uando el presidente Joe Biden concedió el Estatus de Protección Temporal (TPS) a casi medio millón de venezolanos en septiembre, sus críticos argumentaron que se trataba de un incentivo para que otros grupos buscaran un alivio similar.
El presidente hizo lo correcto al otorgar ese alivio migratorio porque, en efecto, los venezolanos enfrentaban en su país serios desafíos alimentarios, humanitarios, de seguridad, políticos e incluso ambientales, tal como justificó la Casa Blanca. A unas semanas de ese anuncio, miles de migrantes procedentes de diversas ciudades de Estados Unidos trajeron un mensaje claro al presidente: si pudo usar una acción administrativa para beneficiar a 472,000 venezolanos, ¿porque no hace lo mismo para beneficiar a millones de indocumentados, muchos de los cuales llevan décadas en Estados Unidos? Fue un mensaje que trajo a la capital de los Estados Unidos la conocida activista migratoria de origen mexicano Elvira Arellano, como parte de una movilización más amplia de inmigrantes procedentes de ciudades como El Paso, Chicago y Nueva York. “Venimos a pedirle al presidente Biden que utilice su poder y haga un cambio administrativo para dar libertad condicional a los 11 millones de indocumentados y que puedan tener permiso de trabajo”, me comenta la señora Arellano, quien ahora reside en Chicago.

hen President Joe Biden granted Temporary Protected Status (TPS) to nearly half a million Venezuelans in September, his critics argued that it was an incentive for other groups to seek similar relief. The president did the right thing by granting this immigration relief because, in effect, Venezuelans faced serious food, humanitarian, security, political and even environmental challenges in their country, as the White House justified. A few weeks after that announcement, thousands of migrants from various cities in the United States brought a clear message to the president: if he could

This is a similar scenario to the one Barack Obama faced in 2012. In June, a few months before the midterm elections, he approved DACA and ingratiated himself with millions of Latinos. At the end of the election, Obama received 71% of the Hispanic vote and Mitt Romney only 27%. His action has given fair temporary immigration relief to hundreds of thousands of undocumented youth. Eleven years later, President Biden is headed for a re-election bid with serious political vulnerabilities. One year before the elections, he is at a disadvantage against Donald Trump in five of the six key electoral states in 2024: Arizona, Nevada, Michigan, Pennsylvania and Georgia.
At this time, it seems unlikely that President Biden will approve immigration relief for more than 11 million undocumented immigrants. But the reality is that his strategy of putting “band-aids” to heal a patient in intensive care, such as the migratory phenomenon, has not worked as he expected.

Although there is enough time to reverse the electoral dynamics, especially if Trump is convicted in any of the four criminal proceedings against him, these are signs that should worry the White House.

It is very likely that the thousands of protesters who came to Washington will return to their places of origin emptyhanded. But the millions of migrants who live semi-clandestinely are not going anywhere, nor will new migrants stop arriving.

While it is true that migration does not always appear as one of the main concerns of Hispanic voters, an unprecedented immigration relief from the president for undocumented immigrants could perhaps be the big surprise within the 2024 election cycle.

It is part of the budget battle in Congress, which has to pass a budget or a continuing resolution by Friday to avoid a government shutdown. Melanee Cottrill, executive director of Head Start California, said conservatives in the House of Representatives want a 6% cut in Head Start funding, while Democrats in the Senate have proposed a 2% increase. "The 6% cut would reduce a significant number of slots and services," Cottrill pointed out. "In California, Head Start serves about 90,000 kids. And we would lose about 6,000 of those kids if those cuts went into place." Cottrill acknowledged the 2% increase proposed by Democrats who control the U.S. Senate is appreciated, but would not keep up with the cost of living or inflation. If the 6% cut goes through, an estimated 51,000 children across the country would lose their spots in local Head Start programs, leaving families to scramble for child care. House conservatives, citing concerns about the national debt, have proposed cuts to many social service programs including nutrition assistance for women and children, teachers in

