días del vencimiento para un acuerdo sobre el presupuesto federal y sobre importantes iniciativas como la Ley del Campo (Farm Bill), no existe ningún indicativo de qué podrán resolverse a tiempo.

Se trata de una virtual repetición de lo ocurrido en 2023, cuando ante la falta de un acuerdo se acordó extender los beneficios de la ley del campo por un año más y expiran este 30 de septiembre.

El nudo de los desacuerdos entre demócratas y republicanos es la financiación del Programa de Asistencia Nutricional Suplementaria (SNAP) de cupones de alimentos a familias de bajos ingresos, que proporciona asistencia alimentaria a casi 42 millones de personas. SNAP absorbe más del 80% del costo de la Ley del Campo.

Sólo el 20 por ciento de los hogares que reciben SNAP tienen ingresos mensuales brutos por encima del umbral federal de pobreza. El ingreso bruto mensual promedio de un hogar que recibe SNAP es de unos $900 dólares y el ingreso neto de $400. Alrededor del 16% de los beneficiarios de SNAP son familias hispanas.

SNAP no sólo ayuda a combatir la inseguridad alimentaria entre las familias de más bajos ingresos del país, sino que tiene un efecto positivo para estimular a las comunidades locales y aumentar la demanda de productos agrícolas y de consumo básico, todo lo cual tiene un impacto positivo en la economía en general.

Pero los republicanos buscan recortes de 30,000 millones de dólares a SNAP e imponer requisitos laborales y de elegibilidad más estrictos y una reducción del gasto, a fin de canalizarlo a agricultores. Sin embargo, los demócratas, incluida la Casa Blanca, se oponen de manera categórica a cualquier recorte.

Rudy Arredondo, que representa 75,000 granjeros y rancheros latinos en Estados Unidos, y que forma parte de una coalición que empuja por una renovación de la Ley del Campo, dice que han sido mantenidos en la sombra sobre posibles avances en las negociaciones.

Todo parece indicar que la intención de demócratas y republicanos es explorar la posibilidad de un acuerdo sobre la ley del campo durante las sesiones legislativas que tienen lugar después de las elecciones y antes del

inicio del nuevo Congreso.

Los beneficios de SNAP no se acabarán inmediatamente. Aún si no hay un acuerdo presupuestal, pero las familias de más bajos ingresos del país merecen una solución duradera que les brinde seguridad y una alimentación digna.

Withjust days to go before an agreement on the federal budget and on important initiatives such as the Farm Bill expire, there is no indication that they will be resolved in time.

This is a virtual repetition of what happened in 2023, when in the absence of an agreement it was agreed to extend the benefits of the Farm Bill for another year, and now they expire on September 30.

The crux of the disagreements between Democrats and Republicans is the financing of the Supplemental Nutrition Assistance Program (SNAP) for food stamps to low-income families, which provides food assistance to almost 42 million people. SNAP absorbs more than 80% of the cost of the Farm Bill.

Only 20 percent of households receiving SNAP have gross monthly income above the federal poverty line. The average monthly gross income of a household receiving SNAP is about $900 and the net income is $400. About 16% of SNAP recipients are Hispanic families.

SNAP not only helps combat food insecurity among the country's lowest-income families, but it has a positive effect on stimulating local communities and increasing demand for agricultural and consumer staples, all of which have a positive impact on the economy as a whole.

But Republicans are seeking to cut $30 billion to SNAP and impose stricter work and eligibility requirements and reduce spending to channel it to farmers. However, Democrats, including the White House, are adamantly opposed to any cuts.

Rudy Arredondo, who represents 75,000 Latino farmers and ranchers in the United States and is part of a coalition pushing for a renewal of the Farm Law, says they have been kept in the dark about possible progress in the negotiations.

“We are not sure that the Farm Bill will be finalized. We don’t know if the differences in the two legislative proposals, from Democrats and Republicans, have been resolved. We are very concerned,” he tells me.

