was up to the federal Congress, not the president, to decide on the advisability of protecting those who had been brought as minors by their parents to the United States without legal documentation.

His order does not affect the more than 600,000 young people who are currently DACA recipients, who will be able to remain protected under the program and even apply for renewal, but the ruling closes the doors, at least temporarily, to new applicants, which could potentially affect the future of thousands of young people qualifying under DACA.
federal judge in Texas recently decided something that was unfortunately not surprising: He blocked the possibility of the federal government approving the DACA program to new applicants, arguing that then-President Barack Obama lacked the legal authority to grant widespread relief. undocumented youth.
Less than 24 hours after the ruling, President Joe Biden made it clear that his Department of Justice will appeal the judicial decision and took the opportunity to renew his call to Congress to approve once and for all a permanent and deserved solution to these extraordinary young people who are Americans at heart, except for legal documentation.
The 77-page ruling of Judge Andrew Hanen, appointed by President George W. Bush, was unfortunately expected, since 2018 he had made it clear that it
Frustrated by unsuccessful negotiations with Republicans who oppose giving relief to immigrants, Democrats made a bold decision shortly before the ruling last week: they included a path to citizenship for DREAMers, beneficiaries of TPS as well as for essential workers, including agricultural workers, within the massive infrastructure package that congress is preparing to debate. His plan is to achieve the approval of this urgent immigration relief through the reconciliation process, which would allow Democrats to pass the bill with a simple majority, that is, without having the support or votes of any Republican, neither in the House of Representatives nor in the Senate. However, the Democratic maneuver has more obstacles than are apparent. First, the congressional parliamentary expert must determine that immigration relief such as the one Democrats plan is eligible to be voted on within the reconciliation process, which was institutionally designed for budget issues. Second, Democrats must avoid defections from their ranks. It would not be the first time that conservatively oriented Democratic senators, or senators facing re-election in states where immigration is divisive, have poured a bucket of cold water on the ambitions of the more progressive sector of the Democratic party. For this reason it is up to the Democrats, independent organizations for the defense of Hispanics and migrants, and also society as a whole, to raise their voices for these young people, so that Congress commits an act of responsibility of consistency, creating a permanent, just solution. omy. A clean electricity standard would reduce emissions from power plants, but that only accounts for 25% of greenhouse gas emissions. An economy-wide price on carbon, however, reaches into every sector — electricity, transportation, industry, commercial/residential real estate, agriculture and land use. It’s also quick to set up, leading to meaningful impact in a matter of months.
O
ur nation’s lawmakers are currently working to craft and attempt to pass a package of spending measures and policies aimed at transforming America’s infrastructure and tackling climate change.
Finally, it puts money in your pocket. A carbon tax becomes affordable for ordinary Americans when the money collected from fossil fuel companies is given as a dividend, or “carbon cash back” payment, to every American to spend with no restrictions. This protects low- and middle-income Americans who otherwise might not be able to afford the transition. Studies show that the monthly carbon cash back payments are enough to essentially cover increased costs of 85% of American households, including 95% of the least wealthy 60% of Americans.
During an Earth Day summit with world leaders, President Biden committed the U.S. to reducing greenhouse gas emissions 50 to 52 percent by 2030 compared to 2005 levels. To achieve that goal, Biden has proposed spending billions of dollars on electric vehicle charging stations, incentives for consumers to purchase EVs, retrofitting homes and businesses to be more energy efficient, and upgrading the nation’s energy grid to facilitate the transmission of renewable energy throughout the country. The proposal calls for a clean electricity standard mandating that all U.S. electricity be generated with non-fossil fuel sources by 2035.

L

“No me voy a rebelar”.

