Reflections Jesus could not have possibly given more to us than His Body and Blood. Jesus gives everything that He has to give by allowing Himself to be nailed to the cross. Through His sacrificial death Jesus cancels the debt of our sins and opens to us the new and everlasting covenant of His love. Jesus gives his life that we might have life and have it to the full.

The sacrificial death that Jesus endured for us upon the cross is perpetuated through the holy sacrifice of the Mass. When we participate in the Holy Eucharist, we take our place at Calvary at the foot of the cross, and we experience the greatest love the world has ever known.

What is more, we have the awesome privilege of receiving into our persons through Holy Communion the very Body and Blood, Soul and Divinity, of the Lord. Instituted by the Lord at the Last Supper in anticipation of his sacrificial death and glorious resurrection, the Holy Eucharist is our greatest treasure. She even widened the extent of her search to his relatives in the suburbs and in Manila but her efforts proved negative until a few months of search. She continued her search and even sought the assistance of the barangay police, to accompany her in her quest to find him as she loved him so much; that at the time of their marriage, they begot children namely: Christine Marris D. Calderon, who was born on October 26,1989 and Czarina Mae D. Calderon, who was born on February 4, 1993; Since her efforts were fruitless, she is now convince that something bad may have befell him and might not be located anymore; The petitioner now desires, after her helpless and hopeless futile efforts, that her absence and/or disappearance be declared presumptively, so that she can now start a new better life and new beginning.

13. The growing distance between them physically, meant the Plaintiff’s even more growing emotional distance with respect to her husband. She never longed for her husband to come home. All she cared for and nagged about was the shortage of money being sent to her by the Defendant; 14. Because of the situation between the Plaintiff and the Defendant’s parents and siblings, the former decided to move to her mother’s house in Bulacan. This was a very big issue that resulted in numerous quarrels not only between the Plaintiff and the Defendant, but also between the Plaintiff and her in laws; 15. On May 2000, after three (3) years in Taiwan, Ricky finally came home. The Plaintiff did not feel any excitement at the thought that they would be together in strengthening her marital vow with the Defendant. The Defendant had numerous attempts at making love with the Plaintiff, but the Plaintiff always found an excuse not to give in to the Defendant’s sexual advances, and never submitted to her husband’s need. Plaintiff was no longer interested and would rather sleep. She did not even want to kiss him or hold him. She never felt the urge of consummating such a marital privilege with the Defendant. She looked at him with rage and disgust, blaming him for her misfortunes and status in life; 16. Plaintiff was discontented and disappointed at what was happening to her family.

As a child growing up with issues of abandonment, she still could not let go of her emotional hang ups and excess baggage. She promised herself that she would never allow what happened between her parents to happen to her. But the Plaintiff disappointed herself when she married a man she never loved. When she married a man that could not provide her with the love, respect, comfort and attention that she so desperately needed and craved for. And the Plaintiff very well knew that no matter how much the Defendant tried, the latter will never be good enough for her; 17. During the time that she felt such discontent, the Plaintiff wanted more for herself and her only son. She applied for, and was processing her papers for Japan.

While waiting for her visa, the Plaintiff persuaded the Defendant to find a job, but the latter vehemently refused claiming that it was embarassing for him to work as a security guard again since he came from work abroad; 18. On October 17, 2000, the Plaintiff was able to go to Japan. This was the break she had been desperately waiting for in order to be as far away from the Defendant as possible. Although she was still sending financial support to the Defendant, she did not do it out of love or longing. After her first contract had expired, she immediately went back to Japan to work there again; 19. During the Plaintiff’s short vacation in the Philippines, she finally told the Defendant that she wanted to separate from him. The latter acceded to the Plaintiff’s desire to separate;

21. When the parties’ only son graduated from grade school, he decided to move to Baguio City and stay with the Defendant. When the Plaintiff talked to the Defendant about their son’s arrangements, the Defendant demanded that the Plaintiff send a monthly allowance for their son because the Defendant had no gainful employment.

22. After a week, the Plaintiff was shocked to get a call from her cousin, telling her that Richard (the parties’ son) called and wanted to be picked up from the Defendant’s house. Their son claimed that the Defendant hit him many times. From the time Plaintiff’s cousin picked up Richard from the Defendant’s house, the Plaintiff never spoke to or ever tried to communicate with her estranged husband. Up to the present, Richard is still under the custody of said cousin.

