So far, it’s been a mild winter in the North East with the exception of me just shoveling two feet of snow out of my driveway today. I’m hoping this February isn’t anything like last wintery February. But either way winter is almost over in the North East. By the time I type my next “Letter From the Publisher” next month it will be time for Daytona Beach Bike Week. It won’t be long before the first bike night or open house at your local dealer . WHO CARES COMMITTEE

30th ANNUAL ST. CHRIS TOY RUN December 13, 2015 • HICKSVILLE, ny

The motorcycle riders started arriving around 930am at the Sears parking lot for a kickstands up time at noon The WHO CARES COMMITTEE volunteers helped to register and collect from each rider a new unwrapped toy for the children of ST Christopher Residential Treatment Center in Glen Cove, NY.

The weather was unbelievable for this time of year - in recent years the weather was that of sub freezing temperatures, high winds, and a mixture of rain and snow. The recording breaking temperature of 68 degrees and sunny skies on Sunday brought out over 400 riders – well done BILLY! Santa and his elves were on hand giving a warm welcome and a candy cane to the assembled riders that came out to support this great annual event. The volunteers packed a full sized pickup truck with the collected toys – more than I recall in recent years. The Nassau County Police Department responded to the huge turnout by providing more than enough equipment and personnel to safely escort the riders to the destination. The start of the run took the riders out of the massive parking lot and onto public streets and as they joined other riders in the procession it seemed as though the line of riders would go on forever. I attempted to take a photo of each of the riders as they passed in review – check the photos to see if I was able to catch your ride. Archie from KIckstart Towing provided support should any of the riders break down on the journey. He told me later that it was a safe run and that no one had broken down. The WHO CARES COMMITTEE arranged for the after party at the VFW Post 3021 not far from the starting point. The riders were treated to a massive hot buffet of a turkey dinner and all the trimmings with beverages, coffee and dessert. There were drawings for a 50/50, raffles, and door prizes. Live entertainment was provided by a great band I had not heard before The Basement Boys, they were Fast Lane Biker

great. One of the riders even volunteered to sing a tune or two with the band, she did a great job. It was a bit of a surprise after all for me – of all the live entertainment shoots I’ve done I can’t recall a band with 2 drummers and drum sets as part of the kit. Catch them if they are in your area - they were great. Thanks to the WHO CARES COMMITTEE and all of the folks that contributed to make this event successful they really put the meaning of the season and support for the children above their own wants and needs. Thanks also go out to the riders for taking the time out of their day to provide a little cheer for the children of St Christopher’s. See you next year!! FEBRUARY, 2016

As always in true New York City fashion the event was packed from the time the doors opened till closing time . The New York City show is from what were told the flag ship ion the IMS shows. It comes to town just at the right time of the year. Every manufacture in the Country is gearing up for the new year and getting out he latest and greatest equipment parts and accessories ready for this show. All the products that will be on the market this up coming riding season. It’s one of those shows you don’t really want to miss. This year the International motorcycle had plans for a Philadelphia show and was originally on the schedule . Rumor has it they will have one for two thousand seventeen. See you there!

KNOW THE LAW T

his month’s and next month’s articles will address two provisions of Pennsylvania’s criminal law of justification in self defense, the Castle and Stand Your Ground Doctrines. Yes, Pennsylvania’s justification law has both, under 18 Pa.C.S. §505. Two recent “crimes” in South Central Pennsylvania call the separate provisions of §505 into question. I will address the Castle Doctrine in this article and the Stand Your Ground Doctrine in next month’s article. First, the facts of the two cases are gleaned from local newspaper articles so we all need to understand that the full facts will not be known until the cases go to Trial. That said, in the first case, a criminal breaks into homeowner’s home on Christmas morning with an assault rifle. Criminal orders family into bedroom. Father fights with criminal and wrests assault rifle from criminal. Criminal flees outside. Father follows and tracks the criminal who is now some distance from the house. Criminal sees father and starts to run away again. Father shoots criminal in the back with his own assault rifle. Criminal dies. You might say job well done. Lord knows I do. Unfortunately for father, cops charge father with homicide. Father is in jail awaiting Trial for murder. Not good. In the second case, high school boys prank homeowners by ringing doorbells in the middle of the night and running away. Pissed off homeowner gives chase as boys flee down alley. A good distance from his home, pissed off homeowner shoots at fleeing boys striking one of them in the foot. Pissed off homeowner is in jail awaiting Trial on myriad charges but, thank God, the boy Fast Lane Biker

BY ATTORNEY STEVE STAMBAUGH was only wounded. Pennsylvania Law has always required that a victim retreat if possible before using deadly force and/or force that could result in serious bodily harm. This is outrageous. Thanks to the National Rifle Association, although we still have a duty to retreat, we now have some exceptions to that duty. This is the first and most important point to remember - the duty to retreat still applies - we just now have exceptions. A man’s home is his Castle. That is finally the law. So, if someone breaks into your house, the law presumes that he/she is there to do you serious bodily harm. You don’t have to retreat in your own home. You can protect yourself. There are a bunch of exceptions to the Castle Doctrine. For example, you can’t shoot law enforcement people or folks under cloak of legal or government authority who enter your home. Another example is that you can’t shoot people who have a right to be in the house or their children or grandchildren. Also, you can’t shoot people if you yourself are engaged in a crime. You should read the law and apply common sense. Applying the Castle Doctrine to the above two cases we can see that both of the homeowners were well outside their home when they shot the perpetrators. As such, the Castle Doctrine arguably does not apply. So, if either homeowner has a defense under the law, it can only come from the Stand Your Ground exception, which I will address next month. The Modern Classics Motorcycle Show The Modern Classics show will celebrate its 6th year in 2016!