Cottrill argued when it comes to Head Start, lawmakers should look at the overall effect of the program. "Head Start is a proven poverty reduction program," Cottrill contended. "It's been around since the 1960s. It is incredibly effective. It is an investment in our families, in our kids, and in our educational system that pays dividends down the line." Research from the National Head Start Association shows these programs are particularly beneficial to Hispanic and Black children, duallanguage learners, children who are homeless or in foster care, those who qualify for free school meals, and those whose mothers did not graduate from high school.

ew regions in California have escaped the impact of maternity ward closures in the past decade. At least 46 hospitals have permanently closed or suspended labor and delivery since 2012, a CalMatters analysis of hospital records found. About 60% of the closures have taken place in just the last three years. These closures are being driven by a combination of factors, including high costs, inflation, labor shortages and declining birth rates, according to hospital administrators and experts.

In some cases, communities are losing decades-old maternity units. Four counties lost their last maternity ward in the past 10 years, with three of those closing since 2022. In others, the maternity ward was short-lived. For example, Palmdale Regional Medical Center in the high desert of Los Angeles County opened a birth center in 2021 before closing it last month, citing “lower than anticipated” births.

Young people are stuck earning low wages, working long hours — often while going to school — and often without benefits or work protections. Their hardships may hamper the state’s economy for years to come, researchers said.

ore than 2 million people ages 16 to 24 are working in California — about the same as the population of Houston — making up 12% of the workforce. They comprise a critical portion of the state’s economy, according to a new report by the UCLA Labor Center. But many young people earned low wages, worked long hours — often while going to school — and lacked sufficient worker protections and benefits. These hardships may impact their financial future and the state’s economy for years to come, said researchers who examined the years surrounding the COVID-19 pandemic, 2019 to 2021. “Young people are critical actors in California’s vibrant economy and labor force,” says the study, released today. “Yet, young workers in California find themselves navigating a tumultuous landscape of societal shifts, economic challenges, and the lingering aftermath of a global pandemic.” About 64% of California’s young workers earned low wages — defined as about $18 an hour, twothirds of the median wage — and 60% reported difficulty affording their expenses, researchers wrote.

While many young people are stuck in lowerwage jobs, the research suggests they are contributing significantly to their household income. And about 12% of young workers are heads of households, according to the report. Young workers are overrepresented in households living below the poverty line compared to those over the age of 25. About 14% of young workers lived in poverty compared to 5% of older workers, according to the report. A third

The report analyzed data from multiple sources, including the U.S. Census Bureau’s American Community Survey, the COVID-19 Household Pulse Survey — which documented the impact of the pandemic — and the federal Bureau of Labor Statistics. Young workers reflect California’s growing diversity. About 3 in 4 are people of color and more than half are Latino. About 15% of high schoolaged young people worked full time and half of young people ages 19 to 24 worked full time. Young workers’ trap In the service industry, 40% of young workers are employed in bars, restaurants and retail. These young people run the risk of being caught in a “circular labor trap,” the study says, because these low-wage service jobs are structured with little room for growth or skill development. “When you have these skill sets that are hyperspecific toward these industries, and not much room for growth, it’s hard to compete against students who may take an unpaid internship in a very content-specific area of expertise and gain connections in the career they want to go into,” Ramakrishnan said. Because so many service industry jobs were considered frontline jobs, the pandemic was particularly disruptive for young people, who often had to choose between their health and their income. And when grocers and restaurant businesses closed during the pandemic, younger workers, especially young people of color, experienced higher levels of unemployment or underemployment compared to older workers in other industries.
Postsecondary education became more essential for a stable career, yet with education costs increasing, it was less accessible for young people, according to the report.

