rating, complaint history and reviews from past customers.

You can also use the BBB Accredited Business Directory to find a trustworthy camp near you. If a camp is a non-profit, you’ll be able to find more information through give.org, which is run by BBB Wise Giving Alliance (WGA). Many summer camps are run by BBB Accredited Charities, which meet 20 comprehensive Standards of Charity Accountability. Look at other online reviews as well to get a better picture of others’ experiences, and ask friends and family for recommendations.

• Are they licensed? The California Department of Public Health requires resident (overnight) camps to be licensed.

However, day camps aren’t required to have a license. The American Camp Association (acacamps.org) accredits camps that have met up to 300 nationally recognized standards. Accreditation is voluntary.

• Visit the camp if possible. It’s important to look beyond glossy brochures and potentially deceiving pictures on websites.

If you can, visit the camp in person to evaluate the living, eating and recreational facilities. You’ll be able to meet the staff and ask questions. If you aren’t able to visit it’s even more important to do your research.

Look for photos posted by past campers – don’t just rely on images provided by the camp.

• Understand the fees and payments.

A deposit is usually required to reserve your child’s spot, and it’s only sometimes refundable. Know the total cost of the

camp and when payments are due, and see if payment plans are available. Understand the refund policy – if there’s an emergency and your child can’t attend, what percent of your money will be refunded? Know whether meals and transportation are included, and if you’ll have to pay extra for certain activities. Inquire about financial aid and available scholarships. Make sure everything is included in a written contract, and keep a copy.

• Ask questions. Don’t be afraid to ask questions, and consider it a red flag if a camp is hesitant to answer them. What’s the daily schedule for campers? What medical facilities are on site and what are the medical care procedures? How is homesickness dealt with? Are children able to communicate with parents, and if so, how? What are children required to bring and what’s provided? How is safety prioritized? How are staffers screened?

What’s the camper to staff ratio? What’s the camper and staffer return rate? What background does the camp director have?

If it’s a specialty camp, what expertise do staffers possess?

• Think about a backup plan. Just in case the camp is closed, the session is cancelled or your child is no longer able to attend, have a backup plan in place. This could be another form of child care or a different camp or summer program. Research these options in advance.

TATUADO Y ARREPENTIDO: ELIMINACIÓN DE TATUAJES FDA

Ese tatuaje de una antigua novia en el brazo —que parecía una idea maravillosa hace unos años— actualmente le causa un poco de vergüenza. Y a su esposa tampoco le gusta demasiado.

Quizás usted no sepa que la FDA considera que las tintas que se utilizan en los tatuajes son cosméticos, y nuestra agencia toma medidas para proteger a los consumidores cuando surgen temas de seguridad relacionados con estas tintas.

Por el otro lado del proceso de tatuar, la FDA también regula los dispositivos láser que se utilizan para eliminar tatuajes.

La FDA ha autorizado para su comercialización varios tipos de láser como dispositivos a base de luz de uso bajo prescripción para el aclaramiento o la eliminación de tatuajes. Una compañía de Massachusetts recibió recientemente la autorización de la FDA para comercializar su estación de trabajo con láser para la eliminación de tatuajes y lesiones cutáneas (en la piel) benignas.

De acuerdo con una encuesta realizada en enero de 2012 por el encuestador Harris Interactive, 1 de cada 8 (14%) del 21% de adultos estadounidenses que tienen tatuajes lamentan habérselo hecho. Y la Sociedad Americana de Cirugía Dermatológica (ASDS) informa que en 2011 sus médicos realizaron aproximadamente 100,000 procedimientos de eliminación de tatuajes,

La autorización de la FDA significa que este método de eliminar tatuajes cumple con los requisitos de seguridad y efectividad del organismo, según el dermatólogo de la FDA, el Dr. Markham Luke. Otros métodos incluyen la dermoabrasión—significa “lijar” la capa superior de la piel—y la escisión—el recorte del área del tatuaje con la posterior costura de la piel para volverla a unir.

Desafortunadamente, eliminar un tatuaje no es tan simple como cambiar de idea.

Además, Luke sostiene que los ungüentos y las cremas para eliminar tatuajes pueden causar reacciones inesperadas durante el procedimiento, como erupciones, quemazón, cicatrices o cambios en la pigmentación de la piel.

Una manera efectiva y segura de eliminar tatuajes es a través de cirugía láser, realizada por un dermatólogo especializado en la eliminación de tatuajes, dice Mehmet Kosoglu de la FDA, que revisa solicitudes para autorizaciones de comercialización de dispositivos láser.

¿Cómo funciona?