SMALL CALIFORNIA SCHOOL DISTRICTS WILL REFUSE TO FOLLOW MASK MANDATE
C
Joe Hong CalMatters
OF EDUCATION Some rural districts do plan on enforcing the mask mandate and expect at least a few phone calls from frustrated parents. But administrators there doubt many parents will choose independent study just because they don’t want their kids to wear masks.
alifornia’s smallest school districts say they will refuse to send kids home for not wearing a mask despite a new state mandate. Superintendents in these tight-knit and typically more conservative communities want the state to let local districts make their own decisions, considering the success some of them have had with reopening their campuses last year without triggering COVID-19 outbreaks.
“They’re gonna make a big fuss,” said Patricia Gunderson, superintendent of the Lassen County Office of Education. “But if that’s the difference between their kid being in class or being at home, they’re probably going to wear a mask.”
“These districts were in class all year, and they just don’t believe masks are needed to teach children,” said Tim Taylor, executive director of the Small School Districts Association, which represents hundreds of districts with fewer than 5,000 students. On Monday afternoon, the California Department of Public Health went back and forth on updates to its masking rule. Health officials first said students who refuse to wear masks without a valid medical excuse won’t be allowed on campuses. Four hours later, the agency revised the guidelines to say local districts will be responsible for enforcing the mask mandate. “If the state is not going to enforce maskwearing then neither am I,” said Amy Alzina, superintendent of Cold Spring Elementary, a 198-student, single-school district near Santa Barbara. Cold Spring Elementary’s use of ventilation and outdoor instruction, Alzina says, makes masks unnecessary and possibly even harmful. “Students, especially English learners, rely on nonverbal communication” she said. “I spent last year trying to smile at students with my eyes.” The district resumed full in-person instruction in October. The district had no COVID cases with about 90% of its students returning to campus for nearly the entire school year. “Students, especially English learners, rely on nonverbal communication. I spent last year trying to smile at students with my eyes.” -AMY ALZINA, SUPERINTENDENT OF COLD SPRINGS ELEMENTARY State officials said the updated guidelines only extend the mask mandate already in place and continues the policy of local enforcement. “There’s still a pandemic happening, the Delta variant is dangerous and the majority of students still aren’t vaccinated,” said Alex Stack, a spokesperson for Gov. Gavin Newsom. “We can open schools safely, but COVID prevention strategies are necessary to keep everyone safe.” Stack said county health agencies are responsible for making sure districts enforce the mask mandate, and that he couldn’t speculate on whether the state would penalize districts.
Gunderson said she would urge the 10 small school districts in her county to enforce the mask mandate. But she said the parents in her conservative community are losing patience. Newsom’s decision to leave some decisions to local districts while maintaining some vague statewide guidelines is reminiscent of his approach to school reopenings.
As of now, state rules nominally give students only two choices: either wear a mask to school or refuse to wear a mask and enroll in virtual independent study.
“As it’s been throughout the pandemic, (the state health department) is not built to enforce,” Stack said. “The local agencies enforce these things.”
“In a community that’s predominantly red…it’s going to create tension between our parents and our administration.”
Options for students
-PATRICIA GUNDERSON, SUPERINTENDENT OF THE LASSEN COUNTY OFFICE
“In a community that’s predominantly red, people are used to doing their own thing,” she said. “It’s going to create tension between our parents and our administration.” Options for districts Leaders at some rural districts are hoping to find a middle ground. “We will not be sending kids home,” said Scott Borba, superintendent of Le Grand Union Elementary School District in Merced County. Le Grand Union is another single-school district with just 360 students. Borba said he’ll consult with local public health officials to find alternatives for students. One possibility, Borba said, is to separate unmasked students in the classroom and attach plastic shields around their desks. A more extreme solution he is considering is to place unmasked students in separate classrooms. “The whole purpose of my job is to get kids in school,” Borba said. “We’re gonna do everything we can.” Stack, the spokesperson for the governor, could not answer whether the state will intervene if county health agencies approve district plans allowing unmasked students on campus in defiance of state mandate. Gunderson, however, said she’s urging superintendents in her county to abide by the mask mandate. Smaller rural districts, she said, might not be able to afford a steep fine from the state. “When you’re a small district, and you don’t have a huge budget, you have to be really careful with putting your district at risk,” Gunderson said. Alzina, the superintendent at Cold Spring Elementary, said she would require masking on her campus again if the state does try to punish her district or if there’s a spike in COVID-19 cases. “If there is an issue, we’ll continue to align with the state,” she said. “I’m not gonna go rogue.”

recent study, commissioned by Always, found that girls who played sports during puberty built confidence and critical life skills, like teamwork and resilience. Yet nearly half drop out during puberty, according to the nationally representative survey, conducted by OnePoll in 2021. Parents and caregivers can help tackle that. Research from the Women's Sports Foundation found that girls, and other underrepresented youth in sports, find it beneficial to have multiple champions in their lives. These champions can help counter the cultural and societal barriers that young people face playing sports (e.g., teasing, exclusion, inequality and feeling less valued). Ultimately, parents and caregivers who encourage and support girls' sport participation will help reduce the dropout rates. The following five top tips, based on the Foundation's research, can help you engage the girl athletes in your life and keep them motivated in the long run. 1. Create a community of support: Invite your daughter's friends and family to her games and broaden her cheer team. For remote kudos, keep people regularly updated with her game schedule, photos and stories. For example: Maintain a group text or email thread to share highlights in real time and record a video compilation of support from her champions that she can treasure at the end of the season. 2. Diversify how you show up: There's no rulebook on what parental support can look like. Realistically, scheduling can make it tough to go to every practice and competition, so think about all the creative ways you can be there for her that work for both of you. For example: Make time to watch women's sporting events together when you can. Buy her books by
female athletes and have regular conversations about the women's sports figures she admires. You can also cater team outings to show your love and support. 3. Be her champion, not her coach: Parents who step into automatic coach mode can diminish her confidence and leave her with a negative experience. It can be tempting to review the game in detail as a way of "helping" her improve but it's always better to support, not instruct. Words of encouragement and positive affirmation go a long way. For example: Instead of focusing on what went wrong, talk through her overall feelings about the game and have her lead the conversation on what she feels she's learned from the experience. 4. Encourage exploration: Not everyone knows what they want to do right away. Give her the space and opportunity to try different types of sports and find her true passion on her own time. For example: Make it a bonding activity by watching new sports together or by introducing her to another sport in a more casual setting, such as a local community center. 5. Help her set her own goals: Many girls will compete to please their parents, not themselves. Avoid pressuring her with unrealistic expectations or playing a comparison game. For example: Ask her what "success" looks like for her and help her build personal goals to get there. These could be different qualifiers such as the confidence she's building or the friends she's making. This year, in partnership with the Women's Sports Foundation, Always and Walmart have donated $500,000 in #KeepHerPlaying Youth Grants to help schools and organizations across the country provide access and opportunity to puberty-aged girls in sports. Visit www.walmart.com/ always to read and share the stories of the girls receiving these grants and learn more about the campaign.

