From Jennie’s Desk Welcome to the readers of this next issue of Connexions Business Magazine. As this year comes to its shortest day in the southern hemisphere I reflect on the past twelve months. This time last year I was in Europe, when I started to become quite unwell. It has taken me a year to wake up to being well and alive again and ready to commence my life and move my business forward. As a result of Wealth Dynamics and Jim Rohn’s teachings, I was able to recognise where I was in the terms of me and my business. I went into my own personal ‘winter’ on returning from Europe at the end of June and started my own personal struggle. My business was working well which continued until the end of the year, owing to good planning, thanks again to the teachings of Jim Rohn. I had started planning my 2014 at the end of October (which I always do each year) and had everything ready to rock ‘n roll, or so I thought. Unfortunately, my business by January was in its own winter too, with me personally still being there. It has taken me, with lots of help, a full year to bring both myself and my business back to happening and being able to see spring emerge … what a lesson it has been and I am forever grateful for the learnings which have helped me get through the past twelve months, without beating myself up. I let it happen in its own time and now can say, I am really back and ready to move forward. The year gave me so much knowledge on myself as where I stand as both a woman and a business person. It was not easy feeling that I had lots the plot totally, but as I emerge in from my winter’s cocoon, I see and understand that I needed to learn to grow. I want to say a special thank you to Tam Ho and Tanja Caprioli for their support as co- facilitators for my mastermind groups, to Margaret Wilmink who has been my meeter and greeter at most of my events this year and Terri Cooper who has been there with good sound business advice when I have needed it. The support you have all given me has made the coming through my ‘winter’ so much easier. I hope you all enjoy the collections of articles that are being presented to you in this issue. I am grateful to the authors who willingly share their content. They are personally picked to support you and your business grow. Until next issue, take care ….

Decluttering and Its Advantages by Jennie Gorman

Is it time for you to do some clearing out? Decluttering can be the most fulfilling exercise you can have …. If you are like me, you probably need support to stay in order. After having spent some considerable time in the past cleaning up a family member’s home after their death, I became aware that we all need to do this on a regular basis to keep everything in some order! When someone dies there often are many years of ‘things’ that were memories or interests that often didn’t get used for the original purpose of keeping. What a wonderful lesson for me to make sure that I do my best to never do that to my children!

I have a business office as well as a home office. I am only too aware of how you leave jobs that need to be done and find your office has got out of order. This is when you need to get some help. Jobs take longer when there is a mess around. Get someone, maybe a Virtual Assistant, to help you with things that can be helped with virtually, and someone local to help support you to set up a good and workable filing system, arrange your books, fix your stationery cupboard, make sure you have a place for your audio collection, an area for all your computer equipment and parts, and all

6

Connexions Business Mag

those miscellaneous things around your office. Wherever your office is, I suggest that you start with your office desk … this can be a hard one, especially if you are like me and like to have things around you when you work. Keep your desk as clear as possible. All the computer cords and attachments can be stored under your desk on a screen for easy access …. Voila, a clean desk! How you place things that are being worked on will be dependant on your sensory style. As I am very visual, I need to be able to see where things are that I am working on. If they are out of sight, they are out of mind to me. So, is this you too? When your desk is clear, then it is your filing cabinet that needs to be looked at. This needs to be cleaned out every year or so. What was wanted when collected some time ago is not necessarily needed now! Remember to keep your taxation information separate and easily accessible away from your office for five years. Make sure that your files are clearly marked too so that you can find things easily! Your book cases need clearing too …. Sort out the books you don’t want and either sell or give away. They become dust collectors sitting on a shelf and never looked at. If you have an area for hobbies this is another that can get out of hand too …. I know this one as I don’t get to my hobbies as often as I would like. There are many people who help others who need to declutter their lives and offices. It may not be your office but a clothes cupboard, a room or your whole house. But, please, don’t leave it to someone else to clean up after you have departed this world!!

Staying Positive When Things Get You Down by Zig Ziglar

You get back what you send out. I am a very “up” person, and people frequently ask me how I maintain my enthusiasm. I do several things, including reading an average of three hours each day for the past 26 years. One of the fun things I do is to give people my special greeting. Whether it’s eight o’clock in the morning or eight o’clock at night, I always try to greet others before they have a chance to speak to me. My greeting is always the same, whether I’m in Auckland, New Zealand, or Augusta, Maine. I use an enthusiastic “good morning!” Interestingly enough, 85% of those who respond will respond by saying “good morning” — even if it’s eight o’clock at night. Many of them cut it short before they finish the word morning, and then say, “It’s not morning!” And I respond, “Then, why did you say ‘good morning’?” They tell me it’s because I said “good morning.” Are you making an unforgettable impression on everyone you meet? The point I make is significant. If you go out in life looking for friends, they’re hard to find; but if you go out in life to be a friend, you will find them everywhere. What you send out is exactly what you get back. You send out a “good morning,” and in most cases you’ll get back a “good morning.” Send out a cheerful, positive greeting, and most of the time you will get back a cheerful, positive greeting. It’s also true that if you send out a negative greeting, you will, in most cases, get back a negative greeting. I encourage you to make this positive approach to life a way of life. It’ll definitely make things interesting! Staying focused on what’s important through the ups and downs Very frequently I’m asked to give my definition of success. Here is one of my responses: I believe success is getting a reasonable number of the things money will buy and all of the things that money won’t buy. (People who say they’re not interested in money will lie about other things, too!)

