A COMMENTARY ABOUT LABOR DAY & LABOR ISSUES is considered the end of summer.

Labor Day in the United States is a federal holiday celebrated on the first Monday in September. It honors the American labor movement's contributions made to the social strength, economic prosperity, laws and community well-being of U.S.A. The first three-day weekend of September is now known as Labor Day Weekend; considered the unofficial end of summer in U.S.A. During the 1880's, as labor movements grew, trade unionists proposed that a day be set aside to celebrate labor. "Labor Day" was promoted by the Central Labor Union and the Knights of Labor, which organized the first Labor Day parade in New York City in 1882. In 1887, Oregon was the first state of U.S.A. to make it an official public holiday. By the time it became an official federal holiday in 1894, thirty U.S. states officially celebrated Labor Day. More than 80 countries celebrate International Workers Day on May 1 – the ancient European holiday of May Day – which is considered the beginning of summer. Canada's Labour Day is also celebrated on the first Monday of September. Mexico’s Labor Day was celebrated last May 1, 2017 as a day off work and school on the first day of May. Labor Day

The celebration of Labor Day has included a street parade to exhibit and publicly display the strength and esprit de corps of the trade and labor organizations. Labor Day parades are followed by a festival for the worker's family and their friends. Speeches by prominent men and women were introduced later, as more emphasis was placed upon its civil significance. This became the pattern for Labor Day celebrations. Still later, by a resolution of the American Federation of Labor (AFL) convention of 1909, the Sunday preceding Labor Day was adopted as Labor Sunday dedicated to the spiritual and educational aspects of the Labor movement. Labor Day Weekend has become another special event for the retailers who offer discounts and allowances to attract consumers having time-off work. The same is true for sporting events such as NASCAR's auto races; National Hot Rod Association (drag races); U.S Open Tennis Championships; and the professional football leagues. All these events take advantage of large numbers of potential customers with time to enjoy shopping or being a paying spectator. Some retailers claim it is one of the largest sale dates of the year, second only to the Christmas season's Black Friday. (Source: Wikipedia: National Labor Day Holiday). So, Labor Day Weekend has become very commercialized. Today many skilled workers are not unionized so these non-union

individuals have no collective bargaining rights as do trade unions such as the American Federation of Labor (AFL); the Congress of Industrial Organizations (CIO), California Teacher Association (CTA), Service Employees International Union (SEIU) and all those construction trade unions (Steelworkers, United Auto Workers, Plumbers, Carpenters, Roofing, etc.). This listing of unions is incomplete without the professional Office and Administrator's Associations. Think of the public policy power which could be very effective if all these groups would unite to advocate for their common concerns and interests. Examples are: equal pay for work requiring the same skill set (i.e., equal pay for equal work); Stopping the practice of having an American skilled laborer train the foreign laborer replacement who will do the same job at lower wages...with the American skilled laborer then being furloughed; health care insurances which include dental, vision and rehabilitation features; include family members and is transferable with the individual; Privatization of Social Security Administration programs; Adoption of foreign trade policy which impacts American jobs (e.g., allowing cheaper foreign steel to enter the American domestic construction market and which caused the RUST BELT) which stretched from Pittsburg, PA to all steel mill centers such as Gary, Indiana. High steel worker layoffs (unemployment) resulted. Recall that Trump Towers was built using cheaper Korean structural steel beams. Without the effective push-back

of a representative union this happens unimpeded. Other common American Labor concerns include health care insurances which are independent of being employed and which deal with benefits such as prescription medications; inclusion of these benefits for family members, etc.; job site safety issues (monitored and enforced by OSHA); a national affordable housing program; improved and continuing Consumer protection Administration to monitoring and enforce existing laws and regulations in the financial industry (banks, mortgages, credit cards, etc.). The current situation is that legislators are prone to favor the interests of very conservative special interests. One of the first things Republican Governor Scott Walker did upon assuming office was to successfully remove the collective bargaining rights of all Wisconsin's public labor unions. In addition to the above concerns, the developments of automation, artificial intelligence (AI), and robotics using increasing levels of computerized technology (cybernetics) are all becoming investments which end up increasing productivity while reducing employment. These remaining employees are invariably ‘knowledge workers’, whose skills are highly rewarded, especially when multi-disciplinary training and experience is already possessed. It is in this regard that education and training become very important. The current public

