2016 Rock, Rib’s, & Ridge’s Festival Sussex County Fairgrounds Do you hear it? Do you smell it? Do you feel the bright sun and cool breeze’s on top of the hill’s of an area known for some of the best motorcycle riding in NJ. Well welcome, to the 2016 Rock, Rib’s, & Ridge’s Festival at the beautiful Sussex County Fairgrounds in Augusta, Nj. The Pit Crew has once again found our reader’s a great place to ride to and hangout with some good music, good food, and just have a good ol’ time. The Pit Crew found themselves at the Sussex County Fairgrounds, an area surrounded by natures ridge’s, a rock stage, a midway of rib vendors, camping, vip tent’s and mixed drink’s such as Barenjager Honey Liqueur. What were we up too, you ask? We were about to get down with the Rock, Rib’s, & Ridges Festival, a two day event held in late June. We started by checking out all the festival had to offer and after walking around for a bit we found Howard Freeman, founder and managing general partner of the Rock, Rib’s, & Ridges Festival. Howard was kind of enough to spare a few minutes in his busy day for an interview to explain how he puts on this festival as well as speak about his Quick Chek Festival of Balloons in Readington,NJ. While in Rochester, NY seven years ago he had met a man who ran a rib festival. Having a little down time from the balloon festival that takes place in late July, and thinking of another event to fill in his down time, the idea for Rock and Rib’s was born. Originally held in Vernon, NJ at the Hidden Valley Resort it grew to such numbers it was forced to relocate to the larger venue at the Sussex County Fairgrounds. The festival just celebrated its 7th year and get’s larger by the year. Pitmaster’s come from all over the country and do what they do best and also to win in different contest’s where trophies and prize money are won. After our chat with Mr. Freeman, we had the pleasure to meet Allie, the youngest female Pitmaster in the US and owner of Butch’s Smack Your Lip’s BBQ. Darn good BBQ. We walked around and watched people pour in with their chairs and shade tents. They set up to watch the long list of bands such as the Outlaw’s, Jefferson Starship, Blues Traveler, Kansas, Artimus Pyle, and more, what a line up huh? Now speaking as one half of the Pit crew, i don’t normally do these kinds of events. It’s usually a hundred degrees and torture to me, so let me explain what makes it so different and worth the trip. One, you can camp there which is always a treat, water cooling stations were provided, the vip tent had table service, free water and ice coolers in every corner. The vendors supplied ribs, water, soda, and ice cream. There was shade, there was grass, and yes it was hot but it was not torture. It was a well planned and an enjoyable 2 days. The parking was organized and Rider Insurance sponsored an area just for motorcycles. Our hat’s off to all the staff that endured the heat all day to provide exceptional guest services. We also met a crew from a new radio station out of Nashville, who were running around doing interviews with the bands for Indie Rock 101, the Southern Voice, very cool people live streaming music to you. I’m sure we’ll see them at the Quick Chek Festival of Balloons on July 29-31, 2016. Just remember it goes on every year around the same time. Fast Lane Biker, which lane are you in?

Bikers are made up by all kinds of people. All share the love of riding their motorcycles, some like oriented events, some like breakfast runs and some love an old fashion “party all night” event. Personally, I like them all and I do greatly enjoy the “Gathering of the Tribes” which consists of lots of great people that ride and their common bond is religion. Once a year christian faith motorcycle clubs, freinds and family all get together to meet and put together the “Gathering of the “Tribes, which brings awareness about “Bikers Against Drug & Alcohol Abuse”. Funds raised from the event benefit the “Americas Keswick” in Whiting, NJ. This year it was held at a new location at the Burlington county fairgrounds . There were a variety of food trucks, vendors, a live band provided music, a cool bike show and much more. Many came out to support this event, so heres to good things at the new locations and god bless!