Just days before the September 30 deadline, Democrats and Republicans agreed on a plan to extend the deadline for a budget agreement until December 20, after the elections. But the Farm Bill was not included.

Everything seems to indicate that the intention of Democrats and Republicans is to explore the possibility of an agreement on the Farm Bill during the legislative sessions that take place after the elections and before the start of the new Congress.

SNAP benefits will not end immediately. Even if there is no budget agreement, the lowest-income families in the country deserve a lasting solution that provides them with security and decent food.

Contact your congressional delegation in Washington and let them know your point of view. No one should be a passive spectator when the food of millions, especially the most vulnerable, is at stake. Your voice and your vote count.

Community colleges are designed to help students get an associate degree and transfer to a four-year university. Most community college students never graduate or transfer, a state audit found.

Manystudents start community college with the hope of getting an associate degree and then transferring to a fouryear institution, such as a California State University or University of California campus.

But a state audit, released September 24, found that the vast majority of these students never accomplish their goal. “Only about 1 in 5 students who began community college from 2017 to 2019 and intended to transfer did so within four years,” the audit states. Transfer rates are even lower for students in less affluent parts of the state and in rural areas and for students who are Black or Hispanic, according to the audit.

The state’s higher education systems are designed so that students can spend two years at community college, two years at a university, and then graduate with a bachelor’s degree. Tuition at community college is cheaper than at any Cal State or UC campus, so in theory, a student who follows this path is saving money.

In practice, few students ultimately transfer and those who do take so long to do it that they lose out on any potential savings.

Without a bachelor’s degree, career prospects are often dim. Many jobs require a bachelor’s degree, and on average, young adults with a bachelor’s degree earn $16,000 more than those with only an associate degree. Adults with only a high school education earn the least on average.

In 2022, Gov. Gavin Newsom set a goal to increase the percentage of working-age adults with a postsecondary degree or certificate from 55% to 70% by 2030. Improving the transfer process is critical to reaching that goal, the audit states.

The community college transfer maze

The transfer system is too complex, the audit says, and numerous studies have found that bureaucracy is partially to blame. Students who want to transfer face a maze of administrative hurdles and esoteric requirements — akin to a game of chutes and ladders.

“California community college students who want to transfer to a four-year college or university are trying to make progress, but one bad roll of the dice can set them back several turns,” said a June 2021 report by the Campaign for College Opportunity, a nonprofit organization.

Some Cal State and UC majors don’t accept certain community college courses, and some community colleges don’t offer the classes that students need. The Cal State and UC systems have different requirements for community college transfer students, and some students — even students who meet the requirements — get rejected, the audit found.

While most community college students who apply to a UC or Cal State get accepted, popular majors, such as computer science, and popular schools, such as UCLA and Cal Poly San Luis Obispo, are far more selective, the audit found. If rejected, these students are supposed to go through a “redirection” process, where they get accepted to another campus. The state audit found that the CSU redirected more than 25,000 community college applicants to other campuses over the last few years.

In 2010, California lawmakers reformed the transfer process by creating a new kind of community college degree that also guaran-

tees admission to a Cal State campus. Known as the Associate Degree for Transfer, it’s become increasingly popular and a key benefit to students, according to the audit.

Lawmakers tried — and failed — to have the UC system guarantee admissions for these community college students. Last year, lawmakers made a breakthrough by passing a bill that will require UCLA to prioritize certain community college students for admission beginning in the 2026-27 academic year. More UC campuses will participate in later years.

The state has also pushed the community college system to standardize how it labels courses to make it easier for students to determine what they need to transfer. Implementing the new system has been slow, however, and it won’t be complete until 2027.

The last major reform will go into effect next year. Beginning in the fall semester, the community college system will offer a new set of common prerequisites that both the UC and Cal State systems have agreed to accept.

