• Hilbert Morlaes THE DECLARATION OF INDEPENDENCE We celebrate American Independence Day on the Fourth of July every year. We think of July 4, 1776, as a day that represents the Declaration of Independence and the birth of the United States of America as an independent nation.

But July 4, 1776 wasn’t the day that the Continental Congress decided to declare independence (they did that on July 2, 1776).

It wasn’t the day we started the American Revolution either (that had happened back in April 1775).

And it wasn’t the day Thomas Jefferson wrote the first draft of the Declaration of Independence (that was in June 1776).

Or the date on which the Declaration was delivered to Great Britain (that didn’t happen until November 1776). Or the

The Continental Congress approved the final wording of the Declaration of Independence on July 4, 1776.

They’d been working on it for a couple of days after the draft was submitted on July 2nd and finally agreed on all of the edits and changes.

July 4, 1776, became the date that was included on the Declaration of Independence, and the fancy handwritten copy that was signed in August (the copy now displayed at the National Archives in Washington, D.C.) It’s also the date that was printed on the Dunlap Broadsides, the original printed copies of the Declaration that were circulated throughout the new nation.

So when people thought of the Declaration of Independence, July 4, 1776 was the date they remembered.

In contrast, we celebrate Constitution Day on September 17th of each year, the anniversary of the date the Constitution was signed, not the anniversary of the date

How did the Fourth of July become a national holiday?

For the first 15 or 20 years after the Declaration was written, people didn’t celebrate it much on any date.

It was too new and too much else was happening in the young nation. By the 1790s, a time of bitter partisan conflicts, the Declaration had become controversial. One party, the Democratic-Republicans, admired Jefferson and the Declaration. But the other party, the Federalists, thought the Declaration was too French and too anti-British, which went against their current policies.

By 1817, John Adams complained in a letter that America seemed uninterested in its past. But that would soon change.

After the War of 1812, the Federalist party began to come apart and the new parties of the 1820s and 1830s

Printed copies of the Declaration began to circulate again, all with the date July 4, 1776, listed at the top. The deaths of Thomas Jefferson and John Adams on July 4, 1826, may even have helped to promote the idea of July 4 as an important date to be celebrated.

Celebrations of the Fourth of July became more common as the years went on and in 1870, almost a hundred years after the Declaration was written, Congress first declared July 4 to be a national holiday as part of a bill to officially recognize several holidays, including Christmas. Further legislation about national holidays, including July 4, was passed in 1939 and 1941. I am certain that American Dem0cracy is at a crossroad.

“We, the People” will choose to have a governance which does the greatest good for all of us or we will choose to continue to not push back the objectives of the Koch Brothers Network. A government that takes care of all its residents is preferable to one which continues to concentrate 90% of the wealth of this nation into the hands of a few.

Women and Girls in Non-Traditional Career Technology Education • Ian Schiffer U.S. DEPT OF EDUCATION Although progress has been made to ensure all girls and women have access to a quality education, I am reminded that forty-four years after the passage of Title IX, there are still lengthy strides to be made; fewer than two percent of plumbers, and three percent of electricians are women. In contrast, women and girls are disproportionately enrolled in career and technical education (CTE) programs for many traditionally lower-paying jobs.

This is why, the U.S. Department of Education’s (ED) Office for Civil Rights (OCR) and the Office of Career, Technical and Adult Education (OCTAE) recently released guidance to make clear that all students, regardless of their sex, must have equal access to the full range of CTE programs offered.

Following the White House’s United State of Women Summit in Washington, D.C.,

ED joined other federal agencies and held an event focused on improving the lives of women and girls. In keeping with the theme, “Today, we’ll change tomorrow,” ED hosted over 100 community advocates, government leaders, students, influencers and innovators to discuss how access to CTE is helping all students, including girls and women, change the world.

The event was filled with architects, engineers, and other non-traditional advocates who shared personal experiences, best practices, and resources with the goal of making these professions more accessible to young women everywhere. Samantha Dorwin, the student speaker who gave an impassioned TED talk on her experiences in CTE, said, “As a graduate of a Machine Technology program, it is comforting to know that strides are being made, advancing opportunities for all students with special emphasis on helping strong, capable young women develop their voices and follow their dreams.”