Con la eliminación láser, los pulsos de energía láser de alta intensidad atraviesan la epidermis y son absorbidos en forma selectiva por el pigmento del tatuaje. Suzanne Potter California News Service SACRAMENTO, Calif. -- Advocates for immigrants promoted the idea of making California a "sanctuary state," with a big rally which occurred on the morning of Monday May 15th, on the steps of the Capitol building in Sacramento.

Monday was the 21st annual California Immigrant Policy Day, and groups showed support for Senate Bill 54.

Known as the California Values Act, it would ban immigration enforcement at public schools, libraries, courthouses and hospitals.

Jon Rodney is communications director with the California Immigrant Policy Center, which coordinated the event. He said the Golden State should resist the Trump Administration's deportation policies wherever possible.

"This year, all of us have a choice," Rodney said. "Will we be complicit in the federal government's cruel persecution of our neighbors and our loved ones? Or will we stand up for our values of equality, dignity and community?"

The State Senate has already passed SB 54, and it now goes to the Assembly. The bill instructs local police not to notify Immigration and Customs Enforcement when they're about to release people who are undocumented, except for those convicted of serious, violent felonies.

President Donald Trump has threatened to pull federal funding from cities that limit cooperation with Immigration and Customs Enforcement agents, but hasn't addressed this bill specifically.

Rodney said those at the rally support several other state-level immigration proposals as well.

"It also includes the Dignity Not Detention Act, to improve the treatment of immigrants in detention centers, and ending the practice of detaining immigrants for profit," he said. "And the Investing in Immigrant Families budget package will protect services and bolster due process for folks who are vulnerable."

Dozens of immigrants' rights groups from across the state are expected to take part.

The rally starts at 9:30 a.m., followed by more than 70 visits with legislators.

Should “13 Reasons Why” Be a Show to Worry About?

Teenagers across the United States are watching a controversial but popular show on Netflix called “13 Reasons Why”, which is a13-episode story arc that has everybody talking due to its controversial content ranging from suicide, sexual violence, and bullying. Most of the filming of the show took place locally in Marin County, and was directed by Tom McCarthy and executive produced by actress and singer Selena Gomez.

The show is about the13 reasons why a teenager, Hanna Baker, killed herself. A series of events led her to take her life, all involving her classmates in the fictional high school of Liberty High. She then leaves 13 tapes, each dedicated to every person that hurt her and led her to commit suicide.

However, even though the show is supposed to create awareness and address bullying, I think that the shows effect on some teenagers is the opposite of the intended.

Natalie Garcia is a 16-year-old junior at Mount Pleasant High School and she watched the whole show when it came out. “My friend told me about it, that's how I become interested in it…all my friends have watched it; it’s a must watch.”

According to the Mercury News, a Bay Area counselor met with a student who was having trouble coping with school and when the counselor asked her if she had heard about the Netflix series “13 Reasons Why,” about a teenager named Hannah who chronicles her downward spiral before taking her own life. The student looked up at the counselor and tearfully replied, “I am Hannah.” This incident clearly shows the copy-cat effect that the show has on some teenagers that are having trouble in a vulnerable age.

Due to this type of behavior amongst teenagers who watched the show, some schools in Contra Costa County are sending out letters to parents warning them about the content in the show and its effects on students who might be going

through depression. Many parents are not aware of what their children are watching on their devices.

The show has very strong content that event to me, a 23-year-old had trouble watching. I can only imagine what a 12-year-old felt when she watched the scenes where a rape takes place.

There are two rape scenes in the show, which both are very graphic and show more than what any teenager should see.

NASHVILLE, Tenn. – Suicide rates in Tennessee are on the increase across all age groups, just as a new Netflix series features a story line about a teenager who takes her life in the first episode.

“I think the show really shows reality but I was not affected by it, I learned positive things from it but I do have one friend who was really sad and depresses after she watched it,” Garcia said, who also admitted that her parents were not aware of the show.

The fact that anyone of any age can watch the show on Netflix should be something for parents to worry about and I think that every middle and high school should be sending out these letters to warn parents. Some parents aren’t always aware of what their children are doing at school, what they’re watching or if they’re being bullied.

It’s not because they're bad parents, but because every teenager needs space and it’s natural to not include our parents in our school and social lives.

Also, in Colorado “a community mourns the loss of seven students who recently killed themselves, a school district official ordered librarians to temporarily stop circulating a book that’s the basis for Netflix’s popular new series 13 Reasons Why,” according to the Associated Press.

Every parent should know that suicide is the second leading cause of death among teenagers and young adults ages 15 to 34, according to the U.S. Centers for Disease Control and Prevention.

