Hilbert Morales EL OBSERVADOR The “Inaugural Spirit Awards Gala” organized by La Raza Roundtable Executive Committee was held on Friday, August 26, 2016 at the Mexican Heritage Plaza. This event focused upon the efforts of Latino leaders, who with their institutional partners, focused upon encouraging and informing Latino millennial youth concerning the need to become 'knowledge workers'. Its program featured CA Supreme Court Justice Mariano-Florentino Cuellar (nominated by Governor Brown; confirmed unanimously by the Commission on Judicial Appointments, and retained by voters for a full term in November 14, 2014). Justice Cuellar is a naturalized U.S. Citizen who was born in northern Mexico. He has stellar credentials: Calexico High School diplomate (Imperial Valley); Harvard UniversityB.A. magnum cum laude; Yale

THE 2016 SPIRIT AWARDS GALA (LRRT) University Law School, J.D.; Stanford University, Ph.D. in Political Science; has focused his practice on international law, administration; and 'legal academia' (Stanford Law School). After law school, he began his careen at the U.S. Treasury Department, Office of Enforcement. Justice Cuellar clerked for Chief Judge Mary M. Schroeder, U.S. Court of Appeals, 9th District. His wife is also a judge. Justice Cuellar, as keynote speaker, summarized in a very engaging manner his personal life journey. The Spirit Awards were made to: Mrs. Pattie Cortese, Board member, East Side Union High School District for her 'Youth Advocate' community services which, she said, “I enjoy very much; It's what I like to do.” Superior Court Judge, The Honorable Katherine Lucero, for being a juvenile court “Judicial Advocate.” Member of the California State Senate, the Honorable Jim Beall was awarded the “Legislative Advocacy Spirit Award.” Senator Beall is the author of several legislative proposals on mental health/behavioral health services.
The “Social Justice Advocacy Spirit Award' was made to the Office of Cultural Competency, County of Santa Clara. The Latino Education Summit featuring the ENLACE Program received the “Education Advocate Spirit Award.” This program was specific for Latino students at Evergreen Community College; Also to the Latino Education Summit (Foundation for Hispanic Education) was the first Latino lead effort to bring forth educational issues presented by Latino educators for Latino parents, students, and teachers. It was only right that the “Lifetime Achievement Award” was made to Victor Garza, Chair, La Raza Roundtable since its formation during 1988. Under his tenure, LRRT has evolved into a monthly forum , MC'd by Chairman Garza. LRRT audience hears brief reports from 13 'Standing Committees' (really work/task groups addressing specific issues). These are: 1) Educational Institutes; 2) ConXion (Rose Amador); 3) Juvenile Justice (Raul Colunga); 4) Probation Department; 5) San Jose City Manager; 6) Work2future; 7)
Legislation (Paul Guerrero, Esq.); 8) Los Bomberos/San Jose Fire Chief; 9)District Attorney; 10) Hispanic Chamber of Commerce; 11) SIREN; 12) Bridge Point; and 13) Elected Officials commentaries. Each monthly meeting has a featured guest speaker. For the July 2016 meeting these were Norma Camacho, Interim Director, SCVWD and SJPD Chief Eddie Garcia.
This 'Spirits Awards Gala' had a 'sold out' full house (300 paid attendees) who enjoyed the above proceedings while dining in the Rotunda, Mexican Heritage Plaza. It focused upon the extensive community service work done by many on behalf of 'improvement of the quality of life for all residents' in keeping with its 1988 “Mission Statement” which is:

It was very appropriate, during his brief comments following receipt of “Lifetime Achievement Award” that LRRT Chair Victor Garza asserted his appreciation that “They do all the work and I get all the credit.” The LRRT 'Spirit Award Committee' deserve the community's gratitude for planning and implementation of this event within three months. Its members were Rose Amador, Raul Colunga, Jennie Meehan, Bob Nunez, Craig Pasqua, Michelle Pelayo-Osorio, Izaak Piehardo, Herman Vasquez, and Teresa Alvarado.