Samantha’s passion for CTE and community building among attendees made me think of my education and how I can be an advocate for CTE. Upon reflection, I believe, to achieve equity in CTE, men should not be left out of this

conversation. As an aspiring male educator, I hope to teach boys to break down the lines between non-traditional and traditional.

Currently, men make up less than three percent of early childhood education teachers; it is a shame that most boys will not experience the rewarding work of reading, laughing, and growing with young scholars. While studying at Pomona College, I have the distinct privilege of working as a pre-school teacher through Jumpstart; in the pre-school classroom, I experience the joys of learning in its purest sense, free from distractions and based on discovery and enthusiasm.

When thinking about my experience working in early childhood education, I recognize that, as a male, I face much different, and lesser, barriers than a young woman may face entering a field like architecture. While I confronted a strong internal bias that is rooted in gender roles, women have to face systemic discrimination in recruitment, admissions, and access. In tandem with pushing young

boys and men to pursue careers that are fulfilling, we must support women and girls in CTE, to ultimately achieve the goal of universal access to CTE, regardless of gender.

Throughout the two days in Washington, over 5,000 women engaged in this summit, working toward meaningful change for girls and women across the country. From President Obama who said “that [he] may be a little grayer… but this is what a feminist looks like,” to Vice President Joe Biden, who highlighted efforts to end violence against women, to a powerful conversation between First Lady Michelle Obama and Oprah Winfrey who inspired attendees to work together to continue breaking barriers and shattering stereotypes. Throughout the day, speakers and participants chanted “When women succeed, America succeeds!” Events like the USOW bring us closer to realizing that goal.

can comply with the Clean Power Plan by reducing their dependence on so-called dirty energy over the next 15 years.

SACRAMENTO, Calif. - California’s electric bills will go up about 2 percent over the next 15 years if nothing changes in the state’s energy policy, but consumers actually would save about $1,400 over that same period as the state implements the Clean Power Plan, according to a new report.

The report found that as they do that, households nationwide could save almost $1,900 on their electricity bills.

Georgia Institute of Technology just released a study that looked at the impact of the federal Clean Power Plan on power bills. And while California already has virtually stopped using energy from coal-fired power plants, researchers found that energy efficiency is the key to low-cost integration of cleaner energy and to staving off climate change.

Sachu Constantine, director of policy at the Center for Sustainable Energy in San Diego, says the Golden State is ramping up large and small scale solar.

“Energy efficiency is not taking cold showers and drinking warm beer,” says Marilyn Brown, the report’s author. “It’s not suffering.

It’s not consuming less in order to cut your bills. It means using energy more wisely, purchasing and using equipment in a more efficient manner.”

Many other states rely heavily on coal and

Studies show that aspirin use is not detrimental to one’s health, in fact it can have an array of positive effects on health • NAPS Aspirin is a familiar over-the-counter medicine that reduces pain. Taking a low-dose or “baby” aspirin every day has long been recommended to people who have had a heart attack or stroke, so they can prevent another one. Evidence now shows that for people aged 50 to 69 at increased risk of cardiovascular disease, aspirin can help prevent a heart attack or stroke from happening in the first place and, if taken for five to 10 years, can also help prevent colorectal cancer.

This is great news because cardiovascular disease and cancer are major causes of death in the United States. Heart attacks and strokes are responsible for 30 percent of all deaths, and colorectal cancer is the third most common type of cancer—causing 8.3 percent of all cancer deaths.

The Task Force recommends that people in this group start taking aspirin after talking with their primary care clinician.

People 60 to 69 years old with increased cardiovascular disease risk can also benefit from taking aspirin, but because the risk of bleeding goes up with age, the overall benefit is smaller. Therefore, people in this group should make a decision with their primary care clinician about whether or not to take aspirin.