espite significant gains in vaccinations and fighting COVID-19, the rise of the more transmissible Delta variant poses a significant risk for unvaccinated people. “We are at a critical moment in the COVID-19 pandemic. We have the vaccines and public health measures necessary to protect people and stop the spread of the virus, but the onus is on all of us to get vaccinated in order to protect ourselves and our communities. Despite the gains we have made, the dangers -- particularly of the Delta variant -- are real and concerning,” says Gerald E. Harmon, M.D., American Medical Association (AMA) president.

According to the AMA, here is what you can do now to decrease the risk to you and your family.
1. Talk to your doctor. Speak to your own physician about vaccines. Physicians remain one of the most important sources for information about vaccines. And with 96 percent of physicians vaccinated, according to a recent AMA poll, they are prepared to answer your questions and speak about their own experience with vaccines.
2. Get vaccinated ASAP. If you’re not already vaccinated, get the first vaccine available to you. Three vaccines are now available in the United States: those made by Pfizer-BioNTech, Moderna and Johnson & Johnson/Janssen Pharmaceuticals. All are safe and highly effective at preventing severe COVID-19 illness, hospitalizations and death.
3. Immunize your child. Now is the time to immunize your child, if they are eligible, so they are fully vaccinated by the start of school. It takes five weeks for the two-dose Pfizer vaccine to be fully effective. With schools reopening in person in August in many places, and with just one in five children between 12-15 years old vaccinated, you should start the vaccination process as soon as possible. Additionally, childhood and adolescent vaccination rates against diseases such as measles, pertussis and human papilloma virus dropped precipitously during the first few months of the pandemic stay-at-home orders. Although rates have picked up, they have not picked up enough to achieve catch-up coverage, so make sure your child’s immunizations are on track during well-child visits with their doctor. “In order for communities to fully move on from COVID-era restrictions and ensure we don’t fall back due to spread of COVID variants, everyone must do their part now and get vaccinated. Too much is at stake,” says Dr. Harmon.

WILL YOUR FAMILY GET $300 MONTHLY CHILD TAX PAYMENTS? WHAT YOU NEED TO KNOW
M
Melissa Montalvo CalMatters
Supporters of the tax credit say that while the temporary benefit will help families take care of basic needs like food, rent, and transportation, many households risk slipping back into poverty when the tax credit ends.
onthly $300 payments are in the works for California families struggling to make ends meet.
“Pulling the rug out from under families at the end of the year would be devastating,” said Crowell.
The IRS begins the roll-out of the Child Tax Credit on July 15 as part of the American Rescue Plan. Qualifying households will receive up to $3,600 annually per child, which will benefit families across the state.
Push for permanent child tax credit expansion Speaking to reporters on Thursday, Costa and other Fresno-area groups urged Congress to make permanent the CTC benefit.
On Thursday, Fresno area leaders from Faith in the Valley, Fresno Economic Opportunities Commission, and First 5 Fresno County were joined by U.S. Rep. Jim Costa at a news conference touting the payments. “We all benefit when families in our community have access to their basic needs,” said Amber Crowell, a Fresno State sociology professor and regional housing coordinator with Faith in the Valley. But that’s not all. The coalition is advocating to make Child Tax Credit expansion permanent and exploring the idea of a guaranteed income program for Fresno County. What to know about the Child Tax Credit payments The IRS will pay half of the total credit amount in advance through monthly payments for the rest of the year. The government will pay the other half next year after tax season. Families earning $150,000 or less can expect between $2,000 and $3,000 a year per child up to age 17 and up to $3,600 for kids under 6. There is no application process; families that filed taxes in 2019 or 2020 will automatically be enrolled. Non-filers that already signed up for the Economic Impact Payments will also be automatically enrolled. Over 1 million immigrant children are not eligible for this benefit because of the 2017 Tax Cuts and Jobs Act. Those that didn’t earn enough to be required to file taxes can still sign up for the Child Tax Credit on the IRS website. Children of undocumented parents can also qualify for the Child Tax Credit under two requirements: The child must have a Social Security number issued before May 17, 2021, and undocumented parents or guardians must have an Individual Taxpayer Identification Number or an ITIN. Families can see how much they qualify for by answering a few questions on the IRS CTC Eligibility Assistant page. Anti-poverty effort Supporters of the CTC and the American Rescue Plan describe it as a once-in-a-generation anti-poverty effort that they say will lift over half of American children out of poverty, including in California. Fresno County is home to some of the highest rates of concentrated poverty in the nation. In the three congressional districts that touch Fresno County, an estimated 630,600 children will benefit from this tax credit. But the