49ERS' COLIN KAEPERNICK HAS SPARKED THE SOCIAL JUSTICE CONVERSATION HE WANTED BY SITTING THROUGH THE NATIONAL ANTHEM Arturo Hilario El Observador Friday August 26th at Levi’s Stadium was a day of NFL infamy. Although not playing that day, Colin Kaepernick sat amongst his teammates on the bench through the whole game, most notably during the National Anthem. In a post game interview, Kaepernick made it clear why he was sitting out on the anthem: “There are a lot of things that are going on that are unjust. People aren't being held accountable for. And that's something that needs to change. That's something that this country stands for: freedom, liberty and justice for all. And it's not happening for all right now. Yes. I'll continue to sit. I'm going to continue to stand with the people that are being oppressed.” It may have seemed like Kaepernick's act of sitting was being unpatriotic and a nuisance to his team and the NFL, but
after the interview it was there for everyone to analyze. It was not him screaming radical statements, or him being ignorant or uninformed. It was an American athlete using his spotlight to bring to attention a problem in this country in the same vein as Muhammad Ali during the Vietnam War or Tommie Smith and John Carlos during the 1968 Mexico Olympics. Kaepernick's reasoning was simple. As an American who is also half-black, he believes that there is inequality in how law enforcement treats African-Americans and other minorities. He would not stand for a flag that represents freedom and equality but does not practice what it preaches amongst all its citizens. He was concise, and well thought-out in his messaging. It was not him screaming radical statements, or him being ignorant or uninformed. He is still proud of being an American, he just isn’t happy about how some groups are treating others. Even with this clarification, he started a wave of opinions for his actions, and negative views against him.
Some of the bad is coming from promilitary folks saying he was out of line and un-American. The problem with this is they fail to see that Kaepernick acknowledged that angle. “I have great respect for the men and women that have fought for this country.. Men and women that have fought for this country have given me this opportunity by contributions they have made. So I don't see it as going about it the wrong way.” One interesting thing is the development of twitter hashtag #VeteransforKaepernick on Tuesday August 30th, which pushed back against the hate. Veterans of many military branches let themselves be known as supporters of his freedom of speech and reluctance to stand, even if they didn't all agree with everything the 49ers quarterback had said. One of the most publicized tweets was of Army Vet and writer Charles Clymer, who said “Don't use my service--or that of any veteran--to justify the silencing of black Americans. Not on my watch.”
The brilliance of Kaepernick's action, whether he planned it to this extent, was that people are talking. Citizens of all types, of all ethnicities and positions in life are bringing their opinion to the table, whether they care about the NFL or not. Sports fans, veterans and anyone really are having a conversation surrounding the idea of what makes someone an American. That a person in this country has the right to decline to such American traditions as a flag ceremony at a sporting event if they feel the country is not doing its job is okay. It’s what makes this such a nation of discussion and freedom. To disagree with your government is as American as Apple pie. Presidential candidate Donald Trump says America needs to be fixed, and now so does this NFL athlete. But unlike Trump he is demonized specifically because of the issues he feels need to be fix; And because of the color of his skin, or half of it if you want to get specific.

ESUHSD IS THE TOP PERFORMER AMONG DEMOGRAPHICALLY COMPARABLE DISTRICTS
San Jose, CA - The California Department of Education released its CAASPP results this month. The CAASPP are from the Smarter Balance Assessment Consortium (SBAC). The CAASPP replaced the former California Standard Test (CST) during the 2014-15 school year. The 2015-16 school year marked the second year that students took the SBAC in English Language Arts and Math. The 2014-15 results established the new baseline for performance and trends. Tests include performance tasks that challenge students to demonstrate critical thinking and problemsolving, and to apply their knowledge and skills to real-world problems. The following is an executive summary of the CAASPP scores from Spring 2015 for East Side Union High School District and 5 demographically comparable districts (Sweetwater Union, Antelope Valley, Kern Union, Oxnard Union, Anaheim Union). ESUHSD Key Highlights and Trends: • ESUHSD had a higher percentage of 11th grade students scoring "meeting or exceeding standard" in both English Language Arts (ELA) and Math (2016 vs 2015)
• 30% of 11th graders scored "college ready" in ELA