orkers at a Stanislaus County tomato farm and packing company are the first to successfully unionize under a new California law making it easier for farmworkers to organize, the United Farm Workers said today. The union said California’s Agricultural Labor Relations Board certified the election petition of workers at DMB Packing, also known as DiMare Fresh, based in the northern San Joaquin Valley town of Newman. Barely 51% of the company’s 297 workers voted for union representation, said Santiago AvilaGomez, the executive secretary of the Agricultural Labor Relations Board. The company is disputing the results. The workers organized under new rules enacted this year by a controversial new California law, which allows farmworkers to vote for union representation by signing union authorization cards, called card check. They’ll be part of UFW, which represents nearly 7,000 agricultural workers at 20 California companies. Although the union founded by Cesar Chavez and Dolores Huerta is still the most prominent advocate for farmworker rights in California and nationally, its membership has significantly decreased since the height of the farmworker movement in the 1960s and 1970s. Prior to the new rules, farmworkers voted for union representation via a two-step “secret ballot” process that often took place at their worksite on employer property. In the summer of 2022, UFW members and supporters marched 335 miles from Delano to Sacramento to urge Gov. Gavin Newsom to allow farmworkers to vote via card check or by mail. After months of public pressure — and a White House endorsement of the bill — Newsom and the United Farm Workers negotiated a compromise that allowed farmworkers to vote by card check, but removed the vote-by-mail option and other complicated administrative processes. The previous version of the law, which went into effect in January, had allowed farmworkers to mail in ballots or vote via card check. The final version of the law went into effect in May. During their year-long battle for the union election rules, the UFW and other labor advocates insisted that the secret ballot process made it difficult for farmworkers to organize without fears of retaliation from their employers. Now, the UFW says this first election win is proof they were right. “We have been fighting for a long time to try to protect workers,” said Teresa Romero, the UFW president. “This new law helped the workers have the safety net to be able to decide what they want to do. Their safety and job security is something we always want to protect.” The UFW originally filed a petition with

the Agricultural Labor Relations Board in September, but the board ruled the union didn’t yet have a majority. The board finally certified the election results on Oct. 23, but DMB Packing filed objections, claiming that the board mishandled the ballot process, that the UFW was counting workers that shouldn’t be included in the union and that workers were coerced into signing something they didn’t understand. The board will hold a hearing on the dispute during the last week of November. Although the company can still appeal the results, the board will eventually issue a final decision on the validity of the election. The administrative process is “new territory” for the board, AvilaGomez told CalMatters, because this is also the first election petition submitted under the state’s new rules. DMB Packing, which currently disputes the election results, said in a statement that it supports and respects the rights of farmworkers. “We will continue to utilize the legal and regulatory process to ensure a fair election where the results represent the will of the majority of DMB Packing employees,” the company said. The last time the UFW won a union election was in 2017, when workers at a raspberry farm in Watsonville narrowly voted for union representation 269 to 236. The company appealed the results, fighting orders to negotiate with the union for years before filing for bankruptcy and laying off hundreds of workers at the start of the COVID-19 pandemic in March 2020. The UFW eventually secured settlements for laid off workers, spokesperson Antonio de Loera-Brust said. Although the fledgling union of DMB Packing farmworkers still has to navigate a potentially-long administrative appeals process and company negotiations, Romero said she believed their initial victory would encourage other farmworkers to organize and to feel more comfortable about their anonymity and job security while voting in elections. She said the UFW is expecting more successful union certifications elsewhere in the state soon. “We marched last year, 335 miles or more, and it was done with the purpose of making it safer for farmworkers to organize for union representation,” Romero said. “We have our first certification, and it happened because workers had the ability to sign a card and not be intimidated by employers and supervisors.”

Dado que la comida juega un papel importante durante la temporada festiva, comparto algunos consejos sencillos para una alimentación más saludable que puedes implementar este año mientras mantienes vivas las tradiciones y la festividad de tu familia. Platillos festivos favoritos y alimentación saludable Los días festivos suelen ser momentos preciados en los que se reúnen miembros de la familia de todas las edades. Dave Cortese, D-San Jose, who wrote the bill to launch the program, said "paternalistic" programs restricting the aid to cover only food or rent have not worked in the past. "People in poverty need to be empowered, just like the rest of us, to make their own decisions," Cortese contended. "It really should be up to them to decide whether they need food, a warm coat, or rent. These aren't decisions that the state should be making, these are decisions that individuals should be making." Opponents worry people receiving unrestricted income could waste it on luxuries, but post-analysis of pilot programs in Stockton and Santa Clara County disprove the concern. While the effort is the first statewide universal basic income program, there are also about 200 local programs now operating across California.

