Can offers to purchase be enforced? Property professionals answer this and other relevant questions, including the pitfalls of buying a farm
Q: WE ARE thinking of buying a farm but are a little worried about any legal issues that may come about regarding land rights. What should we be aware of? A: Buying a farm is a lot more complex than a single house. Besides the usual checks and balances of an agreement of sale, buyers and sellers should proceed with extraordinary care when entering such contracts for farmland and working farms. There is a lot to consider when buying or selling a farm. We recently assisted in the purchase of a game farm and, following findings during our due-diligence process, we attached a four-page schedule of listed specific warranties that will apply to the successful transfer. Among the many examples are “basic” assurances that the seller is not a party to dispute with any neighbour or that there are no pending land claims registered to the property. Buyers should check if any servitudes apply and the farm’s water rights. Zoning rights and permits must be checked and investigation must be done to establish if the farm is under any environmental or heritage limitations.
Among the recurring disputes encountered is that farm workers’ rights of tenure are often overlooked and often not disclosed. So, you buy a farm with the intention to turn the staff houses into guest units, only to find the staff have a legal right to the property. Is there anything in particular to consider when choosing such a location? A: While rental properties in major metros may have their work cut out for them in 2022, demand in the so-called “Zoom towns” could well begin to outstrip supply in the coming year. We’ve seen an amazing aboutface in demand, thanks to Covid and working from home. Where metros were once thriving rental centres, we’re now seeing properties in small towns – particularly on the coast – flying off the metaphorical shelves. With commute times no longer an issue, people are clearly choosing quality of life over city proximity, and this is not expected to change soon, regardless of whether businesses return to some semblance of workplace normality in 2022. – Jacqui Savage, national rentals manager for the Rawson Property Group
Q: How enforceable is an offer to purchase?
Q: We are considering buying a holiday home, mainly for our personal use. However, we have been told that it may be a good idea to let it out for short-term stays. If we decide to do this, what should we know?
A: When a written offer is accepted and signed by the seller, it immediately becomes a legal contract, binding on both parties. This means that you cannot use such an offer as a way to “book” a property you like while you carry on looking. And you cannot simply “change your mind” about buying the property without the very real possibility of incurring a hefty financial penalty or having to pay a significant amount of money to get out of the contract. A: Owning a holiday let can be both personally and financially rewarding but it will only be profitable if you approach it like you would any other successful business. The first step is to do plenty of research and, once you have decided on your area and the type of property you want to buy, enlist the help of an established and reputable agency. These are the most important factors to take into account: • Potentially more volatile property values: Although some coastal regions are thriving
due to semigration, the values of properties in holiday locations are traditionally more volatile, booming in the good times and crashing when the markets are down. It’s important to buy in areas that don’t only rely on tourism but have a solid proportion of permanent residents. • Ensure you buy in a prime location: When selecting holiday investment properties, consider factors like beach views and proximity to shops and restaurants and other tourism hot spots. • Opt for self-contained: Holiday apartments purpose-built for short rentals with small hotel-style rooms may yield a higher rental return on purchase price in the short term, but a self-contained unit (or house) with larger rooms and a separate kitchen, bathroom and bedrooms, will generally give you better capital growth and be easier to sell down the line. • Do your sums: It is important that your sums allow for longer vacancy periods and fluctuating occupancy levels from season to season, as well as maintenance costs, which can be higher than normal with so many different people using the property. • Familiarise yourself with the legislation: Legislation regarding the rental sector and short-term lets has been tightened in recent years for both your, and your guests’, protection, so make sure you operate within these laws to avoid potentially costly and stressful pitfalls. • Consider professional management: This is especially important if you don’t live in the area because there is likely be a guest or an issue that needs your attention on a regular basis. The professionals will also have a thorough knowledge of all the relevant legalities. • Adequate cover: Ensure that you are adequately insured – with more people coming and going than in your own home, accidents and incidents are far more likely. Letter from the editor A YEAR ago, we featured a magnificent Fresnaye home in our Home Improver magazine. What attracted me to the home, and why we featured it, was its easy indoor/outdoor flow and feel, and it worked well for our summer-themed magazine. When I chatted to estate agent Lance Cohen recently he told me about a R160 million home he had just sold. We put two and two together and found it was the same house. It’s heartening to see luxury property still moving – and a home in Cape Town fetching such a high figure. During the worst of Covid, it was this market that suffered most, so seeing it reignite is a positive indicator for the sector. Of course, we live in a country of contrasts, and it would be remiss, as we feature mansions such as this, not to mention that, in spite of low interest rates, there are many who are unable to step on to the property ladder even at the lowest end of the market. For many, the luxury property market is aspirational – or merely a dream. A friend recently sold her mansion on the Atlantic Seaboard and there were many tears as she said goodbye to the idyllic life of beautiful ocean views, perfect weather and a home that had it all. She and her partner have moved to a small apartment in London (and not SW1) for work reasons, among others. As soon as the house sold, she started looking to buy a lock-up-and-go for holidays. It seems South Africans living abroad still want to have a piece of home and so they, including my friend, make up a big portion of those who are buying luxury homes to use for holidays. Whatever end of the market you’re at, happy buying!