BPT "How was your day," you ask your child after school. Rather than hearing a funny recess anecdote or story about a tough test, she murmurs back, "I'm hungry." School days are long, and if your child participates in after-school activities, they're even longer. Busy kids need plenty of fuel to keep their bodies and minds going. "Considering most kids get just 20 minutes to eat lunch, and some as early as 10:30 in the morning, after-school hunger becomes a big problem," says Laura Fuentes, cookbook author, food blogger and founder of MOMables. Better Business Bureau El Día del Abuelo se acerca a principios de septiembre, y no hay mejor manera de celebrarlo que aprender sobre el sorprendentemente bajo nivel de vulnerabilidad a las estafas de los adultos mayores. Las personas mayores son a menudo consideradas como las victimas de estafas perfectas – fuera de tacto, crédulos, y no familiarizadas con tecnología. Sin embargo, este estereotipo no es cierto. PRIMERA REVISIÓN QUINQUENAL EVERGREEN ELEMENTARY SCHOOL SAN JOSÉ, CALIFORNIA El Departamento de Control de Sustancias Tóxicas (DTSC) ha completado una Revisión Quinquenal sobre la eficacia de la solución para el sitio de Evergreen Elementary School (Sitio) ubicado en 3010 Fowler Road, San Jose, California 95135. El propósito de la Revisión Quinquenal es asegurarse de que el método de limpieza elegido sea aún efectivo y que funcione como diseñado y se mantenga adecuadamente para proteger la salud humana y el medio ambiente. La limpieza incluía cubrir las siguientes áreas con una tapa: Área del Corredor del Sur de servicios; área del Corredor del Este de servicios; área de estacionamiento pavimentado; áreas ajardinadas; área de aulas de clase; área de edificio de usos múltiples y área de parada/acceso de autobús para reducir la exposición a estudiantes y personal. La tapa consistía en una barrera de advertencia (valla paranieves naranja) seguida de material de relleno importado, seguido de asfalto o concreto, materiales de suelo y jardinería. La limpieza también incluía actividades de operación y mantenimiento a largo plazo para controlar y proteger las tapas en el Sitio. La limpieza finalizó en el verano de 2009. El 27 de agosto de 2015, se llevó a cabo una inspección del Sitio. La inspección identificó cambios en la condición o uso del Sitio; cambios de construcción que afectan las tapas; identificación y evaluación de las reparaciones necesarias; y cualquier información significativa en relación con las tapas. BOARD APPROVES SUPPORT FOR ROOTS COMMUNITY HEALTH CENTER

New Clinic Will Serve the Needs of African American Community in County Office of Dave Cortese A new health center focused on the needs of African Americans received $350,000 from the Santa Clara County Board of Supervisors on Tuesday, August 30, 2016, to cover construction and other initial costs of launching the project. The Board voted unanimously to support the Roots Community Health Center, which will be the first and only primary care facility in the County to specifically address the needs of residents of African ancestry. The project will be a partnership of the Oakland-based Roots Community Health Center and the Ujima Adult and Family Services in San Jose, which currently provides mental health services to AfricanAmericans. “The County will continue to support the
Roots Community Health Center as it develops into a vital health care service provider for our African-American community,” said Board President Dave Cortese. “This project will improve the overall health of African Americans, and the overall health of the County.” The health center was a recommendation of the County Public Health Department’s report, completed in 2015, the “Status of African/African Ancestry Health: Santa Clara County,” a health assessment called for in 2013 by Supervisor Ken Yeager when he was Board President. The Black Leadership Kitchen Cabinet of Silicon Valley partnered with the Public Health Department on the assessment. “One of my priorities was to address the significant health disparities in our County’s African-American population,” said Supervisor Yeager. “I’m happy that led

to the health assessment and now a clinic dedicated to these residents’ unique needs.” While the health assessment found that disparities between the health status of the African/African Ancestry community and other racial/ethnic groups in the County had decreased in recent years, disparities continued to exist in several areas. The report revealed a lower life expectancy among this population compared to other racial/ethnic groups, a higher rate of infant deaths and higher rates of cancer, high blood pressure and newly diagnosed HIV cases. Participants in the study cited that a lack of cultural competence in the healthcare delivery system that contributed to poor experiences and the lack of services to address the cultural practices and experiences of community members.