I confess that I like the things money will buy. I like to live in a nice house, drive a nice car, wear nice clothes, belong to the country club, play on beautiful golf courses, travel to nice places, take my family out for relaxing dinners. I like all of those things, but I love the things that money won’t buy. Money will buy me that house, but not a home. It’ll buy me a companion, but not a friend. It will buy me pleasure, but not happiness. Money will buy me a bed, but not a good night’s sleep. It will buy me a good time, but not peace of mind. I’m grateful for the fact that I have many of the things money will buy and all of the things that money won’t buy. I know many other people who can make the same statement. I mention that only to say that these things are available and, by following the right procedures, playing by the rules of the game, and dealing with all phases of your life, you can have them all. That’s exciting! Improve your character, relationships, and work ethic, and wealth will come. Subscribe © 2014 Nightingale-Conant Corporation

Thoughts on TRACTION by Tam Ho

A few weeks ago in my MasterMind Group I talked of the moment when all our thoughts and planning comes easily to life through ACTION. When you have finally escaped procrastination habit, you notice you commit to more ACTION... this is where you start crossing off more “to-do” items off your daily list. Make no mistake this is a huge achievement in itself but it is only the beginning. ACTION can be a lot of wasted effort and time. We recognised this as busy-ness during our day but not really progressing or being productive. We become more productive when we achieve and maintain TR+ACTION. Doing the wrong ACTION we rev up our energy but seem to stay in the same spot... this is working without TRACTION... like trying to drive on ice. We try hard but burn out because we slipping around- we are simply doing the wrong type of ACTION. To get anywhere, we need TRACTION. Good TRACTION occurs when we start to VALUE OUR TIME (It has taken me over 6 months to only begin to understand this). Out of the

10

Connexions Business Mag

hundreds of tasks we do every day, we start to become selective of the few tasks we know that will makes us move forward. Real quality action.. While I have not yet 100% identified what these actions are- I know these actions for me occur when I start working ON my business... It’s time I allocate to sitting down and work on strategic planning. The required actions coming out of these session are usually the quality ACTIONS I need to do gain TRACTION. With enough TRACTION we will inevitability move towards gaining AT+TRACTION. Another topic for another day. I hope you have enjoyed it. I am only paraphrasing my understanding of Roger Hamilton’s work.

Did you make this mistake when investing? by Daimien Patterson

Like with everything in life, it can be easy to make one little mistake in property investing, and have it all grind to a halt (and cost you lots of money to fix. This mistake in particular is made every year by thousands of property investors, and most of them never realise where they went wrong. But you won’t be one of them, because I’m going to tell you what it is before it’s too late. Here’s what it is: when they went to purchase a property, they took out another mortgage with the same bank. No, Surely Not… At this point, you might be thinking… what? Isn’t that a good thing? Shouldn’t I show loyalty to the bank who has served me so well with the previous property(ies) I own? And won’t it be simpler to set up because they already have all my information? My answer is: no. Getting a loan for a second property with your bank is the least simple thing you can do for your growing portfolio. In fact, you will create a wealth of complications. Here’s why… Structure I have written about this in the past, but what I recommend is you avoid cross collateralisation

12

Connexions Business Mag

(I’ll talk more about this in a second). Do this by taking your available equity in your first property out, and using it for the deposit and costs on your second property. The remainder of your second property should be covered by a loan from a separate bank. Why You Should Avoid the Same Bank If you go to Bank “A” and ask for the money for your next property they will welcome you with open arms. But they will not structure it in the best way for your future portfolio as I outlined above. Instead, they will offer you a loan for 100% of the purchase price and all of the costs. So in our example they may lend you $350,000 plus the $25,000 costs, or a total of $375,000. And then what they will do is what they call “cross - collateralise” your two properties together. What that basically means is that if you default on the mortgage on one property, they can sell both of them to get their money back! Now that’s not a good situation to be in if one of those properties is your home. Furthermore, and this is the most important thing to note, they will keep cross collateralising your properties until you get to about four. Then they will STOP lending you money! This is because at about that point you become too risky to them. If you fall over in one day, they lose four mortgages in that day.