But the audit found that these reforms alone are insufficient. Auditors recommended that community college campuses find ways to increase the number of counselors who can support transfer-bound students and that all three higher education systems should work to expand successful programs, such as the Associate Degree for Transfer.

When collaboration is ‘ineffective’

When California designed its current higher education system in 1960, it required both the Cal State and UC systems to make room for community college transfers. The UC system agrees to admit one transfer student for every two new freshmen who enroll, but it didn’t meet that goal last year, said UC spokesperson Stett Holbrook. Part of the problem, he said, is that community college enrollment declined.

The Cal State system doesn’t have a specific goal, but the audit said most campuses still enroll a high number of transfer students. The largest exception is Cal Poly San Luis Obispo, where just 18% of incoming students came through the transfer system in recent years.

In 2017, the community college system set a goal to increase the annual number of students who transfer from about 80,000 to just over 100,000 by 2022. The system never achieved that goal, and the pandemic is in part to blame, the audit states.

Paul Feist, a spokesperson for the California Community College Chancellor’s Office, said the next goal is contingent on whether the Cal State and UC campuses can boost their own enrollment.

One challenge with the transfer process is that it requires the community college, Cal State, and UC systems to work together. Historically,

When the state Legislature allowed the community college system to begin offering their own bachelor’s degrees — a solution that avoids the transfer process altogether — professors at the Cal State campuses fought back, fearing that community colleges might siphon away students and force the Cal State system to lose money.

Each system has a different set-up: The UC is constitutionally independent, which means the Legislature has limited authority over it. The Cal State system is centralized, whereas the community college system is more similar to the K-12 system, where regional college districts make the majority of decisions.

There’s no official coordinating committee between the three public higher education systems. Such a committee did exist over a decade ago, but former Gov. Jerry Brown stopped funding it “because he believed it had been ineffective,” the audit wrote.

The audit didn’t call for a new committee but it did ask all three higher education systems to improve how they share data and information.

El laberinto de transferencias a colegios comunitarios

Más campus de la UC participarán en años posteriores. El estado también ha presionado al sistema de colegios comunitarios para que estandarice la forma en que etiqueta los cursos para que a los estudiantes les resulte más fácil determinar qué necesitan transferir. Sin embargo, la implementación del nuevo sistema ha sido lenta y no estará completa hasta el 2027.

La última reforma importante entrará en vigor el año próximo. A partir del semestre de otoño, el sistema de colegios comunitarios ofrecerá un nuevo conjunto de requisitos previos comunes que tanto el sistema de la UC como el de Cal State han acordado aceptar.

Pero la auditoría concluyó que estas reformas por sí solas no son suficientes. Los auditores recomendaron que los campus de los colegios comunitarios encuentren formas de aumentar el número de consejeros que puedan apoyar a los estudiantes que se trasladan a otro país y que los tres sistemas de educación superior trabajen para ampliar los programas exitosos, como el Grado Asociado para Transferencias.

Cuando la colaboración es “ineficaz”

Cuando California diseñó su actual sistema de educación superior en 1960, exigió que tanto el sistema de Cal State como el de la UC hicieran espacio para las transferencias de estudiantes de colegios comunitarios. El sistema de la UC acepta admitir a un estudiante transferido por

cada dos nuevos estudiantes de primer año que se inscriban, pero no cumplió esa meta el año pasado, dijo el portavoz de la UC Stett Holbrook. Parte del problema, dijo, es que la inscripción en los colegios comunitarios disminuyó.

El sistema de Cal State no tiene un objetivo específico, pero la auditoría indicó que la mayoría de los campus aún inscriben a un gran número de estudiantes transferidos. La mayor excepción es Cal Poly San Luis Obispo, donde solo el 18% de los estudiantes que ingresaron a la universidad lo hicieron a través del sistema de transferencias en los últimos años.