ACTORS HEADLINE MARCH TO KEEP SANDERS' REVOLUTION GOING Suzanne Potter California News Service HOLLYWOOD, Calif. - Actress Shailene Woodley, best known for her role in the "Divergent" movies, spoke at a march on Hollywood Boulevard on Saturday, rallying hundreds of progressive advocates to defend causes championed by Sen. Bernie Sanders. The "Enough is Enough" march was the first event for the group Californians for Progress, which evolved from the L.A. office of the Vermont senator's presidential campaign. March co-organizer Michelle Manos said the thousands of people who were drawn to Sanders' cause will now harness that enthusiasm to push for change on a range of issues. "People need to stay involved. We're still here. You should still be here," Manos said. "This revolution is not over, it's just getting started and everyone needs to be involved." But Woodley was there to protest the proposed Dakota Access Pipeline, which would carry 400,000 barrels of crude oil a day from the Dakotas through Iowa to connect with a pipeline in Illinois. Local tribes have been fighting the halffinished, multibillion-dollar, 1,100 mile project, arguing that the risk of a spill is too great. Manos said it is a matter of environmental justice. "The idea that you could take a pipeline that a white community rejected and put it through a brown and Native community is blatantly racial," she said. "And then to violate the treaties and sacred lands is absolutely egregious." Californians for Progress is also working to defeat the Trans Pacific Partnership, saying it would be bad for working people and for the environment. Actor Kendrick Sampson, best known for the show "How to Get Away With Murder," also spoke at the event.

WHEN DID SCIENTISTS FIRST DISCOVER THAT CARBON DIOXIDE LEVELS WERE RISING DUE TO HUMAN ACTIVITY?

Since the planet was born some 4.5 billion years ago, it has undergone ice ages and warm periods due to natural changes in its orbit around the sun and other factors on its surface. But since the Industrial Revolution, humans have been the main factor in the Earth’s warming. Since pre-industrial times, the Earth’s surface has warmed some 1.5 degrees celsius. And with 2.4 million pounds of carbon dioxide (CO2) being released into the air every second, we are on track to get a lot warmer still. So when did we realize climate change was happening and who is responsible? The science behind climate change was first understood by Swedish chemist Svante Arrhenius in 1896; he thought the results would be positive for humans. Arrhenius realized that burning fossil fuels would have a greenhouse effect on the planet and would likely warm the planet by several degrees. Throughout the 20th century, the planet’s human population increased by more than 280 percent and CO2 production increased by more than 1160 percent. As the climate warmed, more and more scientists started to realize that human activity must be to blame. By 1959, worry among the scientific community increased as some scientists projected that CO2 would increase with potentially “radical” effects on climate. But it wasn’t until 1995 that the Intergovernmental Panel on Climate Change gave a definitive statement that humans are responsible for post-industrial global warming. As of 2010, there was a 97 percent consensus among scientists that climate change was caused by humans. So why haven't we fixed the situation? The answer may partially lie in the part large energy corporations played in swaying public opinion. As InsideClimate News reports, ExxonMobil was aware that anthropogenic climate change was likely as early as 1977. Since