policy proposals to provide a free education to all individuals is unrealistic unless this program is linked to some return on investment (ROI; i.e., payback). One way to receive an ROI is to require the trainee to agree to serve an equal amount of time in an assigned underserved community. For those who will be unemployable because of the very effective use of robotics, automation and IT, it will be necessary to collect tax revenues which are used to provide a guaranteed annual personal income which underwrites the consumer capability (for living essentials...Maslow Hierarchy of Human Needs) of all unemployed individuals. Shareholders must understand that robots will never be paying consumers which are required if the American Consumer economy is to be sustained. All of the above concerns require work force members to become members of some trade union or professional association. Effective practice of collective bargaining will re-establish an equitable distribution of wealth created by the skilled labor force. The individual worker must become a supporting member of those unions which advocate for (i.e., push back) on behalf of the labor force. The worker who has no membership has no advantage when negotiating a living wage, benefits and retirement plans. Enjoy your three-day Labor Day Holiday. Resolve to become an involved stakeholder in your future. Recreational activity is part of having a good life.

UN PERDÓN IMPERDONABLE Por José López Zamorano La Red Hispana Aún quienes creemos que todas las personas merecen una segunda oportunidad, el perdón del presidente Donald Trump al ex alguacil del condado de Maricopa, Arizona, Joe Arpaio, pasará a los anales de la política de los Estados Unidos como una de las más claras afrentas no sólo contra la comunidad latina, sino contra las normas elementales de la dignidad. A sus 85 años de edad, Joe Arpaio no es sólo un anciano que mostró con sus dichos y acciones un alto grado de desprecio por las minorías, era una autoridad legalmente constituida que durante sus seis mandatos como alguacil se dedicó metódica y sistemáticamente a violar los derechos constitucionales de los latinos. Desde 2011, el ahora ex alguacil Arpaio

fue acusado por el Departamento de Justicia de Eric Holder de utilizar su cargo público, incluidos sus agentes policiales, para establecer una cultura de discriminación contra los hispanos, que caían presos en las redes de las redadas del alguacil simplemente por parecer latinos. A pesar de que un juez federal dictaminó en varias ocasiones que Arpaio y sus alguaciles incurrieron en violaciones constitucionales por sus políticas de detención de latinos, el alguacil Arpaio tomó la decisión no sólo de ignorar sino de burlarse del poder judicial, de allí que haya sido encontrado en desacato y convicto. Pero el perdón presidencial a Joe Arpaio confirma que el presidente Trump decidió continuar siendo un factor de división y polarización nacional, y con en el factor de unidad y reconciliación que los Estados Unidos necesitan para sanar las heridas raciales que rasgan el tejido social. La condena de organizaciones de defensa de los derechos civiles y de las minorías, así como de líderes políticos, legisladores demócratas y activistas progresistas fue inmediata y predecible. Pero llama la atención que el propio presidente de la Cámara de Representantes, Paul Ryan, se declaró en contra del indulto presidencial a Arpaio. Trump no sólo indultó a una persona

que desacató un fallo judicial, sino que, de acuerdo con The Washington Post, inquirió al Procurador de Justica, Jeff Sessions, para ver si era posible echar por tierra el caso criminal contra Arpaio, un dato que podría tener implicaciones legales, aun cuando la Casa Blanca ha intentado minimizar las acciones del presidente. Con su indulto a Arpaio, Trump ha premiado la lealtad y el apoyo político de un hombre a quien considera un héroe nacional. En contraste, para muchos en la comunidad latina, la decisión presidencial fue una clara confirmación que su corazón está del lado de quienes incitan el odio y las tensiones raciales, y que muestran un abierto desprecio por la cultura de la legalidad. Ask who will be doing the actual work and make sure that information is included in the contract. If the contractor is hiring a subcontractor, make sure they’re properly licensed and insured as well.

Few things are more refreshing than swimming on a hot day, but traveling to a neighborhood pool can be more trouble than it’s worth. Maybe the recent heat has made you consider building a pool in your backyard. Or maybe you have a pool that you’d like to use, but it needs to be repaired.