Por qué: De conformidad con la Ley de Calidad Ambiental de California (California Environmental Quality Act), Santa Clara Valley Water District (Valley Water), como agencia líder para el Proyecto de Gestión de Residuos de la Planta de Tratamiento de Agua de Penitencia (Penitencia Water Treatment Plant, PWTP) propuesto, preparó un borrador del Estudio inicial/Declaración negativa mitigada (Initial Study/Mitigated Negative Declaration, IS/MND) para evaluar los impactos ambientales del proyecto.

De conformidad con la Ley de Calidad Ambiental de California (California Environmental Quality Act, CEQA) (Código de Recursos Públicos de California, secciones 21000 y siguientes) y las Directrices de la CEQA (Título 14, Código de Regulaciones de California, secciones 15000 y siguientes), se preparó un Estudio inicial del Proyecto de Gestión de Residuos de la Planta de Tratamiento de Agua de Penitencia (PWTP) para evaluar los impactos ambientales. En función del Estudio inicial, se determinó que el nivel apropiado de revisión corresponde al de una Declaración negativa mitigada (MND). Este es un aviso de intención de adoptar una MND para este proyecto de conformidad con las Directrices de la sección 15072 de la CEQA.

Ubicación del proyecto: El Proyecto está ubicado dentro de la planta de tratamiento de agua de Penitencia, sita en 3959 Whitman Way, San Jose, CA 95132.

Descripción del proyecto: El Proyecto de Gestión de Residuos de la Planta de Tratamiento de Agua de Penitencia (PWTP) conlleva mejoras a diversos componentes del sistema de gestión de residuos de la PWTP. Las operaciones actuales de la PWTP se ven limitadas por las ineficiencias del sistema de gestión de residuos para cumplir con los estándares regulatorios actuales. El proyecto abordará los siguientes componentes del sistema de gestión de residuos de la PWTP: gestión y tratamiento de aguas de lavado, manejo y deshidratación de lodos, y retiro de lodos de la cuenca de sedimentación. Este proyecto abordaría los problemas de edad, capacidad, eficiencia y confiabilidad del sistema de gestión de residuos actual. Adicionalmente, el proyecto aseguraría que la PWTP entregue de manera eficiente y confiable agua potable a los minoristas en el área de servicio de Valley Water y cumpla con los estándares regulatorios actuales. Se propone que el proyecto se comience a construir en 2025 y se complete en 2030.

4 TIPS FOR CHOOSING THE RIGHT MEDICARE PLAN

Withso many Medicare options available, selecting a plan can seem daunting. This year you may be wondering how news of Medicare drug price negotiations, economic uncertainties and other factors may impact your coverage in 2025.

Medicare is the government health insurance program for Americans 65 and older and others who qualify, providing hospital coverage (Part A) and physician visits (Part B) to beneficiaries. Additionally, there are a variety of options that coordinate with original Medicare, such as Medicare Supplement plans and Prescription Drug Plans, or replace original Medicare with Medicare Advantage (MA) plans combined with Prescription Drug Plans.

During this year’s Medicare Annual Enrollment Period (AEP), which takes place between Oct. 15-Dec. 7, 2024, here’s what Cigna Healthcare, which serves millions of Medicare customers nationwide, wants you to know:

1. Check for plan changes: If your current plan is working for you, you can likely keep it. However, it’s a good idea to review your plan every AEP, especially if you’ve experienced major life, health or financial changes. Any changes to your current plan will be outlined in your Medicare plan’s Annual Notice of Change (ANOC) letter, which you can expect to receive in September.

2. Research your coverage: There are a few key things to watch for when shopping for a plan. One of them is

whether your favorite providers and specialists will be in-network. You should also review each plan’s formulary – that is, the list of drugs covered under the plan. You’ll want to find a plan that will cover your current medications and any you anticipate your doctor prescribing over the course of the year ahead. Finally, carefully consider your total spend for your prescription drug plan coverage (i.e., premiums plus pharmacy costs) since the maximum out-of-pocket costs for drugs you utilize will be capped at $2,000 in 2025.