Worse still, the other banks won’t be interested in you either, because you are over exposed to the first bank. The best policy is to simply only use one lender for each property. There are approximately 150 lenders in Australia, so you can have 150 properties before you run out of lenders and you have to go back to the first one again! Daimien, It’s Too Late…What Do I Do? If you already have investment properties and did not structure your finance properly with multiple banks, then you’re going to have a problem. If you want to own a decent sized portfolio (we’re talking about more than four properties here!), you’ll need to fix the problem. At this point, you need to talk to some experts who can advise you on your individual situation, but what you can expect is to invest some time and money in restructuring your portfolio with different banks. However, it’s not the end of the world.

Remember your end goals and why you got into property investing, and what you can achieve through it. Getting out of your mess will be a learning experience, and it will be well worth it in the end! If you’d like to chat more about what options you have, give my office a call on 1300 372 677. I offer personal 90 min Property Investment Coaching Sessions and/or Portfolio Reviews. Eliminate the Hassles of Life by Stacey Huish

Suffering is optional! Stop suffering, tolerating and hoping. There’s a huge addiction in our culture among entrepreneurs that’s rarely recognized. It’s the addiction to adrenaline. Adrenaline is a source of energy. It’s not the healthiest source of energy, and yet people will do anything to get it. Adrenaline is a habit that creates an unhealthy lifestyle.

day. Now I’m clear about my real talents and draw genuine energy from within. I have time to stop and think and gained a love for my discipline of not running on adrenaline.”

Here are some symptoms of adrenaline: • Rushing around and juggling as many projects as possible all at once. • Speeding in your car. • Always looking at the clock. • Filing up your gas tank on empty. • Coffee • Sugar • Messy desk with piles everywhere. • Never saying “no” to projects. • Over promising your results. Adrenaline addiction runs rampant among entrepreneurs because the common belief holds that adrenaline equals success. Gordon Bahary, president of Electric Kingdom Records used to run his life on adrenaline. “I used to create situations that developed adrenaline. I would drink coffee, eat sugar, get hyped, angry and excited more than was necessary. I planned my execution of tasks in an erratic fashion just to get the adrenaline rush. I was dependent upon something external pushing me and used adrenaline to get through my

By eliminating adrenaline you naturally attract success, reduce stress, integrate all aspects of your life, simplify, and reorient around what makes you the happiest. An interesting happening in China by Tove Vine

One day in spring I had an interesting experience walking home from school. I was walking along the canal which was absolutely filthy; imagine the most polluted water possible then double it. This canal was across the road from where I lived. I walked along that canal to get to the school. I suddenly heard screaming and shouting behind me. I looked to see what was happening and saw a man running across the road toward me followed by police officers and about half a dozen security guards. I realised the man had done something wrong. As the man was looking behind him at the officers, he didn’t see me and ran straight into me—not hard; he just brushed me. As I was alongside the canal I wondered where he would go. He then jumped over the railing and the filthy canal! I screamed out, “Oh no!” and ran over to the railing to look and there he was half walking, half swimming across the canal to the other side! It seemed as if the canal was not as deep as I had thought, and the filthy water only came up to his chest. A lot of people had gathered along the railing and they started to throw stones in the canal toward the man. I guess he thought he could get to safety on the other side but alas the police had obviously alerted the law enforcement on the other side of the

16

canal (there are many police officers and security guards around all the time), and a few came running toward the canal on the other side where many people had also gathered. In fact, he could not have climbed out on the other side, as it was a straight wall. He started to swim toward a drain where the water ran into the canal (who knows what comes through that drain; I dare not guess) and he crawled into the drain like a water rat. I stood and watched for about ten minutes. It was interesting to witness such an event. Nothing else happened and so I walked home thinking about this. All the other teachers were so envious. Betty said it wasn’t fair as she had been in Guangzhou for five years and had never seen anything exciting like that! Tove in China Making a difference. Is your networking building your business by Jennie Gorman

As a business person I know you know how important networking is for the growth of your business. So I ask you, is your networking building your business? Many people who attend networking events, enjoy the experience but don’t attract more clients and/or increase their business profits. They don’t even build a new relationship. Do not expect just because someone likes what you offer, that they will be keen to catch up for a coffee. They may exchanges business cards with you BUT nothing usually comes of it. This in NOT their fault!! It is because they are not sure why they went to the event in the beginning or what outcomes they wanted to receive as a result of attending. They enjoyed what they got, but wasted their time, money and energy as they had not set an outcome prior to attending. Unfortunately, I see this happening at most networking events I attend. If this happens to you, consider what you did or didn’t do to make this a reality! Why wait for the other person to make contact? If you liked them and thought you had synergy, make the contact yourself. If you want to have a good relationship with someone, you need to put in too! Maybe the other person is unaware of what follow up is necessary after an event. So, I ask you these few questions.