“13 Reasons Why” has already confirmed a second season is expected to come out by next year, and it’s also expected to have very graphic material that could have a negative effect as season one did.

The show "13 Reasons Why" is prompting numerous mental-health groups to express concerns about the series.

At the Tennessee Suicide Prevention Network, executive director Scott Ridgway says the detailed portrayal could ignite thoughts in impressionable young people.

"I think that we're not planting it in their minds, that's key, but if they had not made it so graphic, and it's really more fictional," he says. "It has a buy-in that people watch the first episode and go, 'Oh, my goodness.'"

According to the most recent data, more than 1,000 people a year commit suicide in Tennessee, with more than 250 of those involving people under age 24.

Ridgway says the TSPN is advising

against schools screening the series for students, or leading staff or class discussions.

In response to concerns, Netflix has added additional warnings to the show, including "viewer discretion advised" labels on the episodes that contain explicit material.

Ridgway says teens interested in watching the series should view it with a parent or guardian - to have an open dialogue after the show.

"We recommend parents to watch it with their children if their children choose to watch the series, and this way it gives an opportunity for that discussion afterward to let folks know that there are resources and support," he explains.

Critics also take issue with the story line in the show that features a school counselor unable to help the lead suicidal character.

Suzanne Potter Public News Service SACRAMENTO, Calif. – Opponents of a bill intended to smooth the way for the rollout of next-generation cell technology are cautiously optimistic after a key committee put the measure on hold on Monday May 15th.

The state Senate finance committee put Senate Bill 649 in the suspense file - in the face of vocal opposition from groups concerned that the 5G technology emits harmful millimeter-wave frequencies when compared with the 3G and 4G now commonly in use.

Josh Hart, director of the group, StopSmartMeters.org, says the bill would limit local governments' ability to use zoning laws to block the proliferation of these towers near schools, hospitals and residential areas.

"This bill was basically written by the Cellular Telecommunications Industry Association, the CTIA," he says. "This is their wish list. Local governments are the biggest impediment to them putting wireless wherever they want to."

Supporters of the bill say it will boost the economy by encouraging the spread of super-fast wireless connections in the Golden State.

The bill already sailed through the

governance and finance committee but faced determined opposition from advocates on Monday, who organized hundreds of people to call into the hearing on a central conference line and express their concern.

A recent study by the National Toxicology Program found that male rats exposed to cell phone-like signals had a higher incidence of brain and heart tumors, compared with a control group.

Hart says other studies have linked 5G technology to skin and eye damage in humans.

"Approximately 5 percent to 6 percent of the population has been injured in some way by electromagnetic fields," he adds. "This is an acknowledged impairment in Sweden. Often these people's lives have been turned upside down. They've had to move into remote areas, lost jobs. This is a really serious and growing issue."

Hart says Santa Cruz and Marin counties and the League of California Cities have come out against the bill, which could be revived at any time before the end of the legislative session this summer.

ST. PAUL, Minn. - Cycling is many people's choice to get some exercise and enjoy the outdoors at this time of year. However, a study by Yale researchers in 2006 linked cycling to problems with sexual health and urinary dysfunction. Now, a new team of scientists disputes those results.

According to new research, the Yale study was small and focused mostly on extreme athletes, not those who bike for exercise, leisure or to commute. Dr. Mohannad Awad, resident physician at the University of California-San Francisco and a member of the American Urological Association, authored the new study.

"Surprisingly, the results were completely contradictory to the previous results," he said. "We found that cyclists have no worse sexual or urinary functions compared to other, non-cyclist athletes."

"When the previous studies have been done in the past, the cycling community just got worried, and a lot of people might have just stopped cycling for a long time," he said. "So, we just wanted to reach out to all the cyclists, all over the world, and let them know the results."

Awad said riding a bike is one of the healthiest forms of exercise, so he advised everyone to strap on a helmet and enjoy the ride.

Is It True That Fuel Cell Cars Are Finally Available for Mainstream Drivers in the U.S.?

San José Clean Energy, which will become largest single-city CCE in nation, will give customers a choice of electricity provider, reduce greenhouse gas emissions, and generate local jobs currently receive from PG&E, while ensuring competitive rates and funding new green energy projects. The program will buy renewable energy on the open market and deliver it to customers using PGE’s transmission system.

SAN JOSE, Calif. – On Tuesday May 16th, the San José City Council voted to form a Community Choice Energy (CCE) program that will provide renewable energy choices to customers, lower greenhouse gas (GHG) emissions, increase local control, and stimulate the economy.