3. Look for value: No matter what the economic outlook is, it’s wise to select a plan that provides great value. To that end, you may want to consider an MA plan, which offers quality and affordability. MA plans cover everything original Medicare does, plus more; most also include dental, vision and hearing benefits, prescription drug coverage, and other extras like over-the-counter drugs, transportation to doctor’s visits and pharmacies, healthy grocery purchases, and fitness services. MA plans are often available with $0 premiums, but you’ll also want to check on what your annual out-of-pocket costs could be based on your health status.

Kamala Harris se compromete a construir 3 millones de viviendas y apartamentos asequibles en su primer mandato como presidenta, pero el gobernador Newsom no ha cumplido una promesa de campaña similar en California. ¿Qué lecciones puede aprender?

ForCalifornia political observers, the housing plan that Kamala Harris recently unveiled may have caused a twinge of familiarity.

As a central plank of her agenda to “lower costs for American families,” the Democratic presidential nominee pledged in August to build 3 million additional affordable homes and rentals over the next four years to address “a serious housing shortage across America” — echoing Gov. Gavin Newsom’s platform during his first gubernatorial campaign in 2018, when he called for California to add 3.5 million housing units by 2025.

Housing policy experts are enthusiastic about many of the ideas that Harris floated to promote production, which include creating a new tax incentive for developers who build starter homes for first-time homebuyers, expanding a tax incentive for affordable rental housing projects and establishing a $40 billion “innovation fund” to finance construction, as well as repurposing some federal land for housing and streamlining the permitting processes for projects.

Michael Lens, a professor of urban planning and public policy at UCLA, called it a wonk’s wish list: “This is all of the stuff we talk about at dorky academic conferences.”

But transforming the housing market from the top is difficult, as Newsom’s experience has demonstrated.

While California has increased production during his time in office — about 112,000 units were completed last year, according to the Department of Housing and Community Development, compared to about 70,000 in 2018 — it is still only building at a fifth of the rate necessary to meet his original target.

The governor has since acknowledged that 3.5 million units “was always a stretch goal” and scaled back. His office declined an interview request for this story.

Even with new policy priorities in place, high construction costs, onerous regulations, lack of public funding and community resistance remain major hurdles to supercharging homebuilding in California — offering lessons for a potential Harris administration.

“You’re going to be limited in your ability to change things on the ground,” said Ben Metcalf, a former state and federal housing official who is now managing director of the Terner Center for Housing Innovation at UC Berkeley. “Even when you are trying to move carrots and sticks, you find years later, what do you have to show?”

Set manageable goals

The high cost of housing has long been a top concern for Californians, but the problem is spreading across the nation. Industry data indicates that home prices exploded over the past five years, up more than 50% since 2019, while rent surged by about a third during that time, outstripping raises.

People moving from expensive cities to outlying areas for more affordable housing or moving into bigger homes during the coronavirus pandemic has driven up demand in new places, while even many recent pro-growth boom towns are becoming strained by the natural limits of expansion or a dimming taste for development.

“There is plenty of reason to think that it could get worse, in the sense that California is a bellwether,” Lens said.

Construction is constrained in California by pricey land, local zoning limits and fees, lengthy permitting processes and the threat of litigation, all of which drive up the cost of building and make it difficult for many projects to pencil out financially.

It’s unclear where the Harris campaign came up with its goal of 3 million housing units over the next four years — or how exactly it would measure success, given the emphasis on affordability. A campaign spokesperson did not respond to questions seeking a more detailed explanation, though he did clarify that this would be above current production.

That would require a President Harris to immediately boost construction nationwide by 50%, to levels not seen since before the housing market crashed during the 2008 financial crisis. The country built about 1.45 million new homes last year, according to the U.S. Census Bureau.