Cortese argued such programs reduce homelessness and end up saving the state money in the long run. "We have significant economic disparity issues in this state," Cortese pointed out. "This gets the kind of outcomes that we're looking for in terms of giving people a leg up and keeping them out of the systems that cost us a lot of money; incarceration, like mental health and so forth." Cortese hopes to secure funding next year for a similar proposal, called the California Success, Opportunity, and Academic Resilience or "SOAR" program, which would give a five-month stipend to the 15,000 homeless children who exit California high schools each year.

f you get an email or phone call from PG&E, the power company says, the best thing to do is to quickly hang up or delete it, because it’s most likely a robbery attempt. At a Nov. 8 roundtable discussion with ethnic media, PG&E’s Fiona Chan, Matt Foley and Stephen Vuong asked for help in getting the word out to everyone, but particularly friends or family who may be less aware of how sophisticated scammers are becoming. “Education is key,” Chan said. “The most-used scam,” Foley said, “is the threat of a power cutoff due to past-due bills – the truck is on the way!” And scammers have fleeced tens of thousands of PG&E customers for millions of dollars in just the past few years. Besides emphasizing that the company does not make bill-collection phone calls, or ever take payments in bitcoin, gift cards, or over Zelle, Venmo or PayPal, the speakers described some of the latest scams they’re hearing about. One is to call a real estate company about a house someone’s trying to sell, to say that the power bill is overdue and the house will be plunged into darkness unless someone makes a payment. The trick here is that when the owner gets a follow-up call from the Realtor relaying that message, he or she is more likely to think there really is a problem that needs to be solved, because the person telling them about it isn’t a stranger. “We’re not going to call the Realtor,” Foley said. “We don’t have the number and we don’t give it out.” People tricked into believing they need to make an immediate payment are unlikely to ever see that money again, because part of the thievery involves quickly transferring those funds overseas, out of the reach of law enforcement. “I’ve worked with very few people who’ve gotten their money back,” Vuong said. “They move the money so fast.” He said that for 95% of the cases he’s seen, the ill-gotten money quickly left the country. Many of the scams originate in phone banks located overseas. Crooks have figured out that while pretending to be friendly and helpful, they can sometimes stay on the phone with their victim, directing him or her all the way to a nearby convenience store or “payment kiosk,” and providing step-by-step instructions on buying gift cards and other payment systems – some involving ‘crypto currency’ – while all they’re really doing is helping victims throw their money away. Don’t be fooled by your phone’s “caller ID” feature, either. Crooks have figured out how to make it look as though their calls are coming from PG&E itself. They’re not.

Another way people get tricked is by “sponsored” websites made to look like PG&E’s, that show up at the top of computer searches for the company’s customer service contact information. A web site that a search engine indicates is “sponsored” may very well not be PG&E’s but instead be from someone with bad intentions who paid to have that site prominently displayed at the top of search results. Look to see that the site is actually pge.com. One way to do so is to scroll over the address on display, which will sometimes reveal another, different address, masquerading as pge.com. Some of us might want to check with younger members of the family who often are more tech-savvy. There’s a way to report suspected scams, at scamreporting@pge.com. But it’s better not to fall for a ruse in the first place. “Prevention is best,” Vuong said. “I tell my 89-year-old Mom, who’s pretty sharp,” Foley said, “‘Don’t ever engage in this kind of thing. Everything financial, run through me!’” People can be scared into making payments when they’re worried their power is at risk of being cut off, particularly if they’re struggling to pay their bills or know they’re late. But PG&E doesn’t call people about their past due bills, and has many ways to help people who’ve fallen behind. “If you have difficulty paying the bills,” Chan said. “Please contact us. We have so many good assistance programs. We’re happy to work with you.” The number for customer service is (800) 743-5000. One of the roundtable guests asked about whether to trust third-party contractors who may claim to be PG&E partners, for instance, doing solar panel installations. Don’t be cowed, “Call us if you feel uncomfortable. If they’re legit, they will understand.” “There’s not a lot of uniqueness to these scams,” Foley said. He told a story of how a convenience store employee saved someone from a $2,000 loss by overhearing the customer taking instructions over the phone about how to buy a gift card to send. “So the message is getting out,” he said.