Why did you go to the event? Did you plan and have a goal prior to attending? What did you do at the event? What follow up did you do afterwards? If you want to turn your networking into profits you need to create the relationship with the person. They may not even be aware of the potential of knowing you. Most people don’t do business after a first time meeting. If you exchanged business cards, and made contact within a few days of the actual meeting via email, social media or a phone call, you can then follow them up to arrange to get together to learn more about what they are needing help with for their business! It is all up to you. Do not wait for others to make the first move if you want to go further with any business building. If you want to form a genuine relationship, you need to put in firstly. Most people networking are not aware of what they need to do after the event so they miss out on not only supporting someone else but helping themselves too.

Five Skills Necessary to run Start-Ups and Small Businesses by Alex Faubel

A great idea does not guarantee success. This is learned the hard way by many in the world of entrepreneurship. An idea may seem great on paper but it comes down to execution. Execution is one of the biggest competitive advantages that start-ups tend to overlook. To effectively execute an idea and run a successful start-up there are a number of skills that are necessary. We’ll cover five of the most important ones. 1. Communication All entrepreneurs must be able to communicate proficiently. In modern times especially, communication takes many forms: emails/ blogs for written form, presentations, networking, vocal (via phone), and visual (designs, diagrams, infographics). While it is not necessary to be “world class” at all of these, a solid competence is required. An entrepreneur that is unable to communicate ideas or issues sharply and concisely, give a good presentation, or close a sale successfully will not get very far. 2. Networking While networking may be considered more of an activity, it’s still a very important part of running a start- up or small business. There are varying levels of skill among entrepreneurs when it comes to networking and not everyone gets the same amount of value out of a meet-up.

20

Connexions Business Mag

Networking abilities can be improved over time, as the skills take practice and a persistent deliberate approach. Projecting confidence and engaging with people goes a long way. To work with high-level clients you should know how they think, speak, and make decisions.

3. Financial Control/Management When it comes to running a start-up, money isn’t always available in abundance. As a matter of fact, bootstrapping is often a part of the game. Overall, managing money effectively is a necessity. Keeping cash flow positive is one of the major responsibilities of someone running a small business. There may be times when you have to cope with low cash flow so smart management of money is a key skill in addition to the ability to raise money from investors and other sources.

4. Recruitment Recruitment is a crucial part of management. The ability to recognize not only talented people but those with the right work ethic, and then convince them to be a part of your business, is a considerable skill for entrepreneurs. This is not something that can simply be outsourced or delegated in the early stages of a start-up or small business. 5. Versatility Start-ups and small businesses are typically constrained when it comes to resources. This means that those in charge usually have to juggle multiple roles and tasks. These tasks may cross the fields of finance, marketing, operations, and customer service. In the early stages of a start-up, the owner’s ability to play multiple roles is often a determinant of whether the company will sink or float. There will come times when it will be best to lessen the juggling and hire the appropriate experts to help. Until

then, learn how to identify, analyze, and rank priorities. Successfully running small business or a start-up company can involve great challenges and taxing work. With the aforementioned skills however, the chances of success are greater, since execution is key in bringing an idea to life. Communication, networking, financial management, recruitment, and versatility are part of entrepreneurial life, especially in the early stages of a start-up. Alex Faubel enjoys writing about topics related to business and technology in career-focused education programs.

Welcoming Opportunities by Debra Jarvis

Now the office is in order it’s time to cast your eye around your home and apply the following principles. I reckon you’ll see major improvements in your business. Our home is our Castle; it is the foundation for everything else that we do. When we are making do, putting up with in our home, then that is the premise by which the rest of our life also operates. When our home nourishes and provides an enjoyable sanctuary then our other life experiences also reflect this. Here are a few suggestions to get you started on increasing the beneficial flow of Chi (good Feng Shui energy) in your home. Entrances are considered to be the most important area in a building as they are where we welcome opportunity in. What is the first thing you see? An overgrown garden, rubbish bins, a garage full of junk or a welcoming garden, a smart letterbox with a clearly visible number and or an enticing door? In a home the second most important area is the bedroom as it is the first place we see in the morning upon waking and the last before we go to sleep. What do you see when you wake up? Ensure it uplifts you! Do you feel good about where you sleep? Invest in sheets that you love! Is there stuff under the bed? Ideally Chi flows freely under the bed and there is access from both sides. (i.e. The bed is not up against the wall.) Where the eye goes, Chi flows. When cupboards, sheds and other areas are full of stuff that we rarely use and struggle to locate when required, then the energy flow is blocked. Those items you are keeping because; they might came in handy or were left over from a

job, or worse remind you of a project that has less than excellent memories, feelings and associations are holding your business back from reaching its full potential. Inevitably when you are stuck, frustrated, things are not going your way the reason is because there are things and/or people in your life creating resentment, that consciously or unconsciously are adversely impacting you, inhibiting your ability to move forward and to be, do and have anything and everything you have ever desired or wanted in your life.