The strategy carries some political risk. Newsom set an ambitious housing goal

Since California forced local governments to waive fees and affordability requirements and grant faster approval for backyard cottages and other secondary units, the state has seen a boom of ADU construction.

Elmendorf said Harris’ proposed tax incentive for starter homes — which is not an official category, but generally refers to more modest housing that provides a cheaper entry point into the market — could similarly provide a quick jolt to the housing supply.

as a candidate for governor, which would have required California to build 500,000 new homes per year, and then faced criticism for falling short.

Metcalf noted that Harris’ plan for 3 million homes is more aggressive than the 2 million figure that President Joe Biden was campaigning on before he dropped out of the race this summer, but far below the Housing and Urban Development Act of 1968, which targeted the construction or rehabilitation of 26 million units over the next decade, including six million for lowand moderate-income families.

“The last time we saw an incoming president really putting a big, bold number on the board was that,” Metcalf said. “She wants to be able to campaign for a second term saying, ‘Hey, we did it.’”

Clear regulatory hurdles

California officials are undertaking a serious push to make it easier to build housing. Over the past several years, they have passed major legislation that allows landowners to add additional units on singlefamily lots in residential neighborhoods, streamlines the process for turning empty commercial properties into housing, shields certain affordable projects from lengthy environmental reviews and legal challenges, opens up land owned by religious institutions and colleges for construction, and gives developers more tools to speed up permitting in uncooperative cities and counties.

Advocates projected these policies could unlock millions of new homes across the state, but the impact so far has been significantly more modest.

“That’s a precursor to making a lot of these things work,” Lens said. “We have to make housing more allowable in more places.”

Experts argue that California has not been able to maximize the effectiveness of its new pro-housing laws because it is prioritizing so many other goals — demands to use union labor, requirements for more deed-restricted affordable units to reduce gentrification, environmental considerations to discourage sprawl and climate risks — that it’s still too expensive to build here.

The high costs for workers, materials and local regulations have been compounded lately by elevated interest rates, which drive up the price tag to finance projects and may actually be reversing California’s progress on construction. Metcalf compared it to a straw breaking the camel’s back for the building industry.

“That’s something that we’ve made almost no progress on as a state,” he said. “Once you have the table set, if the costs are too high, then nothing gets built.”

It’s of particular concern for affordable housing developers, who rely heavily on public funding. Chione Lucina Muñoz Flegal, executive director of the affordable housing advocacy group Housing California, said that despite state laws that have made it easier to plan projects, developers continue to struggle to pull together enough money to get them over the finish line.

She is hopeful about a surge in financial support — through the tax incentives and innovation fund in Harris’ plan — that has been unavailable from state or local governments, which she said have

not generally prioritized money for affordable housing because constituents do not understand the benefits.

“There’s a narrative challenge that we’re grappling with that often translates into a political challenge,” Flegal said. “That’s a way the federal government could be impactful in a way the state could never be.”

Use sticks as well as carrots

Though Newsom made clear his desire to boost housing production in California, not everyone has been on board with his approach.

Some cities, particularly wealthy or coastal suburbs, have vigorously fought to restrict additional development in their own communities, resisting a state mandate to plan for far more housing and suing to exempt themselves or overturn new laws that make it easier to build more densely. They contend these policies would destroy the character of their communities.

Newsom, who argues that everyone must do their part to solve the crisis, has cracked down by creating a new enforcement unit within the state housing department and suing the most intransigent cities for failing to approve housing plans or even specific projects.

But the federal government does not have the same le-

gal authority that California has given itself to demand local communities build more housing, and there’s no guarantee that Congress would be willing to step in to play more of a role in what has traditionally been a local matter in most states.

“Plans don’t translate into outcomes if people don’t want to build housing,” Elmendorf said.

So to reach her goal of 3 million new homes, Harris would have to rely more on the proposed incentives, such as the tax breaks for starter homes and affordable rentals and the innovation fund, for voluntary compliance.