then, ExxonMobil has spent more than $30 million on think tanks that promote climate denial. While it can perhaps be pardoned for opposing climate change research when the science was still inconclusive, ExxonMobil continued funding climate change denial groups as late as 2009—well after our carbon emissions were established as the cause of climate change. ExxonMobil even helped found the “Global Climate Coalition,” a lobbying group that prevented the U.S. from taking action against limiting greenhouse gas emissions. And ExxonMobil isn’t alone. Koch Industries, a Kansas-based multinational with big investments in oil and other fossil fuels, has donated over $88 million to climate change denial. Chevron, BP and others also fund such efforts. The actions of these companies have had a profound impact on public opinion. According to a recent survey by the Pew Research Center, the U.S. has the highest carbon emissions per capita in the world but “is among the least concerned about climate change and its potential impact.” Confronting ExxonMobil and other corporations that give misleading information to the public is important because this issue affects all of us. Non-profits like Greenpeace are trying to make sure oil companies stop obfuscating the truth and start promoting cleaner energy. Regardless, our commitments at the Paris climate accord have the U.S. and the rest of the world on the right path toward reducing emissions, no matter what the oil companies say about it. The event included a screening of a documentary based on Salazar’s work and life as well as a panel discussion with the director Phillip Rodriguez. “Ruben Salazar is a pioneering journalist whose legacy is that of a champion and a voice of the Hispanic community in Los Angeles,” said Patiño. “It is an honor to rename our news studio to commemorate his life and his work, and to inspire generations of Univision journalists and community members for years to come.”
Born in Mexico and raised in El Paso, Salazar began his career as a local reporter at The Los Angeles Times in 1959. He left Los Angeles to fill posts in Vietnam, the Dominican Republic and Mexico City, but was called back in 1968 to cover the increasingly vocal Chicano power movement that was growing in Los Angeles at the time. Univision Los Angeles is UCI’s owned and operated, Emmy-award winning and nationally recognized television station. San Jose Sharks SAN JOSE, Calif – The San Jose Sharks (@ SanJoseSharks) announced last week that forward Logan Couture (@logancouture) has been selected to represent Team Canada at the 2016 World Cup of Hockey. The tournament will be held from Sept. 17-Oct. 1 at Air Canada Centre in Toronto. Couture, 27, recorded 36 points (15 goals, 21 assists) and 20 penalty minutes in 52 games this season with San Jose, and recorded his first career hat trick on March 19 at Vancouver. He went on to post 30 points (10 goals, 20 assists) in 24 playoff games as the Sharks reached the Stanley Cup Final for the first time in franchise history. Couture led all NHL skaters in playoff points and assists, establishing Sharks postseason franchise records in each category. He became one of just five players to record at least 30 points in a single postseason in the last 20 years (joining Sidney Crosby, Evgeni Malkin, Daniel Briere, and Joe Sakic), and he recorded
four, three-point games in the playoffs, all of which coming with his team facing elimination or with the chance to eliminate an opponent. One of San Jose’s alternate captains, Couture has posted 324 career points (154 goals, 170 assists) and is a plus-48 in 431 NHL games over his career. He ranks 6th all-time in Sharks franchise points and goals, and T-9th in assists. He ranks 5th in goals scored amongst his 2007 draft class. In addition, Couture represented Canada at the 2007 World Jr. U-18 Championships, posting two goals and two assists in six games. The six-foot-one, 200-pound native of Guelph, Ontario, was originally selected by San Jose in the 2007 NHL Draft (1st round, 9th overall). Couture joins fellow Sharks Joe Thornton, Brent Burns and Marc-Edouard Vlasic on Team Canada for the tournament, as well as Joe Pavelski (USA), Tomas Hertl (Czech Republic), Joonas Donskoi (Finland), and Mikkel Boedker (Team Europe), who were also selected for their respective countries.
The Golden State Warriors will play three home games in the Bay Area, including two at Oracle Arena and one at the SAP Center in San Jose, as part of a seven-game preseason schedule, the team announced today. Each of the three home games will feature exclusive bobblehead giveaways for the first 10,000 fans in attendance. The first home game, on October 4 against the Los Angeles Clippers at Oracle Arena, includes the Stephen Curry Back-to-Back MVP Bobblehead, presented by Kaiser Permanente Get Fit, featuring the All-Star point guard holding both of his MVP trophies. The Warriors will return to SAP Center in San Jose for the second-consecutive year on October 6 to host the Sacramento Kings in a game that includes a Klay Thompson San Jose Sharks Edition Bobblehead, featuring the All-Star shooting guard in a Sharks sweater in support of the Bay Area’s National Hockey League team that calls the SAP Center home. A FEW WEEKS WITH THE SAMSUNG GALAXY NOTE7: REVIEW Shelly Palmer
The Galaxy Note7 is Samsung’s newest, fastest and best handheld to date. Rather than dress up the very successful Note5, Samsung skipped a generation (by number only) and dubbed the new device the Note7 to bring it into line (in features, look and feel) with its Galaxy S7 and S7 Edge. That said, the Note7 (which runs Android 6.0 Marshmallow OS) has some excellent new features that separate it from its Galaxy siblings and make it the perfect device for business people who need enhanced productivity and for normal people who want a f lexible device that will let them express themselves in fun and easy ways. WHAT’S NEW? There is a laundry list of new features that, while not paradigm shifters, are super nice to have, including these:
• SMART S PEN – it can translate text and take scrolling screen shots, and you can write on almost every screen the device can display. There’s no need to open the Note7 to jot a note; you can just pop out the S Pen and scribble what you need to scribble right on the lock screen.
• AWESOME
GIF MAKER – is it pronounced Jif, like the peanut butter, or Gif, with a hard “G?” Steve Wilhite (who invented the file format in 1987 while working at CompuServe) says it’s pronounced Jif, like the peanut butter. But no matter how you pronounce it, the Note7 has an awesome Gif maker. Select the video you want with the S Pen, crop it, save it and you’re done. It could not be faster or simpler.
• K NOX
SECURITY FOLDER – Samsung took its industrial-strength Knox Security protocol and built it into the Note7. You can have as many password-protected files and folders as you like, but you’d better remember the password because if you forget it, no one (not even Samsung) can recover it for
you. Considering what’s going on with nation-state hacking, this is a feature whose time has come.

