Banners and/or buttons are to be produced by the advertiser and all arising costs are at the advertiser’s expense. All files should be supplied in the specified format, otherwise ITEBE may levy relevant technical charges to the advertiser. 2. Gifs should be sent by email at the same time as the order or in time to meet the required publication date. 3. The advert is published under the sole responsibility of the advertiser. ITEBE reserves the right to refuse, at any time, an insertion which according to its nature, the text or the presentation, is contrary to the spirit, the ethic and the moral interest of ITEBE. 4. ITEBE will notify the advertiser once the banner is in place. 5. ITEBE reserves the right to cancel any outstanding services due where payment for rendered services has not been made at the right time. 6. In the case of the website, orders may be stopped or cancelled at any time and services rendered will be charged for in accordance with clause 10 below. 7. Payment is to be made by cheque, to be made out to ITEBE and to be sent to the following address: ITEBE, 28 boulevard Gambetta BP 149, 39004 LONS LE SAUNIER Cedex, France. 8. ITEBE invoices are to be paid on receipt of invoice. 9. In accordance with the set legal precedent, ITEBE disclaims all responsibility for the noticeable omissions or mistakes, in spite of the care take by ITEBE. ITEBE bears no responsibility for the content of texts, photos or brands used by the advertiser. 10. If for any reason, the web advert does not appear for the full duration of the ordered period, then the charge will be levied on a pro-rata daily basis against the number of days the service was implemented. Under such circumstances, there is no compensation of any kind due for loss of service. 11. In the case of dispute and specifically regarding the provisions and the terms & conditions stated herein and/or in any referenced documents, only the French texts shall refer (available from the website). Disputes arising between the advertiser and ITEBE that cannot be settled otherwise will be brought exclusively to the Court in Lons le Saunier, France where the applicable law is French law.