Experts believe she has a good political opportunity to actually get her plan passed. Congress will be under pressure next year to extend a series of tax cuts made under former President Donald Trump that are set to expire at the end of 2025, which could be used as a bargaining chip for Harris’ housing proposals.

The federal government also has the power of the purse on a scale well beyond California, which it could amplify through regulations — such as tying transportation dollars to building more housing — that make supporting development the more desirable option.

California has tried this type of regulatory incentive, encouraging local governments to remove obstacles to construction with grant money and creating a “pro-housing designation” for cities that adopt streamlined development policies, which gives them privileged access to state funds.

“Unfortunately, that pro-housing designation is not based on outcomes. So that’s a fundamental problem,” Elmendorf said. “That’s something Harris will have to figure out.”

Onceagain we are celebrating Hispanic Heritage Month which was established to highlight the contributions of Americans who have roots in Spain, Mexico, Central America, South America and the Spanishspeaking nations of the Caribbean.

According to the Office of Arts and Archives of the United States House of Representatives, this celebration dates back to President Lyndon B. Johnson, who designated the week of September 15th as National Hispanic Heritage Week in 1968.

To encourage the adoption of this celebration, six years later, President Gerald R. Ford issued a proclamation in 1974 urging schools and human rights organizations to fully participate in that week.

Two decades later, on August 17, 1988, President Ronald Reagan reiterated Ford's call for broader recognition of Americans of Hispanic origin and to this end, Congress approved Law 100-402, which extended the celebration for a period of 31 days which was called National Hispanic Heritage Month – from September 15th to October 15th.

Since then, this month has given the Hispanic, Latino or whatever community you prefer to call it, the opportunity for the rest of Americans to know the contributions they have made to society.

In this particular year, the celebration occurs at a particularly delicate moment because the migrant community has been used as a flag to win votes by one of the candidates for the presidency of the United States.

In the attempt to use them as scapegoats for all the evils that occur in the United States, it has been said that migrants contaminate the blood of this country, that they are guilty of crimes and homicides and that they even eat pets in a town of Ohio.

In this “demonization” of migrants, there is a risk of further polarizing society and of migrants becoming the target of hate crimes.

During this month we also celebrate ordinary people, like you and me, who have come to this country to contribute their efforts to make a more prosperous and powerful country.

En esta “demonización” de los migrantes, se corre el riesgo de polarizar aún más a la sociedad y de que los migrantes se conviertan en el blanco de crímenes de odio.

Durante este mes también celebramos a las personas comunes, como usted y como yo, que han llegado a este país para contribuir con su esfuerzo a hacer un país más próspero y poderoso.

THE WRONGFUL EXECUTION OF MARCELLUS WILLIAMS

The Missouri man pleaded innocence into his last moments.

Civil rights organizations decried Missouri’s Sept. 24 evening execution of Marcellus Williams, noting that the victim’s family and a prosecuting attorney called for him to be spared the death sentence.

Williams was executed by lethal injection at the Eastern Reception, Diagnostic and Correctional Center in Bonne Terre, Missouri. He had been charged with the murder of journalist Felicia Gayle Picus, who was found dead in her home of Aug. 11, 1998. Picus was stabbed at least 43 times with one of her home kitchen knives.

Williams was sentenced to death in 2001. He maintained his innocence throughout his time in prison and in the minutes before he was executed.

Hours earlier, the US Supreme Court denied Williams’ request to halt the execution.

No DNA Evidence

The Innocence Project is one of several civil rights organizations which maintains Williams was wrongfully convicted. “No DNA evidence linked him to the crime,” wrote the organization in a statement released shortly after Williams’ death. “And the current St. Louis County prosecuting attorney acknowledged that errors made by the trial prosecutors – including mishandling the murder weapon and intentionally excluding Black prospective jurors in violation of the Constitution – contributed to a wrongful conviction.”