Sort through your belongings and consider these questions: • Do I love this item or am I holding onto it out of GUILT and OBLIGATION? • Is it useful to me now? If not, but it is useful to someone now, give it to them! • Does it reflect who I am now in my life? Who I am choosing to become? or is it a reflection of where I have come from?… do I want that energy in my life? • Does it act as an environmental affirmation for me? What positive and/or negative thoughts, memories, or emotions do I have? • Does it need to be fixed or repaired, (28 days) and am I willing to do so now? Items that are in a state that is less than excellent negatively impact on our life experience within 28 days, conversely when we implement Feng Shui we expect a positive result within 28 days even if it seems co-incidental. • If I moved tomorrow, would I choose to take it with me? If it is time to let it go, am I going to dump, sell, lend or give it away and how, when and who to?

Boosting your way to Business Success!

Business Success Demands a Plan... No one in their ‘right mind’ would Plan to fail and yet many in small business simply overlook the Power of Planning …

That’s right, it’s not the Plan that matters, it is the Planning! Ponder this for a moment if you will ... according to an Australian Bureau of Statistics survey, only 18% of Australian businesses have a formal written business plan. That figure on its own is revealing enough. When you compare it to the fact that less than 20% of business survive past the first five years ... you can start to understand that formal planning can have an enormous impact on the future of your business. Many business owners make the leap from employee to owner without a clear understanding of the rigours of managing a business. Almost all of them want to experience greater ‘freedom’ from their business and yet they find themselves spending less time with their family and earning less per hour than they really deserve. As a business owner or operator you will ensure that all the technical requirements of your customers are met but how effectively do you manage your business?

For your business to be a profitable investment for you and the stakeholders, you need to plan for it to be able to work without you ... otherwise all you have is a job! So how do you go about creating a ‘business that works without you’? Effective business management relies on an understanding of the three major systems of business. These are the: Planning Systems, Doing Systems and Monitoring Systems. The colours are significant as they represent: Blue for “Blue Sky” thinking; Green for the colour of “go” (all planning and no action results in nothing more than a good plan); and Red to indicate that you need to “stop” at regular intervals to monitor the performance of your business.

Planning Systems

These are those plans and processes you use to regularly determine the actions you are to take to achieve your business objectives. These objectives should be created to meet your lifestyle objectives and you need to be clear as to what they are. This is often referred to as “Working ON your business!” When asked, most business owners are willing to “work ON their business” the only challenge is that often they have no idea where to start. The expression that best describes this situation is, “You don’t know what you don’t know!” This is where a Business Coach could be an advantageous to the development of your plans for the future of your business. You need to find someone with lots of business and coaching experience, a proven planning and business development system and a structured process of time to work with you to train you to undertake a planning program.

Doing Systems

These are those everyday parts of your business. The way you implement the plans you created in the Planning phase; the way you service your clients; how you invoice; the way you answer the phone; and everything you do in your business. Freedom comes from the process of having documented systems in your business. Documented Systems are therefore the key to freedom. It is this critical factor that most in small business ignore or miss altogether. Knowledge, commitment and determination are needed to address this important part of effective business management.

Monitoring Systems

These include the accounting and performance reporting systems in your business. Accounting reporting is often driven by your taxation reporting obligations as determined by your Accountant. Effective monitoring is about those activities or performances that result in your financial performance. Key Performance Indicators (KPIs) are those 6 to 10 key measures of your business that ensure you know your business is on track to its goals. The two important words here are “performance” and “goals”. The goals are the ones set in the Planning phase and it is the Performance you measure here, not the eventual result. Remember:

What you measure you manage … and what you manage improves. Are you looking for success in managing your business? This success will be determined by how well you budget and monitor your KPIs. Profitability and the business model by Steve Major

Andy Grove of Intel fame is famous for his quote and subsequent book title that “only the paranoid survive”. He went on to explain the importance of understanding how your industry is changing and being willing to embrace change. Only by being paranoid about how business is changing will you survive and thrive.

It is not only a matter of increasing scale and efficiency.

Often though it is very hard to look outside the current way of doing business and realise that the dynamics of the industry are changing. The other trap is that some of the people in the industry realise it is changing but still focus internally only.

But real change comes from thinking about the business model. Real changes come from understanding what is really valuable to the customer and determining how to provide a more effective solution.

It is why so often in many different industries the real change has been generated from somebody outside the regular players in the industry. Too often, regular players just become extremely focused on reducing costs so that they can continue to make a profit. This is particularly the case in a market where the product has fast become a commodity. But remember in a commodity business you cannot be smarter than your dumbest competitor. Then people start focusing on those dumb competitors who they forget are going to be around until they run out of capital and then probably be replaced with somebody else who is just as dumb.