Yup, its mid July and its f#uckin hot!!! So what else would be almost as nice as a cool bike ride? How about some pics from cooler times... Every year, this is the big one that is highly anticipated by many, the annual Delaware county ABATE Toy Run For the Kids! In its 35th year, thousands of bikers attend and bring toys that are collected by the United States Marine Corps to help many local Philadelphia children have a merrier holiday. Tons of bikes line up on Columbus Avenue with many restaurants, vendors and local favorite radio station WMMR all come out to participate. At noon a seemingly endless procession of motorcycles all take a ride through Philadelphia and end up at the “Electric Factory” where toys are collected and music is provided by the band “Live At The Fillmore”. Recognition was given to those who organized this event and rightfully so. As motorcycles came and went throughout the day, its nice to know that bikers still do the right thing!

KNOW THE LAW I
had intended to devote this month’s article to the FBI Director’s decision not to indict Hillary Clinton for the email scandal however that article got trumped by the United States Supreme Court Decision of Birchfield v. North Dakota, which was decided on June 23, 2016. Birchfield basically turned the nation’s DUI laws upside down. It always amazes me how long Supreme Court decisions are when you can boil the guts of those decisions down to a few nuggets. That is equally true of Birchfield. In short, pretty much every state in the nation has a provision in it’s DUI laws whereby the offender must submit to a blood draw or face greater criminal DUI penalties. In other words, if a repeat DUI offender refuses a blood draw, the law automatically jumps him or her to the highest penalty level based on the presumption that the offender refused the test because he or she was already at the highest level. Those presumptive laws were eviscerated by Birchfield, which held that the State can no longer give DUI offenders an increased criminal penalty for refusing a blood draw. What does this mean at a practical level? First, if you are currently facing criminal penalties and the Police Officer read you the standard warnings prior to your consenting to the blood draw, the blood draw results will now be inadmissible as fruit of the poisonous tree. This will take Tier 2 and Tier 3 offenders down to a Tier 1 offense, which will make a huge difference when it comes to sentencing. Second, the Police can still have you submit to a breath test as part of the standard field sobriety tests. Third, the Police can ask you to submit to a blood draw however they cannot threaten you with any criminal penalties if you refuse. Third, you can still have your license suspended for refusing to consent to a blood draw as that is a civil penalty not a criminal penalty. Fourth and last, if you refuse a blood draw, the Police can detain you while they get a search warrant to draw your blood. The question then is in which cases will the Police take the extra time they will need to secure a search warrant to draw your blood as they will not have the time to do that in every case. Given that the current PennDOT penalty for refusing a blood draw is one additional year of a license suspension, the only people who will refuse a blood draw are most likely to be DUI Fast Lane Biker
BY ATTORNEY STEVE STAMBAUGH offenders who both have reason to believe that they will be a Tier 3 offender (the highest DUI offense category) and also have two or more prior DUI offenses within ten years. The reason I say this is that, in my opinion, there would be no reason to incur an extra year of license suspension for refusing a blood draw on a first DUI offense. The same is probably equally true of a second DUI offense. However, when you get to a third DUI offense and the mandatory minimum one year in State Prison for a third tier / third DUI offense, an additional year of a license suspension doesn’t start to look that bad. What this means is that the people that the state most needs to get off the road and into prison, treatment or both, are the ones most likely to refuse the blood draw, and the ones most likely to benefit from that refusal. The foregoing being said, every action begets a reaction and I anticipate a few reactions to this decision. First, we will start seeing more DUI checkpoints where the blood draw facility is on site and a Judge is on call to hear, decide and issue search warrants. Second, I suspect that law enforcement will ramp up the accuracy of field officers’ access to a person’s complete criminal history so that they can determine, in the field, the number of a person’s prior DUI offenses. If those records are up to date for the Officer in the field, s/he will be able to identify repeat offenders and thus will know to take the time to get a search warrant in those cases. Last, I suspect that the Legislature will enact increasing civil penalties for DUI offenders who refuse a blood draw, which will take the current one year forfeiture to new and much higher levels. Classes include antique, choppers, best exhaust, metric/sport, mild custom, touring, radical/wild, trikes/special interest, and peoples choice. All winners are invited to a year-end celebration and a grand prize winner is chosen. In addition to the bike show there will be punchboard and a jackpot machine will the opportunity to win cash prizes as will as concert tickets. Kids can play with Ronald McDonald. If you register before August 14, the fee is $20.00 per rider and $10.00 per passenger, afterwards it goes up to $25.00 per rider and $10.00 per passenger.