BOURNE–STYLE IRIS SCANNING – fingerprint scanning is fun, but iris scanning is super fun! Just hold your locked Note7 in front of your face and look into the iris scanner, and the phone will open. It’s probably not as fast as fingerprint scanning, but it’s so much cooler.
• SMALLER IS BIGGER – The dual-edge 5.7″ Super AMOLED screen on the Note7 is the same size as its predecessor, but the Note7’s case is a bit smaller than that of the Note5, so the phone feels smaller and is easier to hold. If you really need to know, the main display is Quad HD (2560 x 1440), which means it’s breathtaking.
• LOW-LIGHT CAMERA – The dual-pixel 12.0 MP (megapixel), rear-facing camera takes great pictures outdoors or in welllit environments, but it is a superstar at night or in darker environments such as candlelit restaurants, night clubs and evening strolls. The Note7 shoots video in 4K UHD (ultra-high definition). For my videophile friends, that’s 3840×2160@30 fps. The videos will play beautifully on your new 4K f latscreen. Up to 256 GB of External Storage – If you’re going to be shooting high-resolution pictures and 4K video, you’re going to be very happy that the Note7 features a microSD slot for memory cards up to 256 GB. It’s IP68 compliant or, to put it another way, “water-resistant in up to 5 feet of water for up to 30 minutes.” Now there’s only one body of water that the Note7 absolutely has to resist (and we all know what that is). The question is, even if the device is undamaged, are you going to put your hands in there to get it? BTW, “IP” is an abbreviation for “international protection marking.” In this case, the “6” means,
“Dust tight – No ingress of dust; complete protection against contact (dust tight). A vacuum must be applied. Test duration of up to 8 hours based on air f low.” And the “8” means “Immersion, 1 meter (~3 feet) or more depth – The equipment is suitable for continuous immersion in water under conditions which shall be specified by the manufacturer. However, with certain types of equipment, it can mean that water can enter but only in such a manner that it produces no harmful effects.” Now you are an IP68 expert. All of the Note7’s other specs are best-inclass. Simply put, it’s the best handheld Samsung has ever made.