market in South Africa has been thriving over the past year, with the tough economic conditions and Covidrelated financial stress apparently not affecting high-end buyers. The 10 most expensive homes in Cape Town alone fetched a combined R855 million last year. In fact, last year saw the country’s second and third-highest property sales ever, as well as the highest sale ever for a plot of land. The most expensive home in South Africa, in Cape Town’s Bantry Bay, was bought for R290m in 2016. Last year, Lance Cohen of Lance Real Estate sold an “incredible” home in Fresnaye, on the city’s Atlantic Seaboard, for R160m. This sale was the second-highest ever plus the most expensive home sold last year. The property – described as a “magnificent five-bedroom home that offers pristine, uninterrupted views of the Atlantic Ocean and whose back yard is essentially Lion’s Head” – was not even on the market when an offer to purchase was made. Cohen also sold last year’s second-highest property – and third-highest ever. The “exquisite” five-bedroom, five-bathroom home
in Bantry Bay, sold for R125m. It, too, was purchased following an unsolicited offer. In addition, he says his R55m sale of a plot in Fresnaye last year was the country’s most expensive sale ever of a plot of land. Property sales of R97.5m and R80m – both in Cape Town’s Clifton – appear to be the third and fourthhighest sales of last year. These sales, agents say, are indicative of the high level of activity that has been seen in the luxury property market over the past year. Although he can’t divulge the buyers’ nationalities for privacy reasons, Cohen says high-end South African properties are being snapped up by “a fair balance” of local buyers and foreigners from countries such as Germany and Sweden, as well as other African countries. “Some of these properties are used as holiday homes, especially during our summer, or are rented out.” At the moment, there is a lot of interest at this end of the market. “We are in a market that, although improving, is still a buyer’s market... Just as the low end of the market has been very active, so has the high end. This is due to the value of the rand and the fact that property prices in South Africa during Covid

dropped while, in many other countries, they climbed.” Further evidence of luxury buyer activity is the fact that the Seeff Property Group made 12 significant sales of properties above R20m last year. These homes are on the Atlantic Seaboard and in Plettenberg Bay, Bishopscourt and Constantia, says chairperson Samuel Seeff. “We also provided the buyer for a R62.5m sale in Franschhoek.” In addition to this massive sale, the group sold a Plettenberg Bay home for R60m. “This was a new record price for the area and the property sold twice within six months, first to a South African expat in May for R55m and then again for R60m to a local buyer as a second home. “It is a spectacular beach house in a prime location in Beachy Head Drive, one of the top addresses in the country.” Seeff says the group’s high-end sales included: • A R52m home in Camps Bay’s Theresa Avenue, sold to a South African expat who lives in the UK, for use as a second home and then as a retirement property. • A R45m home at the V&A Waterfront – a 509m² penthouse with

a pool and exceptional views, sold to a German buyer as a holiday home. • A R40m home in Head Road, Fresnaye, sold to a German buyer as a residence. While last year was a “great year for property”, Seeff says the story of the year was the significant uptick in the R20m-plus sector and sales to foreign buyers which are at their highest levels in over three years. “The luxury sector and trophy home sales, in particular, have enjoyed an excellent year, with a notable uptick in high-value sales, predominantly on the Atlantic Seaboard and in Plettenberg Bay.” He says the country’s affluent areas, such as Sandton and Pretoria East, and luxury estates around the Johannesburg and Pretoria metros, have performed excellently in the R5m to R15m sector with a few sales at the high end. “In the Durban area, Umhlanga has performed extremely well, as has Ballito and Zimbali, although predominantly in the R5m to R8m price bands.” Echoing this, Andrew Golding, chief executive of the Pam Golding Property Group, says much of the demand for luxury homes is driven by local buyers who have identified specific areas of interest and understand that the current market, “characterised generally by motivated sellers and well-priced stock”, presents opportunities which offer exceptional value for money. “Apart from local purchasers in Cape Town’s sought-after, conveniently located southern suburbs, the buoyant Constantia high-end market has been mainly driven by buyers from Gauteng and KwaZulu-Natal. “We’ve also seen a notable increase in demand for properties listed above R10m on the Cape’s globally renowned Atlantic Seaboard,” Golding says. Last month, the group made its highest sale for the year – and what appears to be the country’s fourthhighest for last year – an R80m property in Clifton with direct access to the beach. The South African buyer plans to repurpose the multiunit dwelling into a family home. Nick Gaertner, director and chief operating officer at Knight Frank, says there was a “strong resurgence” of luxury property buying in the last quarter of 2021, and an even stronger start to this year. “This suggests high-valued properties will perform strongly this year,” he says.