It is not clear whether taking aspirin is beneficial for people with increased risk of cardiovascular disease who are younger than 50 or older than 69. More research in this area is needed.

But just because aspirin is available over the counter doesn’t mean it is safe for everyone to take on a daily basis. Aspirin can cause serious side effects, such as bleeding in the stomach and intestines, and strokes caused by bleeding in the brain. So daily aspirin is only recommended for people who are at increased risk of cardiovascular disease and who are not at increased risk for bleeding.

You should not begin to take aspirin daily without speaking with your primary care clinician first.

A number of factors go into determining a person’s risk of cardiovascular disease, including age, sex, race, blood pressure level, total cholesterol level, and high-density lipoprotein (HDL) cholesterol level—also known as “good cholesterol.” Whether a person has diabetes, smokes, or takes blood pressure medication can also affect his or her risk of cardiovascular disease. Talk to your primary care clinician if you are between 50 and 69 years old to determine your risk for cardiovascular disease and for bleeding, and to determine if taking a daily aspirin is right for you.

Who Should Take Aspirin for Primary Prevention?

Other Ways to Reduce Your Risk

The U.S. Preventive Services Task Force (Task Force) found that how much a person can benefit from taking aspirin depends on his or her age and risk of cardiovascular disease. Daily use of low-dose aspirin is the most beneficial for people 50 to 59 years old who

Does Aspirin Prevent Other Cancers, Too?

There is growing evidence that aspirin may also help to prevent cancers other than colorectal cancer, such as cancers of the esophagus and stomach. However, the evidence on aspirin to prevent these cancers is still new and not yet strong enough to be part of a recommendation.

No group currently recommends that people take aspirin for the prevention of cancer only, even for people who are at increased risk of cancer. In order for the potential benefits of taking aspirin to outweigh the potential risks, a person must have increased risk of cardiovascular disease.

Recommendations to Protect Your Health The U.S. Preventive Services Task Force is an independent group of national experts in primary care, prevention, and evidence-based medicine.

The aim of the Task Force’s work is to evaluate and identify critical preventive health services that a primary care clinician can perform.

Requires Elder Care Referral Agency Licensing, Inspections & Financial Disclosure • Sacramento CALIFORNIA Senate Bill 648 authored by Senator Tony Mendoza was approved Tuesday June 28th by the Assembly Judiciary Committee on a unanimous bipartisan vote. The bill will strengthen inspection, licensing and financial disclosure requirements in order to protect seniors and their families from elder care referral agencies that engage in unscrupulous business practices. The bill now goes to the Assembly Appropriations Committee for consideration.

As the population of aging adults who need specialized medical care and support

services has grown in the last several years, there has been an explosion of for-profit businesses that offer referral assistance to seniors and their families in finding suitable long-term care housing options in extended care, skilled nursing home or intermediate care facilities and residential care facilities. While these agencies provide a valuable service, current licensing requirements leave room for abuse. For example, some referral agencies advertise their services as free-of-charge to the consumer.

However, they often contract with care facilities and receive commissions, incentives, and bonuses for each senior or family placement. These financial incentives are largely undisclosed to the senior or families being placed, and may lead to a placement

that is not helpful and may even be harmful to the patient.

“We must strengthen the licensing and financial disclosure requirements for referral agencies in order to guarantee that seniors and their families are not victimized. This will help protect against referral agencies that engage in unscrupulous business practices,” said Senator Tony Mendoza.

“Seniors and their families who use these services have a right to know what financial relationships may be influencing the referral to a specific nursing home or long-term care facility,” said Senator Mendoza.

“My bill requires a more transparent process so that seniors will be able to make a more informed decision about what long-term care options are available,” added Mendoza.

“A decision to find long-term care quickly creates an environment that makes families and seniors more susceptible to pressure, misinformation, and unscrupulous business practices,” said Senator Mendoza.

“Minimum standards for disclosure are needed to ensure that seniors, and their families, are making the most informed choices when it comes to their long-term assisted care needs.”