real need is probably greater than the numbers say, according to the Economic Security Project. Nationwide, over 1 million immigrant children are not eligible for this benefit because of the 2017 Tax Cuts and Jobs Act. Growing inequality is also a concern. A recent analysis of Bureau of Labor Statistics data
showed that full-time minority workers earn a median income of $40,000 per year in the Fresno metro area, or about 33.3% less than non-minority workers, who make a median of $60,000. At the same time, Fresno has seen some of the highest increases in rent nationally over the past year, and the city has an affordable housing shortage.
“We want the government to really understand and help and lift up our families that are struggling to meet basic needs (and) make it permanent, so it’s not a constant repetition of (the) cycle of poverty,” said Emilia Reyes, CEO of Fresno Fresno Economic Opportunities Commission. The statewide coalition, Keep Families Afloat, says a permanent CTC benefit would drastically cut poverty. They also say Congress should remove the social security number requirement so that all families who need the credit can get it. “Getting money directly to families who need it will give them that little extra stability that they need to stop surviving day-to-day.” AMBER CROWELL, REGIONAL HOUSING COORDINATOR WITH FAITH IN THE VALLEY Crowell said supporters are confident that the CTC payments “will be effective and successful by all metrics.” “Getting money directly to families who need it will give them that little extra stability that they need to stop surviving day-to-day and start thinking long-term about their future and about their well-being,” she said. Crowell is also part of a coalition of local groups exploring a potential guaranteed basic income program for the Fresno County region. While the local coalition is still working out the details of a potential local guaranteed basic income program, Crowell said they hope to see it started by the end of the year. Similar efforts are underway around the state, with Long Beach and Sacramento recently announcing basic income pilot projects. A poll conducted in late June by Data for Progress and Mayors for a Guaranteed Income found that most likely voters surveyed said they supported making the CTC expansion permanent, with about 74% of Democrats expressing support, along with 57% of independent voters and about one-third of Republicans. The poll also found that most voters surveyed said they support a guaranteed income program. Melissa Montalvo is a reporter with The Fresno Bee and a Report for America corps member. ACRAMENTO, Calif.
ACRAMENTO, Calif. -- Huge new aid programs are beating back poverty in the Golden State, especially among families with children. Gov. Gavin Newsom just signed a raft of budget bills, that included another $640 by the end of the month for CalWORKS families, on top of the $600 payments already sent to those in the CalWORKS and Supplemental Security Income programs, and three rounds of federal stimulus payments.

Mike Herald, director of policy advocacy for the Western Center on Law and Poverty, said the supports are a boost to parents who lost jobs during the pandemic. "We are really lifting up a lot of lowincome families," Herald remarked. "They're getting real financial assistance in the $5,000-$7,000 range, and really, believe me, it's going to make a big difference in people's lives." The California Comeback Plan, as Newsom calls it, also puts $5.2 billion toward rental assistance, so families can apply to get all their back rent paid, and even get a few months ahead. Last week, parents started receiving payments of up to $300 a month per child, as part of the Biden administration's expanded federal Child Tax Credit. Herald said because funds are going out monthly, instead of all coming at tax time, it is a game changer. "This will help to really provide more financial stability," Herald asserted. "They're going to have more money every month in their accounts, to be able to pay bills and put food on the table. And this is something that advocates have wanted for a long time." And the help for children doesn't stop there. California has also added 100,000 new slots to the state-funded childcare program and raised what it pays child-care operators, to encourage more of them to reopen as the pandemic subsides. The budget also includes a significant funding increase for K-through-12 schools.

‘HISTORIC MOMENT!’ ASIAN AMERICANS CHEER PASSAGE OF CALIFORNIA’S $156 MILLION FUND TO COMBAT AAPI RACISM

Sunita Sohrabji Ethnic Media Services
sian Americans cheered the July 12 passage of California’s API Equity Budget, a three-year $156 million initiative which seeks to equip the AAPI community with resources to combat hate crimes. “This is historic and unprecedented. It is the outcome of many community-based organizations who rallied to get this support to find the best ways we can respond to violence against our community, and to prevent these attacks from occurring in the first place,” said Cynthia Choi, co-executive director of Chinese for Affirmative Action. “The AAPI community has historically been overlooked and underfunded. Imagine what we can do with resources,” she said, adding that the investment in the community must be ongoing, beyond the initial three-year commitment. The API Equity Budget allocates $110 million to the California Department of Social Services, who will work with the Commission on Asian & Pacific Islander American Affairs to distribute funds directly to community-based organizations that provide services to help victims of hate crimes and help hate crime prevention services. It allocates $10 million to the AAPI Data Project — housed at UC Riverside and helmed by Karthick Ramakrishnan — to improve data equity by conducting policy research and demographic data for the API community. The fund also allocates $10 million to an anti-bias block grant that provides funding to schools to create restorative justice programs, and safe spaces for students and staff to share their experiences with racialized hate and macroaggressions. Another $5 million will fund a peer social network for APIs to connect with and support each other through the use of social media. CAA led an effort to mobilize 150 community-based

