How to buy property with someone else and share the expenses – and risk

Opting to go this route with a partner, friend or family member can be a good way to take that first step on the property ladder or start an investment. T

HERE ARE many benefits to co-ownership and, just like an individual bond application, parties entering into joint purchasing need to get their financial lives in order. If a problem is found with one applicant, the entire home loan application will be declined. Therefore, all parties will need to polish their financial profiles, says Leonard Kondowe, the Rawson Property Group finance manager. Financial readiness • Ditch the debt Debt is one of the first things banks

look at when it comes to assessing bond affordability. It doesn’t matter how many applicants there are – bad debt will count against you. To qualify for the largest bond at the best interest rate, Kondowe recommends getting rid of unnecessary store cards, credit cards and loan. If you can tighten your belts to pay off things like car loans, even better. “Ideally, you need as few expenses coming off your bank accounts each month as possible. This shows the bank that you have sufficient disposable income and

that each of you is serious about your financial health.” • Put your best foot forward Chances are, one person’s financial profile will be stronger than the other(s) on a joint home loan application. Whether that’s because of a higher income, better credit record or more stable employment, it makes sense to play up those strengths. “It’s smart to make the most attractive applicant the primary applicant on your joint home loan. Think of it as putting your best foot forward to give the banks a good first impression. “It’s not going to make up for any serious black marks on other applicants’ records, but can help boost your overall profile enough to encourage lenders to come to the table with their best offer,” he says. Get the legal stuff sorted Most joint buyers will usually get an attorney on board to draw up a detailed co-ownership contract before they apply for a home loan, says Carl Coetzee, the chief executive of BetterBond. But note that such a contract carries no weight with third parties like banks and municipalities. This does not mean that a professionally drafted contract is unnecessary. In fact, if you do not have one, it will automatically be presumed in law that each signatory has an equal share to the property, which might not be the case. And this is how the title deed will be registered at the Deeds Office. Know who pays for what There are several costs involved in buying a property beyond your basic bond repayments. These include one-off costs like your deposit, transfer and legal fees; and ongoing expenses like insurance, maintenance, rates and levies, says David Jacobs, the Gauteng regional sales manager for the Rawson Property Group. “It’s obviously very important to know how much you can each contribute to bond repayments, but you’ll also need to assign responsibility for the rest of the costs associated with your purchase and property ownership.”

Understand who owns what Most co-owners match their ownership proportion to the proportion of costs they cover. For example, if one partner commits to paying 70% of the expenses, that partner will usually receive a 70% share in the ownership. “Just remember, the default division of ownership on a shared property purchase is 50/50. If you want something different, this needs to be clearly specified in all the applicable documentation,” Jacobs says. Although the share of the property that is owned by each purchaser can be stipulated in the title deed and then registered at the Deeds Office, Coetzee says the banks will always want both or all parties to sign that they will be ‘jointly and severally’ liable to repay that loan. In their eyes, it’s a collective commitment. This means the bank is entitled to recover the debt from all the debtors, in proportion to their share. “Or, if necessary, the bank can recover the whole amount from any one of the signatories. “So, if one co-owner falls on hard times and stops paying for some reason, the others will have to make up the shortfall.” If the remaining owners don’t bridge the gap and the loan then falls into arrears, the bank can call up the debt and demand that all, or just one, of them settle the debt, at the risk of having the property repossessed. This is the same procedure followed by municipalities concerning rates, water and electricity accounts. Note who will be living on the property Whether joint owners will be living together in the home – as would be the case of romantic partners, or if it has been purchased as a rental investment property, Jacobs says this needs to be clearly stated in the co-purchasing agreement. “If only one of you will be living there, will that person pay rent for the privilege? Will this affect the division of costs like rates, levies, and maintenance? “If you’re planning to rent the property to a third party, you’ll also need to consider the responsibilities