In spite of their proliferation, referral placement agencies are largely unregulated in California. Under current law, only certain referral agencies are required to be licensed and there are no requirements for ensuring that referrals are made solely to licensed care facilities. There is a need to address these gaps in current law in order to ensure that every placement agency meets some licensing and financial disclosure requirements to ensure

that seniors are not being referred to facilities that have lost their license to operate in California.

“Referral agencies targeting a senior or family member during one of the most difficult times in their life and profiting from it without full disclosure of their financial interest is just wrong. I am meeting with various stakeholders that represent a vast number of referral agencies, including brick & mortar and online referral agencies, to ensure that my bill will end this practice,” said Senator Mendoza.

SB 648 will:

• Require placement referral agencies to disclose whether the agency shares any financial interest with a care facility, including whether a fee or commission is received, and other financial benefits resulting from the placement.

• Enact provisions to guard the medical privacy of seniors, and require the referral agency to maintain liability insurance.

• Add “residential care facility for the elderly” to the definition of a referral agency.

• Require referral agencies to be licensed under the Department of Social Services.

In 2011, the state of Washington became the first state in the nation to regulate elder placement referrals in response to an investigative report conducted by The Seattle Times. The Times reported that some referral companies did not disclose the commissions they collected from facilities, oftentimes steering seniors to those facilities regardless of the patient’s needs. Agencies also referred patients to facilities with known histories of poor care and neglect, a practice that SB 648 will address.

For now, the lower court ruling stands, which means his executive orders are on hold. One, called DAPA, would have given temporary work permits to parents of those here legally. The other would have expanded DACA, which helps people brought here as children. Aidin Castillo is a staff attorney with the Immigration Legal Resource Center, part of the nonprofit “Ready California.” She said the main thing to know - is that the so-called “dreamers” can still apply for the original DACA program.

“The original deferred action for childhood arrivals program, which was launched in 2012, remains available,” she said. “It’s in full effect. It was not affected by the Supreme Court’s decision.”

The program could, however, be rescinded by the next President. Castillo said quite a few people eligible for DACA still haven’t applied, and many wrongly believe you must be enrolled in college, when in fact many job training and adult education courses will suffice.

She also warns that people should be on high alert for “notarios” or other, possibly shady legal advisers who cannot represent anyone in court.

“Only go and get advice from trusted legal services providers,” she added. “That means an attorney or an accredited representative by the board of immigration appeals.”

Several other immigration options remain open, including the U-visa for people who have been victims of serious crimes.

The next U.S. president will fill the vacancy on the Supreme Court and determine the new majority. This decision all but guarantees the prediction that Latino voters will turn out in record numbers this November.

Sacramento, CA - A new report has good and bad news for California’s kids. It says many more have health insurance, but poverty continues to threaten many aspects of their overall well-being. Comments from Jessica Mindnich (MIND-nick), director of research for the group Children Now. Despite the recession, California’s rate of uninsured children was cut by more than half from 2008 to 2014 - thanks largely to Medi-Cal expansion under the Affordable Care Act, according to a new report. The 2016 Kids Count Data Book from the Annie E. Casey Foundation, also found that young people are graduating from high school at much higher rates, and fewer teens are having children or abusing drugs. The report ranks California 36th among states for overall child well-being. Jessica Mindnich, with the nonprofit group Children Now, says that isn’t great - but it’s a major improvement over a few years ago, when the Golden State ranked 41st.

“So, we are seeing some of the policy changes and investments that our government has made in California’s children, paying off.”

JULY 1-7, 2016 She notes even more children will be insured this year, with a law allowing undocumented children to enroll in Medi-Cal that took effect in May. But the report also says California has a long way to go, particularly in terms of fighting poverty.

Mindnich points out that California ranks 47th in children’s economic well-being - and one-third of their parents lack fulltime, year-round employment.

“Currently, 23 percent - or roughly one in four kids in California, over two million are living at or below the federal poverty line.”

Children Now is calling on policymakers to continue investing in children’s programs and services to solidify the current upward trends in young people’s well-being.