Paying a premium for luxury

OUTH AFRICA’S favourable exchange rate, natural beauty and good weather make it desirable for foreign property buyers looking to live, holiday or retire in luxury. Even though their euros, pounds or Swedish krona could buy them beautiful properties in their home countries, the opulence South Africa’s luxury properties offer, in addition to the climate and scenery in our high-end suburbs, makes buying here an easy choice. Contrary to public perception, though, says Nick Gaertner, director and chief operating officer at Knight Frank, 90% of buyers of luxury homes in Cape Town, Franschhoek and Stellenbosch are locals. The main demographic of buyers are people in their 40s and 50s with children at school and university. Samuel Seeff, chairperson of the Seeff Property Group, agrees: “Although there has been a massive uptick in sales to foreign buyers over the past year, about 80% of luxury homes have been bought by South African buyers. “On the Atlantic Seaboard in Cape Town, sales above R20 million were made predominantly to local buyers, but also to wealthy buyers from
Johannesburg, KZN and other inland areas.” Whether local or foreign, luxury-home buyers want prime locations and views, and are prepared to pay a premium for them, says Ross Levin, licensee for Seeff Atlantic Seaboard and City Bowl. “This trend is echoed in the high demand for estate homes and relatively high prices paid, not just in Cape Town, but also the estates on the KwaZulu-Natal North Coast, such as Zimbali.” He says some of the latest trends in luxury home design include integration with nature and features that maximise a property’s location. Home automation, green features including water storage, grey-water systems and solar heating are among the standout features in many of these homes. “Private lifts for multi-storey homes, generous use of glass to ensure maximum views and spectacular indoor/outdoor flow to maximise South Africa’s lifestyle are also luxury features, as are wine cellars, gyms, yoga studios, multi-car garages and even car-wash bays.” Rory O’Hagan, chief executive of Chas Everitt International’s Luxury Property division, says luxury buyers are looking for l Continued on next page...

what is referred to as “whole life” homes, where everything they need – from wellness and sports facilities to various types of entertainment spaces for different members of the family and full-on business facilities – is literally on the same property. Lifestyle is the major driver of these luxury property purchases, he says. “Homes incorporating gyms, yoga studios, 10-pin bowling alleys, home cinemas, luxury car display facilities, hair salons and work-from-home facilities, including boardrooms and executive office space, are trending. “Additional demands include more extensive on-site staff accommodation, smart technologies and water, power and internet back-up systems.” Some of the outstanding features seen in luxury properties recently, or currently, on the market include private nightclubs, home health spas, and multiple vehicle garages which double up as large entertainment spaces, complete with catering kitchens. O’Hagan adds that affluent individuals are searching for different lifestyles post-Covid, and want to be able to live an “abundant and full” life, even if lockdown had to occur again. In addition, Gaertner says, luxury buyers consider the lifestyle offered by the neighbourhood and surrounding areas, security, privacy from neighbours, and proximity to schools. The emphasis is on properties that offer a combination of outdoor and
work-from-home spaces. “The pandemic has shifted people’s mindsets slightly to be more conscious of what luxury homes offer in terms of being able to live freely in the home, without feeling cramped for space, and also being able to have a separate office that does not take away from the feeling of ‘home’.” South Africa’s high-end properties offer such features in
abundance and at a price that foreign buyers love. Although the equivalent value in their currencies could still get them beautiful homes in their own countries, the style and quality of design of South Africa’s luxury properties, combined with breath-taking views, prime locations and standout features, puts our luxury properties slightly higher on the opulence list.