Gavin Newsom’s office organizations who rallied the state Legislature to get the budget measure passed. “Lawmakers have to move beyond platitudes,” said Choi. The organizations worked with the Asian Pacific Islander Legislative Caucus of the California state Legislature to get the budget allocation in the $262 billion 2021-2022 budget. Governor Gavin Newsom signed the budget July 12. Over the past 15 months, the AAPI community across the U.S. has been beset by an unprecedented wave of hate crime, which many community advocates blame on former President Donald Trump who targeted China for allegedly infecting the world with Covid. Trump repeatedly called coronavirus the “Chinese flu,” “Kung Flu,” and other racial epithets. The online Web portal Stop AAPI Hate, which allows the AAPI community to self-report incidents of hate-based violence, speech, or verbal harassment, had logged 6,603 reports as of May. More than 12 percent of the incidents — which can be reported in one of several Asian languages — involved violence. Stop AAPI Hate will receive $10 million to continue its work. Ramakrishnan, who also chairs the California Com-
mission on APIA Affairs — which played a key role in getting the API Equity Budget passed — said there had been a community upswell throughout the past year for means to respond to the increased violence against the community. The movement escalated after the spa shootings March 16: 21-year-old Robert Aaron Long went to three massage parlors in the Atlanta, Georgia area, and killed eight people, including six Asian American women. Long told police that his actions were motivated by sexual temptation. AAPI organizations have called for the murders to be investigated as hate crimes. Ramakrishnan said that, after the shootings, he spoke with California state Senator Richard Pan, who chairs the Asian Pacific Islander Legislative Caucus; Pan agreed to work on getting the budget allocation passed. In a statement released after the passage of the budget, Pan, a Democrat who serves portions of Sacramento, said: “This sends a message to the API community that the State of California sees them and that we matter. It gives us hope that California will be supporting our survivors and communities as our state recovers from COVID-19.” Assemblymember Phil Ting, a Democrat who represents San Francisco and chairs the Assembly Budget Committee, said in a statement: “For decades, API communities have been longing to be seen and heard. The pandemic amplified the need to do more amid rising hate against Asian Americans.” “Every person has the right to shop, go to school and enjoy our neighborhoods safely without fear of being attacked. It is my hope that with this historic investment our communities feel safe once again,” said Ting. The budget also allocates $10 million to ethnic media to improve outreach to API and other underserved California communities about grants and helpful services. Chinese for Affirmative Action notes that the money will be channeled through
state agencies working with ethnic media outlets who have audiences of monolingual and underserved communities. “This is an important opportunity to think about the future of ethnic media in California. Media serving communities of color are important in making sure that the stories of our communities are seen by the eyes of decision makers.” Ramakrishnan characterized the investment in media as an important first step. “It opens up the conversation about what community supported media can look like while still maintaining independence.” He noted that this has been done on the federal level, with the Corporation for Public Broadcasting, which supports PBS and NPR. Several states have also created some version of a public broadcasting network. Regina Wilson, executive director of California Black Media, lauded the grant to the ethnic press. “This is an exciting day: the state budget has recognized the importance of ethnic media and its important role in informing communities who really yearn to plead their own cause.” “It earmarks resources to help get critical messaging into the communities that need it the most,” she said, adding: "CBM and our partner Ethnic Media Services — on behalf of an advisory group of ethnic media leaders — are inviting the Asian Pacific Islander Legislative Caucus and the Commission to a briefing with representatives of the sector to discuss how the $10 million allocation will be distributed. We want to ensure all media, no matter how small, benefit from this historic bill." Wilson said the murder of Minnesota resident George Floyd by a white police officer, Derek Chauvin, who has been sentenced to 22 and a half years in prison, alongside the Covid pandemic, has served as an inflection point for communities of color. “It has made us look at our humanity. We are neighbors who must stand up for one another.”

month after California’s reopening lifted most pandemic restrictions, COVID-19 cases and hospitalizations are rising, worrying public health officials as they contend with the more infectious Delta variant and the lagging pace of vaccinations in some communities.
Los Angeles County has drawn particular concern, with five straight days of more than 1,000 new cases, a five-fold increase from mid-June. Gov. Gavin Newsom on June 15 officially ended the state’s stay-at-home and mandatory mask orders affecting 40 million people, allowing most businesses to fully reopen. Vaccinated or not, many unmasked Californians eagerly crowded into reopened stores, restaurants, churches and sporting events. The fallout: On Wednesday, nearly 3,100 new COVID-19 cases were reported, compared to 700 on June 15. And the state’s test positivity rate – a measure of how much virus is circulating in a community – jumped from 0.08% to 3%, according to the California Department of Public Health. The actual numbers of cases remain small, however, compared to the peak of California’s devastating winter surge, when new daily cases topped 50,000. Case counts and testing results can fluctuate because of reporting delays. But public health officials in some areas have reported notable spikes in cases and hospitalizations. Between June 12 and July 12, San Francisco, Los Angeles and Orange counties saw the biggest jumps in the 7-day average of COVID-19 cases per 100,000 people, excluding very lowpopulation counties, according to a CalMatters data analysis. San Francisco’s case rate nearly quadrupled to slightly more than six cases per 100,000 people. Los Angeles’ case rate nearly tripled, and Orange County’s more than doubled. About 1,935 people were hospitalized statewide with confirmed or suspected cases on Wednesday, up about 54% compared to hospitalizations on reopening day. Hospitalization rates spiked in Yolo, Marin, El Dorado, Sonoma and Alameda counties. Nearly all of the new cases, hospitalizations and deaths have been seen in unvaccinated people. About 40% of Californians remain unvaccinated. Which raises the question: Did California reopen too soon? Not necessarily, according to Dr. Peter ChinHong, a University of California, San Francisco infectious disease specialist. “I think we were a very good place in California when we reopened,” Chin-Hong told CalMatters. “And we had no idea what the Delta variant was going to do.” California waited longer than most states to reopen fully, Chin-Hong pointed out. “We always expected an increase in cases after that.” California’s regional surges echo those around the nation, with COVID-19 cases rising by more than 50% this past week in 31 states and hot spots reemerging in Missouri, Arkansas and Florida. Across California, the Delta variant as of July 7 has been found in 1,085 COVID-19 patients whose test results were genetically sequenced, according to the state public health agency. But as a percentage of the state’s cases, it has grown incredibly fast, from just 2.2% of all tests se-