ustainable parenting isn’t easy given all the ways modern society has become largely a profusion of disposable products. Besides making conscious decisions about the products you buy, you also have to think about teaching your kids to do the right thing— and you can never start too early. One way to do the right thing by the planet is opting for reusable diapers. The average American baby uses 7,000 disposable diapers over the course of a typical three-year run. Some 200,000 trees are cut down each year in the U.S. alone to provide the wood pulp found in diapers. To make matters worse, the diaper’s plastic and absorbent polymers are not recyclable. Nowadays you can purchase reusable diapers at a local Walmart or Target, or online. Popular brands include Cotton Babies, Nora’s Nursery and Green Mountain. Many people are concerned about the washing process, but it is relatively simple. For liquid waste, you should pre-rinse the diaper with water. For solid waste, you should allocate a spatula or knife as a “scraper” and dispose of the waste in the toilet. You can purchase a dry pail to hold the diapers until laundry day. Keep in mind, reusable diapers must be washed with water that is at least 140 degrees Fahrenheit (60 degrees Celsius) to kill bacteria.
or bamboo baby washcloths and cut them into eight-inch by eight-inch squares. For the wipe solution, oft-used ingredients include aloe vera, gentle baby wash or Castile soap, natural oils, and water. Other recipes can be found online. You can keep this solution in a spray bottle to use when needed. Store not-yetused wipes in a clean airtight container. Spray them thoroughly with the solution before use. Store soiled wipes in a dry pail until you do laundry. As with reusable diapers, you should scrape off solid waste before washing. Another major source of waste from kids is toys, most of which are made of cheap plastic and end up landfills. According to the Yale Environmental Review, toys constitute six percent of landfill plastics worldwide. Today, there are many online services where you can order a monthly subscription for rentable plastic and wooden toys. If your child gets bored, you can send the old toys in and receive new ones in the mail in the matter of days. The toys that you send in are sanitized and sent to other families.

Another environmental hazard of parenthood is baby wet wipes. Almost all, even the “flushable” ones, contain microplastics which do not biodegrade. So today, with this new understanding, we’re taking accidents to significantly reduce the flow of precursor chemicals and pill presses from China to the Western Hemisphere. It’s going to save lives and I appreciate Pres. Xi’s commitment on this issue,” said Biden.
In his remarks to reporters after the meeting, Biden said he stressed the “importance of peace and stability that Taiwan Straits.” Asked by a reporter if he would continue his promise to support Taiwan in an armed conflict with Taiwan — given that the US is currently supporting Israel in its fight against Hamas, and Ukraine’s struggle against Russia — Biden responded: “I reiterated what I’ve said since I’ve become president, what every previous president has said. We maintain the agreement that there is a one China policy. I’m not going to change that.” Biden has long maintained that the US will intervene mili-