of managing tenants and how you will split the rental income and/ or costs.” The possibility of financial problems Echoing Coetzee, Kondowe explains that if one party in a shared bond is unable to cover their portion of repayments, the lender wil hold the other bondholder or bondholders liable for the shortfall. “It’s always best to have a clear procedure for recovering these costs fairly, and handling any situation in which the other bondholders cannot cover the extra expense.” In this event, he recommends bringing the lender into the loop before resorting to desperate measures. “Banks are very understanding and willing to compromise to help bondholders through tough times.” Kondowe adds that bond insurance can protect against unforeseen financial challenges, covering bond repayments for the policy holder in the event of death, disability, loss of income or dread disease. Things to do when you need to sell It is vital for the co-ownership contract to spell out what will happen if co-owners go their separate ways, Coetzee says. “Problems can and do occur if one co-owner wants to sell but the others don’t or if, sadly, a co-owner dies. “There should be some sort of opt-out clause in the contract so that if someone wants or needs to sell their share, the remaining co-owners will have first option to buy.” He says the contract should also include the option of not buying out a partner’s share. It should stipulate that the whole property has to be sold and the proceeds divided according to the original shareholdings. Jacobs adds: “Don’t forget, you’ll also need to agree on the division of costs – compliance certificates, last-minute repairs and estate agent’s commission, as well as any profits from the sale.” It is also important for co-owners to each have a last will and testament, specifying what happens to their portion of the property investment in the event of their death, he says.

South Africans under pressure to sell their homes

NB’s most recent property barometer statistics reveal that in February, most sellers (21%) were giving up their homes in order to downscale due to age while 18% were selling due to financial stress. When looking at property price segments, the data shows that 28% of sellers of houses valued at R750 000 and less are downscaling to more affordable accommodation as a result of financial pressure. This is the only price segment in which financial pressure accounts for the most property sales, with selling/downscaling due to age leading the reasons across all other price segments. Interestingly, selling for the purposes of upgrading to bigger and better properties accounts for 15% of sales – the third most common reason for selling. While emigration-related sales account for only 9% of sales across the board, the sellers of more expensive homes, with 15% in the R2.6 million to R3.6m and R3.6mplus segments, are listing their homes for this reason. Gerhard Kotzé, the managing director of the RealNet estate agency group, says a quick survey of RealNet principals around South Africa has revealed that the main reasons for selling depend on the area, and also whether owners are selling their primary residences or secondary properties such as rental units and holiday homes. “In the latter case, the main reason for selling now is clearly financial pressure, with owners seeking either to free up cash or to cut their monthly expenses. “However, when it comes to primary residences, the main reason for selling, currently appears to be semigration, downscaling for the over-fifties, and consolidation of families.” He adds that he has not seen a predominance of sales yet due to financial pressure, although the number of homes being entered into the banks’ distressed sales programmes is rising – a “clear indication” that a big shift in the market is coming as interest rates continue to rise. “As for emigration, many of those who had plans to leave

South Africa appear to have put those on hold, and such sales account for a very small percentage of the total. What we are seeing, to an increasing extent, though, is the movement of families to secure estates, so that the breadwinner can work abroad on long contracts. “Highly skilled South Africans are increasingly head-hunted for well-paid positions in the Middle East and the rest of Africa, for example, where they may come home only a few times a year, and they want their families to enjoy safety and a good lifestyle while they are away.” Most semigration, Kotzé notes, is to the Western Cape from other parts of the country, with Cape Town, the Hermanus area, and Garden Route towns being the favourite destinations. In addition, family consolidation, which has increased since the pandemic and the forced separation of various family members due to lockdowns, is driving the sale of separate homes for parents, grandparents and grown children, and increasing

the demand for homes where two or more generations can easily be accommodated together. “These include family homes with ‘granny flats’ or cottages, and larger properties with multiple residences.” He notes too that plans to downscale are a “major sales driver” for many homeowners in their fifties and sixties, especially if they are empty-nesters tired of managing, maintaining and paying the rates, security and insurance costs on big family homes. “But once again, the main consideration for such sellers is often not financial, since they will often spend as much or more on their new homes.” Since the onset of Covid19 and the “huge reduction” in the interest rates, property sales and values have been “positively affected in the Western Cape”, says John Weston, the sales partner for Rawson Properties in Bergvliet, Constantia and Ou Kaap. Many property owners have taken advantage of the low interest rates and the opportunity to upgrade into better areas – often into sectional title complexes, for security reasons. Younger families are also selling, so they can buy higher-value properties in better areas closer to good schools. There has also been a “surge” in sellers emigrating now that other countries have reopened their borders, he says. In many instances, young families and their parents have been selling their homes, and then combining the profits to purchase dual-living accommodation. In his area, there are “very few” stressed sales happening, thanks to the banks having given many homeowners payment holidays. “This has encouraged good equity growth in property, particularly in the lower end of the market. Another factor for people selling their homes is that the banks have made it attractive