• Know if you need a permit. Many cities and counties in California require a special building permit to install swimming pools over a certain depth. Know whether this applies to you and make sure your contractor obtains all necessary permits. Upon completion of the project, someone from the city or county may need to perform a final inspection.

Thankfully, you can find help – there are many swimming pool companies eagerly awaiting your call. But it’s important to be careful! In 2016, consumers nationwide filed nearly 2,000 complaints against swimming pool contractors, dealers, and design companies with Better Business Bureau (BBB). Common complaints included contractors refusing to do repairs that were covered by a warranty, projects not being completed in a timely manner, and contractors making a mess and destroying yards. Avoid these problems and keep your cool by keeping the following BBB tips in mind: • Do your research. Your first stop when looking for a swimming pool contractor should be bbb.org! A company’s BBB Business Profile includes their rating, complaint history, and reviews from past customers. You can also ask for recommendations from friends & family. When you first talk to the business, make sure to ask for references – and actually check them. Ask at least three contractors

Make sure the estimates are for identical scopes of work and specify the size of the pool, what labor is needed, and an itemized list of materials. Watch out for too-good-to-be-true quotes and don’t automatically accept the lowest bid. • Check licensing. The contractor performing the work will need a special C-53 license from the Contractors State License Board (CSLB). The CSLB advises that “in California, any contracting

Suzanne Potter California News Ser vice LOS ANGELES - Immigrants' rights groups are organizing a week-long series of rallies aimed at saving DACA , after reports sur faced that President Donald Trump will decide its fate this week. The Deferred Action for Childhood Arrivals program has given work permits to more than 750,000 people. One in four of them, or about 215,000, lives in California. Melody K lingenfuss, a California Dream Ne twork statewide organizer for the Coalition for Humane Immigrant Rights of LA , came here at age nine from Venezuela, overstayed her visa and grew up to earn a master's degree from USC. She now heads the California Dream Ne twork for CHIRLA . "They're really dealing with our lives here," she states. "They gave us a chance and now making a decision that could change the entire course of our lives, of our education and what we have built up so far since we were brought to this countr y. It really would be unjust." Each day this week, CHIRLA is organizing phone banks and unfurling banner drops over freeways. It also is holding a vigil

Wednesday night on Olvera Stree t and a lunchtime rally at the federal building on Friday. Other groups are planning events in the Bay Area, the Sacramento region, and Orange County. The County’s brief, authored by the Santa Clara County Counsel’s Office and filed with the United States District Court for the Northern District of Illinois in City of Chicago v. Sessions, urges the Court to grant the City of Chicago’s motion for a preliminary injunction barring enforcement of new federal grant conditions recently announced by the U.S. Department of Justice (“DOJ”). The new DOJ conditions target the Edward Byrne Memorial Justice Assistance Grant program, the leading source of federal grant funds for law enforcement, crime prevention, correctional, prosecution, indigent

defense, and crime victim and witness programs. DOJ aims to disqualify state and local governments from receiving these funds unless they agree to assist the federal government in enforcing immigration law. The County’s brief argues that these unconstitutional and unlawful conditions undermine the ability of local law enforcement agencies to carry out their own considered judgments about how best to keep their communities safe. “Local law enforcement officials around the country, including here in Santa Clara County, have said time and again that they cannot fulfill their duty to protect the community when immigrants are afraid to come forward and report crimes because they think the police will turn them over to immigration,” said Santa Clara County Board of Supervisors President Dave Cortese. “Local governments need the

freedom to set policies based on what’s best for our communities.” Many cities and counties around the country have decided that limiting their involvement in federal immigration enforcement promotes public safety by empowering all community members to report crimes and serve as witnesses. In fact, the brief cites evidence that communities where local police do not serve as immigration agents—including major cities like Chicago—have lower crime rates than those that do. DOJ’s new grant conditions would force local governments to either abandon the policies that they have adopted to increase community trust and lower crime rates, or lose their main source of federal funding for critical law enforcement programs that help achieve these goals. “These new the federal

unconstitutional attempt to strip grant funds from local communities,” said Santa Clara County Counsel James R. COULD GLOBAL WARMING REALLY ALREADY BE A FACTOR IN THE EVOLUTION OF WILDLIFE SPECIES? EarthTalk