The buggy whips manufacturers were at their peak efficiency the day they went out of business. Efficiency works for a while. Remember the old market saying - the market will stay irrational longer than you can stay solvent.

It all starts with what is of value to the customer. This is not always easy to answer and often the customer themselves struggles to answer it. As Henry Ford is famous for saying “if I asked people what they wanted they would have said a faster horse”. We need to understand what is happening in the lives and businesses of our customers and where the product sits in their lives (or businesses). An effective solution will win over an efficient solution any day of the week. So stop focusing on the dumb competitors and start focusing on the customer.

International Travel What hurdles do I need to jump through? by Kym-Marie Bush

International travel is a fairly straight forward thing to do these days – decide where you are going, when, book a ticket and travel. Maybe. For those in family law disputes, it’s not that straightforward. Sometimes a parent won’t agree to your travel plans or there is an Airport Watchlist Order in place. Sometimes a parent won’t sign the passport application. What then?

For a parent looking to travel overseas, turn your mind to the likes of the following: • where am I going to – what is the travel warning for this country; • when am I going – are the travel plans going to impact upon arrangements for the child to see the other parent; • how long am I going for; • will the travel affect the relationship between the child and the other parent; • what are the contact arrangements whilst I am away. When a court considers whether it will allow a child to travel overseas, it’s overriding concern is whether the travel is in the child’s best interests. Whether the country being travelled to is a Hague Convention country is also a significant factor. The Hague Convention, to which Australia is a signatory, sets out principles for international relocation/return of children. The countries that are signed to this Convention have a system in place which recognizes the country of habitual residence of the child. Where the country is not a party to the Hague Convention, the court might order that a surety

28

Connexions Business Mag

be paid – this is an amount which is designed to be forfeited if the travelling parent does not return. A recent case of Raycliff & Nilssen (No.2) [2013] FCCA 1810 required the mother post a $25,000 as she was travelling to a nonConvention country.

Other factors to weigh up are: • what will the impact be upon the relationship between the child and non-travelling parent – what is the relationship now, how long is the travel, how will that impact; • what are the bona fides of the parents – is this a genuine trip from which the child will receive some benefit such as a holiday or connection to the language, cuisine and culture of the heritage of their parent; • are there any threats to the welfare of the child at the proposed destination – what is the infrastructure, are there threats of terrorism and are they likely to be acted upon; • will the promise to return be honoured; • what are travelling parent’s ties to Australia – do they own their own property, are they an Australian citizen, what is their work; • what are the motives not to return. In the earlier hearings involved in the matter of Raycliff the court had been required to look at the cultural aspects, education and financial situation of the parents, age difference (30 yrs), unilateral relocation of the mother and the nature of household as well as how settled each parent was in the Australian culture as they were both immigrants. Together with this was the understanding of language, communication and domestic violence.

All of these factors have a place in determining whether or not travel should occur, where parties cannot agree. Ordinarily, a passport can only be issued where the persons having parental responsibility for the child consent to the travel or there is an order of the Court allowing such travel. The Australian Passports Act 2005 sets this out. If a parent refuses to sign documentation, the Court can authorize the other parent to sign in their place. Where grandparents have the care of the child, the Court may order the grandparent to sign in the parent’s place. Added to this, there has been issue in the past which has resulted in Court proceedings, an (Airport) Watchlist Order may have been issued. This Order notifies customs and immigration that there is a ban on the child travelling out of the country. You could find yourself stuck at the international airport and the child is not allowed to travel with you. If you are concerned about the existence of an order there is an Family Law Watchlist Enquiry Form which can be lodged with the Australian Federal Police.

The Watchlist Order can be lifted or suspended where there is an order of the Court or both parties agree. To remove the child’s name from the list, there must be a Court order. It is helpful, where you have been involved in litigation in the past, to check over the Orders to see whether there is a Watchlist Order in place. If there is, you won’t be able to exit the country without first addressing this issue. So, before you travel, remember to obtain the approval of the other party to not only the travel but also the issue of the passport for the child and that there is no Watchlist Order in place. If there are objections to your travel, you can file an Application with the Federal Circuit Court of Australia, outlining the above factors. Each case is considered on its own merit. Be prepared to provide a surety if you are travelling to a nonConvention country and to provide details of your travel, contact number while your away and flight itinerary.

Quick check list on ….

Are you being the leader of your life? by Josie Thomson

Answer these questions:

• What does being a leader mean to you? • How do you lead? How do you want to lead? • How can you begin to take greater command of your life? • Are you ‘creating your life’ or reacting to events and letting life or others lead you? • Who do you lead? Who looks up to you and looks for guidance and support? What are you modelling for them? • Are you ‘leading by example?’ If you want to become the leader of your life, I will show you how in my powerful one-day workshop in September where you will learn the 7 simple steps to put you securely in the ‘drivers seat’ of your life – to be your own leader.