by offering good interest rates and often 100% to 105% bonds to assist particularly first-time buyers.” Weston adds that many people have sold their properties to buy bigger ones as they require workfrom-home space. “The huge reduction in travel costs, particularly where both parents work from home and previously travelled in two cars, allows for a larger bond repayment and more spacious living accommodation, without affecting bottom-line income.” Elsabe Lombard, the sales partner at Rawson Amanzimtoti and Scottburgh in KwaZulu-Natal, says most sellers are leaving the province, either to semigrate for work or emigrate. Those who are selling to stay in the area are downscaling, often to lock-up-and-go apartments. In Gauteng’s Waterkloof and Faerie Glen areas, Bertie Lombard, the franchisee for Rawson Properties there, says most people are selling to either downsize or retire. “On the flip side, younger people are selling their starter bachelor or two-bedroom units to buy bigger homes to accommodate growing families and in areas close to schools. The buyers are especially buying in estates for security reasons… A handful of our clients are selling to move to the Western Cape.” The main driving factor for buyers moving to coastal and country areas remains semigration, says Barbara Larney of RE/MAX Town and Country. “The most activity is seen at the coast (Gansbaai and surrounding areas), especially between the R2.5m and R5m price range. “Remote working and people wanting space, security, and an outdoor lifestyle is still a major trend. Buyers are looking for a quality lifestyle, but they are also looking for value because of the current global economic status.”

O Interest rate increases start to bite for commercial property market Business conditions less that satisfactory, given supply chain disruptions and the ripple effects of the war between Russia and Ukraine,among others

NLY the industrial property market’s activity rating is rising, according to FNB’s Commercial Property Broker Survey for Q2 2022. The percentage of broker respondents perceiving business conditions to be satisfactory, declined slightly in the survey, from 47% in the quarter before to 46%, says FNB commercial property economist John Loos. “This decline comes after a prior rising trend, remaining at a mediocre level. This reflects an economy battling to fully recover from the very deep recession of 2020 and, more recently, pressured by rising interest rates.” When asking brokers for their ratings of market activity levels, he says the group of respondents remain upbeat about the industrial and warehouse property markets. “Rising interest rates may have begun to dampen the spirits of the market. Prior to the Q2 survey, sales activity ratings had been on a rising trend in all three property classes following the easing of Covid-19 lockdowns. “We believe that this ‘normalisation’ from a Covid-19 point of view may have had a positive impact on the economy as well as property markets. But global supply chain disruptions had been contributing to building global inflationary pressures and, more recently, the war in Ukraine and resultant sanctions and boycotts on Russia, have further exacerbated the problem.” The result, Loos says, has been 1.25% interest rate hikes by the SARB since late-2021, with a further 1% expected this year. “Future broker surveys will give us insight about whether the events will dampen the commercial property market further but we would expect to see some weakening in the near term.”

KITCHENS and bathrooms have long been known to be the most important rooms in a home when it comes to selling, with experts advising that these areas be the first to be upgraded if renovations are being made before listing a property. When you consider that kitchens and bathrooms tend to be among the most expensive rooms to update, it is no wonder they sell homes. However, for those who do not have the budget to undertake an expensive remodel,

Re/Max of Southern Africa shares three tips on how to upgrade kitchens and bathrooms without breaking the bank: 1. Replace handles and taps A quick and easy way to make a room feel more modern or add character is to change cabinet handles. Handles of all shapes, colours and styles can be found at hardware stores and can cost less than R15 each. Although pricier to replace, a rusty or outdated tap can also make the room feel like it needs an upgrade. You could get away

with spending about R1 000 to R3 000 to replace taps, which can create a whole new look and feel to the room. 2. Paint the walls and/or cupboards Replacing kitchen cupboards or the bathroom cabinet can be costly. For a more affordable solution, purchase a high-grip primer and a high-quality paint designed for cabinets. Depending on the size of the room and how much you have to paint, you could spend R1 000 or more on paint and related supplies. A fresh coat of paint on the

walls can also work wonders at updating the space – just make sure that the paint is moisture resistant. 3. Upgrade the lighting An outdated light fitting and inadequate lighting can make a room feel dark and dated. Replacing a light fixture is a simple and affordable way to brighten up a space. Installing LED light strips underneath overhead kitchen cupboards is also an easy way to modernise the room. Try shopping around at thrift stores or outdoor markets.