No doubt the quickly changing climate is already triggering various evolutionary shifts in a wide range of species. And while we can’t be sure just how different wildlife species will adapt (or not), scientists are already noticing some surprising changes as a result of rising surface and ocean temperatures thanks to human-induced global warming. To wit, a recent study published in the peerreviewed scientific journal, Global Change Biology, by scientists from the University of British Columbia, found that the body size of larger fish species decreases 20 to 30 percent for every one-degree Celsius increase in water temperature, given their gills’ inability to keep up in our warmer and increasingly oxygen-deprived seas. (The top 2,000 feet of the ocean water column has warmed 0.3 degrees Fahrenheit since 1969, and the speed of the warming is faster than ever.) The researchers add that smaller fish are likely to have an advantage given that their body sizes are less likely to outgrow their respiratory systems. The result could be a profound shift in marine food webs with untold consequences for the health of the ocean, not to mention the state of our dinner plates (nearly a billion people around the world rely on fish as a primary source of protein). And there’s proof that global warming is shrinking wildlife species on land, too. An October 2014 study by scientists at Durham University in Britain found that chamois mountain goats in the Italian Alps weigh 25 percent less than their same age

counterparts did 30 years ago. University of Maryland researchers found that six out of seven species of U.S. salamanders studied have shrunk an average of eight percent overall since the 1950s, with each successive generation shrinking in average body size by one percent. Another example comes from a National University of Singapore study that found that ectotherms (toads, turtles, snakes) are also shrinking around the world in response to hotter climatic conditions. A February 2017 review of scientific literature on global warming’s broad footprint on wildlife by 17 researchers collaborating from around the world suggests that we may actually be underestimating how much climate change is affecting wildlife populations. The analysis of 130 studies on the ecological consequences of climate change revealed that 47 percent of land mammals and 23 percent of birds—more than 700 wildlife species overall—have already been affected by global warming. “There has been a massive under-reporting of these impacts,” says University of Queensland researcher and study co-author, James Watson, adding that only seven percent of mammals and four percent of birds showing a negative response to climate change are currently listed as “threatened” by the IUCN, which maintains the world’s “Red List” of endangered species. “We need to greatly improve assessments of the impacts of climate change on species right now, we need to communicate this to wider public and we need to ensure key decisions makers know that something significant needs to happen now to stop species going extinct,” warns Watson. “Climate change is not a future threat anymore.”

appreciation for one another. “We see what you’re doing in the community, we like what you do, like how you support us, this is how we can support you,” says Nguyen. The music this year, down to 11 acts plus the 5 Sonido Clash resident DJ’s, aims to please people of all tastes and ages. “I personally always wanted to get a traditional cumbia band, we also wanted to do somebody like Prayers who are making a name for themselves, playing Coachella and all these music festivals all around. To bring that quality to the East Side,” says Zepeda. Amongst the artists this year are the aforementioned “Cholo Goth” musicians Prayers, 19 year-old R&B artist and social media famous Cuco, and classic Mexican Cumbia band Grupo Maravilla.

As avid readers may remember, we have spoken to the music collective Sonido Clash a few times now, and each time they are upping the ante on what they can do in San José for culture and community. Now they’ve returned with a music festival in tow. The 2nd Annual Sonido Clash Music Fest marks a moment where the main team of Quynh-Mai Nguyen, Roman Zepeda, Fernando Julian Perez, Angel Luna and Thomas “Tommy” Ramon Aguilar, have brought together a diverse music festival with just enough musical edge and activities to bring about the entire family. Last September was Sonido Clash’s first foray into throwing a festival, which according to them is quite different and expansive compared to one of their traditional downtown get-togethers. “So the first music festival came with a lot of heartache and stress, but we always had this idea that we wanted to do a music festival, especially one that was all-ages, and we wanted to do something in the east side. Then the opportunity came that we could do it last year and through grants we went ahead and did it,” Zepeda says. In some ways the collective aims higher because they want to do more for the local population of San José but at the same time experiment with what groups of people they can converge and bring together. Zepeda says, “I think shifting from doing these events at clubs or parties, it’s just Sonido Clash maturing. It’s trying to take it to the next level. Kind of getting away from doing small parties and doing these larger events.” Nguyen adds, “My experience is coming to Sonido Clash, starting with their marketing as they were doing parties consistently on the monthly, and seeing