For us land-dwellers, underwater noise rarely reaches our ears. However, marine organisms can be very sensitive to undersea sounds, particularly unnatural noise. Human activity—from explosives to underwater construction to ship traffic to oceanographic research—creates intense noise that threatens the health of ocean wildlife. Direct effects include hearing loss, habitat displacement, and even brain hemorrhages. The noise impedes the senses that enable many marine species to coordinate their movements and find food, and can also interfere with breeding cycles and migration patterns. This cacophony of underwater noise pollution puts additional stresses on marine ecosystems already on the ropes due to overfishing, pollution and myriad other human threats.

Of particular concern lately to environmentalists is underwater noise pollution from seismic testing, where resource extraction industries use air guns to map the seafloor to look for potential oil and gas reservoirs. “From the water’s surface, the gun generates a blast of sound that penetrates the ocean floor then bounces back up to a receiver, relaying data about the layers of sediment, rocks, and potential fuel deposits below,” reports the Pew Charitable Trusts. “There is concern that the intensity of seismic sounds and their large spatial coverage may lead to injury, disturbance or displacement of marine animals or a masking of their communication.”

While the United Nations (UN) Convention on the Law of the Sea forbids pollution that can damage marine wildlife, a lack of enforcement abilities means corporations and the military can continue to carry out many noisy undersea operations. The non-profit Ocean Mammal Institute would like the UN to en-

dorse a “precautionary approach” limiting all sources of intense underwater anthropogenic sound and requiring individual nations to follow suit accordingly.

“The precautionary principle should be applied publicly and transparently to noise generated for military, commercial and scientific purposes,” reports OMI. “In many cases, there are alternatives and realistic mitigation scenarios for reducing and eliminating very loud human-generated noise from the marine environment, including employing improved passive sonar devices, using reduced noise energy, mechanical and operational designs that minimize noise, alternative energy sources, etc.”

Given the Convention on the Law of the Sea’s lack of “teeth” on monitoring and enforcement on the issue, the United States has started taking matters into its own hands to address underwater noise pollution in its own territorial waters and beyond. The Obama administration recently called for more scientific research to fully understand the ecological impact of underwater noise, and directed the National Oceanic and Atmospheric Administration (NOAA) to step up efforts to track and monitor volume levels below the surface. NOAA is also working on tools that the public, corporations and military can use to assess and help mitigate noise-making activities, and has initiated a campaign to raise public awareness on the issue.

While ocean wildlife activists say much more needs to be done to start solving this insidious problem, at least the U.S. is taking steps in the right direction even if the rest of the world continues to ignore the noisy threats lurking below the depths.

Shelly Palmer The impact of BREXIT is so vast that we may never fully understand its effect. I’m not a political pundit, so I’ll leave the politics of BREXIT to others. Technology is the core focus of my advisory practice, and our solutions group builds digital products for some of the world’s leading multinational corporations. Through that lens, I offer some thoughts about the near-term impact BREXIT will have on the tech sector and make a few educated guesses at the outcome.

The EU and the United States have been trying to reach an agreement about data transfers and personal information. The EU struck down “Safe Harbor” a while back, and there is ongoing negotiation on a replacement called “Privacy Shield.” That negotiation has not been going well. The EU wants to exercise very strict regulatory control over the flow of data in, out and around the EU. By itself, this has been bad news for top-tier, US-based, multinational tech firms and all businesses that need to turn data into action in order to compete in the global economy.

BREXIT will impact privacy regulation in at least three ways: 1. As a lame-duck member of the EU, the UK will not be able to add its weight to the regulatory discussions. As an EU member, the world’s 5th largest economy (now 6th because the British pound got hammered that hard by the BREXIT vote) had a loud voice at the table with Germany and France, which want far stricter controls on EU data

flow. The UK’s voice of reason on the subject of EU data flow is now silent.

2. The UK’s data policies are sure to differ from the EU’s, so now every company that wants to collect data in Europe will have to comply with the data policies of both the EU and the UK. This will add an extra layer of administrative expense that will likely be passed on to consumers.

