All accounts to be settled in full and are due immediately at the close of the sale and should be made at the auctioneer’s office on site.

If Payment for any animal or item purchased is offered by cheque, the title or own ership of said items shall remain with the vendor and shall not pass to the purchaser until such cheque has been cleared and paid by their bank.
IHFA acknowledges ICBF and milk recording organisations for providing data. Latest data as supplied at date of printing. While every effort is made to ensure the accuracy of the material published no responsibility will be assumed for the validity or accuracy of any statement, error or omission.
1. The stock will be sold in Euro’s plus 5%. i.e. Each bid is €1.05 and VAT will be charged on .05 if applicable.
2. The bidding is to be regulated by the auctioneers, The Auctioneers will regulate the bidding as they see fit, with no bid less than €5; thereafter not less than €10.
3. The highest bidder for any lot shall be the buyer and the contract shall be concluded on the fall of the hammer. If any dispute should arise, the lot in dispute is to be put up again and re-sold, or the Auctioneers may determine the dispute at their discretion and their decision shall be final.
4. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give a reason for such action. The purchaser to give his name and dwelling place and pay for all lots at the close of sale. No lot or lots shall be removed from the premises until paid for, and a pass-out slip is obtained from Auctioneers clerk, but each and every lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale at the purchasers expense.
5. It shall be the Vendor’s responsibility to ensure that their animals are declared as being eligible for export at the time of sale. No liability shall rest with the Auctioneers for failure to declare any animal as being export tested.
6. In the case of ‘In calf heifers not in calf’, this must be notified to the Auctioneers within 3 months of sale.
7. Where the vendor/agent is not present to sell livestock, the livestock will not be deemed as “SOLD” unless a written reserve has been given to the Auctioneers prior to sale.
8. All animals in the DBA Dairy Sale will be on the market from the commencement of the sale and will be sold even if the owner is not present. (However, the Auctioneers may allow a non-specified number of lots to be “Sold Subject” and allow re-run’s in any given sale.
9. All complaints regarding broken engagements must be notified to the Auctioneers within four days but in any event not later than 12 noon on the Thursday following the sale. All dairy stock must be inspected by the purchaser within one hour after the finish of the sale and complaints must be lodged immediately with the Auctioneers.
10. Animals must not be drawn prior to sale, only after the fall of the hammer can an animal be drawn by the purchaser.
11. All dairy stock are sold as being free from inhibitors, otherwise a declaration will have to be made.
12. All dairy stock are assumed to be free, fair and genuine.
13. Title (ie.ownership) to any animal or animals knocked down or sold to any person or persons until payment of the entire price bid by that person or persons shall be discharged in full to GVM Auctioneers or D.A.Barrett Auctions. Tendering of a cheque, which is not subsequently honoured or not paid for any reason, shall be deemed to constitute non-payment.
14. All loading shall be the duty and responsibility of the purchaser.
15. All statements in the catalogue or any made by the Auctioneers at the time of sale, also the identification of the animals, are the entire responsibility of the vendors. The Auctioneers take no responsibility for the correctness of such statements or identities.
16. The Auctioneers act, as agents for the vendors and any action taken by the purchaser must be against the vendor and not against the Auctioneer, and “vice, versa”.
17. Neither the vendors nor the Auctioneers will be responsible neither for any accident through fire or any other cause or whatsoever nor any damage done to, during or after the sale.
18. If any of these conditions are unfulfilled, the vendors or the auctioneers shall have power to resell the lots, retaining any surplus and charging any deficiency and expense to the defaulter.

SECURITY OF TITLE: If payment for any animal or item purchased is offered by cheque, the title or ownership of said items shall remain with the vendor until such cheque has been cleared and paid by their bank.