that growth. It was kind of as if building that consistency within the community and credibility within the community led them and prepared them for the moment of the festival and taking a lot of the opportunities that San José had to offer, especially for people of color.” Last year’s initial festival saw over 500 attendees, and a whopping 24 musical acts at the School of Arts and Culture at the Mexican Heritage Plaza. “I think personally, it was a success for being the first one, and we only had three weeks to do it. We didn’t spend any money out of our pockets, we broke even and that’s successful, just hearing from other people that throw events. There was a lot of things that we learned, and that we want(ed) to tackle this year,” says Zepeda. One aspect that needed to change in order to better utilize the time and space of the Mexican Heritage Plaza is according to Nguyen, the number of acts and who they brought in as partnerships.

“I guess because we got so excited, one of the things was that we had so many artists, so scheduling was something that was like, ‘okay, maybe we shouldn’t have too many artists on the bill,’ because the logistics.” Nguyen says that the 5 members of Sonido Clash were leading the charge, working with volunteers to hectically load and unload acts onto the stage. “What made it different this year is that we really thought about what partners to reach out to help us fill up that space, and to take lead and ownership of that space. And it’s a trusted partnership too.” The groups that are featured at the festival include Poetry Center San José, South Bay DIY Zine Collective, and Veggielution. They are collaborators of Sonido Clash which share the same goals of community buildings and the arts, and have mutual

In the end the group hopes that there is

greater attendance, and a lot of diverse people having fun and enjoying what they worked so hard on. After all, the event is moving the constantly evolving and sometimes alien downtown area entertainment to their backyard. Nguyen says, “I think for me, and I feel that for a lot of people, especially in the east side, what makes San José, it is the diverse cultures, it is the Mayfair, it is the east side. We’re a million more strong and a lot of the people within the 280/680 border are a very intimate and vibrant community with multiple cultures. It’s the cultural history that really sticks out and if we don’t take opportunity to highlight those areas and activate those areas it’s always going to be seen in downtown.” Zepeda adds, “I think a lot of people in Sonido Clash feel the same way. We’re born and raised in San José, growing up and always being told that the east side was ghetto, that there’s nothing in the east side, and to be able to make this festival in the east side and finally having something, well there’s more to the east side. PORTLAND, Ore. – Agosto 31 fue el Día Internacional de la Conciencia de Sobredosis, una fecha para visibilizar la lucha que los expertos médicos en Oregón y en todo el país libran contra la creciente epidemia de esta causa prevenible de muerte. Y es que el uso intensivo de opioides ha captado la atención nacional debido a que la cantidad de muertes que provoca se elevó demasiado en los años recientes. Melissa Brewster, farmacéutica y coordinadora clínica en la organización Columbia Pacific CCO en el noroeste del estado, comenta que la cantidad de muertes por sobredosis ha bajado un poco en Oregón, a 12 casos por cada 100 mil muertes en 2015. no siempre es el caso.” En 2015 casi 35 mil personas murieron en el país de sobredosis de opioides o heroína, según informa el Instituto Nacional del Abuso de Drogas (National Institute on Drug Abuse). Hace algunos días, este mismo mes, el Presidente Trump declaró la epidemia de opioides como emergencia nacional. Brewster comenta que Columbia Pacific trabaja con clínicas y hospitales para encontrar alternativas a la prescripción de opioides para el manejo del dolor, y aumentar el acceso a naloxona, una medicina usada para bloquear los efectos de los opioides en caso de sobredosis. Agrega que Columbia Pacific también trabaja para incrementar el acceso a los tratamientos asistidos con medicamentos.

El condado Tillamook es el que tiene la tasa mas alta en casos de sobredosis en el estado. Brewster dice que cualquiera que use opioides corre el riesgo de una sobredosis.

“Reconocemos que los pacientes que toman opioides durante mucho tiempo pueden desarrollar una dependencia física o una adicción a estos medicamentos, y el tratamiento más efectivo para los desórdenes por el uso de opioides es el que se apoya en medicamentos como buprenorfina o suboxona.”

Brewster comenta que se ha reducido dramáticamente la tendencia de recetar opioides para el manejo del dolor, y que esto está llevando a su vez a una disminución de muertes causadas por sobredosis.
