Hello Everyone, and welcome to the September issue of FAST LANE BIKER. This Month starts out busy and continues too be all the way into October. Starting right after Labor Day with Wildwoods Roar to the Shore then heading down to Delmarva for Ocean City the following weekend will be in Seaside for the NJ State HOG Rally. Then from there the first weekend in October back down to Wildwood for the Race of Gentleman. It’s gonna be a long busy month But all these events wind up being a great time. The only downside to September is that the season is coming to an end for the year. Don’t get me wrong there is still going to be a lot of things going on. And there is still a least two months of good riding weather left. So till next time I hope to see you all at the September events.

Nothing like a early winter swap meet to get the mood for better riding coming soon. And one of the few that has been one to look for in early year is the Harley rendezvous swap meet, held at the Garden State Exhibition Center in Somerset, NJ for many years. Many come out to break the winter blues and check out what is at the swap meet, and as soon as you walk in and see, there are lots of goodies there for sure! Motorcycle parts, memorabilia, a cool bike show, live music too. If you where looking to get some ink you could have got that this year too. Plenty of stuff to do, no doubt! So next winter sometime around January, if you get cabin fever come on out and check out a New Jersey favorite.

Those who ride a motorcycle around x-mas time recognize the generosity of motorcyclists and motorcycle organizations and clubs. Without a doubt these riders rise to the occasion to make those less fortunate have at least a bit more cheer this time of year. The members of Northeast riders m/c are just that kind of club! They’ve organized the first toy run in 1985. That’s along time for this event (you do the math!). Also, keeping it at the first place as the original start point at Brian’s Harley Davidson, there’s no doubt and its easy to understand these guys have a lot of heart and are very passionate about this event. Many riders bundled up and came out to support this event as well. There is no cost on this run, additionally donuts are served before the ride, and hot coffee indeed is in order cause this time of year it can be cold and it was! They also ask that you bring a new toy which will be donated to Woods services (that serve people with special needs). Many a bike leave Brian’s Harley-Davidson and do a nice brisk ride through the woods complex to the much enjoyment of those living there. Once the ride is finished there’s an open invite to a free after party at the Tacony Club where the x-mas spirit continues. There was a good vibe at the end party with music, food with a true festive feel, knowing you made the holidays a little nicer making it a great ending to the day.

KNOW THE LAW BY ATTORNEY STEVE STAMBAUGH

T

his month I will address two provisions of Pennsylvania’s criminal law of justification in self defense, the Castle Doctrine and the Stand Your Ground Doctrine. Pennsylvania’s justification law has both, under 18 Pa.C.S. §505. Pennsylvania Law has always required that a victim retreat if possible before using deadly force and/or force that could result in serious bodily harm. So, if you were about to be mugged or assaulted, you had to retreat until you could retreat no longer! What was worse is that the duty to retreat followed you into your own home. That’s right. A guy breaks into your house with a gun and you had to retreat as much as you could before defending yourself. How upside down is/was that? Both laws not only flew in the face of common sense but also were exactly the opposite of what you probably thought about what the law would say on this topic. Anyway, thanks to the National Rifle Association, although we still have a duty to retreat, we have some exceptions to that duty. That point is worth repeating: the duty to retreat still applies - we just now have exceptions. The Castle Doctrine is far more likely to impact us in life because it applies to our homes. Everyone knows the old saying: A man’s home is his Castle. The Castle Doctrine enshrines that maxim into the law. The law now is, literally, that your home is your castle. What this means is that, if someone breaks into your house, the law presumes that he/she is there to kill you or do you serious bodily harm which means that you can immediately protect yourself by using deadly force. There are a bunch of exceptions to the Castle Doctrine. First and foremost, you can’t shoot law enforcement people. Second, you can’t shoot anyone who enters your home under cloak of legal / government SEPTEMBER, 2015

authority. So, if the mortgage people come into your home, you can’t shoot them. Same with the Township Code Inspector, Fire personnel, etc. Another example is that you can’t shoot people who have a right to be in the house or their children or grandchildren. Last, you can’t shoot people if you yourself are engaged in a crime. You should read the law and apply common sense. Just as a man’s home is his Castle, a man can now Stand His Ground and use force, including deadly force, but only if three conditions are met. First, you must have the right to be in the place where you are being attacked. Second, you must have a reasonable belief that the use of such force is immediately necessary to protect yourself against death, serious bodily injury, kidnaping or sexual intercourse by force or threat. Third and most importantly, the person against whom such force will be employed must display or otherwise use a firearm, a replica of a firearm, or any other weapon readily or apparently capable of lethal use. This third prong is critical, the person against whom you intend to use deadly force must have some type of a deadly weapon if you are outside of your home.