quenced in April to about 43% of all tests in June. Chin-Hong says it’s important to distinguish between infections and those that cause serious symptoms or death, because COVID-19 vaccines remain strongly protective against both, even against the Delta variant. The death rate has actually declined slightly since reopening day; with most California seniors vaccinated, serious cases are seen far more often in younger people, who are more likely to survive the disease. About 70% of the state’s COVID-19 cases as of July 7 were seen in people under age 50. Improved treatments, including monoclonal antibodies, also have improved patients’ chances. Still, 30 deaths were reported statewide on Wednesday. About 1,935 people were hospitalized statewide with confirmed or suspected cases, up about 54% compared to the number of hospitalizations on June 15. Chin-Hong said unvaccinated Californians accounted for nearly all of the hospitalizations and deaths. So-called breakthrough infections remain exceedingly rare in fully-vaccinated people, a tiny fraction of 1% among more than 20 million Californians. There was a lot of second-guessing before and after Gov. Gavin Newsom’s decision to largely end pandemic restrictions in mid-June. In late May, Santa Clara County public health officer Dr. Sara Cody – who helped spearhead one of the nation’s first shelter-in-place orders – voiced concerns about the state’s pace of reopening and warned of a potential surge in cases.

Two weeks after California’s reopening, Los Angeles County health director Dr. Barbara Ferrer recommended residents once again wear masks as the Delta variant surged throughout the state and nationwide.
But Chin-Hong suggests that these COVID-19 surges will become a regular part of life in California, much like flu season. It’s just that unvaccinated people will be far more likely to be hospitalized and die, he said.
“Just like there will be two Americas, there will be two Californias: the California of the vaccinated and the California of the unvaccinated,” he said. “If (non-elderly) people didn’t get a flu shot, they’ll probably do fine but with COVID, you’re going to have a very different trajectory.”

ritney Spears shouldn’t be the poster child for conservatorship in California. The “Free Britney” media campaign has created a nationwide myth-making machine that excludes some of the most vulnerable members of our society, including my son Danny.

Californians must change the debate about conservatorship and focus on the people and their families who are waiting for real reform. People like Danny should be the face of that reform, not Britney Spears. Thankfully, state Sen. Susan Eggman’s legislation, Senate Bill 507, which expands the criteria for assisted outpatient treatment, is a step in the right direction. I have been on a mission to “Free Danny” from the shackles of our broken mental health care system for 22 years. A conservatorship has been the tool he needed to live and stay free. Danny has been on a California LPS conservatorship (named for the Reagan-era Lanterman-PetrisShort Act) for 20 years. Families like mine use this type of conservatorship as a last resort, often after being forced to allow our loved ones to mentally deteriorate, become homeless and sometimes suicidal. Under the law, people suffering from disabling mental illness must pose a threat to themselves or others in order to get through a psychiatric hospital door — only then can they be treated without their consent. Once the individual is committed to the hospital, the law appropriately imposes protections that can extend the stay and require medication. What the law does not cover is a right to treatment along a compassionate continuum of care that evolves with the patient’s needs.

They both have inspired movements fighting for their rights. Danny’s is different: It is a moms-on-amission movement for the right to treatment, such as that described in my paper and Democratic Sen. Eggman’s legislation. This movement is growing. Please join us. Teresa Pasquini is a California mother seeking to reform local, state and national mental health systems, housingthatheals@gmail.com.

Danny and families like mine need a mental healthcare system that is flexible, funded and full. What we have is incomplete. Because we have inadequate legal standards for judging whether people living with severe mental illness are competent to make decisions regarding their own treatment, we treat some disabling brain disorders as mental or behavioral issues rather than as medically defined illnesses. Our system needs to stop cherry-picking among illnesses that entitle sufferers to treatment and dignified housing and those whose sufferers are left to live and sometimes die on the streets. “Housing That Heals” is a paper that describes an ideal system of care: one that wraps a person in the medical, clinical, rehabilitative and social supports they need in order to live in dignity. The paper describes how an LPS conservatorship helped free Danny from a solitary cell and a potential state prison sentence. That involuntary, medically necessary care also restored his stability, safety and health, allowing him to transition to an adult residential facility in our community. Thanks to the conservatorship, Danny is finally in the right place. He is adequately protected when the conservatorship renewals take place. He has a psychiatrist and peers who partner with him on his care, a mom and dad he relies on for advice, a public conservator he trusts and a public defender who is knowledgeable in conservatorship law. He has the mental capacity now to know that he needs support. There is still no system in place, however, that provides the continuity of care that would protect his freedom and dignity if his conservatorship ends again. Sen. Eggman’s legislation focuses on people like Danny, who need access to outpatient treatment in order to prevent suffering on the street or in jail or returning to a mental state in which they are unable to provide for their own basic needs of food, clothing and shelter. “Free Britney?” Britney has a house, food and an estate worth $60 million to help prevent her from be-