23. Plaintiff and Defendant have no common properties to submit for judicial disposition.

24. The Plaintiff now seeks the said of the Honorable Court so that after due hearing, the marriage she contracted with the Defendant be declared null and void pursuant to Article 36 of the Family Code of the Philippines and that the sole custody of their son Richard Macadangdang be awarded to the Plaintiff; PRA YER PRAYER WHEREFORE WHEREFORE, premises considered, it is most respectfully prayed of the Honorable Court that, after due notice and hearing, judgment be rendered in favor of the Plaintiff, and against the Defendant: 1. Declaring their marriage null and void from the beginning, in accordance with Article 36 of the Family Code, setting them free from the effects of the marital bond; 2. PETITION The PLAINTIFF, through the undersigned counsel, unto this Honorable Court, most respectfully states that:

1. Plaintiff and defendant met when both went to a drinking spree hosted by a common friend. The plaintiff was then a soft spoken high school student, while the defendant was unemployed and an out of school youth; 2. On or about the year 1990, due to their juvenile impulsiveness and aggressiveness, and without loving and knowing each other that well, they decided to elope and live together as husband and wife, without the benefit of marriage. The plaintiff was then a first year college student taking up junior secretarial; 3. On October 1990, Plaintiff discovered that she was pregnant and decided to stop studying in order for her to concentrate on raising the child that she was then carrying. The plaintiff and the defendant stayed with the defendant’s parents. The defendant was then working as a security guard; 4. Nine days before the plaintiff’s birth, and without giving any thought to the repercussions of their actions, Plaintiff and Defendant decided to get married on June 3, 1991 in Baguio City as evidenced by a machine copy of their Marriage Contract hereto attached as Annex “A”. Their only child, RICHARD CABALSE MACADANGDANG, was born on June 12, 1991 in Baguio City, a copy of his Birth Certificate is hereunto attached as Annex “B”.

5. It was not easy for the Plaintiff to stay with the defendant’s parents due to the latter’s patent disrespect for her. As such, the Plaintiff and the Defendant decided to live on their own, and rented a small room; 6. However, just like any union builit on shaky and uncertain foundation, the worse was bound to happen. In this case, it was sooner than later. When their child Richard was four (4) years old, the Plaintiff decided to leave the Defendant because the latter started to reveal his true self, which unfortunately carries a personality disorder, so grave that it prevented the Defendant from fully recognizing, appreciating and complying with the marital obligations required of him under the law; 7. Such personality disorder was, in fact, existing even prior to the celebration of the marriage of the Plaintiff and the Defendant and it manifestation became evident during the course of their union, like the Defendant’s protracted refusal to cooperate in the management of the family’s finances. During the time that the parties left the Defendant’s home, the Defendant was unemployed and was always out on drinking sprees with his friends, leaving the Plaintiff alone to care for their young son; 8. When the Plaintiff left the Defendant, the latter begged the former for another chance and promised her that he would find gainful employment in order to support his family. His pleas were heeded by the Plaintiff, but everything went for the worse as far as their relationship went; 9. In 1997, the Defendant decided to work as an OCW in Taiwan. Although the Plaintiff had qualms about the payment of a huge amount for the Defendant’s placement fees, the Plaintiff did her utmost best to raise the money the Defendant needed to go to Taiwan, hoping against hope that such move would mean the start of a better life for them. The Plaintiff even went to the extent of swallowing her pride and asking her family to help her raise the money; 10. Although the Defendant, was able to go to Taiwan, the Plaintiff had to sell fish balls, puto, and rice to augment their income because the Defendant did not send enough money to cover the increasing needs of their growing child. The shortage in money being sent by the Defendant necessitated the Plaintiff to ask for financial support from her sisters; 11. She continued her search and even sought the assistance of a barangay police, to accompany her in her quest to find him as she loved him so much, her untiring efforts proved futile and the surrounding provinces, Again she departed in Hongkong because of the untiring search she decided to file a Divorce in Hongkong in the District Court of the Hongkong Special Administrative Region under Matrimonial Causes No. FCMC10672/2002 and the same was Disolved in June 6, 2003; That at the time of their marriage, they begot no child; After an incessant fruitless search, she came to believe that something bad happened to him. The petitioner now desires, after her helpless and hopeless futile efforts, that his absence and/or disappearance be declared presumptively, so that she can now start a new for a better life and new beginning.