Ways of living in retirement How to thrive in your old age is a conundrum increasingly exercising the minds of baby boomers, Gen Xers and even millennials BY VIVIEN HORLER
M
ANY baby boomers – born between 1946 and 1964 and now roughly between 57 and 75 years old – have already retired. Gen Xers – born between 1965 and 1980 and aged from 41 to 56 – realise that retirement is coming – fast – and wonder if their plans and savings will see them through. And millennials – born between 1981 and 1995 and aged between 26 and 40 – are beginning to take the prospect of retirement seriously. A lot of it is about money – financial experts say you need to be saving for at least 25 years to fund your retirement, and it is the first 15 years of your working life, roughly from 22 to 37, that are crucial, because it’s your oldest savings that compound interest works its magic on. But it’s not all about money. There are also a number of lifestyles to choose from to give you the best chance of happy and fulfilled golden years. Property 360 look at some of them.
Remaining at home This option sees seniors choosing to stay on in the home they have lived in for years. They are familiar with their surroundings, don’t want to go to a retirement village or move in with children – they want to remain independent for as long as possible. As people get older and increasingly frail, they will have to pay for more help, so will need cleaning services, caregivers, meals and transport. Modifications might need to be made to the home, such as a wheelchair ramp, grab bars in the bathroom and a medical alert system. In cases where people live in a double-storey home, they might need to install a stair-lift, which is an expensive option, or adapt a downstairs room to become a new bedroom. And, of course, the normal home maintenance will need to continue. This could be a lonely option, as life partners die and friends visit less frequently as they stop driving.
Retirement villages These frequently offer different modes of living – younger and fitter people can live independently but, as they need more help, can move into an assisted living component of the complex. And if people become unable to live alone, they can move into frail care. A set-up like this works well for couples who might be ageing at different rates, meaning the frailer of the pair can be cared for by professionals while the fitter partner can remain in their own home but can easily visit. The advantages of these villages are that they are usually in attractive settings with communal gardens and joint facilities such as a swimming pool, tennis courts or even a golf course. There is plenty of company because residents can socialise with each other and those who run the villages arrange activities from book clubs to bridge as well as outings.
People can eat in their own homes or dine communally, and they don’t have to worry about daily chores and property maintenance. Security is usually prioritised The homes themselves are invariably convenient and compact. The disadvantage of retirement villages are that they are in relatively short supply in South Africa and tend to be expensive because of the facilities and services on offer. There two distinct funding models. One sees the pensioner buying their home in the village, and having full title to that home. When they die, their estate will inherit the home, be able to sell it and take advantage of capital appreciation. The other way, which is becoming increasingly popular in South Africa, is a life rights scheme. These schemes tend to be more cost effective for people with less capital. The retiree is not buying the home, he or she is buying a right to use the property for the rest of their lives. The catch is that the home remains the property of the developer, and on the death of the retiree, the developer can then “sell” the unit to a new resident at current prices. Usually the deceased estate will get some or all of the original payment but without any, or very little, capital appreciation. One way of looking at life rights is that it is as if the retiree is renting the property but paying all the rent upfront. Because buying into a life rights scheme does not involve actual transfer of property, no bond registration or transfer
fees are payable. The developer, as owner of the property, is responsible for all maintenance, but retirees do have to pay a levy in addition to their initial payment. Multi-generational living This is an option for many families. It enables the older relatives and the younger ones to share costs, chores and even child-care. It means elderly parents have company and younger family members have support. However, it can generate tensions – who is the boss of the family? Will the seniors be taken advantage of? The success of this option could be improved by having the different generations in separate homes, such as a main house and a granny flat or cottage. This would mean that the different generations are more independent, don’t live in the same space but are within easy reach of each other for company and help. It is important to arrange the finances and property ownership in such a way that should either party want to withdraw from the arrangement, no one is left disadvantaged. Home-sharing Think of The Golden Girls TV programme. Home-sharing is not just for students. Advantages include live-in company and sharing interests, costs and chores. But, as with multigenerational living, it is vital that the set-up is arranged in such a way that should tensions arise, people can leave without losing out on capital. A legal contract is probably sensible.

ODAY’S retirees are faced with a number of options for their senior living years, but the only one really worth considering is a continuing care retirement community (CCRC). This, says Barry Kaganson, chief executive of Auria Senior Living, is the most modern and comprehensive living option for seniors. CCRCs are communities that offer a full continuum of senior care – ranging from independent living to assisted living, memory care and frail care, within one environment that ensures independence and quality of life. And, inspired by global best practice, Auria develops, owns and manages a portfolio of CCRCs in South Africa. The traditional concept of a “retirement village” or “old-age home”, Kaganson says, is not appealing to today’s older adults. “Modern senior living communities are attractive places where older adults – retired or not – can still enjoy an unrestricted quality of life, in an engaging environment with hospitality and lifestyle services, which is supportive of their changing needs.” The advantage of a CCRC is residents can move in as fully independent and can enjoy all the lifestyle amenities and extensive activities on offer. Such communities, he adds, offer life enhancements for older adults on a daily basis. “They offer the opportunity to connect with other residents, staff and even volunteers. Group activities, such as clubs, outings and socials promote much-needed social interaction and opportunities to exercise.” Recent years have seen a growth in the trend towards relocating to places which offer a more relaxed lifestyle and many parts of the Western
Cape are proving attractive to people at all stages of life looking to semigrate. With this in mind, Auria recently acquired Woodside Village in Rondebosch and has embarked on an extensive upgrade and redevelopment process to bring it in line with the quality of other communities in the group’s portfolio.