He noted that the relationship has never been “smooth sailing,” but added: “For two large countries like China and the United States, turning their back on each other is not an option. It is unrealistic for one side to remodel the other, and conflict and confrontation has unbearable consequences for both sides.” Competition and Conflict “I am still of the view that major-country competition is not the prevailing trend of current times and cannot solve the problems facing China and the United States or the world at large. Planet Earth is big enough for the two countries to succeed, and one country’s success is an opportunity for the other,” said Xi. Biden stated: “We have to ensure that competition does not veer into conflict. And we also have to manage competition responsibly.” But the eggshell on which both leaders ended their talks quickly developed a fissure. As Biden ended his press conference at Filoli Gardens, a reporter asked him if he would still refer to Xi as a dictator. Biden characterized Xi in that manner at a fundraiser in San Francisco last June. “Well, look, he is. ongresswoman Rashida Tlaib, the sole Palestinian-American voice in Congress, was officially reprimanded last Tuesday, but many of her colleagues say she will not stop fighting for peace. A 234 to 188 vote of nearly all Republicans and enough Democrats sealed Tlaib's censure, a punishment proposed by Republican Congressman Rich McCormick of Georgia. Tlaib held back tears as she asserted her position. "I can't believe I have to say this, but Palestinian people are not disposable. We are human beings. Just like anyone else," she said. Tlaib is only the 26th member of the House of Representatives to be censured since 1789. She was not asked to stand in the well as typically expected with censure. Tlaib's House colleague Cori Bush from Missouri was by her side to defend her along with many other Democrats, all Black and brown. Bush said the House is where an elected body enslaved Black

igarettes may not appeal to America's youth like they did in the 1960s, but a significant number still experiment with e-cigarettes. The Centers for Disease Control and Prevention has new data that show the use of e-cigarettes by high school students declined in the past year, but rose among middle schoolers. From 2022 to 2023, said CDC epidemiologist Jan Birdsey, e-cigarette use among high school students declined from roughly 14% to 10%. But the news about usage among younger students was not as encouraging. "We did find among middle-school students significant increases in the current use of at least one tobacco product and the use of multiple tobacco products," she said. "We're still seeing the e-cigarettes as the most commonly-used product among both middle and highschool students." A 2020 survey by the Texas Department of State Health Services found about 11% of youths reported using e-cigarettes on at least one day over a 30-day period. It also showed that about a third of respondents said they'd talked about the dangers of tobacco with a medical professional. To quit, Birdsey recommended the website teen.smokefree.gov or by calling 1-800-QuitNow. E-cigarettes have been found to be less

harmful than regular cigarettes because they contain fewer toxic chemicals but they are not considered safe by the CDC because they're known to harm adolescent brain development. Birdsey said not surprisingly, many who report using them are drawn to kid-friendly flavors. "About nine out of 10 users of e-cigarettes were using a flavored product such as fruit, candy and other sweets, mint or menthol," she said, "so, flavors increase the appeal of the products, encourage experimentation and can contribute to that lifelong tobacco use." The data show about half of students who have tried e-cigarettes reported still using them. A lack of information about the dangers of smoking cigarettes led an estimated 40% of Americans to take up the habit by the mid-1960s.

THE SUPREME COURT VS. THE COURT OF PUBLIC OPINION While SCOTUS is the highest court in the land, public trust in the institution has never been lower.