Here is an overview of the 7 steps:

Step 1: Know Who You Are – the foundation. When you know who you are and what you stand for, making decisions is easy! You will walk out of this day with clarity, certainty and a clear map for making the ‘right’ decisions to create a happier life – maybe even for the first time! Step 2: Know What You Want - This step usually involves shifting focus from what you ‘don’t want’ to what you ‘do’ want. A significant piece of neuroscience is covered which gives understanding about how to rewire your brain for more adaptive thinking and habits. Step 3: Know It’s Possible – There can be a big gap between wanting something and actually believing you can have it i.e. thoughts about worthiness, fear or allowing. We create a window of possibility for a new life, a new beginning. This

30

includes being alert to the risks of old thinking, and creating a pathway for mindset shifts with practical techniques to manage those risks, and an introduction to Dr Jeffrey M Schwartz’s work: You Are Not Your Brain (Deceptive Brain Messages) and my F.E.A.R. model Step 4: Pave The Way – Time to shed the old thoughts, habits and beliefs that have held you back or prevented you from living your best life. Introduction to mindfulness with other highly practical tools and tips to pave a new way of creating, living and experiencing life. Step 5: Prioritising You – Now we make the most of the mental/emotional/physical resources you can access – we look at effective strategies for supporting what you need to sustain your new life reality. Step 6: Show Up and Take Action – How to step up and deliver on your desires and promises to yourself. Helps to assign a deep level of commitment to following through and valuing yourself enough to do it, and keep it going with taking personal responsibility and spirited action. Act – get into it and do things differently, implement the plan with confidence and if it takes a couple of shots, learn from it, be grateful for the learning and keep moving. Step 7: Attitude of Gratitude - a new beginning. Recognising and appreciating the opportunities to learn. Grow and develop and strengthen ourselves for future work and service. The benefits of gratitude are still being measured but what we know so far is that this is powerful. Powerful in results neurologically, physically, emotionally, psychologically. Make it a habit. Copyright and Facebook by Geoff Moller MBA FAIM, Trademarks and IP.

Copyright infringement is continuing to raise its ugly head and become quite frustrating when your competitor on Facebook thinks the wording on your Facebook page is better than theirs, and decides to ‘borrow’ it or most of it for their Facebook business page. In this article I’m going to cover an overview of the problem plus offer some useful links you can use. Copyright infringement is using another person’s material without their consent or proper citation and can seriously damage a website’s or Facebook page’s reputation.

Here are some great tools for hunting down copyrighted material.

Facebook and the other major social media platforms take Trademark and Copyright infringement of your material quite seriously but first you have to determine the exact reason why you believe someone may have infringed upon your copyrighted material and be able to prove that you are the original creator. Submitting a claim of copyright infringement is a fairly straight forward process but don’t be tempted to lodge a false claim or a claim you can’t prove as that can backfire on you.

Copyscape (www.copyscape.com) can help you check if content is unique and original and to monitor the web regularly for plagiarism.

If you feel you can prove that someone has taken and used your material without your consent the first action would be to contact the other party and ask them to remove the offending material. The next would be to take action via Facebook, the third would be legal action (letter first). Before you go too far you’ll need to have a clear idea of the outcome you want to achieve e.g. remove the offending text, or financial compensation etc. If it’s to remove the offending text some simple processes can be done via Facebook’s own internal system which can work. Here are some useful links to Facebook information on Copyright infringement: How do I report a claim of copyright infringement? Click HERE What happens after I submit a claim of copyright infringement to Facebook? Click HERE

Among others services Grammarly (www.grammarly.com) can help avoid, or find, plagiarism by checking texts against over 8 billion web pages.

Other Tips to help protect your material: Add a copyright notice to your Facebook business pages in the ‘About’ section at the bottom e.g. © Your Name 2014. Have a copyright notice on your website and don’t forget to add one on each article you write for your blog posts or as a guest blogger elsewhere. Australian Copyright Council (http://copyright. org.au/) has some good information relating to copyright in Australia. Keep creating, I believe the world benefits from original and inspiring material. Geoff Moller MBA FAIM is a management consultant specialising in IP Strategies, Trademarks and business mentoring. In Australia the Sydney-Hobart ocean yacht race is a Boxing Day classic. Yachting on Sydney Harbour is an exhilarating and challenging experience for young and old. Yachtsmen and women catch each wind change. They change course to move towards their destination with as much speed as possible. Solo skippers and teams compete fiercely in open water. Prominent landmarks and new technology guide each crew. This week Wild Oats XI the super maxi yacht won line honours for the seventh time. Think how lessons from this race can help create a climate in your school, business or organisation so that sustained achievement innovation and experimentation is encouraged, supported and implemented. Entrepreneurs live it now!