“¿Liberar a Britney?” Q&A: JACKIE CRUZ AND “MIDNIGHT IN THE SWITCHGRASS”
Actress, singer and activist Jackie Cruz gives us the details on her newest film, which follows the true story of law enforcement’s pursuit of a brutal serial killer
Arturo Hilario El Observador
not to be a part of and know that there's a lot of that going on.
Editor’s Note: At a few points during the interview there is a splash of Spanglish, for flavor. That’s just the way bilingual minds work sometimes!
So, yeah, definitely the part of it being a true story definitely intrigued me and the way of it being told in a big way starring Bruce Willis, Megan Fox and getting the story known internationally and worldwide was very, very intriguing as well.
Y
ou may remember Jackie Cruz from her iconic portrayal of Marisol “Flaca” Gonzales on Netflix’s prison drama, “Orange Is the New Black”, or her recurring role in the series “Good Girls”. You may also recognize her from her singing career, or past modeling career; Cruz is a multifaceted entertainer but beyond the cameras and microphones she is an active “freedom fighter”, her activism was on full display last year with support for her fellow Latinx communities amid the pandemic and support during the Black Lives Matter protests, which included speaking engagements at rallies.
Can you talk a little bit about your character, Suzanna? Yes, Suzanna is a strong, dedicated mother and wife, and she keeps her husband on the ground, kind of like, "Okay, you work in this violent world, but remember that you have a house with a family, you have a daughter, you have a wife that you need to come home to. You have that world, and you have a big heart. And you were put in that situation because of your heart. And no one is like you. But don't forget about us. Don't forget that you need to come home to your family."
Recently the dynamic Dominican–American actress chatted about her newest project, “Midnight in the Switchgrass”, which takes its premise from the very true horror of the “Truck Stop Killer”, a serial killer truck driver who terrorized Texas for 15 years until he was apprehended in 1990. “Midnight in the Switchgrass” moves things to Florida but involves the FBI’s pursuit of the elusive serial killer before he takes more lives. With a cast including Megan Fox, Bruce Willis, Emile Hirsch, Lukas Haas, Cruz breaks down what attracted her to the project, what it was like working with one actor who she went to high school with, and how the film ties into the ongoing problem of human trafficking. Hi Jackie, thank you so much for taking time to talk about “Midnight in the Switchgrass”. Yes, I'm so excited it's finally coming out! To start off, I wanted to ask, what attracted you to the script or the story? Well, you know, these are things we don't really talk about very much. These are temas que son muy difíciles de hablar, they're just topics that are difficult to talk about. So, when I read it, I was excited to work on a project that would be known internationally because I grew up in the Dominican Republic and I know about sex trafficking and I know about these young girls that have to go through this, and that's their life, and it's not easy. And what I loved about it is Megan Fox's character and my character, it's seen through like a woman and kind of like strong women, not just like these docile women know it's a woman fighting for girls' lives. I just think it's time to talk about this. I think it's time to talk about these difficult subjects and especially in such a big way with Bruce Willis, Megan Fox, Lukas Haas, Emile Hirsch.

And it was kind of awesome that I got to work with Emile Hirsch because I went to high school with him, and it's been a dream of mine since I was 15 to work with him. We don't know each other in high school, but we had mutual friends and also mutual teachers. And so, the first 15 minutes of me meeting Emile we talked about that, and he couldn't believe it because we went to performing arts school at Hamilton Academy and after that, we had this vulnerable scene together and it was very easy for me because we connected very, very quickly. But yeah, that's what really attracted me to it, that I finally brought this subject forward internationally and in a big way. So, what was it like working with such an ensemble cast and like you talked about already, but what was it like working with the others? Since we're working during a pandemic, the people there are the people that have to be there, like my scene partner, the director, the people behind the scenes, the people making it happen. So, I can only really touch upon my experience with Emile, which was incredible, I respect his talent, he respected my talent, and we just did a beautiful, vulnerable scene together and he took away my shyness because he's very, very method, he's very
focused and he wants to do good work all the time. He did great! I was really blessed to work with an actor that's professional and talented and on point and it was it was beautiful to work with Randall Emmett, it's his first directorial debut. And he brought a lot of heart to it, and he knew exactly what he wanted from me and got it from me. So, it was it was wonderful, it was a great experience. And I can't wait to work with Emile again one of these days. And hopefully Megan Fox and Bruce Willis, like some one-onone scenes, you know. I think for me, one of the things that attracted me to the film is the true crime aspect of it. I was wondering if that at all was also another aspect that piqued your interest besides what you had originally mentioned, which was the unfortunate reality of trafficking? Yeah, I mean, this this is the truth. I'm used to telling the truth when I'm acting, when I get to tell someone else's truth and I've been lucky enough to play roles like Flaca ("Orange Is the New Black") where I'm telling her truth and I get to play roles telling someone else's truth. So right now, this movie, it intrigued me that it was a true story. It's not something new for me. I grew up in Latin America, the Dominican Republic. It's something that I've known my whole life. And I've been lucky enough
So, my character is a very smart woman, and he respects her, he listens to her and she's a dedicated mother. And regardless of what he's doing, maybe he talks about these little girls being prostitutes and she makes sure that he understands that these little girls, that wasn't their dream as a child. This was a position that they were placed in that they didn't want to be in, so I have to make sure that he doesn't judge these little girls, that he stays focused, that he remembers that it's not their fault. So, I have to keep him grounded. So that's what I love about my character, that she has a big heart, but she keeps him grounded and steady and making sure that no matter what he's doing, that he has to come home to us, he has this family that he needs to take care of. Y la última pregunta, muchas gracias de nuevo Jackie, why would you recommend audiences check out "Midnight in the Switchgrass"?