The Innocence Project alleged that two key eyewitnesses were paid for their testimony. The organization also stated that — despite evidence that Williams was not Picus’ killer — the Missouri Attorney General’s Office and Missouri Governor Mike Parsons pressed for Williams’ execution.

“Mr. Williams’ story echoes that of too many others caught in our country’s broken criminal legal system: a Black man convicted of killing a white woman,” wrote the Innocence Project.

NAACP

The NAACP Legal Defense Fund also maintained Williams innocence. “Tonight, our legal system tragically failed Marcellus “Khaliifah” Williams for the final time,” the organization

posted to X/formerly Twitter Sept. 24 evening. “The state of Missouri executed Mr. Williams in a horrific display of inhumanity, despite compelling evidence of his innocence.”

“Tonight, we mourn his loss and honor his legacy,” wrote the NAACP.

In August, Picus’ husband Dan, a radiologist, told court officials and representatives of state Attorney General Andrew Bailey’s office that while he believed Williams was guilty, he did not want to see Williams executed, reported The Intercept.

HISPANIC HERITAGE MONTH CELEBRATES, PRESERVES COLORADO'S GREAT OUTDOORS

Communitiesin Colorado and across the U.S. are making time to connect with nature during Hispanic Heritage Month.

Hilda Berganza, climate manager with the Hispanic Access Foundation, said Latino Conservation Week (September 14-22) saw thousands of people gathering at over 300 events. That's up from just nine events held during the initiative's launch in 2014.

"It was born from a commitment to Latinos being exposed to the outdoors. To experience being and playing in public lands, to empower families and future generations to be stewards of the planet, of the land," Berganza said.

Families of color are three times more likely than white families to live in areas considered concrete jungles without access to parks and natural areas. Due to policies some people deem racist, including redlining neighborhoods, communities of color also disproportionately live near high levels of toxic air and water pollution.

In 2022, just over 10% of Latinos were able to participate in outdoor recreation activities. Berganza said a broad coalition of community groups, nonprofits and faith-based organizations are working to change that. They are inviting families to picnics and park clean-ups, to go kayaking and hiking, to join scavenger hunts and festivals, and attend film screenings and webinars on the importance of maintaining healthy ecosystems.

"We also have events at churches where community members are learning why it's important to take care of our earth from a religious and spiritual point of view," Berganza added.

Berganza said work is also being done to push towns and cities to create parks and other green spaces in historically under-invested neighborhoods.

"National parks, or state parks, or even regular parks. They are not usually around or built within the communities that Latinos live in," Berganza said.

NEWSOM SIGNS BILL TO FIGHT INTIMIDATION AT CA POLLING PLACES

Padilla introduces federal ban on open carry at polls

Withthe election six weeks away - concern is building about attempts to intimidate voters at the polls - so lawmakers are taking action at the state and federal levels. On Tuesday September 24, Gov. Gavin Newsom signed the PEACE Act, which makes California the first state in the nation to state explicitly that open carrying a gun in or near a polling place constitutes illegal harassment.

Sean Morales-Doyle, director of the Voting Rights Program for the nonprofit Brennan Center for Justice, said the measure is important.

"It represents some really commonsense principles. All voters, all election workers, should be able to participate and run our democracy free from intimidation. And visible guns around our elections are intimidating," he said.

A recent survey of election workers from the Brennan Center found that 40% report being subject to threats, abuse, or harassment.

On Wednesday September 25, Sen. Alex Padilla, D-Calif., introduced a bill to ban open carry of firearms in polling places nationwide - noting the country has a long history of scare tactics on election day.

"There's individuals out there stoked by partisan rhetoric and false narratives about election fraud that have taken it upon themselves to either discourage at a minimum, or sometimes outright intimidate people into not letting their voice be heard in the democratic process," Padilla said.

Both political parties plan to have poll watchers present this year. The Brennan Center has set up a hotline at 866-OURVOTE for people to report any efforts to intimidate voters or election workers.