“While leaders in Washington continue to languish in a petroleum-fueled past, cities like San Jose will chart the path to a more sustainable future,” said Mayor Sam Liccardo. “Through our CCE program, we will significantly lower our greenhouse gas emissions and boost our renewable energy supply, while also providing cost-competitive electricity rates for our residents and businesses.”

The San José Clean Energy (SJCE) initiative will make San José the largest city in the nation to operate its own CCE, adding momentum to the growing renewable-energy movement. It also takes a major step toward achieving the City’s ambitious GHG emission reduction goals.

“San José Clean Energy will offer more renewable energy choices for our San José community as well as reduce our carbon footprint and air pollution,” said Kerrie Romanow, Environmental Services Director with the City of San José. “It will also spur local green energy production and boost the San José economy.”

SJCE will give customers the choice of buying a greener blend of power than the mix they

The City Council voted to require that SJCE provide customers at least one option with 10 percent more renewable energy than PG&E’s power blend and to offer a 100 percent GHGfree power mix option as soon as feasibly possible. In addition, SJCE will provide at least one option with a rate equal to or cheaper than PG&E’s rate.

The SJCE program has the potential to bring significant environmental benefits to San José.

According to a SJCE business plan developed

by EES Consulting, if all consumers chose an electricity option with 10 percent more renewables than PG&E, San José would see an estimated 10 to 18 percent reduction in GHG emissions from electricity generation. This is the equivalent of removing approximately 56,000 passenger vehicles from the road or the annual energy use of 28,000 homes.

The program is expected to launch in 2018 and will ramp up to serve roughly 300,000 customers by 2019. The transition will be seamless for business and residential customers, who will continue to receive their electric bills from PG&E. Customers will automatically be enrolled into SJCE and can choose to opt out of the program and continue to receive their power from PG&E. Eight CCE operations have launched in California since 2010, most of which are in the Bay Area. Several more are expected to begin service by 2019 – half of the state’s power load could be provided by CCE programs within five years.

Roddy Scheer & Doug Moss EarthTalk For years, green car enthusiasts have been heralding the dawn of a new era of pollution-free driving powered by fuel cells, which combine readily available hydrogen with oxygen to fire up the engine. NASA created the first commercial grade fuel cells in the 1960s to power satellites and space capsules, and automakers have been talking up their potential for use in cars and trucks ever since.

But the idea has never gotten beyond the prototype stage, due mostly to the lack of any refueling infrastructure. After all, drivers are used to being able to refill their tanks on almost every corner, while the new generation of electric and plugin hybrid and electric vehicles (EVs) can be recharged from any electrical outlet.

But FCVs (fuel cell vehicles) may still represent the holy grail of auto travel because they combine the environmental benefits of electric vehicles (no reliance on fossil fuels and no pollution) with the driving range (~300 miles between refueling) of conventional cars. While GM, Hyundai and Daimler are heavily invested in fuel cell vehicle production, Toyota and Honda are already offering fuel cell vehicles for sale or lease to drivers in California, given the Golden State’s head start in creating a hydrogen refueling network. According to the California Fuel Cell Partnership, 27 hydrogen refueling stations are already up and running around metro Los Angeles and the Bay Area, with 33 more coming online soon.

Toyota’s Mirai FCV seats four and offers all the trimmings of any new car—touchscreen entertainment, dual climate control, steering wheel mounted controls, radar to prevent accidents and help with

parking, and a 312 mile range per fill-up.

The MSRP on the Mirai is $57,500, but Toyota is currently offering $7,500 back.

Another option is a 36-month lease on the Mirai for $349/month plus $2,499 up front.

Meanwhile, Honda’s new Clarity FCV is similarly appointed but offers a roomier interior (seating for five) and a longer range (366 miles per fill-up). Californians can lease the Clarity (it’s not for sale in the U.S.) for $369/month for 36 months plus $2,868 due at signing, with Honda covering the first $15,000 worth of hydrogen fuel.

Drivers behind the wheel of the Mirai or Clarity qualify for a one-time $5,000 tax rebate from California for driving a green car, not to mention access to HOV lanes statewide even with just a single occupant.

Of course, fuel cell drivers won’t want to leave California just yet. Outside of the Golden State, there are exactly three publicly accessible hydrogen refueling stations (Massachusetts, Connecticut and South Carolina each have one). But later this year Toyota, in partnership with France’s Air Liquide, will start to rollout a new network of hydrogen refueling stations around the northeastern U.S. so drivers there can start to enjoy the benefits of driving the latest, greatest and greenest technology ever to grace the American road.