new report by the Brennan Center for Justice examines so-called ‘audits” either under way or proposed for five states that voted to replace Donald Trump with Joe Biden as president in the Nov. 3, 2020 election.
“While details differ, in every case, the proposed election reviews fail to satisfy basic security, accuracy, and reliability measures that should be in place for any election review. And the “auditors” themselves fail to meet basic standards of objectivity,” the report (https://tinyurl.com/AuditingArizona) finds. In addition to Arizona, similar projects are taking shape in Pennsylvania, Georgia, Wisconsin and Michigan, all states that were won by Biden in the general election. “In each state,” the report notes, “election officials have already conducted post-election audits without any findings of widespread fraud.” “That these efforts are gaining traction more than six months after certification of the election is a blinking red warning light,” the report states. “The partisan attempts to review election results are organized by people publicly associated with pro-Trump conspiracy theories.” “The five so-called ‘audits’ are dressed up as fact-finding missions, but they are meant to create evidence that doesn’t exist — fake proof of the myth that the 2020 election was somehow wrongly decided and false validation for the restrictions on the vote now sweeping the country,” said Gowri Ramachandran, counsel in the Brennan Center’s Election Reform Program. “The procedures proposed for these reviews are not designed to obtain secure and accurate results and are radically different from proven election integrity procedures, such as postelection tabulation audits routinely conducted by election officials across the country.” Instead, the report continues, “These plans have severe deficiencies in basic security, accuracy, reliability, and transparency.” Among the issues identified in the report are that Arizona taxpayers will be on the hook for $2.2 million to replace the voting machines in question, because the audit procedures violate federal standards for keeping election materials secure (https://tinyurl.com/ArizonaMachines). Given the audits’ failure to follow established protocols for handling election materials, for instance by giving unaccredited contractors access to voting machines, as has already occurred in Michigan and Pennsylvania, it is reasonable to expect other jurisdictions will incur similar costs, according to the report. While Arizona’s already oft-extended audit is confined to Maricopa County, Wisconsin is embarking on a similar plan that could encompass the entire state. But, the Brennan Center report notes: “Immediately following the 2020 election and prior to the certification of election results, Wisconsin

This audit confirmed that none of the audited voting machines changed votes from one candidate to another, incorrectly tabulated votes, or altered vote totals in any way.
In addition to the official audit, the Trump campaign exercised its statutory right to request and pay for a hand recount of votes in Wisconsin’s two most populous counties—Dane and Milwaukee – which also confirmed Biden’s victory in those counties, finding, in fact, that Biden’s victory had been undercounted by 87 votes (https://tinyurl.com/BidenWisconsin87).
Nonetheless, after GOP legislators from Pennsylvania and 12 other states visited the Arizona “audit” site, Pennsylvania GOP state Senator Doug Mastriano called it “the model to use” and proposed that his state follow Arizona’s lead. Even Arizona’s Maricopa County recorder, Stephen Richer, a Republican, scoffed at the idea: “This is insane just from a competence standpoint,” he said on CNN. “I would say to [visitors who observed the Arizona review] ‘this is not the audit you want, this is far from the gold standard (https://tinyurl.com/RicherComment).’” “Investigations that lack procedural transparency, competence, independence, and objectivity are easily leveraged by partisan actors,” the Brennan Center report concludes.
“Now, in 2021, proponents of the lie that the 2020 election was stolen are looking to use the mere existence of these sham audits to further their ends, just as they leveraged the existence of numerous baseless lawsuits in the lead-up to the January 6 attempted insurrection.”
“The partisan reviews of certified elections being pursued across the country — despite a host of evidence that the results were fair and legitimate — represent more than a break from best practices in election administration. They are an existential threat to our democracy.”
The Brennan Center on July 11 announced the creation of a new website, "https://notanaudit. com/," developed with States United Action, Fair Fight Action and United to Protect Democracy, to provide more details on the so-called "audit" process in the five states.