3. Even with BREXIT, the UK will have to comply with the EU’s data policies if it wants to move data freely between itself and the EU. To be sure, BREXIT was a victory for digital sovereignty, but now the UK’s sovereign data policies will have to be brought into alignment with the EU’s. Can it be done? Of course. How long will it take and how much will it cost? Unknown. But one thing is for sure: BREXIT is an expensive, time-consuming blow to the globalization of the Internet.

For the start-up community, London was the Yellow Brick Road to the entire EU. As the financial capital of Europe, London was the perfect place to start your start-up. You had easy access to a diverse workforce, and you instantly had the whole EU as a marketplace.

BREXIT will impact investment, funding and the Yellow Brick Road to Europe in at least three ways: 1. London will no longer be a clear choice for start-ups. For many, Berlin, which has a

thriving tech community and relatively easy access to capital, will now be a much better choice. It has a diverse workforce and access to a much larger market. This will be especially true for financial technology start-ups.

2) The EU’s Digital Single Market initiative will not include the UK, unless the UK negotiates its way back in. This will have direct and significant economic impact across the whole of Europe and will affect the bottom line of every tech company that was hoping to have a single set of rules for all 28 EU countries.

3. While it is generally true across every aspect of post-BREXIT business, political and economic uncertainty significantly increase the risk of starting and growing a business in the UK. Hopefully, the UK will be able to make a deal with the EU to continue the relatively new legislation that entitles EU citizens to very affordable data plans and cheap (or free) mobile minutes and txts. Data roaming across country boundaries is remarkably expensive and having to navigate additional international phone plans adds friction to the doing of business. Additionally, 5G, the next generation wireless network is on the horizon. Now, two different standards bodies will have to agree on the use of spectrum (the frequencies used to carry its radio signals) and other technical details. This is not fatal by any means, but it will add time and expense, which in turn will slow the progress of high-speed communication in the UK and the EU. In 2015, Tech City UK published a report titled Tech Nation: Powering the Digital

Economy. At the time of the report, over 1.5 million people were employed in the tech sector, and more than 300,000 of them worked in London. Importantly, the report stated that the “digital economy” grew one third faster than the entire UK economy. This should not be news to anyone. The tech sector is growing worldwide, and certain sub-sectors are growing at breathtaking speed.

Without the free movement of labor, the UK will have to “home grow” the tech talent pool.

Great news in the long run, but in practice, HR is the hardest part of the tech business.

Foreign-trained, foreign-born, immigrant talent may be controversial, but world-class coders, product designers, engineers and data scientists come from all over the EU. Now, they will need special visas to work in the UK. With so many excellent tech jobs in Berlin, Munich, Madrid and Paris, will it be worth it? Human beings usually take the path of least resistance.

I understand that more than 52 percent of the voters firmly believe that BREXIT was the right thing for the UK. Maybe they are right. None of the problems listed here are insurmountable (although this list is woefully incomplete). They can be solved with time and money. Which is exactly the point. How much more time and money will be spent to fix the parts that were not considered by those who voted leave?

According to @GoogleTrends, “What is the EU?” was the second top UK question on the EU since the #EURefResults were officially announced. The first was, “What does it mean to leave the EU?” Clearly millions of Britons voted with their hearts and not their heads. I’ll leave you to draw your own conclusions.

However, there’s still reason for undocumented immigrants to remain optimistic and continue the fight for equality and justice for all. Immigration advocates and organizations are pushing hard for legislative changes that will provide relief to those already in the United States and positively contributing to the U.S. economy and society.

The Supreme Court’s decision does not affect Obama’s original DACA program commenced in 2012. Undocumented immigrants

can still obtain the benefits of this program.

In other words, an applicant who meets the eligibility requirements for DACA 2012, can still submit an initial DACA application. In addition, anybody who was granted deferred status pursuant to DACA 2012, can continue to renew their DACA status every two years, unless the new President halts the program, or a new lawsuit is brought challenging the legality of the original 2012 DACA program.

However, the expanded DACA and DAPA programs are dead for now.