# Invest in the best equipment you can afford. Great teams deserve great equipment to allow them to do their jobs. Buying cheap products or cutting corners rarely pays off. Quality pays again and again! # Update the weather forecasts. Trend spotting is as vital as weather forecasting. It opens the door to growth, expansion, turnaround or acceleration. Reading emerging markets, social and technological trends can save and make money. It can make progress possible. # Give total physical and emotional commitment.Winning the wholehearted commitment of staff involves telling a story worthy of your organisation.Catch people’s imagination. # Plan and change your plans. Be flexible as conditions change on the journey. Rework strategies. Set new targets. Try different things. Change direction to take opportunities. # Celebrate success, completion, best practice.

# Prepare thoroughly for this year’s race. Yachts men and women spend weeks preparing for their journey from Sydney to Hobart. They check their equipment, weather forecasts, and supplies. Thorough preparation is important for each person. Having that you need to hand inspires confidence. It leads to high performance. # Know the crews strengths and limitations. A wise leader or manager knows their people as a farmer knows each animal by name and behaviour. They utilize strengths and accept the limitations of skill or temperament. Drawing out the best is as beautiful to watch as a flower opening in time lapse photography or a sports person’s strike or stride in super slow motion.

Written Testimonials Michael Donoghue says:

I joined a Mastermind group to be with like-minded people which has allowed me to tap into the power and wisdom of the people in the group. It has since assisted me in obtaining both my personal and professional goals. This is a big difference to building and shaping a business by myself. I suppose in some ways, it is harnessing the power of we instead of me. The mastermind group lead by our mentor and facilitator Jennie Gorman has given me access to a unique brains trust to help generate support and understanding, and ultimately solutions. Jennie Gorman is a real professional and certainly knows how to leverage upon: each person’s skills, experience, ideas and abilities of others. Jennie definitely helps creat a synergy within the group, and a compilation of thoughts which would otherwise, possibly never be generated. Another important ingredient of the Mastermind Group calls for being accountable. There can be no excuses not to get things done, as you are not only accountable to yourself, but to other group members as well. In the group, as in life, you must learn to give and sharing allows you to process things better and in return as a group, we really care about each other and get to know each other on a different level. The more you give out, the more you get back in return.

Why is your Personal Image such an Important Business Tool? by Ann Whitaker

Often when we are preparing for an important presentation we think about the content, the pitch delivery, what tools we are going to use, the quality of our handouts, but do we actually pay enough attention to what we are going to wear? Within 10 seconds of first meeting, a customer will have formed an initial impression of you and your capabilities 55% of that first impression is based on appearance, 38% is based on the tone and inflection of your voice and only 7% of a first impression is based on the actual content of what you say. A poor first impression is very hard to overcome and elevate, whereas an initial good impression is much harder to lose. Since 55% of that first impression is appearance based, making sure you “look the part” is vital. Firstly think about whether your appearance is appropriate for the audience and the location. You need to be sympathetic to your audience and their corporate expectations whilst still looking professional. So what can you do to ensure that you make a good first impression at your next business meeting? • Decide on your outfit, right down to the shoes and accessories; make sure the outfit is in your top colours since wearing the wrong colours will make you look drained, tired, drab and boring. • Try on your complete outfit a couple of days before and give it a trial run for the presentation. o Can you move easily in? Does the skirt (or trousers) ride up? o Does the outfit crease badly, so you look unkempt by the time you arrive? Is your blouse business appropriate? o Or it is too low-cut or too see-though? • Is the outfit clean and pressed and are your shoes clean? There is nothing worse than mentally planning your outfit, then taking it out on the morning of the presentation only to find that it is marked or torn.

• Be aware of your “entrails” the items that are not immediately visible but might be seen by another. These “entrails” say a lot about the person you really are: o Pens. Is your pen a chewed biro? Does it have slogans or logos or sparkles on it? Or does it look professional, a simple classic pen is the best option. o Phone cases. Is your mobile phone’s cover business appropriate? Or should it remain strictly in your personal life? o Wallets/Purses. Are you carrying a battered surf wallet, overflowing with old receipts and lottery tickets? Or does your wallet indicate that you are responsible and can be trusted with money o Handbags. Is your handbag business appropriate? Or is it too glitzy, too casual or stuffed to overflowing? o Keys. Is your key chain professional and minimalistic? Or does it have cuddly toys, family photos, sports club or video club tags? Or are you carrying 1001 keys around with you like a jailor? The little things can make or break your Business Image, think carefully about the way you present yourself on a daily basis and always aim for sleek, classy and business like.

With a little planning appearance can be a significant business tool, for more information on how you can make the best possible first impression contact Ann Whitaker from House of Colour & Image on ann@annwhitaker.com.au