here’s an old joke in DC about how Supreme Court Justices make the worst dates. They won’t take gifts and so insist on paying, but they don’t make that much money, so they choose the cheapest restaurants. (Cue drumroll!) You’d be forgiven for not knowing that, based on the string of revelations about previously undisclosed luxury retreats and rolling mansions that some on the bench now enjoy. The reality is that while SCOTUS is the highest court in the land, public trust in the institution has never been lower, one reason why on Monday the court released a code of ethics that many say does little to remedy the situation. Recent decisions, meanwhile, on issues ranging from abortion to gun and voting rights show in sharp relief how the court and the opinions of a majority of the American public are moving in near diametrically opposite directions. And, according to Senator Sheldon Whitehouse (D-RI) and Michael Waldman, president of the Brennan Center for Justice, that’s by design. “The court has been an agent of its own reputational destruction,” said Whitehouse, co-author of a bill that would impose 18-year term limits on sitting justices. (The US is among just 5 countries with life tenure for the highest court.) Capturing the court Speaking at a recent event co-hosted by the Brennan Center, Whitehouse described a decades-long effort from the right to achieve what’s known as “regulatory capture,” a term that harks back to the Gilded Age of the mid-19th Century when railroad barons sought to stack the commission overseeing the nation’s railroads with “cronies and friends.”
Fast forward to today, and that same strategy is now being applied to the Supreme Court. “Some very big special interests are upset because they can’t operate in an open democratic world, so they went dark to capture the court,” said Whitehouse, tracing the origins of this latest hostile takeover of the court to the 1971 Powell Memo that laid out in detail ways for corporate interests to reassert control over the political arena. “These same billionaires are now enmeshed in the controversies involving Supreme Court judges,” Whitehouse added. “When you see the court’s records and the dark money around it, it’s hard to argue this is a legitimate court following traditional judicial principles.” Whitehouse points to the recent West Virginia v EPA ruling as an example of how these special interest groups work to shape law and public policy. In its 6-3 decision, the court essentially gutted the regulatory agency’s ability to protect Americans from environmental pollutants. The ruling was based on an unprecedented judicial concept known as the Major Questions Doctrine, which argues a federal agency’s authority does not extend to issues of major political or economic significance. “These words have never been used by the court before,” Whitehouse said. “You see dark money think tank and academic areas where this notion was planted, fertilized, propagated and then pushed out and these judges picked it up.” Whitehouse called the case a “dangerous example” of the court’s interference in the government’s ability to protect Americans. A growing backlash Michael Waldman, whose book, “The Supermajority: How the Supreme Court Divided America,” examines the first year of the court under its current
conservative majority, says the justices are “working aggressively to change the reading of the constitution and thus the country.” Alongside the West Virginia case, he highlights two others, the Dobbs ruling overturning Roe v Wade and the Bruen decision, which said states can only consider “history and tradition” dating back to the time of the founders and not current safety concerns when it comes to regulating gun rights. “Does this sound like a court or like the caucus of a political party,” Waldman quipped, noting there are inherent structural issues that make the court susceptible to capture. Yes, he says, the court’s structure was designed to insulate justices from undue political influence. Yet the court’s makeup is almost entirely driven by election outcomes for Congress and the Presidency. “One political party has won the popular vote in 7 of the last 8 presidential elections,” explained Waldman, “while the other

controversias que involucran a jueces de la Corte Suprema", añadió Whitehouse. “Cuando ves los registros del tribunal y el dinero oscuro que los rodea, es difícil argumentar que este es un tribunal legítimo que sigue los principios judiciales tradicionales”. Whitehouse señala el reciente fallo de Virginia Occidental contra la EPA como un ejemplo de cómo estos grupos de intereses especiales trabajan para dar forma a las leyes y las políticas públicas. En su decisión de 6 a 3, el tribunal esencialmente destruyó la capacidad de la agencia reguladora para proteger a los estadounidenses de los contaminantes ambientales. El fallo se basó en un concepto judicial sin precedentes conocido como la Doctrina de las Cuestiones Mayores, que sostiene que la autoridad de una agencia federal no se extiende a cuestiones de gran importancia política o económica. “Estas palabras nunca antes habían sido utilizadas por el tribunal”, dijo Whitehouse. “Se ven grupos de expertos sobre dinero oscuro y áreas académicas donde esta noción fue plantada, fertilizada, propagada y luego expulsada y estos jueces la recogieron”. se remontan a la época de los fundadores y no las preocupaciones de seguridad actuales cuando se trata de regular los derechos de armas. “¿Suena esto como un tribunal o como el comité de un partido político?”, bromeó Waldman, señalando que hay cuestiones estructurales inherentes que hacen que el tribunal sea susceptible de ser capturado. Sí, dice, la estructura del tribunal fue diseñada para aislar a los jueces de influencias políticas indebidas. Sin embargo, la composición del tribunal depende casi exclusivamente de los resultados de las elecciones para el Congreso y la Presidencia. “Un partido político ganó el voto popular en 7 de las últimas 8 elecciones presidenciales”, explicó Waldman, “mientras que el otro partido eligió a 6 de los últimos 9 jueces.
