PAYMENT FOR PURCHASES Payment for lots , including those on which opinion s are desired (Con dition of Sale 8), sha ll be as follow s: (a) Floor Bidders . Payment of the purchase price, or such pan there of as Hann ers sha ll require , shall be made by the purchaser in such manner as Hann ers may detennine. The name and add ress of the purch ase r of eac h lot shall be give n to the auctioneer immediately following the sale of such lot. (b) Ma il Bidders. A succ essf ul mail bidder will be notified of lots purch ased. Before Hann ers will send such lots , payment in full must be received by Harmers within three (3) business days of receipt of the aforesaid notification by the mail bidder. (a) Purch ase rs agree to pay for lots as specifi ed in Co ndition of Sale 4 (or as the sam e may be modifi ed by Co nditi on of Sale 8), and no credit is extended; a late payment charge of 2% per month shall be added if payment is not made in accor dance with the aforesaid conditi ons. (b) In the even t that a bidd er shall fail to comp ly with these Condit ions of Sa le (" Non-Compl ying Bidder "), then, as to any lot wit h res pect to which such failure to comp ly occurs , Harmer s may, in its so le discre tion , re-offer such lot durin g the same auction or at an auction al a later tim e, or by pri vate treaty at such time as Harn1ers, in its so le discretion, deem s appropriate and the Non-Complying Bidd er shall be liabl e for the deficiency, if any, betwee n the hammer price and the net pro ceeds of a sa le to a subseq uent pur chase r, whether at auct ion or by priva te treaty , a we ll as for all cos ts and ex pen ses of both sa les, a ll other charges due thereund er, includin g commissions with respect to both sa les, whe ther paya ble to Harmers or to a third party and a ll incid ental damages. In no even t shall any surp lus arising from the sa le of a re-off ered lot be paya ble to a Non-Co mplying Bidd er. (c) A defaulting purch aser shall be deemed to have granted Harmers a security interest in prop erty in Hanners possess ion ow ned by such purcha ser. Ample opport unit y is give n for on premises inspection prior to the auction date , and , upon written request and at Harmers discretion, for inspection by postal viewi ng (all as detailed elsew here in this Catalogue). (b) Each lot is so ld as ge nuine and cor rectly described, based on individua l desc ripti on as modifi ed by any spec ific notation s in this Catalogue, including but not restrict ed to the sec tion entitled " Key to Cataloguing " . (c) Quality. Any lot which a purcha ser considers to be incorrec tly described may be return ed to Hann ers within two week s of its receipt by such purchase r ("Returning Purcha ser"), pro vided , however , that the same is received by Hanne rs within four weeks of the date of the auction; howeve r, Harmers may, in its discretio n, refuse acce ptance of such returned lot. If an opini on of a genera lly recogni zed authority is des ired , the period of time w ithin which a lot must be rece ived by Harn1ers will be extended in accordance w ith Condition o f Sale 8. In the event that a dispute cannot be reso lved by reference to a generally recognized authorit y, and Harrners thereupon undertakes to re-offer the lot with a description identica l to the description disputed, the Returnin g Purchaser shall be liabl e for the deficiency, if any, betw een the proc eeds o f the sa le to the Returnin g Purchaser and the proceeds of a sa le to a subsequent purcha ser, as we ll as for all co ts and expenses of the re-sa le, includin g commission , and all inciden ta l damages. EXTENSION OF TIME Success ful bidd ers who wi h to submit an item for expertizat ion must spec ify their request in one of the follow ing ways: I) when submittin g their bid , 2) by ca lling our offices within 24 hours of the end of the sa le, or 3) wit hin 5 days of rece ipt of the lot(). Al l lots being sent for expert ization must be sent by H.R. Harmer, Inc., exclus ively.
